Solve a number of seemingly intractable policy problems. Something well be talking about a little later in the broadcast. First, though, lets start with nbcs jeff bennett who is at the white house. Jeff, tell us exactly what President Trump said today. Hey, craig, lets start with this tweet you mentioned. Theres a lot to unpack here. The president writes, crooked Hillary Clintons top aid, the spelling error is, uma abedin has been accused of disregarding basic security protocols. She put classified passwords into the hands of foreign a gents. Remember sailors pictures on submarine . Jail. Deep state Justice Department must finally act . Also on comey and others. So parsing this, youve got President Trump appearing to suggestion that huma abedin should face jail time. Days after the state Department Posted emails found on her estranged husbands computer that included confidential government information. Remember, craig, the discovery of those email, some marked as classified, is what prompted former fbi director james comey to announce just before the 2016 election that he would reopen the probe into Hillary Clintons emails. He then, you know, reversed himself and said nothing of significance had been found in her emails although the president in this case is apparently calling for her to serve jail time. I also draw your attention to the president suggesting that the deep state that he apparently believes has sought to undermine him. A justice tent, we should point out, led by his own appointees including session, rosen steen and chris ray over at the fbi. He also appears ty s to be t credit for preventing plane crashes . Every president likes to take credit when things go well and pass the blame when things go poorly. Apparently in this case taking credit for planes not crashing. He says, since taking office i have been very strict on commercial aviation. Good news, it was just reported that there were zero deaths in 2017. Best and safest year on record. A white house official tells us, craig, that the Trump Administration credits the president s efforts to modernize air traffic control. And some of the steps hes taken to step up security measures. But the facts tell a slightly different story. No commercial u. S. Airliner has been involved in a fatal crash since 2009. What accounts for that stretch of laudable aviation safety is not really the result of any one persons actions. Its decades of work on the part of lots of people in the u. S. And also around the world, craig. All right, jeff bennett starting us off here. President trump also had a message for the new publisher of the new york times, in what appears to be a reference to the papadopoulos story. Tweeting, quote, lose all of your phony and nonexistence sources and treat the president of the United States fairly. For more on all of this, lets bring in the panel. Matthew miller is an msnbc justice and security analyst, also former spokesman to president obama. Natasha bertrend. And ned price, analyst, also former spokesman under president obama. President trump, is he asking the doj to investigate jim comey . He appears to be. Its not the first time or even i think the second or third time that weve had to discuss the president calling on the Justice Department to go after his political opponents. Its no less inappropriate, no less dangerous for him to do it now just because hes done it before. I think the worrisome thing is the cumulative effect of these constant tweets and public calls by the president and other places for the Justice Department to investigate Hillary Clinton or Hillary Clintons aides or now jim comey. Two things. One, the Justice Department bends to his will in some cases. Weve seen it before, for example, the attorney general, Deputy Attorney general, signeded off on the firing of jim comey under false pretensions. Or when the attorney general started to look into whether there should be a special prosecutor to investigate this uranium one deal left over from the Obama Administration. Theres a problem, a larger problem that the American Public starts to lose faith in the credibility of our institutions that guarantee the rule of law. Thats a corrosive effect that could have ramifications not just during the Trump Administration but for years to come. Ned, a week earlier, the president told the times reporter this in regard to the Hillary Clinton email investigation. Quote, i have absolute right to do what i want to do with the Justice Department but for purposes of hopefully thinking im going to be treated fairly, ive stayed uninvolved with this particular matter. Bluster or do you think that hell try to exercise that power . Well, craig, i think weve already seen indications that President Trump wont be able to keep his hands off this investigation when it comes to uranium one. Hes already voiced his input into that investigation, releasing material that was previously held private by an fbi source involved in that matter. I think the broader point of all of this is these are not the words of the president. The tweet this morning was not the words of the president. They were the words of a man who was running scared. Scared from an independent fbi and department of justice. And so the question becomes why does President Trump feel the need to be so hands on, not only in this investigation but also in other investigations . And it suggests to me that President Trump feels that he has something to hide. If you add that with the other data points from the firing of sgr jim comey to the attempt to get his Top National Security aides to claim there was no collusion, it paints a picture of just that, not only potential collusion but also certainly what appears to be obstruction of justice. I want to throw trumps comey tweet back up on the screen. Natasha, let me ask you about this here. At the end of that, he referred to the deep state Justice Department. I think a lot of folks find it odd that the president referred to this deep state Justice Department when you look at Jeff Sessions, you look at rod rosenstein, you look at christopher ray. These are all trump appoint ooeps. Can you be a trump appointee and still be a part of the deep state . Well, this is a talking point that is really prevalent in the fox news world. They all accuse the Justice Department of essentially working to or members of the Justice Department, agents, fbi agents, of working to overthrow the trump presidency. They say a coup is taking place that mueller is leading. For him to say this is a deep state operation is essentially his way of delegitimizing the probe. For him to say, you know, comey should possibly be in jail or be investigated is another problematic statement because comey has a ton of information that could incriminate the president as this investigation moves forward. Comey is the one who told congress President Trump asked for his loyalty. He told congress that trump asked him to drop the investigation into flynn. For him to come out on twitter and say he thinks comey should be investigated is something im sure his lawyers did not want him to do. Nate, ed, you both spent times in the upper echelons of government. I give you an opportunity here to speak the truth. Are you part of the deep state . I guess a former member of the deep state. Look, david fromme, the conservative writer, said something i thought was appropriate on twitter this morning. When you see the president talk about deep state, think about the rule of law. When he talks about the deep state, thats what he means. People who are committed to the rule of law. People who swore an oath to the constitution and not the president. When you see him rallying against people in the intelligence community, the Justice Department, its because hes angry, that these are people that wont bend to his will. That instead will follow the path that, you know, the constitution and the rule of law demands of him. The president appears to be referring to this bigtime story over the weekend of course, the papadopoulos story. Sources telling the times it was George Papadopoulos whose loose talk over drinks led to the fbi russia investigation, it was the impetus. The third time we know of the trump family or campaign had interactions with russia or wikileaks. First read today, pointing out, quote, Cooperation Without collusion is still cooperation. What do you say to that, ned . Well, think thats right. Not only from the papadopoulos story but from the june 2016 tower meeting, with don trump jr. s outreach to wikileaks. At the very least, there was an attempt by the russian government to meet and to collude with the Trump Campaign. The Trump Campaign showed extreme interest in that prospect with don trump jr. Famously saying, its if what you say it is, i love it. I think at the very least, the key ingreedants were there. The question then becomes just how successful wallace the Trump Campaign in all of this. To be sure, this was not the most talented or agile group, so its certainly possible that theyre very genuine and concerted desire to collude or cooperate with the russians didnt off the ground, but all the ingredients were there. We know smoke is there. What mueller and his team are looking at is there any fire, and i think that question remains unknown. Reported statements to that australian diplomat came about two months before the president , then candidate trump, famously said this on the campaign trail, take a listen. Russia, if youre listening, i hope youre able to find the 30,000 emails that are missing. Should we should we be viewing those comments differently now . Should we be looking at those comments through a different lens . Absolutely. As of right now, we have no evidence that papadopoulos told the Trump Campaign he had met with the professer who told him the russians had this dirt in the form v Hillary Clinton emails. However, it would be very, very unlikely he would be drinking with an australian diplomat and start bragging about the fact he had this information and not then go back to the Trump Campaign, who he was trying so hard to impress over the course of several months with that very same information. So the idea that he may have told some high level officials on the campaign, happened was actually taken very seriously in the early months when he first got there, that he, that trump would have not known about this or someone high level would not have known about this is very unlikely. Natasha, always good to have you, and matthew and ned, its good to hear you are not part of the deep state, thank you for clearing that up. Reformed. Conducting major u. S. Foreign policy on twitter. The new year brings two simmering International Situations to the forefront. There are new reports of deaths and violence in those nationwide protests throughout iran. The Associated Press citing Iranian State television reports nine people were killed in the unrest overnight. Iran Supreme Leader Ayatollah Khomeini has blamed for nationals and enemies for making the situation worse there. Meanwhile, in east asia, north Koreas Kim Jongun bragging of a, quote, Nuclear Button always on my desk. At the same time, kim has apparently offered an olive branch of sorts to south korea, proposing talks that could lead to north korean participation in the Winter Olympics set for south korea next month. Lets bring in amman mohyeldin. Ann guerin, White House Correspondent for the washington post. Ayman, bring us up to speed on the protests with iran. What do we know . We know theyre continuing. They started thursday. Were seeing the momentum of the protests continue to grow, continue to expand, geographically. It started in the eastern part of the country on thursday, predominantly with a lower socioeconomic class, more the working class types. Over the past several days, the nature has changed from being a purely economic complaint or demonstrate to one now that has taken a slightly political sing to it with some of the chants and demonstrations against the religious leadership of the country and that can be a turning point for those sitting on the sidelines particularly the Strong Security services, the besiege in the iranian rogc, the revolutionary guard corps. Giving the president a chance to deal with, if he cant, they will weigh in on it. What were watching from the protester side is the durability of the demonstrations, how long can they go for and if they are spreading. The short answer is geogafically theyre spedding and the intensity seems to be there, that they are still taking to the streets despite some of these deaths. The death toll steadily rising and that could be a defining moment if the Security Service is now joined the protests to quash them. To be clear, these protesters in iran, not to oversimplify it, but what are they looking for . Thats a really good question. It began with economic grievances. They were complaining about the economic sag nation, unemployment, inflation, cooperation. A lot of the things we hear when were talking about populous protests. Now its changed a little bit in the last couple of days to include political rhetoric which is the downfall of the religious leadership and the clerics that are ruling that country. So this is why, again, were going to be following this very closely to see. One of the things people observe compared to 09 when these demonstrationings were larger in scale is the protests were seeing over the past several days, they dont have a single leader. Theres not a political figure that is spearheading them. Some say that works in the advantage of the government in the sense they dont have to worry too much about it. Others say the fact this is the working class, its populist in nature that is dispersed across the country is probably going to make it harder for the iranian government to deal with them as opposed to simply going and arresting a political candidate or a president ial candidate back in 2009 that may have been disenfranchised or his voters may have been alienated. The 2009 protests were political. They were the middle intellectual class to speak. This is the working class who have economic grievances about quality of their life getting any better. Trump tweeting earlier this morning, the people of iran are finally acting against the brutal and corrupt Iranian Regime. The u. S. Is watching. How does that potentially translate into policy, p. J. . Well, i think the president has positioned the United States fairly well. Hes reintroduced human rights as a National Security concern, you know, for the United States. I think so far so good. The challenge here is how do you keep the focus on iran and the iranian governments reaction to, you know, these demonstrations as opposed to creating an opening where it gives iran the chance to change the subject . Its one thing to say we want to see change in iran. We do. Its another thing to go so far as to suggest regime change. Which then enables the government to say, well, this is the this is about foreign interference, its really not about genuine disenchantment, you know, by the iranian people. So going back to 2009, i think the Obama Administration was, in retrospect, a little bit too understated here. But the central challenge for the Trump Administration, keep the focus on iran, that creates a dynamic that is actually good for the United States and good for our policy. And does the president see the unrest as a sign that International Sanctions against iran are working . I think the president sees the unrest as a sign that his view of the way the regime really works is the right one and that the Obama Administration had a naive view of what the u. S. And other powers could do through the iran nuclear deal. Part of the protests here is against the rouhani government and the promises that rouhani made to the middle and lower classes economically in iran, that they would see benefits from this deal, which required the government of iran to give up at least some international prestige, if not any actual coin. And that you know, that was something that the government sold into the iranian people as being of economic benefit for them. It hasnt worked that way. And thats what a lot of people advising trump and apparently if you kind of read between the lines of both the trump and pence tweet, refer to the deal, you know, they see this as vindication that the deal doesnt work for anybody except the Iranian Regime itself and were coming up on another deadline here where trump will have to either certify or not certify the deal in about ten days time and the expectation is he will do the same thing he did in october and not certify it, which leaves the deal in limbo and kind of leaves that as an open question. The president also taking to twitter. His favorite megaphone. To talk about pakistan this morning. He said, in part, talking about the billions of dollars in aid from the u. S. They give safe haven to the terrorists we hunt in afghanistan with little help. No more. P. J. , whats the point . The president has a very good point. Pakistanplicitous when it comes to fighting extremism. When the pakistani Officials Say, hey, weve been a very significant victim of terrorism, theyre correct in that. By the same token, if you look back, the fact that Osama Bin Laden and mullah omar the fact they died on pakistani soil a coincidence . The answer is no. I think that confronting pakistan about this duplicitous behavior is a necessary element. Pakistans always been the weak link in our policy towards afghanistan, for example, but sticks by themselves will not work. The Obama Administration tried to use carrots. That didnt work. I think its about, you know, using this as a level but creating for pakistan to clear a path as to what they need to do to fight extremism more consistently and the fact they need to begin to rationalize their relationship with afghanistan on the one hand. And then on the other, be patient, because this is a longterm problem well face for years, if not decades. North korea, kim jongun, now offering to talk to the south and it was senator Lindsey Graham that said in a tweet yesterday if north korea goes to the olympics, we do not. The senior senator from south carolina, is he echoing a sentiment from the administration . Well, i mean, weve already seen some inkling within the administration about three weeks ago that there were concerns about the olympics, and that was quickly turned around in part from by pressure from the business community, from the ioc we think saying wait, you know, the United States cant sort of hint that it might not go, you know, this close to the event. There are millions and millions of dollars on the line here. I have no indication that graham is speaking for the administration there. I think he does, however, have his finger on something that the north koreans appear to be doing cleverly here, which is to divide the United States from one of its two closest allies on this problem. South korea. And, you know, anything that north korea can do to raise questions in the minds of the south korean public and the government there about whether the United States is doing right by them is going to be to the norths advantage, its smart politics. Ayman mohyldin, thank you. Watching for actions on health care, immigration, infrastructure, but will we see any bipartisanship to tackle these big issues . Plus, a deadly prank. Deadlines on several difficult issues, including funding the government, stabilize health care and of course immigration. With me now, nbc news capitol hill correspondent kacie hunt and nick konsfori, msnbc contributor. What are the most pressing issues for lawmakers as they start this new calendar year . Craig, happy new year to you. I hardly know where to start to be honest with you. Essentially Congress Just took a couple weeks break. The first item on the agenda is going to be trying to find a budget deal, some way to figure out how to cap spending for defense and domestic programs. Democrats want equal an equal amount of money for domestic programs while many republicans and some democratic defense hawks are worried about the defense budget. So thats going to be one of the thorniest things to try to resolve. You also have some pretty pressing emotional issues, areas where theres, quite frankly, a lot at stake for large groups of people. Daca is one of those issues. The solution for those dreamers. The deadline is in march. But Mitch Mcconnell has promised jeff flake hell put something on the floor to try to deal with it perhaps late in january so thats another thing to watch. And then of course the Childrens Health insurance program. There are millions of kids that rely on that program and right now its only funded through march. You can see that pretty long list there. Theres also of course disaster relief, lots of places in the u. S. Suffering from disasters last year. Congress did not get that done. So really this the environment is so contentious right now, craig, that its really hard to see how any one of these issues gets solved, even if you just pick one out of the pile, let alone all of them. So theres really a lot to tackle here for lawmakers when they come back tomorrow. A short time ago, we learned that omb director nick mulvaney, legislative Affairs Director mark short, meeting with congressional leaders tomorrow on the hill to talk about budget caps. What are we expecting to come from this meeting . Those budget caps, thats kind of the language we use on the hill to talk about that budget deal. So they know they need to spend more money on defense. They need to figure out how to balance that more correctly. Thats what they were trying to do back in the winter where they put off government funding for a couple weeks and it was supposed to give them time to negotiate a deal. Democrats will say basically republicans punted the ball because they wanted to get tax reform. There will be some hope now this will be the central focus. Congress has gotten into the habit of governing by crisis deadline and thats what youve seen with these kind of continuing resolutions that set date after date and we all talk about a Government Shutdown in a handful of weeks. The new deadline is january 19th. 18th, the funding runs out. Theyre hoping to get something by then. Theres also a chance we could simply see another round of punting the football. Nick, for every topic, there is a tweet. Heres the president s tweet from earlier today. The democrats have been told and fully understand there can be no daca, deferred action for childhood arrivals. Without the desperately needed wall at the southern border and an end to the horrible chain migration and ridiculous lottery system of immigration, et cetera. We must protect our country. We know 60 of americans roughly support daca. Do democrats compromise on daca to get a wall . Look, we see here the opening bid from the president. This is the deal he would like to make. Something the democrats want, daca, for funding on the wall. I think a smarter move for the president actually is to put the wall funding in a bill for plains, trains and troubleautom right, for infrastructure. His choice, though, is to do this as part of an immigration deal. It makes sense on policy. I think hell probably get something if hes putting daca on the table because theres extraordinary pressure from the base of the Democratic Party to do something on this and some pressure from the business wing of the gop to do something. You mentioned infrastructure. Is that where you see the greatest opportunity for bipartisanship in 2018 between this administration and democrats . In a highly polarized environment, yes. I think if the president feels like throwing a life raft to his party ahead of 2018, this is the way to do it. You could put in a bill that has some border funding, some roads funding, puts in some funding for critical projects on trains and roads. For example, the gateway project here in new york. The president just shut down. And kind of put it all together and make something thats almost impossible to vote against and gives republicans Something Else to take back home. Especially in those blue states. Kacie to you get the sense from democrats on the hill they would be open to providing any morsel of funding to go to the president s wall . Not if not if thats what the president s going to be able to sell it as, craig. Democrats dont have a fundamental problem with border security. The comprehensive immigration deal they had agreed to that passed through the senate had a significant increase for border security. There are plenty of democrats who are more than willing to spend millions to reinforce the border and to do more along those lines. But i think if the idea is that the president is then going to be able to go out and make a sales pitch, and the president has alluded to this, at some point hes going to tour the prototypes of the wall being constructed, et cetera. Think its untenable for democrats to be in that kind of a position. Its going to put chuck shumer in a little bit of a bind potentially. Because he has a very fine line to walk between the people, the senators that he needs to potentially at least maintain democratic strength in the senate, if not have any kind of shot at retaking the chamber from republicans. Theyre in red states. There are people like claire mccaskill, jon tester, others, who are going to want to try and at least show theyre willing to work with the president , where it makes sense to work with the president. A state like missouri, for example. On the other hand, you have progressives in the conference, in the caucus that, you know, want nothing to do with this. Elizabeth warren, sanders, others. Thats a very difficult place to be. Kacie hunt, happy new year. Nick, happy new year. A 911 call. A huge police response. Then, a deadly shooting. Nbcs hans nichols joins us from the pentagon with this new information. Hans, what do we know at this point . Well, craig, according to military officials, a potential stress, i stress test, test of the Ballistic Missile could happen as early as this week. The short term is what another official told me. What they see is they use their intelligence, they have a lot of assets in the air, and they see a behavior, a pattern, that was like what they saw before when they had test launches earlier last year in 2017. They see them moving around equipment, moving around assets. I should stress, craig this doesnt necessarily mean without a shadow of a doubt that north korea will launch in the coming days. It just means its possible. Its somewhere between likely and possible. Well continue to report this out here and try to get a little more certainty. I would also add on all this that if there is any potential test by north korea in 2018, this new year, how that will impact what that will do for two potential talks between north korea and south korea. Remember, both the north and the south are signaling that theyre willing to talk, theyre open to the idea. How that would impact and affect any sort of ongoing talks if they are actively testing missiles, that could be another complicating factor as we head into this olympic season. Any thing from the pentagon what their response would be . In the past the pentagon has always tried to stress the three allies involved here, japan, south korea and the u. S. Almost every response has been to make sure to include assets from all three, whether thats fighter escorts, bringing in bombers from guam, flying them right up to north koreas border or in some case having south korea fire rockets the exact they fired them in the ocean, but the distance matters and the distance they fire them into the ocean is the exact distance from those launchers to pyongyang, the capital of north korea. So look for that kind of response. But i dont think theyll formalize that until there actually is a test. And then of course they need to ascertain whether or not the threat is a test, right. The first thing that happens within minutes of a launch. They see this missile going up in the air and they make the decision whether or not to shoot it down. Because within minutes, theyll have a sense of where its heading and thats a difficult call to make. Hans nichols for us at the pentagon with that developing story. Hans, thanks. Meanwhile, a young man in california is under arrest on this tuesday in a shooting death that took place halfway across the country. 25yearold tyler paris could face serious charges over a socalled s. W. A. T. Ing hoax that led to a fake 911 call that allegedly ended with the Fatal Shooting of a wichita, kansas, man, by Police Thursday night. Its a fairly complex story. Lets bring in msnbc legal analyst danny sevellos. Bring us up to date on the story itself. For a lot of folks watching and listening who arent familiar with the term s. W. A. T. Ing, what is that . S. W. A. T. Ing is basically prank calling a 911 or the Police Department and telling them that theres some dangerous event going on, a hostage situation, anything that will cause the police to be dispatched in force and on high alert to that location where the victim of the prank, and as weve seen the victim of a shooting, is living organize residing so they get surprised. Its often done by gamers so that they can watch midstream, because these games are sort of televised i would say, broadcast live over the internet, so that they can watch ideally the person, the gamer, react in real time. You wrote a column for nbcnews. Com and i want to just read this sentence here for folks. Barriss allegedly made the false 911 call with the specific intent that the Police Respond to the call and rush to the home of the person barriss had a dispute with. What does it mean if thats true . It means under kansas law murder charges may be appropriate. Then a Second Degree murder charge is possible. And i think that is something that authorities will be looking at in this case in kansas. It also sounds to me like this is one of those instances where lawmakers around the country may have to create new laws that govern this kind of ridiculousness. On the one hand, there are a number of laws that would already apply to this. I mean, its illegal to call 911 as a prank. What we may see is criminalizing any harm that results from calling 911 as a prank. There are a number of different and federal state laws that could potentially be applied. The challenge with the Second Degree murder charge ultimately will be a legal concept called causation. The prankster was the reason the police went to the house, but in cases like this, is the independent act of the officer, the independent decision to shoot, does that cut the chain of causation . Is it a superseding cause breaking the chain of causation between the original doer and the death . Our legal analyst, thank you so much. Cashing in on cannabis.
