Hes not yet indicated what measure hes willing to sign. As soon as we figure out what he is for, then i would be convinced that we were not just spinning our wheels. All of this is happening as protesters gather on capitol hill, at least 82 people demonstrating in support of protecting the d. R. E. A. M. Ers have been arrested. Lets get right to Kelly Odonnell from the white house this afternoon. We just heard from senator Lindsey Graham who said he will not support another continuing resolution to push this government funding debate for another month because he said we can have a daca bill on the president s desk in 24 hours if that is what the goal is. But the question seems to be what is the goal . Reporter well avoiding a Government Shutdown is in everyones interest and the period of leverage is heightened in these waning days until the midnight on friday deadline where you have someone who has been at the seat of the table for Immigration Reform for many years. Not just this iteration which is Lindsey Graham where there is work already done that could be modified, offered up and voted on. So his position is that it cant be kicked down the road yet again. The white house has indicated that although it is not its first choice, the president would support a shortterm bump to get through to next month, allowing for continuing negotiation. We all lived through the Government Shutdown which has a terrible cost for everyone in real terms and in political terms sox the terms, so there isnt an appetite for it but there are such differing views and not an easy common bath to get something done to avoid it. So the shortterm band aid fixes is the most likely right now and then continuing conversations. Youve got the Freedom Caucus on the hill, which are the most conservative members who dont like this. The democrats who dont want to vote right now because they want to extract what their top goals are, a lot of digging in, but that is because it is wednesday. By friday things could look different. And in the next 24 hours or so we may see that the shortterm package is something that people can get behind. Not with the president what the president wants. The president is on capitol hill for an unrelated event. A ceremony to honor bob dole with a congressional gold medal. He and the Vice President are there. Good opportunity for some inface conversation to try to see where things are. So at this point, the white house is saying, no blame should go to the president if there is no agreement leading to a shutdown because they want to blame it on democrats. Democrats are saying the moment was here to resolve the issue with the young immigrants and it is the president or conservative republicans who arent getting it done. No one wants to give an inch and the stakes are high and the real world implications and consequences are dire if they dont get it together. So for President Trump, Government Shutdown is a real test and can he resolve it. And when he talked about being the business man president , this is the one differen difference between, they dont just shut things down. And the interview with reuters with President Trump and anything interesting. This is an inperson interview with the top roerpts, not on camera. A print interview where so far what weve seen of their initial reporting he talks about the issues with north korea, does not acknowledge whether or not hes had any direct communication with kim jongun, as unlikely as that is, and open to talking but does not think talking with the north Korean Leader would be very fruitful. He said while china is helpful, russia has filled any gap when china has tried to support the u. S. And so he said russia is not being helpful when it comes to north korea. Some important conversation there on International Topics with reuters and a chance for the president to comment on other news of the day. Lets get to casey who has been following developments from capitol hill. Casey, last night republicans put forward a shortterm funding deal that would fund c. H. I. P. For six years, something that stephanie and i think about because it hasnt been done. But it will repeal obamacare taxes an the issue is it does nothing for the d. R. E. A. M. Ers. Nothing on daca. So where do we stand . Reporter well, republicans said the deadline for helping the d. R. E. A. M. Ers is not this weekend. Democrats said it is. But republicans in the house have decided that they are going to put c. H. I. P. , a program for millions of children that has not been funded into this bill. A sixyear reauthorization with the idea it will make it harder for democrats to vote against. It and theyve tried to give concessions to conservatives. The obamacare taxes that you mentioned. The bebig question is whether paul ryan could get the 218 republican votes that he needs to pass this bill. That is going to require some negotiation from the Freedom Caucus. But ryan to focus on main question at the top of this, ryan said, look, we need a fix for the d. R. E. A. M. Ers. But it is one that the president is on board with. Take a look at what ryan had to say earlier today. Weve been very clear, we want to see a dack you solution. But a daca solution has got to be a balanced solution. It has to be a solution that also not just treats the symptom, which daca is, but the root cause of the problem in the first place. Look, i feel that it makes no sense for democrats to try and bring us to a shutdown. Reporter so as you could see, playing the blame game there. Saying it is democrats who want this and we still want to do it down the line but the question is whether the trust is there. As you know, trust in washington, not ata super high level right now. Let me ask you a question that a number of people have been asking. With democrats in the control of the house and senate, what is the rational for being able to blame democrats if there is a shutdown . Reporter essentially that they are taking a stand that is unrelated and you could see this playing out. Republicans came out of a Conference Meeting this morning, all kind of singing the same tune and saying this is funding for the military, why would you put the needs of a small group of people over the needs of defending the country when everyone is officially on board with the broader daca solution. The reality is political. Republicans have struggled with the issue of immigration for years. The Senate Passed a comprehensive Immigration Reform bill that then House Speaker john boehner never put on the floor of the house because of this restive group of conservative lawmakers known as the Freedom Caucus. And mark meadows has been doing what mark meadows often does, getting in the room with the white house staffers, he was in and out this morning, of those kind of negotiations. Here is what he told our Capitol Hill Team when he came out of one of those meetings. Take a look. Were engaging on an hour by hour basis to try to find some resolution. Im hopeful it will get there. I could tell you that no one in our caucus wants a shutdown. We just believe that it is time to start making some real decisions on behalf of the American People and now is the time to do that. Reporter his argument that they dont want another continuing resolution. Really, what you have here is kind of a tempest of three or four different critical issues, all tied up together, defense hawks are unhappy with the overall state of defense funding, that is why Lindsey Graham came out and said i dont want to support this continuing resolution which he went out of his way to clarify has nothing to do with immigration or the lack there of. The democrats angry about immigration but putting pressure on leaders, the Senate Democratic leaders to make daca a line in the sand but at the same time a lot of red state democrats dont want to be seen shutting the government down over it. So at the end of the day, very few answers to your many questions. And eat your wheaties. It will be a busy week. Casey hunt on capitol hill. Im working on it. Turning now to major developments in the investigation into russias election meddling. Former Trump Campaign manager cory lieu aewandowski as one of investigations that are going on. There are also developments in the special counsel investigation. Nbc news is reporting that fbi agents showed up at Steve Bannons home last week intent on surfi serving him with a subpoena but the agents were unaware he had obtained an attorney just hours before and they were redirected to bannons lawyer. Just yesterday he spoke to the House Intelligence Committee where he was requested for more than ten hours, although when i say questions, it wasnt a consistent ten hours because in many cases he refused to answer some of the questions he was asked. For more, i want to bring in Kristen Welker who contributed to this nbc report. What else could you tell us . Bannon could still end up and interviewed by muellers team by the end of the month. What is the significance of all of this. Reporter that is right. Right now hes dealing with two subpoenas. One from the special counsel, which would require him to testify before a grand jury. But by all accounts, bannon is signaling that he will cooperate with the special counsel and if, in fact, the offer is put on the table for him to be interviewed by muellers team instead of a grand jury, he would agree to that type of an option. Now, in terms of what happened yesterday on capitol hill, as you pointed out, he was answering questions before the House Intelligence Committee. And essentially his attorney determined that some of the questions were outside of the bounds of what the white house said it had discussed with the committee. Based on my conversations with white house officials, those bounds that bannon couldnt answer questions that relate to instances after the election. So during the transition and while he served here. Sarah huckabeesanders was pressed about this earlier today. Take a listen. This white house is following the same practice that many white houses before us have. That have gone back decades, that there is a process that you go through any time you have congressional inquiries touching upon white house, the congress should consult with the white house prior to obtaining confidential material. This is part of a judicial recognized process. We want to follow through that. Weve been fully cooperative with the ongoing investigations. And were going to continue to do so and we encourage the committees to work with us, to find the appropriate accommodation to ensure congress obtains all of the information that they are looking for. Reporter and so the question becomes what happens next. Ive been told that the House Intelligence Committee is speaking with officials here at the white house to determine what the parameters will be moving forward. And it is anticipated that steve bannon will be back on capitol hill for some followup questions. But all of this underscores the bottom line which is the investigations on capitol hill and by the special counsel are zeroing in on the president s inner circle. Getting closer to getting a final answer and determining whether or not donald trump is going to need to talk to anyone. Thank you very much for that. Kristin welker at the white house. I want to bring in nick ackerman, a special prosecutor with boughter gate and an msnbc legal analyst and partner with dorsey and whitney. Nick, for people who dont follow this as closely as somebody like you or we do, what is all of this parsing about whether he is speaking to the Intel Committee or hes being interviewed by mueller or going to speak to a grand jury, because my understanding is you cant lie to any of them. That is right. Whatever he says to one, whatever he said to the congressional committee, is ultimately going to the prosecutors and gos to the grand jury. What he says to the grand jury will not go to the congress. It wont go the other way around. But nonetheless, he has to be very careful what he says to the committee. Because all of that is going to be read and reread by the prosecutors. So he has a lawyer who is clearly got to prepare him for any of those type of interviews. It becomes confusing to people as to when Sarah Huckabeesanders said that we need to discuss the parameters wave is going on when bannon is before the house Intel Committee and his lawyer is texting with the white house as hes been asked questions and then on a piece meal basis declining to answer some of them, citing executive privilege. In the end, bannon has some kind of story. Can mueller get that story . I think he can. First certainly he claimed, as i understand it, executive privilege over the period of time between the election and the time that trump took office. Which was january 20th, 2017. Right. So during that period of time trump wasnt the executive. He wasnt the executive. So there is no executive privilege. Just like you dont have a lawyerclients privilege with somebody who is not a lawyer. So the only conclusion you can really draw from that is someone is trying to hide something and cover up something. And i think the obvious issue here is Michael Flynn. That was the time period when Michael Flynn was talking to the Russian Ambassador about u. S. Sanctuary shun sanctions. So what does bannon know about that. Why is the white house so concerned about keeping him talking from that period of time. So i think most americans or Many Americans would think that the information that gets to Robert Mueller is the information they are most interested in. The House Intelligence Committee has proved itself time and time again to be subject to some in fighting and politicalization. If you are Robert Mueller, where do you want to see the steve bannon testimony. Do you want to interview him or have your Team Interview or have a grand jury subpoena. Hopefully the fbi agents interviewed him when they served the subpoena. That gets some idea of how cooperative bannon will be. Short of that, they may make a reasonable Decision Just to put him in the grand jury. Because again, the wild card here is Michael Flynn. They know what Michael Flynn has said. They know what he can say about bannon. They know what he could say about trump. Bannons lawyer doesnt know of this. And what is the way out for bannon there . Pleading the fifth. Facebook has made some moves and i think twitter discussed today some moves to Contact People who they know, because they do know, who engaged in false information who were subject to false information during the election. Maybe information that was put on there by frol trolls or news that was known to be false. Where do we stand with that . It seems like they are doing a slow but deliberate rollout of notifications about russia influence through the platform and this is important to really bring to the awareness of the american public. Because remember, there are some people in this country, namely our president , that doesnt really believe it even happened. At the same point, this will also probably hurt trust with their platform and really in any of the social Media Companies, the thing they value the most is keeping that trust trusting relationship with the consumer. And so they will be harming themselves but doing the right thing when they do those disclose ires. So let me ask you this. I got into a discussion over dinner last night with someone who said you cant tell me any votes were changed. And i think they meant was that a ballot box in the 2016 election. It may not be resonating with anyone that votes changed at the ballot box in your opinion are are not the focus of this discussion. It is the votes or influns that may have been changed by these meddlers in our news and social media. That is right. There was no hacking of actually Voting Machines or changing votes. But at the same point, we saw Massive Movement and changes that were missed by polling that are hard to explain. And when you put it in the context of the social media influence campaign, they sought to push down clinton, push up trump. Tell Bernie Sanders suptsers he got a supporters got a raw deal and helped others show up to the polls in states with jerry man gerrymandering and this could have an outside impact in terms of changing the vote. Especially when we are talking about 1 or less decided some of the elections. So you could nudge and just a very small way. What is most important for the public to know in all of this is it is about eroding trust in our democratic institutions. And that is the most damaging part of this. The second set of narratives pushed by the kremlin was election rig, voter fraud, election rig and voter fraud. That is to make people believe their votes didnt counts, that they are not having a voice. That is and so for those people, including the president of the United States who do not take this threat seriously because they feel it relates to the integrity of the election, one has to separate the two things. Donald trump was elected and attempts at meddling were made in the french and german election and the dutch election. This is not a uniquely american or republican or democrat problem. No. Not only is it that, it is being repeated around the world. Were seeing massive political suppression happening in the philippines and general mcmaster brought up manipulation potentially in the mexico elections coming up. This is widespread and it is going to come down to Political Parties as well. If they dont use dark social Media Campaigns, there is no regulation against this in terms of ad disclosure, everyone will almost be compelled to run a very negative dark social Media Campaign against their opponent. The prosecutors say they suspect him of something far worse. Betraying u. S. Informants in china, leading to the death or imprisonment of approximately 20 people. But he may never be charged with espionage, which could carry the death penalty. National security reporter ken delanie broke the story. When i read it, i had to read it a couple of times. Im always reading the stuff you do because it is so good. But this was at another level. Who is this guy and what happened . It is a stunner. He is 53yearold jerry chung ching lee. And he was arrested on monday night after he got off a plane from hong kong in new york city and charged with a single count of possessing National Security defense information. That is based on the fbi finding two notebooks in his possession back in 2012 with highly classified information, including the names of covert cia officers and covert facilities. But he is suspects of something far graver. Of being a chinese spy and unraveling a network of cia assets leading ten of them to be executed. And it is being called one of the most significant breaches in american history. And this is going back to 2010 when the cia noticed they were going dark, they set up a task force and focused on lee. They searched his hotel rooms and found the information and interviewed him and did not charge him and he moved to hong kong with his family. It is not clear why he decided to come back to the United States or why they decided to file the charges but they are very serious and hes in custody now. Which leads me to the fact it is not clear why hes not been charged with espionage, why hes just been charged with possession of this information. And authorities are not answering that question. Because there are two possibilities. One is they may not be able to prove the case. Espionage is a difficult crime to prove. You almost need to have someone on tape handing the information over to the foreign handlers. The other possibility is they are often reluctant to go into court and expose these highly sensitive secrets in a public courtroom and so they settle for a lesser charge. David, the campaign, the steve bannon part of this campaign was about the deep state. The idea that there are entrenched interest in the government but we saw as Civil Service that do nothing else but perpetuate the idea that they remain in power and that is what we should be fearing. And i think weve been doing this for 30 or 40 years. Weve been making government into something evil. Government may have become something less efficient than other parts of the world but weve decided to in america dislike government and that spread around the world. Well, yes. With the rise of rond reag of reagan is the government is the problem. He pointed to a guy that helped save someone in the airplane crash in the Potomac River in the snow and the cold. But his Budget Proposal would reduce the benefits for some disables veterans from say 35,000 a year to 13,000. He has his administration has taken side of bankers against students in the student loan crisis and who did they bring in to address this . Executives at the very companies that were engaging in the worst behavior. Hes moved against pay day the rules on pay day lenders with Mick Mulvaney and said there would be no cuts to medicaid and well see cuts to medicaid. And all the way across the board, i show in the book this stuff. Which you dont see. That is why i use the termite analogy. And in this business we cover what the president said, what the controversy is of the day and but not what is happening to our government. Keep in mind it is our government. We dont have ambassadors in places around the world including south korea. In south korea, saudi arabia, jordan, libya, when big deals are being made or National Security issues, we dont have the people there. And why . Because he summarily fired everybody. But that means that it is also reflective of his view that the soft power that has been so important to the United States over the last 75 years, the ambassadorship and the influence, that is less important than military. And that goes to his appalling ignorance about things. No one is a bigger friend to china and its economic ambitions than donald trump. He killed the tpp. And i was a critic, but not to kill. It but to fix it. Hes done nothing. And in this vacuum, china has stepped forward with the region cooperative Economic Policy and the countries in the pacific are now tilting away from us and toward were interested in having america play that role so they wouldnt have to lean on china but they have to lean on somebody. They have to go with the realist world. There was something in your book that talks the conclusion and said great social waves like tsunamis cannot be stopped by holding up signs in protest. They must instead continue until their destructive energy dissipates. Our hope must be that the future will produce better leaders, not worse. It is a little fatalistic. But you are saying that is not the answer. No, it is not alone the answer. Im an in curable optimist. You cant have eight children and not be an optimist. But what matters is organizing and having candidates into the polls. The republicans are good at this for the last 40 years and doing the knitting and the democrats are lost about what to do here. Donald trump hopefully is an anomaly and our country will endure and get past this. There is a lot of damage and well get past it. But if we dont get past it, then someone who doesnt have Donald Trumps deficit, somebody who is smart and really does know things and who shares his values, which are aggressive, self centered and focused on money as his son himself said yesterday, then we could slide into being a very different society. Our individual liberties and our freedoms stem from our government, from our constitution and from the enforcement of its rules. And so it really matters what whether we respond here. Griping and moaning and posting on the internet doesnt get you anywhere. Does it alarm you in the background, donald trump if he were to actually articulate, and he claims everything as a success but one of them is the appointment of federal judges. And in fact, a move to actually create more openings to fill. That is something that will live with us for 50 years. Yes. It is a real problem here with the democrats have generally agreed that anybody qualified to be on the bench and the republicans said were not going to prove anybody that doesnt meet the litmus test and including some republicans that were denied and qualified and except they didnt meet certain litmus tests. And these are longterm apointies. Chief justice of the United States, roberts is playing a long game. I read his opinions. He is clearly setting up future litigation to direct it the way he wants it to go. He is a serious guy. And if you want to have a country in the future where the human spirit is ennobled to see what people could become, you cant go down the road of the jungle roberts wants to go down or the road donald trump wants to go down. You have to promote individual liberty, and you have to focus on the Economic Needs of people. As Congress Tries to avoid a Government Shutdown this very week. It is wednesday. The government could shut down from friday becomes saturday. Joining me is garrett haake. First of all, just give me the odds on this. What is it looking like . Every month we seem to discuss this. Is it likely or possible that the government will shut down on friday night into saturday morning . Ill say this, it seems more likely than in any of the previous months in which weve had this similar conversation for a couple of reasons. Number one, there is no real hard deadline. People arent trying to go home for the holidays, there is not as much pressure on lawmakers to get this one solved right now. But really mainly im hearing a lot of pessimism from republican senators who are usually folks who are in the mix, optimistic, involves in the conversations like mike rounds from south dakota, who i spoke to a little while ago, told me he is not optimistic about this. The math on the senate side is really hard to figure out. Getting to 60 votes is tough when sindly graham said he wont vote for this and democrats dont want to vote for this and john mccain is not here in washington, at least not yet. Scrambling in the senate where they will need bipartisan support for anything to pass is a tougher road to hoe than personally in the house side where republicans are a little bit more optimistic they could keep the government open with republican votes. Now as it comes to the daca deal, that is going to be even more challenging. It is pretty clear that the president the well has been poisoned with the president on the grahamflakedurbin effort. They are preparing to roll out a couple of more republican sponsors for the bill but im hearing from republican sources that they dont think that that their proposal is conservative enough to pass in either chamber. That puts pressure on the other bipartisan group, all of the number twos from the house and senate and both parties to come up with something else. And i dont hear a hear a lot of urgency by friday which is a long way of saying good answer but it is more likely than weve had this similar conversation. But like casey youll eat your wheaty this is week. And in a conversation, trump said Lindsey Graham meant well in immigration talks but he doesnt represent a majority of the republicans on issue. The deal was the opposite of what i campaigned for on immigration and was unacceptable. To what degree does what the president said about this deal matter to the deal and the potential shut down . It matters a lot. Look, hes right about Lindsey Graham. The only person to the left of Lindsey Graham is probably jeff flake. And you have some of the more liberal republican senators on immigration negotiating with the democrats and they dont necessarily peek speak from the tom cottons and others and there saying im not Going Forward with something im not sure the president will support and the president has not been clear other than to say hell sign what gets to his desk but said conflicting things about the wall. He said conflicting things about what is a an acceptable amount of Border Security. Everybody is looking to the president for leadership on this. And they are looking for him to speak clearly about what he wants and so far they are not getting it. Garrett, i suspect well be talking a lot over the course of the next few days. Garrett haake. Lets go to axios reporter Jonathan Swan outs with his new report. He joins me by phone. Jonathan, this was long testimony that seemed to bob and weave and there were questions asked of steve bannon that his lawyer was checking whether he could answer with the white house, the white house was at some points telling him not to answer. Tell me what the picture was in there. So, they walked into the room. This is from four sources with direct knowledge of the proceedings because obviously it was a closed door hearing. It was the house intelligence hearing and nobody had phones in the room. But they walked into the room, bannons lawyer in his opening remarks said we will only answer questions about the campaign, nothing about the white house. Or what happened on the transition. But what hasnt been reported and we just revealed is that bannon made one big slipup. He answered one of their questions that related to his time in the white house. He admitted he had conversations with reince priebus, the former chief of staff, sean spicer, the former press secretary, and the legal spokesman, mark krel owe, about don junior and kushners and manaforts infamous meeting at trump tower with the russians. Thats important because this meeting and the subsequent drafting of the misleading statement of air force one, has become one of the most important focal points of the investigation both on capitol hill and within muellers team. Bannon, im told, immediately realized hed made a mistake and basically clammed up after that. And the rest of the session involved republicans and democrats hammering him over the fact that he was saying that now its executive privilege, he cant talk about it. Why but why did he care about executive privilege when he leaked prolifically to journalist Michael Wolff in his tellall book . That was a very tense hearing, im told, and to make it even more dramatic, in the first 90 minutes that New York Times story dropped about the grand jury subpoena of bannon. But no one in their room had phones because its protocol. An official walks into the room and tells the committee about this story, and they pause the hearing and, you know, there was a scramble.
