A surprise meeting between the leaders of north korea and south korea. So where does that leave the u. S. And its on again off again summit with the north . Now Rudy Giuliani suggesting now ground rules for a sitdown between President Trump and special counsel robert mueller. Stand proudly for the National Anthem. You shouldnt be playing, you shouldnt be there, maybe you shouldnt be in the country. New reaction to the nfls decision to demand players stand for the National Anthem or stay in the locker room. Well look at what might be behind the policy. And the Harvey Weinstein saga. Some pointed responses from some of his alleged victims coming up next on msnbc live. Breaking news out of the korean peninsula. This new video from a surprise meeting between south korean president moon jae in and north korean president kim jong un. Two reports for you, one from the white house and nbcs kelly odonnell. But first to Janice Mackey fryer in seoul, south korea. Give us some details that are trickling out from this meeting. Well nobody knew about this secret meeting. If we look at the first summit that happened between moon jae in and kim jong un, it was highly choreographed. Very tightly scripted. This one seemed to come together overnight. Moon jae in actually went to the north korea side of the dmz for this meeting. Shook hands with kim jong un. They met for about two hours. Apparently discussing very frankly, how they could implement the agreement they had signed on april 27th, and also, how they could move forward toward an eventual summit between kim jong un and President Trump, and then at the end of the meeting, the two men embraced, it was a very warm hug. There were a lot of smiles, and people seemed to be pleased with the outcome of it. Lets contrast with what happened in the last 48 hours of this roller coaster ride. President moon jae in had been taken completely by surprise by President Trumps letter, calling off the singapore summit. He actually used the word embarrassed. In the hours after that, he called an emergency meeting from which he emerged and said that he believed that direct talks with north korea were the only way forward. And that south korea was going to make every effort to continue to do so. Lets bring in the messaging weve had from china over the last several days. Also saying that china wants to harness the momentum thats been established. The diplomatic momentum thats been established, over the past several weeks in talking directly with north korea. So what we have now is kim jong un having successfully coopted two regional players. And they have different outlook on what it is that they want from north korea. Certainly they want denuclearization. They want the level of tension to be ratcheted down. But theyre also primarily looking for economic projects and economic partnerships and theyre willing to have denuclearization happen in a more phased approach. President trump of course had been very adamant that north korea was going to have to give up its Nuclear Arsenal all at once. That did not sit well with the north. Caused the change of tone and of course all of the events that had kept us guessing over the past few days. Janice mackey frayer, thank you for that comprehensive breakdown of the meeting. Lets bring in nbc White House Correspondent kelly odonnell. With reaction from the white house. Ive reached out to officials here and we have not heard any response on the new developments within the last few hours that janice just laid out. But that is exactly what the white house has wanted to see, where allies would respond. Weve seen the abrupt way that donald trump canceled the meeting the other day was a jolt, a surprise even to moon as janice explained and it has resulted in some of the things the president wanted. He had according to our sources wanted to be able to pull away from the bargaining table before kim could do it. Snapping things back into a way that he would believe is more favorable to the United States. Because they were very frustrated that the north koreans had not been communicating behind the scenes last week as anticipated. And of course it was kim jong un who had put out a statement critical of the Vice President and threatening a nuclear showdown. Thats what prompted the president unannounced to make this letter to kim jong un public where he said its over. But then we watched how things began to change. The president speaking to reporters on the south lawn described some of what is playing out this morning. Listen carefully to what the president said about the possibilities of getting this on track. Is the summit still on . Were going to see what happens. Were talking to them now. It was a very nice statement they put out, well see what happens. It could even be the 12th. Were talking to them now. They very much want to do it. Wed like to do it. Were going to see what happens. Everybody plays games. You know that. You know that better than anybody. So implicit in the president s statement that everybody plays games, is the notion that this could be tactical on the president s part. Wanting to jolt the noikrth koreans into a different approach. Wanting to get china to take a different position, there was some concern that chinas involvement may have been what set the north a little bit offtrack. Also today from the president , were getting more of this sense from the most recent tweet on this subject, where he writes we are having productive talks with north korea about reinstating the summit. Here again you see the president referring to it. Likely remaining in singapore and on the same date. So that keeps things right as planned. And then if necessary, well be extended beyond that date. That is notable in part because if time has been lost in recent days, some of the officials here have suggested that a lot of the work behind the scenes was set behind, because the north koreans were not responding and now weve had this back and forth. So that suggests its possible, you cant get it all done that quickly. Or perhaps the two leaders, if they do meet on the 12th would agree to some kind of a framework with additional work to still be negotiated over time. Those things we dont yet know, those are questions that are out there. But theres certainly some concerns from officials in the u. S. About how much can be accomplished in these next couple of weeks. And today it would appear with the help of president moon and south korea and other things happening behind the scenes, that at least theres a willingness to see this on track. Alex . Kelly odonnell at the white house. Joining me now, aisha racicot, White House Reporter for npr and jeremy peters, reporter for the New York Times and an msnbc contributor. Jeremy to you first, what do you make of this surprise meeting of the koreas . I think this is probably a general rule alex that we should keep following this to stop being surprised by anything that comes out of this white house. President trump has been treating this meeting, not with the kind of the level of caution and apprehension that you would ordinarily see from a president. Kind of like he treats most other endeavors he undertakes as a president. I do think, though, that there was kind of a rush to declare this meeting over before it had even started. And the terms all agreed on before anybody had actually sat down at the table. And that glossed over a lot of differences inside the Trump Administration at the highest levels, the secretary of defense, the National Security adviser, the secretary of state and the president himself about exactly which direction to go in. I think a lot of this is getting worked out, as the president said, everyone plays games and i think thats whats going on here right now. Theres some brinksmanship. Theres a lot of like, a lot of moving around behind the scenes. As the president said, well see what happens. Aisha, im curious about the reversal whiplash weve seen yesterday on the north korea summit. What do you think changed between the time the president announced, its done, im canceling it. To then hinting in the sound bite of, well see what happens, the meeting could be back on. The north korea put out a very nice statement, seeming to be more conciliatory. Towards the u. S. And saying that they would be willing to meet any time. So north korea walked back from some of the more kind of hostile rhetoric that had, that they had been putting out, i think that President Trump responded well to that. And remember, the white house was saying that they werent even hearing anything, from north korea behind the scenes in the week leading up to the meeting being scrapped. They were dealing with that. Then had you, so i think there were concerns that north korea was pulling back from the meeting. I think after the meeting was officially called off, they seemed to now be getting more warmer signals from north korea. I think thats part of the change. The question is, have some of the key disagreements actually been broached and are they going to somehow find a way to find some Common Ground between what the u. S. Wants and what north korea wants. Okay, lets get to this weeks controversial doj briefing with congressional leaders. You had Rudy Giuliani telling the press that he hopes to get a read out from all the information of the meeting p particularly the use of a longtime government informant. Whats the calculation here, jeremy . Scorched earth. This is what the president has been wanting to do for while now. Its what Rudy Giuliani has been trying to do since he came onto the legal team and what some of the other aides around the president have cautioned him against. And thats just really taking a blow torch to the fbi, to Law Enforcement and bob mueller, saying its not just a witch hunt. But these people running it, are dishonest and they were engaged in an act of espionage against a president ial candidate, the likes of which we have never seen in this country before. And thats just really an intensification of rhetoric, that we havent seen even from this president. And behind the scenes, theres been an effort, a coordinated effort, to push that message out, not just from the very top, from President Trump, but on conservative media. In mainstream media, and an effort to discredit the investigators. And its really kind of unfortunate. The president has basically decided, hes declared war on the institutions that are supposed to hold the powerful to account. And thats not just congress. Its not just Law Enforcement. Its the media and anybody who basically tries to question whether or not the president is taking the right approach. Mitch mcconnell went to one of the two classified meetings on thursday, expressing confidence in the mueller investigation. Is that the consensus among republicans who attended that meeting . How much does mcconnells statement undercut the president s argument that suggests something nefarious was going on . Well there are definitely republicans who are supportive of the mueller investigation. And as you said, you have senator mcconnell and others expressing backing for him. The problem is, the president has repeatedly or the issue, the president has repeatedly attacked the investigation, attacked the probe. And Congress Really hasnt been willing to do much about it. They will talk and say that they support the probe. But they havent passed any legislation, anything that would actually protect mueller from being fired. I think that the president is looking at this as he can kind of test some boundaries. He wants the focus to be on the investigators and not necessarily on what the investigators are looking into. So jeremy, i read a report that the president was quite calculating in his use of the word spy gate or spy. Thinking that that rhetoric would be what reaches his base and gets his message out as he tweets and talks about this. Is there evidence thats working . I think there is. I really do. I think that if you look at the way that the president is perceived by, call it 45 of the country, they see a president who has north korea on the defensive. Who is decimated isis. Who is fighting off ms13 and who has grown the economy with the successful tax cut packages. And by the way hes under assault from the deep state. So yes, absolutely. There is a completely different parallel universe thats going on, right now, in which the president is under assault and doing just fine. The spy aspect, the language he uses to describe what really was sounds like by all accounts, by many accounts i should say, to be a rather routine Law Enforcement investigation. Using the word spy to defame and discredit and to sow doubt. Is straight out of the classic trump playbook. To that end, we have 60 minutes correspondent leslie stahl who revealed a conversation with the president after he had won the nomination. Asked, why do you keep hammering the press. Heres what the president told her. Take a listen, everyone. I said you know that is getting tired. Why are you doing this . Youre doing it over and over and its time to end that. You know youve won the nomination. And why do you keep hammering at this . And he said you know why i do it . I do it to discredit you all and to demean you all so when you write negative stories about me, no one will believe you. He said that. So put that in your head for a minute. Yeah. How successful, aisha, has the president been in doing that . Do you think his success is longterm when statements like what leslie stahl just said, really reverberates in peoples minds, they do start thinking about what he has said. The president has definitely been able to kind of set a narrative that you should question everything that youre hearing, you should question that youre hearing, even if its coming from the fbi. Even if its coming from his own justice department. And definitely if its coming from the media. Its fake news. And fake news can be anything that he doesnt like. And so i think that this whole questioning what basic facts are, i think he has been successful in getting that on the table. As far as the longterm consequences of that, time will tell whether this will be a change in the way america looks at its institutions. But i think hes definitely been able to push the conversation in a way that has people questioning just kind of basic facts and reality. Of whats going on in politics. I dont question both of you, thats for sure with your basic facts and reality, thank you so much aisha and jeremy, good to see you both. Expedia nothing we heard today has changed our view that theres no evidence to support the a allegation that the fbi or any Intelligence Organization placed a spy in the Trump Campaign or otherwise failed to follow appropriate procedures and protocols. House intel Ranking Member adam schiff there. Now President Trumps lawyer Rudy Giuliani is saying the white house should get a briefing on that classified information. Joining me now, msnbc legal analyst katie phang. What is giulianis strategy here . A legitimate request or is it just another attempt to try to discredit the investigation . Giuliani may think its a legitimate request. But from a legal perspective, you dont necessarily sit down with a defendant that youre investigating or perhaps eventually going to prosecute and give them highly classified information that you obtained from a confidential informant and or somebody who was put in to investigate legally, wrongdoings and say here you go, things that other people arent privy to, were going to hand to you on a silver platter. That doesnt happen legally. In a criminal case eventually when you get there, theres an obligation by the prosecution to have to turn over everything. The law requires that. However, at this stage in the game it was highly inappropriate for emmet flood, the new guy on the Trump Legal Team in terms of the defense of donald trump to have gone with kelly to be able to go to the any of these meetings. Were hearing that they only came at the beginning for a few minutes. And yet why unless theyre trying to intimidate people into this information. So giuliani said, katie, if the spying was inappropriate that means we may have an entirely illegitimate investigation. Is there credence to that legally speaking . Or is he pulling something from the trump playbook and trying to put that out there. To offer that concern. So thats the irritating component of the giuliani comments that are made willy nilly out into the public. And it troubles me because he is a lawyer ostensibly. So as a lawyer you do have an obligation to make sure that what you say is basically right and do you have an obligation to make sure that youre careful about extra judicial statements made by you, especially when youre representing a party so when giuliani makes these statements, alex, hes trying to poison the well. If a big if, there was something inappropriate or criminally volunteer latie ivvideo lating a rule or a law, and as we know, if there were fruits derived from that, sure there could be an argument made by a criminal defendant that should be suppressed. But right now that statement is an irresponsible statement being made by Rudy Giuliani as a lawyer. Now giuliani also is arguing it would be proper for the president to be at least briefed about the findings from the meeting. He states he is not the subject or target of that investigation. So he should know what is discussed. Moreover, i assume president obama knew about it and if obama knew about it, why cant trump . Because obama was not a part of the reason this investigation is going on. Again, it gets back to what i said at the beginning you cant sit there and say hey, possible defendant, here you go. Let me show you everything we got going on here. That doesnt happen. So for trump to be briefed on this, you need to wall him off. I mean thats why its so inappropriate to have trumps lawyer show up at these meetings. Whether or not he heard anything. If you dont hear it directly through your lawyer, youre going to hear it directly from to the president himself . I dont think thats right to do and i think that trump should be walled off from any of these briefings and any of the information contained within them. And flood to show up at the meeting, why not stay for the whole meeting . Thats my point. Its like were you just showing up to intimidate . If so, legally speaking, bad idea. Unless you have a purpose for being there, thanks for letting us know that donald trump wants things to be open and we want to make sure we know everything great. I guess thats the whole reason were doing these briefings, because thats what Rod Rosenstein wants to do on behalf of the doj and thats what chris wray wants to do on the behalf of the fbi. They want the transparency to show the informant did nothing wrong. I want to move to the situation regarding donald trump jr. Senator chris coons says he may have provided false testimony to the judiciary committee. How concerned do you think don jr. Should be right now in. He should be very concerned. If you look at the transcript from the information he provided to the Senate Committee when he was originally interviewed, he definitively said no, not a qualified no, but a no, when he was asked by them whether or not there were attempts or contact or communications with countries other than russia to be able to be a part of influence, et cetera, the Trump Campaign. Now we know that donald trump jr. Met at trump tower, which seems to be the Grand Central station of all sorts of inappropriate activity legally and they met with an representative, an emissary, george nader, from the uae and saudi arabia, who basely said wed like to help the Trump Campaign and the fact that donald trump jr. Said no, if you make materially false statements to congress, thats a crime under u. S. Code section 1001. And thats brought down other people as well. If the Senate Judiciary committee calls on him, does he have to go back and testify, don jr. . Remember he voluntarily showed up the first time, but we have the power of the subpoena. He could be subpoenaed to show up. And if you dont, what are you trying to hide . You claimed you told everything truthfully before, why not come back and clarify what you told the Senate Judiciary committee the first time through. Katie phang, always good to talk to you, thank you. Coming up next, the nfls new anthem policy. Will team owners have the last word on this political football . I still, think its good. You have to stand proudly for the National Anthem. Or you shouldnt be playing. You shouldnt be there. Maybe you shouldnt be in the country. President trump reigniting his cue with nfl players taking a knee during the National Anthem. His comments coming a die after the nfl announcing its new policy. But now the league says team owners didnt take part in an formal vote and the informal vote was not unanimous. Joining me now, howard brian, writer at espn. Com and author of the new book the heritage black athletes, a divided america and the politics of patriotism. Howard good morning to you on this saturday. So not everyone was on board. So what happened here . And what does it tell you about where the owners stand on this issue . Now that weve had a couple of days to process the blowback. The nfl owners seem to have been completely engaging in the culture war that the president started when attacked the players back in september. He said back then that the players were sobs and then he said they were unpatriotic and he said they shouldnt have jobs and now hes coming out and saying that the players shouldnt even be in the country. One of the things in this book, alex is that were talking about is who gets to be the patriot. And the nfl owners have gone along with this, some have said its not unanimous, but they continue to go along with this in ratcheting up the animosity between the players. Whats really interesting about this is that the owners themselves last september when the president started this, they were in solidarity with the players and now with this new policy they seem to be going along with the president , even after the players and owners agreed to a 9 0 million deal to jointly fight social justice concerns. So the players, the players sort of feel like theyve been backstabbed. Okay. Look, howard, we have the nfl defending itself. They say the policy is in response to the fan who is dont agree with the players taking a knee. Butday want to put up a poll. This is offered by cornell belcher, a democratic strategist and a frequent guest on msnbc. This will give us a different perspective. According to a survey he conducted in march, 35 of black voters in battleground states say they watch less football because Colin Kaepernick remains unsigned. Do you have an idea, howard, whether Roger Goodell or the owners, are they taking the black consumer into consideration . I dont think they are. I think what theyve done is theyve decided that the black consumer is either unimportant, or the black consumer is going to go along and watch football regardless of what the players do or what the owners do. And i think that that is a complete, its a challenge to the black consumer to say how do you feel about this . And i think its also we keep talking about the base. This is an old story. Weve seen this before. When you use the black, whether youre talking about welfare queens or youre talking about willie horton. Now were talking about unpatriotic ball players to sort of rally a base. And the real challenge for me has been what are the black consumers going to do about it . Everybody talks a really good game about being outraged. At the end of the day, when you look at the numbers, the nfl is a 13 billion industry and their ratings were fine last year. Even though they may have been down a bit its still a very highly watched program. So the way it stands now, players can either come out to the field and stand for the National Anthem or decide to stay in the locker room if they choose not to stand. That said, lets say someone comes out and takes a knee. Youve got at least one chairman, this being Chris Johnson from the jets, who by the way his brother, woody, is the United States ambassador to the uk we should note there. He says hes not going to levy the fines on the player who is take a knee. So for the policy, how long does this even last . Well find out i think that once again when we talk about challenges here, one of the big challenges is the players. What are the players willing to do . Are they willing to be unified . I think the challenge is with the Players Association as well. Trying to determine if these guys are unified. This is as much a labor story as it is anything else. And think one other thing to remember about this is that weve talked so much about being divided. We talk so much about the, about sports tearing people apart on this. But if theres one thing we know, and one of the things that i really was pleased to find out and research in this book, is that whether youre liberal, conservative, republican, democrat, veterans do not like this weaponizing of the flag. They do not like the fact that they are being used as props. And as we saw with Tammy Duckworth and steve kerr, the coach of the golden state warriors, talking about this paid patriotism. On this memorial day, i think its kind of important that the players themselves, they do not look at this and see themselves as being unpatriotic. Were going to see what the players are made of here. Because they are being challenged in a very specific way. Being called unpatriotic, unamerican. We see how theres some white players, chris long for one, pushing back against this policy. Whats the role as you see it, that white players are going to have as this moves forward. I think thats the biggest thing, when youre looking at unity. And you see it in the nba, you see it in the wnba, you seeing the female players doing a much better job of this. Where do you stand . This is the entire question of this culture war that we seem to be in. Where sports is not supposed to be the thing that tears people apart. Its supposed to be the place that brought everybody together. Were going to find out if the players have that unity, and i think historically when you look at it from a male perspective, i dont remember any point whether were talking about muhammed ali, jackie robinson, smith and carlos or kaepernick today where you had any sort of plurality of white player who is have gotten involved and said look, this is our issue, too, were all in this together and thats the challenge. Im curious, howard, how much do you think people, the average fan, the average viewer of this broadcast and this discussion, remembers the genesis of all this. That the reason those players were taking a knee was to oppose and stand up against Police Brutality against people of color . Has that gotten lost . Just the genesis of this. I dont think its gotten lost. I dont think it ever existed. That was one of the things i talk about in this project as well. Is that it is a classic humungous, enormous media fail on this. Because we have focused so much on the reaction to the protest, than the reason for it. And because weve done that. That allows the lens to completely, to always be shifted toward the flag. Always be shifted toward the people that this isnt even about. I would be very interested in hearing from tamir rices mother and the families of eric garner, and how they feel about the players. We dont do that in our business and this is one of the reasons that were having these conversations being so distorted toward the flag, when this is really not what this about. Your book is titled the heritage black athletes, a divided america and the politics of patriotism. Howard, come see me again, great chat. Thank you so much. Tuesday night at 9 00 p. M. , msnbc presents a town hall live from philadelphia. Moderators joy reid and chris hayes will explore Racial Injustice in this country and discussion potential solutions. Emmet flood and general kelly went over there. But when they went over there, they were there for a few seconds, just to convey the message from the president. Which was he wanted transparency in this. But he understood the sensitivity of the intelligence community. And the people involved. And so he wanted the proper steps moving forward. Deputy White House Press secretary hogan gidley on the president s lawyer emmet flood and chief of staff john kellys presence at the beginning of the classified intelligence briefings. Lets bring in msnbc political analyst jonathan alter. Of the daily beast and with a good morning to you both, jonathan, did gidleys explanation make sense there . I have to say ive had differing opinions, one went so far earlier in the broadcast to suggest that those two appeared very briefly as an intimidation tactic. Well, i dont know whether it was an intimidation tactic, but i think democrats and republicans agree it was inappropriate. You just dont do that in these kinds of cases. Really any kinds of cases. To give you some sense of an analogy that might be apt, imagine if Harvey Weinsteins attorneys showed up at the d. A. s office and said we want to see your material, not just in the prosecution of Harvey Weinstein, but what youve dug up about the relationship between other people in the Metoo Movement who have been charged with assaulting women. This is just not the way criminal investigations or National Security briefings, which is what this essentially was, are supposed to work. And we understand what the motive was. Giuliani said plainly, they were hoping to get information in order to shorten the investigation. That is completely improper and giuliani knows it. So as a lawyer what do you think were the intentions or the appropriateness of having emmet flod and john kelly turn up at this meeting . Well its completely inappropriate. I agree with everything jonathan said. But more importantly, alex, as you know, i like to bring things back to what its really b. And the question we ought to be asking ourselves is, why did the briefing occur in the first place. Because the president has cried about spy gate and theres spies, people spying on him and there needs to be this briefing and then its only going to be the republicans. Then its the gang of eight. This is you know, to be candid, its just a mess up there. At the end of the day, no one has a right to go to a security briefing but those who are to be briefed on the materials. I. E. , the congress and those who have the oversight and the clearances, the highlevel clearances that are necessary for a briefing like this. So the chief of staff had no right being there and certainly the attorney had absolutely no right to be there. You know jonathan, Rudy Giuliani told the Associated Press the white house wants a readout on all the information that lawmakers received in these briefings about the origins of the russia investigation, as well as the use of the fbi source. They want this by next week. First of all talk about what you think the strategy is here and how likely it is that theyre going to get that readout. Theyre trying to push on all fronts to try to do anything they can to shortcircuit this investigation. But you know, this question of whether flood had the, thats the president s attorney, had the security clearances to go to the meeting in the first place, is a really interesting one. Its the second major Security Breach of the week. We learned that the president is using a cell phone that is not secure. Remember, you know, for many, many months, the republicans were calling Hillary Clinton crooked hillary. Because there may have been some Security Breaches on her computer. You know and here twice in one week we have flatout Security Breaches, so giuliani and company just want to push right through all of that to try to do anything they can to throw cold water on this investigation. And calling this confidential informant in europe, a spy, is to suggest that everybody that the fbi is in contact with, and provides them information, is a spy . This is just ludicrous propaganda for the base. Is it when the president uses the term spy jonathan, is it ludicrous propaganda . Or is it just pain to his base . Its a lie for his base. Which we get about ten times a day. Alex, if i might here, first of all its really important for the public to understand and have a context. The fbi does not use spies, they use informants. The c. I. A. Is in the spy business, so lets clear up the terms. Again this is President Trump distracting, throwing out bombs and doing things to keep our eyes off the ball. Which are many things that we need to really be talking about as a country right now. But at the end of the day, its really important that the public understands, the fbi uses informants, people that give them information. They may or may not be paid informants, that is standard protocol. But spy sgt purview of the Central Intelligence agency. I just need to get that clear for folks. Very true and i want to speak about republican lawmakers, they havent commented about this. But we have democratic congressman adam schiff who said i didnt hear anything that suggested evidence of a spy placed in the Trump Campaign by the fbi or any other Intelligence Agency as well. Where is the value in the president s legal Team Pursuing this further . Sophia . Because what theyre doing is distracting us. I said this on aris show the other day and im going to say it again. This is autocratic behavior. Wake up, america, president s dont talk like this, they dont do this. Theres not this kind of mess going on. Theres so many investigations, theres so much drama. Theres so much impropriety. Jared cushner getting a security clearance is something we should be talking about. He should not have a security clearance. Theyre breaking down protocols and breaking down norms, theyre attacking the department of justice, the fbi, the c. I. A. Im not saying these organizations cant be questioned. Of course they can, this is america. But for the president of the United States to suggest hes been spied on and to dmoond ema twitter an investigation and get it is a problem for me as an american citizen and as a scholar of the american constitution this is unconstitutional behavior. This is not what our Founding Fathers had in mind it just isnt. And its happening every hour, this banana republican behavior. When the president says that the nfl players maybe they should leave the country . That is such an anticonstitutional, unconstitutional view. Absolutely. Of our system.
