As you mentioned, there is no charge of criminal conspiracy with the russians in the stone indictment neither was there with paul manafort, Michael Cohen, rick gates. If mueller had proof of a russia conspiracy, why hasnt he charged it you can argue it the other way, and many legal experts on our air have done so, where they believe mueller is dropping breadcrumbs in the indictments there was some in the roger stone indictment essentially, mueller alaeleged stone was aware of the wikileaks emails before they were made public they said stone was directed by trump officials, and they were directed by someone who could only be the president , to find out what else wikileaks had. That doesnt allege conspiracy with the russians, craig nonetheless, there are people who believe that mueller is holding his cards close to the vest and, at some point, will give us the big reveal it is also possible there is no criminal conspiracy. Mr. Miller, i want to read something that was in the waste th this morning the lies me ti falsehoods by trump advisers that masked efforts by people in the orbit to develop inroads with russia and leverage relationships what does this tell us about a possible conspiracy with russia and the campaign the trump campaign, trump himself, people around trump really lied about their relationship with russia and russian entities, whether his attempt to do business in russia, whether it be the trump tower meeting with an intermediary for russian intelligence, whether it be their contacts through intermediaries with wikileaks. They have lied from the beginning. I think the question that really, you know, kind of to kens point, the question that remains outstanding, have they lied because they were trying to cover up what would be a massive political scandal, but maybe didnt cross the line into a criminal act, or were they lying because people, you know, on the trump campaign, maybe up to the president himself, then candidate himself, actually committed crimes, actually entered into a conspiracy with wikileaks, or as an intermediary we dont know the answer to that question what i will say, we often talk on this program and others about, you know, whether the president committed a crime and whether there will be a finding of criminal wrongdoing by the president at the end of the investigation. We should remain mindful that that is not the only bar for president ial misconduct. Were rightly focused on this. It is a criminal investigation bob mueller has been conducting it if we see all of the president s actions laid out at the end, and the actions of those around him, i dont think just criminal activity is the only standard by which we should judge it. How should we judge that standard i think you would start by looking at high crimes and misdemeanors, the standard in the constitution for whether a president should be removed from office youd look at whether he violated his oath of office, both by actions he took in office to obstruct the investigation. I think there are other standards that, you know, when we if there isnt a move by or successful move by congress to impeach him at the end of this, it will be a standard for voters to judge at the end, whether they think his conduct in the campaign was appropriate, and whether his conduct with represent to the investigation is appropriate. Could mueller be building a counterintelligence report, as well, that we may never see . That could very well be true. Counterintelligence investigations dont always result, craig, in criminal charges. Theyre long theyre complicated. Theyre sensitive. Therefore, the information that you get in a counterintelligence investigation may not be suitable for dumping into the public domain. Sometimes, counterintelligence investigations result in criminal charges often, they do not what im guessing here is that we have both a criminal investigation, that ken and matt described, and a counterintelligence investigation, that you asked you, running parallel to run another. Chuck, we heard roger stone there last hour, in front of his home there in florida ahead of his appearance tomorrow in a d. C. Courtroom, talking again about the special counsel. Would a prosecutor want to talk to someone like roger stone as a witness . Boy, good question. So hes still speaking, but he is still not making any sense. I imagine they would but he has a lot of healing to do it doesnt seem to me like he has come to terms with either the charges against him, his role in this crime, or what the truth really looks and sounds like he was still making stuff up, talking in front of his home today, and i dont think he is going to be incredibly valuable if he continues to do that, craig. There are reports that republicans have not yet announced who is going to be serving on that committee. That, in turn, has made it difficult to sort of get off the ground, difficult to issue these subpoenas and release witness testimony in the russia investigation. Whats the latest on that . Are those reports accurate they are accurate they have not named the members, at least as of friday. I did hear the majority excuse me the minority leader say hed do so today it is overdue. It is absolutely critical weve seen two witnesses before that committee caught up in the criminal justice system. Roger stone was indict eed for lying to the committee Michael Cohen already admitted lying to the committee if the members of the committee think there are other witnesses who lied to them, erik prince, for example, who came before the committee and said his meeting with a russian banker in the seychelles was a coincidence we found out later it was arranged in advance. If there are other witnesses before the committee who the committee has evidence lied to them, whether well see a number of referrals to mueller or other entities inside the Justice Department to investigate them, i think itd be an appropriate step to take. Congressman, what say you to that first of all, do we already know whether there have been other members of the president s orbit who lied to the committee . What needs to happen, every transcript before my committee needs to be made available to the special counsel for the purposes of prosecution, if necessary, but for review of truthfulness that doesnt limit us, by the way, as a committee. We have our own capacity and oversight responsibilities there is a cop on this beat right now who needs all that information, needs it yesterday. I know the chairman is committed to getting it right away the chips will fall where they may. Look, people will be held accountable for what they said, and if they made false statements, they can be held accountable for that. First, having been a federal prosecutor for a long sometitim these are complicated and they take a long time given that, i believe mueller is moving very quickly. To those who would criticize mueller for not moving quickly enough, remember that the House Select Committee on intelligence under republican rule wouldnt provide transcripts to prosecutors to see if folks had misled our congress. If youre complaining about mueller moving quickly, some of that not moving quickly enough, some of the blame has to reside with congress in the last sessi session. Huge question mark at least 4 out of 10 democratic votes would be totally up for grabs. Probably up for grabs even if theyre in it. What do the numbers mean thats the other question it a this early point last time out, we didnt know what the field would look like we didnt know if biden would run, warren would run. Neither ended up running look who emerged and gave Hillary Clinton a fight in 2016, bernie sanders, at 3 at this point back then. You mention the obama parallel it was clear when he got in the race he would be a factor in the race, but it wasnt clear he could give Hillary Clinton actually that kind of a challenge for the nomination and, ultimately, to win it there was biden. He did run remember, people thought kerry might run in 08 thought gore might run you dont know the shape of the field. Go back to this one, 2004, the race to run against george w. Bush joe biebee lieberman had been te president ial nominee last time out. It was name recognition. Howard dean it was kerry who won the nomination, but dean caught fire in 03 you dont know if there is a dean out there you dont see now. Hes not going to be pleased. Lets talk about Howard Schultz for a moment 60 minutes, there was a profile last night theres been some talk he might be getting into the race theres been some talk if he does get into the race, hell run as an independent. To that, he said, quote, i feel if i ran as a democrat, i would have to be disingenuous and say things i dont believe because the party has shifted so far to the left how much damage do we think an independent run by Howard Schultz would do to the democrats . That is the assumption democrats have the fear they have is schultz would drain support that would otherwise go to democrats. To put up the 2016 results Hillary Clinton won the popular vote you did have, you know, about 6 million votes for these thirdparty candidates, as well. I think it is an open question, if schultz ran as an independent, who we draw from. The democratic theory would be folks who have given up on trump, this gives them another option that would drain votes from democrats. That is possible, and i understand why democrats fear that heres the other theory. Remember the soft trump voters from 2016 . They didnt like donald trump. They didnt want to vote for him, but they didnt want to vote for the democrats in the end, they checked off trumps name just because they didnt want to vote for Hillary Clinton. If you have a Howard Schultz out there, does that present, does that provide another option for the soft voters that would drain votes from trump i just dont think we know the history of these things, the thirdparty candidate sis, the assumption of what theyll do doesnt always match up with what they do. I want to bring in adrian elrod, foe former director for Strategic Communications for Hillary Clintons campaign i want to get to Kamala Harris in a moment, but lets talk about Howard Schultz what say you, if he does get into this, does it hurt democrats more, hurt republicans more is it simply too early to tell you know, i guess to an extent, it is too early to tell, but i have a lot of concerns with any independent running Howard Schultz, somebody else, anybody running as an independent, how it might split the vote look, we know from recent polling that donald trump is very vulnerable. He can be beat he could be beat potentially in a republican primary we have to have a united front in this effort any sort of potential independent running could dilute the vote i think in this case, again, i think Howard Schultz is a very commendable businessperson hes done he has a stellar record on progressive issues i think running as an independent in this particular cycle could potentially be a spoiler in terms of defeating donald trump. Lets talk about Kamala Harris now without mentioning the president by name, she made clear her candidacy is, in part, a rebuke of the trump administration.
