Huge losses here, continuing what we saw on tuesday. Thats one driving factor. The status of that trade agreement such that there is one. Only thing theyve agreed to is to keep talking over this 90day period. Investors are following the arrest of the cfo company, she was arrested in canada at the behest of the united states. Qualc qualcomm does business around the world but not in the united states. Its predicated on the fact that theres good faith, personal agreement and personal relationship between president xi and President Trump. This is important as it relates to the Bigger Picture with donald trump and trade. Reporter it points to potential increasing tensions between these two countries as they try to come to agreement over a trade deal. I dont have to tell you, because you were there, but the two leaders came away basically with an agreement to keep talking and to hold off on new tariffs until they could get a broader deal on a whole range of different topics, everything from intellectual property to trade barriers and tariff barriers. A lot of difficult issues to work through and theres not a whole lot of confidence that theyll be able to do that. One of the concerns, if you talk to economists, is that the markets have been responding to that uncertainty, to the fact that its not clear what each side has agreed to and its not even clear what the timeline looks like. The president saying look, its 90 days and the clock started once we had that dinner and that dinner wrapped. Robert mueller recommended no prison time for michael flynn, sources are telling our team that prosecutors in virginia are still pursuing charges for lobbying work that flynn did in washington. He helped mueller with three investigations, one into russia meddling, the second its description blacked out and the third is an investigation where the nature of the investigation is completely blacked out, you can see. Do we know whether this virginia investigation was part of any of that reactive memo stuff from Robert Mueller or can we not make that connection yet . It appears that way. We dont know for sure. Got it. This investigation is continuing at the same time that flynn is youve seen his sentencing document which references his lobbying work in turkey in 2016. And so it kind of the fact that this investigation is continuing offers us clues about potentially the breadth of flynns investigation, what he talked to prosecutors about. Its significant because he has already talked about, or dealt with, or been his work on this issue has really sort of been out there. I know no overt steps to interfere with mr. Mueller, nor should there be, to impede his investigation. Mr. Mueller is moving along now at a very rapid pace. Were going to know more. If somebody did something wrong, punish them for the rest of their natural life if its appropriate. Prosecute them. He seems to be moving quickly now. Im happy with that. Lets get this thing wrapped up. Senator kennedy is making the point, things are moving. Whats your expectation for what well see over the next 24 hours . Mueller looks like he has taken on a new phase in this operation. Under doj policy, there was this slowdown period for about 60 days ahead of the midterm elections but now three key defendants are moving forward and at least so far because theres a lot more to come this week, the most interesting details weve picked up have come from that flynn sentencing memo, which tells us there are at least two additional investigations that we havent been focused on that are in progress. One likely this plot to kidnap a turkish cleric on u. S. Soil. Ned, what do you make of it . Look, i think this investigation is moving into high gear. I think its moving into high gear in a public fashion. As joyce mentioned we had the flynn sentencing that told us this is an Expansive Network of investigations, perhaps even overlapping investigations. We know about the russia investigation. There may well be a separate investigation into obstruction of justice. The special counsels office is handling. The speculation now, as joyce mentioned, is that theres a separate investigation into this cleric. What carol was just talking about. Exactly. And well hear more about manafort, his socalled crimes and lies and whether there are crimes and lies that pertain just to him or whether there are crimes and lies that implicate President Trump. I suspect what we see on friday will be confined just to paul manafo trchlt. Mueller has been playing his cards close to the vest when he releases information. Related to this double jeopardy case for the Supreme Court. Hearing arguments about possible exceptions to that double swrepd rule. Of course, that allows federal and state prosecutions for the same crime or doesnt. Where do you think the court goes on this . Talk about president ial power as it relates to Paul Manafort. The Supreme Court is hearing could rend usunder this longstanding rule, double jeopardy, that you cant be tried twice for the same crime. In other words the federal government cant try you twice but you could be tried by the federal government and then a state government. A president ial pardon might, for all time, tie the hands of prosecutors for federal and state for retrying someone here receives a pardon on other charges. Theres a piece out of the wire talking about what Robert Mueller might know. A list of these 14 questions that are out there in the russia investigation and why the special counsel might be two steps ahead of everybody else. Two of these questions stand out to you, right . Thats right. Why is mueller charging Michael Cohen and was the guardian correct in reporting that the Paul Manafort met with jowlian assange . Thats such a question in my mind. We know in august that he was transferred out of Mueller Office into the Southern District of new york. If the crime was just lying to congress, that could, of course, be charged by the d. C. District attorney. Mueller seems to find some connection between trumps business dealings in russia and his core mandate. That is to say russias interference in our election in 2016. You have lawmakers who want to try to protect Robert Mueller and the investigation. Jeff flake said he would block all these nominees. He is continuing to be the thorn in Mitch Mcconnells side. Why wouldnt Mitch Mcconnell say fine, vote on it . I think were going to see if that happens. But what donald trump is dealing with here is the fact that an emboldened congress in the new year, democrats take over the house and it will be much harder for republicans, you know, to curtail the investigation. Right. It seems like the simplest thing for congress to pass this bill, protecting Robert Mueller. If President Trump isnt actually going to do this, why not pass the bill . It wont change anything. One is that it would be an unmistakable rebuke of the president. For sure. Republican controlled senate signaling that they do not trust the president to not obstruct the investigation and do something drastic and second there are some legitimate constitutional concerns here about whether this would surrender some of the authorities of the executive branch, whether there would be a conflict between the two branches of government. This morning a senate show of force against the Trump Administration on the issue of saudi arabia, with members of congress from both sides of the aisle overnight releasing a resolution to target Saudi Crown PrinceMohammed Bin Salman. They write that the senate, quote, has a high level of confidence that Mohammed Bin Salman was complicit in the murder of journalist Jamal Khashoggi urging the International Community to hold all parties, including mbs, in the murder of Jamal Khashoggi responsible. Saudi lobbyists paid for 500 rooms at the trump hotel in the 2016 election. This Bipartisan Group has come together to basically slap back at the Trump Administration on saud saudi. This might end up being the goldilocks option for senators to find a way to push back against saudi arabia, the crown prince but dont necessarily want to go as far as this other resolution. The first vote had been held on it last week, calling for the u. S. To essentially get out of the business of helping the saudis in yemen. This bill focuses more tightly on khashoggi and mbs perceived involvement in that. It talks about yemen and qatar and the other misdeeds in the middle east it doesnt go as far as to describe anything for the u. S. To do in those situations. The cia director on the hill earlier this week. While she only briefed a small group of senators and no one is talking about the specifics of what was said in this closed do door, classified meeting, it is clear that senators have been talking among themselves. Despite the fact that there was only a small group in that room, there is now agreement that the crown prince at least was aware of this, if not directly responsible for it. Here is some of what senators have been saying this morning about this. I dont see how there can be any doubt that mbs was directly involved. Were not going to find an email saying dont forget the bone saw, but Everything Else points in that direction. We were disappointed when the Administration Spokesman at that meeting used the term smoking gun. If you sat down with the evidence, with the analyst in a matter of minutes the conclusion is obvious. This is clearly an evolving process here in the senate. Congress can only do so much on this. You have now attorneys general from maryland and d. C. Subpoenaing 13 trump entities, if you will. Where does that go next . Thats a fascinating case. Theres been a lot of fighting by the Justice Department, fighting on the president s behalf, trying to avoid to getting to the step of discovery where these attorneys general can ask the Trump Organization who are your Foreign Investors . We wont see the answers you and i may never see the answers but the attorney generals may see those answers in the next couple of months. Then well see how that case plays out. Theres a chance we might get a lot more information about what foreign governments have been putting money into the president s businesses beyond what we know now. We dont have a comprehensive list. Katherine, i remember i spoke actually with the Maryland Attorney general yesterday. I said hey, i remember when there was a big to do about the fact that donations would be made to the Treasury Department as it relates to profits incurred by the trump hotel and brian frost said that is irrelevant. Thats meaningless. What is the white house reaction as it relates to this . Were waiting to see how it plays out in court. Weve heard from the president a pushback that hes being persecuted. He takes it personally. He takes these things personally. He tweeted minutes ago about the russia investigation, that its president ial harassment n general, he takes these things with an affront. Aaron, his attorneys have said and even during the transition they said he separated himself from his business. All good. As david points out, not really. Can he still make money. And were taking them at their word on a lot of these things. The ethics groups its an unprecedented situation where the president has so many tentacles out there in the world, his business is so massive, were taking his word for it. Whats interesting about this story was that these hotels were being booked across the river in virginia before President Trump was elected. That changed in december of 2016. At least one member of congress is now sounding the alarm on the National Level about those accusations of Election Fraud in one state. North carolina. A democrat on the House Oversight committee wants an emergency hearing as investigators look into charges that this political operative working for the republican in the ninth district race hired workers to illegally gather up absentee ballots from voters. That republican, mark harris, leads democrat dan mccready by 905 votes, but the state board of electrics wont certify that. Theyve so far refused to do so twice. Those Election Officials have reportedly subpoenaed the harris campaign. Leann, we are getting our first look at some of the numbers here related to the issue of how many absentee ballots were talking about as it relates to the margin here. Fill us in. Reporter yeah. Sure, hallie. Just being here for a couple of days, our reporting is showing that this alleged Election Fraud here is pretty widespread. Just breaking overnight msnbc news has obtained documents from the state board of elections that show just two people, mcray dowless and jessica dowless collected and turned in 775 absentee ballot applications and thats in addition to our own reporting, where we have found just a handful of people, including jessica dowless have turned in dozens and dozens of other absentee ballot applications. Thats a big number, especially since republican mark harris is unofficially leading in this race by 905 votes. We talked to one woman who says her vote, her ballot was illegally collected. Here is what she had to say. A young lady came to the door. She knocked on the door, asked if she could take the absentee ballot. I said sure. I broke the seal in front of her to show it was never opened. I filled out two boxes. She said she would fill the rest out, that it wasnt important. I signed it. Gave it to her. It was not filled. She said she would fill it and come back to me and show me that it was filled. I never got a show back from her. Reporter so you found out, though, that your absentee ballot was never turned in . Yes. The investigators came. He came and he showed me that my name was on the list but my absentee ballot did not come up in the system. Reporter and so, hallie, the state board of elections is investigating this and its up to them to determine if this will impact the outcome of the race or if they will hold a new election. Hallie . Leigh ann caldwell, glad youre on the ground there. Thank you for reporting this. In wisconsin, its a different story. Democrats won. They beat the republican incumbent for races for governor and ag. Now the Republican Party there is looking to limit how much power those democrats will get with the proposal on the desk of Governor Scott walker right now that would present the guy who is replacing him, governor elect tony eavers, from pulling the state out of a federal lawsuit challenging the Affordable Care act, limit early voting and lawmaker, not the governor, would control the board. Theyre trying to course correct after walker amassed too much power, they say, but democrats are accusing the gop of being sore losers. Democratic senator Tommy Baldwin of wisconsin, thank you very much for being with us. Its a pleasure. Governorelect eavers said he was planning to call Governor Walker overnight to urge him to veto this. Have you spoken with Governor Walker . Not since this legislative attempt to disrespect the will of the voters started to take place quite recently. The measures were introduced on friday night and action begun on monday morning. And but, you know, i have to just say, i am so struck with the big contrast i am looking at. Yesterday i attended the Funeral Services for president george h. W. Bush. And a lot of focus was made on the letter that he left to his successor on his desk, that basically he said you are now the president for all of us and im rooting for your success. And i think about whats happening in wisconsin and what sort of note essentially Governor Walker is leaving for his successor. Tony eavers is going to be the governor for all of wisconsin and wooshd e should be rooting s success and not taking away his powers and authority to make good on the very things that wisconsinites voted for him to accomplish. We know there are some Legal Options available if Governor Walker does move forward with this sweeping proposal, does sign this bill into law. But what, if anything, can you do, can the senate do if that happens . Do you have options . First of all, let me just talk about there are several different measures. One measure would restrict access to the polls by early voting. We saw this, many of the same legislators vote to restrict access to the ballot box several years back and a federal court actually overturned that part that relates to early voting. I have every reason to believe that Voting Rights advocacy groups are going to bring this to court and since theyre reviewing a very similar measure, i think that im very encouraged by the likelihood of success. Some of the other issues have to deal with separation of powers. Right. Weve seen courts elsewhere in the country, North Carolina in particular, take up similar cases. I do believe that the legislature is overreaching and really just disrespecting the voters of my state. It sounds like what youre saying, senator, so i can understand, is that this has to be up to the courts. Theres not much that you as a sitting senator and this body can do in washington. Is that a fair summation . I would say i take a little issue with that. One of the big issues thats being focused on is the issue of health care. I know i was in my own campaign for reelection as the governor was governor elect, tony eavers was running. Right. When asked by the Huffington Post if he had any comment on whats happening in the state that he is from and what he knows, he replied i dont have anything for you. Do you think paul ryan should be stepping up and addressing this in any way, or more than he is now . He, too, knows about the concept of when power peaceably moves from one person to another and one party to another that we ought to be supporting and rooting for that person for the success of all of us. We are watching Actual Movement this morning in the shadow 2020 democratic primary. Its not somebody getting into the race. Its somebody getting out. Somebody who was reported last year president obama was nudging to run, former Massachusetts Governor deval patrick, saying a 2020 campaign for president is just not for me. He is one of the first serious potential candidates to bow out of the conversation. Never fear, gang, there are still plenty of candidates who are still in the ring, doing the whole talking to families and advisers thing. Why is it important to Pay Attention to this invisible primary . Bloomberg opinion writes, quote, whats being tested right now is whether the party can still compete and coordinate over the nomination. I think it can and that these early dropouts are a sign that its happening. I got a rebuke from a source in the democratic side who said you always complain its too early to talk 2020, but campaigns are starting to staff up. Has anybody reached out to you about working on their campaign . Whos dialing you up . Ive talked to a number of, what, the 30 some possibilities . Ive talked to probably half of them about how we started and set up a president ial campaign back in 2007 in the dark ages before twitter even existed. There are a lot of folks and look, it is, what, a month after 2018 midterms, and were not even finished with those yet, and were already starting. It goes to show these elections are important and the more that these candidates can interact and grab the attention of the average not the average American People, the American People that will go to the polls and vote in 2020, its that important. I think its not too early to start. Congressman was on the show a couple of days ago, and he said 30 to 40 people are going to run potentially. Lets say even half that, 20 people on a debate stage in the primaries. Can the party handle that . I think theyll probably have to do bleachers or something. I think it will be a great way for the American People to be engage skpd s engage ed and see what message is resounding, if its Kamala Harris out of california or tim ryan in ohio or Sherrod Brown or whoever may pull through. Its about getting the message out. Frankly folks are smarting doing small dollar outreach and connecting with people via email or twitter, you know. I think thats important. Let me ask you about that small dollar outreach. Thats a key thing. We talk about act blue and their impact during the midterms getting those small dollar donations to candidates. Republicans are going to try to put up an act red to make sure they can get in the game when it comes to fundraising. How do democrats keep up the momentum . I think act blue has been around a long time, probably longer than a lot of us realized. They do a really great job. They have figured out a process that makes the fundraising and the communicating with voters and small dollar contributors really simple, and thats going to be having a small dollar, small donor donor base for any 2020 candidate is going to be critical to their success. 1. 6 billion was raised for the democratic primaries in 2018 through small dollar contributions. I think thats so important. Its a messaging thing, too. Its not just the money. Its keeping in touch with the single mom whos working two jobs to keep, you know, the household going or the family whos saving for college. Its a great way to stay connected and keep them thinking about the future and whats at stake in 2020. Let me turn quickly to katherine or aaron. One or two sentences. I wanted to get to you on hickenlooper, your organization reporting on his. The ap is reporting that hickenlooper is making new moves in terms of interviewing staffers. Just like were talking about. And it comes back to the point you were making with this many people in the race at this point in time, theres already a huge competition of talent. Beto orourke shot onto the scene, president obama like a lot of people say, the obama aides say beto reminds them of obama. He was talking about beto not just look he was a good candidate but like he was an obamaesque candidate. It sounds like he wants beto orourke in here.
