Been wary of working on any case that might catch trumps attention and that the stone episode deepened the concern and said that they were worried that mr. Barr might not support them in politically charged cases, end quote. Over on capitol hill, Senate Judiciary democrats sent a letter to senator graham to unfortunately him to launch an investigation. They wrote the Justice Departments ensuring justice for all americans requires that the prosecutorial decisions free from political influence. It is becoming clear that this is not happening. A key republican senator disagreed with that assessment. What prosecutors do is they make recommendations which may or may not be accepted by the judge and these line prosecutors work for the attorney general so theyre not free agents. So im confident the judge will do the right thing. The jury found him guilty of a couple crimes and the judge will assess an appropriate sentence. Meantime, former white house chief of staff kelly unloaded on his former boss. According to the Atlantic KellySaid Lieutenant colonel vindman who was removed from his job last week, quote, did exactly what we teach them to do from cradle to grave. He went and told his boss what he just heard. End quote. The president fired back at kelly on twitter saying that he, quote, misses the action and cant keep his mouth shut and he bligation to do but the Justice Department isnt the only place reeling from political interference. Another key player in the impeachment inquiry, former u. S. Ambassador to ukraine yovanovitch said the state department is also in trouble. Senior leaders lack policy vision, moral clarity and leadership skills. The policy process has been replaced by decisions emanating from the top with little discussion. Vacancies at all levels unfilled and officers wonder whether it is safe to express concerns about policy even behind closed doors. All right. Thats her talking about the state department. Lets again at the Justice Department. For more on that, we turn to correspondent ken dilanian. From when you first reported this decision by bill barr to get involved this a couple of days ago until now, things are starting to come apart. This is very serious, did degree of tensions between the attorney general and some other Justice Department leaders who might actually take action against the prosecutors who speak up on this issue. Yeah. This is a really serious matter, ali. Some ways as serious as the ukraine scandal. You can argue because federal prosecutors wield enormous influence over peoples lives. They have the power to imprison people. So the idea that there is any kind of political intervention, influence over criminal investigations is a huge scandal and, you know, bill barrs now under fire even from allies. I was just reading an opinion piece by a former Bush Administration lawyer of Jack Goldsmith now at harvard supporting bill barr as a trump critic saying that barr has created the appearance that the Justice Department has been politicized because donald trump is tweeting and the Justice Department is acting. And he essentially i want to read this quote. Barr needs to make the president stop barking commands to the department or stop acting in ways with those orders. If we cannot, he should quit. Thats from a barr ally, ali. This is only getting more serious as the hours and days go on. Ken, thank you very much for your great reporting on this. Nbc newss correspondent covering National Security and intelligence for us. Lets look at how we got to this point. In january special counsel Robert Muellers team secured an indictment against stone for obstruction, false statements and witness tampering over the contact with wikileaks and the efforts to cover the contact up. It charges from the stem before the House Intelligence Committee in september of 2017. In which prosecutors say he lied about his efforts to find out what wikileaks planned to do with thousands of hacked democratic emails. Stone was also accused of pressuring radio talk show host Randy Credico and threatening to take his service dog. Roger stone went on trial last november. Witnesses included randy, rick gates and steve banion. President trump accused prosecutors of being unfair to stone and questioned why nothing had happened to other key players in the russia investigation. This past monday, prosecutors recommended that stone receive seven to nine years in prison when he is sentenced on february 20th. They wrote in the sentencing memo, quote, roger stone obstructed Congress Investigation into russian interference in the 2016 election. Lied under oath and tampered with a witness and when his crimes were revealed by the indictment in this case he displayed contempt for this court and the rule of law end quote. Early Tuesday Morning donald trump tweeted that this is, quote, a horrible and very unfair situation and that he cannot allow this miscarriage of justice. The president of the United States tweeted this. Tuesday afternoon, the Justice Department submitted a revised sentencing memo arguing that the original recommendation, quote, could be considered excessive and unwarranted under the circumstances. And deferred to the judge on the appropriate sentence. The president has denied playing a role in that move. No, i didnt speak to the i would be able to do it if i wanted. I have the right to do it. I stay out of things to a degree that people wouldnt believe but i didnt speak to him. I thought the recommendation was ridiculous. I thought the whole prosecution was ridiculous. Okay. As all of this was happening, all four prosecutors involved in the stone case withdrew from the case, one resigned from the Justice Department entirely. Tuesday evening, as the primary results came in from New Hampshire, nbc news reported that attorney general william barr has been quietly asserting control of legal matters that are of personal interest to President Trump, including the case against the former National Security adviser mike flynn. Yesterday the president congratulated barr for taking over the stone case and accused Robert Mueller oo congress. Joining us now to talk about what this means, other than perhaps the dismantling of our Justice System in america, patrick cotter. Hes now a partner with the greens felder law firm. I dont know how you analyze this and how things normally worked in the yd that you worked in, but there seems to have been a line that was crossed between the fact that the attorney general is an appointee of the executive and the work that the u. S. Justice Department Needs to do. Absolutely. I cant compare it to anything i saw in my years at the doj. I will tell you the attorney general is appointed to administer the law fairly. And impartially and thats the line that i see has been rolled over like a tank by the president who has clearly, clearly applied enormous Prime Minister to the doj in favor of a personal friend of his. Where does that line thats unacceptable. We are aware that the attorney general is apointed by the president of the United States. The department of justice is part of the executive branch of government. So we know that the attorney generals probably somebody who supports the president. This one is an unusual situation because bill barr wrote things in support of the president before he was in the job. He then covered up for the president when the Mueller Report was released to nobody but him. And had a good threeweek lead on the rest of us to read this and had a spin on the whole thing and when does the line get crossed . Typical when you were prosecuting a case for the attorney general to have been involved in the sentencing stage . Absolutely not. Absolutely not. I worked on some very high profile cases. I was part of the team that prosecuted john gotti and we never heard from main justice about our sentencing recommendation or any other part of that case except when we submitted the case and said we wanted to prosecute. Thats when doj has a voice and they should but the line attorneys are the ones that know the case and sentencing recommendations are determined by the sentencing guidelines and the facts of the case. The attorney general should and traditionally has no role in that process whatsoever. Let me ask you about this. When bill barr was having his confirmation hearings in both 1991 and 2019, he was asked about political interference. Lets listen to both of them together. Nothing could be more destructive of our system of government, of the rule of law or the department of justice as an institution than any toleration of political interference with the enforcement of the law. President trump has sought no assurances, promises or commitments from me of any kind, either express or implied and i have not given him other than that i would run the department with professionalism and integrity. As attorney general, my allegiance will be to the rule of law, the constitution and the american people. All right. Patrick, either only two things true here. He believes that and just made decisions he knows will be in trumps favor or that he was lying there. Assuming that he wasnt lying, what is going on here . Is bill barr sort of reading Donald Trumps mind, knowing what he would like to have done and just reading it . Bill barr doesnt have to read Donald Trumps mind. Donald trump tweets exactly what he wants. Good point. Good point within hours william barr does it. I wish mr. Barr, who i worked for and who personally gave me an award. I used to have his picture on my wall. I wish that he was the man an living and exercising his authority the way he testified in congress. But he is not. It is clear. You would have to be blind not to see that the president is exercising power and influence on the department of justice. No conspiracy if we tweets it for all of us to see. Ali, the theory of the case as the Warren Campaigneads into nevada, South Carolina and super tuesday is hinged on grassroots support both in the donors and in the way they operated as a campaign and thats why they invested in infrastructure on the ground here in virginia early. It is a state with 99 delegates at play on march 3rd. 28 staffers on the ground, nearly 1,000 volunteers and they say knocked 75,000 doors in a month or so and two theories come into play. You have the traditional organizing theory of the case an then what Michael Bloomberg is doing. Listen to my conversation with that volunteer earlier. In super tuesday, Michael Bloomberg is taking an approach on the air waves, blitzing Television Screens everywhere. Is there a concern that you have as youre knocking the doors, maybe that air campaign might trump what you guys are doing on the ground . I mean, theres always concerns about things like that but i think the importance is were building a community and we are listening to peoples actual concerns so people are hearing things all day on the radio, things they agree with and dont and we are putting a face to the issue and saying really telling voters why we believe in Elizabeth Warren so i think in the end thats going to make an impact and also going to carry us into the future so when she is elected she will have a base of supporters to hold the local people accountable, hold state legislators accountable. Reporter now, ali, thats not to say that Michael Bloomberg doesnt have staff on the ground here and not invested in the grassroots. Because he putts as much money as this as possible, he has 80plus staffers on the ground and contrast that with other campaigns like Elizabeth Warren, yes, a big strategy going down the rest of the calendar, the question is, can she sustain it with the cash flow . They have raised about 5 million since the iowa caucus and setting a new goal of 7 million by nevada and resources is key question heading into super tuesday for a lot of these campaigns. Garrett, Amy Klobuchar riding a bit of a wave out of New Hampshire where she told people defy the media, make history, show them that you can support me. Third still not moving her up dramatically in National Polls but different issue than Elizabeth Warrens. Reporter thats right. Klobuchar has to introduce herself to so much of the country. She is a senator from a state in the middle of the country. Didnt run for president before, doesnt have billion dollars and Grassroots Army that Elizabeth Warren put together so klobuchars campaign is trying to clear one hurdle after the next. They improve the performances along the way and i suppose the good news for the Klobuchar Team is that they have things that you cant really buy in politics, quantifiable momentum and a message thats breaking new. I cant tell you how many late deciding New Hampshire voters i spoke to who said they broke to klobuchar at the end and ultimately just felt like this was kind of moving her direction, a gut feeling in her favor. You cannot buy that in politics but its very difficult to sustain. She has to introduce herself next to nevada, a state where shes been quite seldomly compared to the other candidates and has a small footprint and will be here tonight Holding Events tonight, tomorrow morning, back and forth across the state an doesnt have the resources to be compete all at once everywhere on super tuesday. Michelle, thank you for being with us. Heres the thing. These are not nothing obscure about them. The opponent is valid. People who dont know their names particularly Amy Klobuchar but not new to politics and evaluated by people that look at policies have put forth in both cases remarkably well thought out and detailed policies and some people think thats what hurt Elizabeth Warren, she came out there not detailed the policies but prices on medicare for all, Bernie Sanders policy, and it started to hit her in the polls. Yeah. I mean, you know, it is possible that that is the problem that were seeing with the Warren Campaign and the Klobuchar Campaign but i dont think so. Earlier this week Jason Johnson whos one of the contributors here at msnbc said in his opinion we are not going to know whats happening with the race until we get to a state to see black voters come out and tell us whos more important most important to them. Im going to add on to what jason said, ali, and in my opinion is were really not gong to know where any of the candidates stand particularly Elizabeth Warren and Amy Klobuchar until we see what black women are going to do. I think the most important voting demographic that we are going do see in 2020 are the votes of black women, 97 of el li gibl to vote are voting in this campaign. Quite frankly, theyre not the issues that we have heard talked about in New Hampshire, in iowa or, frankly, even in virginia. When we get to South Carolina and other states, we are going to see black women in particular looking at what they believe are the greatest threats to democracy. That is racism. It is racial violence. It is voter suppression. It is the destruction of the constitution and it is what is going to happen with the Supreme Court and with courts all over the country and i think that on that issue Elizabeth Warren is going to fare very well with that demographic and the tide will turn for their campaigns as we see a variety of voters coming out to vote. One of my producers pointed this headline out the morning after New Hampshire. And it said sanders just beats buttigieg in New Hampshire democratic primary, biden in fifth. So this headline talked about the first place contender, the second place contender and the fifth place contender, conveniently three and four were these two women. This concept of erasure is interesting. If theyre seeing the news through the lenses, people accused all of us in the media of evaluating and covering men differently than we cover women. Youre absolutely right. Sometimes i ask myself, is it the countrys fear of a guynocracy but i believe that we have evolved from that. I dont know how to explain it except for that it is a phenomenon that female candidates still deal with. We have sort of trudged further along than 2008 saying they couldnt stand to hear Hillary Clintons cackle and reminded them of their exwife. It is something that people have to think about but i will say that the american electorate is a lot smarter than we give them credit for and then theres something i love to look at. We all it black twitter in my universe seeing the issues discussed in detail by africanamericans throughout the country and so we dont always Pay Attention to these head lynns because we have so much at stake. It turns out not very much except to continue to point out to people that decisions relating to health care, minority rights, all decided by the trump appointment judges with Lifetime Appointments and filled over 25 of the circuit courts with his nominees and the literally more District Court judges in his time than barack obama did so hes very busy. Mitch mcconnell is right there. We have to of course start with the two Supreme Court vacancies filled and when Mitch Mcconnell said the goal in life is to fill the vacancies with the most ideological conservative people he can think of he is not kidding. Who does that i mean, what do you about it . If people hear about that becom you may not like donald trump or the way he talks or tweets but instrumental in the vote in look at the courts. For him thats promise what november, not just for the does he call it . President but for the senators and that promises made, promises fulfilled . Promises made to feel the courts with the judge that is will not uphold individual rights and the roberts court, already oriented to protect corporate interests over individual rights and two more to help him do that and what needs to happen is people, part of my i dont know to help people connect the dots between who they vote for the senate and the confirmation of all these kinds of judges that will do them in, that will screw them over in terms of Affordable Care act and the lgbtq protections. You name it and these kind of issues will go before the courts. In fact, ali, what is happening is that because the court is so id logically turning toward the conservative perspective, that this is encouraging states to pass all kinds of laws that will curtail, for example, womens right to choose. So that they can all make its way to the courts, the things they cant do through congress they will hope that the judicial lifetime appointees will do for them. And i have no doubt that at some point the Supreme Court will have a chance to overturn roe v. Wade because they have overturned decades long protections that helped unions, for example. Public sector unions. Senator, obviously theyre doing that. The courts should are and should be a major concern. What i think americans didnt know is the department of justice is and should be of major concern to them. Of course. You are one of ten democrats that sent members of the Judiciary Committee sent a letter to senator graham to investigate what appears to be blatant political interference by the attorney general on behalf of the president s personal interests. Totally. Attorney general barr is not the attorney general for the people. He definitely acts like he is the attorney general for trump. Which is why back in may of 2019 when barr testified before the Judiciary Committee i called on him to resign because it was clear that he had auditioned for the job and that he put his thumb on the Mueller Report so that people got totally erroneous impression as to what the Mueller Report findings were and he hasnt changed in his desire to protect the president. Who sees what and when on facebook . This is the very big and unquestionably important question at the large of a research question. Facebook handed over a trove ofe academics insight into the patterns that result in the spread of misinformation and hate speech. According to the reporting of the wall street journal researches said they expected to get a functional data set within two months but it took closer to two years and sparking concern that the biggest opportunity to examine facebooks affect on its billions of users could fall short. Here to break down what it could mean to us is correspondent jake ward. Jake, this is i mean, people dont know. This is the top of the list of things you think is important looking at social media coming to hate incidents, shootings, genocide even. What could we glean if we had the information that the social media platforms had and you made the argument that should be studied by outside people and not just social media companies. Exactly right, ali. Every announcement you have seen from facebook about the efforts the protect against disinformation or to spike concerted coordinated disinformation efforts is happening inside the company, it is being conducted by people who are on facebooks payroll. They have tried to then expand into having an outside sort of board thats going to oversee content decisions, little bit independent, but really no independent academics allowed to see inside facebook the way the company itself can see how you and i behave. This move by this Research Group of social science 1 is one of the first times we have ever had the opportunity for qualified academics who, this is the really important part, not on facebooks payroll, to take a look at how you and i experience information on facebook. It is a very, very big deal here. This is tell me about the organization. Social science what is it called . Social science one. It is a group of social scientists, law professors, trying to do what they would have done a decade ago in looking at Television Effect on the way that misinformation moves or Political Polarization and right now with billions of active users around the World Facebook is the defacto form of political speech and communication in this world. And so, theyve gotten in this case 38 million urls that have been shared at least 100 times publicly on facebook. And they get to then distribute that across the academic ecosystem and let them take a look and see who saw what many when . Because if you have a piece of misinformation, a piece of hate speech passed into facebook and districted across the news how that works but the problem is instead theyve poured a bunch of sand in the data that makes it harder for researchers to find individualized stuff. That means even though, right now, if youre facebook employee and you could know exactly what you did, what i did on facebook. These researchers wont be able to do that. We generally think policies like that are good and more advanced than what we have in the United States. Now we have an instance where that law may stand in the way of researchers getting all the information they need to make the world a safer place . This is the difficulty of the moment were in. Were insistent on the need for privacy across the world and its creating new, better standards about privacy and its also giving cover certainly creating a legal liability for a company like facebook to turn over individualized data to academic researchers. I was speaking to one of the two heads of social science one and he said governments should be forcing them to open up to academic researchers. Not to everybody. What we want instead is for people who do a responsible job with this stuff and in charge of figuring out whether were being polarized by a platform like this, whether hate speech is finding flower in a place like failk. We need people not being paid by incompanies doing the platforms to do this research. Its not the data they wanted but theyll take it. And after 20 months of fighting, they finally got it. So, a big first step here having outside academic looking at the effect facebook is having on all of us. Technology correspondent.
