Andrea . Peter alexander in now on Andrea Mitchell reports. Deadly inferno. The death toll in the oakland warehouse fire at 36 now as the search grows for those still missing. New today the criminal investigation begins into what caused the fire. In a space one former tenant called a death trap. We have now 36 families, not only grieving for their lost ones but also they want to have answers. I dont want to say was but you know what i mean. He is in the prime of his life, only 22. Hes got plenty of life ahead of him. Courtesy call . As Donald Trumps short list for secretary of state grows more fallout from his protocolbreaking phone conversation with the leader of taiwan. Well, i think the conversation that happened this week with the president of taiwan was a striking call. President obama reached out to cuba and was a hero. President elect take as call and its a thing in the media. And pipeline victory. Members of the Standing Rock sioux tribe celebrate the halt of the construction of the dakota pipeline. Why the fight may not be over. Im just thankful that there were some leaders in the federal government who realized something is not right, even though its legal. Its not just Standing Rock. Its not just indigenous people. Its a win for all of america. Good monday. Im Peter Alexander in today for my friend Andrea Mitchell. We begin with developments in the deadly warehouse fire in whats my hometown of oakland, california. Fire Officials Say the number of victims stands at 36 but that it will certainly go up as the search grows for the missing. Investigators have now paused their recovery work because the building was deemed unsafe. That work is expected to resume this afternoon. The cause of the fire still unknown, but investigators believe they know where it began. We now feel very strongly that we had the section of the building that was the area of origin of where the fire started. The investigators will be here in a few hours to Start Building out their team and really getting deeper into that area of the building. Again, it is the back of the building. When we enter and go straight back to the back wall, center of the building weve got a Square Footage area thats been quarantined off for additional investigation. Joining me now from oakland is nbcs steve patterson. Lets get to where the fire investigators left off. We have now a sense of where it may have started. Is there any better indication of what may have started this fire . Reporter no indication at this time, peter. Thats because obviously the hard work of the recovery effort has to be well under way before they can determine what the cause was. Thats a Significant Development though. Them isolating the possibility of that origination of the fire to the back half of the warehouse. Thinking it started somewhere along the back wall. Investigators have isolated the area. They want to go and start their investigation there. If you want to look at it from a criminal side, yes. The d. A. s office activated the criminal Investigation Team. They are on site looking at not only physical evidence but the history of this warehouse. A sordid history with a number of violations described as a labyrinth mess of different lofts and work spaces that were colluded and collided together in the first floor. Then the makeshift sort of dance floor on top of there with the latter th ladder that connects it probably used as tinder for the fire to spread through the building and have the roof collapse in on the people inside. Thats part of whats going on there. None of that will matter until they get the building shored up and structurally sound. Not only the Investigation Team can go back there but the crews doing the work of the recovery effort. So those are things that have to be taken care of first. Its crushing to hear from the loved ones, the families of those who were lost in the fire. Those who are still missing now. Presumed deceased in many cass. S what more do we know . One of the victims is the son of a first responding sheriffs deputy who was inside the warehouse at the time. Also hearing more about the victims. 11 have been identified so far. One we now know is a minor, a 17yearold. But the stories keep rolling out as the hours keep coming. We keep hearing more stories, one of which comes from a resident who lived inside. I want to play the sound from the today show. We talked to two women who lived in the building. They were there as the fire broke out and talked about the horrific nature of what went down that night. Listen to this. We lost one of our own in the fire. We all knew right away. One of our other members tried to save him and wasnt able to. We all knew right away. I think hes still officially listed as missing because they havent recovered his body yet. Reporter what we are waiting on now is to find out when the work stoppage will end and crews can get back to work. It could be another three hours before that happens. Upwards of that. This was already a long process. It could be longer now that the work stopped here on site. Peter . An awful story. Thank you very much. Back to politics now. In new york the secretary of state search of the president elect is showing no signs of slowing down. The final four floated a few days ago is apparently out the door. There are unexpected new names in the rumor mill. Vice president elect mike pence gave us an update this morning. We are looking forward to another productive week in the transition thats setting a historic pace. The American People are rightfully encouraged and impressed at the speed and decisiveness our president elect is bringing to assembling a government that will make America Great again. Another big name at trump tower in the last hour. The former Vice President , al gore arriving from meetings scheduled with ivanka trump. The topic they will share, Climate Change. Kristen welker live outside trump tower. Its a cold one outside in new york now. Lets get to you out of the gates. Give us a sense of where things stand in terms of the new names being identified as members of the cabinet. Ben carson identified today for hud. Whats it look like for secretary of state . The search for secretary of state is expanding, peter. Thats significant. At a certain point it looked like it was narrowing between Rudy Giuliani and mitt romney. There was all of the backlash against mitt romney because hed been so critical of donald trump during the campaign. One reason why the search is now expanding to include someone like John Huntsman, the former ambassador to china under president obama, a former president ial candidate hyimself in 2012. A governor of utah could be helpful in navigating this recent controversy over taiwan and china as we have been reporting on president elect trump took a phone call from the leader of taiwan. Neither china nor the u. S. Recognized taiwan for some time. The Trump Transition Team saying it is not a shift in policy. Bottom line thats why someone like John Huntsman would be interesting at this point in time. The search is including other folks like rex tillerson, someone who is the ceo for exxon mobi mobile. Hes expected at trump tower this week. There are other names we have been watching. Bob corker, john bolton. This search is expanding and trump transition officials insist hes not rushing to make the decision. It is a critical decision and he wants to make it in due time. Peter . Lets ask about another high profile figure walking through the halls of trump tower, the former Vice President al gore. We know he wont meet with donald trump. He will meet with ivanka. The subject is Climate Change. Donald trump throughout the past has called it a hoax perpetrated by the chinese. Hes moderated his view on this. Why is the meeting significant . Reporter its significant for a host of reasons. One for the reasons you just mentioned. The fact that president elect trump as a candidate was so skeptical of Climate Change and, of course, al gore has done so much work on Climate Change, particularly in the latter part of his career. So you would anticipate part of the meeting with ivanka trump is to argue what are the threats posed by Climate Change. It is interesting for what it says about ivanka trump. The fact that the transition said shell be a key part of the process. What role will she play in the white house . Of course shes the daughter, so that raises questions. You are not allowed to appoint your daughter to the administration. Will she serve as a top adviser . She sat in on meetings with the president elect so far. We also learned today that according to one News Organization she and Jared Kushner are looking for homes in the washington, d. C. Area. We havent confirmed it ourselves. This points to one thing, peter. She will likely play a big role in her fathers administration, if not officially in some type of advisory capacity. Kristen welker outside trump tower now. Thanks so much. We want to get to the New York TimesNational Security correspondent david sanger. I just tried to annex you as a member of todays team. For today you are. Lets talk about the topic of the secretary of state search. The candidates all over the map. John bolton, former u. S. Ambassador, joe manchin, a silly season for his name to be included. But names like the former utah governor John Huntsman, president obamas former ambassador to china and general david petraeus. Does this search highlight how much donald trump highlights personality over policy or perhaps just the opposite . Peter, it sure does seem to suggest hes not looking for somebody who uses a particular ideological line. David petraeus could have been a candidate for secretary of state under Hillary Clinton had she been elected which gives you a sense of how broad this is. I would say John Huntsman, like mitt romney, falls very squarely in the sort of moderate republican traditional foreign pollsticy territory. Mr. Huntsman, in addition to running for president briefly, was the ambassador to china. And has dealt with all of the chinataiwan issues you have been hearing about this weekend. And then you have people on the list including mr. Bolton who are considered to be in sort of far right extreme of the party and whose views did not sit easily with the george w. Bush administration when he was the ambassador to the united nations. Let me pick your brain a little bit about a conversation thats getting a lot of attention. The phone call that donald trump took at the end of last week with taiwans president. The question, i guess, is whether this was strategic, what it means in terms of the shortterm relationship with china. In simple terms, what are the real risks of, as some describe it, freewheeling Foreign Policy in moments like this . The real risk here was that you violate the norms that have been set up since 1979. The campaign, the trump transition said there is nothing thats written in stone about those. Thats true. The Clinton Administration and others have allowed taiwanese officials to travel through the United States which they couldnt do initially. They have relaxed some of the steps along the way. I dont think there was anything earthshaking in this other than it was sort of an early marker to the chinese. I think the followon was interesting. You mean the tweets . You had the criticism of the transition and then the tweets from mr. Trump that indicated that he was doubling down. Those tweets basically went after the chinese on more traditional trade issues. That suggested he was escalating while the chinese were trying to deescalate. John huntsman spoke to one of our reporters and he said donald trump should have taken that call from the taiwanese president. This weekend, secretary of state john kerry told Andrea Mitchell that his department has not been contacted by the trump team ahead of the calls hes taking with foreign leaders. Wouldnt the president elect find discussions with career diplomats on World Leaders to be valueadded . Isnt that generally the way the system works . These are life long career diplom diplomats. They are not necessarily allied to any one position. They are there to help whoever the president elect would be. Yes. Thats the point that secretary kerry made at the forum in washington this weekend which is you listen to them and you hear the risks of what you are thinking of doing and not doing. That doesnt mean you take their advice. Hes choosing to go his own way. Even more interesting if he does that as president. Can i conclude with one other topic . Wednesday is a historic anniversary. 75 years since pearl harbor. Later this month during president obamas hawaii vacation the japanese president shinzo abe will be the the Prime Minister i should say will be the first sitting Prime Minister to visit pearl harbor. I know you have traveled frequently to the region. What does this say about our relationship and what does it mean historically . Peter, its a fascinating moment. I was the correspondent in japan and i was there for the 50th anniversary of pearl harbor. It was unimaginable at that time that a japanese Prime Minister would come. Pearl harbor is wrapped in such mythology in japan that they were forced to do it because the United States had cut off their oil. There are museums and shrines to the heroes of pearl harbor. You can go visit in japan. So for him to come will be a very tricky for Prime Minister abe who is a nationalist and probably one of the few Prime Ministers who could get away with this within the japanese political atmosphere. It will be interesting to see if he does something that seems to constitute an apology which would be difficult for him at home or simply relies falls back to the japanese phrase that all war is bad and we should make sure this never happens again. Very fascinating to watch. That visit scheduled for just after christmas. David sanger from the New York Times, nice to see you, thanks. Great to see you. Coming up, pizzagate explained. Male vo no one deserves a warmer welcome home. Thats why were hiring 10,000 members of the military community by the end of 2017. Im very proud of him. Male vo comcast. We are learning new details about an alarming shooting that took place inside a popular washington, d. C. Pizzeria not far from where we are now. Police said a 28yearold gunman entered comet pingpong and fired an Assault Rifle. The shooter claims he was investigating the socalled pizzagate story, a fake online Conspiracy Theory suggesting the pizza shop was at the center of a child sex slave ring organized by Hillary Clinton and her campaign chief. One of the pieces of fake news we have been talking about frequently over the course of the campaign season. Jacob soberoff spoke to the owner of the shop before the shooting incident. What have you learned about how this Conspiracy Theory turned from a fake news story into something bigger during the course of the campaign . Social media, peter. We have been talking to james oliphantes and others involved in the creation of fake news. Because of how prolific and problematic this phenomenon has become. He told me people that work in the restaurant were receiving harassing, hateful and sometimes threatening messages. This is taking it now obviously to a new level with the gunman coming into the pizza restaurant and unloading at least as far as we know one shot into the ground of comet pingpong. The owner of the restaurant did come out and speak to the media. This is what he had to say. What happened today demonstrate demonstrates that promoting false and reckless conspiracy theories come with consequences. I hope those fanning the flames will contemplate what happened here today and to stop right away. When you talk about consequences, peter, we are not talking anymore just about harassing messages on this mans instagram or to the employees of the restaurant. Right. Even to the scared customers that were there when the incident happened. Yesterday, if you take a step back and look at it from a 30,000 foot perspective we are talking about affecting the outcome of the president ial election. Buzz feed did an analysis that said the 19 most shared stories that were fake leading up to election day in the three months were shared more than the 20 most shared stories coming from real news sources. Fake news stretches from here in Southern California to the incident in washington, d. C. Thomas done i cant where a small town has people making money by creating and sending these stories out to a public that in many respects is unsuspecting and some folks just want to believe this stuff, peter. The stories propel themselves and social media is usually the conduit as they are spread not just across the country but around the world. Jacob, thank you very much. You got it. Speaking of social media the president elect showing no signs of backing off one of his own social media accounts on twitter. Taking aim at one of his favorite targets, the media. Within the last hour he tweeted if the press would cover me accurately and honorably i would have far less reason to tweet. Sadly, i dont know if that will ever happen. Some of trumps recent tweets continue to make headlines including a false claim he would have won the popular vote, quote, if you deduct the millions of people who voted illegally. Even some of trumps closest colleagues are struggling to defend his unsubstantiated claims. Trump tweeted in the last week or so that he had actually won the popular vote if you deduct the millions who voted illegally. Do you believe that . I dont know. Im not focused on these things. Wait a minute. You have an opinion on whether millions of americans voted illegally. I have no way of backing that up. I have no knowledge. It doesnt matter to me. He won the election. The fact voter fraud exists you cant provide evidence. Is a fact in this country. Can you provide evidence . Hes expressed his opinion on that. Joining me now sara flores, former Deputy Campaign manager for carly fiorina. Mike pence and paul ryan, different ways of handling this. Paul ryan saying, i have no evidence to prove this. Mike pence saying, well, voter fraud exists. The thing with social media is donald trump can spew an idea that millions of people voted illegally and not be pressed to defend it. This sort of stuff propels people to believe it. The press will need to find a new way to cover donald trump. We have had revolutions in how politicians reach voters. Reagan was the television president. The press struggled then on how to cover someone who was talking directly to voters. This is a new way to do it but i dont think the press figured it out yet. We talk about fake news for instance. Im not trying to equate any two things. In 2012 the Southern Poverty Law Center calls the Research Center a hate group and someone commits violence. There are mentally ill horrible people who will now spend time in joil for doing these things. The presss over hyper ventilation on each tweet misses what voters are hearing. Lets focus on donald trump. Hes the president for the country in less than seven weeks from now. The latest example this weekend. Hes watching saturday night live, sees an item he doesnt care for and weighs back in. Here is the clip from snl this weekend. Oops, i did it again mr. Trump, please stop retweeting all these random real people. Youre not getting any work done. Minutes after snl parodied the president elect as a co compulsive tweeter. This is after midnight. He watches it and goes straight to twitter. He calls baldwin sad and biased. Before the show is over baldwin says, release your tax returns and ill stop. Perhaps there is a middle ground. It is appropriate to tweet on policy issues as a way to communicate what he calls a modern form of communication. He doesnt need to get bogged down in this. Some said, for heavens sake youre president. Politically its smart and i disagree. On the snl thing . Absolutely. Hes watching tv. How many people tweeted about snl . Do americans want donald trump to be tweeting . He hasnt read the briefing books. I know you dont want to talk about the press but its something that gets under the presss skin. Voters hear something different, a regular guy. This was his populist message. Hes following through on it. Whether it is the taiwan call or snl, for so Many Americans that wasnt working so well try something different. With 25 million followers from twitter to facebook a lot of people are paying attention to what he says. Nice to see you. Breaking news from north carolina. A story we have been following since election night. One of the final open questions from the evening now answered. Pat mcrory conceded the governors race. He lost his reelection bid to the state democratic attorney general roy cooper who was ahead in the vote count after election night. The mcrory campaign voiced concerns over allegations of voter fraud in the following weeks. Governor mccory signed the bathroom bill you may remember, a decision that made organizations like the nba and ncaa to remove major events from the state. Pat mccory, conceding the governors race so democrat roy cooper will be the governor there. The former Police Officer who fatally shot an unarmed man named walter scott last april. In a note friday one holdout juror said he could not in good conscious convict slager in scotts death but a new jury indicates the jury is still deliberating. Gabe gutierrez has the latest. Obviously now its unusual to have this kind of insight into the inner workings of jury deliberations. What else do we know about where they are now in terms of the process . Very unusual to see this before the trial is even over. Today, we just got new information this morning about several more questions the jury is sending to the judge. Why was voluntary manslaughter issued, whats meant by imminent danger and is the idea of selfdefense applied the same as a Police Officer as an ordinary person . Those are three of the questions that the jury sent to the judge this morning. The jury now says a majority of them are undecided. Thats why the defense attorney for Michael Slager asked for a mistrial this morning. However the judge denied the motion. So now the jury is undergoing legal motions now with the prosecution about how to answer the questions. The major questions for the observers here is how long does this go on for . We thought friday we might have a hung jury but the judge agreed to let the jury go back and come back this morning. The trial has been going on more than a month. This is the fourth day of jury deliberations. The jury already deliberating more than 20 hours so far. The family for walter scott hoping the juror might change his mind. We thought there was one lone holdout. Now the question is whats the breakdown . Are some of the jury panel leaning toward voluntary manslaughter, perhaps . Or are some considering murder . Is that lone juror that sent a note yesterday sticking by his acquittal . We dont know the answer as to how long this might go on for. Just reading the tea leaves as we hear more. Gabe gutierrez in charleston. Thank you very much. Also today a major victory for protesters of the Dakota Access pipeline after the army corps of engineers rejects part of the proposed route. After months of protests a major victory of thousands of demonstrators in the battle over the Dakota Access line. The government will not permit construction of an oil pipeline in north dakota, the native americans consider it sacred. Several questions here remain. Msnbcs cal perry, a frigid one in Standing Rock sioux reservation. Hes there keeping a close eye on the latest. Protesters have said they are going to stay. Why . Well, they are going to stay partly because they are worried that people will go back on their words. We have this statement from the Energy Company. Came out about midnight last night saying they are not going to stop construction. Word has spread around the camp throughout the morning. Im joined here by abraham. I want to bring him in. You got here how long ago . One day ago. How long will you stay and what are you trying to achieve . I believe we are staying until the 8th. We are standing with Standing Rock and our goal is to let the world know that the sioux nation will not be moved nor will we be moved. Our oath and our defense of them will continue as long as they need us. We continue to continue running deployments. Reporter were you surprised the Energy Company said we are not going to honor the army corps of engineers decision . I am impressed that the people were able to achieve a small victory and a Public Relations statement by the Energy Company. However, i do not feel that the Energy Company intends to keep the promise. I am not surprised they made a p. R. Statement. Peter, i want to show you the flag here. You flipped it upside down which is a sign of distress. Authorized proper use of the uniform in which the country is under distress and an instance in which a soldier is under distress and they need to notify others that they are in danger and that the country is in danger. Thank you for your service. Thank you for letting us use your fire. Two issues are happening here. You have the issue of the pipeline and the sioux nation which by their accounts is something that the American Government has gone back on. They are trying to balance both issues. Cal, i want to break down more about where we go on the issue next. The thought really is things could change in the Trump Administration. There was a Conference Call with the top advisers to donald trump today saying they have a different position on this. They say its something we support construction of, that they will review this issue once in the white house and make an appropriate decision at that time. Paul ryan weighing in on the topic. How does that weigh in. As we look at paul ryans tweet of the most recent decision, this is Big Government decisionmaking at its worst. When you talk to the elders of the sioux tribe when the news came out yesterday there was jubilation around the camp. There was an immediate reality check from a lot of the elders. I know abraham was saying earlier these people have been here thousands of years. They have felt betrayed in the past and they were expecting. They said we expect this will be a betrayal down the road. It really is counter productive when you look at the big picture of how people see themselves and their relationship with the federal government. I dont think there is a lot of surprise now that we are talking about a Trump Administration thats going to flip it. That was going on here yesterday. A lot of people were talking about president elect trump and his energy policies. Stunning scenery out there in the plains of north dakota. Cal, nice to be with you. Thank you very much. Moments ago the White House Press secretary josh earnest spoke on a phone call between donald trump and the president of taiwan, first Public Comments from the white house. I think it is hard to determine exactly what the aim was of the president elect. The Vice President elect and his Campaign Manager when asked about this over the weekend indicated that these were Courtesy Calls, that was a Courtesy Call and the president elect was returning the call. The Washington Post today tells a different story with some trump aides indicating that this was a long planned call. This is part of a broader strategic effort. Its unclear exactly what the strategic effort is, what the aim of the strategic effort is. Its unclear exactly what potential benefit could be experienced by the United States, china or taiwan. Joining me now for the daily fix, Jeremy Peters and wall street Journal White House correspondent carol lee. Lets pick up where josh earnest left off. Nbc news confirming from sources familiar with the conversations that president elect donald trump had these conversations or had conversations with his own top advisers dating back for months prior to the election about having this conversation with the taiwanese leader. The source says the conversations became more intense of course after he was elected. They say there was an awareness that it would send a strong signal to china in the wake of trump railing against currency manipulation. We know the white house is doing a delicate dance on this. Im curious for your take. Carol, well start with you. For the Trump Administration, what message they are trying to send here with what appears to be a more thought out move than just accepting a simple phone call. Well, think broadly the message they are trying to send is things are no longer going to be status quo. To accept a phone call like that, to plan on having that sort of engagement with taiwan is a strong signal that donald trump is not going to govern in the way that, say, president obama has. And many of his predecessors have. If you look at the way donald trump followed up on that, you know, hes tweeting and saying, you know, what about chinas currency manipulation and what about what its doing in the South China Sea . It is a provocative move out of the gate designed to send a strong message that this is going to be different. We are going to have a different approach. If you listen to the way donald trump talked about Current AdministrationForeign Policy during the campaign, a lot of it was that the u. S. Had not been Strong Enough or forceful enough in taking on countries like china. So hes showing that hes willing to do that. What the consequences of that are remains to be seen. Donald trump proving himself to be the great disruptor during the campaign and perhaps as president as well. Jeremy, i want to ask you about another conversation thats at the heart of all things behind closed doors in trump tower now. The idea who the next secretary of state may be. My colleague at nbc Steve Handelsman spoke to John Huntsman on the issue. Reporter should he pick you as secretary of state . Well, thats a loaded question. Im around to serve my country. I have always believed in that. Any way that i can help i will always stand up, salute, and do what i can. Lets talk about the auditions taking place now. Some are on television, some behind closed doors. What does this say not so much about donald trump but about this decision, specifically the idea of a secretary of state. David petraeus among the names being floated now. Thats right. I think trump is going to be drawn naturally to somebody who is a military figure like petraeus or like general kelly. I do think somebody who very much looks the part of what trump sees as somebody thats a strong presence, a masculine presence. He likes that. Its not all for superficial reasons but trump like it is projection of strength. Hes going to have somebody in there with a wow factor. There are a lot of image concerns from his perspective. I think this is a process thats still very much playing out. Romney is in the game. Rudy is, petraeus. The fact they expanded the final four, some think that means they have dropped in terms of their likely selection. Remember, trump floats names and these people end up being often picked for some other job than they were initially said to be under consideration for. So, yeah. I think i could see somebody like maybe even a John Huntsman. But, you know, these other secretary of state candidates who popped up over the weekend could be in the mix for other types of jobs. Gives us a lot to watch in the weeks ahead. Nice to speak to you both. Thank you. Thank you. There are Major Political shakeups in europe as well.
