He was nominated by president george w. Bush. President trump this morning says he expects the nomination process to go smoothly. Last night was an incredible evening. Brett kavanaughs got rave review, rain reviews, actually from both sides. And i think its going to be a beautiful thing to watch over the next month. But he has gotten rave reviews. All right. Lets get to the details now in justice correspondent pete williams. He was the first to break the news of the president s pick. Pete, let me start with you, sir, so much speculation about how a Justice Kavanaugh might handle roe v. Wade or same sex marriage case, some of the other more controversial issues of our time as well . What can we glean from past opinions, writings, about the kind of justice he would be . Well, attempting to decide what kind of justice he would be by looking at his writings as an Appeals Court judge wont get you very far, for the simple reason appeals judges must follow Supreme Court precedent. Theyre not free to say i think the Supreme Court is wrong about this. They cant do that they would be reversed by the Supreme Court. So the rule is they have to follow what the Supreme Court says the law is. Hes done that pretty well. Even within that broad kind of structure, some justices apply it more conservedly than others. He is certainly a contev e sesc. Some of his decisions havent satisfied all of his supporters so they are rallying around him now. Based on his writings, his rulings, youd have to say he is not the most conservative or the least, somehow in the middle. How about that for a definitivancer . Pete, you have been following this story closer than most. How much of a surprise was this pick to you . Well, i have to personally say, i always thought it would be kavanaugh, but only because of all the factors that we now know and the fact that the president looked at it and decided against Thomas Hardiman last time. Amy Coney Barrett seemed to not have enough experience. Shes been on the court eight months, no other government experience. It just seemed like all the sort of things the president was interested in, Brett Kavanaugh had. But i think, frankly, if it had been any of the three, Raymond Kethledge or kavanaugh or Thomas Hardiman, it wouldnt have been a shock. Kavanaugh just seemed like the more, perhaps the word is conventional choice. Garrett, the pressure is on there on the hill, different groups already putting out statements. The naacp saying this morning in a statement, in part, Brett Kavanaugh is a dangerous ideologue, whose extreme views on civil rights would exact a far right, we say this is the vote of your career. We are in the fight of our lives. We hope you prepare for battle this from planned parenthood. There is no way to sugar coat it, the way to access safe, legal abortion in this country is on the line. What are you hearing there on the hill from lawmakers, garrett . Reporter well, craig, look, we are staring down the battle of a months long multibillion lobbying fight to influence probably as few as a half a dozen senators whose votes seem to be at play here. You got Chuck Schumer the leader of the democrats rallying thus far a more liberal third of the Democratic Caucus of the senate who said under no conditions will they vote . The vast majority in the senate will likely ultimately take that position over time. Thats probably not going to be enough to stop his nomination, in part, because it does seem that kavanaugh, at least so far, seems to be getting the support of some of those moderate republicans, whom he would need to get across the finish line. I just talked to Susan Collins a senator from maine. Collins is an abortion rights supporter. Her view as to whether or not kavanaugh would support or stands by a precedent in roe versus wade will be extremely important in her decision. I asked her kavanaughs views expressed in 2006 when he was confirmed for his day job. This was his response. Back then, he said that he considered roe to be settled precedent and that is my judgment as well. So i was glad to hear him say that at that time. Obviously, its an issue that im going to raise with him, his role as the Circuit Court judge is very different from a Supreme Court judge. Reporter you heard col will you please alluding there to the role as a Circuit Court judge and Supreme Court justice, as pete was talking about. Again you hear Susan Collins sounding what favorably incliepdz towards judge kavanaugh. Last year, kneel gorsuch sounded like he wanted to speak to him in his office and would hold town halls in wet virginia. West virginia went for President Trump what was it 40 points . I think we will know what he is going to hear in West Virginia from his constituents. So i think few are a republican in favor of this nomination, you probably feel pretty good about where you start today. Craig. Interesting. Because a lot of folks have been asking since that nomination was announced, as you know, senator murkowski, senator collins voted to affirm him in 2006, how could they then change their mind this time around . It seems perhaps we got a bit of a glimpse into that thinking there with senator collins just moments ago. Garrett, thank you. Pete, thanks to you as well, always, sir. Lets bring in john meacham how, president ial historian, wr snbc contributor and Justin Walker an assistant law professor Se University of louisville. For the purposes of this conversation, he is also a guy who clerked for judge caf narcotic and also for retiring justice man thoin kanthony kenn. We appreciate you taking hours. You worked with judge kavanaugh, you work with Justice Kennedy. What can you tell us about the kind of justice that mr. Kavanaugh would be . Judge kavanaugh is an independent thinker with an almost unprecedented level of experience for a Supreme Court nomination. He has served 12 years on the second most Important Court in the country. Hes authored some 300 opinions and on 13 different occasions, the Supreme Court has vindicated an penalties written by judge kavanaugh. Those opinions by the Supreme Court that have vindicated judge caf narcotic, they havent all been written by thomas or alito. There are opinions by prior, by roberts, Justice Kennedy has written all those opinions. I think Justice Kavanaugh is extremely qualified, an independent thinker and an excellent Supreme Court justice. Judge caf narcotic, roe v. Wade, settled law . You know, judge caf narcotic said in 2006 that roe v. Wade is a precedent of the court, i expect this time he will say it is a precedent of the court, if anyone is curious how he should handle precedent, i encourage emthem to look at a book he wrote, called the law of judicial precedent. I will warn you, its a thousand pages long, so its a bit of a sloc. What you will finds in that book over and over again is judge kavanaugh saying press dent is so important, the virtues like consistency, predictabilitiaby, stability, they are issues he cares about a lot. Ion meacham, one of the things that struck me most last night. I want to put this full screen for our viewers, this graphic here the existing justices on the high court. There they are, all of them either harvard or yale law school. Judge Kavanaugh A Yale graduate. I may be wrong, Justice Robert is either outside new york city or major metropolitan area, hes from the midwest. Why only draw from east coast elite schools for a court thats supposed to represent the interests of the nation at large . Well, probably because the beach reading for these folks is the law of judicial precedence, which is a thousand pages, which worries us. I think you have, there has been this trend in the court towards lawyers, towards people who spent their entire career in the law i should say. There have been debates through the last 30 years or so, having a few more people with political experience like earl warren, like hugo black, judges who have actually held office and are about consensus building. You can argue that it was a war on it and the governor of california and the Vice President ial nominee in 1948, that enabled him in many ways to build that unanimous decision on brown versus board of education. But, right now, it is a kind of ivy league cartel. I think its an interesting point about gentleman graphic and education diversity. I think judge kavanaugh, there are many, many folks on the left and center left who are worried about this, but one thing i would say and i think justin would agree is this is the kind of republican peck you would have gone, whoever the republican president was. So in an era where we are worried about norms, actually, this is one where this is a fairly normal appointment, it seems to me. John, judge kavanaugh, he made a point last night during his acceptance speech, if you will, he made a point of highlighting the women who have impacted his career. Heres a part of what he said. For the past 11 years, ive taught hundreds of students, primarily at harvard law school. I teach at the constitutions separation of powers protects individual liberty. And i remain grateful to the dean who hired me, Justice Elena kagan. As a judge, i hire four law clerks each year. I looking for the best. My law clerks come from diverse background and points of view. I am proud that a majority of my law clerks have been women. John meacham, was there a message there . It wasnt really a dog whistle. It was just a bullhorn. Absolutely. And it was very smart. I thought the entire statement is fascinating because its a little bit reminiscent of when judge thomas talked about his growing up in. Point georgia and how the nuns had rescued him in many ways from a chaotic childhood. We really only get two glimpses of justice, really. One is when their appointment is announced now, somewhat of the confirmation hearings, then they tend to disappear. We feel their influence for generations, as personalities, we dont get much of a sense of them. I think it was a well crafted statement the message is unmistakable the question is whether he continues to carry on this fight in the court of public penalties through the confirmation origins to focus more directly on senatorial concerns. Judge thomas, by the way, one of the few justices did not do his undergraduate work at one of the ivy leagues. He went to holy cross in massachusetts. Just as you heard in the last few hours especially, there has been some concern expressed about the Mueller Investigation and the role that a Justice Kavanaugh would play, that a sitting president should not be subject to legal action while in office. He wrote in the minnesota law review, in part the indictment and trial of a sitting president , moreover, would cripple the federal government, rendering it up able to function with credibility in either the international or domestic arenas. Such an outcome, would ill serve the public interest, especially in times of National Security crisis. A president who is concerned about an ongoing criminal investigation is almost inevitably going to do a worse job as president. Is there a conflict there . No i actually think if you look at the article, there are several really important things to remember. The first is the date of the article. It was written in 2009. So this was not an example of a republican appointed judge, looking to protect a republican president. He wrote this when president obama was president. It show, if anything, how free partisan concerns judge kavanaugh is when he thinks about the law, writes about the law. This i would also point out in that article, hes talking about his suggestion for what congress should do. So hes not saying that a judge should impose a judges personal preferences, with regards to this matter or with regard to any matter, what he is saying there is if congress would pass this statute the judge should be faithful to the statute and statute is good policy. Regardless of whether congress the statute is good policy or bad policy, ive seen judge kavanaugh every day whether he likes that statute or not apply the text and the structure and the history of that statute. The nfl association has filed a formal grievance. They filed it today aimed at the new League Policy that requires players to stand for the National Anthem or stay off the field. The nflpa claims the policy is quote inconsistent with the collective Bargaining Agreement and infringes on players rights. Now Players Association and the league are expected to start confidential discussions to come up with a compromise. A war this morning between the president and some of our closest allies. What happens next . Well, today at 2 00 p. M. Eastern, the department of justice is going to meet before that u. S. District judge in san diego again asking for more time and possibly presenting a new time line to be able to reunify the remaining kids. But that leaves a lot of desperate parents out there. Parents like maria. Shes an Asylum Seeker we have been covering for the past weeks. She turned herself in at the port offentry with that Migrant Caravan you will remember i was embedded with, with her two kids, nelson age 2, more cuss age 7. She says after a cup. Of days, she was separated from the children. She was sent to a Detention Center in san diego, the kids to a shelter in new york. Its been two months since shes seen them. Today she was supposed to get news, at least on the 2yearold. This was my conversation with maria this morning. Do you know today is the deadline for kids younger than 5 to be reunified, have they told you anything about your 2yearol 2yearold . I know today is the deadline, but they havent told me anything. It worries me, because the youngest one is only 2. He is one of the kids that should be reunified. But im very concerned because i dont know anything. We wanted to understand, craig, why is an Asylum Seeker marias children was taken away and still fought reunified with her. So we asked i. C. E. About her case. They said she had a quote criminal history in el salvador. Maria says shes been exxon rated and shown the document proving she wasnt guilty. One question i still have is why she has been released and why the children are still being kept in a shelter. But if reality is, she is being made to prove she is their mother, providing dna testing, fingerprints from everyone in the household, birth sets a process she says could take weeks or months. A process that is not uncommon with many of those other desperate parents are going through. The clock is still ticking for the government. Craig. As marianna was speaking there, we gotsome new numbers in. These are numbers that vary slightly from what we got yesterday regarding a number of children still separated from their parents. Four children were apparently reunified before the deadline today, four. One, two, three, four. 51 have parents in i. C. E. Custody. Of those 51, 34 have been cleared through screening. They are expected to be reunified today with parents who are in i. C. E. Custody. Eight parents who were released into the occupation, current will i undergoing what is called safety and suitability screening. 12 parents have been deported. Ten are not eligible for reunification. Again, this is according to hhs. Ten not eligible for reunification because their parents are in the custody of u. S. Marshals service or they are in state or county custody. Again, we are expected to get a new deadline from the government after 2 00. New numbers coming in from the department of health and Human Services a few moments ago. We are going to stay on top of this as we have been and get you some new information here in about 30 minutes. Meanwhile, House Republican leadership continues to stand by congressman jim jordan, amid that ongoing controversy, during jrns t jordans tenure as assistant coach at ohio state university. He said he is cooperating with that investigation. He will be talking to the folks running that. It will ultimately be that investigation that sheds complete light on exactly what happened at ohio state during those years where jordan was a coach. Jordan haake on the hymn. Well, you are right what you said, craig, which is one of the reasons donald trump got elected. That promise he made about appointing Supreme Court justicer, but one thing i think referring to one of your earlier segments, craig, you had a guest on sort of dismissing the idea that the article that judge caf narcotic wrote in 2009 and the minnesota law review was of any importance. I think thats something that the senate has to ask him a lot about. He said was he doubted it was a good idea for a sitting president to be under investigation or indictment or perhaps subpoenaed. You go back in history, 1974 the Supreme Court was asked to rule on the United States a v. Nixon, the Richard Nixon tapes, case, 80 they ruled you anomaly against nixon, although the fact that there were four justices appointed, when the Senate Begins to ask judge kavanaugh questions, i think that will be at the top of the list or near the top of the list. Chuck schumer is vowing to fight the president s pick. What itself the democrats unified strategy for opposing this nomination . How will they do that . I think its listening to the base of voters out in the streets, calling their representatives, also the swing vote republicans on the hill and making their voices heard. So this really goes to the fact democrats need to fight like hell even if they dont win. If this nominee is confirmed that has huge repercussion, not just roe vietnam wade, or health care. Ists not just about abortion, its laws that outlaw plan b and other forms of contraception. Those things are already taking place. In addition, you had the fight for pre existing conditions and protecting that the ban against discrimination against people with pre existing conditions and the aca. So you have two major issues that worked for democrats previously. Right . We had the big battle over the aca, the repeal of the aca. You had people literally kank out in the halls of congress, getting arrested. Those are the things we will see over the coming months as democrats fight back against this nominee. This is something senator Elizabeth Warren said about President Trump last night. Take a listen. Donald trump is nothing. If not a man who protects first and foremost donald trump. So moving forward, Elizabeth Warren, nancy ploerelosi, steny hoyer. How can democrats continue to justify leaving them in those positions if theyve lost the white house, theyve lost the lower chamber, if theyve lost the upper chamber. How do those people still have jobs . I mean, i dont blame them for the fact that democrats were unsuccessful if 2016. It was so close. Every single reason you could liss out and factor is true, its correct. If are you ahead of the team that keeps losing, at some point the coach gets fired. I wouldnt say nancy pelosi keeps losing, she never brought a be ill to the floor that failed, unlike paul ryan and john boehner on the other side. So i think that it comes to the fact that shes a great fund raiser. Thats always a fact that is laid out in terms of her staying in leadership. I think democrats are in a position that Elizabeth Warren is right. Of the 25 names, he picked the one person on the record seeing the president based on congress not acting shouldnt be under investigation or be indicted while in office. So of all the names he picked, that one person i think thats very interesting and congress should demand to know whether or not he thinks the president is above the law in the coming confirmation hearing. This is a president that h j hasnt been in office two years. There is a real possibly he will get a third pick. When you look back, lets pretend we are ten years, five years in the future here, is this going to potentially be the legacy of donald trump, the way he is able to shape or reshape the Supreme Court of the United States . It could be, craig. A lot of it is the luck of the draw. Jimmy carter did not get one. George washington appointed 11 justice, Franklin Roosevelt tried to appoint a lot of justices because he tried to pack the Supreme Court. But oftentimes, a president can have an effect long after he was in office basz because of what he did with the court. Dwight eisenhower in 1953 began the liberal war in court. One of the social progress for American History. Eisenhower did it unwittingly. Because as it turned out he disagreed with a number of warrens rulings in the 50s and 60s, oddly enough the decision that eisenhower made turned out to have enormous impact on American History fork decades after he was gone.
