President trump modems ago, defending the Supreme Court nominee, blasting democrats for holding up the nominee, withholding information. We are looking to get this done as quickly as possible. He is a truly outstanding person, as you know, hes got an unblemished record. This is a terrible thing that took place, its frankly a terrible thing that this information wasnt given to us a long time ago, months ago when they got it. They could have done that instead of waiting until everything was finished. Thats what the democrats do, its obstruction, resist, whatever you have to do. With all of that being said, its a process that we all feel, speaking for all of the republicans, we feel we want to go through this process and give everybody a chance to say what they have to say. President trump there just a few moments ago, going on to say the fbi should not be involved in investigating claims of Sexual Misconduct because its not their thing and they dont really want to, anyway. Meanwhile, Brett Kavanaugh for his part hunkered down for a second day at the white house. He and a team of advisers were preparing for what could be an explosive day of testimony in front of the Senate Judiciary committee. He and his accusers Christine Blasi Ford have been asked to appear. We dont know if she will appear, that could determine if kavanaugh is determined as a Supreme Court justice. There has been no fbi investigation of fords claim first reported in the Washington Post. That claim that kavanaugh sexually assaulted her during party at a maryland home back in the early 1980s kavanaugh denies the allegation, jeff bennett is at the white house this afternoon, case hunt is on capitol hill. Let me start with you there, jeff. We just heard from President Trump saying among other things the fbi doesnt want to be a part of this thing. Reporter thats right, craig. Let me put the president s comments in context. What you see here is the white house trying to execute what is a political tricky strategy when it comes to kavanaugh. Its a strategy that serves two goals, really, theyre trying to sabotage his defenders without alienating those republicans, Senate Republicans whose votes they need who also say that Christine Blasi Ford deserves a public hearing. So that is what accounts for the president s uncharacteristic noncombative approach as it relates to the accuser for it. What you hear him doing instead is attacking the process, democrats, attacking senator Dianne Feinstein he says for sitting on the allegation for so long. As for this piece about the fbi, people close to the process say kavanaughs Background Investigation was concluded long before Christine Blasi Ford came forward with her investigations, in order for the white house to open the investigation the white house has to request it. The white house hasnt done that and yes the fbi would be with limited evidence, since it happened 35 years ago, they conduct routine background checks oftentimes with thin evidence. Its something they could do if the white house sees to request it. So far thats not happening. Jeff, stand by if you can for a moment. I want to go to case hunt on the hill. Casey, i know you spent time there last hour talking to senator jeff flake. What did he tell you or other lawmakers saying about all of this . Reporter well, at this stage, craig, this is really a question strictly of credibility the hearing as you pointed out at the top of the show is shaping up to be a he saidshe said that results in everyone having to decide, who do they believe in so the question we have been asking lawmakers today is that if, in fact, it does seem that dr. Ford is credible and senators are not able to discount the allegation that she is making, is that a disqualifying set of facts . Does it mean that if somebody who behaved in the way that dr. Ford alleges Brett Kavanaugh did, should they sit on the federal, on the Supreme Court . And thats a question that jeff flake made a little bit of news when i talked to him earlier when he said, if, in fact, he believes her, he cant vote for Brett Kavanaugh for the Supreme Court. Take a look. We have the hearing set for monday. What id insisted on is that we, one, have a hearing, two, have it in a time that she could be here. So for that, we gave a oneweek notice and complied with senate rules. So the hope is se can come on monday. She deserves to be heard. As soon as she came forward, she deserves to be heard with an allegation leak this. Reporter but mistakes were made during the anita hill hearings. That did not age well. It didnt. I hope we remember that. Reporter so you heard him talking a little more generally there about the tone of this hearing and what republicans will need to do. But he did go on to say that, if, in fact, he believes Brett Kavanaugh behaved the way dr. Ford alleges, he cannot vote for him. The Democrat Doug Jones from alabama had to say to us today. He has been on the fence about whether he was going to vote for kavanaugh. Craig, i want to draw your attention to one looming reality the Senate Judiciary republicans are actually right now huddled in Mitch Mcconnells office, if you what you can do under this hallway behind me, you will get to his office. They have been in there through this afternoon, trying to figure out what to do next. Because they havent heard yet from the lawyer for dr. Christine ford and there are some questions swirling about the fbi investigation, the democrats are demanding be reopened in advance of the hearing. Is that something the lawyers are considering . Quite frankly, if they dont hear anything back from them, its hard to see how we move forward on the monday time table. We should emphasize there is some confusion and uncertainty on capitol hill at this hour exactly how this will unfold. Uncertainty because we dont know if she will show up for that hearing on monday. Reporter there has been no response at all. We dont want to speculate yes or no on this. Her lawyer was out of the office when a lot of this was unfolding. Again, the committee is in the same place that all of us are right now, very much in the dark. To be clear, her attorney said yesterday she would be willing to testify. But saying a client would be willing to testify and is going to testify are of course two things that are very different. Really quickly, we know judge kavanaugh was at the white house working the phones yesterday for nine hours. We know he was at the white house again today. Is he still there at the white house, jeff . If he is sill there, what is he doing . Reporter put it like this, we havent seen him leefbl. We are told he is working alongside don mcgahn, and he is working ahead expecting this hearing to happen on monday. So he is preparing for that, craig. Jeff, if the president is at the white house and his Supreme Court pick is at the white house, why wouldnt the president at least say hi . Reporter yes, its a great question. The president was asked that directly by one of the people reporters in the oval office. He said i have no reason to speak to Brett Kavanaugh. He says he will do fine. Hes a great nominee. He called him a qualified man for the job. So President Trump wouldnt explain, elaborate on why they wouldnt have these kind of conversations. But for the moment, we understand that Brett Kavanaugh is spending the time as he did yesterday, those nine hours with the white House Counsel not having any direct conversations with President Trump. Reporter i think hes trying very badly not to poisen the well with senators like senator flake, who really does sincerely want to here frar from this womd deserves a hearing the republicans have made three problems for themselves, first, they are attempting to exclude someone who the accuser says was in the room, mark judge. That is not going to fly. You cant exclude someone who is a witness if the issue is credibility. He would be the tie breaker. Second problem, at this point theyve done no factual preparation. This is going to hurt republicans frankly more than it will hurt her. Because they dont know what her answers to questions are going to be. You never ask a question as a lawyer unless you know what the answer is. So theyre cutting their own necks by refusing to do preparatory work the third problem, of course, is the anita hill problem, can they question her rigorously, firmly, toughly without seeing like a bunch of oakers . Some of these same people done do that at the anita hill trial, at the anita hill hearing, but right now, its a different mood in the country. If they come across as overbearing, tough, cynic aal, snide, theyre going to have a problem with voters. This is what she tweeted a short while ago. And so i think its reasonable to expect that as a functional matter, he does not have access to that information, but as a theoretical matter of his authority under article 2 of the constitution, he could demand access, sure. So as she sits there alone as you saw in the footage before from 1991 for anita hill, she has to carry the flack for herself. She will be subjected to extensive quebec and certainly about some very traumatic detalsz about something that happened more than 30 years ago. On the flipside there is a presumption of innocence Brett Kavanaugh carries with him throughout the course of this questioning. Because of that, there is a big difference. We know this committee wants Brett Kavanaugh confirmed. We know they want him to be the next Supreme Court justice, but do they want to hear the truth about what happened 30 years ago . That is something that dr. Ford will have to be grappling with when she looks them all in the eye when they question her. Lets talk about brock long, while i have you here, femas head, are you worried at all that the investigation into any potential wrong doing could take away potential resources from the storm recovery .
