Dots. Whats going to happen in the midterms . Its going to be a good year for democrats. We want to break down several part of this story. First, angry at the ballot box, howl the kavanaugh fight impact a Midterm Election now just 340 days away . The democrats contemplating a Nuclear Option a possible impeachment effort involving Justice Kavanaugh if, in fact, he they manage to take over the house. Im going to talk to ted lui about that strategy. And the longterm impact on the court, the fbi, and on the hashtag Metoo Movement. Joining me now, political reporter laura basset and natasha bertrand. Laura, this is President Trump argui arguing. Weve heard them make the argument that men are the real victims. But watch this. Women were outraged at what happened to Brett Kavanaugh, outraged. So you have a lot of women that are extremely happy a tremendous number of women because theyre thinking of their sons, theyre thinking of their husbands and their brothers and their uncles and others. So theyre thinking everybody but not themselves if you look at the stats. What is your assessment of the president s comments that women are a happy to see Brett Kavanaugh confirmed, and the reason is because theyre thinking of the men in their lives who are being wrongly accused . I think its nothing short of delusional. Certainly there were women who supported Brett Kavanaugh. Women are not a monolith. So there were some, 70 of republican women did, but the vast majority were disgusted. They called into cspan in crazy numbers. Of people were sharing their random Sexual Assault stories on the street. A cab driver shared one with me. They were confronting senators in elevators, they were walking out of their offices wearing black in protest. Women are extremely upset, and donald trump sees what he wants to see. Do you think the disappointment, if you will, of women or the fact that they are upset is going to translate politically come the midterms . We know that white women made a huge difference for President Trump. Are we going to see women across the board in the midterms. Women are going to turn out for the democrats in november. Women are extremely angry and theyre going to turn out in favor of the blue wave. I talked to a lot of republican women, i talked to them during trumps campaign. I went to the Republican National convention and spoke to female delegates. Some were galvanized by this idea of getting Brett Kavanaugh on the Supreme Court. Now that theyve got their antiabortion Supreme Court justice, its going to dampen enthusiasm and Democratic Women are going to turn out in boast. One thing the president likes toe boast about is winning. If you look at the course of this week, he certainly by his terms has won a lot. The u. S. Mexico canada deal now, the jobs report that came out friday, capped off with a new Supreme Court pick. If you were to take his logic that he won this week, who lost . Really good question. I think that you can make the argument that the survivors lost, that the women who were accusing Brett Kavanaugh of these horrific assaults lost here. And that, i think, the going to fuel a lot of anger leading up to the Midterm Elections. That being said, i dont know if that angry is going to or even the satisfaction with having Brett Kavanaugh be confirmed on the other side or the anger prevalent among people, thats going to last through the midterms. Thats a month away. Its really unclear whether in four weeks this is still going to be top of mind for most people. This may have been a really good week for the president , but it was also a week where the New York Times dropped that bombshell story about how he helped his father commit tax fraud. Which they republished. Right. Its a clue at whats is to come, as democrats get more aggressive with regard to the president s corruption, especially with regard to the mueller investigation, which is yet another facet of Brett Kavanaughs confirmation that has people really worried. There was a bit of an irony how this played out with Susan Collins being the decisive vote and in doing so casting doubt about the story of dr. Ford, not that she doesnt believe her, but that she doesnt believe it was kavanaugh that did this to dr. Ford. Take a to listen how she adjust justified her vote. I do not believe Brett Kavanaugh was her assailant. I do believe she was assaulted. I dont know by whom and im not certain when, but i do not believe he was the assailant. What do you make of that, laura, the irony of senator collins being a woman also being the woman who cast such a decisive vote against dr. Fords credibility, in the larger context of how this has played out. She believes her but doesnt believe her entirely . As the great feminist heres the bell hooks said, patriarchy has no gender. Its not necessarily men. There are women who contribute to it, to help hold it up. And Susan Collins has shown herself to be one of those women. And he really she really undermines Sexual Assault survives when she says she doesnt believe her, saying i believe something bad happened but i dont believe it was Brett Kavanaugh who assaulted her, when she said herself she was 100 sure is saying i dont believe this woman who put her life on the line and stood before the senate and then stood before the entire nation to tell her story about the most difficult thing thats ever happened to her. Even trump admitted she was incredible. That really sets back to me tao movement and entitlements future survivors from coming forward. Its hard to ignore double standard saying they believe Brett Kavanaugh because he wouldnt lie under perjury but not apply the same logic to dr. Ford. I just want to bring in quickly democratic ted lui of california, member of the house judiciary committee. Great to have you with us. Let me start by asking you about this new, i guess, Campaign Rally or Campaign Slogan if you want to call it that, that the top democrat in the house judiciary committee, jerry nadler is using to try to galvanize the base. He is promising to reinvestigate kavanaugh if democrats take control. Let me get your thoughts on that. Do you support an investigation of now Justice Kavanaugh . And what would be the focus for you . Thank you, ayman, for your question. Im a former prosecutor. Ive never seen a Law Enforcement or Background Investigation where they dont actually interview their accuser or the person being accused. So this fbi investigation really was a whitewash. Im on the house judiciary committee. If we flip the house, we will look at the witnesses and interview them. And we will subpoena the relevant documents and see where the evidence takes as you say no mincing words there. The Senate Democrat and judiciary member chris coons was asked about impeachment. To listen his zblons House Democrats are talking about reinvestigating kavanaugh, possibly looking at impeachment. What do you make of those pledging coming from some House Democrats . I think thats premature. Theres only ever been one justice thats been impeached, and talking about it isnt mugabe us forward. I know that you are for an investigation and try to subpoena the documents that were behind the communications from the white house, limiting the scope of the fbi Background Investigation. But will you support, would you support an impeachment effort if your Party Controls the house . I agree with senator coons. Impeachment is pretty premature. We have to base it on the facts and evidence and the law. But because the fbi did not do that, because the white house restricted that kind of investigation, it is incumbent on congress to do the investigation that the fbi was not allowed to do. Do you think that the calls that people like jerry nadler are making could actually backfire . We know some of your colleagues have talked about trying to impeach the president if they take control of the house and subpoenaing documents that involve him and doings on his part. But are you at all worried that the message being sent to voters that a vote for democrats come the midterms is just going to lead to endless investigation after investigation and exhaust the country . I disagree that it will turn off the voters. What the voters want is a check and balance of the executive branch. If the voters turn out in november, i think were going to have a congress with a spine thats actually going to the appropriate oversight hearings on the corruption weve seen in the Trump Administration as well as on the misconduct weve search with officials within the Trump Administration. So very quickly, what would you say is the best strategy for your party . What should they be campaigning on . Health care continues to be a number one issue across america. People are paying Higher Health care costs and they know that republicans have tried to sabotage the health care law. In addition, we need to put in infrastructure to increase wages, Many Americans are seeing no increases in their paychecks, and we have to actually drain the swamp and get the corruption out of washington, d. C. Hard to imagine a campaign being about the issues not about politics. Always a pleasure. Lets bring back laura and natasha about President Trumps latest accomplishments. You heard from the congressman about what the democrats should be doing and endless investigations, maybe something that the voters want, at least a house with teeth as opposed to what were seeing right now. This is what weve been hearing from democratic voters approximate for the last three years, why are democrats so spineless . They feel like democrats have not gotten down and dirty in the mud in the way the republicans have. And i think that the prospect of more and more investigations into the president and investigations in a way that the republicans congressman said have not been doing and holding him accountable are what the voters do want. I dont think thats going to scare them away. I agree with the congressman thats going to galvanize them, especially when it comes to things like the mueller investigation, if there is an impeachment process for Brett Kavanaugh, theres going to be a lot more learned than we did with the fbi investigation which did not interview the main principals, the third accuser, julia swetnick, who i will just add, her claims and the republicans have tried to oversensationalize them. Thats been underappreciated. So i think that she and her attorney maechbl wiichael avena continue to make an issue of this. I dont know this is going to be top of mind come election time, but the prospect of this being one of many investigations that the democrats do is going to really make people turn out. The president has jumbled jumped on how this is all played out. Hes been on point in terms of their messaging. Take a listen to how President Trump spoke about this ahead of the midterms. Each of you will have a chance in just four weeks to render your verdict on the democrats conduct at the ballot box. You dont hand matches to an arsonist, and you dont give power to an angry leftwing mob. And thats what theyve become. [ cheers ] two things here. One is hes talking about something thats going to happen a month from now, thats 800, 900 news cycles from now. But is that going to be enough to rally the Republican Base from now until the midterms . I dont think it will. As you said, the news cycle is moving so fast, we can barely what happened a week ago, much less a month ago. The russia story, the north korea feels like forever ago we were talking about that. I think its really interesting that donald trump is calling liberals the angry dangerous mob. This is actually a tactic that hitler used to accuse the other side of what he himself was doing. We saw in the hearings it was kavanaugh versus Christine Blasey ford. And ill let her represent the left here, although she was not there on political reasons. She was quiet, trying to please, she was poised. And then kavanaugh got up there crying, shouting, Lindsey Graham was shouting, saying awful things. Chuck grassley was shouting. Men are angry, republican men are airconditioning you should see my twitter dms. So accusing the left of being a wild mob is ridiculous. Its amazing to see how we allow to get angry and use that as a sign of passion instead of frustration. The impact of the kavanaugh fight goes beyond politics really to the future of the Supreme Court and the perception of the fbi in the wake of the investigation as well has become a punch line, literally. It didnt even interview the two main protagonists. This drama played out, galvanized by the Metoo Movement and its demands for greaterbility over allegations of Sexual Assault against women. The problem is the system, you know. Other countries have requirement ages, you know, the judges in the u. S. Theyre like africanamerican dictators. They die on the job. Mocking Christine Blasey ford special attention as well. The political storm next. We are tracking in washington over donald trump Supreme Court pick in a move that appears to break with the white house messaging. Donald trump is targeting kavanaughs accuser, Christine Blasey ford. Hes been respectful and disciplined when talking about Christine Blasey ford, until he soaked in the atmosphere at a Campaign Rally in mississippi. Strong opinions from several international outlets, the u. K. s guardian saying, quote, if youre a rich white guy with powerful friends, it seems you can get away with anything. And another said the ordeal show cases the truth and decline of democracy in trumps america. The battle over kavanaugh has a longterm impact on how the Supreme Court is seen and the fbi. To talk about that, im joined by Justice Department reporter katy bennett and executive assistant director of the fbi, security analyst sean henry. Also with me is former federal prosecutor, paul butler. I want to start with the court here. Heres what senator mazie hirono from hawaii said this morning about the court with kavanaugh now on it. Take a listen. Hes going to be on the Supreme Court with a huge taint and a big asterisk after his name. The partisanship he showed was astounding. And behavior was bizarre. How are americans going to perceive decisions that come out of the court with kavanaugh on it . Is everything going to be tainted or the American Public at large is going to discern every decision on its own merits. Given the aggressive outburst that judge kavanaugh made at the hearing, i think that his opinions will be seen in some instances as ill legitimate. He talked about the allegations of him being payback for the clintons and the election of trump. We never heard such partisan comments bay nominee for the Supreme Court so when we look at whats coming up not this year, but soon, abortion. Senator collins has this fantasy that hes not going to vote to overturn row versus wade. We have four votes on the Supreme Court right now for that. He will be the fifth. We look at gun rights. There was a law in d. C. That said that you couldnt own a semiautomatic rifle. Judge kavanaugh would have struck that down. On all those issues, affirmative action, the power of corporations, the court will take a far right turn. This has been considered the most conservative court since the 1930s, liberal groups very much concerned about that, some even pushing for the Supreme Court justice to recuse himself on some of these cases. Given the fact that his confirmation revealed this strong partisan, you know, flavor, if you will, to the way he approached it, do you think they can be successful and n asking the justice to recuse himself on these decisions . No. The problem is that the rules that apply to other judges do not apply to the Supreme Court. So judge kavanaugh gets to decide for himself whether he needs to recuse himself. 2,400 law professors sent a note to the judiciary commit and to President Trump suggesting theres so many cases in which kavanaugh would have to recuse himself involving womens rights, involving the Republican Party. If he decided a case like bush versus gore, no one who you would think he was being objective. Thats a very good point. Sean, let me turn to the fbi. The fbi in the first two years of this administration has been totally hammered. On all different of any kind fronts. But this one was very different in the sense that what the fbi was asked to do, how they were limited in scope in investigation. He had some rare praise, President Trump, for its work following the confirmation, though. Take a listen to this. The fbi has done an excellent job. They went through it. They went through it seven times. The fbi went through seven investigations. And they did a very thorough job, excellent job. So this is kind of im going to coming from a president whos attacked the fbi and the department of justice and other Law Enforcement agencies for going after him, describing it a witchhunt and undermining that process. Is there a concern, sean, that the fbi could, in fact, be seen as now being used for political purposes as a result of this process and could that impact their larger work Going Forward . I think that is the case. I watched the fbi be maligned for the last year or so, and people need to understand what happened in this particular matter. The fbi, while some have said the fbi did a comprehensive investigation, they did not do a comprehensive verification. They didnt do a comprehensive investigation because they didnt interview the alleged victim or the alleged perpetrator. But they didnt do a comprehensive investigation not because they couldnt, they didnt have the ability, because they certainly could. They didnt do it because they were restricted from doing it. They certainly would have interviewed those people if this was an investigation about that particular incident. What happens is the fbi is akin to a contractor. And the white house is the client. And they provided specific investigative steps for the fbi to take. They did that they were told to do. When they came back and provided information to the department of justice and to the white house, they werent able to do any additional investigation. I can tell you that there are a lot of people who have come forward with Additional Information about this incident and others, some of the alleged or perceived perjury misstatements made by judge kavanaugh while he sat in front of the Senate Judiciary committee, the department of justice likely has all those names and information. Even though the fbi wasnt able to do to conduct those interviews, theyve got them, and i imagine that will come out at some point over time. Including the former classmate of Brett Kavanaugh at yale who has come out and said that the judge lied while he was testifying there. Katy, i know there are reports that at one point President Trump was allowing a more expansive investigation, but it was don mcgahn who stepped in to keep this into a very limited role and confine the fbis investigation. What do we know about how involved the house was in actually defining and controlling the fbis investigation . So its interesting what you say about mcgann. He did say no. We also know that mcgann told judge kavanaugh that what he came out before the senate he needed to channel his anger because he knew it would rally support from the gop. Thats because don mcgahn is playing the long game. He knows that, yes, will there be an asterisk next to his name . Absolutely. Will people believe his opinions arent just in time, absolutely. Will it matter . Absolutely not whether or not you think his opinion is legitimate, it is still going to be the opinion of a Supreme Court justice cement ing a goal that the Republican Party has been pursuing since the 80s with intense focus to create a very conservative Supreme Court. If the democrats dont like it, then they need to get out and start winning some elections. This idea of the blue wave and women are going to come out and the polls, et cetera, et cetera, it actually surprises me that democrats believe that this is a done deal. Its almost like they dont remember 2016 when all the polgz said Hillary Clinton was going to win and there was going to be a wave of women supporting her. We saw a wave of women support trump and a silent majority. If you are a republican today, you might not like trump, but he just delivered for you. You have two leftleaning Supreme Court justices who are in their 80s and he can for them in the next two years. Fair point on that. Sean, let me ask you really quickly. Nancy pelosi is pursuing a freedom of information request for communications between the white house and the fbi. We also know if they take control of congress in the midterms come november, they are going to subpoena those documents. What would that tell us, you think . I think it will tell the broadest story exactly how narrowly scoped this was and the back and forth when the fbi did uncover information because there were people that were coming in to field offices, there were phone calls around the country. The fbi was collecting that information and they would to y typically forward that to the white house saying we have this new information about someone whos come forward. Theyll see the back and forth whether or not the agents were precluded from following leads if they were doing a suitability inquiry. Thank you very much, apprecia. In fact, turkish officials saying Police Believe he was killed inside the saudi consulate. Khashoggi is a saudi citizen. He went to get paperwork to marry his fiancee and was never seen again. He is known for being a critic of the saudi regime. He appeared on this show last november. Watch this. We have legitimate reason to be complaining of iran expansionism and hezbollah mingling in the affairs in syria and yemen. The missile i think was a game changer. Saudi arabia has reasons to turn down hezbollah in lebanon, but i think were doing it the wrong way. So for more on this, im joined by a colleague of Jamal Khashoggi, associate editor at the washington post. And a Foreign Affairs reporter at politico. I know this is a difficult story for many of us to cover because we knew jamal personally. Not only did you know him personally, you appeared on that segment in this show i was referencing a second ago. Sir, what do you know about the circumstances surrounding his disappearance . Was there any indication to you or others at the pothe post t was in any danger . We had no indication that he was in danger. We knew that the regime in saudi arabia effectively headed by the crown prince bin salman was increasingly angry at him. Jamal khashoggi was a journalist who really was fearless. Through his whole career, not just in his climz about mbs as hes called but with saudi arabia, but for many years going back 25 years anyway, he kept writing the truth. He got a job as an editor and he got fired because people didnt like what he wrote. He was a brave person. We didnt have any indication bhefrg when he went to istanbul. Were still waiting for confirmation whether hes dead or alive. Were very worried at the post. It is a difficult time because we know turkish officials arent providing any evidence for their claim, but they are talking to a lot of journalists in the region. Let me read you guys a column that khashoggi wrote. This is an excerpt about the crown prince. He deserves considerable credit for bringing the matter to a close the right way while previous leaders will reluctant to take up the issue, he faced it head on and did the right thing for saudi arabia. At the same time i hope he will not forget the brave actions of each and every saudi who individually worked hard for freedom and modernization. Khashoggi appears to go out of his way to give the crown prince credit. As i played that sound bite. Even though hes described as a journalist, he did also justify some of saudi actions. Im curious how sensitive is the saudi regime to criticism, and how would this be crossing the line that what he was doing where he actually spoke on both sides of the story . Well, absolutely. There are going to be plenty of people who feel like jamal was not nearly as tough as he could have been on the saudis and the crown prince. But what we do seem to be getting a picture of about this crown prince that she does seem to be pretty sensitive to even the slightest of insults. He effectively broke off relations with canada because they tweeted something about womens rights. He has put women activists in prison. Hes contained thdeigned them. Even though it seems hes making reforms that Jamal Khashoggi spoke about, at the same time he nonetheless is very, very sensitive to this type of criticism. And that just puts a lot of saudi disdense and even moderate dissidents in this awkward spot of how far can you go . We should emphasize officials at the consulate that he was killed in the consulate and they did not come from turkish officials. David, we know behind the scenes there are some officials blaming this on qatar saying this was an operation by them to make the saudis look bad. I know we dont have a lot of time, but how does this conflict with qatar on one side and saudi arabia on the other play out. The conflict is poisonous. Its absolutely causing a miserable situation in the gulf. Its bad for both countries and their neighbors. My fear is jamal got caught up in the back wash of that and somebody who we deeply respect as a journalist may have been victimized. This whole incident is a warning. This has got to stop, this fraternal battle thats ripping up both of these countries. President trump has been very supportive of the Saudi Arabian the government. They have been very silent. Theyve been tough on other things vocally, but on this, so far theyve been pretty silent. Actually, this administration tends to be very muted in its criticisms of the saudi government. Theyre really trying hard to have a Good Relationship with them. They want the saudis on their side when it comes to fighting iran. And we know that secretary of state mike pompeo among others thinks about issues like u. S. Arms sales to saudi arabia when he decides whether or not to criticize the government there. So far theyre not saying very much on this. They say that they are watching it, that they are trying to figure out whats going on. But theyre certainly not taking a position. To some extent, thats understandable because theres still a lot thats unknown. Weve also seen in the past where the u. S. Has simply said you know what, were fine if the saudis do their own internal investigation and whatever the saudis say, the u. S. Will simply back. So i dont expect this to lead to a break in the relationship. David, very quickly, if, in fact, Jamal Khashoggi has been murdered, what would this mean for Reform Efforts inside saudi arabia . Would we, then, close the book on this government as being genuine reform minded . It would be a terrible setback for everyone who wants meaningful reform in saudi arabia. Jamal khashoggi embraced all of the positive things that mbs is trying to do. I think what upset him deeply was that he was undermining his own efforts by needless, sometimes reckless actions. I think the repercussions of this, if its found Jamal Khashoggi was murdered, will be enormous. David ignatius and hala toosi, thank you for joining us on this difficult story. They put out a list of the five topics voters that they polled are concerned about. Among them, health care, economy, guns, taxes. And immigration. Its also something we heard from representative ted lu earlier in the program. So emily, should democrats be talking more about those issues and less than about kavanaugh . Look, these are all issues that are very strongly firing up the democratic base. And swing voters. Weve been seeing that since the day trump got into office and the republican congress. Waits a check on him. Health care maintained the number one issue. That was weve seen unprecedented levels of grassroots efforts. Thats why the republicans fail in congress to repeal obamacare in the first place. There was so much activity. Look, its where all of this is where swing left was born out of. There is marching to the polls going on in the early vote over the next couple of weekends. And then people are volunteering. Were seeing huge spikes in volunteerism. That is because of kavanaugh. Health care is motivated to begin with. And he has gotten people to the core. They are fired up. Sto to that point, lauren, what about republicans in this case . You look at some of the wins that the president touts. Unemployment is at historic low. The president delivering on the promises including the Supreme Court. Taxes. Given that, why are they having such trouble with voters . It doesnt look like their funding is as high and the base is as energized as what it normally would be. How do you explain that . Would disagree with the premise that the right is energized. I think the entire country is very energized right now. Fair enough. Look, the reality is youll see republican candidates talk about promises kept. Theyre going to be talking about those issues. I think theyll probably head into a high turnout midterm overall. I wont dispute the fact that they are energized. They are. All you have to do is look at my twitter feed. I think youll see the republicans talk about promises kept. Let me play a clip for you. Number six, you will have the chance to stop the radical democrats and thats what theyve become. By electing a Republican House and senate. So there is no doubt that the president continues to be the largest draw for the Republican Base. He energizes the base. How much does that worry democrats given that they underestimated him in 2016 and hes got a lot of these Campaign Style rallies for candidates from now until november 7th . He loves a rally. Republicans made the calculation to campaign on the fact that a promise kept. Because they really have become the party of trump. Thats a huge liability. Particularly at swing house districts. Republicans need to be holding voters. These are tons of independents, suburban women that broke for trump and republicans. They wanted to kind of give him a chance. It is something different. Now that turned republicans into the party of trump. And the fact that theyre now campaigning on it, theyre making a calculated decision. It really is going to turn off a lot of those moderate voters. I guess republicans are making the calculation they just wont show up in Midterm Elections. I would think i think that is wrong. I think they will. Theyre voting to hold congress to be accountable on trump. And poll after poll shows thats what people want out of congress now. Lauren, the president is hitting the road with mid terms. Are there anyplaces that you would like him to visitor are there anyplaces that you would like him to stay away from . Where is he a liability and an asset . I think hell be an asset in west virginia. You are know, thats a very tight race. West virginians in general like the president. If you look at joe mansions vote on kavanaugh, the reason voted yes is because a lot of people in that state in particular support the president. I think youll see him there. I dont think youll see him in some of the swing districts that emily mern emily mentioned. I think candidates feel theyre better served if they were able to campaign more on their own brand than on the president s brabd. I would be wrong, but i think hell campaign more senate races than specific house districts to try to, as you said, stay on the National Level or a state level.
