Im going to do everything i can to see that that terrible legislation is defeated and move this country to where every other major nation on earth is and that is guaranteeing health care to all people as a right, not a privilege. Lets get right to where all the action is on a friday afternoon. It is in washington, d. C. Cassie hunt is squeezing in time to talk to us. Shes been all over capitol hill talking to lawmakers. Senator heller saying in the form it exists hes not voting for this bill. What does it mean . Reporter some pretty significant news here from senator heller. He was i would say remarkably straightforward in his press conference that he just held with the governor of nevada, very direct, saying this bill is not the answer, making the argument that it would gut medicaid which he called an Insurance Program for tens of thousands of people. There are hundreds of thousands of people in nevada on medicaid and he quite frankly is facing the toughest reelection fight probably of any republican senator who is up for reelection in 2018. That is a lot of pressure and he is on the more moderate side of the spectrum. We were expecting that this was likely going to be what would happen with senator heller, Republican Leaders had privately been hoping that they would have the votes that they needed to pass this bill and they would be able to let him take this route and still be able to get those 50 votes they need to pass it, but this was a surprisingly aggressive straightforward repudiation of the language in this republican bill and i think that tells you a little bit about the pressure heller himselfs under but it also tells you about the bill itself, that there are these mounting concerns theyre really are some major longterm changes to medicaid. I know weve talked a lot about the medicaid expansion, that of course was part of the Affordable Care act but this republican bill would slow the growth of medicaid as a program and thats a major change to something that had already existed. Now the question of course even if they can get this through the senate, is there any chance it could then pass the house again . I spent the morning trying to find out the answer to that question. Take a look. Were going to try and find that for you. Sorry about that. I guess we dont have that. Let me ask you something really quick. Senator heller becomes the fifth person to say no at least in its current form. There are some doubts about a couple of other senators. How many can vote against this bill and still have it passed . Reporter so back to basics. If three republicans vote no it wont pass. Remember they have 52 senators, mike pence is an additional republican vote, so if they hit 50 republican senators then they can bring mike pence down from the other side, have him be that 51st vote and pass this bill. Ond other side of this you have those four conservatives. They are saying, we cant support this in this current form either. They want to try to negotiate to make this bill more conservative, rand paul yesterday saying this doesnt do what i promised. It doesnt repeal obamacare. So if they try to move these negotiations that way then were going to start to really zero in on those other moderate republican senators that we have been watching. Weve been talking about them all day. Rob portman of ohio, Susan Collins of maine, Lisa Murkowski of alaska concerned about the planned parenthood funding. If they try to make concessions of those four conservatives, then theyll start to start counting very carefully on the other side. Folks like heller, republican senators who are more moderate, i want our audience to listen to a bit of your conversation with senator heller earlier. Lets listen. My point of being here today is to tell you that this bill, this bill is currently in front of the United States senate, not the answer. Its simply not the answer, and im announcing today that in this form i will not support it. Our first vote on this piece of legislation may be as early as tuesday. Well have a procedural motion that we dont need to get into its called getting on the bill so we can have a final bill sometime on friday. If this is the bill, if this is the language of that procedural motion, on tuesday i wont be voting for it. This is complicated. Youve got this handful of conservatives that dont think its conservative enough and they want this bill passed by the end of next week. Reporter this is a very complicated political calculus with very serious stakes. We are not talking about a small legislative change. Were talking about health care for 23 Million People potentially affected by this bill and it all does come down to threading this needle between the moderate side who want to make this bill more generous and the conservatives who think it doesnt go far enough to change the health care laws. And they are trying to put this incredible time pressure on it because frankly republicans havent gotten anything done of significance thats been able to break through since the president was inaugurated and they want to hank that. Health care has been a toxic debate for them. Mitch mcconnell knows that he wants to move forward. They want to use this bill to lay the ground work for the rest of their agenda. Lindsey graham said to me yesterday. This is not like fine wine. It does not get better with time. If they spend the rest of the week debating and go home for the holiday, they will get hammered at home. The fact is the president started it by tweeting, this is a good bill im behind it e obamacare is dead. Whats happened since then . Reporter there is an air of being willing to negotiate which is not a surprise. We heard from press Secretary Sean Spicer that the president s view is he wants to get this passed and move on to whats known as the conference where the house and senate, if they each pass a bill that is substantially different, they work on a compromise and then pass that and that heads to the president s desk. Thats leaping ahead in the process but what is notable is that there is a sense of not talking about specific elements of the legislation, not talking about specific lawmakers they want to bring along but a spirit of saying, those who have concerns lets try to address them. You got a sense of that today in a clip the president did on fox news. Were now up to at least five. Heres the president. I think were going to get there. We have four very good people that its not that theyre opposed theyd like to get certain changes and well see if we can take care of that. Reporter so that notion of negotiating among those four that he was referring to there and then weve just talked about dean heller of nevada is rand paul who i have seen here at the white house going on a golf outing with the president , so theyve had a personal relationship that might be use of in trying to find ways to get some Common Ground on things and certainly not a surprise to this white house or frankly to his senior senator in kentucky that would be Mitch Mcconnell of where rand paul is at. At this point the senate bill was the first sort of senate side opening up some negotiation. As casey laid out not much time but theyre trying to not call it more dead on arrival but more of a work in progress. The first attempt from the house didnt go through. It didnt even get to a vote. It happens this way sometimes. Kelly, casey, thank you very much. I want to discuss some of the winners and losers in trumpcare as we call it. Its important to understand there is a good argument that this is an unusually big win for the wealthy because despite the fact that there is gop pushback on this particular point, trumpcare kills a handful of obamacare taxes for investments for families making 250,000 or more. Not only do those go away but, in fact, theyre dialed back for contributions that have been made in prior years. Its an unusually generous payback for the wealthy. Other winners in this bill include the young who now dont have to buy insurance or face a penalty for it. Healthy people who dont have to do the same. The senates bill removes the penalty for not buying insurance which means you can take your chances and save your money. The losers are very similar however. Health industry groups, the Health Industry groups are also a winner. Theyre going to see some benefits from trumpcare that eliminates obamacare taxes on insurers, medical Device Companies and brand name drugs. Let me get you to some of the losers. Some of these are the same people it used to be. The poor and the old continue to suffer under this deal. Trumpcare will lower the income limit on people who get subsidies to about 42,000 for individuals, those realizing on medicaid will also be hit very hard with larger cuts than the house bill had to medicaid coming in starting in 2021 and going out beyond 2025. Insurers will also be able to charge older people up to five times more than they charge younger customers for the same health insurance. So it is going to cost you more if youre old but not old enough to get medicare. The cuts in medicaid are going to affect those battling addiction. Why do i have to pay for addiction treatment, im not planning on being an addict. Many people who are receiving a treatment rely on medicaid to pick up the cost of that treatment. Another loser is planned parenthood and its clients. The plan defunds planned parenthood for a year. Theres a talking point out there that planned parenthood is all about abortion. It does offer other services and unlike what some republicans have been saying there has not been a decrease in the other services and an increase in abortion. There has been increases and decreases to a number of services they offer. Is lets 1. 1 billion prevention and Public Health fund. That is 12 of the centers for Disease Control budgets. It pays for Public Health scare like the zika outbreak. I want to bring in someone this bill would profoundly affect. Hes a democratic governor from colorado. Governor, i want to get a sense, you know, as Kelly Odonnell said, i want to get away from the larger concepts here and get down to how this is going to affect americans across the country including the residents of colorado . Well, we look at the affect on colorado its going to be significant and negative. Clearly when you take away that many people coverage from that many people with medicaid, it disproportionately affects our rural areas and as you point out earlier is going to disproportionately affect the Senior Citizens especially that group from 50 to 65. When you begin to ratchet down the coverage. Ultimately i thought the idea was they were going to try to improve obamacare and find a way to make a Health Care System that was better. This seems really mostly just a large tax cut for some of the wealthiest people in this country. Ive talked to a bunch of them in colorado. I havent found one person yet that says i need that 3. 5 or 4 back. I cant live my life without that, without a tax cut. They dont they may care theyre happy to have it, but that shouldnt be driving such a tremendous change to health care. Senator, youre a business man so you understand a lot of these things that go through the senate and the way i think about them economically. Colorado is a Medicare Medicaid expansion state. About 450,000 coloradoans have medicare coverage. Roughly a quarter of them use medicaid. In some rural countries that is up to 54 and 41 . You mentioned something thats really interesting that those of us in cities dont think about, there is some countries that serve multiple counties, the majority of their payments come from patients with medicaid coverage. Those kinds of facilities in some cases could disappear . It could have a devastating affect on health care in rural parts not just in colorado but across the country when you couple that with the fact that theyre going to take away the coverage for things like addiction, right, so look in rural colorado, Rural America at the Opioid Epidemic and how much of thats led to heroin addiction and now all of a sudden well take away a lot of their the infrastructure by which rural parts of america get health care and well take away coverage for their ability to fight these dakss around opioids thats like a onetwo punch. Whats the benefit . In what ways are we improving the Health Care System of america . Wheres the beef . I just called you senator in the hopes that maybe you would take some of this and go to the senate, in fact, youre a governor and one of the arguments that a lot of the senators are using is that this medicaid the way its not a cut, its not cuts to medicaid. Its a transfer of responsibility from the federal government to the state governments that allow you to make better decisions on behalf of coloradoans and across the country. Tell me the flaw in that argument as some would say why not. Arent you in a better decision position to make decisions for colorado than washington . Theres a crazy argument. A number of us have joined together to write a letter saying, hey, lets let republican and democratic governors Work Together on this, were the ones that have to implement this plan. We want flexibility but you cant just cost shift and take all the funding that the federal government has been a partner in providing and say well put this all on the backs of the states because i guarantee you the states cant afford to do it just in one step like that. Its got to be a gradual process. Most governors realize that weve got to find a way to slow the inflation of medical costs at every level but, you know, medicaid is always been a partnership and we couldnt get to the coverage we have now if the federal government hadnt come in with that 90 and to say now well go back to 50 in three years, thats cruel. That is just cruel to all these people that are going to lose their coverage and many of them with preexisting conditions will have no place to turn. You governors cant run deficits in your states the way the federal government can. We cant pick it up like that quickly. We just cant. Good to talk to you, thank you very much. It wouldnt do justice to have you explain it here because its such a detailed report but in a nut shell what were the options that the white house had at its disposal in terms of russia. Reporter some of the more forceful options included sector wide economic sanctions that would have perhaps really taken a dent out of russias economy by hitting entire sectors like banking or defense or i. T. Or you could possibly done some very forceful cyberattack type of options that would have disrupted portions of russias National Security networks why why did they decide against. Why did they decide against telling people . There was some discussion about actually going public with this and when they did decide not to tell people about it, why did they decide on modest responses as opposed to forceful responses . That was the big debate over the summer whether or not to go public with the news that russia was behind this influenced campaign and b whether to do something about it. There was great debate and agonizing over it. There were a number of officials especially at more junior levels who pushed hard for attribution as we call it or publicly naming russia, but at the senior levels, at the top, all the way up to president obama, there was a reluctance to do so for a number of reasons. One was fear of potential retaliation or two, the idea that if they went public, they might be seen as part overtly partisan or getting involved in a already hyperpartisan election and seen to be putting the thumb on the scale for Hillary Clinton. The third element was the fear that if they did go public that maybe they would be essentially doing russias work for them by saying russias interfering in the campaign, does it then make it so in the minds of the public. Kelly, that sort of the idea of russia putting the thumb on the scale in favor of Hillary Clinton sort of something that donald trump ran with today, the idea that Robert Mueller is in cahoots with james comey which is why he didnt think this Russian Investigation is fair at all . Reporter well, this is a line that the president is trying to walk. He is trying to raise some doubts about Robert Mueller by pointing out that he is friends with james comey also indicating there is some on the mueller team, lawyers who have been brought on to be part of the special counsels office who have been affiliated in some way working for Hillary Clinton. Trying to raise the notion that perhaps he would not be entirely impartial even though Robert Muellers reputation has been sterling. The president has also called him an honorable man. He talked about where the president s thinking is right now when it comes to russian interference. We know that the 17 intelligence agencies say it was, in fact, russia. It was russia who set out to meddle in the election, not other state actors even though they have that capability from the president we have not heard that as definitively. We asked sean spicer to check with the president in recent news conferences and he said he did have a conversation with the president and here was his response. Is he still ruling out firing the special counsel . Nothings changed on that in terms of his position. And his position. While he retains the authority, steve and i had a healthy exchange, but that he is no intention of doing that. Does he seem to suggest this morning that there might be a circumstance under which mueller should take himself out . I dont thats one obviously id refer to Marc Kasowitz in terms of the president s legal strategy on that. Thats a reference to the president s outside lawyer. As it stands today is the white house is saying the president wants to retain wants to acknowledge that he retains the authority to fire the special counsel, but has no intention to do so. There has been some question about whether the president has that direct authority or if it would have to reside with the head of the department of justice who Jeff Sessions is recused himself so then it falls to rod rosenstein. What theyre trying to say here is no immediate plan to do anything to change whats happening with the special counsel, but raising some concerns about might they be tipping the scale toward the comey version of events. You estimate that there are about 2 million americans who are being treated for cancer who are cancer survivors who realize on medicaid. As you look at this bill and those patients, what do you see . Thanks for having me. Well see a lot of americans lose their insurance. Theyre going to lose their coverage. Certainly many of those people are going to be Cancer Patients and survivors. As you said, 2. 3 Million People with a history of cancer are now covered by medicaid and thats not even talking about the people in private insurance who will see their premiums go up, become unaffordable, copays will go up, certainly and deductibles. Its the both the house bill that passed in may and the senate bill that was revealed a couple of days ago, are very, very troubling for patients with cancer and other diseases. You just mentioned people who have insurance. Part of this bill is that it removes some of the lifetime caps on coverage, even for people who get to keep their insurance because they had a preexisting condition. In cancer, thats a very big deal because there are some cancers that if theres a cap on coverage and youre insured, thats it. You could be wiped out. You bet. Before the Affordable Care act was passed in 2010, a full 30 to 40 of families who experienced cancer went bankrupt because their medical expenses. And that changed with the passage of the current law. We go back to a situation where plans dont have to cover such things as expensive cancer drugs or Cancer Screenings. Those plans are going to be unaffordable or to Cancer Patients and theyre going to go without. Were going to see people suffer trying to pay their bills. Senator Mitch Mcconnell was asked to meet with a number of groups representing treatments and fights against certain illnesses including the American Cancer Society. Had you and your organization had an audience with senator mcconnell whats the message that youd want him and the other senators to hear . I think wed ask the senator to be aware of the concerns of millions and millions of patients around the country who have to have insurance or they have worse health outcomes. It winds up costing the country much more in the end if we dont take care of things upfront. If people cant get their mammograms or their colonoscopy, they wind up getting stage 3 colon cancer. Theyre far greater burden on the nation. It doesnt make sense to be pound foolish with health care. Everyone needs health care. Everyone ultimately will have a preexisting condition. It doesnt make sense to exclude them. I want to talk to you quickly about planned parenthood. One wouldnt necessarily think that has to do with cancer but for many women planned parenthood provides basic health care needs, the kind of stuff that i would go to a general physician for. What role does planned parenthood have in Cancer Detection . I know that they do mammogram screenings for thousands of women every year and its for many of those women its the only place they can get those screenings. Cancer screening. Mammograms. Just looking at the numbers in 2014 to 2015, planned parenthood did 682,000 things that worked in the category of Cancer Screening and prevention so that is an interesting point. Good to talk to you. Theres an issue going on, however, with a number of iraqis who are in the United States and about to face deportation. I want to bring in the Deputy Attorney director at the aclu to tell us about what this story is and why these iraqis were scheduled for deportation and whats happened. Lee, what is this story and what are these iraqis, why are they facing potential deportation . So the judge yesterday blocked their deportation and that was critically important because what theyre asking for is time simply to make out their case. They are facing persecution, torture and possibly death and the United States government is rushing them back to iraq and even worse sent to a federal court you dont have authority to stop it. The court rejected that and issued a stay. Now the reason they are being sent back to iraq now is because as part of the travel ban, the iraq was dropped from the first ban to the second ban and as part of that deal, iraq agreed to take back nationals who have been here for decades who have not been sent back before because iraq wouldnt take them. And so these are individuals who admittedly have removal orders and theyve been living here peacefully for decades because iraq wouldnt take them back. Iraq now decided to take them back so the Trump Administration rather than giving them time to make out their claims said were going to rush you out, even though they have u. S. Citizen family and kids who have been living here decades who were born here and did not give them any time to make out their torture claims and the judge rightly said, look, why are you not giving them time to make out their claims . Why not give them process . And thats all were asking for. Its fairly limited. Just give them enough time to file papers. The government used the same argument at least part of it that their using on the immigration ban, that the court doesnt have the authority. The court obviously rejected that assertion, in fact, the judge said that they need this halt for two weeks because its a complex legal issue but the potential, physical harm that these depour tees face far o outweighs the governments needs in this case . Youre exactly right. The issue here and the government position transcends this particular case. The government has been arguing around the country that federal courts do not have authority to step in even where an immigrants life may be in danger. Which is crazy for you at the aclu . All you depend upon is the courts ability to maintain the truth . Right. We need the courts to be there and fortunately since this administration has come to power, the courts have pushed back and said, we do. That doesnt mean well win every case but its critical for our system of checks and balances that the courts play a meaningful role and this judge said right now i have a meaningful role to play, a Critical Role to stop these deportations and i think the wruj really got how much harm these individuals may be in, even threatened with death if theyre sent back. Jurors have said they were deadlocked after more than 30 hours of tliks. The judge ordered them back in earlier in the day after the first time they said they were deadlocked. Ray tensing, the white Police Officer was charged with murder and voluntary manslaughter in the 2015 fatal traffic stop shooting of sam dubose, an unarmed man. The prosecution and defense both agree that tensing shot him in the head but im sorry, that it was in selfdefense. Tensing said he feared for his life when dubose tried to drive away from the traffic stop. First trial also ended in a mistrial because of a deadlocked jury. After yet two more election losses in georgia and south carolinas congressional races for democrats, some people in the party are growing vocal about a need for a change in leadership. The problem with the democrats is that they are not focused on local levels. When you talk about city councils, state reps, state senate thats for the major losses have been. Republicans control 31 gubernatorial mansions. Thats where the changes are being made. So we saw in 2008 lots of intensity for senator barack obama and for senator Hillary Clinton. But after obama wins, he abandons texas. We saw it. I saw it im a native of texas so they got away from what howard dean kept saying, a 50state strategy. You cannot have a focus from d. C. It must be local, state, national. So as leadership of is leadership of the party going to be pew to the pulpit . Im going to put on a few faces. This doesnt mean anything. These are people who have been big voices at the top of the Democratic Party elected or leaders of the party. Where are we getting the next leaders of the Democratic Party from . Because we need somebody around where the message coalesces. Whether or not you like donald trump, at least we have someone to whom a message can be put forward. Its not an individual with a message. You dont need a leadership position to be a messenger. If youre congressman tim ryan, if youre congressman cedric richmond, congresswoman joss beatty, the question is what are you saying when youre talking, are you presenting an agenda . That whats matters. But also democrats have to understand youre not going to have everybody looking like senator Bernie Sanders. You wont have the perfect progressives and liberals. If youre running in texas and mississippi theyre going to look somebody than running in ohio or new york. Thats what you have to have. Heres the other thing its about to get real up comfortable for democrats. They have to stop chasing this epic white voter. They went to its tom perez, keith ellison, Bernie Sanders. You had the latino and a black guy and a white guy trying to say lets recapture the white trump voters. You better go after people of color. Hillary clinton had she put the resources targeting people of color, she could have won wisconsin, michigan and pennsylvania. Thats where they failed. Thats how they win. Black people are tired of being the side piece for the Democratic Party and tired of being political sharecroppers. If democrats want to win they have to drive turnout.
