Evidence. Democrats say they need that evidence to decide, quote, whether to approve articles of impeachment with respect to the president or any other administration official. Chairman nadler says if the Justice Department acts in good faith to provide access to muellers full report, he could still postpone contempt proceedings. So far theres been no indication the attorney general will be reversing course. Up til now, the president has been relentless on twitter, attacking democrats and their investigations, repeating no collusion, no conspiracy, no obstruction. Now hes also reversing course on supporting the idea of Robert Mueller answering questions from congress. Remember, just friday he said that would be up to ag barr. Now he says he is against it, setting up what could be a very tense confrontation with democrats over separation of powers and just how far president ial authority can go. To talk about this, we start with hans nichols at the white house and politico reporter melanie san own. We are looking at a biggest ka ladies and gentlemen of the battle between the president and democrats. Likely the Judiciary Committee will vote to approve the resolution. What happens after that, what kind of time line are we looking at . After that, the issue goes to the floor of the house at a date to be determined by nancy pelosi. Ultimately it is up to courts to decide. That could take months if not years to resolve as we saw in 2012 when Congress Held then attorney general eric holder over fast and furious documents. This thing could be dragged out into 2020. Might not be resolved until after the election, a real concern for democrats, and putting a crimp invest gave plans. They were planning to use this to serve as a road map for possible impeachment proceedings. Now they have to wait to see if they can get their hands on all of the underlying material and go from there. It was interesting, melody, to see hugh hewitt, saying in attacking barr, democrats hurt themselves. Heres what he writes. Quote. The attorney general is widely respected on the center right as a scholar and principled man, so, too, does he boast support from those that trusted my to find no collusion where none existed . The beltway establishment gop. In trashing barr, just as they crashed now Justice Brett kavanaugh, they unfurled the pirate flag. It isnt about opposing trump, it is about opposing anyone with their ideas. You heard the fight that william barr is not just distracting could hurt them in the eyes of voters. It came up last week among judiciary democrats. Theyre wrestling with how far to go after william barr. On one hand, they think it is a way to throw bone to liberal base because theyre not ready to go after trump yet with impeachment, this is a way to keep the base energized, show theyre holding the administration accountable, but on the other hand theres a risk of backlash, looking like theyre overreaching. That can make it especially difficult for democrats further down the line if they decide to go after trump. These are sorts of things that democrats are struggling with, and they will be having to answer questions in the coming weeks. Hans, theres an issue of special counsel muellers testimony. Over the weekend, house judiciary chairman said theyre aiming to bring mueller in may 15th. Trump is now objecting to the testimony. What happened between friday when he was leaving that decision to barr or before that when he said it was fine for him to testify and when he tweeted, quote, bob mueller should not testify. No redoes f for the dems. Youre asking why the president appeared to change his mind. I dont have great intel on that. I would give you a sense that you heard democrats salivating, talking how they were looking forward to how they wanted hear directly from Robert Mueller. There may have been acknowledgment by the president it could be bad for him politically, thats why he reversed his outsourcing response on mueller. Leave it up to bob mueller, that was always the official line to say william barr or barr should not allow mueller to testify, that bob mueller should not testify. What you saw in that shift is part of the overall antagonistic approach by the administration to congress. You see it on tax returns and see it on what parts of the Mueller Investigation should be allowed. Most recently heard from department of justice saying some of it should be able to be seen by Committee Democrats as an invitation. The departments letter invites Committee Staff to come to the Department Wednesday to discuss a mutually acceptable accommodation. The Department Remains willing to accommodate congress legitimate leads but must do so consistent with the law. Chris, thats an indication that the White House Department of justice plan to fight this every step of the way, want to litigate small stuff. It is clear that the president doesnt want to have all this information out there. He likes the way the narrative was set initially by bill barr. Hans nichols, thanks. Joining me, elliot williams, former Deputy Assistant attorney general for legislative affairs at the Justice Department. Good to see you, elliott. There are reports that the president s about face is a retaliation for other moves by democrats. Whatever the reason, we dont know how much longer barr will still have a say over whether mueller can testify. Even though he is still officially special counsel, once everything is wrapped up and there are various reports that it probably will happen this month, the equation changes. He no longer works for the Justice Department. And i guess the question becomes could the white house try to stop him by other means, potentially through the courts. Yes, they can, and here is why. Even though he would be a private citizen, he is still the individual who oversaw what is Justice Department work product. It would be incredibly hard to say because the Justice Department is in possession of this work, the guy that worked on it is free to testify on it, even if he is a private citizen. Pulling back, this isnt just about the particulars of when do we let mueller testify and whats valuable, what works. This is a systemic attempt by the administration, going back to far before the report to undermine congress as an investigative body. And hans talked about this in some of his comments earlier. The president made clear he does not regard congress as a coordinate branch of government, theyre in service of it. Even the rhetoric that congress, weve already been investigated and now congress cant continue it doesnt account for the fact that congress is a different body than the special counsel. So we need to pull the camera back a bit and talk about whats going on here, and it is not just the particulars of this case, it is a much bigger disrespect for separation of powers that were seeing from the president and top aides. Then you have that potential contempt charge against the attorney general. I want to read something written in the washington post. A contempt citation against barr would selt up a lengthy battle. The issue could take months or years to resolve as was the case in 2012 when the republican led house sued eric holder over documents related to fast and furious investigation. How does congress enforce it, do they assume this will be long, drawn out and theyre staking their claim . Likely to, having served under eric holder and legislative affairs, i know those documents got turned over through the natural process of accommodation, whereby the parties under normal circumstances worked out their differences and disagreements as branches of government which we dont have here. What they do is go to the courts, and it will take a long time to sort out. You have to have parties that respect the fundamental process and one of them does not i dont think i am making a partisan point about the president of the United States, it is fact based on statements on the record already. Yes, this will take a long time, months if not years to sort out and were heading into a big election season. That shouldnt be relevant, but i think thats dictating a lot of behavior from the president right now. In the last 30 seconds, i want to ask you about the letter you signed with hundreds of former federal prosecutors saying the conduct as detailed by special counsel would result in multiple felony charges for obstruction of justice if it wasnt for the office of Legal Counsel policy that prohibits a sitting president from being indicted. Here is part of the statement. As former federal prosecutors, we recognize that prosecuting obstruction of justice cases is critical. Unchecked obstruction that goes unpunished puts our system of justice at risk. Realistically, what zooido you k could happen . In terms of how can you make this as something in the view of all of you doesnt set a horrible precedent . The horrible precedent has been already set by the president of the United States. The report is clear either a future prosecutor can go after the president or congress can. But again, this was misconduct and language was clear, regardless whether an individual could be charged or convicted of conduct, it is still chargeable misconduct and incredibly serious. Crimes like obstruction of justice go to the heart of our criminal justice system. If individuals are allowed to get away with thwarting investigations, again, we as a body that cares about Public Safety or nation that cares about Public Safety cant be safe. Thats a little circular, but i want to make clear how serious obstruction of justice and witness tampering are, they thwart one of the Core Functions of safe and civil society. I look at the language carol fully on a personal note, saying the president isnt guilty of a crime or something, but it is chargeable conduct. We are all going back to folks that served eisenhower that signed that letter, great diversity of people that signed and we feel strongly about whats best for the nation. The president s former lawyer and his former fixer Michael Cohen started a sentence today, after pleading to hush money payments on trumps behalf during the 2016 election. Lanny davis gave us a statement saying michael may be sentenced within the walls of a federal correctional institution, but the truth has no walls. Michael will continue to be accessible to congress and to federal, state, local law enforcement. Of that i am certain. Before heading to prison, cohen said himself theres still much to be told. I hope that when i rejoin my family and friends that the country will be in a place without xenophobia, injustice, analy and lies at the helm of the country. There remains much to be told. Republicans have dealt what could be a huge set back to efforts to expand Voting Rights in florida. Last fall youll remember voters approved a Ballot Initiative known as amendment 4. That restored a convicted felons right to vote after they complete all terms of the sentence, including parole and probation. It does not apply to people convicted of murder or sexual offenses. Now the Republican Legislature passed a bill that could mean hundreds of thousands of those voters will essentially be denied that newly won right because the bill requires felons to payback all Court Ordered fines, fees, and restitutions before their eligibility to vote is restored. The legislation heads to the republican governor, ron desantis, who has not said whether he will sign it. Republicans say the restrictions clarify how the initiative should be put in practice. Opponents say it is no more than Voter Suppression, could effectively reinstate the poll tax, which was outlawed by the 24th amendment to the constitution. Joining us to take a closer look, desmond meade, who led the fight for amendment 4 as president of the florida rights coalition. Good to see you. Convicted felons that qualify were beginning being able to register to vote in january, including you, one of many that registered so far. What can happen if the governor signs this legislation . Well, kris, first of all, thank you for having me on the show this afternoon. I would like to start by saying whats lost in a lot of the narrative is that at the heart of what amendment 4 set out to accomplish was that we removed 150 year lifetime ban from felon voting in florida. Thats what it set out to do. That remains intact, in spite of legislation that recently come out of the florida house, what we know in florida, a person convicted of a felony offense who no longer, will no longer face lifetime ban from voting. So we accomplished that. That victory is secure and intact. What we know is that sentencing project estimated in 2016 alone nearly a million and a half floridians completed felony sentences but couldnt vote. Thats about 9. 2 of the voting population. 18 of africanamerican voting population. Do you see this move as Voter Suppression . Well, thats a very broad question to ask, kris. To be totally honest with you, we were opposed to any implement of legislation and still opposed to implementing legislation. However, we knew that legislation inevitable. So we actually worked with republican legislators to try to clean up the legislation that they introduced because when they first introduced this legislation, it expanded financial obligations that a returning citizen would have to face, so we worked diligently with Republican Legislature and there are some gems in the legislation that gives us hope. For instance, now a judge talk about this, what happened now. It has a lot of people up in arms. People that fought so hard to get that bill passed and now theyre adding additional road blocks arguably. Look, isnt the reality if you are coming out of prison, if you are a convicted felon, youre not rolling in cash, right . Chances are youre poor. Yes. Anything that says in order to vote, in order to take advantage of this new legislation you have to pay for largely eliminates a swathe of the population. It has the effect of nullifying it. It has the potential effect, kris, because within this legislation is provisions that would allow a judge to weigh the financial obligations and or convert them to Community Service hours. So that is a benefit in which we will be able to assist the population that would be impacted by the legislation and allow them to register to vote. Thats very important to know because at the end of the day, at the heart of the matter, the lifetime ban is removed. So every citizen, every returning citizen will be able to register to vote. The legislation gives us hurdles that we have to navigate, but all is not lost. Theres no gloom and doom in our camp. Florida rights restoration coalition, were excited about getting ready to go out there under the new law, if the governor does in fact sign this, and register these people to vote. You talking about at least 700,000 returning citizens who are not impacted by the legislation. That in a state where a governor race was decided by 30,000, congressional race decided by 15,000 votes, president ial races decided by 100,000. We have 700,000 returning citizens that would not be impacted by this legislation, and the remaining 700,000, theres a pathway to relief for those individuals, so were looking at the Silver Lining in all this and moving forward. We would love to have bipartisan legislation. We would have loved if there was no legislation at all. But were working with what we have. This is an issue that impacts people from all walks of life, all political persuasions. Were going to make voting exciting again in florida. Good to see you. Thank you so much for being with us. Kamala harris addressed that in detroit at an naacp dinner, arguing the obsession over electability could end up leaving out certain groups of voters such as black voters in the midwest. The conversation too often suggests certain voters will only vote for certain candidates regardless of whether their ideas will lift up all our families. And it is short sided. Its wrong and the voters deserve better. Senator harris is still in michigan, focusing on education, one of her campaigns top issues. Earlier she was at an Elementary School in dearborn, just outside detroit. Shes expected to participate in a round table with teachers this afternoon. Vaughn hilliard is traveling with the harris campaign. So michigan is an interesting place to have the discussion about women candidates because Hillary Clinton lost to donald trump there, 47. 5 to 47. 27 . Less than a quarter percentage point. But he gets all 16 electoral votes. I wonder what youre hearing from candidate harris about this. Reporter good afternoon, kris. I dont know if this group we were with, fourth graders was necessarily the best group to ask about voting. But to give you an idea in dearborn, michigan, this is in the same county as detroit. This is wayne county. What you saw back in 2016 was a drop off in voter turnout, despite an increase overall across the state. One of the things that Kamala Harris is contending that i may be a woman, may be a woman of color, maybe thats what we need in wayne county. This is a county that saw that drop off. Shes contending it is not so much about getting the old time democrats that voted for donald trump to come on board but it is about bringing out democratic voters that didnt show up in 2016, and shes contending she is that candidate that is able to go and do that. I want to play you another sound bite, her address to the detroit naacp which she took on that question of what kind of candidate it takes in the midwest to win. There has been a lot of conversation by pundits about the electability, who can speak to the midwest. But when they say that, they usually put the midwest in a simplistic box and a narrow narrative. And too often their definition of the midwest leaves people out. It leaves out people in this room who helped build cities like detroit. Reporter kris, it was our friends at the New York Times put it well in an article this weekend. In this field, who has not lost an election in their career, the women. Who have lost elections, the men who often are looped into the conversation about being potentially good candidates for the midwest. The joe bidens, bernie sanders, pete buttigiegs. Kamala harris is the candidate that could win detroit and milwaukee in wisconsin. Thank you so much. Vaughn hilliard. Much appreciated. Kamala harris is one of six women running, mentioned that article in New York Times. In addition to talking about how the women have won, it goes on to point out how several of them have won in red areas or purple areas. Kristin gillibrand flipped 18 new york counties in 2018 that voted for trump in 2016. Joining me to talk about this, amy allison, president of democracy in color, host of democracy in color podcast and founder of she the people. Also with us, emily sh rock, president of an organization that works to elect female candidates. Amy, is there a double standard for women, the old saying, if youre tough enough to be a ceo or president , youre probably not likeable enough to get elected. The whole electability conversation has me stumped. Democrats havent supported a white guy nationally for president since the 1990s, it doesnt speak to the base. Republicans can make an argument about white men being a case for electability because it speaks to the base, but the new american majority, multi racial Progressive Coalition is how barack obama was elected. Electability the way it is talked about now is to me a function of fear, that is democrats that are confused or have amnesia about the way to beat republicans and the way to face trump. I agree, i think it is not just the candidate but it is in what the candidate will do, how they inspire the multi racial group, particularly women of color, key part of the base, what are they doing, how are they organizing in places Like Washington and michigan. Stephanie, in the early primary states, some voters point to Hillary Clinton and her Electoral College loss making voters who want trump gone nervous, right . But to amys point, no democrat said after gore or kerry lost, we cant nominate a white man again, right . Thats exactly right. It is this electability it is outrageous. Were not good at predicting anyway. I dont know why any of us are trying to do that. Amy is right. We have a new electorate thats expanding. Were looking at a 2020 electorate that could be historic in size. Why . Because it will be driven by women voters in particular. I think the other point is important. This fear piece. Hillary clinton did win popular vote by 3 million votes. And if not for the Electoral College in three states, she would be president today. That was not the problem. We have never thought that a man shouldnt run again because a man lost. That makes no sense. Talking about michigan, i mean, michigan turned around in 2018 and elected Gretchen Whitmer as governor. Women as secretary of state and attorney general. Two new women members of congress, three excuse me, in michigan. This piece of why were trying to put out there what electability is, lets let the Voters Decide who best fits their vision and desire for the future of this country. Lets let this play out. New york times oped we should say written by claire bon potter, history professor at the new school, points out that the likeability thing is a concept largely created by men as a means to achieve success, but she suggests it can be changed. What if women no longer fit a standard not meant for them and focus on redefining what like ability might look like, not someone you want to get a beer with, but say someone you can trust to do the work. I guess the question is, amy, is that realistic and how do you achieve that . Not only is it realistic, it is how the white house will be won in 2020. I think that oped writer was right, we need to redefine likeability. I give you an example. A couple weeks ago, my organization she the people hosted a president ial forum with 8 candidates. Senator Elizabeth Warren walked into a room with 2,000 women of color from many important swing states that shes going to be facing other candidates in a heated primary to a lukewarm reception. And in 20 minutes, i saw her build that kind of trust and connection with that at home that gave her campaign a huge lift and gave her a platform to go deeply into issues like black Maternal Health that are so critical to inspiring black women as part of the coalition shes building. I saw in 20 minutes that she walked out with a huge standing ovation. Because it is so early in the cycle, and most americans havent had opportunity to see the president ial candidates in a debate format will be able to build that trust, understand who we believe will carry the issues, et cetera, distinguish in a crowded field. It is still early. I think electability needs to be how can those candidates build trust with the core part of the base, instead of chasing after people that voted for trump last time, which i think is a losing proposition, or ignoring the base of the party which is half people of color, a quarter africanamerican, instead leaning deeply in and establishing likeability and trust with those populations, particularly women of color i think is key to victory. Only a minute left, stephanie, im sorry. Im going to cut you short. This will be the first test, first time theyre paying attention. Trump stalked Hillary Clinton on the stage, certainly didnt do him. Do these women candidates need to have discussions internally based on where we are as a country, about how to straddle the line just before the debates, how tough can i be, how strong can i look. How do i have to come off. These women, particularly the four United States senators who are doing so well in the president ial primary, theyve already done this. They have won and won over and over again for attorney general, for u. S. Senate, for d. A. , they have been up against some tough competition in their history and have all done well. This is not their first rodeo. They know how to handle themselves. I think what america will see are some really fabulous leaders to start defining what new leadership in this country can look like, and it is going to be led by women because frankly in battleground districts in 2018, the electorate was 54 women. Just think about that. If we have that in 2020, were going to be in a great position. As amy said, led for democrats, africanamerican women that are turning out, ready to lead the way. Right. From a technological perspective, what are the first steps and can they be taken between now and 2020 . Upgrading machines is the number one thing. What i like about the report, despite how hard it is, is that it makes it i think, unavoidable now. Theres no sugar coating it. We can reverse the worst trends were looking at. I think its going to make people Pay Attention and thats important. You look at the worst trends but say we have to get to the root drivers. Were seeing the top of the iceberg, species at risk of extinction but when you look at the bottom of the iceberg whats at the root problem here is our values and beliefs that we can have an infinitely growing economy without considering that the Natural World out there has its limits and we can make decisions without considering the social and environmental impacts of them. Theyre not the only stocks going down. Those are the ones we need to be watching too. Theres a huge political opponent of this, we saw it with the Climate Change accord from paris and the withdraw from the Climate Change accord, thats one example of so many. As individuals look at this beyond the political pressure they can bring to bear, what can any individual do about this . Theres a lot we can do. We can ask ourselves hard questions about how much do we need in our lives in terms of how much we consume, what choice we make and decisions we support. We may be in agreement with the large global goals and know that nature is important but people forget because you get your food at the Grocery Store every day, our life depends on the land and species around us. And even more important for vulnerable communities at the forefront of Climate Change. Everybody can make a difference in terms of how they consume, what they support as citizens, how they vote for sure. And understand that these are scientifically extremely well supported facts and that we need to change not just what were doing, but we need to change the very way in which we approach, i think, how business and society operate and it will impact everybodys well being, our livelihoods, our economies. I think its a call to action and a wakeup call. We were talking in the great and i have a lot of great nieces and nephews who talk a lot about this, and talk about whats happening in their College Communities they do things a lot differently than i did when i was in college. They seem more conscious of everything from plastics to straws, packaging, you can go on and on. But is that a minority . Are you optimistic about the future . Do you think younger generations are getting it . I think younger generations get it. Especially with issue about the Climate Crisis it will affect them disproportionately. Theyre ready for the change and what we need to do is get the rest of the political establishment and the political Decision Making processes to take into account the real larger economy in which humans live.
