To help me break down the charges, im joined by liz holtzman, a longtime congresswoman who voted to impeach president nixon. Im also joined by Barbara Mcquade whos also a legal contributor for us an is outside the alexandria courthouse because she has been following very closely the Paul Manafort trial which we are going to get to here in a few minutes. So, liz, i want to start with
you. When you see all of these charges and the case presented by the government, whats your first takeaway. Well, i was a former member of the u. S. House of representatives, so for me its a very sad commentary to see somebody who ought to know better being charged in this case of a cut and dried case with Insider Trading, violating the federal law. He shouldnt have been in this kind of position, he shouldnt be Breaking The Law and its very, very sad. Thats my first reaction because it casts aspersions on all public servants. Barbara, i want to ask you, and maybe perhaps were still trying to see exactly how President Trump is going to handle this, seeing as Congressman Collins was his first sitting member of congress to support his campaign. But this is a situation where the president if he wanted to and Chris Collins were convicted, he could in theory pardon him, no . Well, yes, the president has the power to pardon anyone he wants to. He has used that pardon power
weve seen without input from his Justice Department. Highprofile people have received pardons and so he certainly has that power to do it. In fact he doesnt even have to wait for a conviction, as we saw in the pardon that president ford gave to president nixon. He pardoned nixon for any crimes he might have committed, so he could pardon him today if he wanted to. More often it happens later down the road after theres a conviction and you see how things play out, but certainly President Trump has the power to do it even today. Liz and barbara, stick with us because we have several other stories to get to with both of you. Eight months of negotiations later, President Trumps lawyers are rejecting the Special Counsels terms for an interview with the president. Once again trumps legal team is countering with their own suggestions, narrowing the kinds of questions the president would face if an interview with mueller were to happen. Earlier Rudy Giuliani told nbc news, quote, it will be a legitimate offer to find a way to do an interview. It wont be a refusal. Citing a person familiar with the response, the New York Times reports mr. Trumps lawyers did not wanting the president answering questions about whether he obstructed justice. The response indicated how far apart the two sides remain. With me now from the white house is nbc news kristen welker. Kristen, i know youve spoken to Rudy Giuliani, the president s attorney, about this. Do we have any details on what the latest backandforth is . Hes being incredibly tightlipped, kasie, but i can tell you this is a counterproposal so it is a proposal to narrow the terms of the interview. We also know that Robert Mueller in his previous proposal said, look, some of the q as can be in writing. Thats what the president s team wanted. They want this entire interview to be in writing, by the way. Theyre concerned about him being subjected to followup questions and potentially getting tripped up either because he doesnt remember or he misstates something. They dont, we know this based on our conversations with Rudy Giuliani and other members of
his legal team several days ago, they dont want him answering questions about obstruction, answering questions about his time in office essentially. They say, look, ask him anything you want about the campaign, but his time in office is privileged. So this is their counteroffer. We know that President Trump has publicly said he wants to do an interview. Privately thats what his attorneys say. But i can also tell you, just go back to what you just said, kasie, this has been going on since january, these proposals an counterproposals and they havent reached an agreement yet for an actual interview so there are real questions whether they will get to yes and the president s legal team has had a lot of skepticism about what type of legal jeopardy an inperson interview might subject their client to. This seems like a lot of dragging it out if really they want mueller to wrap this investigation up. Kristen welker, thank you. Great reporting as always. I do wanting to go back to tom winter because we have some Breaking News on Congressman Collins arraignment. Tom, what do you know . This from my colleague Jonathan Dienst who was in the courthouse. The congressman has pled not guilty to the charges. In addition, his son also pled not guilty and another person who was identified in the document as Steven Zarski has also pled not guilty. Theyll be released on a 500,000. He has to surrender his diplomatic passport and firearms within 14 days. So again, the congressman pleading not guilty as well as his son in this criminal case that weve been talking about today centering around allegations of Insider Trading. The next Court Hearing is set for october 11th at 2 30 p. M. So thats the next time that we expect them back in court. Thats the latest from the Arraignment Hearing that wrapped up just moments ago in lower manhattan. Tom, october 11th, obviously close to the First Tuesday In November when Chris Collins is set to be on the ballot. Is that a situation where the judge might decide that the hearing should be later on or
will we see a spectacle like that so close to the election . Well, the thing that guides us is a memo that goes back to when eric holder was attorney general. Its basically when the government and Justice Department can bring forward a case like this or make certain or do certain developments in a case as it gets closer to an election. The judge is really not beholden to that at all. The judge can do whatever the judge wants to do. In this case the judge may say, look, youve been charged. We have a duty here to have due process and to have a trial or move towards a trial, and so, yeah, were going to have the hearing when we have the hearing. Have some sort of preliminary hearing or motions hearing. Really thats up to the judge and their schedule and what works for them and the judicial process. Thats not beholden to the election process at all. I want to go now to Stephanie Gosk who was in the courtroom and just ran out to a camera for us. Steph, what did you see . Reporter stephanie, can
you hear us . We do not have Stephanie Gosk, but we are going to keep going now to the trial of the president s former campaign chairman, Paul Manafort. After three days rick gates is off the stand and fireworks are for the most part over. Some of the more salacious details included revelations of Extramarital Affairs. At this hour a forensic accountant is about to statake stand again. Judge ellis is reportedly getting antsy on this seventh day of the trial and telling the prosecution to hurry it up, asking them to sharply focus their testimony. Once again i want to bring back my impressive female legal counsel, former new york congresswoman liz holtzman and Barbara Mcquade, a former u. S. Attorney in michigan. Barbara, can i start with you on judge ellis. He seems to have emerged as a very interesting character in the course of this trial and it
sounds like he was back to pressing the prosecution. Should we read in anything into that . Do you think that he thinks they are making mistakes . Well, i dont think his behavior is unique to this case. Ive talked to people who practice in front of judge ellis and it seems to be his m. O. That he pushes cases. You know, this is the district Knowns Athe Rocket Docket so hes constantly hurrying people along. The thing that would frustrate me as a prosecutor is the extent to which he involves himself in the case. He asks questions of witnesses, he makes statements, and that can really disrupt the strategy of a prosecutor when theyre trying to put on their case. Hes also very reluck tangt cta allow the prosecutors to show exhibits while theyre telling their story. In a complex case like this, i think its really important for the jury to see these exhibits as theyre coming in so that they can understand them. The judge says things like the jury can look at those things later. But if they dont see it at the
moment, i think its going to be very difficult for them to go back and pore through financial documents to find the one nugget that was relevant to the testimony at a particular moment. Liz holtzman, can i get your take on this topic broadly. We heard pretty salacious things from rick gates about his Extramarital Affairs and some suggestions that perhaps he didnt reveal those as he should have. How much do you think this, despite the judge saying, hey, were not going to touch the Trump Campaign and russia, how much do you think this is impacting the white house right now . Well, i mean the white house has to be concerned about a conviction of manafort, definitely, because its going to look bad for the president. He, after all, Picked Manafort. Hes supposed to be such a great judge of character, he Picked Manafort to run his campaign. This is not going to look good, particularly if manafort was involved in is convicted here. So i think they have to be worried. And remember, theres going to
be another trial, which brings the whole matter of corruption and the Trump Campaign much closer to the midterm election. I think they have to be concerned and they obviously are. We know that the president is concerned because hes attacked this trial. Hes attacked the prosecutor. Liz, you mentioned the midterm elections and just because we have this Breaking News on the congressman being arraigned, what is your take on the scheduling, the timeline, the fact that this is going happen so close to the midterm elections. Hes schedule to be back in court october 11th. Hes trying to fight it. To your point earlier in the show, Democratic Leader Nancy Pelosi condemned the behavior, but there has been something of a tradition of members of Congress Facing indictments remaining in office unless the voters throw them out. Well, they still can remain in office. They cant exercise certain privileges in the house of representatives, but they can still remain in office. But hes going to have a tough time, as he should, before the
voters in november. Theyre going to want to know whats going on and they should. Theyre entitled to get answers. They may be very concerned about this, as they should be. Liz holtzman and Barbara Mcquade, thank you both for all of your time today. I want to go back to nbcs Stephanie Gosk who is with us and can hear us now. Steph, you were inside the courtroom. What did you see . Reporter well, kasie, this hearing was pretty brief. We kind of expected it to be brief. All three of the defendants came in, including Congressman Collins. He was interestingly dressed in a jacket and tie but the other two defendants, his son, cameron, and Steven Zarski, no jacket and buttonedup shirts looking casual surrounded by a sea of attorneys in jackets and ties. They then pled not guilty to the charges, pleaded not guilty to the charges, and then they talked about the bond proceeding, the bail afterwards. Each of them 500,000. They have to give up their passports. Both cameron as well as steven
zarski have already done that, but as you know, Congressman Collins has a diplomatic passport, so they are making some sort of accommodation thats different for his passport. Now theyre just inside the court house arranging the paperwork for the bail but are expected to leave later on today. I suppose posting 500,000 bond is relatively easy when you are one of the wealthiest members of congress. Stephanie gosk, thanks very much. Up next, too close to call. the Special Election in ohios 12th District remains too close to call. It looks like republican candidate Troy Balderson leads democratic candidate Danny Oconnor, but the president already has called the race for balderson and he seems to be reacting to the suggestions the race was a referendum on his leadership. Over the past roughly 24 hours or so trump has launched a series of tweets that read like a pat on the Back Reveling in victories for the candidates he endorsed. Despite that, republicans more broadly dont seem to be breathing a sigh of relief. If it takes this much energy and money for republicans to pull off oneoff wins in Special Elections in red districts, there is no way theyll be able to do it in 435 places at once come november. For that joining me now is kevin mclaughlin, also with us new
york times reporter jeremy peters. He is also an msnbc contributor. So, guys, thank you very much for being with me. Its great to see you. I want to start, Steve Kornacki has given us a rundown in each of these areas. Well start with his analysis and take a look. All right, kasie, the story of how it happened in ohio 12. Three quick stories. Number one, columbus, the immediate suburbs. Democrats got everything they could have dreamed of here. They got turnout, overwhelming support. Why weasnt it enough . The rural parts of the district, not as much turnout but very strong support. Trump did extremely well here, so did balderson. The ball game was won apparently in delaware. He didnt get a great number for a republican year but he got the trump number. He didnt slip any further from what trump got in 2016. Add it together, apparently just enough for balderson. So thanks to steve for that. Kevin, whats your take on what happened . So i findi find it fascinati well oconnor did in franklin. He outperformed obama and clinton by 5 points there. In delaware county, balderson underperformed romney and mccain by 7 and 5 points. If you had told me that beforehand and said that he would even be in the race or let alone be winning it, i would have told you youd be crazy. So i think its a little disheartening for democrats how well oconnor did in his base and didnt win. Right. Jeremy peters, how much of this do you think is due to the strategy that cory bliss and his Congressional Leadership Fund were running antiimmigration ads basically aimed at driving out base turnout. It seems that work. That worked, trumps visit probably helped. The fact that Chris Matthews got involved and had Danny Oconnor flipflopping or seeming to hedge on im serious, people told me that that was republicans felt like that was a makeorbreak moment for them. So there were all of these factors when youre talking about a race thats this close. Anything could have tipped it. But talking to republicans today, ive got to say most of them im talking to sound like zombies. This put a real scare into them. If they didnt realize that november was going to be tough, boy, they sure do now. There were a lot of republicans who kept telling me, dont worry about it, dont worry about it, its all going to be fine. Not so fine. If you needed this as a republican to know this was going to be a tough cycle, you should be hit in the head with a tack hammer as they said in whatever movie that was. Its just like i dont think anything is different today than it was yesterday morning. Tough cycle, first midterm of a have you lost the suburbs . The Suburb Problem is real. I i think the erosion of suburban voters was real. The turnout was pretty good in this election. There were over 200,000 votes cast. One of the other things i would say from a democrat standing point, if i was sitting at the
dccc, id be like, wow, we turned out a lot of votes and got a lot of votes we shouldnt get and we still couldnt do it. Theres room to grow for republicans here and i dont know if theres room to grow for democrats in this Congressional District so i think november will be a heavy lift for them. Interesting. I want to check on another race last night that we were all watching. Heres Steve Kornackis take on what happened in kansas. All right. Well, in kansas, the story, the insurgent, kris kobach backed by the president , donald trump, beating the incumbent governor. It looks like 191 votes. Thats the margin for kris kobach over jeff colyer pending a recount. If kobach is the nominee, the republican establishment, whats left of it, they are very nervous about kobach leading that ticket in kansas. There are suburbs of kansas city they think he might be a Lightning Rod there. This might be a kind of year where the kind of candidate like
kobach makes the republican establishment very nervous. In the end if kobach pulls this out, do you think there could be a democratic governor of kansas . It could. There wasnt that long ago there was one. Kansas is a unique populist state. Tle they were populist before it was cool to be populist. Theyre a leading indicator of where the Republican Party is headed, absolutely. I think hes a real problem for us on the ballot. I dont know if it necessarily spreads out past kansas, per se, but i do think it gives democrats a huge opening in theres a lot of theres a super cycle for the governors races, so theres a lot of resources that are going to be needed. So if theres i dont know how thats going to affect what they do at the rga. That makes sense. Jeremy, whats your sense of how this dynamic plays out more broadly insofar as this is president endorsed. He went out and said this is the guy i want. Has vaulted him over a sitting governor. Obviously not one who was originally elected, but still. Is this a phenomenon where the president will pick candidates that are not palatable to a general electorate. You mean like roy moore . For example, roy moore. And we saw this with obama to a certain extent too, right . Obama was magic. For Republican Voters trump is magic, but he may do what Mitch Mcconnell has been so afraid of for so long which is ultimately endorse a bunch of candidates. Both obama and trump were singular figures within their party. Just like we saw with obama and are starting to see with trump now, that popularity is not necessarily transferable to the congressional candidates. Trump is not a republican. He spent the better part of his political career, short as its been, attacking the Republican Party and its leadership and talking about how they were rigging the system against him to deny him the nomination. So its not surprising that there are not a lot of trump voters out there or that there are trump voters out there, i
could say, who are skeptical of voting for a congressional republican. Just dont care to and probably werent going to show up in a midterm anyway. Kevin, final thought to you. Is there anything going on in ohio that you think is being underplayed or not highlighted or a trend that you think icritical here . I just think overall what drives people like me crazy who do campaigns for a living is when people say this such and such Congressional District is a bellwether for whats going to happen in november. I think were overstating it. Yes, there are large problems for republicans on the ballot in 2018. Its not as indicated by ohio 12. Its indicated by you said suburban erosion, by enthusiasm gap, and of course our Candidate Selection sometimes. So those are things im looking for. While the white house remains tightlipped over what happened with President Trumps private meeting with Vladimir Putin last month, according to
politico, russia is reportedly taking a different approach releasing a document that goes through the topics purportedly discussed behind closed doors. According to the document, putins requests included new talks on Controlling Nuclear arms and prohibiting weapons in space. Politico reports, quote, the white house, which has refused to answer most questions about what trump and putin discussed, would neither confirm nor deny the documents veracity. We should note this document has not yet been verified by nbc news. Joining me now is the reporter who wrote that police, defense editor brian alexander. Brian, thanks for being here. You report that the person who provided the document to politico got it from russian officials who described it as what putin had conveyed to Trump In Helsinki. Can you walk us through the highlights and what may be the motivation for putting something on this list or leaving it off. Well, this was a onepage document that are probably better described as talking points that President Putin relayed as part of this meeting
with Trump In Helsinki last month. Of course the meeting was two hours long, so this was not the pull substance of the meeting, but this was a very discreet list where the president of russia said, hey, we are willing to sit down and talk about these things. They almost all cover arms control. So one was sitting down and talking about extending the new s. T. A. R. T. Treaty that was signed in 2010 by president obama an President Putin. Expires in early 2021. Is intended to reduce the number of Nuclear Weapons on both sides. So lets Start Talking about doing that. And then listed a bunch of other areas, nuclear treaties, you mentioned a possible treaty or an agreement on barring weapons in space. So this was an attempt by the russians quite frankly to continue on a path that is very well trod by the u. S. And russia for many decades, which is to sit down even despite all the differences, and god knows there are a lot of differences, and
talk about the big stuff. How do we get together on controlling the spread of nuclear arms . How do we take some steps to ensure we dont dive headlong into an arms race. So this was a very traditional approach for the russians. Now, whether we live in an era where the u. S. And russia can talk about these things and reach some solutions i think is a big open question. Brian, thank you very much. Really appreciate it. going to turn into a racially heated situation. Reporter he was a neonazi and a member of the kkk. So you would actually wear this when you all were burning crosses. Yes, maam. And thats an actual cross burning behind you . Yes. Reporter like hundreds of others that day, ken was fueled by anger. Of all the things you could have picked to say i want to be a part of this group and i want this to be part of my identity, why whiteness . I had gotten out of the navy. It was really hard to get a job. Its really easy to blame it on somebody else. You know, we have people with darker skin in our country, you know, taking my jobs. Do you think this is a growing movement . I think the more extreme people become, they were the ones that came in under obama. A vast majority of the Recruiting Calls had something to do with having a black man in the white house. So obama was part of your recruiting tool. Absolutely. Reporter but just seven months after charlottesville, ken started having doubts. Why hate these people just because they have different
color skin than you. Reporter thats when he bumped into a man that made an offer that would change his life. He invited me and my fiancee to go to church. I was like, well, its worth a shot. Reporter that man, was a black pastor. So youve got a 70person congregation now. Theyre all black and just three white people, including you. Yes, maam. He called me up and asked me to share my testimony. I said i was a grand dragon of the kkk and their jaws about hit the floor. But after the service, they were all coming up and hugging me, shaking my hand. When we make it to heaven, heaven is not just going to be one race, theres going to be all kinds of races up there. Reporter ken knew that he wanted to stay out of the White Nationalist movement, which is why he reached out to someone who would understand. Hey, what up, ken, its arno. Reporter he is a recovered nazi skinhead. All of my swastikas have been recovered. Reporter he basically runs an Underground Railroad for men like ken trying to escape hate
groups, by helping them removing their tattoos. This is pain youll be grateful for the rest of your life. Reporter and reconnect with society, a job thats more important now than ever. Thanks, man. I think a big thing fueling hate groups is this rhetoric from the white house that immigrants are dangerous, that islam is dangerous. Thats all like the same kind of speech that we used 20 years ago in what we called the movement. Reporter now just one year later, ken is still navigating uncharted waters. Turning the tied of hate. Better than i did the last time i had a robe on. Into a wave of love. And Morgan Radford joins us now from new york. Morgan, ken was inspired to make a change because of what happened in charlottesville last year . Thats right. Its really an interesting layer to the back story because he was featured in a Netflix Documentary called white right meeting the enemy. Then he was still in the movement. He said some outrageous and inflammatory things, but that filmmaker, she was actually born to a muslim family and she was kind to him and that got him to be a little bit more open in his mind. But then he met the pastor and that changed everything with his actions. So ken says hes now getting messages from people all over the world online asking how they too can get out of hate groups just like he did. Ken says he knows hes caused a lot of pain for a lot of people, but he hopes that this is just one small step towards making up for it. Kasie. Morgan, i couldnt help but notice in your package you talked about how this was sort of an Underground Railroad to get people out of these hate groups. What do those groups do to try to keep their members in the fold . Reporter they try to keep their members in the fold by playing on their fear. We spoke to that guy, the gentleman, Arno Michaelis and he said they play on your fear by saying immigrants are wrong, muslims are wrong and he said hes seen those numbers increase
within the last administration. But again, kind of point out what ken said that was so interesting is he said he actually saw the numbers increase during the Obama Administration because then people who felt like they were economically disadvantaged an they felt like immigrants were taking their jobs were so upset that a black man was in the white house, that that inspired them to come together and to march on places like charlottesville, kasie. We have to remember in any sort of influence network, most of the conversation at any moment is about whats going on currently in that Audience Space and only if you look at really the links, the urls, the stories theyre sharing, thats where you start to see the influence. Mostly what ive seen this week is theyre more concerned about Alternative Media Personalities being pushed offer social media. Libertarians. Thats the main topic ive seen. So, ben popkin, you cover this in great detail, indepth, and spend a lot of time in corners of the internet that frankly im not interested in going myself. What examples have you seen so far of Potential Meddling as we head towards the midterm elections . Well, theres been different examples, as we saw in the tweet last night and you can see suspicious looking accounts, accounts with lots of numbers at the end of it, the boosting for
balderson. Weve had other examples, one of the very first was the Special Election in alabama. We saw some examples of where sort of kremlinlinked accounts were using some of the same strategies where they would take these madeup person as who would come out and attack the other candidate and there would be Amplification Networks around it. And we also saw the other attacks against the senators. There was the Spear Fishing campaign that was reported on. So its clear that there is well, not clear. There are signals that there is potential, you know, russian influence and interest in influencing the conversation around the midterms. But i would sort of caution against saying, heres a rerun of 2016 all over again. As dan coats, director of National Intelligence said last week, he said yeah, theres activity, but its really not at the heightened level and there
has been some signs from intelligence that russians are shifting some attention towards looking at our infrastructure, looking at attacking our utilities and electrical power grid and so forth. So i think something that is really important to keep in mind here is when were looking at russia, were looking at a weaker world power that is going to be using tactics of deception and distraction in order to kind of jujitsu america as a larger power. That involves making us think they are strong where they are weak and weak where they are strong. And so in 2016 the reason why the social a media attack was so effective was no one was really looking out for it. But now here we are two years later, weve been talking about it over and over again. All this attention is focused in on it, and its not that hard to
think that maybe they could lie low a little bit while we kind of all work ourselves up into a tizzy over it. Another thing you can always look at with social media, this is how the trick kind of has been played out in the past, if you get a link from a friend, you are trusting really your friend or your Family Member as the source of the information. But thats not exactly right because they may be passing you junk information. So always look at the Information Source and ask a couple things. One, have you ever heard of it, two, do you know where its actually produced . If you cant identify the actual
reporter, the person, actual location which the content is being produced, it is usually a good indication you might not want to trust that Information Source because its easier for them to dupe you if you cant be held responsible for the information thats out there.
