Essentially, versus privacy when it comes to the debate over this controversial spy issue. President paying attention to this tweeting today house votes on controversial fisa act today. This is the act that may have been used with the discredited and phoney dossier to so badly surveil and abuse the Trump Campaign by the Previous Administration and others. So he doesnt seem happy with it. But heres the deal his own administration has been pushing hard for this. So cue the clean up. Quote, with that being said the president tweeted about 90 minutes later, i have personally fixed the unmasking process and todays vote is about Foreign Surveillance on foreign land. We need it, get smart . That vote is set to start in about 45 minutes from now. You hear lawmakers for gn against this act. So well talk more about the politics. But i want to start with tom winter. Because i think its important before we get into a big discussion, explain in plain english wh english explain what phi sa is. It allows the federal government to be able to listen to be able to gather information on and to get the Electronic Communications of people that are even foreign agents or foreign governments, whether they be on u. S. Soil, so if its say for instance a spy from a foreign country that happens to be in the United States, or to be able to listen to people abroad for the purposes of trying to figure out if there is a crime. Or if there is some information we need to be aware of. In addition, on the tear rifrm aspect, if somebody here in the United States is talking to somebody who is isis operative for someone in syria, this is a real example, ittal louls the government to say we need to have a little bit of different process here. Theyll go to the phisa court, we know this operative is talking to this person, and we need to listen to that conversation and make sure we dont have a terrorist attack on our hands. So you look at critics and supporters say. I want to pull up some of the graphics. Because you talked about supporters talk about how they is helpful to conduct surveillance on terrorists in us, overseas, because this is foreign issue, against the u. S. Can be used for surveillance on foreign agents spies on the u. S. Inside the u. S. But critics say, listen, americans information can also be accidentally scooped up in all of this too, right . Thats correct. So it is possible that, for instance, i dont think im giving away a state secret, if i called the Russian Ambassador the chances of my phone call being record rd 100 . So with my information, with tom winters information and my voice be residing on a government server somewhere . Yes, it would. However, for the fbi to figure out, whats going on, we want to be able to listen to toms communications and his side of that we want that information. They would have to go to the court, produce probable cause, and get a warrant for it. However, some people say with all this information being continually collected, it could open up, and i think its an important concern, it could open up some forms of abuse, potentially by those in the Intelligence Community. And you have people like for example senator rand paul talk about on that one part of that. Tom, stand by, because i want to go to Kelly Odonnell there at the white house. Because we saw the tweet this morning. And a lot of folks looked at the phone, really, this doesnt make any sense from the president s original tweet that seemed to be antiphi sa. Because his administration has been pushing for months. Reporter and it was great you noted the time lapse between tweet 1 and 2 here as if it was a continuous conversation where clearly there was an intervening event of giving the president some update, one would presume, about the nature of his tweet and the impact of it. Heres what the white house had previously said about this, with a statement in the oldfashioned way, an original kind of printed statement put out, not a tweet. The administration strongly opposes the usa rights amendment to the fisa amendment authorization act. This amendment would reestablish the walls between the intelligence and Law Enforcement communities that our country knocked down following the attacks of 9 11 in order to increase information sharing and improve our national security. So the Administration Urges the house to reject this amendment, again, Administration Urges the house to reject this amendment to preserve the useful role of fisa section 702 in the legal code. So the president by implication, his tweet sounded as if he was urging one position quite different, not a real gray area, the exact opposite of what the white house had said. And it would appear the president con flights soflates own personal struggles with russia investigation and larger issue. And of tom clancy pop culture back drop of all this, there has been times in u. S. History domestic spying of american citizens done by the government. Thats why the Foreign Intelligence Surveillance Act was enacted to try to create the barriers. Then after 9 11 there was obvious need for more intelligence sharing among agencies because of course we know the hijackers entered the United States and could have been picked up internally and in certain instances were. So thats the sort of historic back drop. Curious thing is the president having two different minds today on this very important issue. Kelly odonnell, thank you very much for that. Again the president is supporting whats on the floor today. Reporter but you dont think the tweets were helpful . It wasnt helpful at hurt. Hopefully its been corrected. Reporter we were talking down in the basement here at the capitol warehouse republicans are meeting behind closed doors and did have a debate about fise and peter king was talking about that. The unmasking which the president first tweeted about was raised by that, thats the memo president signed two days ago to try to address that. The other piece is privacy. Thats different issue from the president raised in a tweet. That is the one we think based on kings comments and others was being discussed behind closed doors today. Now there will be a vote on the amendment on the floor. Thats going to be something to watch. But again that is different from what the president has been talking about. So youve had this kind of broad call for corrections to the president s tweet. One from mark warner. Maybe put that up on the screen there. So hopefully our viewers can take a look at what mark warner had to say. Then the other piece is rand paul and falls into the other category. Tells us this. Take a look what rand had to say. I have spoken to the president but its not necessarily think this is switching position. Administration advocate for reauthorization. So do i. I want reauthorization with reforms. I dont think they are mutually exclusive. Reporter and i should have said senator paul, of course. But as you heard there, he is saying, look, we do want to reauthorize this program but we want additional privacy protections. At this point its not clear those changes will actually be made. Most people on both sides of the aisle are advocating for clean authorization of this bill. But well see here on the house floor if there will be any ra digsal wrinkles in this story. Its interesting because as we are having this conversation, i got a text from someone on the hill with prediction this will give some democrat lawmakers on the fence license to vote now given the president s tweets, given in the eyes of some of them the president is tweeting without fully grasping the issue here. That it may in fact end up being a closer vote. What do you make of that . Reporter i think thats probably a correct assessment. I think the question is going to did the president s clean up tweet, clean up aisle 702, referring to 702 is the sec sho shun of th section of this law we are talking about. First tweet was interpreted as a signal from the president to allies on capitol hill to willing defend, have his back in the russian investigation, willing to say that, yes, this is all a hoax, to kind of go along with president s dismissal of it. But this was essentially say to them, hey, dont vote for this and that would create a problem for this law. Now it does seem that the president has now sent that conflicting reversal signal, so that could of course impact that. Im holding up right now publicly available document out of the District Court of massachusetts, involves two people being involved a terrorist plot and involved another person shot and killed by police and the fbi when he had said on a surveilled line that he was going to kill a cop that day. Law enforcement, federal Law Enforcement according to four sources were able to get up on his communications and became aware of him. And his idea of attacking the fourth of july celebrations in boston, goes back several years ago, were able to get ton to that because they were able to surveil his conversations between himself and top isis operative in syria. So you want to talk about value to the Intelligence Community and to the u. S. Law enforcement community, thats prime example a right there. But stanley there are people who like rand paul have real concerns about privacy, about Civil Liberties here. Is somebody like senator paul wrong in that . No, hes not wrong h there is it a balance that needs to be struck here. And thats what the ongoing issue will be. The president s tweet number two has probably ensured that the law will pass today, even if its a closer vote than before. But the ongoing controversy is not going to stop. And that controversy has to do with how do you protect ordinary americans and their co correspondence and telephone calls, how do you protect that with a court that stands between the use of that information by the government and the privacy that the citizen expects. That debate is going to continue on. And most likely it will come down to a matter of figuring out ways in which you can find a court, fisa court or otherwise that will be able to look at a broad array of information that sits there. In other words, when the fbi or the cia or other agencies, nsa, picks up my conversations with my daughter in france and somebody else is involved, or the other way around, they pick up my name or my daughters name because there is someone there spying on in france, how do you make sure that all at once my daughter and i are not swept up into an investigation which we had nothing to do that. Usually the way you do that is require the government to go to court, heres why we think his daughter is involved. That controversy will continue and it will have to get sorted out in the next few weeks. You mention tweet two from the president , but file this under the tweets have consequences category because now you have ann and kathryn adam schiff Ranking Member someone with nunes pushing this bill, lets withdraw the consideration of the bill because of the president s tweets. Absolutely tweets matter. Thats abundantly clear from the first year in office. But also i think this really speaks to the difficulty of this president as a negotiating partner. We have seen this before. Public statements or tweets have undermined the administrations official positions. What does that say about the people who speak for the president . The people who are tasked with portraying president s positions to lawmakers, to stakeholders here, when you have people like mike pompeo talking about importance and president tweets tweet one this morning well call it this morning . I think it says to them that its going to be they may get the rug pulled out from under them at any moment. Which surely anyone in this Administration Knows is a possibility simply because of the unpredictability at the top. But i think also this episode, and we dont have a full picture yet of everything that happened in that hour plus span. Although i spoke with someone after tweet one you should watch for clean up, retweet or something. Yeah. And obviously we changed our story as the morning went on as things developed. But it shows that there is a disconnect, forget the people out talking on the hill for a moment, shows there is a disconnect actually within the white house in terms of what the president is seeing and doing and communicating essentially on his own and what the rest of the administration is doing. You have three democrats and republicans trying to figure that out. Does it include a wall . What about the d. R. E. A. M. Ers . Will the house get on board. And here to answer is leeann on capitol hill. What are you hearing about the bill . Reporter yeah, hallie, after the wild meeting televised at the white house a couple days ago, the senators said they actually made progress, that it helped them get to the parameters of this bill. So what weve learned is there are four main points that are being discussed and close to a bill. The points are daca. Prompt prom probably going to beal path. Border security, not a wall but authorization for construction of 6 to 700 miles of a fence along the border. Another issue is familybased migration. This will be very minor and limited and it will change as it pertains to d. R. E. A. M. Ers and their families. And, finally the visa lottery system. And that will probably end. And this group of six senators continued to meet after the white house meeting. And they merged from an afternoon meeting yesterday saying they were pretty optimistic. We have some sound of senator richard durbin, a democrat from illinois talking about this. Were still working. We feel very positive we are moving in the right direction. Its time for us to meet the president s challenge and to create a law which solves this problem. Reporter and after the amount of optimism they have in the senate is pretty promising, they said they could announce a bill as early as this he can would. But these senators say their legislation would get the support of 60 senators with a lot more unclear as to how it would go in the house. Already hearing rumbling from republicans and democrats in the house who arent happy about what they are hearing. And they have a lot of work to do over there, even if it does pass the senate. You have the senate bill creating a rift, too, not just among republicans, but among democrats who worry tick did your bdurbin go giving away too much. What do you think . So, yes, there is a constellation here of good will, but the history of this issue is that you get almost to a deal and then it falls apart. And that is history that goes back more than a decade. Law make tears you said you would be open to signing about any immigration deal by bipartisan sent to you. Right. Any solution has to include the wall, because without the wall it all doesnt work. At the house floor where lawmakers are debating the fisa reauthorization act, as i get some text messages, presumably from sources whats going down there, including frthree source inside gop leadership telling us there is no plans to pull the bill from today. That is despite nancy pelosi asking paul ryan to do just that. We expect a vote in about half hour. Well talk about else is happening at the other end of pennsylvania avenue at the white house, this is where President Trump is listening to Prison Reform something championed by Jared Kushner who help prisoners bet back into society. But attorney general Jeff Sessions, hell be at the meeting and heres some of the stuff hes done as attorney general. Last year eased penalties for certain nonviolent drug offenders. Scrapped plans for program that would helped inmates get birth certificate and state id card and new standards for hoff way houses. And heres what happened before President Trump won the white house. Criminal Justice Reform bill, a bill that would have provide add Second Chance for nonviolent offenders facing long prison sentences while also saving tax dollars on prison costs. But that bill was killed before the 2016 election because some republicans, including then senator sessions worried it conflicted with then candidate trump law and Order Campaign talk. So how is today going to go . Joining our panel to talk about all of this is Vincent Sutherland sen it tr on race and equality and the law and former public defender. Also back with us ann and kathryn. Lets talk about the first year of Jeff Sessions as attorney general because he has done a lot from policy perspective. A lot of talk about his fallout with the president , bad relationship with the president but still implementing the trump agenda. So can the actions of the Justice Department exist in the same universe as these efforts towards Prison Reform that kushner wants . Thats a great question. I think with sessions he has driven this return to tough on crime law and ford era that really drove mass incarceration. So thats the question of the day. Hes addicted to filling up the prisons rather than reducing it. Now Jared Kushner wants to take steps for Prison Reform thats part of what the meeting is about. Our friends from axios reporting this. That senator grassley corrections act. This week the American Bar Association asked the senate to do that. So when you look at legislative actions that the white house wants, this is grassley bill a good place to start . I think it is a good place to start. What this bill did or proposes to do is open up opportunities for individuals who have been incarcerated to provide more chances for them to reduce sentences and provide incentives for the further rehabilitation. So this is a great place to start. You talk about obviously you dont agree with the attorney general as it relates to criminal just over at the department of justice. That said, he and others and the president have said tough on law and order. This is what we want. We want to crack down on a ltot of these issues. What else can the administration do if in fact thats what they wanted to do . In terms of some of the things this administration can do, i think they can return to many so of the obama era Administration Policies that were put in place, which really expanded Mental Health treatment, and Educational Opportunities, expanded raised standards for halfway houses, tried to reduce privatization of prisons foreign sure that the conviction and stay in prison is not going to be a basically kind of a bar you from being able to join society successfully. Ann and kathryn you hear vincent say return to obama era policies. But president has showed little interest in continuing those policies. Is that realistic . This is not ha issue where the president has had much to say on his own accord. So we dont really know what he thinks are good, cost saving, or practical solutions. There has been in the past considerable area of bipartisan Common Ground around the idea that america locks up too many people too long too high a cost. That appears to be where Jared Kushner is coming from. Question remains is that something that he can persuade his father of and that something that the administration, including the Justice Department, can get behind in a meaningful way. Right, fatherinlaw, because his dad puts this in a different way with the reports of kushner. Thats a whole other thing. Very different, obviously between Jeff Sessions and Jared Kushner but the white house says they have been working closely. So is there a middle ground here . I think thats obviously the question. Working fr sometime. Talked about it at camp david. I think also looking ahead to this year, year going into midterms they might be looking to find some areas of policy agreement. Vincent, let me go to you for final questions here. If the idea is to cut costs and recidivism, what should it be for President Trump . I think a lot of concerns for criminal justice, that includes investing in individuals. And when they get to prison, really expanding Educational Opportunities and Mental Health treatment and treatment for trauma and other concerns that drive people into drug addiction, and criminal activity. And really reducing the amount of time that people are in prison. Those are the type of thing that this Administration Needs to if he cufocus on. Thank you for being with us on this program. Just weeks after the president signed the sweeping new tax law, the irs is pushing businesses to withhold less in taxes by next month. So workers can get basically instant gratification, meaning see some fatter paychecks. But paychecks. But heres the rub. This is what democrats are complaining about. You may be in for sticker shock at tax Time Next Year because too much was taken out of your pay this year. You may owe uncle sam. This is all because of a rush for republicans. They want to boons their chances and you have this headline, Trump Administration opts for speed over accuracy in implementing new tax laws. And back with me damians Washington Post colleague ann and catherine lucy. Damian, sure, politics, everyone want to play it. Explain the policy that millions more people could end up paying more come tax Time Next Year. Sure. In the next couple days the irs and Treasury Department will give us these withholding tables that dictate how much money the employers will withhold in terms of taxes from our paychecks. If they dont pay enough in taxes in our paychecks and we get much fatter paychecks than we were expecting, it could turn out in april 2019, when we have to pay our 2018 taxes, we could end uppeyi owing money because essentially we didnt pay enough taxes during the year. There is precedent for this, they inattentionally changed the withholding tables to get more money during the year and then they had to owe more in april. The idea was that you had more money at your dispose and pay it back later. That is really unpopular and how accurate are these paychecks going to be and were really not going to know until april 2019 because were going to be basing these changes on old irs documents that havent been updated yet. The government side of it and the private side of it. Companies, businesses updating payrolls and figuring this all out in the next couple months, right . They have to get the w2 forms by january 31st which tells everybody how much money they made the prior year so they can pay their taxes in april of this year but make all these changes for millions and millions of workers by february to get those paychecks changed. It is going to be very fast. Democrats are saying this is a rush, republicans and wanting to get this in before the midterm so people will have several months of seeing bigger paychecks. Who doesnt like that, right . Is that sour grapes or do they actually have a point . Its certainly true that republicans are trying to sell a tax law. Thats not a surprise. Not particularly controversial. Theyre talking about companies are getting bonuses and companies that are, you know, adding workers and, so, the law has so far been unpopular. They are certainly feeling pressure to try to pitch this to the american people. Are democrats taking advantage of that . I think they are to an extent. But republicans say there is no political pressure here. Were not telling the irs to do anything. So, i think absent specific evidence that the white house is saying irs, we want you to juice this for us. This may just sort of go away. Damian, when you look at catherine alluded to Companies Giving tax breaks or benefits to employees because of this tax law. You have walmart coming out now and announcing because of this it will raise its starting salary, basically, its first wage from 9 to 11 an hour and also give out bonuses. Up to 1,000 if you worked there for more than 20 years. A little bit less if you worked there for more than 15 years. What is the political implication for that . That is a great news story. What we have been really frustrated by this economic recovery is that wages have been sluggish to return. We have seen the stock market really roar and weve seen people in the upper tier make more money but a hard time seeing the middle class and lower middle class see their wages. Walmart is the biggest private employer in the country and this will have real consequences for a lot of workers. Target, they raised their minimum wage. They are a big competitor for walmart. They raised their 11 last year so walmart had to do this for business reasons, as well. This is a really positive development. Whatever the cause thats going to be felt by millions of people.
