Hearings on capitol hill, kavanagh was sworn in to the nations highest court. The Supreme Court is now solidly conservative and could remain that way for years to come. As one law professor in washington put it, we might be heading into the most conservative era since 1937. We are now 29 days out from the Midterm Election which will determine who controls the house and potentially the senate. Last hour the president had this to say about kavanagh at a Police Convention in orlando, florida. I say brett, congratulations, this is going to be a piece of cake getting you confirmed. This is going to be so easy. It should go quickly, nicely, dont even worry. He was so thankful. And it was very, very unfair what happened to him. False charges, false accusations. Horrible statements that were totally untrue, that he knew nothing about. Frankly terms that he probably never heard in his life. He was this, he was that the, he never even heard of these terms. It was a disgraceful situation, brought about by people that are evil. Lets get started this hour with nbc News White House contin correspondent jeff bennett. You are not quite on the campaign trail, but youre treating that ceremonial swearing in. It of course judge kavanagh already sitting on the bench . Reporter the president , casey is trying to channel all of the passion and energy gined up by republican from getting kavanagh confirmed out to the voting booth. The victory will be turning out those hardcore strategies. Hes trying to do a couple of things. One, hes trying to erase the claims made against kavanagh by Christine Blasey ford, saying it was all made up. It was just a hoax. And hes casting the loudest, including democrats, hes casting them as part of an angry mob intent on impeaching Brett Kavanagh. Heres what the president said today on the south lawn. Now theyre thinking about impeaching a brilliant jurist, a man that did nothing wrong, a man that was caught up in a hoax that was set up by the democrats. I think its an insult to the american public, and i think youre going to see a lot of things happen on november 6 that would not have happened before. I think a lot of democrats are going to vote republican. So this is something of a jedi mind trick, Democratic Leaders know the key to winning back the senate is not to run on impeaching Brett Kavanagh, its not an issue thats going to work well for them. That is why President Trump keeps saying, theyre talking about impeaching Brett Kavanagh knowing that this does not work well at all for democrats, kasie. Can i ask you about the other news story you have been covering today which is the president s conversation with Rod Rosenstein, which was put off by a week or so because of kavanagh . Reporter right, so when he was headed to orlando, President Trump told our colleague Kristen Welker that he had no plans to fire Rod Rosenstein and today when he got to orlando, the most he would say about their conversation aboard air force one, the two of them traveling together, is they had a good talk. Heres what he said earlier. Thank you as well to our Deputy Attorney general Rod Rosenstein for being here. Flew down together. The press wants to know, what did you talk about . We had a very good talk, i will say. That became a very big story, actually, folks. We had a good talk. Reporter a good talk, they talked about crime in chicago and in general doj business, no talk about rosensteins future in the justice department. If rosenstein resigns or is fired, then that could lead to an impeachment investigation. Fair enough, jeff, im interested to see what the hill is going to want to hear from Rod Rosenstein in the next couple of weeks as well. As the country tries to heal after an emotionally turbulent few weeks, several senators in both parties face a political reckoning in their response to their decisions to vote for or against the newest Supreme Court justice. I believed that a Sexual Assault had happened to her. What i think hes mistaken about is who the perpetrator was. I do not believe her assailant was Brett Kavanagh. I think that the politically expedient vote here was a yes vote. Why not then . Because this isnt about politics, this is about a lifetime appointment on the Supreme Court. This is about a responsibility that we have as leaders, a responsibility that we have to exercise the judgment that we were sent here to exercise. Joining me now with more on this in capitol hill, msnbcs garrett haik. We just heard from Susan Collins and hidecamp, a lot of republicans are saying she essentially signed her own death warrant when she voted no. Meanwhile the target of democrats come her reelection in 2020, what are you hearing . Reporter those are two of the three senators who have the most explaining to do after their votes last week. I think the third being joe manchin. And heidi hidecamp and joe manchin are both saying their boats, as he said, it was a surprising no. As she said it would have been more expedient for her to vote yes. And manchin, not a surprising yes vote. But both of them are now going to be at ground zero of figuring out what the political kavanagh effect is in 2018. If this is any at all. Hidecamp was already in a lot of trouble in north dakota. A very heavy trump state. She was behind in some polls by double digits. This could be signing her own political death warrant. A and manchin, his yes vote, you have to wonder what he gets from it. Hes already been attacked by the president s son over it, theres some democrats in West Virginia who are not as fired up about him as they were. And for Susan Collins, were not going to know what this cost her until 2020. Shes the last republican senator in new england, she may be a major target. This may not be the last opportunity for those people who want to weigh in on judges for democrats. Mitch mcconnell is not going to quit pushing conservative justices. He said over the weekend, he sees this as his key legacy. Its hard to judge your own legacy is, but i can say this, i i can its the single most important thing ive been involved in in my career. I think putting strict conservatives on the court is the single thing you can have a longterm impact on the country. Reporter this issue of conservative judges has flown under the radar for a while. Its one of the things that the senate has been quietly churning away at for months. And now that democrats have gotten so fired up about the kavanagh hearing, this could become a more contentious issue in terms of if the left has been plugging away at these democrats for months and months. And even if he did, he showed himself too i know many conservative judges who can fill this job without tearing our country apart. If heidi hidecamp really does have a chance in this race, it seems as if her final play is to make her look as authentic as possible, that straight to camera, a very direct appeal. North dakota is a small state, heidi hidecamp could reach every voter there between now and november, and im only be a little facetious. Shes independent minded enough, you heard her mention her vote for neil gorsuch, and you dont hear he get into the nitty gritty politics on the kavanagh vote. She said he was too biassed. But the best thing for heidi hidecamp would be talking about these other things like for example the president s tariffs in the coming weeks. So whats on deck this week and this year as Justice Kavanagh takes his seat on the Supreme Court, hearing his first oral arguments tomorrow . For that i want to bring in our chief justice correspondent pete williams, and jeffrey rosen, also a law professor at George WashingtonUniversity Law school. Pete, i want to start with you, what do you have coming up tonight and tomorrow that might be these hot button issues that we have talked so much about potentially being at the center of a 54 decision on this court . Thats easy, nothing. The first couple of cases the first few days will be an easy lift for kavanagh. Its the kind of things hes been doing for 20 years on the court of appeals. Hes trying to define federal statutes that are oftentimes ambiguous, what do the fine points mean. An issue thats repeatedly before the Supreme Court, what did congress mean when it said you could be getting a longer prison sentence if you commit three nefelonies and a violent crime. So thats the thing hes going to do these first couple of days. This term is off to a lowkey start. Its the kind of run of the mill Supreme Court cases that we frankly dont say too much about and you dont hear much about. Cases that are decided 81 or 90 about what federal laws mean, but the court could get into some dicier cases, theres one thats pending. One thats probably the more interesting issue is, does the federal rights law that bars s discrimination of employment on the basis of sex, does that include discrimination on the basis of sexual orientation, the courts been split on that issue. And then theres a 40foot tall cross thats on public land, some have said you cant do that, its a government endorsement of christianity. And later in the court, it might take up daca, it might take up the president S Health Care plan. So there are some other issues out there if the Court Decides to take them, but so far its a low key start. Can i ask you about the role of chief Justice John Roberts . We have focused so much on judge kavanagh and his contentious confirmation, but considering what john roberts did with his decision on the obamacare mandates that he may potentially involve as a jurist that could change the shape of the court . Whats your take on that . Chief Justice Roberts cares intensely about the legitimacy of the Supreme Court. He said before he left that he could try to encourage unanimous decisions, in order to make the court to appear to be nonpartisan. And more than any time in the courts recent history is that need especially salient. So judge roberts has two options now, first he can try to convince his colleagues to avoid these splits. And theres a bunch of technical, sort of sleepy cases right now, Justice Roberts may want to avoid cases about discrimination law or affirmative action so the court can avoid the but more than at any time in decades, the oel of the chief will be front and center. Pete, can i ask you about the future of roe v. Wade, it was so at the center of the kavanagh fight before dr. Blasey ford came into the spotlight. And i know that some of the questions before the court have related to clinics and their hospital licensing and other things that tend to limit access to abortion. Is there a legitimate claim to the fundamentals or a potential change to the fundamentals of that decision that the court may see in the coming years . Well, there will certainly be a renewed effort to try to get roe v. Wade in front of the court. The cases challenging the court hold have fizzled out in the last couple of years and the emphasis has been more on restricting access to abortions, requiring that clinics be built like ambulatory care centers. But now that theres a 65 court, states passing laws, for example, intending to get this before the Supreme Court. But i think its unlikely, that the Supreme Court, for the very reason that professor rosen just sketched out, that the Supreme Court is unlikely to completely overturn roe v. Wade. It seems pretty obvious that the court will continue to uphold restrictions with Justice Kennedy gone. But reversing roe v. Wade, overturning roe v. Wade, that seems very unlikely. And jeffrey rosen, one other issue before i let both of you go. Executive power has been at the front and center of this, including the Mueller Investigation and the potential surrounding issues, what is your view about how this court might rule if faced with questions along those lines . Theres a really interesting under the radar case involving whether the attorney general can apply a sex crimes law retroactively and challengers say congress cant delegate that power to the president. Whats at stake is essentially the future of the administrative state, can the Environmental Protection agency pass regulations without strong congressional oversight. Interestingly Justice Kavanagh, like Justice Gorsuch likely hold that the government cannot pass regulations. But its a broad victory for conservatives who want to roll back on the scope of the regulatory state with huge implications for executive power in the future. There are also cases involving stays to discovery, involving daca and immigration issues that pete suggested that may come up to the court requiring an instant decision. So we could get a read on those issues soon. But chief Justice Roberts might himself try to avoid 45 splits to make his role look for partisan. Now that the debate over whether Brett Kavanagh will sit on the Supreme Court is over, its time to assess the damage done by his emotionally fraught confirmation process. Passion was ignited on both sides of the aisle and that passion didnt dissipate on saturday when he was confirmed. Given the fallout from the situation, the wounds still need to be healed. The Washington PostWriter National political reporter, michael, its good to see you. You spent a lot of time talking with sources across washington for this, and you end your piece this way. It you say after talking with numerous lawmakers, quote, why what no one could offer was an incredible path out of the abyss. Thats a pretty depressing final assessment. It is and to make it more depressing, i would say i could have written that line a few years ago, and a few years before that. We have been on a downward trajectory for a while. And while theres much hang wringing over the divisions, the lack of comedy, the increasing questions of motives and actually pitting americans against each other as part of our politics, it keeps getting worse, and you probably have further to fall. There was talk about having hit rock bottom, but i dont have a sense that we have. There was a time for example in the congress that not all democrats came from the same regions of the country. You had democrats from the south with different sets of interests than democrats in new york or los angeles and thats simply not the case anymore . Thats right and you had different coalitions that came together, even though there were cultural differences within them. Now i think the country is much more culturally divided as well as politically divided. We have gotten politicians, theres an increased in anxiety and politicians have become more adept at messaging these different populations and technology has allowed media to fracture to the extent that people get their news only from one side or the other. So it becomes sort of circular for different sides. And there just really isnt much incentive, for, if youre running for congress, if youre running for senate, to appeal to the middle, especially on a national basis. Because to do that is to risk not turning out, not exercising, not playing to anger, which is really the dominant theme on both the left and the right right now. It seems to me the difference between the way donald trump ran his president ial cam dane and those who came before. George w. Bush, it was compassionate conservativism, bill clinton was a centrist democrat. Barack obama was the lets get rid of this whole redblue divide. And donald trump came and ran right at those divisions. If you look in the final weeks of those president ial campaigns. There was a lot of divisive rhetoric, youre for the billionai billionaires, were for the people, stuff like that. But it wasnt as consistent as it is right now. There was sort of an invisible line that was respected to not go so far as to question the motives of other americans. People would attack other politicians, other people in the arena, question what theyre fighting for, but you didnt have politicians regularly questioning entire swathes of the population. Now you have a president who says democrats are from open boarders, or democrats are for crime. The degree to which the rhetoric has swung is that its almost dehumanizing on the other side. On the left, you have a pretty prevailing view that to support Justice Kavanagh avenue things came out is to endorse chauvinism and to endorse an excuse of Sexual Assault is, which is a pretty strong charge as well. How has what we have been through the past three weeks affected survivors and what do you think is going to be the impact on the coming election . Whats interesting is that the Brett Kavanagh vote happened right around the time when we were marking oneyear of the Harvey Winestein stories. And this last year we have had this extraordinary public reckoning around harassment and violence and really around gender equity more broadly. And i think what happened and what you will continue to see is that women are quietly angry. Or not even quietly. Not are out loud angry, but we are hearing from so many people who cannot believe the senate failed them so deeply. And i dont think that that is something that is going to fadeaway quietly. In 2018, people have learned that they can come forward and tell their stories and the expectation is that the sort of blaming and shaming and trivializing of their experiences wont happen no more. So the senate may not have moved ahead with the shortest of margins, but were just getting started. How do you about women being able to show their anger. We have always been taught thats not something women are allowed to do. Serena williams dealt with that on the tennis match. You saw this really deep contrast between dr. Blasey ford, who had ever right to be angry, sitting in that room given that the president had bullied here. But she had a quiet composure,nd i was in that room that day, and Brett Kavanagh was allowed to have his angle rail around the room and have it reverberate and even talk about conspiracies and hillary clinton. And women when they are angry, its considered hysterical and angry, but in men, their anger is rewarded. But i dont know if thats a lasting thing. Many people who supported Brett Kavanagh, backed away when they saw that december play. They said thats not what we want in the Supreme Court. That feeling that remains, i actually think its going to be focused rage that make people vote and run for office and push forward new laws. We have record numbers of women running, mostly as democrats. I want to play you a little bit of an interview that i did with dr. Blasey fords attorneys, as this was coming to a close last week. About how dr. Ford is doing after all of this. Shes not yet back at her home. She still receives threats every day and shes going to have to work hard to put her life back together. And get back to what she wants to be doing which is spending time with her family and teaching, which is what she loves to do. So that was a little bit of that. They also told me that shes still not back in her home, that shes still continuing to receive death threats. What impact do you think all of this is going to have on womens willingness to come forward and report their assaults when they happen . Well, i think its obvious. Its going to have a devastating effect. I mean heres a woman, who thought she was doing a patri patriotic duty, a civic duty, she called it. And she tried to alert the government before the numbers of people under consideration had come down to kavanagh himself, when there was still a short list, to say, listen, this is my experience. And look at whats happened. Shes been slimed, attacked, insulted, humiliated, death threats, she cant go back to her house. How many victims of Sexual Assault are going to want to come forward in this kind of circumstance . This should never, ever happen. Why isnt the president out there condemning this . Hes not, hes calling the people who made the accusations, hes saying its all made up. This is really a devastating thing for this country, because i served for about three years on a federally created panel dealing with Sexual Assault in the military. And one of the things the military was trying to do was deal with the epidemic of Sexual Assault. Get the victims to come forward. Treat them in a humane and respectful fashion. Give them the support they need to deal with all of these accusations and attacks. And this sets that effort back, it sets every effort back by prosecutors all over the country because what were talking about is the safety of men and women who can be victimized and thats going to continue until we take rape victims and Sexual Assault victims seriously. And its not enough to say, we hear you, okay, im listening to your voice. What are you going to do about it . And the Senate Judiciary committee, they listened and they turned their backs. Instead of doing a real investigation, instead of really trying to find out what happened. They ignored it. They went through a sham, they didnt even want to have an inquiry, they went through a scam, an extension of an inquiry and went right on ahead. It sets victims back, the whole effort to deal with Sexual Assault way back and thats wrong. The president says hes for law and order, but not when it comes to Sexual Assault, thats quite clear. Do you think this is a set back for the me too movement, or do you think it will gralvanize the movement . I think it will galvanize women. We said we didnt know if donald trump is going to carry out the misogyny we saw during the race. And we lost this one vote, its a generational thing. Theres a lot of upsetness about it, but i think we will be propelled towards a change thats lasting. Thank you both. What can we actually do to reverse this . What are steps that countries could take to try and contribute to it . I think there are possibilities in that the laws of physics allow us to. We have the technology, but we really need to change things dramatically, we need to be getting 2 3 of our renewable energy. At the same time, almost totally phasing out coal fired power plants. We have the technology to do this, california, hawaii other places are doing this. But doing it everywhere around the world would mean overcoming the power and money of the fossil fuel industry . What are the politics of that like . I mean obviously here in the United States we had the paris climate accord, which the president has rejected. What sort of progress can be made on the political front . Well, thats really challenging because the problem is we dont see the consequences of environmental damages so clearly. And in fact we dont realize them at all in our economic system. Thats really the problem. If theres a small increase in cost by shifting from natural gas to renewable, say, a Power Company has no incentive to do it, if it costs them an extra million dollars, even if it saves tens of millions of dollars in damages, they dont have the incentive to do it. So our system is set up that we have a tax on every citizen in america, every business in america to pay for damages from the fossil fuel company. Until we really put a price on these damages or reflect their view costs, we wont take the actions that are actually better for everybody as a whole. Because we dont see that theyre better, and we just see that these small incremental costs in, say, gasoline prices at the pump. Saudi arabia is denying that they had anything to do with the disappearance of a journalist fiercely critical of the saudi crown prince. Jamal khashoggi, disappeared last tuesday while visiting the saudi consulate in istanbul to pick up paperwork to marry his turkish fiance. She was waiting outside for hours and says he never left the saudi outpost so she called the police. Senior turkish official and a regional diplomat told nbc news they believe khashoggi was killed at the consulate and that his body was moved out of the building. Saudi arabia denies that allegation and says khashoggi left the consulate shortly after he arrived. Turkeys president says the saudis have the responsibility to prove their claim. On friday the Washington Post left an empty space on its editorial page where khashoggis latest column would have been printed to bring attention to the story. You have someone who was living in the United States, was writing a column in the Washington Post who was a prominent journalist who apparently, according to turkish officials at least, went to the consulate to fill out paperwork. Was nervous about doing it because he told his fiance to keep his cell phone, to wait there and he said should anything happen, call the authorities. She waited for 11 hours and did sound the alarm when he didnt come out. And turkish officials think that he was either drugged while he was inside the consulate and taken away or that he was killed. One turkish official suggesting that he may have been taken out in pieces. So this is an absolutely serious incident that reflects on the nature of a crackdown. A nature of saudi arabias relationship with the press and how far it is willing to go to crush dissent on its soil or abroad. That is if that, in fact, is what happened. Turkey today asked saudi arabia for form at authority to go in and send inspectors to look around the consulate. They dont expect to find khashoggi inside but could look for evidence, for blood, for dna, and the saudi government has said that it is also looking for khashoggi and it was not involved. Can you just walk us through how his posture has changed, the pressure that hes been under internally in saudi arabia and how that could contribute to or explain why they felt the need to target this man . Hes presented himself as a reformer, but one who will not accept any criticism, especially as he tries to make himself and the country, he believes, to bring it into the modern era and fundamentally shifts society. But that has come at a cost of cracking down on political dissidents and, according to the turkish officials, killing a critic on turkish soil. Just a remarkable, dangerous, terrible story.
