A key witness has refused to show up to a scheduled deposition this morning and democrats are now preparing to hold it in contempt of congress. We move forward and we will obviously consider, as we inform the council his failure to appear as evidence that may warrant a Contempt Proceeding against him. Charles cupperman, filed a lawsuit asking a federal judge to decide if he has to comply with democrats subpoena or follow the white houses order not to comely. It all come comes as Weaver Learning Sondland is back on the hill right now reviewing his testimony. Also on the hill, msnbcs garrett haake. Like a lot of figures in the probe, Charles Cupperman caught between the battle between congress and the white house. Remind folks who he is and what lawmakers were hoping to learn from him today. Cupperman was a top deputy to former National Security adviser john bolton. Hes still a white house employee. But he was most important to
this conversation because he was on that phone call between President Trump and the president of ukraine that kicked off this entire Impeachment Inquiry. So he could speak to the phone call. He could also to speak to bolton, who they want to get in here, reacted to it. But hes now the first person to take this issue of the bat the between congress and the white house to the courts this is not his battle to decide essentially. He wants the Judicial Branch to weigh in on whether or not its appropriate for him to follow a congressionally mandated subpoena or the guidance of the white house, which is not to come testify. You heard adam schiff saying thats not good enough. They are going to put his lack of forthcomingness to speak to the committee in a bucket that says hes obstructing and he must thehave something damning say. They are hoping to essentially move on with the inquiry. There has been, as you know, a fair amount of consequential
testimony already. This is how the New York Times frames what could be a head. What has been a rapidly moving investigation securing damning testimony from witnesses who defied white house orders may soon become a more arduous effort. Investigators are trying to secure cooperation from higher ranking advisers who can offer more direct accounts of trumps actions, but are also more easily shielded from congress. Do we anticipate that this is the first of a number of road blocks ahead for House Democrats . I asked adam schiff is and he hopes other witnesses will not follow this tack. We know that another staffer on the National Securityexpected t. His attorney has made it clear, but democrats knew this might eventually be the case much like in a criminal investigation, they worked from the outside in. Start iing with State Departmen employees, folks who were work on the ukraine side of things. Working in other agencies of the
federal government. As they are working closer to the white house, they are running up against more claims and more folks who are more loyal to the president and r more willing to follow the instructions of white House Attorneys telling them not to comply. But democrats have said since the very beginning of this inquiry they dont intend to get bogged down in long protracted court battles. They are looking at witnesses who dont come as having something to hide. And put that as evidence of obstruction of congress, perhaps evidence towards another article of impeachment that dont intend to fight this out in the long ongoing legal battles. Just a short time ago, we heard from the congressman. Lets start with the refusal to be deposed this morning. What do you make of that . And the assertion we heard from jim jordan if the Court Compels him to come, he will be there. If he had something to help the president or exonerate the president , the white house would allow him to come. The white house ordering him not to come, well just assume its a consciousness of guilt by the white house, put that into further evidence that the white house is object strukting our investigation and that the inference can be that he would
corroborate all of the the other evidence that there was a shakedown scheme going on. People like rudy giuliani. You mentioned sondland. We know hes back on the hill today. Reviewing his previous testimony. What more can you tell us about that . Well, witnesses despite what the republicans say about access to transcripts and access to hearings, republicans are allowed to participate in the hearings. The witnesses are allowed to review the transcripts as the ambassador is doing right now. What is more important, though, is that people like ambassador taylor and others have point ed that there were two lines. A sharp line from President Trump to rudy giuliani, a line from President Trump to ambassador sondland that said that the ukrainians must investigate the political opponents or they would not get a white house meeting and they would not get security
assistance that they were counting on. Until now at least things have moved fairly quickly. You have significant testimony from mull president ial administration officials. But according to the New York Times, this could be the first of many road blocks. What were seeing here. How are the committees going to secure cooperation from more high ranking officials as we move forward. We are going to count on people to follow lawful subpoenas. For the publics sake and most people in the public get this, if youre innocent, you show up and cooperate. It youre the white house and youre innocent, you allow people to come forward and help their country understand Whats Going On. If you dont have anything to help the president , youre going to be obstructive. What i dont understand, i understand why the white house would order these witnesses not to show up. I cant understand why my colleagues who want to make sure that congress as an independent branch of government has an
ability to investigate an exec fifth branch would just play party to what the white house is doing and green light their obstructive acts. I can only conclude they dont have an interest in having a fair process here. They see themselves as public defenders for the president and not independent, impartial actors in this investigation. Before i let you go, this morning as you probably know, President Trump doubled down on that decision to leave House Democrats including yourself out of the loop on the al baghdadi raid. This is part of what President Trump said. I guess the only thing is they were talking about why didnt i give the information to adam schiff and his committee. And the answer is because i think adam schiff is the buggest leaker in washington. You know that, we all know that i have watched him leak. Hes a corrupt politician. Hes a leaker like nobody has seen before. Your reaction, congressman . Congratulations to the men and wum in our Intelligence Committee who took down al
baghdadi, but the president gave the information to Vladimir Putin first. The president , if he wants to talk about leakers, he leaked in the oval office National Security information to the russians. The president has private meetings with Vladimir Putin and kicks everyone out and takes the interpreters notes hes the leaker. He put russia above the speaker of the house and informing democrats. I think thats a bad precedent to set and it says a lot about where his loyalty lies. Well leave it there. Congressman, thank you for your time, sir. My pleasure, thank you. Schiff says that cuppermans lawsuit has no basis in law. This is part of what he said. The lawsuit that was filed in District Court has no basis in
law. A private citizen Cannot Sue The Congress to try to avoid coming in when they are served with a lawful subpoena. Clear it up for us, if you can. So heres the way i see this. I see it one way with respect to trump and the administration. I see it another way with respect to the administration. It sure does look like this is more obstruction of a congressional Impeachment Inquiry. Plain and simple. I was reading through the 17page filing this morning. And what caught my attention for those scoring at home, its on page 6, paragraph 18. His lawyer quotes the white house as saying you have constitutional immunity. Do not show up ask do not testify. By anybodys interpretation of that threat, that seems like the white house trying to obstruct was ruled a legitimate
Impeachment Inquiry. Thats how i see it with respect to the white house. Now with respect to mr. Kupperman, the white house said you may not testify. And Congress Said you will testify. What he did was file for whats called a declaratory judgment. Hes asking the federal court in the District Of Columbia to tell him yes or no. Who has the better of the argument . And if this can be done in an expeditious manner, i actually think that it would be a nice precedent to have for a federal court judge in d. C. To say, you know what, this constitutional immunity, this absolute immunity that the white house keeps throwing into the mix is nonsense. I will say judge john bates of the federal District Court in washington, d. C. In 2008 said this absolute immunity claim is nonsense. I predict thats what a judge

Tstz reported that democrats want to vote on articles of impeachment by christmas. Too soon . Do you think their case isnt Strong Enough yet . Well, when Congressman Schiff talks about obstruction, everyone in both parties in congress and the Executive Branch understand that Obstructing Congress is an impeachable offense. Its just not as powerful a message across the country with voters. I think that they have a very good chance of piling far more evidence. They have had nine depositions. It looks like they will have more if like glen points out this becomes a test case that opens the door to the testimony of john bolton and others who can back up the testimony of

I do think that it is a mistake to rush this when they have so much potential evidence ahead that would speak more to the public and to the voters than obstruction, which sounds like the Trump Administration is going to say the congress was mean to me and the president wasnt fair. Its not as potent and did you want breakthrough as much. I think that they are not on a fishing expedition. They are on to something very compelling here. They should stay the course and wait for the legal decisions to make a more powerful case to the Senate Republicans who have to weigh in on trial and then ultimately to the public. The president saying that he didnt share that information with schiff because he described him as the biggest leaker in
washington. But this is significant because it really shows the way that the Impeachment Issue right now, this inquiry has colored traditional relationships as they formerly existed in washington. The president not sharing that information with those congressional leaders as would be the protocall before and advance of or at least through the process leading up to a significant military operation. Nancy pelosi for decades served a on the Intelligence Committee. She was its Ranking Member before the first term as house speaker. Theres no evidence or indication at any point she leaked information that would have sacrificed National Security. Nonetheless, the president did take this opportunity to whack away at the democrats here. As you compare to before osama bin laden, then the republican of michigan who was the chairman of the Intelligence Committee said that he was in contact with the white house for several
months. Kept abreast rksz, as it related to all the developments in the efforts to get osama bin laden. I also understand theres a bit of an update on the canine who was wounded in the raid. What more can you tell us about this dog . The president himself acknowledged the details. It played out within the last 48 hours in syria. The president said of that dog that it was a beautiful and talented dog. It appears to be okay right now. But within the military community, theres been real frustration about the way the president did detail so many operational details. Eight helicopters, the way the assault took place or the way they entered that compound the fact that there were dogs with them and concerns within the military community that by give
ing so much detail the i way that he did, he threatened to undermine the sort of operational efforts that might take place in future raids of that kind. As i understand it, youre a few miles away from where he was killed and the question that a lot of folks are still asking this morning, what was he doing there so close to the turkish border. What more do we know about this part of the story . That is the key question at this point, craig. Especially when you consider where he was. He was in idlib, a known al qaeda stronghold. Unfriendly to isis. The president yesterday said that he was there to spread the isis ideology, but experts i have been speaking to really question that. They say i. C. E. Wouldnt use such a high level target this that way. I was just down at the border
crossing watching trucks drive into syria earlier today. It really struck me that just three miles from that point is the safe house now reduced to rubble. Why was he there . I was also struck by the Military Base we passed along the way. There was a Turkish Military base. Turkey is known to have a Loorge Intelligence Apparatus Operating in Idlib Provens as well. So what did turkey know and when did it know it and was al baghdadi trying to cross over the border . Courtney, Kurdish Capital of the region. What are you hearing there about the raid . What are folks telling you . Well, the raid was launch ed out of here. The helicopters actually took off from a base thats about two miles from where were stand gt rye now. We heard them taking off. There were two big raids launched that night. One into iraq going after an isis cell, which was a
successful as well. But theres no way thats break breaking through the news when the other raid was a special operations one to take out al baghdadi. We know that this is sort of becoming the Staging Point for much of the missions going in and out of syria. The retrograde or the mission for u. S. Troops leaving, thats part of the old mission. And now we know this new mission, President Trump spoke about it yesterday at the white house to secure the oil fields. The trouops are moving out of here and moving into Down Into Syria and down into the region where they conduct that mission. The first of that convoy literally drove out of here on saturday. We have some video of it going in. So this has become the new Staging Point. What we dont know is whats the deal with the securing the oil Fields Mission . How many troops are dedicated to it. Are some in country to be moved down to that . And then exactly what will the total footprint be. It does seem evident it will be smaller than the current footprint of a thousand troops. But were not sure what thats going to look like. Were also waiting to hear exactly what the military would call the flavor of these troops. Are they going to be the special operators conducting this isis mission or see more of the conventional forces that do much of the other missions around the region. So is michael steele, former spokesman for john boehner. You outrank the other two. How significant is the death of al baghdadi . What damage will it do to isis in the near term . What damage does it do in the longterm . You know, theres been a lot of talk about the ideology lives on. Isis can reconstitute. Theres still 15,000 or more fighters still out there. There may be several thousand encolluding a Couple Europeans who will escape kurdish custody in the coming days. Its clearly not a strategic blow to isis. But i think its extremely significant. These come parted Terrorist Organizations take a long time to reconstitute when they lose a key guy. Never mind the sort of Public Relations impact not just on the surviving isis organization, but people that might be recruited. I think it was a major spectacular success by delta force, the 160th aviation, the air force that supported it, the cia organization that gleans the intelligence. Its really astonishing what they can do. The New York Times reporting this morning baghdad has won enduring achievement. Those groups operate independently of the central leadership in iraq and sear kwa. Does the Global Isis Network present more of a threat than the organization that remains in syria. I think you cant talk about one without talking about the other. And the truth is that isis is always an idea as much as it was about an individual. So this goes on. Its a victory that does not mark a real end to the discussion about what the Islamic State can bring. I discussed all of this yesterday with the the head of the all womens force thats part of the sdf. They fought isis alongside the United States. My question to you, over the last three weeks theres been heightened attention to the u. S. Role in the middle east. My question is, what is that role . Are you supportive of Jared Kushners efforts overseas . To answer that first, you know, of course im supportive of efforts to make sure that were doing our part to help achieve a peace and achieve greater stability in the middle east. I wish, though, that this president were more serious and that he would send somebody over there that actually has a track record and experience of being able to help achieve stability and peace. You know, the idea of Jared Kushner going and negotiating this Peace Agreement between the israelis and the palestinians, one of the thorniest, most complicated types of agreements that you can arrange, it flies
in the face of, i think, what a president should do. It doesnt seem serious. Obviously im hopeful for it but im not holding my breath. I think that what we need to do in this 21st century is embrace the values that we care about when were engaging our allies and trying to deal with our adversaries. That goes for syria. That goes for trying to achieve a twostate solution between the palestinians and the israelis, our relationship with iran and the nuclear agreement. We had a conversation about that today. So when we look around the world, we need tone sure that we rebuild the trust of the world based on the values that we support of freedom, of democracy, of opportunity. Theres one more question. The u. S. Gives about 3 billion a year in military aid to israel. Theres a conversation over whether that money should be used as leverage to push and to press israel to hold back from its Settlement Expansion in the west bank. Is that something you support
using that aid money as leverage . I support doing everything we can to pressure israel not to move forward with unilateral an exannexation. My hope is theres going to be a new opportunity with a new american president in January Of 2021 to get this relationship back on track and to work toward a twostate solution and stop any kind of effort to unilaterally annex the west bank. I would not take off the table the option of conditioning our aid on israel not annexing the west bank, but that wouldnt be my first focus. My first focus would be to use this moment, this opportunity we have with a new administration here in 2021 and a new stla administration there soon to get it back on track. Earlier he suggested that he would be releasing video. Now hes blaming obama for not getting him. Were going to see to what extent the president stays on the baghdadi message here. Of course hes in chicago, but he could be talking to anyone in the country because he is talking to local Police Chiefs that represent all across the country and the message he wants to drive is a Law And Order message. I also just learned from the president that apparently hed been telling his generals that he wanted al baghdadi from day one. I had not heard that before. Had you . Reporter he started to hint at that yesterday, that he
wanted a name, that he wanted a big name because all the other terrorists that had been killed in the region werent necessarily household names. Al baghdadi had a certain resonance beyond some of these names that had been taken off the battle space. Its difficult to fact check that, because a lot of those are private conversations the president would have with his senior advisors. This is the first time hes really publicly said thats what he wanted. Again, the president is going to try to keep al baghdadi on the Radar Screens of the american public. It took him about 30 seconds here to jump into that. Now hes onto talking about Law And Order issues all across the country. Thats another message he wants to drive here. He is talking about how tough chicago is. Right now, on the streets outside where protesters are gathered. These are protesters outside
trump international hotel. I know that youve been talking to protesters this morning. Why are they telling you they feel compelled to take to the streets today . Well, chicago is very disappointed that President Trump decided to come here. As you know, weve had a very difficult relationship with the president over the years. He has basically used our city as a caricature for his political platform of antiviolence. Clearly he does not understand the issues we have here and people just want him to know that we dont appreciate that. You argue in your latest column that inviting the president to address that gathering of cops, that the invitation itself was a slap in the face to the city and an opportunity that the president has been waiting for. You write in part, quote, trump has been a thorn in our side since he announced his campaign for the presidency. He continuously uses his vile
contempt for chicago to fuel division not only between police and minority communities, but between all americans who do not see eye to eye. Trump paints police as helpless misunderstood victims of a cruel, Unfair Society rather than the brave and courageous protectors most of them really are. That is a disservice to all of us. Why do you think that coming here is an opportunity that the president has been waiting for . Well, as you know, hes used chicago as an example many times and said very negative things about chicago from afar. At this particular time where things are very sensitive between our minority communities, specifically our Africanamerican Community and police, its just a bad time for him to come. Were still not fully recovered from what happened with laquan mcdonald. We have other police shooting
incidents that will be coming up very soon. Were still trying to figure out how to deal with those. We need the police and our city working together, not being divided. Police superintendent eddie johnson, as you know, is hosting this event. He is not attending the president s speech, were told. That decision, to not show up for the president s speech, how is that decision playing there in the city, how is it playing inside the Police Department . Well, as you know, the fraternal order of police, the union has issued a statement basically, you know, condemning the police chief for doing that. But the community is very supportive of him. We understand why he did it. We actually wanted him to do it. And i think it makes a strong statement about where the police chief stands on this issue of community and police working
together and coming to an accord. We will leave it there. Thank you. Former congressman john conyers jr. Who represented michigan on capitol hill for more than five decades has died. Conyers was the longest serving africanamerican lawmaker in congressional history. He was also the cofounder of the congressional black caucus.
