Time, including a period featured in a bomb shell New York Times report. The times reporting that this past spring the president talked about the possibility of prosecuting Hillary Clinton and jim comey. Thats according to two unnamed sources familiar with the discussions between President Trump and his white House Counsel, don mcgahn. It is something his former attorney general would never do, but something his new acting a. G. Previously has said should happen to clinton. Matt whitaker also under a financial cloud after some new Financial Disclosures. Well break it all down, and we do that starting with our white house correspondent, Nbcs Kelly Odonnell following it all, following the president in West Palm Beach, florida, on this wednesday. Lets start with the mueller questions, kelly o. How forthcoming was the president , and do they cover questions of obstruction . Reporter well, the profile homework for the president has now been submitted and the president s lawyers have said all along that he would not answer questions that deal with his time in office. So issues, for example, around the firing of james comey they would not engage on that his lawyers have told us because they believe that is under his article 2 power to make those sorts of decisions, but they were willing to give written answers on matters dealing with the Campaign Season and so that is our understanding of the content of the answers provided to the special counsel. The president has said that he wrote the answers and then they were sort of supervised or approved by his legal team. We dont know exactly how that process unfolded in terms of how they decided when his answers were sufficient, but the president said he read over them a few times. He also had some revisions to the answers. Big questions we dont know, were only hearing from the president s legal side. The mueller team has been notably tightlipped throughout this whole process, so we dont know what they wanted to know with respect to any issues of alleged obstruction of justice or conduct while in office, and if they will be satisfied with the written answers provided. Now, the legal team from the president including former new york mayor Rudy Giuliani has put out a statement to give us a sense of where they think things stand. The special counsel has been provided with more than 30 witnesses he says, 1. 4 million pages of material, and now the president s written responses to questions and its time to bring this inquiry to a conclusion. That call for an end to this has been going on for a long, long time, and yet, we dont see an end to the light at the end of the tunnel. Typically an investigation, it would not be unusual to have sort of the biggest fish, in this case the president be at the end of the process, but it could be a case where the legal team for the president believes any involvement related to the president could be coming to an end with his cooperation in this manner. There are of course other avenues of the Mueller Investigation that could go on. We just dont know because the mueller team isnt saying. But how forthcoming . President trump reportedly wanted the Justice Department to prosecute fbi director james comey and Hillary Clinton. He discussed this with his exwhite House Counsel don mcgahn in the spring. The president has repeatedly pressed officials on the status of the investigations, that includes then chief of staff Matt Whitaker. Hes now the a. G. Trump, quote, has continued to privately discuss the matter. It mirrors what the president has publicly said about comey and clinton. Comey is a leaker, and hes a liar, and not only on this stuff. Hes been leaking for years. He is guilty of crimes, and if we had a Justice Department that was doing their job, the democrats hated comey more than any human being. He actually did Hillary Clinton a big favor because she should be in jail. He lied like a dog on emails. She should be in prison. Maya wiley, msnbc legal analyst, danny is a va lis, and yamiche alcindor, any reaction to the story inside the white house yet . It really is a window into the fact that President Trump is still really angry at his political opponents and really hoping to wield the power of the presidency to hurt those people. I think that sometimes the people thought there was a lot of rhetoric on the campaign trail and that he was just ginning up his base by saying lock her up. Now we know he really did want to lock her up. It shows the president has some restraint in that he didnt actually follow through with this idea yet, but it paints in a different light the hiring of Matt Whitaker because he has publicly said that Hillary Clinton might have broken some laws and maybe should have ended up in jail, so now he has an a. G. That might have a different take than what don mcgahn was. Don mcgahn was saying dont do this, cautioning against this. Matt whitaker might have a completely different take. Also saying apparently at one point if you want to do it, mr. President this could lead to impeachment. I know you communicated with giuliani by text, what did he tell you about the answers to bob mueller . So far what we do know is the president didnt want to talk about anything having to do with obstruction of justice and they really focused on russias connections and things that russia might have done, but the president s lawyers and the president himself dont want anything to do with the obstruction of justice investigation. I think that ive talked to ive talked to Rudy Giuliani several times, and every single time hes repeated over and over again that its a witch hunt, that its a hoax, echoing the language we hear from the president , and hes essentially saying theres nothing to see here, but if you want to talk to us about what russia could have done in the election, were happy to provide those answers but were not going to start the conversation on obstruction of justice, which of course is a big deal because that could be at the heart of this case. The p the has spoken publicly about the idea of obstruction of justice in that interview with lest lester holt. He said that he fired james comey because of that russia investigation, so possibly Robert Mueller doesnt need the president to respond to that in writing because you have that on tv on national television. Yamiche, stand by for a second. Yamiche brought up a point thats been brought up a number of times. On the obstruction question, isnt there enough on the Public Record to already convict him for obstruction . Hasnt he admitted to obstruction on a number of occasions or am i making this up . Youre not making it up. There is a very strong Public Record for obstruction of justice. What Robert Mueller is doing is the appropriate thing, though. You go through a thorough investigation. You make sure youve talked to all the witnesses, and that does include the president of the United States. If youre preparing a case, what you want to know is what will this person say in response to these questions. Am i sure that theres not a different reading because, remember, theres a difference between i said things i shouldnt have versus i took steps. Now, its certainly evidence that he said publicly that he fired james comey because he had the russia investigation in mind, and i think you have to link that with this current story with regard to two people who are actually victims both of in the case of Hillary Clinton and the case of russian meddling, but also in the case of james comey himself where the president essentially is suggesting he should be he should be investigated for crimes. By the way, the things that the president is suggesting, both of these individuals have already been investigated and so the comey memo that hes referring to in terms of relief, that was already reviewed, and there was nothing there. Heres what the president can do. The president can say, im going to step up prosecution of all leakers. Im going to step up prosecution of all people who misuse government email. What the president cannot do is say i want to get that person, find me a crime attributable to that person. Thats something hes not allowed to do. So the next inquiry is how far did this request go by the president. Was he just musing about it in the afternoon as he contemplated lunch or dinner. As hes been known to do. As hes been known to do. He muses about a number of different things, so if he was just asking a question out loud, thats one thing. On the other hand, if as the times suggests he took more than a substantial step into asking about this prosecution, such that a memo was required by don mcgahn to impose or impress upon him that this was a really horrible idea, then maybe it went further. Then we get into ethical issues, and then we get into potentially impeachable offenses. Remember, impeachable offenses need not be crimes. A very popular one is abuse of power. Its been used in the past, and it does not correlate with any particular crime. One person who apparently might support a prosecution of at least Hillary Clinton, the acting attorney general. This is what Matt Whitaker, this is what he wrote in an ed editorial. This is 2016. Kw quote, i would indict Hillary Clinton, and he was quite vocal about it on tv and radio as well. Long story short, is theres plenty of evidence here to support a criminal charge. I think anything under the espionage act, which is section 793 f of 18 United States code, which is the criminal section, could be justified here. And i could imagine in this world that we live in that a Trump Administration could open this case and relook at these charges. However petty that might seem to some. Acting attorney general now, mat whittaker there. Whats the likelihood that he opens an investigation into Hillary Clinton . I would say probably very unlikely since theres already been a very lengthy investigation of Hillary Clinton on any possible criminal activity, and there simply is not sufficient evidence to suggest it should be reopened. We know of no new evidence. But lets go back to this issue of what donald trump has said. As early as november he was tweeting that the Justice Department and the fbi should prosecute Hillary Clinton, podesta, the democrats. This isnt actually something where we only know from this news report that he as the president of the United States, as everyones boss has put significant pressure on an independent Law Enforcement agency suggesting actions trit should take after it has completed investigations on those very topics. Whitaker is actually a huge he should be not in that seat. He should be recused, and i think what were going to see because of the comments and statements hes made about the Mueller Investigation, but i think were going to see in january the democrats actually doing hearings now asking what conversations whitaker had and whether he made promises to the president about actions he would take if he was given this position. The odds of an investigation into Hillary Clinton or james comey are 0. 0, and the reason for that is that you have a number of line prosecutors up and down the chain of command that would be unable to find a crime. Most importantly because, as was just said, this investigation has already been completed. I cant imagine line prosecutors saying, well, we already have we did that. We have that, theres no new evidence. So fortunately, the a. G. Is not a king. The doj is full of independent prosecutors who have a duty not to secure convictions but to see that justice is done. And whitaker also has a number of controversies apparently brewing. New Financial Disclosures showing that he made more than a Million Dollars from a group with backers that dont have to disclose donors. He also curiously made 9,000 earlier this year from donors to a campaign committee. This was for an office that he ran for in 2014 . I actually dont know, but i would say this goes back to the question of whitakers ability to serve in this position, and i think the fact that what we should be seeing is some very, very serious questioning by republicans, not just by democrats on his qualifications to serve as the highest Law Enforcement officer of the land. This is an incredibly wide ranging interview, actually, craig, because what i asked the foreign minister as well not just how could the crown prince not know about this, but are you going to be transparent in the trial of these five individuals that youre now holding with potentially the death penalty. He said thats something thats up to the public prosecutor. I also asked him about the possibility of regime change because a lot of folks on the ground here privately telling me that thats something thats being discussed at the very top level, whether or not the crown prince would still be able to hold on to power and become king himself. Thats an actual conversation. I asked the foreign minister about that, he said thats ridiculous. Thats a red line for all saudis and not something thats being talked about. He did feel the need once again to come out and say that this is a country that is safe, that it is open for investment. After President Trump was elected, these are just some of the headlines that we saw. You see them here on the screen for our viewers on sirius satellite radio. Ill read a few of them. The Trump Presidency destroying marriages across the country, post election stress disorder sweeps the nation. Americas therapists are worried about trumps effect on your mental health. Is this unique to this time in history, john meacham or has there always been so much strife around our Politics Around our president . Well, we had a civil war where we fought, we killed each other over questions of liberty and freedom. Families divided during the revolution. Arthur slayinger used to say the battles over interventionism and isolationism were more ferocious in intimate settings than even the battles over vietnam, but just because somethings happened before doesnt mean its not happening now, and i have a theory about this. Theres been a little butt of scholarship on it, that to some extent whats happening is as particularly main line protestantism begins to fade from the center of the country, to some extent political strife and political loyalties have replaced religious belief and religious practice. And when you think about it, so you have your own denomination. You normally assent to the fact that youre part of a larger community, but by and large, you worship in your pew, you read your texts, you listen to your preachers, and i think that because we have a social cohesion now built on our social contract that is much more about conflict than cohesion, its going to be a tough holiday for a lot of folks. Are you saying that our politics has replaced our faith . I think theres an interesting argument to be explored that there is a natural human impulse to seek meaning and order and community, and that more often than not at the moment, people are seeking meaning, order, and community in political tribalism as opposed to traditional religious communities and affiliations. Do you buy that . Its such a smart thesis, and i think its a very intriguing one. I think theres an added dimension with trump, which is that what divides us about trump isnt simply a question of policy, although there is obviously that, its also a p perception of values and the place that values ought to play in our lives. I mean, its very difficult for someone like me who has young children, a couple teenagers someone younger to explain that a man whose behavior is like that of the president should occupy that kind of position. I mean, you know, i used to have problems with some of obamas policies. I disagreed with the iran deal, one thing or another, but i never had trouble respecting obama as a man or thinking of him as a really fitting symbol for the country in the idea of the president occupying not just the position of head of government, but head of state, almost analogous to Queen Elizabeth in england. So my differences with whether it was president obama or president clinton were always essentially policy differences, president clinton was a little different because there it became a question of moral values. With President Trump, i think why its so divisive, a lot of people are saying how can you support a guy with these views about minorities, these views about women, these views about his position in society, these views about the truth. These go to the sort of questions that religious institutions used to address and perhaps john is right, no longer do. Of course the great surprise is that so many people who identify as being religious conservative christians find themselves supporting a president whose behavior is so at variance with what they espouse. One of the things that i continue to find fascinating in this current age in which we find ourselves politically especially, there was a time where you could have a conversation around a table with people who came from various political leanings, but the conversations themselves were rooted in some semblance of fact. I find now that you can be talking to people who, again, conservative, liberal, whatever have you, they dont even care about the facts. Theres no concern about facts. Fact checker brett, your paper today publishes handy guide, sort of fascinating. I saw it and thought this may be useful, not to say that other things in the New York Times arent useful, but this is the hot button issues to avoid according to the New York Times. The Midterm Election results, the migrant caravan, health care, the kavanaugh fight, the economy. Anything thats happened in the past six months you should avoid talking about at your thanksgiving table. By the way, i would encourage all of you watching and listening to print that out. And one of the things that ive been trying to do just on a personal level is separate my disgust with the president , his policies and his behavior, with my view about his supporters because i have too many friends who pulled the lever for President Trump. I know that they are good and decent and moral people, and i dont want to judge them morally simply on account of who their political preference is. Well, we talk about john tyler, so we try to do as many 19th century president s as possible. You know, my i hope theyre not watching, well, this is msnbc so theyre not. My inlaws, my inlaws in mississippi actually have only been pressed with me when occasionally im attacked on fox. Thats the only time i cross their radar screen, so no, honestly. Although since this seems to be a support group about families, i had a lunch yesterday with an inlaw where 20 of the 25 minutes or so was about politics, and it goes exactly craig, to what you just said. We just didnt begin with the same assumption, and so i would play the, you know what, in 1890 it was xyz, and you know, its a useful diversion because then they kind of wander off. I think its particularly its an interesting microcosm, right . And brett writes about this a lot. My sense is if we dont find a way to reinstate and honor the role of reason and of being able to take account of changing circumstances and shifting data to change our views on things of public value, then were not being true to what i think of as the true original intent of the revolution, which is very grand to say, but it has the virtue of being true. You know, when jefferson wrote that all men were created equal, he did it not because he was a rising young politician in virginia, but because he had been in this transatlantic conversation including the scientific revolution and the european enlightenment, and the reformations, and the translation of sacred scripture into the vernacular of guttenburg, this entire shift in the world being one in which reason could lead us past reflective obedience to authority, whether it was a pope or a king. Thats the insight to which the republic was founded, and if with dont think when people Say Something and dont think that maybe theyre right, 99 times out of 100 youre going to disagree, but ive been thinking a lot about this. I think we need to find a way to get to a kind of patriotic partisanship because partisanship is fine. Thats the oxygen of government in a free society, but it is this reflexive partisanship, and what brett just said is so important. You cant paint with a brush the you cant take the president s behavior and attribute it to all of his supporters. At the same time, his supporters have to have an honest accounting of what theyre supporting. Is it worth the tan dell. Patriotic partisanship. Fascinating conversation. I so enjoyed this. New york city could feel the coldest temperatures for the holiday in 117 years, and that could actually impact the balloons for the world famous macys thanksgiving day parade. This is a big deal for millions of people. Kristindal Kristen Dahlgren live. Reporter theyre going to make that a game time decision, craig. What theyre worried about is the wind. You know, we know that its going to be cold. We know its going to be the coldest macys thanksgiving day parade in history since they started doing this in 1924, but the big question is are the winds going to be too high for those 26 giant balloons that Everybody Loves to fly. In 1997, there was an accident, a woman was severely injured, and so they made a rule that those balloons cant fly if the winds are gusting upwards of 34 miles an hour. We are right on the cusp of that tomorrow. Theyre looking at the forecast, what theyre going to do is lay out wind detecting devices along the parade route, and tomorrow morning they will see just how high those winds are. They have the option of either lowering the balloons or if the winds are too high, they may have to ground them altogether. They havent grounded those balloons since 1971, so the 3 Million People that come out are going to be very disappointed if that happens. Theyll just have to keep an eye on those things for tomorrow morning. During that debate she apologized for saying she would attend the public hanging. Vaughn hillyard joining me now from lion mississippi. Dani Daniel Strauss is also with me. Vaughn, what did espy just tell you . Reporter yeah, good morning, craig. I just talked to secretary espy essentially about the debate in which cindy hydesmith said to all of those who are offended she certainly apologized to those individuals about the comments she had made and the tape that was released in which she referred to sitting in the front row for a public hanging. I want to play you that soundbite of mike espy here in mississippi responding to her apology. I try not to judge people. I only heard what i heard, and when i begin to hear that coming out of her mouth, i looked and she had her head down and she was reading it. My mother always told me that when you apologize to someone you look them in the eye. You tell them that youre sorry and you offended them and you try to make reparations if you can. So i cant judge her sincerity. Craig, talking to a large number of black voters here across the state over the last couple of days, theres been a i think you could call it a frustration and anger when they see cindy hydesmith in what was essentially two weeks of no apology until last night, still even at that point in talking to those voters they said that there is much more that she could do and seemingly not quite acknowledging why her comment was so offensive. This is a rural part, this is a delta region where its a high concentration of black voting population. Black voters make up about 1 3 of the electorate, and mike espy needs not only those voters but a portion of the white electorate. This race has come down to unfortunately very much a discussion about race here, craig. Thank you, vaughn there in mississippi on the ground. Daniel, let me turn to you. I know youve been following this race very closely for politico. Where does this thing stand right now . How much of a chance does espy have, and how much of the last week or two hurt cindy hydesmith . I mean, espy has a stronger chance now than he did a month ago, two months ago or even three weeks ago. These comments and the drip, drip, drip of cindy hydesmiths appearing on facebook wearing a confederate hat, cindy hydesmith reading that apology at the debates i think is going to continue to shrink the margin between espy and cindy hydesmith. Look, both republicans and democrats didnt expect this to be an incredibly competitive race, but thats what were looking at now. Something like singledigits separating the two candidates. It is fascinating to watch from afar, you know. Midterm cycle, the midterms hydesmith, espy, i think they were separated by less than a half a point. What do we know about where those other voters will go now, daniel . Its really hard to tell. The voters who supported a third candidate were voters who preferred a candidate to the right of cindy hydesmith, so its very hard to tell, a, if theyre going to just stay at home, or b, if theyre going to cross over and most of my reporting suggests that republicans expect them to either back hydesmith even now or stay home. One person with something called hemolytic uremic syndrome which is kidney failure, and for the vast majority of people, people will be better in a u couple of days, but the old oreer the people with a chronic illness can have a more severe illness.
