Address the Naval Academys graduating midshipmen this hour. Well talk about the likelihood of the conversations with north korea will happen. We have a lot to get to this morning and i want to start with north korea. Just in the last hour the president is talking about that canceled singapore summit now saying, hey, maybe june 12th should be back on the calendar after all. Were learning that the president has been in touch or at least hiS Administration with counterparts in pyongyang. Well see what happens. Were talking to them now. It was a very nice statement. Well see what happens. No, no, well see what happens. It could be were talking to them now. They have you much want to do. Wed like to do it. Were going to see what happens. Nbc Kelly Odonnell for the white house. Kelly, apologize to you if i have to interrupt you in the middle of a sentence as we wait for the big story with Harvey Weinsteins lawyers. Talk about where this goes next. Reporter no worries i can slam on the brakes as needed. This was notable because when the president came out his pace was slow and he veered toward the cameras wanting to talk. He had a new message today and he wanted to make clear that the thing we had thought was blown up yesterday might be intact after all. So the president said a number ever things that were notable. That the u. S. And north korea are talking again. Why does that stand out . Because yesterday a senior official told us there was radio silence, so thats notable. In addition, the president has also suggested that everybody plays games when prompted by a question about was north korea plais playing games with their tactic that led up to the cancellation . So everybody plays games. Might even ib clued the u. S. In terms of strategy based on the president s words. He said were in touch again, that certainly could move the ball. The president said both parties want to do this. Earlier in a tweet he complimented the North Koreans for their response and opened that door once again by suggesting that because north korea responded in the overnight hours that he would be willing to keep talking. These are very significant steps. Earlier in the day we heard from senator Lindsey Graham who is sometimes an ally of the president on matters like this and he had a very graham esque way of describing the stakes right now. It could be the worst abortion in the history of the world or we could all get back together. I talked to the president yesterday he said he thought they were playing him. He thinks china is sort of pulling back north korea. So perhaps each side is sending the other flowers and keeping the door open. The stakes here of course are very high. Its Serious Business if the matters a great deal to u. S. Allies in the region and the safety of millions of people when it comes to a threat about potential Nuclear Showdown which is the threat made by north korea. Kelly odonnell in the briefing room. Thanks. Well bring you back to new york city. Ben is speaking with reporters after the media mogul was arraigned on sex crime charges. We want to talk about weinstein as seen today in court. Could we do this now please. Im going to make a brief statement. Im going to distribute a brief press statement in writing as well which hopefully you will share. And i may take just a couple of questions. Mr. Weinstein tends to enter a plea of not guilty. We intend to seek im going to make a brief statement. Im going to distribute a brief written statement, and i may take a few questions. Mr. Weinstein will enter a plea of not guilty. We intend to move very quickly to dismiss these charges. We believe that they are constitutionally flawed. We believe that they are not factually supported by the evidence. And we believe that at the end of the process mr. Weinstein will be exonerated. Someone inside asked me how mr. Weinstein feels this morning. And my response was, as well as can be expected when you are accused of a crime that you vehemently deny having committed. So we are going through the process. Todays the first step. We knew that mr. Weinstein was under investigation for more than seven months. He voluntarily surrendered this morning. And we have met all of the bail conditions by agreement so that we would not have extended court proceedings. We have a right to revisit any issue in this case later in the event that an indictment is returned. And i anticipate that this case will ultimately be resolved favorably as to mr. Weinstein. Im going to take just one or two questions. What are the before a grand area. Will you put him before a grand jury . Im going to make that decision next week. And what are the bond conditions. Did you maintain his relationship was consensual . Mr. Weinstein has always maintained that any Sexual Activity he engaged in was consensual. He has vehemently denied any of the allegations which suggest that he engaged in nonconsensual Sexual Activity. Many of these allegations are long overdue, quite frankly, having been made about events that are alleged to have occurred many years ago. They were not reported to the police at the time these events occurred and i anticipate that the women who have made these allegations when subjected to crossexamination in the event we even get that far that the charges will not be believed by 12 people, assuming we get 12 fair people who are not consumed by the movement that seems to have overtaken this case. What are the details of the bail conditions and is he wearing an ankle bracelet . I think the details of the bail conditions were discussed in open court. I really dont want to revisit them now. He has met them, we deposited the Million Dollars of cash bail that was required by the court and weve agreed to turn over mr. Weinsteins passport and thats where we are. How about a federal investigation something how concerned are you about a federal investigation . Plan in on if you get to that point. What . I anticipate a vigorous defense, thats been my professional job for almost 40 years and i think most of you know that. What has been explained to you about a federal investigation . I think the federal investigation if it occurs we will deal with it when and if that happens. I am hoping to continue my discussions with the Southern District and my efforts to dissuade them from proceeding. That investigation, too, has gone on for many months. Thank you very much. There are dozens of women who say theres a pattern of behavior, a pattern of misconduct by mr. Weinstein against these women. Let me say this without defending behavior. My job is not to defend behavior, my job is to defend something that is criminal behavior. Bad behavior, mr. Weinstein did not invent the casting couch in hollywood and to the extent that there is bad behavior in that industry, that is not what this is about. Bad behavior is not on trial in this case. Its only if you intentionally kmil criminal act. And mr. Weinstein vigorously denies that. They say that he did commit that. I understand that, thats why were here. People dont get convicted based on accusations. People get convicted only when there is criminal evidence beyond a reasonable doubt and in this case i do not believe that the District Attorney has that, nor do i believe that mr. Weinstein has intentionally violated the law. Thank you very much. Youre saying a sevenmonth investigation you have been watching beckman brathman now leaving the courtroom in new york city after speaking with requirements after the arraignment of Harvey Weinstein. His defense, that weinstein didnt invent the casting couch culture in hollywood, that bad behavior is not whats on trial, adding that hes hoping to find a jury who is not as he put it, consumed by the movement that is overtaking this case. Weinsteins case triggered the me too movement rocketing it into the National Consciousness after a series of women, dozens of them, came out against this, yes, bad behavior by the mol hood mogul. What youre seeing today has been a tuning fall from grace from Harvey Weinstein and potentially just the beginning of what could be a very long court battle. You heard them asking the question about the pattern of misconduct on the part of Harvey Weinstein as hes been accused of by a number of women, two in this particular case. Katy and danny, katy, let me start with you. What stands out from what you heard from brathman as he previewed what he described as a vigorous defense of weinstein . Two huge things that stood out is the fact that, once again, Harvey Weinstein has taken the position that, yes, there was sex walg conduct and contact, however it was consensingual which was the bill cosby defense. Yeah, it happened but it was consequenceua consensual. The prosecutors have to be happy to prove that, it doesnt mean they have to prove that the contact happened. Its going to turn on whether it was consensual or not. Bill cosby in a second trial failed in that defense and was convicted of his felonies. The second thing that stood out to me was the fact that once again in a sexual crime prosecution youre challenged as a direct attorney or as a prosecutor is basically making sure that the jury believes the credibility of your victims. He just said right now, quote, the victims do not report it to the police when it happened. That is a typical criminal defense line in a sexual crimes prosecution defense. They like to always say when youre a criminal defense attorney, well why didnt you go to the police when it happened . Well we all know that there are a myriad of reasons why victims of Sexual Assault and abuse do not report it immediately to the police, especially when they are intimidated, when theyre threatened, when theyre coerced by the defendant this case. So id be curious to see the legal grounds for the motion to dismiss that he said hes going to bring to see whether or not it survives that stage. Daniel, let me bring new and just a reminder that there are two wane at the center of accusations, the charges that weinstein now faces. But in sum, 90 plus women have accuse him of what his attorney described as this bad behavior. One of things that his lawyer said moments ago that was striking was the comment that weinstein does not invent the casting couch in hollywood. Talk through how that plays in a courted of loy and, danny, how that plays in the court of public opinion. Its a surprising statement because in a sense it concedes that possibly Sexual Activity was going on. In any rape case, in any Sexual Assault case, you have two major prongs of a defense. Number one, it didnt happen and you cant prove that it happened. But number two is if it did happen, it was consensual. So by referencing a casting couch in that Harvey Weinstein didnt invent it, that creates sort of this haze of, well, this is sort of what was going on at the time. And i think prosecutors are going to seize on that position. It signals that the weinstein defense is going to use consent as a defense. And that say ve is a interestg development. A delay in reporting has evidentiary significance. That may not jive with what we think socially, which is that victims delay reporting for a lot of very good reasons, and thats true. But as it stands, in some jurisdictions, a delay in reporting can be evidence, can be ripe material for crossexamination of a expla explain complain nant. So by him saying that we can expect hes going to seize on that and exploit it in crossexamination. Id like to you stick around but i want to go now to nbc korptd who correspondent whos live outside the courthouse. Give me a sense of what this is like because this is a moment being watched by people around the world. And where you are it looks like a chaotic scene. Reporter its chaotic and were being crushed here. Ways practically on my knees because there are so many people out here trying to get some words from Harvey Weinsteins attorney. And so the questions were, many questions about the how was his client feeling sne said his client, you can imagine how someone would feel said his attorney when hes accused of something that he did not do. He said that Harvey Weinstein plans to vehemently fight against these charges against him. He says that he is going to plead not guilty to these charges. That he is not did not engage in any nonconsensual sex with women. I asked him what would he say to these women who have accused him of bad behavior . Listen to what Harvey Weinsteins attorney. Thank you i have much. Dozens of women say that theres a pattern of behavior, a pattern of misconduct by mr. Weinstein against these women . Its only if you intentionally committed a criminal act and mr. Weinstein vigorously denies that. They say that he did commit that. I understand that, thats why were here. Reporter so what he was saying essentially is that his client, again, says that he did not engage in any nonconsensual sex. So he is going to fight any allegations that he forced himself on any of these women who are accusing him. Specifically two different women in this instance, although, as you point out, hallie, there have been dozens, waupwards of , 90 women who came out and accused him of inappropriate sexual misconduct. Our legal analysts katy and danny are joining us now. Given what we just heard, danny ill start with you, from the attorney there, the sound we just replayed, you can talk through what you surmise about the idea of an intent argument here, the idea that perhaps he is foreshadowing that because of what he calls the culture of the catting couch in hollywood that there is some sort of intent factor that might play into this . Intent is not so much a factor as consent. If there is sexual contact, and you look at all of the new york codes with which Harvey Weinstein is charged, everything from rape to criminal sexual act which is for sentencing purposes equally as serious as the rape charges, but whatever the case may be, Harvey Weinsteins intent would only be relevant if he could argue that he accidentally had sexual contact with these complainants. And that probably wouldnt be a very, very helpful argument to make for the defense. On the other hand, consent is key in this case. And weve seen a foreshadowing by the attorney when he implies that the hollywood casting couch is part of a culture whereby theres a currency and that currency is sex. And when you come in, theres a quid pro quo that these complainants willingly had sex with this person, not by force, not by forceable compulsion and not by threat, but because they thought cohelp them he could he the business. If thats ends up being the defenses argument, it could very easily turnoff jurors. You also heard him indicate as we know theres another Court Date Set for next week that he will decide next week whether or not weinstein will address the grand jury. If you were advising Harvey Weinstein, what would you tell him do here . I would tell him not to address the grand jury. Its a huge difference between the criminal defense lawyer standing on the courthouse steps and, you know, very, you know, announcing the innocence of his clienl client. Theres a difference between the lawyer doing that and the actual criminal defend who could be looking at his words being used against him speaking to the grand jury. I think this casting couch reference, i think it was poorly made, but i do think it speaks to the possibility that the prosecutions going to try to use one of the other 90 alleged victims of Harvey Weinsteins bad, sexual, criminal conduct and that basically none of those women should be able to testify against him because its just bad behavior and its not criminal behavior. So i think thats a little bit of a foreshadowing that perhaps he knows that thats possible possibility. It was used in the bill cosbys trial and he knows thats a possibility that the das office will use those owner victims at his trial if it makes it that far. He also bleakly referenced the me too movement, not calling it out by name but saying theres a possibility he believes they might not find 12 fair jurors because he describes the movement in his words overtaking the case. Reminder for folks here, this was really the first of the me too movement cases that came out. The New York Times reporting on weinstein, what we are seeing today, or him in a sweater, a collar, a jacket, standing in handcuffs coming out of that Police Station that were seeing right now in front of a judge inside that courtroom with cameras in court, this is remarkable given where we were, where Harvey Weinstein was just one year ago today. Talk through how the movement in the words of his attorney, how this me too movement could potentially play into this. Is this for me, hallie . Katy, take it. All right. So for purposes of jury selection, you, as a criminal defend, are entitled to a jury of your peers. And they must be fair and impartial when they listen to the evidence against you and that evidence and those facts are applied to the law of your jurisdiction. The suggestion by his attorney that it might be difficult for Harvey Weinstein to get a fair and impartial jury is a little bit assist and the reality is we know about it because the stretch and reach of social media and at media these days is so far and wide. The fact that he wouldnt reference the movement, the fact he didnt use the words the me too movement is because Harvey Weinstein is the reason why the me too movement basically got started to the extent that we all found out about his threats, his coercion. You know, his intimidation tactics. The problem for Harvey Weinstein isnt so much that the me too movement has gained speed and has progressed. The problem for him is that we now know that he hired covert Companies Like black cube out of israel, right, to be able to compile these dossiers against all the victims and the witnesseds and the reporters in this case. It wasnt just i didnt do it. Now hes going to have to defend against the fact that we all think that he did it perhaps, but that we know what he did to make sure people didnt find out about it. Sometimes the coverup is worse than the crime. Danny, another of the reporters reporting behind the me too movement was ronan farrow. He talked this morning for the women who came out against weinstein and specifically for one of the two women involved in this criminal case, because, remember, two women involved in the criminal charges, many, many more as weve been talking about have accused him of other behavior. But for these women, specifically one of them, this could be drawn out for years. He says weinstein has powerful counsel and the lawyer we just saw is very aggressive talking about the potential for tactics being deplayed olympi being deployed here. Do you believe thats could happen in this case . This is an unavoidable risk and consequence of any victim, any complain nant testifying in trial. After all, its the defendants constitutional right. And on the attorneys zealous duty to Research Everything they can, learn everything they can about witnesses and complain an complainants. But in this case we have a unique situation. Harvey weinstein has spent years and lots of money compiling intelligence on wouldbe accusers, potential witnesses, and other folks. Its a very rare instance that a defense attorney comes into a case and a client has already prepared a professionalstyle work of intelligence for the defense attorney to use. So while there is there really is very little the law can do to prevent the discomfort and the agony that victims go through while they testify, it is also a feature of our system that a defendant is permitted to crossexamine and face his or her accuser. Nbc correspondent is live outside the courthouse now one of the New York Times report whorss broke in weinstein story. Ill turn it over to you. Reporter thanks, hallie. And im with megan. As hallie just said, you broke the story of the scandal about Harvey Weinstein. You were in the courthouse. What was it like in that courthouse this morning . Yeah, it almost nelt felt li felt like a dream as someone whos been reporting on him for moans and months and seen so many of his victims be so scared of him for so long. Today to see the fear in his eyes was just remarkable. I mean, he shuffled into the courtroom and looked around out at the people who were in the rows watching and he just looked completely terrified. He was shuffled in and he had handcuffs on at the time. He was shuffled in and he had hand scuffs on. What are your thoughts now as this moves forward that these charges have actually been brought against him in this courthouse but there are also some federal charges that federal investigation that the grand jurys still looking into . Right, thats right. This could very well be the first of many charges that we see roll out in the coming months. The investigations here in new york are ongoing. Theres investigations in los angeles, and theres investigations in london where its worth noting theres no statute of limitations on sex crimes there. Thanks very much. Great reporting. Thanks so much. Reporter hallie, back to you. Megan broke that story taurk about the fear in the eyes, not of the victims, but of weinstein himself inside that courtroom. We told you at the top of the hour we are following two big breaking stories right now. You just heard those developments on Harvey Weinstein, well be watching that, talking about that not just today but you know for a while to come. We also want to talk about President Trump who right now is in annapolis. Hes set to address the mid shipmen for their commitment. I want to bring in jeff on the ground for us. Jeff, we just learned from our teams over at the white house, the white house adviser hogan gidly, one of the deputies came out and said a planning meeting set for this weekend in singapore has been called off. The jep chief of staff is not going to go. We had not known than before today. I know you and i had been asking a lot of questions to our sources about whether or not that was still on the books, it is not. Yet at the same time we have the president saying, hey, were in touch with north korea again, its no longer radio silence. What do you make of all this . Reporter thats right. One of the things were looking for from this president s speech today is if he says anything about north korea, we know based on his public statements both on twitter and what he told our peter alexander, kelly odannell and other reporters on the south lawn is he wants to have this meeting so long as the conditions are right. We also know based on the conciliatory message that north korea sent overnight that theyre open to having a seat at the table too. But the lingering questions about the substance of those talks still remain even though it looks as if theres another motivation on the parts of all those involved. So i think we have the sound youre referring to from hogan gidly, lets take a look at it. Okay, so we dont have that sound. Im not sure we have that. Reporter so we expect the president to speak momentarily and when he does we expect his comments to focus more on leadership than politics given that the graduates who are assembled behind me here are set to join the ranks of the navy and the marine corps. I can tell you what the president s done speaking hes going to shakt hand of some of those 1100 or so graduates who are set to join the ranks of the u. S. Military today, hallie. Jeff, thank you very much. I want to bring in now john mclaughlin, former acting cia director as well as victor chod, director ofation studies at Georgetown University and former director of affairs jill cove van of the ap, Charlie Savage of the New York Times here with me as well. Thank you all for being here on what has turned into another very busy news morning. Victor rer let victor, Lindsay Graham was out this morning talking about what he thinks might happen. His tone was really interesting. Watch. The preferred route is through peace through a peace treaty, win win for them and us. And in terms of when, he wants it to be in his first term. But if diplomacy fails, then military action is the only thing left and it would be the utder destruction of the north korean regime which would come at a high price. Is that where we are, talking military options already . I certainly hope not. I think the there is of course the possibility that north korea will Start Testing missiles again. They tested 20 of them last year during the first 12 months of President Trumps time in office and i hide dre again bomb. But thus far their statements have been more conciliatory after trump canceled yesterday. Just in the last 15 hours or so. Yes. And President Trump has blown hot then cold and now hes blowing hot again. So, you know, sometimes i wonder that this isnt really about anything except whether they say nice things to each oblingether. Thats the thing driving the president. John. I think could you sum up this process with the reaction we got from the South Koreans when they were surprise by this. Their statement was were trying to figure out what the president means. Which is something we often say here in washington. Yeah. So theyre getting a dose of that. But listening to the president this morning, when he says were in touch with them. Yeah. Theres a chance, i think, that the sputtering engine of this summit process could be getting a tuneup here. What they have do you think that could lead to a june 12th summit . That was the original date. We found out 24 hours ago that was off and now what . It could, but i think it could also lead to a completely different process. More normal process in which the diplomats from these two countries moflly engaged also with the china needs and the South Koreans could in a normal way meet, structure a new process, and put a summit at the end of this business. Or, restructure the summit to be nothing more than a waving of the hands over the negotiators and sending them off. That would be a normal way do this. Quote unquote, normal, if you will. Yeah. Senior white house official was talking with some reporters yesterday at the white house and when pressed on the idea of whether this will actually happen in like two weeks and six days from today, said, hey, june 12th is ten minutes away and theres a lot to speak to johns pointed, that has to happen, jill, before you get these two leaders at the table. Including this advance trip that hogan gidly tells reporters is off. Which i think the likelihood of something happening is very unlikely. But we have to keep in mind here how the stakes have now changed because its not just about the conversations and what are you going to get out of meet, but its now about whether anyones going to show up. This is a president who puts a great deal of importance on the visuals of this all on the honor and the integrity around how it looks in and the staining craft of it. If were now nay position where theyve rescheduled the meeting and theres concern that kim jongun might stand them up like they did the hagan group last week, that would be huge. That would be the worst Case Scenario for somebody like donald trump who has arizona we know and have seen likes to make sure that he has the proper sort of honoraries associated with him. I want to point out the president is at the podium now at that naval commencement ceremony. The second he starts talking north korea well bring that to you life. We have our teams keeping an eye on all of that as it goes down. Charlie, let me bring you into the conversation. Theres another piece of this which is how china fits into the puzzle. What youve seen from our nbc news team talks about how china has been pivotal to perhaps toughening the tone of kim jongun and creating the pullout in the first place. Thats right if the it was chinas hidden hand behind all this is one of the many pieces of the puzzle that makes it difficult to understand whats going on. But i do think that one insight that shouldnt be lost in all of this is that when trump abruptly said, hey, im going to meet facetoface with the leader of north korea, everyone whos hahn expert in t an expert in the ploems diplomacy said what are you zmog thats a gigantic succession. Is may that be that message has sunk in and hes pulling back before he gives something away. I think the chinese angle is interesting because they worry im sure that a bilateral meeting between trump and kim aces them out a little bit. Cuts them out, sure. What they want on the peninsula is more of the same, but take the temperature down a little bit. Saber rattling Nuclear Weapons is not a good idea. I think they probably, guessing here, encouraged kim to step back a little bit. And this puts the Trump Administration in a very difficult position because they want to continue to put maximum pressure, sanctions. Cant do that without china. I want to bring in janice speaking of regional allies who is in seoul for us now. Janice, we know from our reporting that south korea was caught off guard by the initial cancellation of the summit. Now the president is reopening the door to this talking about a warm statement from kim jongun from the North Koreans overnight. Whats it like from your neck of the woods . Reporter well, south korean president moon jaein apparently used the word embarrassed to react to the news from President Trump. He had just been in washington, had just met with President Trump, and they appeared to be on the same page about the summit only to have him drop the letter with absolutely no notice and raise a lot of questions here, at least discomfort about how President Trump regards the u. S. south korea alliance. Today south korean officials met again and they maintained that direct dialogue between the u. S. And north korea is necessary. They say theyre also going to continue to pursue interkorean talks so they can follow through on that agreement that the two sides signed on april 27th. This, hallie, think is what is key, these small steps. South korea saying that its going to push ahead. China giving the same message, that they want to continue to build on the momentum thats been established and having direct talks with north korea to try to boost relations. Perhaps even independent of the United States or President Trump. The view from here is portraying kim jongun as the more reasonable player. The chinese newspapers especially have been playing up the fact that President Trump skew wei sk skewered the iran deal. Kim jongun released the three detainees, followed through on blowing up that testing site and now is willing to come to the table to try to see things now. Janice reporting live from seoul in south korea. Thank you. As janice was talking here im look at my phone, defense secretary james mattis is talking as well. Hes had some interesting comments. Im going to read this to you. I dont think weve been able to turn around the video yet. He says the diplomats are still at work on the summit, the possibility of a summy, thats good news saying weve got good news on korea where we may have it back on even. According to james mattis. And then he says, basically the diplomats are working on it but nothings changed. This is the defense secretary. And, again, we want to plate full context of that video when we get it. But it sounds theres optimism even inside the president S Administration that some kind of talks are going to happen. People shouldnt be throwing out those comment rative challenge coins just yet. Im not going to throw mine away yet. Thats probably a collectable. There were to pieces of any summit. The joe hag began piece this is all the logistics. The planning of it. The planning of it. There air million to one pieces to that. Then theres the substantive piece. Whats the saub substantiative deliverables. But in both cases, if any piece of this is moving forward, then theres reason for a degree of optimism. And then of course the president himself just because of a nice word from the North Koreans may decide, sure, why not, its back on again. Thats the problem with this all. Its like we get whiplash watching this thing because every day its a different story. You know what janice reported from seoul is very important because the meaning of it to me is that were out of step a little bit, maybe a lot with our south korean partners. You really cant do this deal without being at least in close march with them. And they clearly have been taken off guard here. There are two things they would have never done in this context. One of them is they want denuclearization too. I spent a week there bay month ago. They would have put that demand in softer terms than we did and would have left vague a little bit exactly when that happens. Whereas we said thats the ticket for entry. Right. Second, they would have never mentioned libya. They would have never mentioned libya. Well. That is such a clear error that it makes you wonder whether someone in the administration does it deliberately. But it seemed to have been intentional because john bolton said it at the end of the april, the president walked it back may 17th. Walked it back. And then may 21st, Vice President mike pence came out and talked about the libyan model. Its a summit killer that it raises the suspicion that one of these two people wanted to just scuttle this thing, or delay it, which they have. Go ahead, victor. The other piece of that is by putting that out there it brings the chinese closer to the North Koreans side because theyre not in favor of a libyan model either which makes it harder for sblus weve been keeping you two busy on this show. Thank you for coming on. I appreciate it from both uh. Im going to ask jill and charly to stick around because after the break the president s speaking right now to Naval Academy mid shipmen. If he starts talking about north korea, you know were going to bring it to you. He want to talk about a possible answer to the question weve been asking, is President Trump going to sit down facetoface with robert mule center well talk about the president s legal team is saying and how soon we might have a decision. If he starts talking about north quick question. Do you want the same tools and seamless experience across web and tablet . Yes . Great then youre ready for power e trade. Com academy midshipmen. Might have a decision. Academy midshipmen. Might have a decision. We are watching President Trump there at the Naval Academy not too, too far from where we in washington up the road in annapolis, maryland. Hes speaking to midshipmen for commencement. The president got on the ground roughly 40 minutes or so ago. Hes expected to be handing out diplomas in a few minutes. So far no mention of north korea but if that happens we will bring it to you live. We also want to talk about another story thats hanging over the white house. President trumps lawyer read giuliani saying there may be a silver line together breakdown the singapore summit. He says President Trump will have more time to decide whether to sit down for an interview with special counsel Robert Mueller. But giuliani says the president is more likely to meet with kim jongun than the special counsel. He tells the washington post, i think it is more inevitable than the mueller interview. At least they arent going to try to trap him in korean perjury. Joining us via skype, alan, thanks for being on. Thank you. And let me just quickly clarify here, youre not formally part of the president s legal team but he clearly listens so some of the things that you say on television. Whats the last time you interacted with him or talked with him . Well, ive only met him three times in my life. Ive never given him legal advice. Im not his lawyer, i didnt vote for him, i voted against him, but i have strong views on what constitutes obstruction of justice and i state them publicly. Ive written 40 or 50 op eds. And hes reading them. Apparently the president listens or reads them. Thats the only way i communicate with him. You know, ive been a longtime friend of Rudy Giuliani and, yeah, and i, you know, i like him very much. Let me ask you about mr. Giuliani, alan. Again, forgive me because the delay on the skype is just a little bit delayed there. Do you agree with giuliani that a facetoface with kim jongun is more likely than donald trump sitting down for a mueller interview . I think this is part of a negotiating tactic. I think we see two negotiations with north korea or with Robert Mueller . Were seeing hardball being played in both instances. I twhihink with mueller were hearing the president say through his lawyers, look, if you give me the right deal, if you let me sit down to three hours with predetermined subject matter, limited period of time, ill do it. If not, hey, i have my legal rights, ill go to court, well delay this thing for years, i may win on at least some of the issues. I think we see the art of the deal being illustrated both in north korea and in mueller and also with iran. So i think were seeing very much a wheelerdealer negotiating president. Thats his strength and i think he likes to play that kind of a negotiating tactic. Clearly Rudy Giuliani is taking on this roll of public negotiator. Hes out practically daily with new interviews with reporters including here that the network but hes had to clarify some of his comments with mules team. Then he told buzz feed he hasnt talked to the president in a couple of weeks. Told another outlet it was just this weekend. Do you think giuliani is a reliable narrator particularly when it comes to what muellers team is telling him . I think it would be much better for the president if they were able to speak with one voice. It takes time to learn the case. And i think rudy came to the case suddenly and relatively recently and i do think that his most resent comments do reflect the legal team. He has inside lawyers who are playing the inside legal game, no public statements, preparing for all the eventualities. And then Rudy Giuliani whos playing the outside negotiating game. That sometimes say little difficult to coordinate. Talk about the inside lawyers here because somebody who has been in the news a lot over the last 24 hours is white house lawyer emmitt flood who we saw publicly twice yesterday attending these meetings or at least the start of them the white house said with john kelly relate to the debrief of highly classified materials, the department of justice and the hill relate to the socalled fbi informant, the person who talked withsocalled fbi informant. This is emmit flood walking into the hill. The white house said they only introduced the meeting and left. Didnt stay for the rest. Democrats are extremely concerned about why flood was even there. That this is raising questions about the Justice Department sharing information about an investigation with people tied to the investigation. Was it appropriate for flood to be there at all . Of course it was. Every criminal defense lawyer tries to get as much information as possible. The question is not whether or not it was appropriate for flood to be there. Of course it was. Was it appropriate for the Justice Department to share the information with flood. Thats his issue, not theirs. I think any lawyer wants to meet as much as possible with officials, wants to keep his ears open. Wants to get as much information as possible. Perfectly appropriate doesnt the white house have an obligation to also consider the optics of this . I show youre getting another skype call as we speak from somebody else. But doesnt the white house owe the public perspective piece of it to the americans to not have emmit flood show up and ask all these questions . I dont think so. I think flood is his defense lawyer, and flood has the right to get the information. Other people are concerned with the optics. Hes not the white houses lawyer. Hes the personal lawyer for the individual donald trump. And i think hes doing the right thing. Allen, quickly. Im going to make a hard left. Youve overseen a number of high legal profile cases. Theres one with Harvey Weinstein. Have you had a chance to see what ben brafman had to say, and whats the Legal Defense he seems to be foreshadowing here . Allen . I cant hear what hes saying. I was just referencing ben earlier saying Harvey Weinstein foreshadowing a defense that all of these acts that winstein is accused of were consensual. Ive consulted with ben on obtaining the emails in this case. I dont feel comfortable comments on the case as it gets forward. I served as a consultant. We did get the emails. Are you still consultanting with him . I consultanted with him on the emails. We prevailed on that. Right now i have no current task remaining, but i do have a lawyer client relationship with him. I dont feel comfortable commenting on it. Allen, thank you for talking through a lot of topics. I appreciate it. I want to bring in former assistant u. S. Attorney. Kim, lets talk about what you heard saying its totally appropriate for emmit flood to show up on capitol hill and the department of justice of yesterday. Thats not what other outside experts ive spoken with have suggested. Its beyond optics. Im glad you brought up weinstein at the end. If we look at the optics of him today, he was a very powerful person in hollywood. Hes been brought down to a regular person whos going to face a jury of his peers. His lawyers will have to deal with facts and the law, and the process is going to either hold him accountable or not. Whats happening with the president of the United States is hes trying to peek behind the current and manage the prosecution potentially of himself. And those people close to him. Harvey weinstein isnt in a position to be firing prosecuters and demanding information from the investigative team, to be making public statements that theres going to be consequences and that were going to get congress involved to actually Start Holding the prosecuters accountable for doing their job. Its very different and goes well beyond the optics. Its a conflict of interest and deeply problematic for purposes of our criminal Justice System and separation of powers. I dont think americans really appreciate that. The structure is at risk here. The substitutional democratic structure is being broken down by this president before our very eyes, and the suggest that somehow this is normal, lawyering is just a distortion. The white house will make the point. I wonder if this e lalleviates your concern . I guess we get to rely on them for deciding they have integrity rather than them making a decision to abide by norms because the broader questions with respect to our democratic process are important. Emmit flood is on the american taxpayer payroll. I worked for white water independent counsel. I was an assistant United States attorney. There are ethical and just sort of Public Service rules that should govern these decisions. Not just whats best for mr. Trump personally. Very quick final thoughts . Its not just democrats who are questioning whether the president might benefit from his staff being somewhere near this meeting. It was also Rudy Giuliani himself who was asking questions about whether they might glean useful information. Talking about it publicly. This is part of Rudy Giuliani being off script for them. Saying the legal team is entitled to know. He said maybe well decide what we learn before we decide to sit down. Thats the opposite message they were trying to send of nothing to see here. Nothing for being here. Well be right back with todays big picture. baby crying dont juggle your home life and work life without it. And dont forget who youre really working for without it.
