The one thing i look at is corruption, and the other thing i look at is, why isnt france and why isnt germany, and why isnt greece why arent these countries paying, why is it always the United States that has to pay, i said that very strongly, its in the transcript, the press doesnt cover it, why is it that the United States pays and it affects europe far more than it affects the United States. The president got back up from the aids in the room who were giving him that when it came to questions about the messy Defense Department letter, draft letter that was mistakenly released to the iraq okays and has created international turmoil. The president backed off somewhat of his threat to go after cultural sites in iran. One is the comments from defense secretary mark esper saying that would be a violation of International Law. And the other was secretary of state mike pompeo virtually echoing that word for word, saying he doesnt believe the president would give the United States an illegal order both from esper and pompeo. That message seems to have gotten through to President Trump. Although it is clearly something you get the impression he wishes had been on the table. They can do bad things to us, with no bounds, no rules. Okay from President Trump. He also, i think hes trying to message to americans, why they went after soleimani in the first place. We saw this on friday, and those two on camera events. Immediately after the strike happened when the president came out and explained why he did what he did. Casting soleimani as a monster was another notable highlight from that discussion. This is the first time reporters have been able to ask questions of the president in this kind of setting. He did not reveal anything more about the intelligence assessment behind the strike here, that is one of the key questions lawmakers have, we are within an hour of so of the gang of eight. And that all hands on deck briefing tomorrow. That is going to be a lingering question out there, im curious to see what else we might hear from that later on. Let me ask you about this, things are so upside down our views would be excused for not remembering how these things are supposed to go. Theres an authorization for the use of military force, there are rules that say within 48 hours of a strike, on either side of it, Congress Needs to be informed of it, of this. Theres a gang of 8 which are the leaders from the senate and the house, and the leaders and the ranking members of the intelligence committees. How usual or unusual has the process been so far with respect to the strike that killed soleimani, and congresss ability to play the role its supposed to play . If youre talking about just the strike that killed soleimani, ali, everyone the consistency within the trump era, its been somewhat consistent, if you go black and look at the strike that led to the death of al baghdadi last fall. You saw a similar pattern, the Trump Administration taking action, the Trump Administration issuing an order for a strike. He did not tell House Speaker nancy pelosi. That came up again this time, in that sense, its somewhat similar to what we saw from the president last time. If you look at the context of past president s and the way history has worked. Congress wants to be notified when things like this happen. Feel because they have they should be able to have a say in this. That said, there are critics that point to the fact that over time president bush, president obama, now President Trump. Congress has ceded some of the authority they would have had to be a check on the executive branch. That right now is not new new in the Trump Administration, youre seeing it play out in this political moment were in. Thank you for that. Thank you. There are people who say some of these people who we kill and we target are bad folks and its better for the world when we get rid of them. There are reasons why the executive has to follow certain rules. They have rights to defend the homeland. The article that members of congress use, we have rules you have to follow them, and we have to prove what this imminent threat was that required soleimani to be taken out. Prior precedents did have the opportunity to take out soleimani, and they judged the cost benefit analysis wasnt there for them. Right, there are two things that are going on here. Whats the law, whats the policy and the law . And the other thing is, what are the considerations that need to be addressed prior to any decision to attack or not attack. What youre seeing here is, a way in which the custom of having to brief congress has been violated. And what the real issue here is the fact that general soleimani was the part of the state apparatus. He was the top general in the state. Different from bin laden, different from al baghdadly . Very different. And if you think about the way weve designed our law and policy its been dependent on this nonstate actor contest. We crossed a light. That line does implicate these other considerations. What is an imminent attack. This is a discussion that we did not have under obama in a public way as we should have. There was a lot of criticism that meant days, months. Habitually does this someone who is able to carry out lethal attacks, what is imminence. That is where we are right now. Do we want to cross this threshold. Congress is concerned about this. The reason for so much of this, is what were seeing now, the chaos, the disinformation were getting from inside the National Security apparatus, what was the fall on, what were the plans . All of that matters. The reason is not just to tether the president in terms of what he can do. But to create a situation where there is some kind of debate and not just a decree. And now were in trouble and you see it. Steve, were 18 years in the degree of involvement in the middle east that there are Many Americans that never supported it. Some who feel that we have not developed adequate strategies. Something i often ask you, you and i are often on tv after something bad has happened in the world. This guy was a monster, he was a terrorist, the world is a better place with Qassem Soleimani gone. Is it more or less stable in a part of the world that we have struggled with instability in americas role in creating instability. They want to be able to say that soleimani was among the worst people in the middle east. That is true, they want to end the discussion there. A problem with this administration from the beginning has been that they havent appreciated that with every one of their actions, their adversaries are going to have a reing action. And the strike against soleimani was a dramatic step and dramatic escalation. There is going to be a retaliation from the iranians, we dont know what its going to be, where its going to come from. It will be something that targets either americans abroad or american interests somewhere this would suggest that at least the short run, things are less stable before they were before soleimanis killing. Were often talking about bad things that are happening. I want to bring in ali arouzi joining us from tehran. When we talk about the reaction, the type of reactions. We had a map up there showing where u. S. Troops are in the middle east. Where iran is, iran is not simply a country where the reaction emen atsz from tehran in a governmental form. He was an unusual being in that he was an actual general in the quds force. He steered the activities, some of the proxy activities of noniranian groups in lebanon in yemen in syria, although iraq, all through the middle east. When you talk, when they are talking about a reaction coming out of iran, as a result of this, what kind of reaction are we talking about . A government led reaction. Hamas or jihad, what are we talking about . Well, we could we dont know at this stage, we could be talking about one of them or all of them, i mean, as you mentioned, soleimani had kul cultivated a wide network of militias across this region. He was a cultish figure amongst them. Thats what made iran powerful. Those militias are able to strike at the United States assets they have across this region. Theyve always said they are within immediate striking distance of them. But soleimani was a jain of irans armed forces and that is an indication here that were getting that there could be a strike from irans actual armed forces, to send a very clear message to the United States that iran itself can strike back, and it doesnt have to rely on its proxies to do that. This is a very dangerous and confusing situation as to how and where and in what form iran will strike back. Those we heard some interesting reports today from hezbollah, which was one of the Shiite Militia groups, under the patronage of iran. They were the guys that attacked the u. S. Embassy that sparked off this whole crisis. They said, were waiting for irans actual military to strike u. S. Assets even then were going to go into motion. So this seems to be a multilayered attack thats being talked about from various different groups, the head of hezbollah. Interestingly he said, they are not looking to attack u. S. Diplomatic posts or civilians in any form like that. Which they have done before. This is not going to be some sort of terrorist attack on civilians, this is going to be a legitimate strike against the United States. This is war is basically what theyre saying, and that was drilled home today at Qassem Soleimanis funeral, by the head of the irgc. He gave a fiery, angry speech. He said, have no doubt in your minds that america is going to suffer a very severe blow. And that was followed up with another warning. If america strikes back after iran takes retaliation for soleimanis killing, iran will hit where america loves most, israel. Israel is getting thrown into the hits. This is threatening to engulf this entire region, including israel and some kind of a conflict that is very unpredictable. Emotions here in iran are running really high. A large Cross Section of this country expects some sort of relatet retribution for the death of soleimani. Its hard not to see this happening. Iran on a daily basis is saying that all u. S. Troops have to be expelled from this area. More u. S. Troops are coming as iran is saying that. The u. S. Is saying theyre not going to quit. Soleimanis main goal was to get the u. S. Out of iraq, these are all building up to be a very dangerous situation. Just to give you have a highlight of how high passions are running in this country. At Qassem Soleimanis funeral today in his hometown, people went crazy there trying to get a glimpse of his coffin, trying to touch his coffin, so they have an item of clothing that is worn by soleimani. On our last live hit i told you 50 people have died. Yeah. Thats now gone up to 78 people, including children. Theres a lot of tension and inflamed passions in this country right now. People are worried about whats going to come next. Ali arouzi was talking about the troops in the middle east. We have a number of troops in kuwait as of friday night, we were deploying 3500 members of the 82nd airborne to the 13,000 that are currently in kuwait. Iraqs looking for the soldiers to leave, were sending more in. There are massive interNational Security issues, then there is an important legal issue in the United States. I think its important for americans to understand regardless of whether or not you think theres going to be a terrorist attack on the United States, what keeps you up at night . What im worried about is that the declaration of war will come almost like this, impulsively without strategic concerns, and also, legal concerns, and the reason im worried about that, is that right now, the United States still has the post 9 11 dhorgs for the use of military force. Which has been extended and expanded to cover more and more geographical areas. To say, these are terrorist related groups, terrorists who were tied to 911. Youll see these ways in which theyre trying to say this is terrorism, we have the ability to go against terrorists. It is true. But this is a different ilk. This is a nation state. This is not just a nonstate terrorist group. My worry is, the authorization for use of military force will be used to say, its sort of carte branlanche which is where started in the white house before it went to congress. President trump issued this warning on twitter saying 9 United States has targeted 52 iranian sites saying that is representing the 52 hostages taken by iran years ago. He followed up with reporters on air force one saying, theyre allowed to dill our people, torture and maim our people and were not allowed to touch their cultural sites. Just to be clear, no ones allowed to do these things no ones allowed to kill our people, allowed to torture and maim our people. What are the laws governing the targeting of cultural sites. Article 4 states that members of the agreement shall refrain from any act directed by way of reprisal against cultural property. It is prohibited to commit any acts of hostility toward an historic monument. In 2017 the United Nations Security Council con demented the destruction of religious sites in iraq and syria by terrorist organizations including isis, and the world joined them in that. Iran has 24 sites designated by the Cultural Organization as World Heritage sites. The 22 cultural sites include the historic complex which dates back to 500 b. We have the votes once the impeachment trial has gng to pass a resolution essentially the same very similar to the 1000 vote in the clinton trial which sets up as you may recall what could best be described as a phase one. The arguments from the prosecution, the defense and then a period of written questions. He says hes getting ready to lay out the rules for the trial, which would allow lawmakers to hear arguments, but decide on witnesses later. Democrats have been demanding testimony from witnesses. The proposed format echos the format of the clinton impeachment trial, for more on how that trial could foreshad go the next couple months im joined by bill mccullom who was the impeachment manager during the senate trial of bill clinton. There was a period of time in which we were allowed to go and take depositions of certain key people that could be witnesses which wound up being what was used and the vote took place in that period of time with respect to whether we got to have live witnesses on the floor or not. Which is what we wanted, we wanted to bring Monica Lewinsky and several other witnesses to the floor of the house, and we were never permitted to do that. How does this work legally . You present your cases. And then decisions are made about witnesses . Because the average person like me wouldnt be familiar with this. First of all, the senate trial of an impeachment is not anything defined by law, its defined by the rules they set up, the senate has complete discretion. The chief justice in our case found that out when he proposed rules that we were quickly rejected by the senators. They want to do their own thing. If youre at home watching this and youve been watching television on a famous crime show, youre not going to see the same procedure. You have to pick the jury, we already have the jury. Then you would have Opening Statements. This is not too far removed from the Opening Statements part of this, we would know who we want to call as witnesses, we would be able to examine each side and prepare those witnesses for trial. They would be live. We got to meet with Monica Lewinsky one time. I set that meeting up at the mayflower hotel. While the trial was in progress. We anticipated meeting with her two or three more times because she would be a hostile witness. Normally you would get a chance to prepare the witness meet with them several times, know what theyre going to say, then take their deposition and bring them live to the actual appearance. That did not happen for us. Given that youre a republican one would assume there was an outcome you wished that didnt end up happening because of the final vote in the trial. Thats true. Do you feel the process was fair . Did you leave that process not with the outcome you wanted but the process played out fairly . I thought the senators listened with an open mind to us there was a point in time where they became per situated by the arguments against us, and i think Monica Lewinskys deposition did not allow the give and take in the crossexamination. I was told afterwards they either didnt believe her or they didnt believe president clinton was trying to persuade her to lie. She had indicated he was telling her what to say. Even if he didnt say i i want lie to your deposition. It wasnt fair. We didnt have the opportunity to have live witnesses where the jury in this case, the senators, could judge for themselves the impact of that witness. She was a very a very powerful witness in person and in this case she was not able to be in person and i think that made a lot of difference. I dont know if it made the difference in the final outcome but i think it could have. So given that way of thinking, do you believe that de facto witnesses should be allowed in this trial of donald trump . Well i think they should unless the senators have made up their minds theyre going to grant a motion to dismiss without any witnesses in that sense. That is what senator bird proposed in our trial and it came after we made our opening arguments, after the president s attorneys had made their case. And it came before we presented our witnesses. So i really think that it was it could happen that way. But my preference would be for witnesses. I must admit im a little biased by my experience and it is not a partisan thing at all. But i think being allowed each side should be allowed to present witnesses in this case. But not many. Maybe limit those. But i think fairness would say they should be allowed to present live witnesses for a limited period of time under the rules the senate sets up. According to a massachusetts based nonprofit called blue help, at least 228 Police Officers died by suicide in 2019. That is higher than the number killed in the line of duty. The cofounder of blue help told usa today, quote, 132 officers were killed in the line of duty in 2019, data that includes debts due to 9 11 illnesses and heart attacks but the actual number of officer deaths by suicide is likely higher because it only includes cases in which the family voluntarily provides information. Joining me now ari melber who has done some extensive reporting on this. What do you make of this. This is something we do here at msnbc at the end of the year, as sad as it is, and look at portraits of officers in the line of duty by several and killed by guns is 49 and that is down and what we put together with the Law Enforcement memorial fund, faces of every officer around the country died doing their job. Tonight on the beat im speaking to manpreet singe who knew one of the officers. Lets take a look at that. If hes remembered as the selfless servant, that is the most touching thing left behind for his legacy. Shes speaking about sandeep taliwell the first sikh officer to wear his religious garb on duty and was a trail blazer showing him in the background playing with kids and as we talked to his family about his life and this is someone who in addition to being an officer would take his Vacation Time and do volunteer work on behalf of people affected by the hurricane. And that is officers killed in the line of duty and we have more. The suicide story is so important. It is striking to see that the deaths by suicide are even higher than the risk we associate with police work with the homicides and that is largely because of the stress, the trauma, ptsd and resistance getting the help they need. Is that solvable . Living in new york, it feels like weve seen more stories of Police Taking their own lives . I dont know how you solve all of it. Partly because you have multiple things there like access to guns which in the case of Law Enforcement officers it will stay. It is different than guns from an area with people who may not need them for their job. At a practical level. But what we saw for example and you mentioned nypd and leadership said make sure that Mental Health help is available and deal with the stigma and to put it bluntly were dealing with people who pride on being strong. We hear in the police force being strong, quote unquote man and masculinity and 90 are men. And it is a conversation among all of us as a society and certainly within Law Enforcement that you can be very strong and go to the doctor when your leg is broken or get Mental Health help if that is what you need. We dont have Mental Health equivalency and people have less of a concern calling in to say i have the flu but we dont have that in society generally and we dont have it in Law Enforcement in any more meaningful way. Right. And i think youre seeing that carry. And again the suicide rate as were emphasizing is higher among these individuals and first responders. Five times i believe. Five times. Theyre carrying a tremendous amount of stress and to state the obviously, which is part of the stories, were talking about people who do Public Service. Who do this work. And yet sometimes i think it goes without saying, sometimes they also need Public Service and need assistance just like anyone else. Thank you for doing this my friend. A pleasure to see you.
