Stormy daniels lawyer is is trying to get the president to do something he hasnt done publicly in days now. Speak. Her side filed a motion in federal court demanding they be allowed to depose the president about that 130,000 payment possibly more. The other front is his russia woes. Unable to add a heavy hitter, his legal team has gone to what appears to be a very thin bench to take on the special counsels investigation. Lets start at white house with kelly odonnell. Lets start with the deposition. What specifically are they asking for and what response from the president s people . Reporter the attorney b for Stormy Daniels wants to get the president on the record to go through the facts as they u see them about the relationship and the payment that was made. The 130,000 contract, a nondisclosure agreement filed just before the 2016 election within two weeks of that date. So wanting to go through that fact pattern and get President Trump on the record. That is is a difficult thing to do. The president has not been talking about it. He is and through his white house spokesman denied that any affair took place and have denied his awareness of this payment made by Michael Cohen, a lawyer for the Trump Organization and an associate of the president , that that even happened. They are giving the president distance from this. We also heard from Michael Cohen through his attorney who says that the move by the Stormy Daniels side is is a reckless use of the legal is system in order to continue to inflate the defla deflated ego and keep himself relevant. That is the sort of back and forth taking shots at each ot r other. We also heard him referred to as a fixer for the president. A lot of negative connotation to that. Lets go back to the idea that the president hasnt spoken in three days. Or at least no public events. Do owe we know why thats the case . Whats the white house say iing about the president s silence . Reporter we dont have any explanation tr why the president s schedule has not provided for public events. He will have on the schedule tomorrow a visit to ohio, where we expect he will be talking about economic issues. He will be making remarks in public and there might be an opportunity to be able to toss some questions at the president. Thats often the way we have been able to interact with him over his time in office. But the proximity give iing us chance to ask a question. It give a bit of a buffer between the president and that notable interview that aired sunday with Stormy Daniels. So perhaps that is a cause and effect. But the white house isnt saying this. The president is here at the white house according to officials and had an accreditation for ambassadors, which is is a formal ceremony here at the white house. That was not covered on camera. Kelly odonnell at the white house, thank you. They explained why they are filing this motion. The motion is is not crazy. Its well founded. It was well thought out. Its incredibly documented. We want the truth. We want to know the truth about what the president knew. And what he did about it. Jeffrey rosen is a law professor at George Washington law school. Hes also author of a new biography of our 27th president William Howard taft. Rosen, let me start with you. Whats the judge going to be considering when he decides whether to grant this motion to have the president e deposed. Its a technical question under the arbitration act e he will be balancing considerations there and could go either way. Whats so significant is once theres a way in and the president is aloud to be deposed either in this suit or in the other ones being filed against him by other women, the pattern of practice of similar conduct is open game. We remember from the clinton impeachment how the paula jones was an opening into conduct, whether it its this case or the state law libel suit or one case may provide the window that the president s opponents want. You brought up the clinton case. The filing cites the case that president clinton testified in the civil suit. This is a quote from that. A sitting president is not afforded special protection from a civil suit regarding conduct before he or she entered office. Where do the similarities begin and end with regards to the clinton case . They really are dramatically similar in the sense that the Supreme Court said that as long as the case is not likely to take too much of the president s time, it may proceed. And thats hugely significant. That means the state lawsuit could force the president to testify. If president lies in the depositions, the clinton case shows that will both open the possibility of obstruction charges and also in each of these cases similar conduct can be used to prove that what happened with one woman happened with other ones. Its a pandoras box for the president and thats why theres legal jeopardy. The Supreme Court could hold this will take up too much of the president s time. John paul stevens said i expected the president to lie under oath. Thats why it took up so much of his time. Heres whats significant. Even a president ial pardon cannot stop a state court suit from proceeding because the president can only pardon federal crimes. I want to play a sound byte about this matter in particular. Take a listen. You called him a counter pumplger many times. I didnt say he punches back on every single topic. If he did, he would probably be addressing a lot of the stories that most of you write every single minute of every single day. He has a country to run. Sometimes he chooses to specifically engage and sometimes he doesnt. Anything damaging to himself. And thats why in a modern era of twitter and everything is recorded, you schismly have to advise your client to not speak unless they absolutely need to. It seems trump is finally following this advice that he must have got trn his attorneys. In a court somewhere, that could be cat cliz mahmoud mic for the president. Because he would be under oath. It seems likely this is going to happen. Under the federal arbitration act, the issue of whether or not the parties agree to arbitrate is an issue b that can be resolved by a rur trial if the judge determines that theres a real dispute as to whether or not the parties agree to ash constitute trai arbitrate. All of those, every answer are under oath. And every one of those is a potential perjury pitfall. These are are some fresh numbers from politico. The First Showing the daniels story is getting significant play u. Here are the numbers. 60 overall say they have heard a lot or some about that 60 minutes interview. Most voters believe her by 35point margin. Do we think that this is going to have any measurable effect on the minds of Republican Voters . Well, which part of republican parties are you talking about . If youre talking about the Republican Voters who are the president s die hard base, the answer is no. They have been with him from the very beginning. They have known about the president s accusers right flu through the campaign and voted. D for him any way. It youre talking about republican voter who is are republican and didnt really like Hillary Clinton and pulled the lever for donald trump because they didnt want her and now they see whats happening with this president and his presidency, particularly on this issue, are walking away from him. Then, yes, this will, according to the poll numbers, is is having an impact in terms of what they think about this and whether they think Stormy Daniels is credible and whether they believe the president. I think in the court of Public Opinion, Stormy Daniels and her lawyer have been playing this pitch u perfectly. President trump has always played the court of law and the court of Public Opinion. In the two, hes always relied on the court of Public Opinion. Stormy daniels, he has found his peers. They have been playing a very strong court of Public Opinion game and thats why i think the poll numbers are going the way they are going. Thats why i also think the president has been mute. In addition to what danny said that the president has probably been advised to keep his mouth shut when it comes to Stormy Daniels, but what can he say that wont attract the ire of her lawyer, who has been baiting the president for a minimum of two and a half to three weeks before the Stormy Daniels interview and now with that th lawsuit hes trying to bait the president into tweeting something, saying something, doing something that will help his client. Heres the thing. Heres a president that voters sshlly knew what they were getting. They heard the president on the access hollywood tape. We heard from a number of evangelicals, even since he took office, who decided to look the other way when it comes to some of his alleged and con if you remembered moral failings. Even if all of this turns out to be true, so what. I mean, for them, the so what is hes an adulter and lied under oath. But hey, we get our Supreme Court pick. Which is one of the reasons why a lot of evangelicals are sticking by this president. So what, we got our tax cuts. Assuming that the benefits of those tax cuts flow to you. Or you got your tariffs thrown in assuming that you benefit in some way from what the president has done. So i get your so what question, but as i said in the beginning of my last answer, for a lot of the president s supporters, that die hard 36 , all of those things were baked in. And so for them, this is nothing new. Really quickly here. This assistant da being promoted to such is an important position. What do we make of that . Theres just a lot of turmoil in the department. Its a sign of the fact that the nel could change quickly. Do you take that promotion as a signal of the likelihood of a future new hire from outside the team . Possibly. The conflict issue is to be expected when youre courting large law firms. So its not a surprise youre going to go to smaller outfits and solo practitioners. For years and through many administrations everyone said that peace and the denuclearization of the Korean Peninsula was not even a small possibility. Now theres a good chance that kim jongun will do what is right for his people and for humanity. Look forward to our meeting. I think quite a bit. China has now put out a lot of images of this meeting. Its been blanketed across the media in north korea. Both countries hailing it as a success. Even President Trump saying that it was a success with President Trump appearing to try to take some credit for it. But for china, this was an important agenda. It was an important meeting. It wanted to make sure that the diplomacy didnt get out of beijings courtyard. And china rolled out the red carpet. Chinas president wanted to make sure kim jonguns first summit was with him. And that his first ever trip abroad since taking power in 2011 was to beijing. Official images of the secretive trip, which china and north korea both initial i refused to confirm, show all the. Trappings of a state visit. Kim jongun inspecting the chinese honor guard. The two leaders toasting at a lavish banquet. Even formal portraits of the two men with their wives. Welcome d on his armored train, the kim family is reluctant to fly. Kim jongun said he remains committed to denuclearization and to a summit with President Trump. The president accepted that invitation on the basis that we have concrete and verifiable step. The summit could potentially happen at the end of may. But the details, including where it could take place, remain unclear. After sending his sister to break the ice at the Winter Olympics in south korea, kim jongun has so far held off on missile and Nuclear Tests while he tests diplomacy. For that reason, the white house hailed the china visit as a success, even appearing to take credit for it in a statement. We see this development as further evidence that our campaign of maximum pressure is creating the appropriate atmosphere for dialogue with north korea. But it was chinas president xi who took the first step signaling to rump that while he may be bold, china is fast and will not be sidestepped in its own backyard. Richard, that last point about the administration deserving credit. How much credit does this administration e deserve for applying maximum pressure . I think it deserves some, frankly. I think the surprise announcement by President Trump to his willingness to hold the summit has pushed the chinese to take this action. They wanted to have a quick summit with the north Korean Leader before any summit takes place between the u. S. And north korea. So i think you hasee the president s action prompting china to take action. And perhaps the bellicose language has also caused china to wake up and take this problem very seriously. Thats not to say that irresponsible language or tweets are necessarily the best way to get World Leaders to pay attention. Plus rewriting the rules on who your vote sends to washington. Or more accurately, redrawing them. The Supreme Court just heard arguments that could change the course of history. And Barack Obamas new plans to start campaigning ahead of the november midterms for the first time. Theres a Common Thread i see every time im in the field. While this was burning, you were saving other homes. Neighbors helping neighbors and strangers alike. This is what americas about. Sometimes its nice to see all the good thats out there. Bringing folks out, we have seen it in community after community. The Supreme Court today is hearing arguments on redrawing Congressional Districts. Jerry manders, the process of reshaping a district to Favor One Party over the other. The court heard a case last fall where it claim ed that the process favored republicans. The case being argued today was brought by republicans who say democrats intentionally altered a maryland district to favor democra democrats. Pete williams is outside of the high court. Why did the court taik on the maryland case . It accepted the challenge from the republican challengers from maryland to be a companion case with wisconsin. But heres the problem. The redistricting is always done by the majority party. It inevitably takes steps to entrench its position. The question is how much partisanship is too much. Can it ever cross a constitutional line . I u would say based on todays argument its no easier to an answer than it was in october when it heard the wisconsin c e case. Now today was from marylands sixth district when democrats got. Power. It unseeded a republican who held that seat for 20 years. He had before the gerrymandering won the seat by 28 of the vote. He lost it by 21 and the republicans say that violates the first amendment. They say people in that district are being punished because of their political views. Because they supported the republican candidate and thats why they say the court should declare the redistricting unconstitutional. Now i would say after todays argument, it seems pretty clear that a majority of the court believes what maryland did was too much partisanship, but the problem for the court is coming up with a test thats good not only for maryland, but in every other case where this issue comes up. Hes worried that the court would be called upon to referee every redistricting from here on out. Another sign that the court isnt close to answering this question is a suggestion made today by justice breyer. He said at one point, why dont we do this again next year. Take the maryland case and the wisconsin case that we heard and another one from North Carolina thats waiting in the wings and put them all together and bring all the lawyers in a room and shut the doors and let them hash it out and try to come up with the best test. Its fair to say he would not have made that suggestion if the court had come up with an answer to the wisconsin case that was set satisfactory. So bottom line, they think that it maryland went too far, but they dont know what to do about it. It sounds like the Supreme Court is going the way of congress. Its going to kick the can down the road. Reporter heres the difference. The Supreme Court has to decide these cases. One possibility, one exit ramp would be to say, you know what, you waited too long, republicans. Youre coming up here saying that youll suffer harm, but this redistricting was in 2011. Now you come now. Its a little late. Why should we take this case now . Let the lower courts hash it out for awhile. That could be an exit ramp. Justice correspondent Pete Williams at the Supreme Court. Thank you. Martin omalley was marylands governor when the law was passed. Governor, good to have you. Thanks for being with me, sir. Thank you, craig, good to be with you. I want to read this part of a Washington Post story that quote d you from a deposition i o 2013 lawsuit. Quote, as the elected governor, i did my duty within the meets and bounds that set up redistricting as a partisan exercise. E he added that if the reconfigured district, quote, would be more likely to elect a democrat than a republican, yes, this was clearly my intent. How was that not stacking the deck in favor of your party . Yeah, well, look, i am very much in favor of us doing it away with partisan redistricting. But it is the practice. It is the political practice that has existed in our country for many years. I dont think it serves us very well. I also said that in that deposition. However, keep in mind, in 2010, we were watch iing for marylands states often times with more democrats than republicans found themselves with a republican governor who was carving the districts in such ways to create lopsided republican congressional delegation. So we felt an obligation. Even a duty to. Push back in a system of checks and balances f you will, to do everything we could in our state to offset what we were seeing happening in other states. Now i think now that we have gotten to a point as a nation where we realize the polarization, the separation from one another, an inability to find Common Ground has become is such an acute problem, a lot of us are hoping that the Supreme Court can invent some new standard that makes it unacceptable throughout the country. But when faced with what a lot of other republican states were doing, and i dont want to suggest this is some sort of this is not a matter of equivalence, i think its well known in the record that 30 republican governors were elected in 2010 and they really took their pens to knifing up the map and saddling president obama with the very unrepresentative house of representatives. We need to rise above it and move beyond it. Hopefully the Supreme Court will find a way to do that. Perhaps you heard that former president barack obama is set to hit the campaign trail in Beverly Hills for senator mccaskill. This will be the president getting out there publicly for the First Time Since he left office. What do you make of that . How much of an advantage do you think barack obama is is going to give democrats during these upcoming midterm elections . Look, i think all of us have an obligation to do everything we can to win these midterms. I think its great that the president is getting out there. Last year i was in 20 different states for 31 different candidates. And if youd look at the special elections for state senate and state house, democrats have won 38 of the 44 that have happened. So these midterms are an opportunity for course correction. President obama sees that. And a Great Republic can sometimes make mistakes. And thats what we have the ability to do in these midterms. Win back our state to save the United States. Thats a lot of work for a form er governor. Unless that former governor is planning on running for president. Look, people have said is this the groundwork. I u said running the first time might be groundwork for that. This is about winning back our states so we can win back our country. I have enjoyed being out there. We have some creaourageous men women up and down the ballot. Donald trump has been an outstanding recruitment tool for Democratic Candidates across the country. Look at oklahoma. Oklahoma had the largest margin of america, but we have won 5 of the 7 special election there is. I was honored to have campaigned in a couple of those for some great people. So this is democracy. We have the opportunity to do a course correction. Thank you. I need to get to some breaking news now. Thank you for your time. This just in. The New York Times out with a new report that President Trumps former top counsel on the russia investigation once discussed pardons for Paul Manafort and Michael Flynn. This according to three sources who spoke to the times who had knowledge of these discussions. Nbc news has not yet confirmed this report, but im joined on the phone by one of the authors of that times report. Back with me is law professor jeffrey rosen. Michael, tell me more about these discussions. What did you find . The discussions happened last summer as mueller was building his cases against Paul Manafort, trumps former campaign chairman, and Michael Flynn, his foshler National Security adviser. The president s lawyer talked with manafort and flynns lawyers says the president was prepared to do this. He told folks that the president and him believe that the case against flynn was very flimsy. That there was no need for these guys to plea and he should accept is the pardon. The question is what did the president know about this. Was john acting on his own. Was he out there free lansing talking about consulting or something the president told him to do. The president s lawyers now deny that they have heard any discussions ever about pardons. When we spoke to john dough today, he denied it as well. But we felt comfortable with our information and thats why we did the story. Three sources. Standby for me. I want to bring in two of our legal experts here. Jeffrey rosen, let me start with you. If a pardon was offered, is that considered obstruction of justice on its face . It is an open and serious constitutional question about whether or not the president s pardon power can be exercised correctly. Some say the power is unlimited and regardless of motives he can pardon anyone he likes. Others say if the purpose of the pardon is to obstruct an inquiry, that itself can be prosecuted as obstruction of justice. The Supreme Court has not ruled on this. Thats why michael is absolutely right. The question of what the president knew and when he knew it is crucial because if trump asked dowd to offer a pardon in exchange for manafort and flynn not testifying against him, then that could build a case that he exercised it corruptly and it would go up to the courts and possibly even to the Supreme Court about whether the pardon power is limited. Its a fascinating question. It wasnt since the 1880s or 90s that the court last had a serious pardon case on the limits of the pardon power. This could be a constitutional case of great significance. If there was this explicit quid pro quo, that would boast the argument this was an attempt to obstruct justice. Yes, the president s critics would say a prid pro quo is a motive. Youre not supposed to offer it tostop an inquiry from going forward. It could be prosecuted under corruption statutes. It doesnt matter what the pardon is is. There are these english law cases saying its like a sovereign power that dates back to the king and . Exercised and not limited in any way. And thats what the justices would have to decide. Michael, in the past, what has this administration said about its willingness and desire to pardon manafort or general flynn . The president has discussed the issue before publicly. The president talked about the fact he doesnt have the power to pardon. This is something he has. Its something he talked to lawyers about in private. Hes been explained to them by the White House Counsels Office how this would work and the authorities that he does have. He did pardon the former sheriff from arizona found guilty of criminal charges related to the stopping of latinos down there. Trump did go ahead and pardon him earlier this year. He has only done one other pardon at that, but obviously, something that relates to the russia investigation has a different severity and question to it. Danny, what would prevent the white house from pulling the trigger on Something Like this . President trump has to consider and his attorneys have to consider the possibility of a pardon as a tactical maneuver. Its true the president may have the power, but not the right. If he par dobs for a u corrupt purpose. But assuming he isnt doing it for a corrupt purpose, his attorneys have to explore this possibility. Strategically, though, its actually not in the president s best interest to pardon manafort or flynn because if he does, especially at this stage, they have already cooperated. If he had pardoned them way back when they were being indicted, he would have withdrawn or removed their ability to claim the fifth amendment and called before congress. In a strange paradox, its worse for the president to pardon those people who have been indicted and pled guilty than it is for him to leave them to their own devices and just hope they take the fifth amendment or hope they cant hurt him too badbad ly if they decided to turn on him. At this point, you cant get the horses back in the stable. 245i7 they sat down for hours with u. S. Attorneys and debriefed and given up everything they know in order to get any favorable treatment. So at this stage of the game, it wouldnt be tactically viable for him to pardon them. Its too late to do so. Back several months ago, his attorneys would have had to discuss the possibility. It would have been mall prpract to not consider the possibility of a pardon. So long as its not done for a corrupt purpose, a pardon, the president has the power to pardon. So as his attorneys zealously representing him, they had to consider whether strategically they could pardon those people who were being charged, being indicted if this was viable to do so and whether or not they u had to consider he opened himself up to an obstruction charge. They had to consider the possibility. Michael, what if anything did your sources say about there being a concern inside the white house regarding the optics of all of this. Regarding the president of the United States pardoning someone who had already been indicted. Dowd, who as we may remember time moves so fast here, left the president s legal Team Last Week and the president needed to use all the tools at his disposal to try to help himself in the investigation. That dowd was not as much into the political consequences that could come of these things as he was the president using authorities to protect himself. He took a very strong view of executive power. The president is the president does have political calculations. He has to decide whether to sit down for an interview with mueller. There would be political consequences. People are saying why arent you sitting down with mueller. He was an advocate of not sitting down with mueller. He thought that was a bad idea that the president , someone who often does not tell the truth, may get himself into more trouble. Theres a lot of calculations going on here. And its still not yecloer the severity of what mueller is doing as it is regards to the president. Hes asked a lot of questions about what the president said about russia behind t saenhe sc and what the president said about comey and possible obstruction. But he still hasnt sat down and talked to the president. And until that happens, i dont think well have a clear picture of where this is going. Theres also been some interest from the special counsel regarding that memo that was written aboard air force one as well. Really quickly here. Last word to you, jeffrey rosen. What do you glean from all of this . This new reporting from the times that the president s attorney are raising the prospect of pardons for paulm manafort and general flynn. That mueller may have an avenue in the investigation, whether the president corruptly considered a pardon to obstruct the investigation and thats a central concern of muellers should be a new concern of President Trumps. So he will be the republican candidate in a district which the state Supreme Court changed a month ago that had been in kpi tense and the district is 50 existing Congressional District which i now represent. So when you had said who is a goner, the reality is they obliterated the district. The other thing they did, the Voting Rights act, the first thing you have to look at when you do redistricting, which is a Civil Rights Era law which protects minority representation. The Supreme Court eliminated one of those districts any without analysis. Racial gerrymandering is a very serious charge and theyve yet to answer for it. We should note, as governor omalley noted, this gerrymandering you speak of is something that both parties have engaged in. It sounds as if youre blaming your decision solely on gerrymandering. It would also seem over the weekend that you blamed your decision in part on the president of the United States, no . Oh, just to be clear, craig. Ive been very forthright about this. There were four or five factors cumulatively that had me arrive at the decision i did. One was a the court decision. Another was just how difficult it is to run in this political environment. A piece of that is what President Trump says and does, but also the difficulty that it is, particularly in suburban districts, to get your message out. A lot of your voters really are just interested in what your opinion is on relative to the tweets and Stormy Daniels and issues that i dont you got sick of defending the president , is that a Fair Assessment . I think that theres a piece of it. Again, im trying to be im trying to lay it all out there. It gets tiring. Some things i dont defend, but the moment that you speak the moment that you speak out against something you may disagree with, whether it be policy or not, obviously, you get the wrath of another set of voters. Thats congress. I accept that. Im serving in my term. But you have to realize that when you run for reelection in a district like this, a big piece of it may not be your record. In just a couple of hours, friends and family members of Stephan Clark are expected to gather for his wake. He was a 22yearold unarmed black man that was shot and killed last week in his grandmothers backyard. The entire incident was caught on top. Joe fryer has been covering this story for us. Its a meeting that was supposed to last six hours, but was so tense at times, it adjourned early after three and a half. City hall packed with people and passion. Ste Stephan Clarks brother burst into the chambers. Some in the crowd called for calm. Order was eventually restored. Nearly 300 people signed up to speak. Our community is in a lot of pain. Its got to stop. Those officers need to be fired. Ive lost my voice several times this week and ill lose it again if another black life dies. Reporter outside for the second time in a week, protesters blocked the entrance to the Sacramento Kings arena, preventing many fans from getting inside the nba game. Police are investigating clarks death. But now Californias Department of justice will provide independent oversight at the Police Chiefs request. Our city is at a critical point right now. I believe this will help build faith and confidence in the investigation from our community. Reporter last week, the city released video of the shooting. Shots fired. Reporter police were responding to reports a vandal was breaking car windows when two officers confronted clark in his grandparents backyard. They say they thought he had a gun. The officers fired 20 shots, but clark had no weapon. Only a cell phone. Minutes after the shooting, it appears a responding officer says mute. And the Police Body Cameras stop recording audio. The Sacramento PoliceOfficers Association says the shooting was justified because the officers perceived this as a deadly threat and fired on clark to save their own lives. Clarks grandmother sees it differently. Why would you empty 20 bullets on an unarmed man . Why would you do that . Reporter do you want to see charges in this case . Yes. Yes.
