Overnight protests erupting over the grand jury decision in the case of Breonna Taylor. No murder charges filed. One for want done endangerment for firing into an apartment. House Speaker Nancy Pelosi is talking about the Breonna Taylor case and the response. Lets listen in. Talking about Prescription Drug prices. Lets listen to the mayor of louisville, greg fisher. Our community is hurting. Many see Breonna Taylors case as both a tragic death of a young woman and the continuation of a long pattern of devaluation and violence that black women and men face in our country as they have historically. The question is, obviously, what do we do with this pain . There is no one answer, no easy answer to that question. But i do know this, violence is not the answer, and destruction is not the answer. Public safety and the work for Racial Equity and justice can and must coexist. Thats the goal that were working toward, creating equity in our city for everyone in our city. We in our country obviously have much work to do. We here in louisville, myself, are firmly committed to that work to make our future a future of equity for everyone in our country and in our city. Its important for those taking to our streets and those supporting demonstrators from home to understand the power of this moment. You have the attention of the people who lead our government, our businesses, our education and other institutions. Were listening, were obviously engaged in this work and ready to do a lot more, but we have to do it together. Violence only hurts this cause. When any of us gives into the temptation to channel anger into violence, we slow our progress. We sacrifice the future for the moment, and thats just another tragedy and weve seen enough tragedy. We never had control over what attorney general or the grand jury would do. We dont have control over what the fbi will do with its investigati investigation. We do have control over what happens next in our city. Im asking everyone to reject violence and join me in committing ourselves to the work of reform for justice and for equity, and do that now. We have to respond to what dr. King called the fierce urgency of now because this problem has always been, but its acutely even more so urgent today. We have to come together to create plans to address the wounds that so many of our community are carrying and have been carrying and replace them with compassion, connection, opportunity and justice. Chief schroeder is going to give an update on yesterdays activities. Chief. Thank you, mayor fisher. First, i would like to start by saying how grateful i am that our two officers who were shot during last nights protests are doing well and will survive their injuries. Last nights situation could have been so much worse for our officers and for the people who were protesting when the gunfire broke out. Major aubrey gregory, the commander of our special Operations Division and was leading efforts on the ground last night was treated and released from University Hospital for a gunshot wound to his hip. Major gregory joined the department in february of 1999 and has done a tremendous job the past several months as one of the leaders of our protest efforts. In fact, some say he may be the bedrock of our protest efforts. Officer robinson giz row chess was shot in the abdomen last night having to undergo surgery as a result of his injuries. He is in stable condition and expected to recover. He joined the department in march of 2019 and works in our second division. Again, we are extremely fortunate these two officers will recover. At this time Lorenzo Johnson has been charged with two counts of assault in the first degree and 14 counts of wanton endangerment, all directed at Police Officers. In addition to these officers, we have reports of a Police Sergeant being injured after being struck by a protest at the time, a sergeant who suffered a knee injury while arresting a resisting individual and an officer exposed to blood and spit after a protester spit upon him. As for the events last night, there were several instances of unlawful behavior where Police Needed to intervene during the protest activities including damage to property, such as businesses along bar stand road, moving of barricades and barriers restricting traffic and damage to a public works vehicle that was blocking the roadway. Due to the fires being set at the courthouse and along Jefferson Square park, we needed to declare an Unlawful Assembly in the area just after 8 00 p. M. Prior to the curfew taking place. We made several clear announcements to disperse prior to Police Moving into the park. Throughout the night we made 127 arrests in various locations including the highlands in downtown that were protest related. As the night went on there were several instances of looting outside of the downtown area. We had reports of 16 incidents of looting throughout the evening in our first, second, third, sixth and seventh divisions. Areas include broadway, kres ton, outer loop and poplar level road. As a reminder, the curfew remains in effect tonight and tomorrow from 9 00 p. M. To 6 30 a. M. I would like to give a special thanks to our state and federal partners who have helped us out during these events. These include the kentucky state police, the Kentucky National guard and a variety of other state and local partners. The Kentucky National guard has been providing assistance in securing government buildings and other locations throughout the city as well as several of our other partner agencies. Thank you. Okay. The first question is for chief schroeder from jess clark from wfpl. Jess asks, were there protests her first question is why is johnson being charged with assault and not attempted murder. The investigation is still early and on going. I would have to speak with our Public Integrity unit investigators to determine that answer. I dont have that at this time. The second question also from jess clark is were there protests on crescent highway and poplar level road . Why do you believe those burglaries were connected o protests. There was looting. Whether thats directly related to the protest or simply people taking advantage of the situation, i cannot advice at this time. We have been listening and watching this virtual update in the city of louisville. First we heard from the democratic mayor there greg fisher. Mayor fisher saying the city of louisville is hurting. The question now is what do we do with that pain. Then from chief schroeder we got an update on two officers who were shot last night. Major gregory was shot in the hip, was in surgery at one point. He is expected to recover. Officer robinson deroche shot in the abdomen in stable condition according to the chief there. Both of those officers are expected to recover. We also heard from the police chief there about two other Police Sergeants who were injured during the protests last night in which 127 people were arrested. There were, according to the police chief, at least 16 incidents of looting there, as we show you some of the images from wednesday evening in louisville. I want to bring in nbcs blayne alexander. Shes been on the ground there in louisville, kentucky. New york times correspondent, also an nbc news contributor, shes also been in louisville and has been digging into the Breonna Taylor case for months, has been doing a great deal of extensive reporting in there. Blayne, let me start with you. You were there last night, there this morning. Whats the mood like on the ground and what more do we know about those two officers who were shot . Reporter craig, i want to start by speaking to what we heard from the mayor and police chief. They were speaking much to what was seen last night on the streets of louisville but also what theyre expecting to see tonight. I want to set the scene and show you what were seeing. A lot of this, a lot of blocked streets. This is one of the streets blocked in downtown louisville. You see these concrete barriers, giant trucks, Police Officers in some cases using these areas as a sort of checkpoint. This is something weve seen going on for the better part of this week here in louisville, restricting access, restricting traffic in and out as police kind of continue to keep a very heightened presence here in downtown louisville. Ive got to say that as of right now, as of 11 00 this morning or so in louisville, things seem very calm. Things seem pretty calm. I just walked over to Jefferson Square park. Thats been the gathering area for so many of the protesters who have been protesting now for days on ends. It was very calm over there. You saw people kind of tending to the Breonna Taylor memorial thats taken place up there. Some people even cleaning up the park there. I think one thing that we can speak to is this feeling of anger, this feeling of frustration. Some people say the decision was an insulting one. Thats why so many people have taken to the streets. They did so last night. They said they plan to do the same thing again tonight, craig. Let me bring you into the conversation here. First of all, your initial reaction to what we just heard there from the city of louisville this morning about the protests. I think the city is in a really tough spot. The city itself and their administration have no role in the decision that the attorney took and the grand jury executed, but it is the city and the police force that are going to have to deal with the upheaval and the very real anger and frustration and lack of understanding that people here feel. The only indictment, as you know, of this former detective, Brett Hankison charged with wanton endangerment after firing into the homes of taylors neighbors. What are you hearing from folks in louisville about the charges or perhaps the lack thereof . In preparation for the indictment i spoke to a number of legal experts. Legal scholars in the state and beyond had predicted this very result, and the reason for that is the Breonna Taylor case is complicated by the fact that the Police Officers who went to serve the warrant that night did so with a legal warrant in hand. They were not rogue cops that just broke down her door in the middle of the night. They were there with a document that had been signed by a magistrate the day before following months of investigation that had been done by their colleagues. A flawed investigation, sure, but they were the ones that were handed this document and set to go. Once they got to Breonna Taylors door after they knocked for some time and after allegedly they announced my own reporting is at most they announced in a very incomplete manner. They punched in the door. Breonna taylors boyfriend believed they were intruders and he opened fire. What the attorney general explained yesterday and what legal experts i have spoken to have concurred with is the notion that once those officers who were there with a legal mandate that were fired upon, they had a selfdefense rationale for returning fire. Thats what protected the two officers in the doorway who are the ones who actually killed the young woman. Brett hankison is the only officer that everyone agrees did something out of line, and that was that he left the formation by the door. He ran into the parking lot, and without any line of sight, he began firing into the sliding glass are door of her patio and into the window of her window. Those bullets went across Breonna Taylor and her boyfriend, didnt touch them. They went straight into the apartment behind her where a couple and their young child were sleeping. It was not wanton murder because his bullets did not hit Breonna Taylor. I want to go back to something you just said. Youve done a fair amount of extensive reporting on this. The attorney general yesterday mentioned this eyewitness who claimed he heard or she heard the police knock and announce. Taylors boyfriend said he didnt hear them say police. You note in your reporting in interviews with nearly a dozen neighbors, only one person said he heard the officers shout police a single time. You talked to a dozen people. The attorney general manages to find one person. How do we square that . How do we square that disparity . I think that the witness that the attorney general is referring to and the person that i spoke to, a truck driver who was coming home late from his shift and happened to be on the landing upstairs just as the police began banging on her door, i believe those are the same people. The New York Times is the only entity i think that has spoken to this solitary witness that heard them say police. I asked the attorney general in the press conference yesterday do you consider that to be enough, one human being out of a dozen or so neighbors hearing these cops announce themselves . Because whats crucial here is they did knock nobody disagrees that they knocked. If all you do is knock at nearly 1 00 in the morning, whats somebody sleeping inside their home to think . Obviously theyre going to think its a robber or intruder. Its crucial that they need to identify themselves. The attorney generals answer to me was not that it was enough for me, but was it enough for the grand jury. The grand jury decided they had properly announced. I felt frustrated at that answer, i have to say. I think there are a lot of folks who feel frustrated because, as is the case in most jurisdictions, grand jury proceedings are largely secretive. Despite what the governor of kentucky has suggested that the transcripts be released, the likelihood of that happening, slim to none. Rukmini, thank you. Blayne alexander on the ground, be safe. In his News Conference on wednesday the president making unfounded claims about the security of the mailin ballots. He went even further in refusing to commit to a peaceful transfer of power if he should lose. This is just part of that exchange with the reporter. Will you commit to making sure theres a peaceful transfer of power after the election. Well see have to see what happens. Ive been complaining strongly about the ballots. I understand that. People are rioting. Do you commit to making sure theres a peaceful transfer of power. Get rid of the ballots and there wont be a transfer. Theyll be a continuation. Again, we should nohere ther have been no legitimate claims of mailin voting fraud widespread. Nbcs Shannon Pettypiece joining me from the white house. Shannon, weve heard the president echo this before, but these new comments seem to be getting even more attention than usual. Has anyone in the white house tried to clarify what he meant . Well, the president was given an opportunity himself to try and clarify this a bit. He did interview on Brian Kilmeades radio show where he was asked specifically about, if the Supreme Court were to rule that joe biden was the winner, would he accept that decision. He said, yes, if its the Supreme Court and then went on to complain, again, about ballots. Im souping he means mailin ballots, not ballots in general. He continues racing issues about mailin ballots. I will say its interesting that the Supreme Court was brought into this question because the president also said yesterday that one of the reasons he wants to make sure his nominee is put on the court quickly is because there is a possibility that he anticipates the Supreme Court playing a role in deciding the results of the election should there be a contested election. Of course, as you mentioned, the president has repeatedly claimed without evidence that there is widespread voter fraud from mailin voting. His campaign, in defending the president s comments yesterday about a peaceful transfer of power said once again the president s answer yesterday highlights the huge potential for fraud in democratic schemes to mail unrequested ballots to unregistered voters. The fbi said a moment ago historically theres no evidence of National Coordinated effort of voter fraud by mail. There are only nine states in the District Of Columbia that are even planning to send out actual ballots versus request for ballots. Were talking about a small group of states that this effects anyway. It should also be noted only one of those states, nevada, is a battleground state. The president would have a snowballs chance in hell of winning the other states including california. Mitch mcconnell, the Senate Majority leader rarely rebukes the president publicly at least. He apparently did that this morning. What did he say . Reporter right. Not a direct rebuke of the president , but certainly it was a strong statement from mcconnell considering his past of not wanting to get on any wrong side of the president , especially this close to the election. What mcconnell said is the winner of the november 3rd election will be inaugurated on january 20th. There will be an orderly transition just as there has been every four years since 1792. We heard other republicans in Congress Come out and make similar remarks, again, not directly admonishing what the president said, but validating that they believe there will be a transfer of power. Lynne cheney, marco rubio, signaling to the president they believe this is an issue they will be behind a peaceful transfer of power regardless of what the president may have intended here. Hours after the president s eyebrow raising remarks about the transfer of power, reporters then asked democratic president ial nominee joe biden about it. This is part of what he said. Your group is creating a panel to independently vet these decisions. Why do you think thats so necessary, and how does this fit into the larger history of black americans and medicine, especially when it involves government . Good morning, craig. Very good question. The National Medical association, we have concerns. A resolution was introduced by dr. Rodney hood and passed unanimously in our house of delegates to establish a covid19 task force on vaccines and therapeutics. So to map this out, theres been a cloud of political influence date back to hydroxychloroquine, whereby it was given emergency use authorization by the food and Drug Administration. Then not too long afterward was found to cause serious adverse cardiac effects. N now, following that, convalescent plasma. On august 23rd, the food and Drug Administration provided emergency use authorization for convalescent plasma. This was one day prior to the Republican National convention. Hold the phone. What happened . Not too long afterward a panel of scientists from the National Institutes of health made a statement saying that there are insufficient data to recommend for or against the use of convalescent plasma for the treatment of covid19. They went on to say that convalescent plasma should not be considered a standard of care. And furthermore, they said that prospective randomized controlled studies needed to be conducted. So, yes, we have concerns. So we want to be that nonpartisan, independent voice speaking to the Africanamerican Community and to our physicians of the National Medical association. Dr. Mcdougal, really quickly, if the government does approve a vaccine that your group does not think should be administered, what steps are you prepared to take . Well, thats another good question. First of all, we are the trusted messengers in our community. We serve the black community. So our patients are going to listen to us. So thats my statement. We can make all the vaccine in the world. If a trusted messenger doesnt provide that bridge to interpret how we should move forward, its not going to move forward. Thats a really good point. Dr. Leon mcdougle, thank you. This is how one of the attorneys representing Breonna Taylors family describes their reaction to the grand jury decision. Here is part of my conversation with Attorney Ben Crump earlier on today. The wanton endangerment charge, it just doesnt make sense when you think about they had wanton endangerment for the white neighbors apartment, the bullets going there, but not for the bullets going into Breonna Taylors body. You talk about transparency, Breonna Taylors family would love to see the grand jury transcript to see if there was any evidence presented for Breonna Taylors perspective. Nothing seems to say that breonna mattered. I want to bring in david henderson, a civil rights attorney and former prosecutor and also eddie glaude, the chair of africanamerican studies at princeton university. David, let me start with you. We just heard ben crump there express the familys outrage at the grand jury results, called it a sham. David, what flaws are there in the grand jury system that you think affected this outcome . I think ive watched the movie a few good men 50 different times. A line in the movie, theres a difference between paper law and the law. Based on what we read we determine how actions should take. In a Prosecutors Office you begin with a basic impulse about what you want to do. Once you decide that, then you decide what actions youre going to take under the law. What we saw yesterday was a Justice System that decided it was going to protect Law Enforcement at all costs even at the expense of innocent victims. The way the grand jury role plays into this is that its completely secret. Prosecutors can say whatever they want when they present cases to the grand jury and the grand jury are not a body of lawyers. They take cues from the prosecutor. We have a sense of what his recommendation to the grand jury was and it appears to be the exact outcome that we got. David, there is, of course, this expression that a grand jury would indict a ham sandwich. As a former prosecutor, it sounds like what im hearing you say that basically, if the prosecutor wanted to charge officers in this case, he easily could have done that, but for whatever reason, he chose not to. Is that what im hearing you say . I wouldnt go so far as to say he could have easily charged them with all of the charges discussed. However, he could have taken more action than he did with regard to Breonna Taylor. Weve been saying her names for months. Yesterdays decision ensures that her name will never be said in a courtroom. We wanted justice for Breonna Taylor. We only got justice for her neighbors which is interesting because the officer who was charged was fired for shooting into the apartment. The chief of police wrote in the termination letter your actions displayed an extreme indifference to the value of human life when you want donnelly fired into the apartment of Breonna Taylor. We use the legal words like wanton, but basically the officer is charged for firing his weapon in public so dangerously that he put peoples lives at risk, yet he wasnt charged at putting at risk the person who was actually killed. Thats the what. The bigger question is why. The reason why he wasnt charged is because when this case goes to trial, Breonna Taylors name will never even come up. All the jury will know is that the officer fired a weapon in a way that put three peoples lives at risk and ultimate any none of those three people were harmed. This case will likely be resolved two to three years ago with a plea agreement that probably will not involve any prison time, certainly not any serious prison time. Eddie, david raises an interesting point because it would seem as if the officer was charged for the shots that he missed, not actually shooting and killing Breonna Taylor. Professor, what does this mean for this consequential year of racial reckoning . Where does the justice for Breonna Taylor movement go from here . Well, first of all, my heart goes out to Breonna Taylors family, her mother. But this is just another example, another some more evidence of the disregard for black life. There is its clear that a. G. Cameron did not consider, at least to my mind, the value of Breonna Taylors life when we read that indictment, right . When we read what he said, when we listen to what he said. You know what, craig . It sounded like an echo. If we had the tape, when we heard the rationale of the d. A. In ferguson to not charge the officer who shot and killed mike brown. Similar language, similar concerns about how did he present the case. So this lets us know that we need to get the kind of prosecutors in these positions that will actually pursue justice. Thats the first thing. We need to do what color of change is doing, elect progressive prosecutors. Thats the first thing. We need to change the criminal Justice System from bottom to top or top to bottom, as it were. Also, we need to name it, craig. Im reminded as im trying to process this, im reminded of a line from james baldwins the fire next time, the innocence is the crime. He says he accuses his country and countrymen for what theyre doing. Theyre destroying hundreds of thousands of lives and they dont want to know it or they ignore it. So its the innocence. Who gets to be innocent here while we have to bury Breonna Taylor and her family has to grieve and black families have to grieve over and over again as the country continues to turn its back on cops killing black people. Professor of racial justice, its obviously a major issue this election cycle. Next tuesday joe biden and donald trump will face off in their first debate. We learned yesterday that one of the segments in that debate will titled race and violence in our cities. What do you make of those two ideas being coupled . It seems as if the organizers of the debate have capitulated to the frame. That is to say, whenever the discussion of race comes to the fore, theres always the worry around violence or the concern around violence. Reporter well, we just saw a parade here of the 18wheelers that are carrying the votes. There is a parade because on the front end, on the back end, we had the florida Highway Patrol escorting Postal Service trucks to the sort center as they began sending out the mailin votes here in Broward County. Theyre doing that across the state, in the 67 counties. To give you an idea statistically how many people have decided in this age of coronavirus to vote by mail or at least suggest they intend to do it, 34. 8 of voters in the state of florida will be voting by mail. When you look at the breakdown, republicans, about 31 of those, will be voting by mail. 46 are democrats. And then you have this group of 22 that have no Party Affiliation or fall into one of the more obscure parties. And those who are with the republicans and the democrats believe it is that 22 , those with no Party Affiliation, that likely will be the ones who decide in a state like florida where things are neck and neck between candidate biden and President Trump. The parties themselves say they are confident that this mailin vote system, which is getting a very robust workout this election season, will work. I think that the vote by mail system and the optical scanners are a terrific way to vote. I really do. I think that the only concern i have is that voters really need to be aware of how to vote. We want to count everybodys vote, not just our votes. And vote by mail is a great way to do it. What matters is that people go out and vote. I mean, its the cornerstone of our democracy. Its what makes us americans. And i do believe, absolutely believe, 100 , that voting by mail is safe and secure and fair.
