President trump has ordered flags at the white house and other federal buildings to be flown at halfstaff. Nbcs joe friar is in Thousand Oaks. We heard from the sheriff in the last hour. He briefed reporters. What did we find out from him . Reporter one of the most important things the sheriff did was release the name of the gunman. The sheriff says he is 28yearold ian long. He actually lives in new bury park. His house is seven, eight miles west of here. The sheriff says he is a marine veteran, that in recent years the Sheriffs Department had had some small minor interactions with him, the most recent was actually earlier this april when authorities were called to his house. He was irate. He was disturbed. A Crisis Intervention Team was called in, but determined not much more needed to be done, and things were sort of let go there. That was according to police and Law Enforcement their last interaction with him. We do know more about his gun. The weapon was a glock 21, 45 caliber with an extended magazine. What we dont really know at this point is the motive, why did he do this. The sheriff says thats still under investigation. What might provide some answers, serving a search warrant on the gunmans house. The sheriff offered more information about what happened when the gunman arrived here on the scene. Take a listen. It appears he walked up to the scene. He shot the Security Guard that was standing outside. He stepped inside. It appears that he turned to the right and shot several of the other security and employees there, and then began opening fire inside the nightclub. Reporter the sheriff says about 150 to 200 people were inside borderline when the gunman came in and opened fire. Witnesses describe a chaotic scene. Some say initially it sounded like fireworks. Then they realized it was gunfire. Some were hiding in the attic, the rest rooms. They spoke with one man who says he was able to get out the door, that the gunman had originally come in. Some witnesses also describe smoke bombs. Authorities, investigators have also heard that and are still working to confirm it. One witness describes that the gunman seemed to act with precision. Take a listen to what she had to say. I was looking directly at the front entrance, and i saw the suspect come in, pull out his gun and start shooting immediately, but yeah, you was just blown away what i just saw with my own two eyes. He didnt even say anything. He walked in, didnt say one word, just pulled out a gun and started shooting. Right when i saw the actual like flasher on the gun, i immediately just stood there in shock wide open my mouth, and i dropped down to the floor just to get cover and make sure i was safe, and then i started crawling on the floor just to get access to the side door where i was at, and then once i was able to get up started running, and then i started hearing more gunshots, and i didnt know if they were directly behind me, but it all sounded so close. I just started running as fast as i could. Reporter the gunman did die at the scene. The sheriff does believe that he shot himself. As for the 12 other victims, 11 of them still have not yet been identified publicly by authorities, and of course the 12th victim was Sergeant Helus who many are calling a hero. He was minutes away from the scene, arrived within three minutes of the calls coming in to 911. Went in when he heard shots being fired, exchanged gunfire according to the sheriff with the gunman. He was hit multiple times. A california Highway Patrol officer was also with him, pulled Sergeant Helus out. They took him to the hospital, but he died a little bit later at the hospital. Craig. Joe friar for us there in Thousand Oaks. Thank you. Sergeant eric bushow is the spokesman for the Ventura County sheriffs office. He joins me now. Again, before we go to the sergeant, just a little bit more here on Sergeant Ron Helus, the 54yearold that joe just mentioned in his report there. We were told that he was struck multiple times by gunfire. He is a 29year police veteran. He was reportedly looking to retire in the next several months, but most of those, if not all of those who were there on the scene have described Sergeant Heluss efforts as nothing short of heroic there. Again, ten other people injured. Were going to get an update on their condition in just a moment, but lets turn now to that spokesperson. Sergeant, again, the suspect has been identified. What more do we know about him . Do we have any more information, any indication as to what might have motivated this man . Im sorry, the volume was really low. I couldnt hear. All right, it sounds like were having a bit of a technical issue there with the sergeant. Sergeant, craig melvin here at msnbc. Can you hear me now . I can, sir, yes. Okay. Were live on Television Just fyi. I want to go back to the gunman here. Hes been identified, 28 years old. What more do we know about him . Any indication at this point as to a motive . No indication of motive at this point. You know, thats going to be a big focal point of the investigation. Obviously theres a lot of moving parts to sorting through an incident of this magnitude. A typical crime scene might take hours or minutes depending on the scope of it. This will take days at least, and i can tell you that he did serve in the marines for four years as a machine gunnar, aer then he served after that. To look for any evidence related to this, and we dont know the motive, and were going to do everything we can to try and determine just what led up to him coming here last night and committing this horrific act. Sergeant, that four years that he spent in the marines, did he see combat . You know, i dont have details on exactly what his service was, so without confirmation, i dont want to comment on that, but we do have confirmation from his family that about his military service, at least that it was four years active and some procedure of period of reserve time after that. I want to talk more about this incident back in april. We know that deputies responded to that home. What did they find . So to give you some context, we respond to people in crisis all the time, and in california we have whats called a welfare and institutions code section 5150, and that deals with people who are either a danger to themselves, a danger to others or gravely disabled where they cant care for their own needs, and so when we have the authority to take somebody temporarily into custody against their will and take them to a psychiatric facility, if they meet that criteria at that time, and that could be that their suicidal, homicidal or just unable to care for themselves. The family called us. They were concerned about some behavior that he exhibited that day in the house, and our deputies responded. They contacted the individual and talked to the family, and also our local Mental Health crisis team went and evaluated him. He did not meet the criteria at that time of being taken 5150. So somebody can exhibit signs of erratic behavior or even mental illness, but if they dont meet those criteria of either being a danger to themselves or a danger to others or gravely disabled, we cant take them against their will to a psychiatric facility. Do we know if he purchased this handgun, which were told was purchased legally, do we know if he purchased the handgun after this april incident . That i dont know. I know our partners with the atf are looking at the details of the gun purchase, where that happened, what the circumstances were. All of these things, now its rolling back the clock and looking at everything step by step. You lost one of your own this morning, Sergeant Ron Helus, 29year veteran of that department. What more can you tell us about Sergeant Helus . You know, ive been on 29 years as well. Ive known ron throughout my career. Weve at times worked together. You know, were a pretty big county, so were not always working in the same building or the same assignment, but ive had the pleasure and the privilege of working directly with him as an investigator, as a patrol deputy, and he was a cops cop. He was the guy hes the guy that if you were the victim of a crime, hes the guy you want investigating it because hell go to every length to find the person responsible. He was thorough. He was patient, he was kind, calm no matter what was happening. I mean, he was a tactician. He was on our s. W. A. T. Team for many, many years. I have no doubt his tactics were sound. When he went in there, he had every intention of going in there and ending that threat and saving lives. Unfortunately he was just met immediately with gunfire. Its just a tragic loss for all of us, for the community. Our hearts go out to his family, i mean, i just cant imagine what theyre going through. He was a year away from retirement. Its unacceptable, and not just the loss of ron, but you have 11 other innocent people that were here to have a good time, and you know, their families are just, you know suffering unspeakably after such a horrific incident. I dont know what category you put this in, but its got to stop. How do we stop it . I dont know. I wish i had the answer for that. I wish you did, too sergeant. Our thoughts and our prayers and all of our love with you and the department and those families this morning. Thank you for your time, sir. Thank you. I want to bring in clint van zan zandt. Clint is a former fbi agent. He was also a former profiler, and clint weve heard from a number of eyewitnesses this morning already who say this this gunman was dressed in black. He looked like he knew what he was doing. He had one of these handguns that he had managed to get an extended clip for, which is against the law in the state of california. It would seem by all accounts that this is a guy who knew what he was doing with that gun. We know he was a marine veteran now. Based on all of that, the venue what it occurred as well, whats your sense of the gunman . Well, were learning a lot obviously minute by minute like we do, and as you suggested earlier, depending what website you go to, this is at least number 308, 310 or theres another website that suggests this is number 376 Mass Shootings in america where four or more people are shot or killed, and thats just this year. I think theyre reporting he was a marine corps veteran, you asked the logical question. Is he a combat veteran. We dont know, but one doesnt have to be a combat veteran necessarily to suffer ptsd. The Veterans Administration reported this year over 20 military veterans either current or past veterans commit suicide every day. This guy allegedly shot himself after committing all of this murder and mayhem, so i think were going to see a Mental Health issue one more time like you and i have discussed so many times before. The question is was there a chance we could have intervened. The sergeant just told us he was evaluated one time, and he was found evidently not to be a threat to himself or others, and yet he acted out like this. We dont have the litmus test to administer to a person every time they say are you going to be the mass shooter of the future, and unfortunately until we develop that test or until we help these people more, were going to see individuals acting out, perhaps ptsd, perhaps some personal motive. We dont know, but as an exmarine, someone who likely knew his way around guns with a 45 caliber handgun and extended magazine, this guy went in especially if he had smoke bombs he had planned this. He knew where he was going. He knew the inside. He knew what he would be up against, and he decided to do it anyway, to commit this act of mass murder. And there are reports from eyewitnesses that there were smoke bombs detonated inside that nightclub. And again, at this point investigators poring over social media, poring over those accounts. Theyre conducting a search at the home right now. Is there any way we can identify would be mass killers . Is there a better way to identify them than i guess the way were not doing it right now . Yeah, you know, we always have the benefit of 20 20 hindsight afterwards just like in this particular case. You have heard i teach seminars all the time on violence in the workplace, and we tick off the various reasons why either a School Shooter or somebody in a workplace, all of these various aspects of an individuals personality, but we still cant do that, craig, and you know, we wish we could. You and i are unique. Every person out there. We wonder what set this guy off. Thats going to be the question. If he had the handgun, if he had been evaluated previously for Mental Health, why this particular bar, why that night. We had a mass shooter in california a couple of years ago, a college student, and he killed people because he couldnt get a date. We have others who go into high schools and shoot them up. So we know this is cooking inside of their head. This is not just somebody that snaps. This is somebody who planned it, probably conducted summerrveill. Knew what he was going to do, knew what he was going to be up against when he went in there. Somewhere along the line on this path from ideation to action we have to have the ability to intervene and interrupt that thought process. Some people we do. We stop people before they do commit these acts, but again, we dont catch every one. And just like we cant hit a thousand percent in baseball, we struggle with this trying to intervene, trying to find these individuals to do something for them before they act out. But again, right now everything looks like a possible Mental Health condition. The question is why this particular bar. Did he have a victim, or was it just people having a good time. His life wasnt good, and therefore he decided to act out. Well find that out later on today hopefully. Hopefully. Clint van zandt, thank you. Break the glass . Sources are telling nbc news that Chris Christie is currently at the white house. Two people familiar with his visit say that christie is being considered for the attorney general job. The acting ag already facing calls to recuse himself from the russia probe. The white house said it has no idea why the new acting attorney general should have to recuse himself from the russia probe. Youre asking me if hes recused from it. Why would he . Im asking why would he be recused . Nancy pelosi and House Democrats have called for Matt Whitaker to recuse himself from the probe as yJeff Sessions did. Whitaker was a legal analyst on cnn. He endorsed antimueller sentiment including an editorial about the, quote, mueller lynch mob. Whitaker called investigations into trumps finances a potential red line and possible witch hunt, and he talked about a scenario much like the one he is in now in which an acting attorney general could slowly kill the mueller probe. So i could see a scenario where Jeff Sessions is replaced with a recess appointment, and that attorney general doesnt fire bob mueller but he just reduces his budget so low that his investigation grinds to almost a halt. Were going to check in at the white house in just a moment and talk a little bit more about this Chris Christie development. Let me bring in the panel. Paul rosen was a senior counsel on ken star investigation with bill clinton. Bill kirchner, an msnbc legal analyst. Let me start with you. Lets talk about whitaker here. Also once worked for sam clovis, the Trump Campaign ad who testified before muellers grand jury. He managed cloviss 2014 campaign for iowa treasurer. Taking all of that into account, should whitaker need to recuse himself from the russia probe . Taking all of that into account i think the first step that should be undertaken by the department of justice is whitaker should be made to interview with the ethics officers who do this exact thing. They decide whether potential conflicts of interest require recusal. So that should be the first step, and you know, its hard to say in a vacuum. I will say when we see the reporting about some of the things whitaker said on cnn, some of the things he retweeted, and that was not as sort of a paid lawyer taking a position. That seems to be his own personal belief about the nature of the Mueller Investigation. And lets just say, he doesnt think highly of it. I think there are serious conversations that will have to take place with ethics officers at the department of justice, you know, as federal prosecutors, we do conflicts checks all the time, and i dont know that ive ever seen a more important conflict check than the one thats going to have to take place between those ethics officers and mr. Whitaker to see whether he should, in fact, be recused from heading up or supervising the Mueller Investigation. Paul, whitakers antimueller comments, are they any different than peter strucks antitrump comments . I guess that depends upon your perspective. I agree completely with glen that the right course here is for mr. Whitaker to talk to the preo in the department of justice and seek an opinion. Thats what Deputy Attorney general rosenstein did when it was suggested that he recuse himself from supervising the Mueller Investigation, and it is that kind of inquiry that invokes the authority of the Career Office in the department of justice that would give the American People confidence that mr. Whitaker is acting properly or not, as the case may by. Like, glen, i dont know the facts fully, but thats what the inquiry is all about. Paul, you would concede it certainly looks and smells a little funny . Absolutely. Thats why i think its mandatory that mr. Whitaker ask the question and get an answer and that that answer be made public to us all. Theres more than ample evidence to warrant the asking the question and the American People deserve the answer. Democrats will soon control the house, so if whitaker would try to cut muellers budget or trim his staff, one would imagine he would probably have to justify his actions to a House Committee possibly during live testimony. How easy would it be to affect bob muellers investigation . You know, it depends on first of all whether whitaker is permitted to oversee it or start to oversee it. Craig, i would say that the president may have engaged in yet another miscalculation here, at least tactically, because if you look at the fact that the president has been saying and tweeting all along Jeff Sessions didnt protect me. He didnt shut down the investigations. I dont have an attorney general. He then fires him. Hes never complained that Jeff Sessions didnt implement the administrations immigration policy, for example, so it seems pretty transparent why he fired him, and then he replaces him with somebody who is on the record as saying we need to strangle at least financially the Mueller Investigation and put it out of its misery. That could be the kind of miscalculation that bob mueller will look at at yet another indication of obstruction of justice. Bob mueller is ten steps ahead. He has been preparing for this eventuality. He has perhaps done what he needed to do in the grand jury to prepare diindictments. The bob mueller i worked for and learned from, he has been preparing for this eventuality for at least six months. Paul, no love lost between the president and his former ag. A quick primer. Im disappointed in the attorney general for many reasons, and you understand that. I am disappointed in the attorney general. He should have certainly let us know if he was going to recuse himself and we would have used a put a different attorney general in. I wanted to stay uninvolved, but when everybody sees whats going on in the justice department, i always put justice now with quotes, its a very, very sad day. Jeff sessions recused hymimself which he shouldnt have done or he should have told me. He took the job and then he said im going to recuse myself. I said what kind of a man is this . Paul, Jeff Sessions legacy, what is it . Hes the kind of man who follows the law. I agree with glen that you can agree or disagree with his implementation of President Trumps immigration policy, but one thing that Jeff Sessions will be remembered for is as an institutionalist who is committed to the integrity of the department of justice. His high note will be having recused himself from the russia investigation as was completely appropriate for him to do so. His high note will be defending the integrity of the Mueller Investigation and its independence by refusing to resign under pressure until now, until the pressure became too great. Its a sad legacy, really, because he should have been able to go out on a high note as someone who finally got the job that hed been hoping for much of his life, and now hes going to be remembered as the president as the attorney general who was forced out by a narcissistic president who cant stand somebody who says no to him. Well leave it there, paul, thank you, glen, thank you as well. We turn back now to the other big story we are following here at msnbc. We are learning more about that mass shooting at a bar in california that left 12 people dead, including Ventura County sergeant. The officials have identified the shooter. He is a 28yearold marine corps veteran. They say that he has had several minor interactions with Law Enforcement. They also point to an incident back in april in which officials were called to the home where he was living, and there was a Mental Health check. The weapon, meanwhile, were told that weapon was legally purchased. It was a glock firearm. Msnbcs Chris Jansing and Jacob Soboroff are gathering the latest details. First we go to chris at the family reunification center. Chris, what are you hearing . What are you seeing . Reporter well, theres a press conference going on right now, and there was just a description by the local councilman, rob mccoy, that is just as heartbreaking as you can possibly imagine. He said there are 60 families in there. None of them have been given notifications yet. He said as you can imagine there is a lot of crying, a lot of people are pacing, and as he put it, the longer people have had to wait, the more intense it has become, and many people have been there since the Early Morning hours, so they have been waiting a very long time. Always when you have these Mass Shootings, the scene afterward is chaotic, and theyre very methodical about identifying both the victims and those who were injured. Talking to Police Officials, they say that there was an effect in there because so many people ran and so many people were injured in trying to get away, there are at least five local hospitals within a very short distance of people taking themselves, other people taking some of those who were injured, that it is a complicated process as it always is. Inside there every Single Person who is there is being assigned at least someone, a counselor either from the red cross, there are fbi people who are there, victims advocates who are there, and their priority is to get the information to those folks as fast as they can. I can tell you after a period of being very quiet i saw at least one Family Member who came rushing in. Understandably, she looked completely distraught. She was young. She looked to me to be in her late teens or early 20s, and she says my brother is missing. Where do i go to find out about my brother, and we directed her into that center. Again, right now they dont have any specific information. I would just also say that they have asked here for prayers. This is a community that not so long ago had an incident at a mall just down the road from here where a man shot his wife in public and then attempted to shoot himself, and you have a place where a lot of people who went in there said, look, im a teenager. My parents let me go to the borderline because it was considered a safe place. And wednesday nights in particular when there were so many teenagers. For these families who are inside now the Thousand Oaks teen center, the wait continues, and a horrific one it is, craig. Chris jansing there in Thousand Oaks. Chris, well be checking in with you throughout the afternoon. Thank you. Lets move to Jacob Soboroff. Jacob is outside the Medical Center where sheriffs Deputy Ron Helus was taken. Jacob, what more do we know about those who are still being treated . Reporter we know that there are at least a dozen additional people who are injured, not necessarily craig just at this Medical Center, but throughout the Thousand Oaks area of Ventura County region. Were just north of Los Angeles County here in ventura. And Ventura County is where sheriffs Sergeant Ron Helus had been on the force for 29 years. He was one year away from retirement. At this point he was a patrol sergeant. He had been on the s. W. A. T. Task force that you had heard about earlier in the hour. He had had probably just about every job in this department, and it seems like from what weve been able to gather being up here, everybody knew and loved this man. It was it is an 800deputy force. It seems like he had a personal connection with more people than one might know. About an hour and a half from now, his body will be taken from here where it was delivered not in an ambulance but in a patrol car by fellow deputies early this morning and taken in a procession to the Ventura County medical examiners office. Sergeant helus is survived, of course, by his wife and his son, and the process that we are going to see in an hour and a half is that his body will come out in an official procession here with the Ventura CountySheriffs Department on to the street. Up on the 101 freeway and head north where ultimately he will be laid to rest. I want to quickly talk to you tactically about what this sheriff sergeant did. He did not wait for a perimeter to be established when he heard there was a gunman inside the borderline bar ask grill. He didnt wait for backup. He showed up on the scene. The first Ventura County sheriffs deputy to show up on the scene. He was joined by two other california Highway Patrol officers. They went this there immediately. This was an active shooter situation. They didnt wait for anybody else. What ive been told by people on the ground here, other Law Enforcement officials is that Sergeant Helus undoubtedly saved other peoples lives and ultimately paid the ultimate sacrifice himself. Gunshots ring out and this guy runs in. Jacob soboroff, Thousand Oaks, california. Thank you. Earlier in the broadcast, we had been talking about the military record of this shooter at the bar, and youll recall i asked the fbi profiler whether or actually, i asked the spokesman for the Police Department whether the shooter had seen combat. We know that he spent some time in the marine corps, and now it seems as if we have the answer to that question. Nbcs pentagon correspondent hans nichols joins me now with that answer. We have the official Marines Service record and he did see combat in afghanistan. It looks like in 2010. From his Service Record we know what he did, what his mos was. He was a machine gunner. It looks like he was in active duty for about three years, dates of service from 2008, august 2008 to march 2013. Now, he got out as a corporal. He did have several awards. He had a navy unit accommodat n accommodation, a Navy Meritorious Unit accommodation. He served with the second battalion, third marine regiment, and he was deployed to afghanistan from november 16, 2010, to june 2011. It was at that time that you have president Barack Obamas surge in afghanistan, so it does look like he was with the marines in afghanistan. Well get more as we know it, but the marines of course are offering their condolences to everyone. Hans, we know that after his abouti active duty tour he also spent some time was it in the reserves or guardsman . We heard that from local Law Enforcement. This says his dates of service are august 2008 to 2013. Im looking through this real quickly here, and its not obvious to me when he got out officially and when he was in, if he did serve in the marines. This is saying he left march 2nd of 2013, but well check back with the marines and try to get you a better answer on if he did any time in the reserves. As were having this conversation, this is a live look outside that shooters home. We were told by a Police Official earlier in the hour that investigators are there obviously looking for any sign of a motive. I assume that this Service Record gives an indication as to whether this marine might have had some sort of issue while he was enlisted . It doesnt say if he was discharged dishonorably from this. We do know his rank when he got out, and his rank was a corporal. They looked at her and determined that she had broken, fractured three ribs on her left side, so shes going to remain in the hospital for observation and any potential treatment, and they say theyll let us now when shes released. Shes 85 years old. Shes struggled with a number of Health Issues over the years, but has always remained active on the court cou. She would have been at the Supreme Court today, this is the formal welcome for the newest Justice Brett kavanaugh. Matt whitaker the new attorney general was there at the court, but not justice ginsburg. Were told at this point they havent found anything beyond just the fractured ribs, no punctured lung or anything like that, for example. And christie is among the invited former u. S. Attorneys, former federal prosecutors who have an interest in this issue who were invited to participate in a meeting here today. It happens to be the day after the day after. We saw the midterms pass. We saw the resignation of the attorney general Jeff Sessions and Chris Christie is here. He is someone who has publicly expressed interest in a role like that. I have multiple sources saying that he and the president speak with some frequency and that both President Trump and the former governor know where each other stands on the issue of a potential role for christie in an administration in the position of attorney general at the department of justice. They each know what their thinking is on this. My past reporting shows that christie had been offered up to five different roles in the administration while he was still the sitting governor of new jersey, and declined all of those wanting to complete his full eight years two terms as the new jersey governor.
