Less than 24 hours after his public testimony, Julie Swetnick, this woman, has come forward against kavanaugh, this time in the form of a sworn declaration. Among several graphic details of sexually aggressive behavior and drugging girls at parties, swetnick said in 1982 she, quote, became the victim of one of these gang or train rapes where mark judge and Brett Kavanaugh were present. According to her lawyer, Michael Avenatti, Julie Swetnick says shes ready to testify in front of the Judiciary Committee. In the early 1980s, Brett Kavanaugh she is describing as someone that drank excessively, was verbally and physically abusive towards women, also engaged in conduct relating to attempting to get women inebriated. Kavanaugh released a statement denying the allegations saying, quote, this is ridiculous and from the twilight zone. I dont know who this is, and this never happened. What was the president s reaction . Trump tweeted a direct attack. Avenatti is a third rate lawyer who is good at making false accusations like he did on me and like hes now doing on judge Brett Kavanaugh. He is just looking for attention and doesnt want people to look at his past record and relationships. A total lowlife. Avenatti replied with his own tweet calling the president a habitual liar and complete narcissist who is a disgrace as a president and embarrass themeo our nation. Lets bring in kate snow who has been following these allegations very closely for us. Kate, lets start with them. It is not a long document but it is a very specific document with allegations about mark judge and Brett Kavanaugh back in high school. Right. Its a threepage document. It contains i think about 14 different points. I want to go through it piece by piece and just warn people, ali, that this is disturbing what were about to discuss. Basically in paragraph 8 if youre looking at the document, she lays out she says i observed Brett Kavanaugh drink excessively at a lot of these parties. She was at a neighboring Public High School about 25 minutes from his own private school. She says, i saw him engage in abusive and physically aggressive behavior toward girls including pressing girls against him without their consent, grinding against girls, attempting to remove or shift girls clothing to expose private body parts. She says, i likewise observed him verbally abusive toward girls, making crude sexual comments to them that were designed to demean, humiliate and embarrass them. Later in the document she talks about during the years of 1981 to 82 and im quoting here, she says in her declaration, i became aware of efforts by mark judge whos a friend of Brett Kavanaugh, and Brett Kavanaugh and others to spike the punch at house parties i attended with drugs or grain alcohol so as to cause girls to lose their inhibitions and their ability to say no. This caused me to make an effort to purposely avoid the punch at these parties. She says i witnessed efrltforts target particular girls. It was usually a girl that was especially vulnerable because she was alone at the party or shy. She goes on, and this is the most dramatic of the allegations. She goes on to say, i also witnessed efforts by mark judge, Brett Kavanaugh and others to witness girls to become inebriated so they could be gang raped in a bedroom by a train of boys. I have a firm recollection of seeing boys waiting for their turn with a girl. These boys included mark judge and Brett Kavanaugh and she describes something that happened to her. I became the victim of one of these gang rapes where mark judge and Brett Kavanaugh were present. Shortly after the incident i shared with what had transpired with at least two other people. During the incident i was inkpai incapacitated without my consent. I believe i was given quaaludes or something placed in what i was drinking. Tell me what this document is. Its a sworn declaration and she said shes prepared to testify. Her lawyer has said. She hasnt said anything. Weve been trying to reach her and have not spoken directly to her, so nbc news cannot verify directly any of these allegations or, in fact, that she made these allegations. But her lawyer, Michael Avenatti, has been on the air at least twice this afternoon saying this is her sworn statement to the committee. He says that he was in touch with the Judiciary Committee on sunday. Remember he was tweeting about this and talking about having evidence they would be interested in. He says they didnt really get back to him. They went back and forth a couple of times and by his account he felt dissatisfied and felt he needed to release this information. Some on capitol hill, republicans, have said this is an 11th hour, a last minute the president said this is a last minute what he called a con. The issue here is that Michael Avenatti has asked that she be allowed to testify . Yes, and said she would gladly talk to the fbi as well but nobody is asking her to at this point. He has also said avenatti has said that the two people that she told about this in the part that i just read, she said she had two friends that presumably friends that she had told. Those people, avenatti said earlier today, would be willing to talk as well. Thats what we know right now. Last hour with katy tur, people may have been listening, we had a lawyer on for Brett Kavanaugh who vehemently denied these allegations, these new allegations, these new charges, and said again and again that if so many people were aware and at parties and saw this happening, why would it have not come out before now . Why would someone not have called Law Enforcement . These were her words. The contrast here is Brett Kavanaughs own words about his what he was like in high school and now going into his College Years and what certain others are saying about him. In his interview on fox news, as everyone probably has heard by now, he said it again and again, i was an upstanding student and i cared about young women, essentially i was a choir boy. All right, kate, thanks very much. I know youll continue to cover this. There are details that are working on getting. To analyze what we do know, lets bring in former federal sex crimes prosecutor cynthia alsny. There are a couple of things in this declaration that are interesting and i want to read, in approximately 1982 i became the victim of one of these gang or train rapes where mark judge and Brett Kavanaugh were present. Shortly after the incident i shared what transpired with at least two other people. Those to me seem to be that seems to be two very interesting statements here. Mark judge and Brett Kavanaugh she alleges were present and that she shared the information with two other people. What do you make of it . A couple things. First, to keep this all in context, we also know that mark judges girlfriend says that mark judge confessed to him about basically an incident like this. So lets keep that in mind. In the new yorker article we have confirmation that Something Like this did happen, number one. Number two, we have several witnesses here that need to be interviewed by the fbi. The more you look at this, the more you know we need a pause and we need the fbi to look at this. The question at this point is not whether or not really he should be on the Supreme Court. If all of this is true, if all of these allegations are true from these three women, he shouldnt even be on the bench and the only way to know that is if all of this is true or if some of this is true maybe its not true. Lets find out. Its important. You made reference to what mark judges former girlfriend said in this article. Elizabeth razor, yeah. Elizabeth razor. And she does say that in the way mark judge related the story to her, he conveyed it as if that sex was consensual. Is that important in this context, especially when were talking about young people, High School People . I think he was embarrassed by it. He knew it was a terrible thing, but he you know, heits not surprising hes telling his girlfriend it was consensual but it was a confession that she shared. But the basic fact that boys were lined up to have sex with a girl who was drunk, that doesnt sound consensual to me, i can tell that you right now. There are a number of people who have said that the problem with the system is we have all acknowledged and understand that the only way the fbi is going to get involved is if the white house asks them to do unless somebody alleges a new crime and generally speaking these types of crimes the fbi is not necessarily the place you go for them but a lot of people said thats flawed. If things like this are coming up and if Brett Kavanaugh says theyre not true and he has said so on fox news, it is kind of a problem that were trying this in the media. There need to be people able to investigate it. Secondarily, its not really clear that even if this were investigated properly that a Senate Confirmation hearing is the best venue for this. No, but it is clear that the fbi is the right venue. Chairman grassley says, the fbi doesnt do that, that is ridiculous. The fbi does do it. It is routine and it is gamesmanship that theres not one. What would usually happen is the staff from the Judiciary Committee would call the liaison person at the white house who would call the person at the department of justice and it would be done lick ety split. Thank you for joining me. This just in. Senator Lindsey Graham in the halls of the Senate Answering questions about the accusations against Brett Kavanaugh. Lets listen to him in his own words. I am very suspicious of this coming out two days before the confirmation vote. Im very suspicious of Michael Avenatti. Ive been a prosecutor, a judge, a defense attorney. Heres what i think. If youre a serial rapist in high school hes not bill cosby. Hes led an incredible life. Everybody says hes very respectful. Heres what i think. If you went to a party once where people are being drugged and gang raped, you wouldnt go to the next one. You would tell somebody. You have an obligation if you see people being abused to Say Something about it if not for yourself, for them. Im very suspicious of this. He says he doesnt know the lady, never hung out with the lady. The more we know about the difference in age and time, it smells bad to me. Ive been very suspicious. This allegation, i dont know if something happened to her. All the corroborating witnesses go the other way. Ive always been interested in hearing from her. This is getting into the twilight zone. Youre talking about Brett Kavanaugh being a serial rapist during high school. I have a hard time believing you did it then and never done it before. Why shouldnt mark judge testify though . Mark judge is now being accused of being a criminal. If i were him i would be careful of the times in which we live. I do believe its important to invite mr. Avenattis client to come to the committee to be interviewed by the senate. That should happen right now. Should the proceeding be delayed . No, absolutely not. I think two days before the vote, one day before the hear g hearing, from avenattis accusations, to me, you dont go to ten parties and see what shes claiming. You go to the cops. I think normal people would feel an obligation to do something about it, at least i hope they would. I dont believe kavanaugh is a serial rapist. Theres nothing in his background that would imply that. As to ms. Ford, i look forward to hearing from her. [inaudible] how can you be certain if you havent heard from her yet. That affidavit, if it doesnt jump out at you as being strange, that you would go to ten parties over two years where you witnessed drugging and raping and you kept coming back and back and you never told anybody, you never warned any of your girlfriends, i find that to be over the top. I find that not to be reasonable. I find everything about judge kavanaugh to indicate that hes not that kind of person, and he has said that he does not know her, hes never been to a party with her that he knows about, that she is not in his circle of friends. And quite frankly, that is enough to me until something changes, and anything coming out of the avenatti lane two days before the vote i treat very suspiciously. Lindsey graham on capitol hill. All ten democrats by the way on the senate Judiciary Committee are urging the president to either withdraw Brett Kavanaughs nomination or order an fbi investigation which the present can do. One democratic senator has taken it a step further. Senator jeff merkley is filing a lawsuit calling the federal court to halt the nomination process on the basis the Trump Administration has divided the senate powers. Jeff flake the senate floor this afternoon. I do not know how i will assess the credibility of these witnesses, these human beings on the grave matters that will be testified to, because i have not yet heard a word of their testimony and because i am not psychic, i dont believe that dr. Ford is part of some vast conspiracy from start to finish to smear judge kavanaugh as has been alleged by some on the right. And i do know that i do not believe that judge kavanaugh is some kind of serial sexual predator as some have alleged on the left. I must also say that separate and apart from this nomination and the facts that pertain to it, i do not believe that the claim of Sexual Assault is invalid because a 15yearold girl didnt promptly report the assault to the authorities. As the president of the United States said just two days ago, how uninformed and uncaring do we have to be to say things like that, much less believe them. Joining me now from capitol hill is garrett haake. You and i were talking earlier just before jeff flake made those comments. Its unclear from listening to his entire speech what his thesis, what his message was. I think it sounded like lets everybody bring the temperature down and maybe not go to extremes on this. Whats he trying to say . This is the guy who could actually sink this nomination. Yeah, ali, i think this was an effort by jeff flake to turn the temperature down a little bit, to try to make sure that tomorrows hearing is going to be as civil as possible. And you make a good point, hes a leading indicator here. Flake will be the senator where the rubber meets the road on this vote sooner than many of the others who weve been discussing because he is on the Judiciary Committee. We will know based on his vote on potentially as early as friday morning how credible he believes dr. Fords testimony was, how credible he believes Brett Kavanaughs denials will be. I think that will be a big clue as to the fate of this nomination going forward. Can i also just quickly react to some of what Lindsey Graham just said. Id love you to. To be clear, Lindsey Graham was a lawyer in private practice and was involved in sex crimes litigation. He prosecuted in the military people who were accused of sex crimes. Right. He was a jag lawyer. He talks about believing in the rule of law. First, he used that phrase twilight zone. Thats straight out of Brett Kavanaughs denial issued through the white house. That suggests a certain degree of coordination here in how the white house and Brett Kavanaughs allies are pushing back. Second, you heard him talk about this idea of why would you keep going back to these parties if you saw these things that have been alleged. I will leave it to others to describe the logical decisionmaking or not of teenagers but ive heard another senator use that same language earlier today, bill cassidy from louisiana suggesting to try to undermine this argument logically by saying people would not keep going back. I think thats worth paying attention to. Thirdly, the presence of Michael Avenatti in this is a big deal. Hes a polarizing figure in capitol hill just as he is in the country. You have some on the left who have fought against the president and some on the right who see everything he has touched as overly politicized. By injecting avenatti into this they have turned this even more into a political suspect cal. I think some republican senators who might have been inclined to listen more openly to dr. Ford who will now see the involvement of avenatti in this as further evidence that this is somehow a politically organized smear campaign. His involvement could be a double edge sword here and play both ways. Tom cotton has tweeted out that the fbi has investigated the latest investigation. None turned up alleged drug running, gang rape operation. He supposedly ran as a teenager, not credible. Senator kennedy of louisiana has gone on the record. It does seem that some people are hardening regardless of what happens at testimony tomorrow. I think thats true but again, we still have some of these core folks who i think are going to be watching so closely tomorrow. Im standing in front of Susan Collins office. This puts her in an enormously difficult position. By the way, she and Lisa Murkowski who have been in the middle of all of these fights are getting hammered on both sides ahead of this vote. Bob corker and jeff flake retiring, thought to be a little bit more immune from the political pressures from their own party, could they look at what happens thursday and what has happened over this last week and say this is too gross. We just dont know. Tomorrow is going to be such a jump ball, ali. Well be covering all of it. Garrett haake on capitol hill. As this third allegation as revealed and the declaration made public, President Trump took a swipe at Michael Avenatti. He tweeted this, avenatti is a third rate lawyer who is good at making false accusations. Hes just looking for attention and doesnt want people to look at his past record and relationships. A total lowlife. Joining me is nbc news kelly odonnell. Has the president said anything about the new allegations other than that tweet . Reporter he has characterized avenatti. If we look at this as the 30,000foot level weve seen a progression with how the president reacted. Initially it was an allegation by Christine Blasey ford, there was restraint from the president. Then there was a tweet where he raised questions about her lack of reporting as a 15yearold if it was as bad as she said. Now with Michael Avenatti coming into the picture with this third accuser, the president is in more comfortable terrain for himself to go after the attorney who has of course been represented stormy daniels, who has been engaged in litigation with the president. So this is more familiar area for the president and so not holding back as much. The setting was awkward. Hes at the United Nations, with one of his closest friends on the international stage, japanese Prime Minister shinzo a abe. The president was asked specifically does he believe the allegations. It was actually framed as are the women lying and he said what is the next question. The president did want to go after democrats and he puts Michael Avenatti right in that partisan bowl. Heres what the president had to say. Its just a con game. Hes a high quality person. Theyre bringing people out of the woods. They can do that to anybody. Its a horrible con game. I think the people are finding it out. Hopefully over the next couple of days it will be settled up and solved and we will have a Supreme Court justice who will go down as one of our greatest ever. Hopefully hes going to be there for a long time. Reporter the president there is again giving his support to Brett Kavanaugh and by implication of what he said, predicting that his confirmation will go through and he will serve on the high court. So this is a slight variation of what the president is saying, going after avenatti as a partisan messenger in this drama affecting the Supreme Court and the president reiterating his support for his own nominee Brett Kavanaugh. Allegation are against judge Brett Kavanaugh, lets look at his teen years which he characterized himself as being focused on grades, sports and faith. Again, some things were going to tell you here are graphic. Kavanaughs allies put forward a letter signed by 65 women but at least one of them reached by the Associated Press admitted she never had oneonone contact with Brett Kavanaugh and one of the women who signed the letter was named ren ren at na snowede. Shes referred to in kavanaughs yearbook several times with young men listing themselves as ra ngata alumni. A pr rep says it refers to, quote, innocent dates or dance partners. Its degrading regardless. She told the New York Times she only recently became aware of the captions saying, quote, i cant begin to comprehend the mind of 17yearold boys who write such things but the insinuation is hurtful and simply not true and i pray their daughters are never treated this way. The man in charge of those yearbook captions, this guy, mark judge, whose own yearbook page lists, certain women should be struck regularly like gongs, along with a reference to 100 kegs or bust. Thats a reference that kavanaughs own yearbook page mentions along with the quote, he that lives at peace and with ease must not speak all he knows or judge all he sees. Heres Brett Kavanaugh on fox news monday. When i was in high school, i went to an all boys catholic high school, a Jesuit High School where i was focused on academi academics, going to church every sunday and friendship, friendship with my classmates and girls from the local all girls catholic schools. Yes, there were parties and the drinking age was 18 and, yes, the seniors were legal and had beer there. Yes, people might have had too many beers on occasion and people generally in high school i think all of us have probably done things we look back on in high school and regret or cringe a bit. Mark judge and Brett Kavanaugh are the two young men that professor Christine Blasey ford alleges pushed her into a bedroom in 1982. Ford says kavanaugh pinned her to the bed and covered her mouth as he tried remove her clothes, an account that kavanaugh strenuously denies. Kavanaugh is also facing an allegation of Sexual Misconduct labeled by yale classmate debra ramirez. She said kavanaugh put his genitals near her face during a dorm room party. She acknowledges she has gaps in her memory. Kavanaugh strongly denies that incident. Her college roommate, said, i do remember brett frequently drinking excessively and becoming drunk. Some are calling for a pause and investigation into the claims. Now theres more. Yale university classmates are speaking out in a New Washington post piece. Kavanaughs choir boy image on fox rankles former yale classmates. A friend of kavanaugh says, quote, brett was a sloppy drunk and i know because i drank with him. I watched him drink more than a lot of people. He would end up slurring his words, stumbling. Theres no medical way i can say he was blocked out but its not credible for him to say he has no memory lapses in the nights that he drank to excess. For more im joined by washington posts emma brown who cowrote that story. When we spoke last week i had no idea we would be continuing to speak about this in the way that we are. But there are a number of people who either hadnt spoken about Brett Kavanaugh in high school or college who have now come out to speak because of the portrayal of Brett Kavanaugh as somebody who didnt drink underage, didnt drink to excess and had no part in any of these allegations. Right, yes, there are people that we quoted in this story and you just quoted from one of them, liz swisher, who we had been actually trying to reach for some time and were unwilling to return our phone calls until after the fox interview. What these women told us is they just felt like his portrayal of himself did not match the kavanaugh they knew from their own experience in college when it came to drinking in particular. Ive gotten a lot of feedback from this story from folks who wonder why does his College Drinking matter. I dont think for these women its so much that his drinking matters, its the question of whether he was honest in the fox interview about how he portrayed his drinking in the past. I guess thats the question. These women are not making allegations that they think he did what hes accused of doing. Theyre just speaking to the idea that, look, if hes going to go out there and say that all he was concentrating on was this, that, and the other thing and he wasnt a drinker, we think otherwise. Right. They have no knowledge of these particular allegations. I think what bothered them was the notion that he was putting forth a portrayal of himself that didnt seem true to them and didnt seem honest. One of them went so far as to say you cant lie your way onto the Supreme Court. And that person is a republican actually. One of these women was a democrat, one a republican. So for them it was the question of credible and honesty that the fox interview raised, not anything particularly about the allegations in question. In your story there was somebody named chris dudley who played basketball for yale and later went on to a career in the nba. He said i went out with him all the time, he never blacked out, never close to blacked out. There was drinking and alcohol. Brett drank and i drank. Did he get inebriated sometimes, yes. Did i, yes, just like every other college kid in america. So its not everybody whos saying that Brett Kavanaugh drank too much. Right, yes. He has friends and supporters who say that the way that he portrayed himself was absolutely honest in that interview and that they knew him as somebody who, yes, you know, has had beer before, has had even several beers but has never been one person put it sloppy drunk. They vigorously dispute that notion. Emma, good to talk to you againme again and thank you for your reporting with the washington post. I want to go to jeff bennett at the United Nations. The president has made i dont know how to say this, jeff allegations that china is trying to influence the u. S. Elections but not in the way that we think russia has been trying to influence elections. What was he talking about . Reporter thats right, ali. When the president made that allegation today at the gathering of the u. N. Security council, he made it without offering much in the way of details or evidence and it struck some people as an attempt by him to downplay the role that we know russia played in interfering not only in the 2016 election but its the assessment of the u. S. Intelligence agencies that russia is intent on interfering in the 2018 elections as well. Heres the thing to know, u. S. Intelligence officials have said in the past innocently that countries such as china and iran are intent and frankly in chinas case are meddling in the 2018 midterms, although the director of national intelligence, dan coats, says that chinas efforts havent reached anywhere near the scale of what russia was doing back in 2016. All of that said, this is something that President Trump has been talking a lot about and tweeting about today. He put out one tweet earlier today suggesting that this was chinese retribution aimed at getting back at him for this brewing trade war. The president tweeted, china is actually placing propaganda ads in the Des Moines Register and other papers made to look like new. Thats because we are beating them on trade and the farmers will make a fortune when this over. And theres a picture taken of the des moines newspaper. Its also something he talked about earlier today during a oneonone meeting with the president of japan. Im told we have that audio and we can take a look at it. You have not only ads, you have statements made that theyre going to hit our farmers who are my voters. I love the farmers, im taking care of the farmers. The United States would support a twostate solution if agreed to by both sides. So im looking at two state and one state and i like the one that both parties like. Im very happy with the one that both parties like. I could live with either one. Thats a problem that the president is lighthearted and jokey about this matter in which thousands of people have died over decades. Theres not going to be a solution in the middle east if the United States doesnt take leadership in it and this doesnt look like u. S. Leadership. Well, hold on just a second, ali. If you look at north korea, rocket man, he was going to go to war with north korea and then he turned it into talks. We hadnt been talking to north korea in a serious way for a number of years about anything. So lets see where it lands. It could be a good thing or a bad thing. The twostate solution, jared kushner, the negotiator with michael greenblatt, felt they had to below thinlow things up. You defund the palestinian authority. You change refugee status. And you blow it up and you say in fact i heard from senior officials when they recognized jerusalem, we can have a twostate solution with two capitals in jerusalem. Hang on, were going to pull that out. This was a little bit of a flip comment. Im not sure how much strategy there is. That might have been the larger point. Yeah, but dont dismiss the fact that sometimes you have to but the camp david talks took man accam bagen, an israeli leader and Palestinian Leader who are going to have a hard time coming to an agreement. I wouldnt go too far with todays story. Lets take that idea and apply it to the iran situation. One of the reasons whether one likes the iran deal or didnt like the iran deal is that it took a lot of time and bringing together of Different Countries and different leaders who had different opinions on iran over an amount of time. Now the president is trying to break that china too. Is he going to succeed . I dont think so. Had it been a year ago, i think i would have told you there would be more opportunity there but that was before we went ahead with the north korea summit without our friends, before we walked away from the iran deal, before President Trump lambasted some of our allies and there was a disastrous nato summit. I dont think were in a very good spot in our international operations. This is the bully pulpit to the world, this speech. Its a megaphone and the one opportunity you have to set the Foreign Policy agenda for the year and to let everybody know what the United States is prioritizing, and he didnt take that opportunity. It ended up being this campaign stump speech. On top of it, we ended up being the laughing stock. Regarding the nonproliferation meeting that theyre having today that theyve had, its clear that everybody shares the same goal of nonproliferation and thats great. I think that the best Case Scenario could have been that President Trump push everybody to leverage the success that they had in the Security Council on north korea and say we need to combat this issue with actors like iran and perhaps pakistan but i dont have any hope about that. Nikki haley showed up at the United Nations with a lot of people having low expectations because of what the Trump Campaign had been saying about the u. N. And a lot of people came away saying shes engaged, she brings people together. That doesnt sound like what donald trump said at his speech yesterday. What do World Leaders who are looking at this, who have to have peace agreements or defense alliances or trade agreements or whatever with the United States say, who do they listen to . In new york i talked to several of the World Leaders including some of our closest allies and theyre disturbed but theyre not surprised. The argument one of them made to me is it was a she. She said, look, im a patriot but im also a globalist. You can be a patriotic globalist. If you look at the history of the United States, one of the best things weve done regarding iran, weve deepened our alliances with saudi arabia, israel, the uae. I think in some respects if we had not cut ourselves off from the europeans in this process, we would be putting a lot better pressure, tougher pressure on iran for its misbehavior in the region which the Obama Administration didnt do. We cant do any of this without allies. I think a lot of people this week were listening to it and afraid that this language meant that the u. S. No longer sees it in its National Interest to be part of alliances and to take things on in the he said it. He did say it but im not sure people want to believe it yet. As we prepare for tomorrows senate Judiciary Committee, republicans are taking an unusual approach. Chuck grassley appointed arizona sex crimes prosecutor Rachel Mitchell to question both Brett Kavanaugh and Christine Blasey ford. She says its an effort to depoliticize the hearing and get to the truth. All 11 republicans are men. Zero are women. Some are worried it would look bad for a panel of men to question women about Sexual Assault like anita hill. This woman is a veteran prosecutor for 26 years. She serves as deputy county attorney and chief of the special victims division. Though grassley says shes currently on leave from those positions, she is best known for winning a conviction in the sex abuse scandal surrounding the Catholic Diocese of phoenix. Shes a registered republican. The 11 republicans by the way, have a combined 184 years in office. 7 of them have well over 10, some have even 20 years of experience in law. Some of them serving as trial attorneys and even judges. For more on what we can expect from the republican side tomorrow, as well as the democrats will be asking questions, im joined by our msnbc legal analyst, danny cevallos. The senators get time to question and then i guess they yield their time to Rachel Mitchell. Do the democrats too or will Democratic Senators be asking questions of the people who are being questioned . Its unclear as of yet and its unclear the timelines and what exactly is going to go forward tomorrow because this isnt a rules of evidence situation. This is whatever the senate agrees upon situation. And, even the witnesses coming before it have significant bartering power. The fact that this is a situation right now doesnt mean it will be the same in a couple of hours or even tomorrow morning. Thats something we need to watch for. You talk about the prosecutor, mitchell. My sources in arizona tell me that she is very highly regarded. Shes very victim sympathetic and a reasonable prosecutor, but i will say this, that no matter who the lawyer is, lawyers always have a mission in crossexamining you made this point the other day. This is really interesting. Yeah. A lawyers mission, as you said, is not necessarily to get to the truth. Its not at all. Whenever a witness is on the stand, you can bet that no matter whos crossexamining or has the witness on direct exam, theyre not searching for the truth. They have a mission, and that mission is either to bolster the witness if its your own witness, or its to shred prosecutor or even whether she was a prosecutor or defense attorney in a neutral type role or apparently neutral role where shes seeking to get to the bottom of the story. So while she has all these tools in her arsenal or these weapons, she may not be using them to their full extent because her mission is different tomorrow, if it goes forward. You said something to me almost a week and a half ago that has stuck with me throughout this. And that is that the more republicans can make this appear to be a courtlike hearing, a legallike setting, whether its because people think about civil trials with a preponderance of evidence or criminal trials with beyond a reasonable doubt, this is really neither. This is a job interview. The path to victory for republican senators is creating a nebulous of this being like a criminal trial. Because if they do that, then in peoples minds, the defendant in this case kavanaugh, will be afforded what we consider due process. A presumption of innocence. The burden will be on the accuser. And if you want precedent for this, look no further than the Clarence Thomas anita hills hearings where they did exactly that. They spoke of the burden on the accuser. I believe orrin hatch did that. But that is critical if they want to cast this as a criminal trial because then kavanaugh will be entitled to these protections that he really isnt entitled to because the senate rules are a freeforall. And we have now seen polygraf results from Christine Blasey ford. Tell me about this. They are interesting because there are only two questions and it has her reviewing her own statement she wrote. And asking, in my opinion, the two questions, and youre seeing them right now. If you parse them out, there isnt very much difference between those two questions that i can see. Is any part of it false . And did you make up any part of it . If she made it up, it would be false. I could maybe see a difference. But a and b seem almost like the same question so this was not a long multiissue, multiquestion polygraph. A single issue, twoquestion exam. That doesnt make it more or less credible because we know that the fbi and Law Enforcement use polygraphs all the time for their own employment, but we also know that in virtually all jurisdictions, polygraphs are presumptively inadmissible in courts. Thats not a rule here for the senate but its good guidance about the state of the technology. An interesting one for people to understand. Its inadmissible in courts but lots of people use them in their recruiting. Its a tool with a lot of applications. Not necessarily just in court. I should add that in some jurisdictions, it may be admissible if both sides agree to it. It can be put into evidence. But it has many other uses outside of court. But we know that naturally there is information that we find valuable just because it may not be admissible in court. A great example is hearsay. A lot of evidence in this case so far is hearsay. Its certainly interesting to all of us, even if it may not be admissible in criminal or civil court. All right, danny, thanks very much. Msnbcs legal analyst. We have already heard from plenty of senators, including republicans on the hill that that would be a problem and a lot of republican strategists are advising the president that with everything going on right now and before the midterms, firing Rod Rosenstein may not be the best plan right now. We come on the air on the eve of highstakes testimony from Supreme Court nominee Brett Kavanaugh and professor Christine Blasey ford who has accused him of Sexual Assault when the two were in high school. Fords account may have been bolstered by fresh accusations from a woman who claimed kavanaugh and his High School Friends engaged in a pattern of Sexual Misconduct during the same period of time that ford claims she was assaulted. These accusations which we want to warn you are graphic come from a woman named Julie Swetnick. Shes represented by Michael Avenatti who has been teasing for days that new allegations were coming. Today avenatti shared a sworn declaration from her client in which she says i became aware of efforts by mark judge, Brett Kavanaugh and others to cause girls to become inebriated or disoriented so they could then be gang raped in a side room or bedroom by a train or numerous boys. I have a firm recollection of seeing boys lined up outside rooms at many of these parties waiting for their turn with a girl inside the room. These boys included mark judge and Brett Kavanaugh.
