Fundamentally, this chart does not look all that great. I always like to see what happens in the last hour of trading. The question is, are beam going to think they are getting bargains and push this up or will we see the second day in a row with a major selloff. You will notice for those who watch the show regularly, when things start to look seriously, i where i sue in, you see a lot of it. Tell me from your perspective, on a normal day, we would say a 2 loss is no great shape. Exactly. Heres the problem for this market. Its a friday deadline thats looming. So they still have a couple of trading days. Expect to see a lot of volatility. Its has to do with the fact that the Trump Administration has thrown down the gaunt. We have here on cnbc, 25 tariffs on an awful lot of goods. That will get passed onto the importers of chinese goods and eventually, basically, to the consumer. I want to make that clear. Because the president tweeted, a few days ago, that were getting all this extra money from china because of the tariffs. Thats sort of not how it works. No, its not how it works. And one of the things that has wall street worried at this point is that the administration has basically alienated china and is forcing their hand, so that they can basically save face at home and theyre not going to move. China is not going to move on these negotiations. And then the Trump Administration will need to follow through on its statement that it will impose these tariffs. So its a little bit of a game of chicken. Thats what has wall street worried right now. They think perhaps this is a negotiating tactic by the administration. Perhaps it is. If you look at the editorial this morning that penned in one of the chinese newspapers by very high ranking chinese official. It looks like they are digging from their heels. They are not going to move on the language washington wants them to change. That is what is creating all of this volatility. I expect that to continue for the next day or so. Let me ask you something. You saw we had strong markets for much of the year. When the trade war started, we saw markets really suffering. Is this the kind of thing that reverses itself and ends, if we get a resolution with china . It could be. We interviewed a number of people today on cnbc, who pointed out the fact that this market has been basically been going up for some time now. These issues become kind of inflexion points. Some of the big Money Managers use those inflex yon points if you will to lighten up. Sue, thank you. I always rely on you in moments like this. Sue herrera at cnbc. Thank you. It gnaws at the roots of the great oak that is our democracy and could very well topple it. Those blistering words came from senators speaking out on Mitch Mcconnells declaration that the Mueller Report is case closed. This morning, mcconnell told congress, its time to ends what we called a groundhog day spectacle and move on from the findings of the Mueller Report. That sentiment echos the white house, where the president has gone to Great Lengths to stonewall documents, testimonies and key figures related to muellers findings. Just earlier today, nbc news obtained a letter directing former counsel don mcgahn not to comply with the congressional subpoena. In a letter from the chairman house judiciary committee, the white house documents they seek dont belong to don mcgahn, they long to the white house. Joining me for the latest fallout is kelly odonnell. This is becomeing a straight up fight who has the power to get the things they need. The white house now for the third time has said no to a very direct request from congress. Whether its mueller or mcgahn or mnuchin. The white house is saying no what happens next . Reporter well, it is, in part, control of the clock, wanting to extend some of these back and forth power struggles over information for paz long as possible as we get into the Campaign Season and certainly its an issue for the president to use to make his argument that he likes to make that he is under some sort of kind of an onslaught from democrats. Whats happening right now on capitol hill is sort of the wrestling with the issue of is there enough of a sort of band width to keep on with the negotiation and get Everything Else done. Thats say theyve got a duty to their oath of office and the constitution to pursue this. Republicans are in many ways saying there isnt anything there left if mueller and his team of investigators had all the resources to find out what could be determined on russian interference and the president s conduct and so forth. So that divide goes on. What we also heard from Mitch Mcconnell in his case closed argument was, he did not talk about the obstruction piece of that on the senate floor. Then not only did chuck schumer, but Elizabeth Warren and others talked about that extensively, saying thats an area where the president really needs to be held to account. We know all the reasons why that didnt happen in the prosecution kind of end of things. But politically, there is still an argument to make there, later in the day, just a short time ago, mcconnell was pressed on this issue of obstruction, there, too, he said, case closed. We got a little clip of mcconnell being asked about these issues just a short time ago. The special counsel spent a couple of years, talked to a whole lot of people, filed his reported and it seems to me, we got our answer, there was no collusion, no charges were brought on obstruction and the American People i think would like to move on. Reporter so the truckload of stop signs that have been erected around here from republicans will still be met with democrats feeling there is more to do here. So it will go into the legal realm. There will be challenges back and forth. Whether its the president s taxes or documents related to mcgahns Service Inside the white house. A drip, drip, drip, that democrats believe is worth pursuing and republicans are trying to not only protect the attorney general and say nothing there and the president , but also trying to get back to an agenda that they think is better suited for what theyd like to accomplish up here. It has nothing to do with mueller. They want to move on, will democrats let them . It doesnt look like it. Kelly, thanks very much as always for your thorough reporting for us as capitol hill. Particularly if some of these debates go to the Supreme Court. Nothing is above your pay grade, my friend, to be clear. But the white house seems to be clear on his e its position. Reporter sure, this is a position consistent with the sources and officials i have been talking to over the last several weeks. It is not a surprise to anyone that covers this white house that they are, in fact, saying they may want to assert executive privilege down the road as it relates to, for example, these documents for former white House Counsel don mcgahn, this is a white house that is leaning into this fight with democrats, why . Because there is a sentiment, some of the advisers in trump world, this could be politically advantageous to him. It is no coincidence Mitch Mcconnell is delivering almost verbatim the white house said as well. The president is backing up from the supporters, his base, but people on capitol hill. That doesnt always happen. Let me tell you what is happening at the white house now. As of less than ten minutes ago, the president was meeting with a group of republican lawmakers, senators, ostensibly about immigration. You may see a tweet on the border. It would be unsurprising if the little box in the corner of our screen didnt come up. Whats happening with the markets. Whats happening with trade. That is an area where you dont see republicans, many of them eye to eye on the same page with the president unlike as it relates to don mcgahn and the fight the white house is having with house democrats. We will reduce that through the course of the hour. Charlie savage, his book is called power wars, the relentless rise of president ial authority and secrecy. I will focus on the authorities side. You heard from halle, you heard from kelly. The question here is, americans want to know, Congress Issues a subpoena. It wants information. The president says, you dont get it. They ask for taxes, mnuchin says, you dont get it. They ask for mcgahn to testify. They said, you dont get it. Mueller, barr is facing a possibility of contempt of congress. What does this all mean . Does anybody get in trouble for not giving congress what it wants . Well, historically, there are very few Court Decisions that tell us where to draw that line, congresss power stops, the president s power to keep it secret begins, thats because historically normal president s have reached accommodations and compromises. You dont get the Supreme Court that says this is the red line. What is different, President Trump seems like his relishs this fight. He wants to have it. So the bad optics that have constrained previous president s. Does not constrain the president. They do not to. Its hard to argue this is Congress Versus the president. Mitch mcconnell comes on the part of the president. It seems its partisan versus congressional authority. Structurally, its consecutive. There is nothing new about the president s copartisans in Congress Acting as defence for their president as a posed to defending their interests. Im sure if it was the obama administration, Mitch Mcconnell would be on the ramp as he was back in that day. Lets talk about the history of this. You have written about how this has been something going on for decades under different president s, where, president s like to assert more authority than some would interpret that they have. For whatever reason, we the public let that happen, have let it happen, to the extent it may not be clear as you said where these lines r. Is this a product of president s asserting authority and people not liking congress that much and letting it happen . Certainly, no matter what you think has a lot to do with whether your guy or woman in the white house or the other partys. So everyone on both sides is a hypocrite when it comes to executive power issues. But there still president s dont want to look like they are covering something up. There is that constraint saying, fine, the court rules, you can have it as president obama did with the fast and furious documents and so forth. I think were in a very different situation. Trump does not care. He will fight the Supreme Court it looks like, because he wants to run out the clock on the next two years and keep democrats from dragging any more information to light. So other than the political process, the election process, is there any other arbiter here or these arguments go to court . In other words, can anybody tell bill barr, steve mnuchin, don mcgahn, you have to do this or you are in the clear from what is asked of congress . Obviously, the barr prosecution is not going to contempt anyone. They have a monopoly. They will say, we assert our discretion. Were not going to do that. There is an interesting california. Which is if Congress Goes to court not to try to prosecute, be to you ask for it to sue to file a civil lawsuit and say judge please order this person to comply with our subpoena. The judge says, i order you to show up and give that testimony, or turn the documents over. And the trump world figures still defy that. Now theyre not in defense of obstruction of congress. Its obstruction, sorry, contempt of court. Judges can appoint their own special counsels to prosecute if the Justice Department refuses to do so at the very end of that line, trump can pardon that person. If hes willing to go 100 degrees without limits, that may be where we end up. There is not a lot of choose your own adventures here, where a president doesnt care about who looks bad loses. I appreciate that. Your book which i thought was relevant when it came out gets more and more relevant each week. All right. Now, to the middle east, where iran is deciding how to respond to growing tensions with the United States. Iranian president Hassan Rouhani is reportedly giving a speech tomorrow, which may include pulling out of the Iran Nuclear Deal which up until now it had been trying to salvage. That speech would come one year to the day after President Trump announced that the United States was withdrawing from the agreement, accusing iran of violating the spirit of the pact. It comes just days after National Security adviser john bolton announced that the Aircraft Carrier uss abraham lyincoln and its Bomber Task Force were being sent to the persian gulf for what he called a number of troubling and isca latory indications and warnings by iran. We werent able to get more than that. Joining us is an iran director for the National Security counsel during the bush and obama administration, she is Vice President for the center for american progress. Kelly, a lot of my viewers of course will be familiar with you with the work we have done and talked about on north korea. With respect to iran, this was a deal arc long time in the making. Its one that President Trump campaigned on not liking. He lived up to the expectations. But at this point, what are the consequences of the United States not be party to this deal and iran suggesting its going to stop living up to the expectations that it was set to live up to . Well, ironically, i think President Trump has left himself with fewer options that he had than going into the administration. By withdrawing from the jcpoa at the beginning of the administration, he left himself very few diplomatic options. He is doing a sanctions campaign, which is splitting us from our allies and escalating military rhetoric and potentially backing us into an accidental engagement with the iranians. I think ironically, National Security adviser john bolton is doing his best to constrain the president s options with respect to iran. So heres the issue. The world, our allies were not with us on pulling out of the Iran Nuclear Deal. Most people who examine this sort of thing said, its not perfect. It wasnt perfect when it was signed. But its doing a lot of what it was established to do. The problem now is if iran pulls out, it loses its own allies. The europeans were on irans side, the deal should stay. If iran pulls out, is it go him to force everybody elses hands to impose sanctions on iran and the whole situation evolves ago en . Potentially. I think its possible the iranians dont completely pull out of the deal and dial back certain aspects with the international community. We will find out attorney general. Certainly, the president s approach thus for on iran has divided us quite aggressively from our allies at a time we need them the most to be on our side. Kelly, what does success look like in this for america . Well, success would be actually to get iran to be compliant with its nuclear agreement, which it has been in the past. It continues to be, actually. We will find out tomorrow if that continues to be the case. But that itself the best way forward is to get back into a diplomatic agreement with the iranians that constrains their Nuclear Weapons capability to the extent it was by president obama. Thats where we need to get back to. And the path that we are currently pursuing is getting us further from that goal, not closer. Thank you for joining me. Myanmar is effectively controlled by the military. They accused commanders of engaging in genocide on the Rohingya Muslims. The rohingya are refused citizenship and tend to live in extreme poverty. Myanmar says there are guerilla fighters among them, but they have burned their villages to the ground and rained around burned rohingyas. Men, women and children fled on foot crossing into neighboring bangladesh, where they now languish in refugee camps. Myanmar has repeatedly denied any accusations of mistreatment. This is a group that will eventually endorse in 2020. The Machinists Union will get advice from its members before making an endorsement after an early Hillary Clinton endorsement in 2016 led to criticism from Bernie Sanders supporters. Ali joins me, whats going on there . Reporter there was a lot of talk about that member policy, that will kick in further down the road as we parce through the candidates we have to choose from. We saw two different approaches. First we had Amy Klobuchar, who was here to pitch herself from a policy perspective. Going into deeper, talking about that Mental Health policy and Substance Abuse policy she introduced last week as well as the cost of prescription drugs. Then you compare that to corey booker. He spoke after her. He had a losty aspirational pitch. Listen to what he said here. You think the march on washington was about civil right. When Martin Luther king was killed. What was he doing. He was fighting for sanitation workers and workers rights. At the core of this country, this will be a nation if you are willing to work hard, you should have a job with dignity, a job that pays the rent. Reporter and you heard what corey booker was saying there, he used that dignity of work. It sounded similar to what we used to hear from Sherrod Brown when he was considering running in 2020. I have to say, corey booker was well received here today. There were a lot of people listening intently. He was someone that came away with a positive impression. Tomorrow there are five more people on the 2020 docket. We got Bernie Sanders, who has already spoken to this group before in las vegas. As well as tim ryan, seth moulton and a few others. President trump is searching for two people to fill two spots on the Federal Reserve board of governors after his first to choices failed to garner supports in the senate. Those include steven moore, an economic commentator, a distinguished fellow at the heritage foundation. Critics attacked Stephen Moore over what they said was his inaccurate policy and he faced negative headlines over back taxes and writings that critics said denigrated women. After it appeared moore did not have enough support to be confirmed, the president announced last week that moore was withdrawing his name from consideration. Steven moore joins me now. Steven, it has been a long time since you and i have talked. You and i have talked probably going back 20 years on tv. A bunch of stuff was unearth about you, what did you think in days gone by came up . I hi, ali, its great to have 20 years of networks over the years. Let me correct one thing on the outset, my predictions were wrong. If you look over the past ten years, youd have to say many few people have gotten the xi as right as i have. I wrote the trump economic plan. I was the one that said we could get the 3 growth with very little inflation and said the obama stimulus plan wouldnt work, which it clearly didnt. Bring the way, i was very right about what happened in december when the fed raised rates. This was one of the reasons i think the president selected me for this position. A lot of people did this, i was one of the first and loudest voices to say this is a big mistake. Its hurting the economy. That was controversial at the time. Three weeks later the fed had to admit people like me were right and reverse course and the economy has been on this tear. I love my record. I love the economy is as strong as it has been in 20 years. So i will not back down from this. Well look at the dow today. If you look at it over the last fen years since the recession. A lots of the gain in the dow came before donald trump became president. Thats true. Im not sure, there is a tenyear performance of the dow on the screen. You can see the bumpiest part is the part were in right now since 2018. Well, the markets up 35 since trump was elected. You are right, the dow is doing well. The problem is we had a weak recovery in the past seven years, thats one of the reasons people voted for change. Im disappointed i dont buy this i debated this before. I dont buy the stimulus plan didnt work. You cant prove a negative. If you cant prove the plan, where would we be . I will say every single year, the Obama White House said we would get 4 growth. We never came near that i am disappointed, i think i am a needed voice. I think the wall streets editorial on friday said it perfectly. I wasnt defeated and you know had to withdraw because i was wrong. I had to withdraw because i was right. There was a lot of people on the left that didnt want my ideas expressed. You know, thats a shame. Thats a board with ten, 11, or 12 people. Whats wrong with having somebody with a supply side perspective . I think they were worried because i might be per sidewaysable. What comments about women you made came back to bite you . I dont want to replay that. Ill simply say this, any woman that knows me, who has worked with me, for me over the years, scores and scores of women, not one of them has ever made a claim of any kind of misconduct or misbehavior on my part and most will say im an youp standing person. Anyone that knows me knows i am not a sexist or misogynist. Do i apologize for hume mar columns i wrote 20 years ago . I do. I think some are harsh. Im a flamboyant person. I can be politically correct. My divorce, some of the comments i made 20 years ago didnt have anything to do with whether i should be voicing my opinion on the economy on the fed. People that like you say that that kind of stuff i want to include you in that group. You and i have been friends since weve talked for many, many years. I guess the question is, that kind of stuff, even if you said it 20 years ago, these days have you to be able to explain what you meant. Thats true. What humor acceptable 20 years ago, probably know now shouldnt have been anyway. People need to be convinced somebody on the Federal Reserve board doesnt have a view of women in society. Ill simply say that you nknw those were humor columns. Some were funny, i apologize and there should be a statute of limitations on saying Different Things. Some of those were christmas letters we sent to family and friends meant to be humerus. I cant change what i said 20 years ago. Thats true. Most women that know me, almost all will say i am not a sex its. Did that hurt me . Thats one of the reasons. I will give you an exam, you are a fair minded person. What in the world does my divorce from nine years ago have to do with the Federal Reserve board nomination . Because i think i could have helped the economy being over at the fed. Lets talk about your letter, you wrote to the president. As you know, the last four years since the start of your campaign, i have been an advocate of your agenda and proud to play a small role to let that happen. I will continue to be a loud advocating voice of your policies, heres the question i have. I believe you are right. I believe you have been an advocate of the president s policies, perhaps you have influenced some of those policies, is that a job on the fed . Is it a body not advocating for the president or the president s policies, but is above that and removed from that . Ali, its a fair point. I did work for trump and do believe in most of the things he does. I would not have been a puppet for trump on the fed. Trumpanomics. You will see, i love the performance on the economy. I would have been an independent voice. I agree it is important for the press to be political or partisan. Again there are nine, ten, 11 votes on the Federal Reserve board, depending on how many of those seats are filled. One voice isnt going to stwa the entire board. Although i would have liked to have done that i think the fed is too tight. I think we could have gotten higher growth if the feds cut rates one or two more times. Let me ask you the Gold Standard. You and i didnt discuss this a lot back in the day. Yes. Its a little outside of even conservative main stream economics. The idea of returning to Gold Standards, where the amount of money you have is measured against a store of value, gold until a certain point when everybody decided that wasnt the case. Do you worry that positions like that place you outside the main stream enough to take you out of considerations, not the things that you consider took you out of the drawing. Is that the Gold Standard . No, i dont. I think the Gold Standard worked very well for us for many, many decade, if you remember, it was in early 1970s when Richard Nixon closed the gold window. What happened in the 70s . You remember we had waging inflation. That wrecked our economy for many, many years. It killed middle class families. Look, i dont abdicate that today. One of the things i i do abdicate. Not just look at gold, look at what direction the series of commodities are going in to determine whether inflation is too high or too low. One of the reasons i thought the last two rate hikes were wrong is Commodity Prices are falling. Thats a sign of deflation, not inflation. I didnt see any whiff of inflation out there. By the way, one other quick thing, ollie. Its been said i am a dove on inflation. I hate inflation. I think it can destroy an economy as in the 70s. I dont want deflation. I want stable prices. This was a fair interview. So i appreciate it. We have had many of them over the years so we take that into consideration when discussing these types of things, thank you. Stephen moore is an economist. He last week withdrew himself from consideration for a position on the Federal Reserve board. The dow is down 614 points or 2. 3 right now. We are at session lows on this market. This is as a result of the possibility of no deal with china on trade and an increase on tariffs come friday. Those negotiations are continuing through the week. But investors do not seem confident, at least in this moment, that we are going to come to a deal any time soon. I think mayor pete has work to do. I have been in touch with him about their strategy coming out. I think we have reverend al, our colleague and friend. We do a sirius xm show together. I think its important to highlight all candidates, particularly mayor pete, al sharpton is not africanamerican community. You have to cast a wider net. What people and voters care about in South Carolina might be different than in new york. In terms of the black vote is somewhat antiquated. Just like other communities, there are different parts of our Community Care about. So think of pete, you know, looking a lot of things, he had challenges in South Carolina, for sure. He acknowledges that, there are some things that didnt get pick up. He did go to the hcbcu. He did have roundtables with some of the activists and political leaders there. So he is trying to make inroads. I think he has a long way to go. Im just glad the campaign at least acknowledges that. They did hire jose morales, as their consistency outreach. They have a woman roe applewaite who does rapid response. They have a traveling press secretary who is africanamerican. Its not how black are you, but how black are your policies . I am eager to see what kind of policies he rolls out. Bernie sanders suffered for the idea he hadnt made that connection and he has been around so long s. Pete buttigiegs status something he needs to do, to build a relationship with africanamericans as you mentioned who are different in different places and will want to see Different Things from him . Yeah. Look, a week is an eternity of politics. You know this we are real early on in the process, more than a year out. There are a lot of the other candidates who have name recognition going for them. Which is great. Look, i would be curious to hear what africanamericans in south bend have to say. We talked about this before. Dr. Jason johnson did some recording on that for the root msnpc contributor. A lot of people had challenges with some of the decisions he made in his leadership. Thats not to say he cant have room for growth and connect with voters on this trail, but they have to cast a wider net. Look, ive never been with a group of black people and at 6 00 we say, oh, its time to go to our naacp meetings. Some of the older organizations are not the only path into the community. So my guess is, because of the way we have 2020 elections coming up, we dont want markets to tarng because of that, they will come to an agreement at some point, it probably will not resolve the deep underlying conflict between these two countries.
