House. Morgan brenner will be joining us later. I want to start with these executive orders today. When we talk about the Immigration Enforcement orders, what do we expect to see . Where is it happening . Walk us through it . Busy day here. When you get back to the white house, President Trump is going to head over to dhs this afternoon. And hes expected to sign an executive order that would direct federal funds to begin the process of building that border wall. That Key Campaign Promise that was so signature to his campaign. Now how will it actually work . The Administration Says there are preexisting funds but when you look at the cost, it is going to be incredibly expensive. According to a gao report, it could cost more than 6 million per mile, per single layer of fence. If he needs additional propriations hell likely need ngressional approval for that. This is a thorny process. He also says ultimately mexico is going to pay for that wall. Thats something Senior Administration officials continue to insist. But as recently as january 11th, hallie, the president of mexico, Enrique Pena Nieto was quoted as saying, mexico, of course, will not pay. And President Trump will be meet with the president of mexico in the coming weeks. It sets the stage for that bilateral meeting. We also expect him to sign another executive action thats going to prioritize the, quote, removal of criminal aliens. And also in the works, steps to take put into action those extreme vetting measures he talked about which would potentially call for preventing refugees from majority muslim countries like syria, like yemen, like iraq and iran. Immigration will be the focus. Highly controversial measures here, hallie. But this is yet another moment where we see President Trump saying, i am putting my Campaign Promises into action. Hallie . Kristen, one more quick question from you on these allegations the president has made. Without evidence these baseless, false, inaccurate claims of voter fraud. The white house has been pushing this and now the news that the president wants an investigation into this. Do we know anything else about how this would work hypothetically . Well, look, you and i were in this Briefing Room where im standing right now, hallie, pressing sean spicer, the press secretary, on this very matter saying if the president is going to make these claims that there was widespread voter fraud, why not call for an investigation. Early today, this was the tweet from the president himself who tweeted out, i will be asking for a Major Investigation into voter fraud, including those register to vote in two states. Those who are illegal and even those registered to vote who are dead and many for a long time. Depending on results well strengthen up voting procedures. How is this actually going to work . Those are the questions well be asking today in the briefing. Heres the other thing. Whats the timeline on this . When is this investigation going to begin . Those are details the white house has not yet provided. Kristen welker, my colleague over in the Briefing Room of the white house. Thank you very much. And we you are coming with us here on a very busy newsweek. I want to start by this call by President Trump for an investigation into voter fraud. Whats your overall response . Thank you for that question. We know in less than a week that President Trump now lives an alternate reality. He just makes stuff up. Hes lied about his small inauguration crowd size. Hes lying about 3 million to 5 million voters voting illegally, and my response is, bring it on. I want a lot of investigations because i will bet a great bottle of California Wine that they cannot find a single credible witness who will take the oath in a congressional hearing and say, yes 3 million to 5 million voted illegally because thats just a false fact. Why not have an investigation to put it to rest. You sound like youre saying, thats exactly what you want to have happen. The judiciary committee, i oopt. Shut the door on it, that kind of thing . Yes. I want hearings immediately. I want to see them bring up witnesses that will validate President Trumps claims because they wont be able to find any. A poll from the economist from last month finds more than half of republican and independents and more than onethird of democrats actually do believe millions of votes were cast illegally in november. Again, no evidence to support this. I want to be very clear on it. But when you look at those numbers, is that concerning to you . Why does this story line resonate, even with democrats, people in your own party . It is highly trouble chicago troubling, which is why i support investigations. This is going to show that President Trump is lying. Theres really no other way to put it. Hes just making stuff up. We live right now with a white house that puts out alternative facts. We have a president that lives in alternate reality. Its highly disturbing for america this is happening. I want to talk about what else about the president is doing today. Hes heading to the department of Homeland Security where we expect him to sign some executive actions that would, for example, start work on this border wall with mexico that would direct Immigration Enforcement to start procedures to prioritize the deportation of criminal aliens, as the language says. And then theres also plans in the works we have been reporting for the president making good on his promise of extreme vetting. This, i imagine, is personal to you. You are one of just 24 members of congress who came to this country from another country. Came as a child with your family. So this feels like it is personal to you. What do you make of these executive actions the president is taking, particularly when it comes to the possibility that he may end up temporarily banning refugees . As an immigrant, i understand that one of the things that makes America Great is that we are a nation of immigrants. My first reaction to these executive orders is that lady liberty is crying. When you look at President Trumps vision of reality, it is simply not factual. In terms of a wall along our southern border, he is trying to address a problem that does not exist. Net migration from mexico since 2008 has been negative. For the last eight years, more mexicans have left america than entered. And now were going to go on this big federal boondogle spending billions of dollars for a wall thats not going to solve the difficult immigration issues facing america. Theres obviously the question of who would pay for this wall. The president has consistently said it will be mexico. Mexico has said it will not. I had one Senior Administration official say to me a little while ago that there may actually be more of an appetite in congress to get behind some kind of funding for the wall because of the way that their constituents feel about the plan. Do you buy that . Absolutely not. Talking about democrats in congress, not just republicans but specifically, the argument was that there will be some democrats who are in vulnerable seats who will end up backing this. I dont think thats going to happen. Mexico is a sovereign country. We cant make them do anything. They are not going to pay for this wall. The american taxpayer will. Thats why you see these proposals by the republicans in congress to try to cut social security, cut medicare because they need to provide funding for stupid ideas like this physical wall. At least under president george bush we had compassionate conservatism. What wer seeing now is crazy conservatism. These are extreme ideas that a majority of americans do not support and thats why you saw the huge people rallies turning up for the womens march on january 21st. So congressman, how do you try to stop what you are calling crazy conservatism, if the end goal presumably would be to work with republicans. You need to work with republicans as a democrat in congress. Do you think that rhetoric helps . I do because keep in mind donald trump and the even with republicans . Yes, because what youre going to find out is youre going to see a significant number of republicans who do not support donald trump because they dont agree with many of his policies. Speaker ryan has to come up every couple weeks and Say Something public to contradict what donald trump has said. So speaker ryan publicly came out and said, no, were not having a deportation force. Speaker ryan said, no, were not going to impose tariffs on american companies. Youll see a reaction from not just democrats but also republicans to more of the extreme ideas of this alternate reality based president. Youve proposed a bill to stop the president from launching a Nuclear Strike without a declaration from congress. This is not something you brought up under president obamas administration. Are you solely doing this because of donald trump in the office . No, i introduced this bill with senator ed markey last year. I expected Hillary Clinton to be president so this would have applied to her. And the notion is very simple. The framers of the constitution put all these checks and balances on the president with the judicial branch, legislative branch and then they gave the greatest power they knew at that time to congress, the power to declare war. Theres no way they would have let one person, the esident, launch a Nuclear First strike that can kill hundreds of millions of people in less than an hour. That is war. And if you dont define it as war youve read it out of the constitution. Our legislation is very simple. It says a president cannot launch a Nuclear First strike without a deck raalation of war from congress. Okay. For the first time ever, the Dow Jones Industrial average rallied at the opening, crossing the 20,000 mark. Cnbcs Morgan Brennan has been kind enough to hop networks and join us here. Why is this such a big deal . Why should people at home care . If you have a 401 k or another type of investment, then its probably gotten bigger and particularly postelection. Post that november 8th election. So the dow 20,000 is obviously a big round number. And when you put it in perspective, we only hit 19,000 back on november 22nd. So this has been a move, about 5 move to the up side in a little in about two months. So its a very big move. In terms of whats been driving it, its been financials. Boeing reported better than expected. United health. A number of these components have moved dramatically over the last couple of months. So President Trump, unsurprisingly, on twitter reacting to this where he often reacts with great with an exclamation point. Kellyanne conway is calling this the trump effect. Is she right . Is there any indication the reason why the stock market is rallying like this is because of the president . Certainly weve been calling this something of a trump rally. You have seen the stock market move higher postelection. The fact we saw this move from 19,000 to ,000 in about two months, that is the second fastest 1,000point move in the history of the Dow Jones Industrial average. Just to put that in perspective, the move from 18,000 to 19,000 on the dow took a little over a year. So this was a very dramatic move. And certainly when you see whats leading the charge, as i mentioned, financials, bank stocks, its these ideas, these perspective policies that we dont have yet but the prospective policies of Corporate Tax reform, deregulation. You have these executive orders signed in in President Trumps first days in office. All of that is contributing to this rally. The question is, can it continue . Including one that gets the ball rolling on his signature pledge, right, that pledge to build the wall. Build the wall with mexico. Well, were live on the border with mexico in the town of nogales, arizona, with Gadi Schwartz. We saw you in the live tease just before the break. Theres a fence up where you are. How effective has that been . This is one of those border fences. We just spoke to a man on this side of the fence. Its not particularly effective. Somebody can get over this fence in about 15 seconds and he also said when we asked him about this wall, the same principle applies when it comes to a wall and a fence. People that want to come over here will continue to go under it or over it. We know what a border fence looks like. This is just part of a 700 miles of a border fence between the United States and mexico. The rest of the border is unprotected. Its a 2,000mile border. There are Border Patrol agents out there but not a border fence like this one. But President Trump has said he does not want a border fence. He wants a border wall and mexico to pay for it. Thats that constant refrain we heard throughout his campaign at his rallies. His supporters saying build a wall. Build a wall. But here, residents dont think this type of wall will be effective and they are worried about the costs. This particular stretch every mile is about 6. 5 million. A wall would be considerably more expensive. Obviously, donald trump says mexico should pay for that wall. Mexico says they are not paying for that wall. And, oh, we have talked to immigrants in this area. They say theyre not paying for this wall either but they are happy to be paid to work on this wall because they dont think its going to stop immigration. Hallie, back to you. Gadi schwartz there in nogales, arizona, thank you. I want to bring in the executive director of the National Immigration forum. Thanks for joining us on the hill. Lets pick up where gadi left through. The president to follow up and actually build the border wall. To take him literally on this pledge. Hes going to spend over 40 million of taxpayer machine to build a wall that will do very little if anything to secure our nation. There are better and martyr wsm ways to do this. Better use of technology, better use of manpower and more strategic use of infrastructure. If he wants to spend money on the border, he should be spending money at ports of entry where we see the maurjority of drugs, guns and money. I think that there are some in the administration who might say, he promised to do this. He ran on it and he won. Americans elected him into office based, in part, on this pledge. Why wouldnt he follow through. A very large number, 60 of trump voters supported his candidacy, elected him to be president but are quite concerned about his immigration actions. Many of those well see rolling out today. Another one is the possibility our reporting is theres definitely going to be the border wall executive action and one to prioritize the deportation of criminal aliens, although still not clear how that delivers fromurrent policy and possibly something on sanctuary cities. Essentiall cracking down on these cities for refusing to cooperate with federal authorities. Theres no such thing as a sanctuary city. A lot of conservatives would disagree. A lot of conservatives are lawyers and theres no Legal Definition of a sanctuary said. When we talk to Police Chiefs theyve taken an oath to serve and protect the integrity of their community. If the federal government comes in and big foots local Law Enforcement, mandating they take on Immigration Enforcement responsibilities, that trust is frayed. The entire community is much less safe. Thats bad Law Enforcement. Smart Law Enforcement is actually they have Immigration Reform that requires people to attain legal status, pass a criminal background check and pay taxes. Another thing in the works is a plan to follow through on his pledge for extreme vetting. In other words, something that in the language thats still being crafted would temporarily ban people coming in from certain muslim majority countries based not on religious purposes or religious background but history of terror in some of these nations. Your take. This is a back door plan to get to a ban on muslim immigration. You think this is just sheep by a different name . Yes. Whin you look at our Refugee Resettlement policy and security vetting that goes on already, an individual before they set foot in the United States of america, they are going through two years of security checks and theyre residing in really difficult refugee camps. Theres nobody leaving syria today and coming to the United States tomorrow. They are fleeing syria today, staying in refugee camp for two years and then eventually, maybe, possibly getting to the United States after theyve passed these security checks. I think this is, again, bad policy. There are better and smarter ways to secure our nation. And to make sure that we hold our values as a welcoming place. In a little more than a week, a week from tomorrow, President Trump will make one of the most consequential decisions of his presidency. Something that frankly when we talked to his supporters around the country was a big reason why they voted for him. Were talking about his Supreme Court pick. Its going to happen thursday of next week. Announcing the person who will replace Justice Antonin Scalia on the bench. Right now three federal judges based on our reporting are considered the top choices for the new administration. Here to give us a closer look at the contenders is amy howe. Thank you for joining us. Can you give us the overvi of these three leading concontinuedconcontinued contenders and who might have the best shot. Neil gorsuch. Stock has been rising and falling. Hes a judge on the u. S. Court of appeals for the 10th circuit. Hes been there since the bush administration. He was appointed at a very young age and worked in the Bush Department of justice. Has sterling academic credentials and is regarded, i think, as the judge among these who would be most like Justice Antonin Scalia. Hes regarded as a brilliant writer, really incisive thinker. Judge William Pryor on the 11th circuit had been regarded as one of the favorites. He has a very strong backing of senator Jeff Sessions, trumps nominee to be the attorney general. He actually worked as the Deputy Attorney general of alabama when sessions was the attorney general. He has come under fire, though, both from the left and from the right. On the left he called roe versus wade an abomination and had filed a brief with the Supreme Court urging the court not to strike down a texas law that criminalized private consensual sex between samesex partners. The case of lawrence versus texas in 2003. That was something that shou be left to the states. Hes also come under fire for a decision in which he voted to uphold a Federal District courts ruling in favor of a transgender woman who alleged shed been fired because of her transition from a man to a woman. So his stock has if you listen to the rumors, has fallen a little bit. And the last candidate, Thomas Hardeman has got a great back story. Hes the first person in his family to go to college. And he drove a taxi to put himself through law school at georgetown. Hes a solidly conservative judge and i think he may have the backing, which i think would be very important, of another member of the u. S. Court of appeals for the 3rd circuit, marianne trump barry, who is the president s sister. Republicans have the majority of the senate here. Once President Trump picks either one of these people or throws a curveball with somebody else, is the confirmation going to be smooth sailing or will democrats have some power to pump the brakes, to intervene . I think its going to be relatively smooth sailing, especially if he were to go with someone like gorsuch or hardeman. Gorsuch would be difficult to oppose, even though hes taken some very conservative positions. And you probably have a lot of support among the group of sort of washington lawyers to the extent that matters on both sides of the aisle. I think if he were to nominate pryor, it might be tougher sled, but that hed ultimately be able to get, really, whoever he wants through the senate and on to the Supreme Court. I think theres also a sense that this is to this is a nomination to replace judge Antonin Scalia so, really, whoever trump puts on the court is not necessarily going to change the ideological balance that we had before Justice Scalia died in february of last year. The really big fight could be the next nomination, whenever that is. And whenever that does happen, amy, well be coming back to you and scotus blog for sure. On press releases, on social media, as the administration gets it together and figures out how to put their policies on the web pages and what their sort of forwardfacing policies are going to be. Do you is that a fair argument . Is that valid . I dont know if i totally buy that. Not sure i totally reject that but it speaks to this larger story about kind of trump world in which they really care about controlling information in their sort of own particular way. So i think that its kind of speaks to some of the big changes well see in d. C. With this new administration. One of those changes may be happening as early as this week. And thats a plan to follow through on a Campaign Pledge that donald trump made for extreme vetting. Still not clear the nuts and bolts of that but already reaction from the national iranianamerican council saying that donald trump is making good on the most shameful and discriminatory promises he made on the campaign trail. He called for a muslim ban and is now making the first steps to implement one. This will not stand. The American People are better than this. Setting aside we dont have the wording on what the legislation would be, how do you see this resonating globally from, you know, allies and adversaries around the world . This is a huge sweeping thing hes been proposing to do. Its still unclear what this would look like. They talked about what the extreme vetting would look like. But the nuts and bolts of it it was never really laid out. This ideological test. Do, they line with certain socalled American Values and that type of thing. In terms of how this workss, we still dont know. This is something that could have a large impact on our relationships with our allies in the middle east. Somebody said to me this morning the biggest story to watch as you cover sort of populist movements around the world and here at home obviously and the conservative movement is what is the relationship going to be between the Trump Administration and members of congress, republican lawmakers and the leadership on the gop side. How do you see that playing out . It feels like over the next couple of days, thats going to be the headline to watch. How they react to this extreme vetting pl. We are in a new situation here where theres a republican president and republicans control both houses of congress. But theres still a lot of tension between donald trump and the socalled republican establishment, which hes sort of vanquished. One thing thats going to be a key story this year is going to be the relationship with paul ryan. The hiring of juliana hawn who has been critical of ryan to serve in the white house is seen as a shot across the bow from steve bannon to paul ryan. Theres definitely still tensions that have not been actually resolved. Even though publicly they are saying, everything is great. We meet and talk and all is good. Im worried, yes. Because its going to take a lot of resistance. We need to take a page out of republicans playbook when it comes to this. The morale is low in this country. So we need to see our elected officials, especially democratic elected officials show up and fight. I really only woke up politically a year ago right before the election when i realized i had done nothing. We need leaders. I need a leader. So we tried to get on the chartered its a regional train that members of congress are on. Republican members of congress are on. Alas they would not allow us to travel in their closed train compartments so we got on the neighboring acela heading up to philadelphia for this retreat. We saw they all came through the amtrak station. A lot of sweaters and kids. This is a casual affair, this retreat they do. Although not really this year. Its a really intense period of time for republicans on capitol hill. A lot of them are, you know, weve been talking about just how much has happened in the last 72 to 48 hours. Members of congress are feeling that exact same way. Every day, every hour even, they are grapple with a new set of questions. In the case of republicans on their way to disretreat, a lot of them facing tough questions. Answering what trump has had to say and his Spokesman Sean Spicer has had to say over the course of the last couple of days. Today its questions about that border wall executive order because at the end of the day, congress is going to have to pay for it. Theres some money to kickstart the project. And i dont know. We maybe have a quick sound bite from congressman Pete Sessions of texas, if you want to take a look at that. Were going to figure out whether we where we ought to have the wall, how much its going to cost and how much we need to pay for. So the challenge here, of course, the border very long. There are a lot of different circumstances along it. Its often not as simple as simply building the wall. Texas is a state, obviously, the border is much of it is long the rio grande river. That presents unique challenges. Many members in texas are used to dealing with that. Now theyll have to confront a president who wants a simple solution to that. Some republicans are acting with trepidation if you look at senator john mccain on morning joe asked about these reports. Concerned about this. Of course they are concerned by it. What you have is a president who is impulsive, who is not making smart decisions. Why in the world do you have a general matt,is, secretary defense and others and they are not weighing in on this. This raises the issue about americas credibility across the globe. We saw the impact of these private sites, also Guantanamo Bay, the videos released, the impact when it came to spurring more terrorism. This is one of the fundamental problems. America is a leader when it comes to human rights. Donald trump seems to not give a damn. Sarah . I dont think we know anything about what donald trump is about to do but, obviously, human rights of, of course, important. But i dont think what were dealing with here is, lets totally abandon human rights or lets keep all human rights. What were talking about is finding a way to get to terrorists before they come to our shores, which i think everyone agrees on. I think donald trump is going to be aggressive in pursuing terrorism and, remember, this president sorry, the outgoing president was the one who called isis the jv team. Donald trump is taking this seriously. All the options on the table. The outgoing president held a job in firing a number of drones taking out various leaders of isis and al qaeda. I dont think any republican, even yourself, could doubt his resolve in killing terrorists. That was clear, including osama bin laden. I have one minute left.
