Questions still lingering after the president reversed course and signed the executive order on immigration. What happens to the kids now that have been separated from their parents . Secretary neilsen responding to the question about the kids by saying we are implementing that executive order. The president blinked. His public focus on the children lasting about as long as an actual blink. After the reversal after he was blaming democrats on the hill, that is where the house is starting votes next hour on a couple of bills. Republicans are not quite singing. We will show you a heate facetoface on the house floor and tell you what is next if both bills end up shot down with the president weighing in. Then aside from all of this guess who is back in the news, Michael Cohen. Adding to techulation he might cooperate with prosecutoprosecu we have a team of reporters set up and ready to go. I want to start with the rare retreat and reversal by President Trump and the four biggest questions we have about the executive order. First, whether or when detained kids will be reunited with their parents. If a child is in custody they wont be immediately returned to their folks but it is not clear how long it will take. We kople who cross the border illegally will be detained while awaiting prosecution but we dont know how long it will happen for. The Administration Says the goal too hold them for deportation or asylum hearings. Families will be held in facilities like the pictures you have seen from the government. What is Congress Going to do . Anything . The house is voting today. This could be an exercise in futility. If one bill passes it wont make it past the senate. We are breaking down where all of this goes next. We will start on the ground in laredo, texas. What are Border Agents telling you about where they are taking the migrants, how long they are holding them, where . Reporter their job has not changed. We are out here in the desert at check point right now in the middle of nowhere here. They encounter migrants they have to determine who the real bad guys are, the smugglers, the criminal elements within that group. And then they take in the migrant families and have to determine what country they are from, if they have any sort of background record or criminal record and turn them over to i. C. E. That part of the job has not changed. Just being embedded with them, i have been out here for two days now. You see how taxing their job is. These are human beings who are encountering other human beings in the middle of the desert. Im here with the Border Patrol unit in charge of saving lives. The supervisor here is an emt. You sometimes dont get the best rap in our country. What is the hardest part of your job . The hardest job that we have is the humanitarian side of our operations. So we know that were established to prevent terrorists. We we know we are 70 miles away from the nearest city. We know people are out here in the desert and the brush and are going to need assistance because their life is in jeopardy. Knowing that we have to come to work andng we are here to save lives to make these apprehensions, to find these people who are coming here illegally because we need to help them because they will find themselves injured or in a situation where they can find themselves in jeopardy. Our humanitarian side of the house is to locate these people before they get injured. It is incredibly taxing emotionally. The journey north for many of the families is very difficult, very dangerous, controlled by smugglers. I want to play a part of my interview yesterday with the Border Patrol chief about what the journey means and how dangerous it is for the migrant families. How dangerous is this . Its a very dangerous environment. [ inaudible ]. Reporter Journey Towards the American Dream for these migrants and their families, in order to achieve that they have to go through this, this desert that is controlled by the smugglers, by the criminal organizations. It is these guys who are trying to save the families from falling prey to these people. They have been telling me for the past day and a half that they are overworked, under staffed and that humanitarian aspect of their job, no wall and no prosecution is going to make it easier for them. They just need more manpower in order to do what they do for these families. On the ground with that ride along in laredo, texas. I want to go to kasie hunt. You have the twe from donald trump that came out within the last hour. I see the look on your face because i know you know it. The president basically saying what is the purpose of the house doing good immigration bills when you need nine votes by democrats in the senate and he says the dems are only looking to obstruct . Here is the thing. I heard it described as a nuclear bomb and you did, as well, getting thrown into the house discussions happening right now on capitol hill. President is not wrong. This house bill probably wodnt pass the senate. Less than 24 hours ago you and i were reporting on two dozen republican moderates getting summons to be able to vote yes to get to a yes on the immigration bill. Thats correct. While speaker ryan claims that he is not on twitter, i have to imagine or i am imagining in my head him looking at his phone and throwing it at the wall because this has been quite frankly a tortured process for the House Speaker already. This basically represents revolt from the moderate side of his conference. And the president had been engaged in trying to convince ervatives and others that they needed to get on board with this compromise package. But late last night as we were wrapping up a very crazy news day yesterday they were meeting behind closed doors calling the bill not ready for primetime. There were accusations that members of the Freedom Caucus were moving the goal posts at the last minute. The president tweeting the nuclear bomb description is apt because there are enough members of the Republican House conference that if the president says there is no reason to vote for it why the heck would they . They need the president to be twisting arms and pushing that wing of the conference because those are people who have never been with the speaker. You mentioned the very heated conversation between the speaker and mark meadows on the house floor. I think there was a sense among leadership that that may have been an optics ploy on meadows part that he wanted to be seen in public as appearing to be angry at the speaker. This will unfold over the course of the next few hours. A lot of votes we will see will be procedural votes. There will be a vote on what is called the good lap bill. That has no chance of going anywhere. It is likely to fail in the house. So the critical vote is not going to come until about 5 00. I think what we are watching for is a potentially dramatic scene on the house floor. Normally you take a bill to the floor you know what will happen. The House Speaker has played with that rule a little bit. He had a significant failure with the farm bill a couple weeks ago. This is orders of magnitude more intense to be watching from the gallery. So it will be a nail biting, arm twisting day here on capitol hill. Thank you much. I want to get to the white house because they may have noticed the president is on the cover of Time Magazine. This one might not end up on the wall of his golf club. A girl in tears staring at donald trump. The caption welcome to america. The big question here centers on these kids. Talk through the administrations goal to reunite the families and when will we hear more clear policy because so far it has been conflicting accounts. That is the big question, when will we know specifically the plan for reuniting these kids with their families . I spoke with Senior Administration official yesterday and asked her that very question. She said that is the priority. I said can you guarantee it will happen . She said that is the focus of officials on the ground. What is the pathway to make that happen . As you mentioned dhs secretary was on capitol hill and was pressed about all of this. Take a listen. What the president did yesterday is to try to make clear that what we dont need to do as americans is pit the enforcement of law against our humanitarian ideas. So we need to do both at the same time. So what he tried to do is enable us to do that until congress acts. I want to be clear on this, congress has the authority and responsibility to make the law of the land and to fix the immigration system. So what you heard there is secretary nielsen saying this is up to congress but still no firm answers about the fate of those roughly 2,300 children who remain separated from their families. President trump up and tweeting about all of this. Let me give you a sense of what he is saying today. We shouldnt be hiring judges by the thousands as our ridiculous immigration laws demand, we should be changing our laws, building the wall, hire Border Agents and i. C. E. And not let people come into our country based on the legal phrase they are told to say as their password. Another says the border has been a big mess and problem. At some point schumer and pelosi will be forced to do a real deal. Again, pointing the finger at democrats. We are expecting to hear more from President Trump. He has a Cabinet Meeting at 11 45 today. Hopefully he will be taking questions and have some answers. That is likely what we will see. I appreciate that. Lets get with one of the overarching questions here. The upshot, the bottom line from a lot of reporting is we could be back to square one in just about three weeks from now. I think thats right. I think what we saw yesterday is that President Trump answered a crisis that he himself manufactured with an executive order that doesnt address any of the issues that he has created. It doesnt end family separation. It does not have a plan to address the families who have already been separated who have no means of finding each other, of speaking to each other or knowing if they will be reunited and it adds into the mix that now the administration wants to detain parents and Children Together which we have seen historically is a terrible idea. So for us this executive order does not solve the problem that President Trump himself created. Presumably the administration argueds it is better to detain the family and kids together than apart. The other option is catch and release. This seems to be headed to a potential legal battle. We have a case challenging family separation and we have a status conference wite dge tomorrow. We will be telling the judge that we desperately need the preliminary injunction not withstanding the executive order. The executive order does not address the 2,300 kids who are still separated. We need the judge to order the government to reunite those kids promptly. If left to their own devices those kids will languish in facilities for months and months. These kids are suffering harm every day. The trauma is setting in. We need that injunction. We are going to tell the judge we need the injunction to lay down standards for family separations Going Forward in the future. The executive order says we wont do more family separations but leaves lots of loopholes. We believe the court needs to set forth constitutional standards for when separation will occur in the future. We will be asking the judge to continue with the lawsuit and issue a nationwide injunction. When you talk about the focus of a lot of this which the president acknowledges is about the kids he says the reason why he although he claims he is not backing down, he is reversing his own policy did this is because of the sights and feelings by seeing some of the images. Ivanka trump and Melania Trump talking with him about it privately. Senator talking about the executive order and the impact. Delay in trying to separate kids from their parents, i dont think the court will walk away from the standards that we agreed to 20 years ago. So the senator talking about where this goes next. It comes as democrats are focussing on this today. You have congressman lou f example on the house floor with that picture of that little girl, the one we referenced on theTime Magazine. What happens to the kids already separated and detained . Our reporting has been hhs saying one thing late yesterday afternoon to us. From what we understand they remain in the facilities. They have not laid out a plan to reunite parents with their children. That is going to be a big question as they move forward. This is the kind of optics that we know the president cares about, that Time Magazine cover is something that if it keeps producing these optics that is a motivator to get him to change and maybe make more change Going Forward. He reportedly hired a new lawyer and resigned from the rnc and apparently is annoyed that the president is not helping out with legal bills and going after the zero tolerance policy. Do you think he is getting ready to flip . The signs indicate that he is walking that direction at least preparing himself or perhaps his lawyers are preparing to do that. His new lawyers, the lawyer himself is an alum nuof the Southern District of new york, the federal Prosecutors Office highly regarded by people currently in that office. All of his partners are alumni of the sdny. This is the sort of lawyer who would prepare you to cooperate with the government. Nbc news has not confirmed that he is representing cohen. You have been writing about this, aaron. It is clear thathe is a desire to have an impression that he is unhappy. We saw a number of reports on wednesday one from wall street journal and cnn and now the report of him withdrawing. I was surprised he was still in the role. Why would you leave a guy who was like that in that role . It would have been really easy for him to drop that job given the investigation he was under and he did mention that in his letter resigning as finance chair. Then he saw fit to mention the policy difference from trump. That is significant because he and the president there is no day light between them. He said he would never flip on the president. Suddenly we have a rift between the two of them and one that was unnecessarily put forward by cohen. He didnt need to say this. He chose to. It shows he is sending a signal that he needs the president to show him something, a little more loyalty, maybe talk about a pardon perhaps. Everybody it seems is trying to distance themselves from everybody else. You have cohen working to distance from this policy of the president. The rnc distancing from cohen saying he hasnt been active for a couple of months and then the president distancing himself from his former lawyer. Here is what he had to say last week. Are you worried Michael Cohen might flip . I did nothing wrong. This stuff would have come out a long time ago. Is he your friend . I havent spoken to michael in a long time. I think the president real that there is trouble in the water when it comes to Michael Cohen. He wanted Michael Cohen on his staff because he called him a fighter, a real sniper. You look at how he talked about cohen long before he ran for president he was his fixer. He bes that he is relentless and ruthless and i think he is probably seeing Michael Cohen be on the sending end on his back and he doesnt want to be on the receiving end of Michael Cohens own behalf. Lots of distance. The president has managed to amazingly keep his dist bns tween h distance between himself and those close to him. We have breaking news from over at the Supreme Court where there is a new ruling in from the justices that could effect how much you are taxed for what you buy online. Nbc news justice correspondent Pete Williams is joining us live from the Supreme Court. What is this ruling about . Reporter not only could but will effect what you pay online. The Supreme Court says now states can require internet retailers to collect sales taxes. So that means the things that you buy online the retailer now can charge you sales taxes and in many cases must charge you sales taxes. For the longest time the Supreme Court has said based on a decision years ago from Catalog Companies that let the company have a physical presence in the state like retail store the state could not require that retailer to charge sales taxes. Today the Supreme Court said the thinking is out of date, that the internet era has changed everything and that that logic no longer applies, that the physic presence rule has prevented the people who still have a presence in the state from being on the level Playing Field with internet retailers, that they get an advantage by not having to charge sales taxes and therefore what they sell can be cheaper. The Supreme Court is opening the door to this now. I think what it will mean in practical terms is that the large internet retailers will have to charge sales taxes and many already do. Amazon. Com does, for example. Other internet retailers do because they have so many smaller companies, those who do business for example on ebay may have to charge sales taxes, the specifics of that have yet to be determined. This certainly opens the door. It is a big change. The Supreme Court says the old understanding of how it works with Catalog Companies is outdated. The internet changes everything. So you are going to see more sales taxes for the things you buy online. So you are coming out and talking about this Internet Sales tax decision. There was a decision that we might have been talking about but we are not. We are still waiting on that. There is only a couple days left in the term to be able to get that. There is at least two, i think three or maybe four decision days left in the term. We now know we will get decisions tomorrow and on this coming monday, probably tuesday, probably wednesday after that. The travel ban case was the last one argued this term so logically you would assume it would be the last decision we will hear. Today the Supreme Court handed down three other decisions kind of clearing the under brush for the big cases yet to come. So i think we have now eight cases left to decide and we have three or four more decision days. I dont know who wewill gen we it. Pete williams, always a pleasure have have you on. Amazon has been pushing for expanded Internet Sales tax because they already have the infrastructure to collect the sales taxes. And to bring in someone making something in their home and selling it as etsy was doing to pull that business away from etsy. This is a big win for brick and mortar retailers and big online retailers like amazon. Thank you for breaking that down. We want to get to new and exclusive reporting that we have on who will be prosecutor folks at the border . People charged with illegally crossing into the United States. The department of justice has asked the pentagon to send 21 active duty military lawyers to the border. The pentagon tells the rachel mad ow show they will be appointed as full time special assistant u. S. Attorneys. Nbc National Security reporter is joining us along with matt miller. Courtney, to you first, why is this so unusual and what are the Practical Implications of sending these lawyers to the border . Why are they doing this . The request was specifically for attorneys who have crinal trial experience and immigration expertise or knowledge. So what was particularly interesting to me when i first heard about this was that doj would ask the pentagon for attorneys. If you flip it on the head and say the pentagon is asking for a bunchf soldiers that is what it sounded to me. We see it frequently out of the pentagon, people detailed to the white house or state department for specific roles generally as an adviser. In this case these 21 attorneys will be sent to various locations along the border and will have two main functions. One is to help with potential asylum cases. So they will hear peoples cases for asylum and determine whether they have a legitimately legal case or not. But because of the criminal trial experience they will also likely be involved in prosecution, potential prosecution of people who have crossed the border illegally. Matt, you were hot fire on this last night. You were on twitter. You were calling this a complete farce. Its not unusual for jags to be deployed at doj. That happens usually because of a normal rotation or responding to external crisis. The difference here is there is no external crisis. There is an internal crisis that the department of justice has created for itself. What i think people dont understand is when you impose a zero tolerance policy on Something Like immigration i means you are putting in place a maximum tolerance policy for other crimes because there are only so many judges and so much time in the court. What i think this means is that the department of justice is overwhelmed in the states. They are having to spend all of their resources on prosecuting the cases that would otherwise be handled by immigration court. The resources have gone down dramatically. You are nodding. Its another example of them creating issues for themselves with the zero tolerance policy. They have taken care of the one major problem which was children being separated from their parents. You create these situations with these policies and these new policies and then you have to deal with them. Resources are finite. Now we have 21 fewer lawyers working for the Defense Department that are being moved over tathe justice department. What dollars are we talking about . What budget is this coming from . These will be uniformed attorneys. They will still get their pay, health care. That will all still come from the pentagon. It is not clear the day to day cost, travel, lodging, any kind of per diem. What about the training . The documents say they will be given basic training which are things that some attorneys dedicate their entire careers to studying and training their lives for. It is unclear. It might be done by prosecutors in officers they are applying for. The bottom line is these are people who will not be doing other cases now. Talking to a u. S. Attorney in one of the border states had a dedicated National Security prosecution unit set up for cases of National Security. Its been disbanded because they need to spend so much time prosecuting the cases which are misdemeanors that do nothing for National Security. I want to go back to questions we have been casking. What are the facilities . Where will the facilities be that will house these Families Together as they are detained . We had reporting that military bases were being considered. I understand defense secretary mattis said we will do whatever is in the best intest of the country. What more do you know about the possibility of military bases being used . We know of four bases that have been approved. We should point out hhs was the one that went to the four bases. It was Good Fellow Air Force base, fort bliss in texas and then little rock in arkansas. Hhs went and did site surveys and put out requests for contractors to bring in bids to build most likely tent cities, but to build facilities to house upwards of 5,000 individuals. They will come back and choose a location. Up until the executive order we were told they would be providing the location, the space. Anything from an open field, empty field to potentially just an area they have on some of these bases are huge especially the ones down in texas. That is not unexpected based on the executive order. It is intended to keep Families Together. Perhaps we are seeing that it happening. Let me start with the news that we just read from msnbc, the idea that families are being kept together that are crossing the border illegally and not being separated from their children. Your reaction . That is good. It also means that this isnt on congresss lap. This could have been done. It was a change in Administration Policy in the first instance and now are change tg back. Do you believe the president was misleading people about that executive order . It is a reversal though the president says he is not backing down. It is a reversal. It wasnt necessary in the first instance. To the extent he was saying his hands were tied and this was congresss fault, that is not accurate. So we have this news coming from the ground in texas this morning about the families staying together. There are some 2,300 kids who have already been separated from their parents in the last couple of months. Are you confident that they will be reunited with their families . It is too early for me to express confidence. I think given the media scrutiny there will be an intense amount of effort to make sure that everyone of the children is reunited. I think this is as much on making sure that the media follows through with the administration. The administrations feet will be held to the fire on this one to be sure. Did they put themselves in an unworkable situation . They put themselves in a very precarious situation. Whether it is unworkable will depend upon what they did at the origins of separation. If they have not done what they should have done and making sure that they could reconnect then there will be really bad stories coming o and very sad stories. I want to get to the politics piece in a second. Just a little bit more on the policy. The ultimate question is what happens to these kids . I think that is most important for you and members of congress. What can congress do . What can you as a lawmaker do to ensure that these children are reunited with their families . The Administration Says that is their ultimate goal. What action can you take . I really dont know. How am i or any member of congress supposed to know what child was bussed or put on an airplane to michigan or new york and where are the parents in the system . That is the problem with the policy in the first place. Thats why i think there is a lot of outrage is because there is a certain element of helplessness for us to be able to do that reunification. Yourquestion. Good answer for i wish i did. Is that troubling to you . Very much which is why it shouldnt have been done in the first place. We have shown videos of girls without their parents. The administration has not allowed reporters into the facilities housing the girls and toddlers. Do you think the administration is hiding something . I dont know if it is that. There has to be some reason that hasnt been proffered as to why it is whether a good reason or not is a separate question. I have seen the question where are the girls and babies. We do not have the kinds of answers here that we are entitled to as americans and members of congress when the administration has said this is congresss problem. A couple more quick ones for you. You are standing over on the hill which is the house voting on immigration bill. You were not very confident within the last 24 hours that this immigration bill was going oo pass. Did the president s tweet change your mind . No. The tweet undermined i think any ability to get those sitting on the fence or a little uneasy about voting for the compromise bill and the Freedom Caucus nickel and dimed and treated every nickel that they nee a change for as though it was worth a Million Dollars and then yosee the house floor with an outrage. I think the speaker candid himself with a great degree of measure. I think the bill will go down and we may start with a new discharge petition with a bill that will run down the middle of the Playing Field. We will not pretend that the Freedom Caucus is able to negotiate. Very quickly before i let you go, as always i ask you about scott pruitt because that is an area that you have talked about. There are more headlines about pruitt now. He said the allegations are lies perpetrated by the media. Where are you on pruitt today . I think the real big news is the head ethics Government Watch dog in the federal government has said that they are asking the ig to expand their investigation and they are also going to issue what is called a formal corrective action proceeding which is very big news. I dont think that the administrator has spent dollars properly. I will wait for the i. G. Reports to be issued in order to say what you are probably waiting for me to say. That is the real big news. I want to start first with the video that we saw from new york about 24 hours ago, young girls being walked through east harlem. What is your reaction to that . And how does that happen without your knowledge . Cal, its shocking. I mean were talking about hundreds of kids who have been brought to new york city. 2,000 miles from here. With no sense of when theyre ever going to see their parents again. Theres no plan. Theres no transparency. You know, we stumbled upon the information is the honest truth because the folks who were trying to help these kids, the social Service Providers were willing to tell us the truth, but the federal government is not telling us the truth. I saw a classroom of 30 or 40 kids from guatemala. And they are right now theyre putting on a brave face but they have been put through a traumatic experience. These kids have been torn from their mothers, torn from their families. Theyre 2,000 miles away. Theres a 9yearold boy from honduras named eddie, who was put on a bus to go 2,000 miles to new york city with a federal escort. He has no idea when hell see his mom again. This is unamerican if anything was. The kids here are in a similar situation. Theyre trapped between the old, new executive order and what happened yesterday. And we dont know whats going to happen. I saw when you arrived you sort of walked the perimeter. You took a look. What are your thoughts, what are you trying to accomplish . Were going to demand access and in america, Public Officials should be allowed to see something paid for with taxpayer dollars. This is being done in our name. We deserve to see it. You deserve to see it. The media to tell the American People whats going on. The notion that this administration has turned away u. S. Senators and Congress Members who are just trying to do their legitimate constitutional oversight rule theres Something Big here. Why will the government not tell us, how many children are there, when are they going to be back with their families . If you care about democracy you should care about whats happening right here. From the new york city point of view, hundreds of kids have been sent already. We need to make sure theyre taken ca of and a plan to get them back with their parents. I know you want to ask the mayor some questions before i let him run. Yeah, Hallie Jackson up here in washington. We learned that in mccallen, texas, not far where you are, some families that had crossed the border illegally are now being held together. They are not being separated from their kids. Does is that i want your reaction, is that a sign of progress do you believe . Is that a signal that this executive order is doing what it was intended to do, reversing the president s policies and ledding the families letting the families Stay Together . If theyre letting families Stay Together thats a step forward. Heres the problem. Thousands of kids who are separated right now, no plan to get them back together. And zero tolerance is still the policy. So folks seeking asylum this is an american tradition to let people fleeing oppression, a lot of whom who are our grandparents, great grandparents, give them a chance to prove they belong here. The zero tolerance pol does not allow that for that. So maybe its some small progress but we need much bigger answers here. Very quickly, mayor, of the children you talked about, the ones who are in new york city that were brought to new york city in that shelter, in east harlem, how many were children that came across that were unaccompanied minors when they came across . In other words they crossed the border alone versus kids that were actually separated after they crossed the border from their rents . Do you have that breakdown . I do. And it shocked me. 239 kids separated under the new policy this family separation policy just from the last couple of months. 239 who were with their parents la few weeks were taken from their parents, sent to new york city. None of them were folks you know, kids who came up here on their own. They were all taken from their parents just because of this new policy. Again, they dont know when theyll see their parents again. Mayor, you talked about the importance you believe of Public Officials of coming in an seeing the facilities for themselves. The department of homeland security, others, there will be the criticism from those who say this is a political stunt essentially. How do you respond to that criticism . Hallie, this is about basic democracy. The fact is this is something that the American People care about. How are the children being treated, how is our money being spent . Is it being spent in a way wed feel comle with or not. Theres something eerie about a Government Agency saying we wont let the media or the Public Officials in. That would never fly in my city. New yorkers would never stand for that. I dont think americans will stand for that. Theres a bigger problem here. Thats why we have a Bipartisan Group of mayors who we have gathered here to say this needs to be solved. We need comprehensive Immigration Reform and were saying we cannot have our government withholding this information from the American People. What makes you think your message will be effective to the president of the United States . The new york mayor, you know your perception in the white house. Why do you think your voice will get through to the president . Its all our voices, hallie. First of all, the voices of people all over this credit card, including a lot of faith leaders. Thats been a powerful piece of this. Faith leaders, liberal and ervative alike speaking out got through to the president. Its a Bipartisan Group here. We have 20 mayors, republican and domes, all parts of the country saying this is an american consensus. By the w, most americans want the dreamers to stay, most americans want comprehensive Immigration Reform. This is about bringing the voices of the people forward. Were just the vessels but the fact its bipartisan should give the president recall pause. To those who say whats the mayor of new york city doing on the border you say . I say that we have to solve the problem. Its come home to new york city as you just heard hundreds of kids being sent us to us. But because of what it means for the country as a whole. The Trump Administration is trying to do is obviously denigrate immigrants and denigrate people who have been historically part of this country being treated like the other, something separate. Were the greatest city of immigrants and we are proud of that. We think its part of what made new york and america strong. Im here to stand up for those values and my fellow mayors are too. Hallie, the big news to me, its increasingly bipartisan, increasing which the faith leaders. I think a bigger change is coming.
