Attorneys office in manhattan gathered mr. Trumps participation in the transaction. Back in april, the president denied knowing of the payments made by his personal attorney and a month later he walked that back telling fox news that he learned about the hush money payments later on. Later on i knew, later on. You have to understand, what he did and they were not taking out of campaign finance. Thats a big thing. Did they come out of the campaign . They did not come out of the campaign. They came from me. All right, joining me now, one of the reporters who broke that story, nicole hahn, the wall street journal had been out on this story from the beginning. This story is 76 news cycles ago. Bring us up to speed on whats new in this. Michael cohen in august, the fixer and personal attorney of trump pleaded guilty in federal court to among other Things Campaign finance violations. He got up in open court and he i am pli he said i did these orders because of president elect which at the time was trump. In direct contradiction to the story the president had for a long time and even when he finally fessed up to knowing about it. He never suggested that this was at his hand or his direction. Thats right. The first story we published was two years ago. We revealed the payment of mcdougal. Since then it has been a pattern of denials from whether trump himself or his aids or Rudy Giuliani or whoever else. Trump was not involved in drekidre directing these payments and it was cohen did it on his own. Our reporting shows thats not true. Is there legal consequence to the new knowledge that we have or does it confirm Many Americans knew already . See, the Justice Department had sort of adhered to guidelines that you cannot indict to a sitting president , i think there are questions of intent when it comes to charging someone of the campaign violation. Does your reporting speak to that intent. When the president is found to have his hand in the cookie jar, he says someone else put it there and he did not know it was there. Did you have errorireporting sp the idea that the president was involved in the formation of these schemes. Well leave it to the prosecutors whether he knew at the time what he did was wrong or illegal. The fact that the democrats have taken over the house is an interesting that may also get investigated. We know federal prosecutors investigation are ongoing and looking at trump organizations and other things thats involved with michael cohen. I want to read something from the article, this is about david pecker, a lot of people know as the national inquire. Mr. Peckers company paid 150,000 to the model Karen Mcdougal to keep her from speaking publicly about it. Mr. Trump thanked mr. Pecker. We saw in the indictment, we saw that discussion. Now you got this from a different angle that the president knew and thanked david pecker from. When President Trump or when donald trump found out about the mcdougal allegation, he called mr. Pecker and says please take care of this. Pecker promises to do so. They end up paying her. During the transition at a meeting at trump tower, trump thanked pecker for taking care of it. Nicole, thanks to you and the team for your reporting. I know when it came out, many did not know how deep it went and turns out it is out right to the man, the president of the United States. President trump is rebuffing his calling Matthew Whitacre to recuse himself. Democrats are concerned given whitacres comment on the muellers investigation like these. The truth is there were no collusion with the russians in the campaign. There was interference by the russians into the election. Thats not the collusion of the campaign. Thats where the left seems to be combining those two issues. The last thing they want right now is the truth to come out and the fact that there is not a single piece of evidence that demonstrates the Trump Campaign had any illegal or even improper relationship with the russians. It is that simple. All right, with me now is former u. S. Congressman elizabe elizabeth holton, of her new book the case for impeaching trump. Thanks both of you for being here. The article opinion of constitutionalty of appointing whitacre. There were lies that the president said he did not no whitacre is. More importantly whats the effect of the fact that this guy has had opinions on the Mueller Investigation and opinions on collusion and has suggested ways to end the Mueller Investigation including starting a fund. To a lot of people that seem to prejudice him, does it matter . Sure it matters. We have the image of justice, blindfolded, mystical figure of the scale, blindfolded so you dont weigh in on the one side or the other without the facts. Here you have an attorney general acting attorney general who has obviously been put at the spot to squash the muller investigation. He has been put in there and hes got no qualifications to turn general of the United States, reduce marcus is a fine opinion writer for tthe Washington Post called him a crack pot. If you read his legal opinions, theyre off the wall. He has no business being there at all. Now he said he is opposed to this investigation, he should not be controlling it. Trank frankly he needs to resign and should not be there from the beginning. Eliot, you and i were talking about from the moment it happened, what do you make of it now, this administration had made enough mistakes that they must have thought it through figuring they get whitacre into 210 days or whatever it is. Do you think they knew theyre going to get into this thing where he and the presiden president this is hot water. I have a hard time believing these are actually errors. He wants to put people that are loyal to him and close to him in these high positions. What i found striking and i have not seen that particular clip that you showed at the againing of the segment was when he starts referring the argument from the left. Hes politicizing criticism of the mueller problem. We saw the Supreme Court nominee recently for the first time announcing nominees jumping in the the political fray and not leading into senators and the people or the puns on the television. Thats unfortunate. What you are seeing is someone who are political put in charge or if not a Political Agency carries out its work out regards of policies. You cant take it away of americans having the political opinions. This is the whole thing. The question of recuse as a whowal does not bar him. The impunity is enough to make someone stepping out of a case and legal ethics of the right and left have said this over and over again. This is where the American People need to rise up and talk out and ask for change. This is what happened atwat at watergate. President nixon said i am going to control who investigates me and who prosecutes me and the special prosecutor, you are out. Thats basically whats happening right here. When there was talk about removing jeff sessions, there were a whole bunch of republican senators said, a lot fewer now. Right, but the American People will make them find their voice because it is the American People that forced congress to act when nixon fired the special pr prosecutor. Trump is trying to be cute about it. He does not want to fire mueller but he wants to stop the investigation and he has put someone into that. Thats an outrage. If we allow that to happen then the United States of america does the idea that the democrats will control the house of representatives make a difference here. If i can jump in, the congressman is the one person who has engaged this. It is a beautiful thing in our divided government, congress can actually oversees questions whether the appointments are legal or an individual is behaving unethically. The president handle congress, the new democratic majority their first over sight matter, should the individual be attorney general. You can bet yourself that within months of this start of a new congress, hell be up there testifying and request the documents and emails and find out why these individuals at the top of the Justice Department and whether he should be. Hes completely right. We should not have to wait months. The American People needs to speneedto speak out now. Are we some country that the president has characterize wid with. We saw what happens in watergate. If the American People speak out, they can m did not want to investigate president nixon. They did not. The American People forced them. The American People can force the action here, too. Thank you both of you. Three days after the polls closed, the votes are still being counted. Several key races are being undecided. Florida, u. S. Senate and governor races, the georgia governor races and the arizona u. S. senate race. Right now a lawsuit filed by rick scotts senate campaign. Hes a governor running for governor against the Broward County over the ballots. Well give you news on that as it breaks. For President Trump, before he left the white house, he weighed in on the Florida Senate race between bill nelson and republican governor rick scott accusing officials in one county of fraud. If you look at Broward County, they have had a horrible history. If you look at the person and in this case a woman involved, she has had a horrible history and all of a sudden theyre finding votes out of nowhere and rick scott who won by, you know, by a constable margin and every couple of hours, it goes down a little bit. People need to look at it cautiously. The president tweeted we have all seen the incompetence in broward and palm beach for years. Here we go again. I will not sit by while unethical liberals trying to steal the election from the great people of florida. There is a lot in there. Senator bill nelson on the less. He says it is not appropriate for the government suggests that hes going to use his power to prevent the countdoing of ballo that have been cast. Unofficial results in florida are expected to be turned over to the s eecretary of state by noon tomorrow. Andrew gillum says hell be open to a recount. If the ruesults show the candidates are separated by half a percent or less, there will be a machine recount or a quarter or less, there will be a hand recount. Thats a lot of information and numbers. For me, it gets better if steve cornacki is involved. Giver us the late give us the latest of these. Desantis is by four tenth 49. It is close but is it close to be a reverse machine recount that seems unloo i cikely and m the attention is on this one, it is on the senate race. It is closed now to 15,000 votes. Thats. 19 . Now youre inside the. 25 . Thats manual recount here territory. There are a lot of moving parts in the senate race. There is still provisional ballots to be recounted. We expect theyll favor nelson a little bit. That could ease into it more. We expect by tomorrow this thing will tighten further and enough for nelson to take the lead. That seems unloo i cikely. There is the issue in Broward County, huge democratic area and nelson winning. Look at the margin democrats there. One thing that have been found, there were 25,000 more votes cast for governor than for senate in this hugely democratic county. Which seems unusual. You dont see anything like that in any other county in florida and people are asking why. Nelsons campaign is claiming there is some kind of machine error. The other possibility here is the design of the ballot. The counties design their own ballots. This is what they choose to do in broward. Lengthy list of instructions. Here is the senate race at the bottom of it. Check out the governor race, prominent and top of the middle column and big spacing between all those candidates. Your eyes are drawn here, did a certain share of the voters there. 3 county wide. Check off all of this stuff and miss the house race. There were small part of the county where there was not a house race and underneath was just the senate race here. Thats where the nonvote of the senate race really exploded. That kind of point to the strong possibility of a ballot design here steve cornacki, thank you for that. She joins us now, a lot has been going on now and there is a hearing underway. Where do we stand . Reporter so ali, i want to circle back not from anything that steve was saying but something you and i have been talking about. This is another one thatll come in a few minutes. I spoke with the Florida Department of Law Enforcement a moment ago. They are not actively investigating anything right now. They spoke with the department of state, theyll investigate in case of criminal activity or fraud but they have not seen any of those right now. That becomes important when you consider the things that rick scott have been saying that hes alleging quotes like fraud. Thats not whats being seen right now. Of course if the department of Law Enforcement here does end up seeing that and the secretary of States Office end up seeing that then theyll take action. Theyre not right now. Thats an important update that we have. On the other hand, rick scott held a call with some donors and he was extremely disappointed with senator bill nelson and accusing him hiring Hillary Clintons lawyer. Which he is a lawyer that has done work for hillary clinton. He tries to make this is a bipartisan as democrats try to say that hes stealing the election. Do we have some news because thats the next milestone deadline in. Reporter well have news on saturday. It is definitely going to be a long weekend but it is going to be a long week plus long process. Saturday is really just the first step in this. Thats what well actually trigger this recount when all of these votes that we are talking about in broward and palm beach and everywhere else comes back with their final canvassing totals. Thats the marvgins you are talking about. The. 5 will be the first ruound of the recount. Thats going to apply in both of these races. We know in the Florida Senate race that both of these sides have geared up for this recount. Andr Andrew Gillum urges every vote should be recounted. He did concede on tuesday night. Thats a notable thing. Reporte. Thanks for your great reporting on this in tallahassee for us. Lets go to georgia where the battle of the races are getting intense. Brian kemp had over 50 of the vote. Democrats, stacey abrams, says there could be enough uncounted vote to bring kemp below the 50 mark which would trigger a runoff election. President trump weighed in on this. Kemp won a great race and won and it is time to move on. Steve is back. Steve cornacki is going to take a look at georgia for us. A couple of pieces for us here. Like you said kemp sitting at 50. 3. If that number falls below 50. Now you are in runoff territory. There are 21,000 provisional ballots around the state. The provisional ballots tend to wait overwhelmingly democrats. Even if you give abrams that probably knocks kemp down to 50point. The other issue is the abrams camp is saying there are some absentee ballots. They dont know how many. They still think there are a lot of absentee ballots. It is unclear how many there actually are. They for it to be a lot and get abrams under that and there are some potential lawsuits involving. Dorothy county, a county of large africanamerican population. You can see she got 70 of the votes here and what democrats are alleging here are there are voters who did not give they were given the full range of options and possibilities with that that they deserved. There could be lawsuits there and elsewhere and thats the other possibility in georgia everyone if even if it does not go to the run off and the possibility being held in court for a while. I appreciate that. It is friday and this is going on and you are here to help us make sense of what these tight races are about. Nbc Morgan Radford is following this from atlanta. Morgan. Reporter it has been interesting because a lot of what steve said we are hearing from voters and Campaign Officials here on the ground. The question here is one, what happens next . Two, what is the effect on voters . Ter vote votersin terms of what happens next. Theyll not have their votes certified until monday or tuesday. And again that confirms a lot of what the abrams team have. Secondly, the effect it had not only in the voters in realtime when it comes to casting their ballots but what has done to their moral. Take a listen. I went to my lunch break at noon and i was told that my wait is going to be long and after work, i was told it is going to be at about two hours. I was told the wait is anywhere from three to four hours. Reporter and then what happened . Then i knew that i could not vote. There has been tactics put in place where people are affected gives me pause. It is reminiscent of what we are facing. Reporter you hear the voters here who are questioning their democratic process especially here in georgia and especially in the africanamerican community. The second woman, shes a student at boston college, she says when she did not get the absentee ballot she applied for, she called several times and ultimately was not able to vote. It comes down to those provision that will and absentee ballots that steve mentioned and thats why the abrams team today announcing theyll file a second Legal Process based purely on those absentee ballots. Thats in addition to those previous process that they declared yesterday. That was about mailin ballots by the hurricane. The issues of difficulty of people voting as it affects populations where there are a lot of africanamericans is a key and differentiating issues for us, for georgia. Morgan radford if atlantn atlan. I want to head to georgia. The final vote count is not inuit. Wait until you hear how long it will take. Hundreds of thousands of mailin ballots still have not been counted. A Court Hearing is scheduled later today on a lawsuit filed by republican parties. Theyre challenging two of the states in how they deal with signature problems of mailin ballots. It has switched 24 hours ago. Last night cinema jumped in the lead because of massive votes of Maricopa County. Big batches of votes came in strongly for sinema. A little more than 8,000 votes right now. Thats her advantage. There are still and 83 right there. There are still about 450,000 votes give or take to be counted and added all of updates. Well expect more tonight on maricopa. That one will probably favor sinema and what republicans are saying there will be a few more days of this after tonight. T republicans say they think those will favor them. It looks like a situation here where sinema can build up a little bit of a pad here of the next wave of votes coming in. The next question is can mcsally run up scothe score. Steve cornacki, i think i am going to give you a break because you helped us with these races that we are covering so carefully. National correspondent, steve cornacki. I want to bring in vaughan hilliard, he happens to be here now. One, i dont get it. I dont get why it is 2018. Why cant people vote and the vote be counted . Whats the problem here . Why do we have hundreds of thousands ballots not counted . More than 80 of voters get mailin ballots. Most people mail it back. There are hundreds of thousands and thats what we are going through right now that turned them in, friday through monday. They have to sign on their ballots of their own signature. The issue is after the fact that counties are going ballot by ballot to determine if the signature is authentic and matches record and the voters have with the dmv. So theyre literally opening the envelopes and looking at the ballots. Exactly. It is not until sunday ormond or tuesday or wednesday or thursday that well be getting results on the ballots that were turned in as steve was mentioning on natural election day. What are they suing about . If this comes down to a couple thousand votes. This is where it is going to essentially, the Republican Party is laying out here early before we get to that point and establishing this in the court. And so what the Republican Party is contending should the county to have the opportunity to go back and check the record. Other counties in the state dont do that. What Maricopa County are saying is we should have the opportunity to do phone calls, it is you even though the signature does not match. Maricopa is contending we should have the opportunity. Republican party says thats not across the board. It is varying in the weeds. Those 5600 votes may not be counted. I said to somebody the other day, people have to remember there are no federal elections in america. There are thousands of county elections in america. These counties in the same state dont do it the same way. Thanks for your coverage on this. Theyre trying to flood our country. President trump celebrating his administration newest measure that denies asylum to any my graigrant entering our cy leg illegally. The new restrictions will apply for 90 days. Ans an Asylum Seeker is not the same as an immigrant. An sa an it is granted to people who are persecuted on account of race, religion or nationally or membership of a particular social group or political opinion. These are not people who say they can go back to their home countries, it is not just a choice for decades. Immigration law for the United States requires migrants be allowed the seek a asylum regardless of whether they enter the United States legally. Their status of the United States was not a determining point. To add to that, take a look at this global mark. A Asylum Seeker are permitted to make a claim regardless of where they enter a countrys territory. 148 countries signed this law. Another thing, the asylum case that the United States has denied and gone up for five years in a row. Keep in mind, the percent of those who asked for a asylum who are denied is 61. 8 . Fewer than a third and fewer than 30 of anybody who applied for the asylum is granted. The system is not broken. When you look for a asylum. It is an official process, you have to talk to somebody and immigration officials to get it. Jonesing me n joining me now raul reyes. There are all sorts of people who are suing about this. Right, thats their starting point. You see they have multiple grounds on which they base their lawsuit. The aclu is basing it on the grou grounds that violates the administrator act because theyre not allowing enough time for these measures. The problem of the administration is theyre asserting this very broad attempt at president ial power. It is explicitly in the statues that you can be a Asylum Seeker whether or not you happen to reach a port of entry. The only requirement aside from facing potential persecution at home is that you are physically present in the United States. Add to that, we have a tremendous lodgistic cal problem. Right now in places like along the texas border are designated ports of entry, our government officials are turning people away and telling them to come back the next day and take the process and wait. So we have a horrendous backlog already there. Raul, i want to show your viewers picture of the press conference thats taken place in texas, on the border. Raul, it must frustrates of the distinction that this administration does not make about immigration whether it is legal or illegal and asylum. They are Different Things yes, they are different. If you are an Asylum Seeker, you can come here whether or not. To get a asylum, you must be here. It is not the same as illegal immigration. For all these americans who think people who are 61 neighborhoodi neighborhoflooding into the country, you are not likely to. Thats the national average. When we start to look at countries in Central America which where these people originate. Those rates of denial are 70 , 80 , high 80s. More of them are not allowed to remain in the country. They are adjudicated against them and they have to go home. So if 70 or 80 of the people are Asylum Seekers come to the United States get denied, whats the argument that the system is broken . You are asking the wrong person on that. If anything i believe me personally that our asylum system needs to be expanded because for so many years, the United States led the world in promoting the international right to a asylum and promoting things. A asylum system per se is not broken. To me, if anything we need to be generous of what we allow. In terms of sheer numbers, the United States is among the top ten nation of the world in accepting a Asylum Seeker. When luyou look at the populati, we come in at number 50. For all of 2017, fiscal year 2017, the United States only allowed 20,000 Asylum Seekers from all over the world. 20,000. Thats roughly a size of a small time. Raul reyes, thank you for your analysis. We are keeping an eye on the hearing in florida by a lawsuit filed by governor rick scott whos running for senator. This is his Second Campaign seeking for information on the counting of ballots. Well bling yring you news from hearing as it breaks. His opponent, bill neilslson, released this statement. Th tens of thousands of home and businesses are under Evacuation Order and including the entire city of malibu. Bracing for a w. Okay. Votes are still being counted but the 2018 election is historic. Were going to see a big increase in the number of women members. At least 121, up from 107. Now still not half, like the population, but were getting there. The 116th congress will also include a number of firsts including the first africanamerican to represent new england. The first latina representatives from texas. The first native american and muslim women. And with me now is one of these first muslim women to serve in the house. Representativeelect rashid Rashida Talib of michigan. Now and i met some years ago when you were serving in the Michigan House. Youve been in politics a long time. Served in the house almost ten years there. Yeah, i served three terms in the Michigan House representing parts of detroit and the down river wayne county communities. So i guess the thing that makes me think is that youve been in politics, youve been in michigan politics for a long time. Maybe a few years ago it wouldnt have even been outstanding that you got elected to congress because your constituents would have that was a logical choice they would have made. Today it seems more important to be a muslim woman elected to the congress of the United States because of the climate that were in. Absolutely. Its one of the things i tell people. All these incredible women of color that are being elected right now. Its the fact that its now at this moment of darkness in our country that its happening. This particular time, i think, makes it much more powerful, much more inspiring and gives a tremendous amount of people a lot of hope that its happening during this time of just a huge influx of hate and, like i said, people feeling very dark and feeling left out. So in addition to the work that every member of Congress Needs to do, which is hard work, you have this added role as either a role model or someone who is there to represent interests that maybe a lot of people feel havent been represented as a woman. What do you think the greatest impact of you being elected to congress is going to be . Is it going to be that people like you from similar backgrounds or other women run . Is it going to be that youll be able to get something done in congress that makes it a Fairer Society for snench whats your thought about what your big impact is going to be . I feel like im part of a new era of a civil rights movement, social Justice Movement in the United States. Yes, im a woman. Im a woman of color and, yes, i made history becoming the first, but i also am very much an activist here in detroit. Fighting back against corporate greed. Fighting back against so much harm thats been happening to working class residents here. The corporate assault on many of our working families. So i feel like im part of this Larger Movement thats happening where, yeah, we were marching as women outside of the capitol and but now were going to be able to march inside into the capitol. And make a really tremendous difference. More than half of my colleagues, ali, in the United States congress, are millionaires. They are an income bracket thats completely disconnected with the majority of americans across the country. So people like me, people that come from working class families, people that, you know, understand what it means to have college debt, to send your child to underfunded schools, we are now going to be at the table, be able to give a voice to so many people that feel left out right now. What does success look like in two years when youre up for reelection and theres a president ial election. Some of you have been elected on pri progressive platforms. And you represent detroit which is still an emerging story of struggle and working class people. Yeah, i can tell you, i represent the third poorest Congressional District in the country. One of my first proposals is going to be justice for all Civil Rights Act. Many people dont know the 1964 Civil Rights Act, an historic act, has been watered down as our courts have increasingly become more conservative. And so the justice for all Civil Rights Act says, look, you dont have to just show intent. You can show that the impact of the policy, for instance, you know, the fact that we have the highest rates of Car Insurance right here in detroit than anywhere in the nation because of discriminatory practices from Car Insurance companies. Their process, their corporate kind of assault on working class should be considered a civil rights violation. And thats something that, if were able to get that done in two years, that would be huge success for the residents here at home.
