This is a remarkable turn of events when you look at who the president nominated to fill out his Justice Department officials, he only has three that have been senate confirmed. When you look at the total number of people that hes nominated, under a dozen. And the position of Deputy Attorney general needs to be senate confirmed. Even if the president did fire Rod Rosenstein and thought he was turning against him, leading the investigation, the person underneath him is an attorney named rachel brant. Another trump appointee. You include Jeff Sessions and those are the only three people that would have the authority to remove Robert Mueller leading the investigation in which the president himself seems to confirm is into obstruction of justice. It comes as we got this very curious statement from Rod Rosenstein overnight. Tell me what hes saying and why its so significant. This seems to be a general defense on anonymous sourcing. And if theres any specificity to it, its criticizing u. S. Officials. I would note that after the most recent reporting that Rod Rosenstein may have been referring to, a Washington Post report, an investigation into Jared Kushners finances. They lated updated the story and said u. S. Officials. The criticism that sometimes the officials dont say whether theyre american or nonamerican. It seemed like the post cleaned that up. As you and i know, a lot of times when we say officials here we try to be as specific as we can. It could have been an oversight from the Washington Post that rosenstein seized upon. But they cleared it up and its clear its coming from u. S. Officials. He of course in general is decrying the leak, the unauthorized disclosure of information which is something we hear quite frequently just over in the west wing. Absolutely. It certainly fits into all of the talking points that were hearing from the house. Theyve gone after the leaks and the anonymous sources. One more thing before i let you go. There were other headlines as it relates to Jared Kushner and of course Vice President mike pence getting his own outside counsel. This is significant and underscores the gravity of this investigation. No one ever wants to lawyer up. Richard cohen is a respected lawyer around town. Hes now, the Vice President office confirm, will be served as mr. Pences personal lawyer. The other investigations weve had is this idea of the Washington Post looking into the finances of Jared Kushner, what sort of Financial Arrangements hes had with a bunch of other countries. And then the other really significant moment, this piece of news this morning, the fact theres been a request of preservation from documents from the trump transition official, from the general counsel of the trump transition to anyone who was working on russia or ukraine related matter, mentions carter pink, mentions paul manafort. Thats lawyer speak. Let me put it in basic terms for you. Dont shred any documents. Thats what that edict is coming from trumps own transition officials. Thats an indication they could be expecting some subpoenas quite soon. All of it highlighting the fact that the probe continues to expand. Tremendous reporting. None other than the president himself. And for him to get through this, at some point there has to be more thought to the legal consequences rather than political reactions to things that he doesnt like to hear about or read about. Look, i think the president can do some very good things with twitter. Hes done some very good things with it. But my advice is its better not to comment on it. Let the professionals do the job. Sara, the fact that you have republicans repeatedly saying, lay off the twitter, how much is this making the Republican Party jittery, not only the stunning develop thamt the president is under investigation but because of this message discipline or lack thereof. So there was he made a recommendation, highly respected, very good guy, very smart guy. The democrats like him. The republicans like him. He made a recommendation. But regardless of recommendation, i was going to fire comey. As sara points out, the president is contradicting himself. As this investigation expands, how damaging is it politically . Thats been an interview thats come back to haunt the president significantly. We had a message coming from the white house saying that the fbi comey was fire specifically because of the mentions, the reasons that were given in those letters and then we had in that interview him saying i was going to do it regardless. And so that contradictory message, that lack of discipline has been the reason this things has expanded. The reason they cant seem to shut it down. Even republicans in congress who have often agreed with the president s message, agreed with the president colkol policy wis. Weve seen Mitch Mcconnell say i wish he would start tweeting. Weve seen republicans largely supporters of him and backing his policies on things unpopular still be upset when it comes to tweeting because that has been the vehicle, while it helped him in the election, a legal jeopardy is a different things. And so many republicans concerned its putting their agenda in jeopardy. Kendall want i want to talk about the significance of the Vice President hiring a lawyer. This is answer investigation that is expanding. Everyone expected it to. Thats what happens when there is a special counsel in place. What the you make of this move by the Vice President . I think its a smart move. Not that i think hes in any legal jeopardy but hes going to eventually be brought in for questioning from the special counsel. He obviously had interactions with flynn who is a very very significant person in all of this. And he wants to make sure that even if hes not worried about looking bad criminally that he doesnt get damaged politically. And to do that you get a smart experienced lawyer, which he has, who help yos navigate it so that the moment of truth comes in the interview, your answers are credible, consistent and youre fully prepared. Thats a good move and i believe that a lot of others around the white house may be thinking the same way and there may be more people lawyering up. I think youre right about that. But this is clearly the product of a lot of bobbying by President Trump by influential people, including senator marco rubio in florida who was helpful in craft this plan. I want to go now to ambassador huddleston and ask you about what we just heard from Kelly Odonnell. You heard her make this point, that the goal, according to the white house, is to put the emphasis back on the people and to deemphasize the military. What do you make of that and is that an accurate assessment of what is going to happen here . Well, i think its completely inaccurate. The cuban people and the american people, vast majorities of both want us to have good relationships. And having good relationships means that there will be investment in cuba. And if theres investment in cuba, even in the tourist industry, which the military controls, then that means youre reducing the power of the military in cuba, not enhancing it. So to me this explanation doesnt make any sense at all. What were talking about is senator marco rubios punitive cuba policy, which is to go back to a policy that punishes the revolution and the castros. His argument of course would be that the Obama Administration gave too much to a regime that has been very tough on its own people, that has starved so many of its own people. What do you make of his argument and how do you square that . How do you get around that very real challenge that there are real concerns about how the castros have treated their people . You know, we have concerns about human rights all over the world. Particularly in countries in which President Trump has been visiting or has or its leaders have visited him. Im thinking about egypt. Im thinking about turkey. Im thinking about saudi arabia. But of course we care about human rights and we care about human rights in cuba. But actually Political Prisoners have been reduced greatly in cuba. Cuba has Economic System in which everyone has more or less enough to eat. Free education, free health care. What cuba lacks is individual freedoms. And when the u. S. Threatens cuba, those individual freedoms in fact become more are lessened rather than expanded. If we really want to see an expansion of human rights in cuba, that means taking down the embargo, taking down restrictions and having more inner change with cuba. Weve tried that failed policy for over 50 years. We know it doesnt work. All were talking about here is domestic politics once again. A powerful group, including senators and cubanamerican legislators want to punish cuba and this is an opportunity because trump, President Trump not only made a promise to them but he needs this support of marco rubio and ted cruz and senator menendez. And ambassador, were running out of time. I want to get you on another point, which is that this could also limit information sharing between the two countries. And i know that cuban officials have been talking to the Trump Administration trying to make the case that they have actually helped to make the u. S. Safer over the course of the past year. What do you make of that argument . Have cuban officials been effective at all at persuading the Trump Administration not to limit intelligence sharing . Well, its a place where theyve been most effective is not so much intelligence sharing but sharing of information about crime, narcotics, trafficking and cooperation on health and environment. Those have been the really key areas that help both of us. Also, we have now a potential of 6 billion in investment and cuba has provided 12,000 jobs. This is really going to hurt those people that defepend on a growth of trade and friendship between cuba and the nieUnited States. But one quick final point, if i might. Back this morning the jury told the judge after nearly 40 hours they were deadlocked. Cosby has repeatedly denied all allegations of sexual misconduct. But theyve asked a couple of questions of the judge as they continue their deliberations for whats consider a long time. They asked for a definition of reasonable doubt which is the standard required to convict someone. He told the jury you have to be absolutely sure with no hesitation beyond a reasonable doubt before you can convict someone. The jurors also asked to hear portions of bill cosbys statements about the night in question where he explains was a night of romance, part of a continuing relationship that he had with andrea constand. Cosby admitted that there was a sexual encounter. He says it was consensual. She says it with us assault. You can take from that that the jury is zeroing in on the essence of the case. Reasonable doubt, can they convict him and what business cosby has said about the night in question. And the judge told the jury and the public that behind closed doors the cosby team asked for a mistrial five different times while these 40 hours of deliberations has been going on. The cosby team has said this should stop, this that this should go away, this is clearly a mistrial and they should move on. The judge wanted to make sure that bill cosby understood that if he did declare a mistrial, that cosby could be tried again. It gives the prosecutor the option of trying again. How far along with Senate Republicans . Are they making Real Progress . Reporter well honestly its hard to tell because of the way this process is become conducted. Its this working group of 13 republican senators or so who have been trying to figure out basically a compromise that will get them 50 votes. Theres obviously a lot of concern about some of the provisions in the house bill, especially around medicaid, Opioid Funding et cetera. Weve got both republican and Democratic Senators complaining about the way theyre going about this. Now we do have a couple people i think expressing some doubts about that july 4th deadline in the last 24 hours of so. But thats still the leaderships goal. It seemed like an aggressive deadline when Mitch Mcconnell said it but you know how things work around here, if you dont set a deadline like that fb if you blow through it, youre setting the deadline a little further out in the future. So i think realistically the members of congress have through the summer to try and tackle independent legislative initiatives if you will. When we get into the fall were going to be facing a lot of governing by crisis which is to say that the funding runs out for the government. Theyre going to deal with the funding bills and thats going to shove any of this stuff to the side. If they want to do it, theyve got to do it now and its not clear right now that the republicans have the 50 votes to be able to move this forward. A lot of important paints oiu bring up. Let me get evan to weigh in on some of this. Talk about the fact that a lot of this is being done behind closed doors. What do you make of that apro p approa approach . Is it effective . I make two things of it. First, i think doing it behind closed doors is because the republicans fear the pr fallout. This is a toxic bill and nobody likes to see the sausage made and that sausage is really bad on top of that. And doing it behind closed doors is not helpful to the overall goal of fixing obamacare. In you look at it in 2017 onethird of all counties in the United States have only one insurer or even no insurers. And in 2016 that number was 7 . So obamacare is clearly broken. When you do it behind closed doors it doesnt allow input from people who have good ideas. This should be written by the committees that deal with it. The Health Committee would be a great place to do it and we could get ideas from republicans ap democrats that get behind the telemedicine that could lower the cost of care and increase the quality of care without making massive changes to way that medicare or medicaid works. Take is inside what youre hearing from members of the Republican Party, of the republicans that want to see progress on health care. What happens if members of congress, if senators go back to their home districts without getting anything significant done . I mean how much urgency is there to make sure they can show some progress, can tell votes hey, were trying to carry out the promises that we made to you. Well what were seeing here from the people i have spoken to on the senate side, they know theyll end up passing some sort of a bill thats different from the house version of the bill. By july 4th, you think . Are they saying by july 4th . I would say closer to bastille day. They want to be able to say listen, we as the senate did our job. We passed a bill. They know in reconciliation the gulf is so wide that it will be impossible to bridge and that this bill is going to likely fail there. If it fails there, thats a huge problem for us in 2018. It could be better off in the long term in that maybe republicans and democrats will come together and craft a bill to fix obamacare that is long lasting and actually has a meaningful impact that lower to cost of care and increases the quality of care. I want to bring my panel back in. Sara, one of the striking developments this week, and there were so many, was that the president , we learned, referred to the house house care bill as mean. And then he urged Senate Republicans to try to get a deal that was more generous. How much does that ruffle feathers on the house side but make it really tough for Senate Republicans as well . Obviously Senate Republicans are struggling to get members on board because theyre afraid that theyre going to face blowback by cutting regulations too deeply. It doesnt help to have the president out front saying this is mean. But you saw much more legislation. President trump was inviting members over for bowling. You havent seen any direct interaction from the white house and the senate so far. I think there is a recognition in the administration that there has to be leadership from the top because Senate Republicans are just not getting there on their own. Pick up on that point, do you think were going to see the president get more engaged as we get closer to that all important july 4th deadline, which Senate Republicans have imposed on themselves . It would seem so. I mean, the comments he made in private would suggest that hes happier with the place that the senate gop bill is going. I would say it is interesting because we dont know whats in it. It is difficult for us to understand and ask questions about what is in the bill. We havent really seen a full defense of the bill from people on the gop side. They have had that kind of behind closed door process. To pick up on sarahs point, there are vulnerable members of the house gop who voted for the American Health care act. These are now people who are going to have to go back to their districts and say, the president himself called what you voted for mean. Thats going to be difficult for them to do. Think about people who are vulnerable in 2018 and really stuck their necks out there to back the president , came over for that kind of celebration on the rose garden. Now, the white house has done a full 180. It is a slap in the face. Kasie, i want to go back to you and talk about the timing of all of this. Based on my conversations, if Senate Republicans cant get something done this summer, theyre up against some really tough deadlines. In the fall, the debt ceiling, among other things. How much urgency is there to get something done before the fall, and what happens if they dont . Whats your sense . Yeah, look, i think there is incredible urgency to get it done before the fall. Its why they set the july 4th deadline. It was, i think there was a sense it was an unrealistic deadline. Again, sometimes to get things done, especially in the senate where everything moves like ma l malaysis, you have to set a earlier deadline. If they dont get it before the recess, the chances for it to get through diminish significantly. Republicans know that. Then youll run into the debt ceiling, youll run into the end of the fiscal year, potential for a government shut down. This is going to get pushed to the wayside again. Senate republicans are feeling pressure from the white house, yes, but also from the voters theyre going to be facing pretty soon. Dont forget, the midterm campaigns, yes, they are in 2018. That is not that far away, if you are somebody running for reelection at this point. If they dont get this done this summer, they will have basically squandered the year that they had to do make legislative achievements without electoral pressure. Thats a significant thing. I would say fantastic point. Go ahead. Kasie is right. But the white house rose garden celebration is what i worry about as a strategist. I think democrats are licking their lips at being able to have a split screen ad of a republican congressman celebrating passing the ah doctor,ahca, and the other side is a mother who cant get access to health care for a sick child. Obviously, some of his supporters might not be happy, but you have a lot of dreamers briefing a sigh of relief today. We had President Trump signaling this before. Had shown some sort of sympathy towards Young Children who had come here. I think in my reporting, what ive seen at rallies and other places, even in situations where people were fairly harsh on the act of immigration, there was some idea that maybe children should be spared from that sort of language. So i dont think there is going to be a lot of blowback. I think in terms of the fringe, the far right, the hard line side, there will be some disappointment. All right.
