Headquarters in new york. Guessing game. President trump threatening an investigation to hunt down the author of that New York Times oped as more seep ynior offici deny their involvement. It is something about which comedian john stewart has been outspoken and the former host of the today show will talk about it. We begin with the search for the white house staffer who penned the oped for the New York Times four days after it was published the Trump Administration appears no closer to finding out who the author is. Among the claims made about the administration is that there were early whispers within the cabinet of invoking the 25th amendment. Vice president mike pence made the media rounds pushing back on those comments and some others. One of the claims made in the oped is there had been discussion of invoking the 25th amendment to remove the president from office. Have you ever been part of a conversation about that . No, never. And why would we be . Joining me is david glitch, lacklin and eliza collins. Let me start with you. You and your colleagues wrote a piece about how this is resonating around the white house. Youve heard them come out and deny their involvement. Is there an identifiable melody to what theyre saying about who might have written this oped. Last we heard it was a guessing game. Everyone has their theories. Certainly folks in the white house and allies are pushing sort of dual messaging, one of which is that this is probably a lowlevel official with no real insight or power in the administration. But at the same time, it kind of confirms a major Trump Administration theory about sort of internal resistance against the trump agenda. This idea of a deep state of mostly career officials that are sort of out to get trump and out to undermine his agenda from the inside. So theres actually a Little Something here for everyone. If you oppose trump, youre probably hearing what you already thought about the direction the administration is going and concerns about it. If you support trump, youre hearing that there actually is this sort of deep state that is out to get him and out to prevent him from sort of remaking the federal government in his image. Lets talk a little bit about the response here. Kellyanne conway, an adviser to the president was on meet the press and one of the things he asked her was the degree to which they can afford le jgitimy by weighing in as they have, to have the Administration Come out and say it wasnt them. Whats your response to this oped and the book scheduled to be published on tuesday this week . Certainly if the effort was to if the goal was to perhaps distract from the news of the oped from the news of the woodward book it doesnt look like some of the most Senior Administration officials are in the white house are doing a very good job. As youve noted, we have seen one person after the next coming out publicly denying any sort of involvement, any sort of knowledge. We saw of course the Vice President making the rounds on the morning shows this morning and denying any involvement from himself, from his staff, even taking the extraordinary step of saying he would be open to taking a lie detector test. Whether it is the oped or dealing with the allegations coming out in the woodward back, theres no doubt they are continuing to cast a spotlight on this and the story does not appear to be going away anytime soon. Over the course of the last week, you and other reporters have been talking to people on the hill, talking to members of the administration. There was a game taking place where it seemed like every reporter was getting someone to deny he or she wrote it. What are lawmakers saying . There have been a couple of strong statements from folks like senator ben sass but it ends there. What are you hearing from lawmakers and how its resonating the capitol hill. Republican lawmakers trying to walk the fine line. You have ben sass and bob corker and some sort of putting their name to it, but the sort of rank and file republicans and Republican Leadership are trying to figure out a way to basically say this is really bad, this person should resign, this is inappropriate. I had someone say this person is a spy, this person has no personal integrity. But they will not go so far as to say congress should get involved. The message was clear its the administrations problem, yes this person should resign but this is like an employee issue but we dont want to get involved. There was one exception and thats congressman mark meadows who is a close ally on the hill. He told me pretty early on he was exploring some options. Hes the chair of the oversight subcommittee. But he didnt really know exactly how he could do that. I think he was just trying to kind of ally himself with the president and say well, were looking into this. But even he didnt know quite how congress could do anything. I want to turn to you on the subject of president obama being back on the campaign trail. He was in anaheim yesterday for Democratic Candidates who were in districts Hillary Clinton won back in 2016. Lets take a listen to some of what he had to say yesterday. If we dont step up, things can get worse. The good news is in two months we have a chance to restore some sanity in our politics. I cannot tell you all across the country you can feel the energy. You can feel people saying oh enough is enough. I want to ask you about how the Trump Administration is reacting to this, the presence of president obama on the campaign trail. There was this retweet from former congressman Jason Chaffetz talking about the American Dream realized as a result of having donald trump in the white house. How does this complicate the plans this white house has to campaign for republicans here going into 2018 midterms . Well, its remarkable really that president obama is the closest thing even after hes left office that democrats really have to a unifying figure right now. Theres really no coalescing behind a single potential 2020 challenger. Obviously Hillary Clinton is not really seen as standard after her loss. So having president obama back out there, you know, is sort of a throw back to a more unified time in democratic politics. And thats probably what hes hoping is that he can be sort of that unifying voice at a time when theres a lot of ideological turmoil in the democratic party. And so to the extent that he can help sort of rally the troops to get out and vote in the midterms and then, you know, potentially lead up to this challenge to trump in 2020, you know, theres really nobody else that democrats can turn to at this point to do that, so i think thats the role that theyre hoping obama will fill and it might be the role that the Trump White House is concerned he will fill. Katie, what did you hear from him yesterday . It was so interesting to watch that speech after watching the one on friday. He was dressed differently. On friday he did talk about President Trump by name. He didnt do that yesterday. What did you make of the message and what do you make of these candidates hes chosen to stand up for in california . You youre looking at where hes been. He has kept a lower profile compared to a whole host of other democratic leaders. No doubt he is someone that a lot of democrats are very nostalgic for. The fact that he went to a number of districts that were won by Hillary Clinton even though previously actually long been republican held territories seems to suggest hes going to be out there looking to rally and encourage the Democratic Base to in fact get out there. The Democratic Base is already extraordinarily motivated to turnout. It is important to note that when we talk about president obama being a unifying figure on the left, he is certainly also a unifying figure on the right and to the extent that republicans maybe need a little bit of a boa boost of energy to turnout on the other side, seeing him on the trail may add to that on that front as well. Liza, do you agree with that . Im so glad katie brought up that point. Just as democrats are excited to have president obama back, republicans are excited. Theyve had nancy pelosi. Theyve talked about Hillary Clinton. Obama is the most recent president and that he has policies. He has eight years of policies that republicans really felt were the wrong direction. And it allows them to talk about trumps policies. Not trumps tweets. Not trumps controversial statements. But if they said remember what obama did, you didnt like obamacare . Well, President Trump and the republican majorities are trying to repeal it. It allows them to basically talk about what they feel trump has done the best and thats sort of his deregulation agenda, the republican majority in congress, and somebody might not be that excited to come out and vote with trump at the top of the ticket sort of. Hes not up for reelection. But knowing that obama is trying to push to get democrats back might get someone to the polls, a republican to the poll. Lets live a while longer in the vacuum you described, that leadership vacuum in the democratic party. Weve been through the latest confirmation for the Supreme Court justice. We saw senator harris speaking out, there was exchange about what affiliation he had that might represent mr. Trump. Corey booker by releasing the emails did more to make a name for himself. There was a landmark piece in the boston globe which senator warren laid out her academic record in full for the first time ever. Who is beginning to emerge in that vacuum as you see it. The three you just mentioned in the kavanaugh hearings were sort of a great opportunity to really make a name for themselves for some of the senators. There were of course some unfrsunfr unforced errors that im sure senator booker and harris had avoided. Corey booker sort of going rogue and releasing documents that had been cleared for release. But there are others to keep an eye on. Folks like kirsten ji were going to start looking out for these big forums where people are able to make a name for themselves, show theyre standing up to trump, layout their agenda and so on. The fact that these hearings have sort of taken over d. C. For a week was a perfect platform and were hearing corey booker is now sending staff to iowa. Its less speculative and more i mean, the actual groundwork is being laid. Its getting pretty clear who is throwing their hat in the ring. Senator booker making a dinner reservation. We were just talking about the political fallout from the publication of the New York Times oped. It is certainly occupying President Trump. The president has indicated he wants his attorney general Jeff Sessions to open up an investigation. Do you think Jeff Sessions should be investigating who the author of the oped piece was or who said i think so because i think its National Security. I would say jeff should be investigating who the author of that piece was because i really believe its National Security. Joining me now an nbc legal analyst and Chuck Rosenberg with me who is a former u. S. Attorney. The president said in the interview on air force one this is a National Security issue. He reiterated that in another interview with a local tv reporter before a Campaign Rally he gave as well. Whats your read of the legal side of this here . Again, the president stressing that he thinks jeff should look into it. Sarah Huckabee Sanders saying thats just the president opining. Not a direct order to the attorney general. Whats your read on whats happened . I have a very different read not surprisingly. Look, this is not a crime. As far as i can tell, its not a crime. Its First Amendment protected speech. Stuff in the newspaper could be a crime if we were talking about the disclosure of grand jury information or classified information or tax information. There are statutes that prohibit someone from doing that. Whatever the motive may be. But we dont see that in this particular article. And so i cant imagine why the department of justice would open an investigation. There just isnt a crime opinion thats point one. Point two, i think its reprehensible for any chief executive to be using the department of justice to sort of ferret out the identity of somebody exercising First Amendment rights. It is not his playground. Its not his toy. It is the department of justice and they should be used to investigate legitimate crime. Not to sort of fulfill his vendettas. The point here is well never know here whats happening as a result of this. The department of justice doesnt comment on these sorts of things. Kellyanne conway was sitting down with chuck todd on meet the press this morning. Lets take a listen to an exchange between them. Should the attorney general take it as an order . If the attorney general and the department of justice and the fbi feels they have oversight over matters like this, they will make that decision. Your reaction to that, what Kellyanne Conway had to say there. We wont know. Not only will we not know, but if the doj does died to look into this the first thing reporters would think about is the reporters privilege. But the Supreme Court has said this privilege can be pearce ief theres no other way to get the information. A recent case held that in cases of National Security it satisfies that compelling need such that these protections as named after the Supreme Court case dont even apply. In other words, so long as National Security is invoked, it may be the case that there is no reporters privilege whatsoever. So that if the doj does decide to investigate, not only do they not need to tell anybody about it, but they can almost surely pierce any claimed First Amendment protections because of the recent case law coming out of the fourth circuit. Thats something that is very, very concerning for anybody working in journalism. Chuck, as we survey the legal landscape here looking into the next week, someone else on the horizon has been George Papadopoulos who was sentenced on friday. By all indications from robber mull letter mueller muellers team he wasnt very cooperative. Help us understand the significance of his sentencing on friday, a sentencing of two weeks, longer than the norm. What does it say to you about the course of the investigation being conducted by Robert Mueller and his team . His sentence was sort of what i had expected. Its a five year statutory maximum. In other words, the judge could have put him in jail for five years, but thats just not going to happen in a case like this. Why . Well, it was a first offense as far as we know. And second, because he has no criminal history whatsoever. Because he pled guilty. His guidelines, the actual determine of his sense was zero to six months. It doesnt seem like hes particularly particularly helpful or important. I imagine in the next few days were going to stop talking about George Papadopoulos. Someone else we continue to talk about here, though, is Stormy Daniels who is in this legal orbit surrounding the president of the United States. Michael cohen had this company. President trumps Attorney Says hes not going to quibble with the fact the hush money payment was in place. What does that say to you about the place counterthings stand . It says Donald Trumps team is finally following the advice that many other legal analysts gave months and months ago which is streakiconcede the move is ts no agreement. Let Stormy Daniels say whatever she wants. A deposition of the president will be devastating to the presidency. Sure enough now here we are are months later you have cohens Company Filing a motion saying there was no agreement. Michael the only issue keeping team trump in this lawsuit is stipulated to. Its gone poof. It disappeared. Why should there be depositions of the president if hes agreed as to the only issue that keeps him in the case. But Michael Avenatti will have an answer and i expect well see it too. Part of one on twitter let me be clear my client and i will never settle the case absent full disclosure and accountability. This has been the white whale r for Michael Avenatti help whats your read on the odds of it happening in this case and as a couple of others continue . Look, we know from the Supreme Court that president s are susceptible to being deposed while in office. That was the holding of the Supreme Court and the clinton v. Jones case. It was a civil matter. The court did not think it appropriate to postpone it, past president clintons tenure in office. He was deposed while a sitting president. There are a number of proceedings right now in which the president is a defendant in a civil case. And i imagine some of those are going to result in the president testifying under oath or providing written answers under oath. Quickly, in the Stormy Daniels situation, now that the only issue remains is whether or not Michael Cohen defamed Stormy Daniels, its an uphill battle to argue that theres any issue as to that defamation that warrants bringing in the president for a deposition. Given that not just anybody can get a deposition of the president. You have to show a pretty darn good reason. Always good to talk to both of you. Democrats, though, theyre still really outraged over the lack of Public Access to thousands of documents related to kavanaughs record. Chuck grassley says his committee could vote on kavanaughs nomination as early as thursday. Democrats could if they wanted to force a weeks delay which would result in a final Committee Vote on the 20th, but no matter what happens, Republican Leaders say the senate is on track to confirm kavanaugh in time for the new Supreme Court term that starts on october 1st. Many First Responders deal with the Health Consequences of those attacks every day. So far 10,000 men and women have been linked with trade center linked cancers and more than 2,000 of them have died. 425,000 lived and worked in the exposure zone following the attacks. A fuound has provided billions. After december 2020 no one will be able to sign up for the responder. I sat down with First Responders along with jon stewart who has fought for them for years to discuss the issue. Jon, i want to start with you. Were at 16 years out and change from the anniversary of the recovery of the rescue efforts ended. How well taken care of at this point are the folks who assisted with that after 9 11 . Thats a great question. I think youll agree with me whe where we are today from when we got the bill passed, its night and day, apples and oranges. Were in a better place and we want to keep it that way and we want to only improve, but were running into obstacles now. Were seeing that on the Victims Compensation side were going to run out of money. Theres a deadline. That needs to be extended. December 18th, 2020. That currently is the deadline by which you have to sign up for the Victims Compensation fund. Correct. What happens with you all of you between now and then . What will you be advocating for . Second part, if i didnt sign up by then but got sick afterwards, what does that mean . Cancer doesnt have a deadline but the Compensation Fund has a deadline. December 18, 2020. This is why congress has to extend that piece of the legislation. For someone that gets sick after that, if the Victims Compensation fund expires, that family wont get the compensation they deserve, but a person that does get sick, at least the Health Program which is funded is a true benefit, but the family will not be financially compensated and thats a crime. When you get an illness like cancer, it can be it can ruin a family. Jon, your advantage on wash is different in the work youre doing now. Its pretty much the same. I can vouch for that. What have you walked away from when you look at the bro brokenness of. We have spent the last week talking about john mccain, when there was more bipartisanship. Whats the sense that you have, what apoptimism do you have. The optimism comes from being part of a more Grassroots Efforts and realizing that something happens when they come together in that town that the politics of that town i think supersede any of i like to say politics is where solutions go to die. They go to die because calculation starts to change. Everything they do down there is a selfconscious calculation. If i do this, perhaps so it becomes not about people. It becomes about math. Ive got a constituency and i if make a move over here and they forget the reality is on the ground for people. Thats generally what i see there. Washington is about reelection, not about service. Because theres a whole other argument. In the perpetual campaign that its become, the idea of campaigns and reelections are so far removed from the idea of governance and we have a system thats really good at reelecting people and not very effective at governing. And so i think its a shift of the incentives of the system that will allow for these types of situations not to slip through. And we can look back with nostalgia at a guy like john mccain who i personally had a like a love hate relationship with. I love that dude. You know, we used to fight like cats and dogs. But there is no grand nostalgia for a washington that was that functions smoothly and beautifully. It takes constant vigilance. I think as ive seen the grassroots rise up and youre seeing it in different areas, hopefully theyll be able to breakthrough that in permanent that shield thats you know, man. Youve been down there. What do Congress People do four or five hours a day . Theyre on the phone making calls. For what . For money. Jon, if you got stage four cancer, urgency isnt even a Strong Enough word. Why has this taken so long . Why did this process take longer . Why has it taken so long . Thats an excellent question. Why has it . I cant answer for poor leadership and bad politics. The American People need to sense how urgency and they need to know that our struggles are real. People tell us to get over it, its 17 years later. That burns me because we see pain and suffering on a daily basis. We just lost a 46yearold martial from cancer. The absorption through the nose, mouth and skin. We were exposed to these toxin. Were a few days away from the anniversary. I want to ask each of you what that means you to. It sounds like youre commemorating this each and every day. 17 years out. What does that anniversary mean to you versus every other day when youre thinking of the folks you lost . Its a day to pause. Its a day of reflection. Some people going back 17 years cannot remove themselves from the situation and theyre impacted on a daily basis. Ptsd, its rampant in the 9 11 community. For myself, being involved in this and paying it forward to be out educating the public. Jon, how do you mark the date . We stop doing what we do. 364 days out of the year we pay remembrance to those we lost to senseless violence. But were right back at it again on september 12th. The whole country should stop what theyre doing on september 11th. But what burns me and i know it burns jon, we listen to elected officials on the 11th spew rhetoric from the hole under their nose saying that theyll never forget and that they support our nations heroes. And then yet they turn their back on these men and women. When i say these men and women, im one of them. I just have a way to always exclude myself, but there are tens of thousands of americans, human beings, that are suffering. Over 90,000 people in the World Trade Center across the country suffer. That need these programs up and running for as long as it takes. For the rest of their lives. Not a preset date that congress determines to so far remove from our worst day our nations ever saw. Jon, you were active in getting members of the rescue and Recovery Community who passed away recognized at the memorial site downtown just speaking to remembrance more bradly. This might not be fun in line for those who think about those who lost their lives in 9 11. There are still people dying from the attack of 9 11. You cant those that die, the marshal that died today died from the attack on the World Trade Center on 9 11 in 2001 inspect so i think its for the people involved its a continuum. Its not a remembrance. Its were still suffering from the effects of it. And theyre suffering the effects of it because of their heroism and because of their actions in going down and stabilizing not just the city, but in many ways the country. So i think thats the difficulty is that its not a day thats ended. Its a nightmare that continues. As a country, you cannot celebrate the heroism of those that came down and gave us so much and then turn your backs on them when the effects of that heroism is burdensome in any way. And i think one of the things thats difficult is, and these guys dont talk about it, but they would all do it again. Knowing what they know. Theres not a person ill meet guys 25 years old when he was down at ground zero, all kinds of things, he would do it again tomorrow. Theyre built for this type of service. And i just think for that to go through what they went through through that time and then in the 15 to 16 years later to have to spend their days and time advocating against their own government for medical these guys arent looking for a ski trip. Theyre looking for chemo money. And we forget that. I have to tell you, their ten nas tenacity is more impressive because the time ive spent with them down in washington is so infuriating, i dont think i have ever met a person in speaking about 9 11 and what the First Responders and the veterans and the trade unions and the survivors and the victims and what they brought that ever disagreed that oh, absolutely, weve got to take care of all that. Open tennis tournament and the kickoff of the nfl season dominate this, the first weekend of september. This year theyre piloting differences in race and equality as well. Serena williams will have to pay for the controversy surrounding her performance last night in the u. S. Open womens final. She faces a 17,000 fine for three Code Violations that many are calling sexist and unfair. As for the nfl the league and the Players Association continue to discuss a resolution to the anthem protests. For now the policy is going to be there is no policy. President trump weighed in this morning as he has over these last few weeks suggesting ratings could come back if players were to stand for the national anthem. Joining me now is bill roden, a writer at large for the undefeated. Lets start with the serena controversy. We were talking about the Sally Jenkins in which she says an umpire spot is to temper emotions. Your reaction to what you saw last night . I think this is sort of a great moment. This is a 50th anniversary of r arthur ashe becoming the first black man and only the second africanamerican person to win a major tennis tournament. One of the things that arthur was about was inclusion. Thats what he wanted. He was about inclusion. I think he would be so delighted to see that in this big moment you had a portuguese umpire, an africanamerican tennis champion, and a player whose father was asian and mother japanese all involved in the moment. Thats all he wanted was to have this great family of inclusion in this sport of tennis. So i think thats a wonderful thing. In terms of the specifics of the thing, number one, i think Billie Jean King said, the whole thing about coaching has to thats ridiculous. Everybody and boxing, you have coaches. So that has to change. Now, it hasnt changed so if its a rules violation, which it is, in terms of the breaking of the racket, of course serena is probably going to tomorrow say i wish i hadnt done it. I know that the umpire, you know, ramos is known as a stickler and all that. Yes, it is true that in any sport you kind of have to know the officiating. Its also true if youre an official, youve got to know that youre dealing with the greatest one of the greatest tennis players in the history of the sport. Probably the reason why youre getting paid. So you kind of have to temper things too. You just cant treat serena like, you know, everybody because shes kind of why this is the way it is. This industry is the way it is. You kind of have to temper it. And the 17,000 is a pittance, but its the principle. I think men have to kind of get on board that all of us are sort of covering sexist. We absolutely responsibility differently to women who respond. Serena williams is one of the most competitive athletes ive been around in my career and that includes Michael Jordan and kobe bryant. Id probably put her number one. She is one of the most competitive athletes ive ever been around. She is ferocious. Shes a force of nature, one of the nicest people youll meet off the court, but she is a competitor. And so i think that and great officials will tell you this, that yeah, athletes have to know, but its an honor for officials to sort of be in this arena with some of the greatest athletes. So hopefully what comes out of this is technically tennis has to do something. This is 2018. This is not don bud. Youve got to change the coaching thing because coaching goes on. But i think what is the larger point is this gender bias that sort of was unveiled about who can change their shirts when, you know, that was an issue. I think that and i think serena was correct to assume that this is beyond just her. This is a gender this is sort of a gender issue. That has to be addressed. I think when the umpire looks goes to bed and looks in the mirror, you kind of have to sort of follow the truth where it leads. In this case he was wrong. You dont always act on the letter of the law when youre dealing with somebody like serena williams. Bill, i want to ask you about this being a catalytic moment. Youre talking about the need to change these rules with regards to coaching, the penalties that were imposed on players for when they changed clothes. Serena williams talked about this last night in the press conference. Her protest was in part because she doesnt want this to happen again. How do you ensure thats the case . How do you ensure this is something that does change the scripture surrounding professional tennis in the world today. Thats a great question. We can change rules. This is sort of where were in the climate of the country. Whats hard ser is changing whas in peoples heart, especially for men who tend to be in positions of dominance. Its an attitude change that this is a level playing field. When a woman, a powerful woman comes at you, its a powerful human being coming at you. Its not just, you know, we lapse into this thing and i think billie jean said it. I dont want to hear a guy say ive got a daughter. I dont care. Youre a sexist man with a daughter and a mother. I think its an attitude change that we as men have to deal with. Its a changing climate. If we want this to be a better world, we have to change our attitudes. So to answer your question, the rules can be changed. I think they will be changed about umpiring and coaching. About coaching. But i think the larger thing is just how do we change our attitude about women who are strong, women who are powerful, and just dealing with them as human beings. Powerful human beings. Not as women who happen to be powerful. That to me is going to be more difficult. But were on the right track. Bill, the minute we have left, i want to ask you about the nfl. Ive read that tweet from the president. He continues to focus on ratings, continues to focus on this issue that the owners of these teams need to make a change or impose something on these players. I want to get your read on this protest movement here as this new season gets under way. You know, im so excited about this because with the nike ad, a lot of people have just been so empowered. This is such an empowering moment. The owners are looking and saying 70 of my players are africanamerican. This thing about justice is real. This thing about justice is real. These players come out of these communities where this is really real families being torn apart. Communities being torn a byebye mass incarceration. Football is incidental. The owners know it too. This is going to be such an exciting season and the nfl thats why they have not imposed any rules because they know theyre kind of between a rock and a hard place.
