Americas highest court. President trump is at his golf club in sistterling, virginia. The escalating debate fuelling more divisions in an already fragile political environment. One of trump leastrumps leadinr is already joining the action. Kelly odonell, what do we know of the short list and whos facing criticism . Reporter good to be with you, craig, we know there are seven names on the active working short list. It includes some of the judges thats been interviewed by the president and also senator mike lee of utah who had a phone call with the president. There is a lot of speculation who may be the short list. Among them is brett cavanaukava and amy coney. The two of them are perceive as front runners. The stakes rise and fall for each individual based on what the Interest Groups are talking about and legal clerks and some of the issues that may transcend their past cases as an example. For Brett Kavanaugh whos 53, he had worked for the bush administration. Hes been a clerk to justice kennedy. Some suggested his political background in washington may work against him. Others see that as a more pure type of republicanism that may be favorable to a broader group. Amy barrett is someone thatll give the president an advantage, elevate a woman to the court from the conservative side. There has been questions raised about her because during her confirmation hearing to be the judge she is today, she was asked about her own religion believes. That has drawn a lot of support from the evangelicals community. She, for example, said she believes life begins with conception. Would that mean she would vote against abortion rights in some future case. Those are all the things that would make it difficult to know where a judge would be if put on the high courts. The president has to announce his picks. At this point, we have seen this before, when there is a period of time before knowing there is vacancy and the announcement from the president. Anyone in that community of judges is going to feel the spotlight of criticism and those supporting him or her as well. Thats the phase we are in right now. Kelly odonell at the white house on this 4th of july. Republicans, senator susan cullins and Susan Murkowski are emerging. I am joined from maine, nbc vaughan hilliard. I know you talked to senator collins moments ago. She has strong words. Reporter we are here in main. Senator collins have a lot of power in her hand. She will cast whoever mr. Trump puts forward. It is her and lisa murkowski. They shown a ill withingness wi past. Those two senators along with john mccain voted against it. We talked to a lot of voters out here and these two women that i talk to that you will hear from specifically, they voted for Susan Collins. This was their message here today on the 4th of july. Our message is support roe v. Wade and dig deeper and make sure it is not just oh i support, i believe that you will vote to preserve a womans right to choose. Should roe v. Wade be uphold . Yes. I agree it needs to stay. Reporter and what you just heard from those women were their message to senator collins and i asked senator collins that and the wiggle room is to what extent during the confirmation hearings get that commitment from this nominee that theyll standby what they are calling federal law which is what the position that senator collins are taken. I asked her this question here just this afternoon. If that kind of hostility exists where i feel that a nominee cant put aside personal views in order to render a decision that respects the long standing Constitutional Rights then i cant vote for that nominee. Reporter now and kelly odonell was telling us about the list that President Trump is working on. I asked her about that list, the seven names that are out there. She says there is a couple of them that she used the word appear to standby when it comes to roe v. Wade. It was interesting to know for the first time Susan Collins suggested that some of these names that President Trump floated that she will actually get behind. It is really drawing a line in the sand. Reporter shes drawing a line in the sand and she has that vote. 51 votes is what needed. John mccain, if shes not able to vote in the senate on this. That means there are 50 republican senators and they have to rely on mike pence to be the 51st vote. They cant afford to lose. Lisa murkcowski and susan Collin Collin collinss. Vaughan hillyard. Thank you. Let me bring in my panel right now. James baldwin and our unfinished conversation about race in america. Always good to have both of you, david, let me start with you here, there is a recent piece that you wrote for the national review. You criticized progressives for deploying what you call religious, ignorant and bigotry. You write, Amy Coney Barrett is at the peak of her profession. Because of it, the bill betray our nations founding ideas. A fair gain at all through this process . Not a fair game. I think what happened in amy barretts initial nomination of the seven courts of appeal, that crosses a bright line for conservatives but also i would note for quiet a few progressives. I note there are progressives who attack the religion in that piece but there is also progressive understanding whats happening that constitutes. It is completely fair to examine her judicial philosophy and probe her judicial philosophy and ask questions about her religion believes and faiths. Thats out of bound. If the democrats do that. If shes a nominee in the democrats to do that, theyll only serve to rally trumps religion conservative base even more strongly in support of that dom kn nominee. Dr. Dyson, a persons faith should not be considered a great deal. I have been an ordain minister for years. I certainly empathize with those who feel their religion is being under assault. It is being used for the highest court of the land. Obviously thats clear. Whats disturbing here is the consequences politically for whatever religious believes she may entertain. If she believes there is a certain kind of deference to a religious belief, that would i impend on the arena. What i am more concern about is the legal consequences of her own vision and what that may mean for the rest of the country especially when it comes to a womans rights to choose and other serious issues thatll come before that court. Dr. Dyson, has the left taken the Supreme Court for granted. By that i mean it would seem as though the last two president ial cycles especially, republicans have done a much better job of galvanizing our base by stretching the importance of the president ability to appoint a justice or two. Does the left take it seriously as the right does . You are right. We have to acknowledge that we have been out maneuvered here. So my fellow lefters who were contending and there is no difference between Hillary Clinton or donald trump. That was not only grievously ill informed. It is not just about whos at the top of the ballot, it is about that president wholl appoint the people at the Supreme Court and out live him in terms of his political influence and wholl render judgment thatll leave a permanent imprints. Yes, in that sense because we have been so narrowly focused and we have the necessity to l galvanize for instance, whether or not a Police Person is charged with a particular crime, say for instance, shooting an unarmed africanamerican. We need to come together to understand that when we make decisions and cast ballots, pull those levers, it is more than the president of the United States of america. It is about a way and truth and approach. We have been out maneuvered. David, one of the president s considerations here, one of the four federal appeal court judges already met with President Trump. The critical moment for trump was fragile as a president devoted to his base weighed what a kavvaugh is kavanaugh already in trouble . I can tell you for a fact that there are social conservatives in d. C. Who are nervous about him. They are not nervous of the two or three that was mentioned. They are nervous about Brett Kavanaugh. There is a concern about him particularly related to decisions, one pre for life decision and another decision involving obamacare that raise worries. It is not to say that brett kavan kavanaugh is an outstanding judge. I will say beyond a shadow of a doubt, there are concerns that have been raised publicly and privately about him that have not been raised about the others. David sutter and george w. Bush. Dont even mention the name, david sutter, no one is saying Brett Kavanaugh will be a david sutter. When you have an opportunity to make a court shaping pick. The pick that could mean thats a much more solid original majority then has existed in my lifetime on the Supreme Court of the United States, do you pick someone when there is even that shadow of a doubt about their original commitment. When there is not that doub doubt thats the key question. It should be in fair to judge kavana kavanaugh. Thank you, david. Dr. Dyson, thank you as well. The Supreme Court has a lot more soul searching to do and originalist philosophy is the most worrisome of it. Scott pruitts plan. He reported pitched the plan to the president to leave his job but it came with a catch, he took over the Justice Department instead. Also, reuniting families that crossed the southern border. I saw where chief of staff ryan jackson had to give one of the staffers pull 600 bill out of his wallet to give to this young lady. For what . Because she was charged and not getting reimbursed . It was hotel room inauguration is what the family stayed in is what it was. That guy is a whistle blower. Hes a supporter of the Trump Administration. He said that he could not put up with pruitt actions any longer, hes calling it downright wrong. The white house is well aware of pruitts mini issues. One of the president s spokesperson, the president is quote concerned. Just a quick reminder here. This is a sample of what scout pruitt has been accused of doing. Pruitt shot this down though, telling nbc news that the report is false, session and i have friends and i have said i want nothing more than to see him succeed in his role. For more on pruitt. I am joined by emily holden and i am joined by caat lynn clark. Kathleen clark. Let me start with you, kathleen. Lets pick up where this whistle blower left off. Based on what you heard there ethical ethically, problematic . Oh, there are a huge number of problems with scott pruitt at the epa. Government officials are referred to Public Servants because they are supposed to serve the public. Pruitt acts as though he has it backward and the government is there to serve him and his wants and personal needs. It is a huge problem that hes using Government Resources to enrich himself using government officials to do personal task for him for himself and his family. And possibly exploiting his government position. Kathleen, this is more from pruitts former deputy chief of staff. Take a listen. After secretary price was fired and thats when we all got together and said enough is enough, guys. We are not going to do anything like that anymore. In my opinion, administrator pruitt doubled and tripled down and it got worse. Emily, based on the folks that you talked to during the course of your reporting, is this a situation where scout pruitt thinks hes above the law or is there Something Else that works here . We heard a lot of his former aids from these interviews theyre doing with the house government over sight, he feels that hes essentially under attack and thats something about his policies than any of these controversies that we heard where ethic officials hd e concerns about. I want to put the list up. And again, a lot of this stuff and we have been reporting over the last few months, the chickfila franchise he was working to secure for his wife and 43,000 soundproof office good afternoon boo phone booth. The explanation we gotten kathleen has always been ambiguous and i think thats probably putting it diplomatically. Is there anyone else besides the president who can remove scott pruitt. It is possible for congress to impeach the congress has impeached someone other than the president. I dont think we can anticipate this congress in particular is going to take decisive action. This congress can put much more pressure on the epa and on scott pruitt asking for more information and requiring testimonies as the house over Sight Community has. Emily, some of the president s allies are calling for scott pruitt to go. Laura ingraham tweeting, pruitt is the swamp, drain it. One of the reasons that suggest that scott pruitt is still around is pruitt is so effective and deregulation. Is there another reason he may be around . I think you would see essentially the same policy if someone were to replace him. I do think that the president has some loyalty to him. And i think that he has a lot of conservative support from a lot of group that continue to see these roll backs and regulations. Emily, you are the person that can answer this one lingering questions that i had since the beginning. You have done a lot of reporting on this. Whats the deal with the mattress . Do we know why scott pruitt have been trying to secure a used mattress from the Trump Tower Hotel in. I really cannot speak to that. He he has emphasized his loyalty to the president repeatedly and he does all sorts of events. I cant say what was going through their heads when they consider that. We have not gotten any official response regarding that scandal. We can all agree thats a bit weird. It is weird. I would just add that pruitt spent taxpayers money but hes quite cheap with spending his own money. Looking for a used mattress, something that many of us dont want to do, thats not out of character how scott pruitt spends his own money. I am going to leave it there. Kathleen and emily, thank you. More than 2,000 children separated from their parents and at this point, there is still to time for their return. Msnbc Mariana Atencio talks to one mother from el salvador whos been looking for her son for two months. Reporter do you feel there is in i lasting effect on them . I am very scared because i dont know how theyll react. Theyre already traumatized from the moment the separation happened. The older boy could doubt that i am actually doing anything to get him back. I dont know if theyre okay or being treated well . Everyone though even though he says mom, i am okay, i dont really know. Jennifer falcon, communication director of refugees and legal services, jennifer, thank you, you heard mariana there talking about the efforts to locate her children, is what happened to her kids, the two boys, is that an anomaly or is that a common place . I think we see it common place now especially with the new paper that i. C. E. Is having parents signed. We represented a man from el salvador who told us if he signs deportation paper, hell be reunited with his daughters and deported back to el salvador without her. Your organization, what are you guys doing . Family separation is not new in the broken immigration system. We have not been getting any government cooperations through these entities. We that hhad to become our own e investigators trying to locate these parents. We see parents being detained and during the process not being marked as parents. If they sign deportation papers, theyll we reunited with their children. You said something that i heard before that family separation is not new in this country. Whats new about family separation this time, under this administration . I think we see the Current Administration abusing the authority of i. C. E. I. C. E. Is just a government entity, the agency has no legal authority, international and domestic laws require Asylum Seeker submit a legal claim. You are saying Asylum Seekers are being discouraged or prevented to file a claim, if you want your children back, you got to get out of the country . Yes.
