Mcgahn breaking his silence. Hes a central figure on muellers investigation on whether the president obstructed justice. The president directed him to have the special counsel fired but mcgahn did not follow through. His lawyer writes, quote, its a mystery why the president s attorney, rudy giuliani, feels the need to relitigate these issues but they are in the report. He appreciates the opportunity to serve as white House Counsel. Heres what mcgahn is reacting to. Even if its true, its not. Those arent like real orders. Ill tell you, when he wants to fire somebody, ask jim comey if he can fire somebody. Yes, he ruminated. Yes, he got angry. Yes, he got upset. After a while you realize these messages were never delivered. Theres a pattern there and the pattern is he didnt mean them to be delivered. Meanwhile, after reading the report, Elizabeth Warren is the first president ial candidate to call on the house to start impeachment proceedings. This is about point of principle. I get it, that there are people who think politically, no, its going to be too hard to do this. This isnt about politics. This isnt even specifically about donald trump himself. It is about what a president of the United States should be able to do and what the role of congress is. No one is above the law, and that includes the president of the United States. Aides for House Speaker nancy pelosi who has warned against pursuing impeachment replied back saying, quote, one step at a time and that they are now focused on getting the full unredacted Mueller Report. The first poll after the release of the redacted Mueller Report. The president s approval dropped by 3 Percentage Points to 37 . Nbcs mike bacara joining us from the white house. Mike, good morning. What is the reaction of these efforts from democrats . Reporter good morning to you, phillip. We keep hearing these words, vindication, exoneration. Well, not so fast. A lot of the focus on those exchanges between the president and his then white House Counsel don mcgahn. The president according to the white house report calling mcgahn not once but twice at home insisting he have the special counsel fired. He refused to do it. He said he would quit if he were force today do it rather than do it. The fallout nadler, the chairm the house Judiciary Committee, hes in charge of many of the aspects of this investigation, he has now issued a subpoena. May 1st is the deadline. He wants the complete unredacted Mueller Report. He says that this has been a whitewash, that bill barr, the attorney general is spinning. He wants to see the underlying grand jury testimony and bill barr has been stepping in where he shouldnt be stepping in interpreting the report. Whats the white house reaction to nadlers subpoena . When does this ever stop . If we gave them the unredacted report, if we gave him all the tax returns unredacted as well, he would still want something else. Were into the going to deal with jerry nadler in that manner. We have already cooperated so much with the democrats and well continue to do so, but the fact is this is just more political grandstanding. Reporter now of course bob mueller is set to testify. We dont have a date yet. Bill barr says hes not going to stand in the way of mueller testifying before the Judiciary Committee and of course in the senate still chaired by republicans. We should note that jerry nadler and a few other select Top Democrats and leaders of congress will be able to look at a more thorough, less redacted version of the Mueller Report made available to them eyes only in congress. Thats not good enough for nadler. He wants to see that grand jury testimony. Meanwhile, the Top Republican on nadlers committee, doug collins, hes saying that its against the law. It cant be done. Were not going to give the white house, should not the Justice Department should not give that fully unredacted report to democrats. Phillip . Sounds like the fight just beginning. Lets start with former white House Counsel don mcgahn. The Mueller Report says after news reports the president trade to have mcgahn deny that he tried to remove mueller. Mcgahn refused to do that. How much weight does it carry . Right. Its not surprising that mcgahn was such a central figure especially in the obstruction section of the report, which is volume 2. Weve known a lot of this from public reporting over the last couple of years. What was surprising to me was the fact that, one, mcgahn actually spoke publicly about it and defended what was in the report and we saw this evolution from, you know, the president and his allies claiming this was a complete and total exoneration, that he was vindicated, so on and so forth. Weve seen reporting and ive were the most iple white house concerned about what this report was going to say as far as his conversations with don mcgahn. Its not surprising that the president would go from its a complete and total exoneration to calling it, quote, the crazy Mueller Report and appearing to target mcgahn and saying that people who take notes only do so when its convenient for them. We saw in the report it described a scenario where mcgahn and the president talked about the fact that, quote, real lawyers take notes. So it was surprising that, you know, the president seemed to take aim at mcgahn when we knew that a lot of this had already zblapd this is taking from it what he wants to hear, i guess. Dave, the department of justice says that the subpoena now for the premature and unnecessary. Do we think the attorney general will not adhere to that subpoena request . What could we learn from the unredacted parts . Its possible, but we have a couple of things going on. First of all, the democrats, even before we begin to talk about the impeachment word, they do have several steps that theyre going to go forward. One is the subpoena and trying to figure out if they can get access full access to the entire report. As you mentioned earlier, its going to be a less redacted version thats going to be available for eyes on only to certain select members of the house. Thats not going to be good enough for the house leadership. They want to have the full document so they can make determination on what step to take forward. Are the democrats going to go forward and try to impeach the president knowing full well that even if they did impeach the president , that this could be a the senate is highly unlikely to go forward and kick the president out of office when you have a trial in the senate. Big heady and very political questions facing the democrats on going forward. What a heavy internal debate going on. Sonam, you wrote a very informative article. How about you give us the top three. Thats difficult. So i think one of the most interesting details in the report was actually buried in a footnote. The footnote said that a russian businessman texted Michael Cohen on october 30th, 2016, saying that he had, quote, stopped the flow of compromising stopped the flow of tapes from russia that possessed compromising and potentially fabricated material on President Trump. Of course, this fueled intense speculation about one of the most salacious in the so called steele dossier that said that the russian government possessed Video Evidence of the president engaging in certain sexual acts with russian prostitutes in moscow. So it was really interesting that this detail was included in the report. It was a little bit frustrating also reading the collusion volume of the report because mueller kind of laid out a lot of the facts and what he had obtained but he didnt draw any conclusions outside of saying that, you know, he wasnt going to bring conspiracy charges. Another thing that stood out to me in the report was the president s reaction when he found out that mueller had been appointed special counsel. After Jeff Sessions told him that, he said, you know, this is the end of my presidency. Im fd, so that kind of that gave us a lot of insight into the president s reaction to muellers appointment. Another thing that stood out was kind of the reports the new details we learned as far as Vladimir Putins attempts to kind of cultivate members of the Trump Transition Team after the president won the electifforts on people like jared kushner, donald trump jr. , so it puts the spotlight on the president s not only his advisors but the family members. A lot of good things here. You also mentioned about Sarah Huckabee sanders lying about comeys firing a informative things to see on Business Insider. Dave, the report says, quote, the president s efforts to influence the investigation were mostly unsuccessful, but thats largely because the persons who surrounded the president declined to carry out his orders. We mentioned don mcgahn earlier. Ive knocily for the time at th federal election commission. Hes very loyal but hes his own man, somebody who very much feels that if hes got the right thing in behind, hes going to do the right thing so as he sees it. Its not surprising that don mcgahn would act in the way that he did but theres an odd history with President Trump and the mcgahn family. It was in the 1990s when petty mcgahn, he was President Trumps lawyer. He was don mcgahns uncle. Donald trump ultimately got into a huge rile with him, fired him, big legal battle. Here we are facing a very similar situation in a political context with don mcgahn and it should be noted that the Trump Campaign has cut off jones day, the law firm that don mcgahn had worked for previously. It used to be theanymore. Thats a multi multimillion hit. Hes upset even though he saved him from himself. The special counsel asserted that congress has the ability to apply luce on the obstruction of justice to the president s behavior writing that no person is above the law. Now we talked about senator warren whos now calling for impeachment. How do you think this could possibly back fire on democrats if they do, in fact, go through impeachment proceedings . It seems like a lot of the democrats in the house and of course senator warren in the senate are kind of moving toward impeaching the president without knowing all the details in the report. It seems like congressman nadler and nancy pelosi are pumping the brakes on that. They dont want to turn the Mueller Report into a Political Tool where it makes the democrats look like theyre on a fishing expedition and a, quote, witch hunt which of course President Trump has accused them of doing all along. It seems like nancy pelosi and jerry nadler and adam schiff are aware of the Public Perceptions of launching impeachment proceedings. Theyre saying, hold on. Lets see if we can get the entire document and the underlying evidence. I would noetd there is actually precedent for that because republicans in the house obtained thousands of pages of sensitive documents related to the russia investigation, including information about the underlying evidence for launching the russia probe in the first place. So when people like doug collins say that, you know, its against the law to do this, were not authorized to do so, its interesting to see the shift. Dave, quickly, do you think that that is a good strategy for the democrats, to go forward with impeachment proceedings . Far be it for me to give democrats or republicans any advice, but its definitely a strategy thats going to be fraught if they go forward from a political standpoint. Nobody wants to be uber cynical but, hey, we have a president ial election going on. You have 20 democratic president ial candidates running around. They want to talk about things other than the president and impeachment proceedings. Theres a lot going on here and not everyone on the democratic side is definitely as enthusiastic about the others about the possibility of impeaching the president knowing that the u. S. Senate is going to not let down. Polling shows it. Voters, its not high on their list as far as priorities in the election coming up, either. Please stick around. While muellers report details ten instances where the president may have tried to obstruct justice, the special counsel declined to produce obstruction charges. The report says the president engaged in multiple acts that were, quote, capable of exerting undue influence over Law Enforcement investigations. But was unsuccessful because his staff, quote, declined to carry out orders or accede to his request. Joining me now msnbc legal analyst danny savalos. We know there was not an obstruction charge brought forward after discussions with the office of legal counsel. Muellers account is pretty damming. How do you prove criminal intent. Isnt an attempt to commit a crime a crime . Attempt is part of the body of what we call in coat crimes, incomplete crimes. We punish not the completed crime because it never occurred, instead we punish the intent, the specific intent. You have to specifically intend the outcome and either fail at it or change your mind. And this would appear to fit squarely within the definition of a specific intent crime an attempt crime to commit obstruction of justice. However, mueller does conclude that the president is unlike any other person in the criminal Justice System because his actions are at least facely lawful and as the president. United states, he may be permitted to take actions and give orders that any other citizen arguably would be obstructing justice. So another way of looking at the Mueller Report is the conclusion that possibly the president cannot obstruct justice under certain circumstances, even though that is not muellers conclusion. Muellers conclusion is because the president cannot be indicted, i started this investigation from the outset with the idea that i would simply amass facts. Those two issues while they sound similar, actually very different. I think barr and mueller in a way reach very different conclusions, that the president cannot be indicted while in office but also the issue of whether or not a president can obstruct justice. Mueller gathered substantial and credible evidence that made a justice. I want to show you a chart here, created by a managing editor at law fair. It shows that there were eight instances where mueller says trump met the basis for a charge. Mueller says they investigated obstruction to preserve evidence here. I dont know if we have the there is that chart here. Danny, do you anticipate any future legal action for trump here . Possibly if we consider legal action articles of impeachment, although an impeachment trial is really only a legal proceeding cosmetically. Its truly a political proceeding. So that could be in trumps future and, in fact, impeachment proceedings have quasi legal procedural aspects, but ultimately those are the main concerns for trump. His greater concerns are congressional. There will be possibly impeachment proceedings, although not likely. All right. Special counsel did not establish the president was involved in any underlying crime related to Russian Election interference. So, danny, if there is no underlying crime of which to conspire, is the obstruction question then invalidated even if the president possibly believed that there were crimes . I cant stress this enough, that you do not need an underlying crime generally for an obstruction charge. Lookmichael flynn who did not ct an underlying crime but were convicted of lying, materially lying to investigators. What mueller and bar are essentially saying here is that under these very specific facts where the intent is important in determining the obstruction, then the what the underlying absence of a crime can be relevant to intent and motive. Sling revelations in the redacted Mueller Report about the president s children and the infamous june 16th trump tower meeting. The morning of that meeting they attended a regular briefing where don jr. Announced he was promised dirt on Hillary Clinton. He pressed at least twice a russian lawyer for incriminating information. The special counsel did not charge don jr. And others in that meeting in part because it would be difficult to prove they knew their conduct was unlawful. Heres don jr. Back in 2017. In retrospect, i probably would have done things a little differently. Again, this is before the russia mania, this is beforhey were building it up in the press. For me, it was opposition research. The pretexts was, hey, i have information about your opponent. There wasnt followup because there was nothing there. Sonam, what do you make of mueller not bringing charges against don jr. . This is likely not the end of the legal risks he faces in other investigations, is that correct . Right. I think its really interesting to look at the reasoning why prosecutors didnt charge don jr. , you know, connected to this trump tower meeting and his conversations with the russians. They basically said that, you know, like you mentioned, that don its difficult to prove that he knew what he was doing is wrong. So, in other words, it seems like there are multiple instances in this report related to don jr. But also other people like jared kushner. Prosecutors are basically saying that these people cant be charged because they didnt know what they were doing was illegal. So were kind of at this weird point right now where youre choosing between, you know, did this person commit a crime or were they too incompetent to know that, you know, trying to get opposition information from a hostile Foreign Government would be illegal . That is the question. The Mueller Report also detailed that wikileaks directly messaged don jr. And asked him to spread a link with allegations against Hillary Clinton and then don jr. Twice shared those links online. So, dave, what does that tell us about what he and the other Campaign Staffers expected from the information that was released through those russian efforts . First of all, it shows they were definitely around the margins of interacting with the russians. Whether they were doing so unwhitingly we will debate that for many, many months to come, but the fact of the matter is that obviously the Trump Campaign and the Mueller Report details this in great relief was trying to get as much information as they possibly could to win the election. So, you know, one thing that is kind of lost in all this talk about donald trump and the hyper focus on donald trump is the fact mere fact that the russians were engaging in a sustained campaign to influence the 2016 election. And you almost have to pause for a second and just let that sink in, that a Foreign Government, a foreign entity was trying to determine who the president of the United States was and they were able to at least to some degree infiltrate our own political system and achieve that goal. Now whether they ultimately swayed the election or not again is up for debate, but the fact that the Trump Campaign was in some kind of contact with the very people who were hoping to change the election is very, very striking. He also infiltrated our social media. Those are voters right on there. There were trojan horses rolled right out only successful. On the don jr. Point, the fact that Donald Trumps favorite medium was ultimately, you know, the medium that was used by his son to contact wikileaks which is now in the news again because of julian assange, longtime leader of wikileaks being arrested, its just, you know, old is new again, phillip. Sure is. The report also reveals that former white house whun any cases director, hope hicks, warned that the emails about the trump tower meeting were, quote, really bad and it was better to release them to the press but the president ordered them not to release the emails. Hope hicks plays a role. How big of a blow do you think that delivered to the president . I think its interesting. Weve been seeing this pattern for so long now that a lot of the most damaging things for this president are, actually, you know, events that hes kind of brought on himself. Weve seen through ts reportingt he was warned that these emails were going to be monumental and could be catastrophic to his presidency and could cast a cloud over him throughout his next couple of years in office or if he was reelected but time and again we see him kind of ignoring the advice of his own aides and just, you know, doing whatever he wants to do. And i think that its really its really important to note what mueller said in this report, that, you know, if not for trumps own staff refusing to carry out his orders in a lot of these instances, he would have been in a lot deeper water than he knows. Lucked out there. The Mueller Report also found the president rejected a statement drafted by don jr. That would have acknowledged the meeting was about getting information that could help the campaign. Instead, the president dictated a statement that said the meeting was about russian adoptions. Dave, whats your take on the role that hope hicks is playing here revealing its incriminating information about the president . It shows what we know to a large degree already, which is that donald trump is his own communications director. Donald trump is his own press and media shop. He long has played that role for himself in the context of business and hes continued on that role during his time in the white house and that should be seen, too, in the fact that there have been a parade of Communications Directors who have come in and who have gone out at historic rate at the white house right now. So ultimately donald trump is all about the message and hope hicks was a functionary. She was somebody who definitely at times had a lot of power and had the presidlosest aides that he had for a sustained period of time but shes no longer in the white house, donald trump still is, and he takes his own counsel when it comes to lots of things, including communications. Amid all the reaction to the Mueller Report, theres more denial from russia that it interfered with the 2016 election. Bill neely is in moscow with the latest reaction. Reporter hi, phillip, from moscow. For the last 48 hours there has been only what can be described is gloating here over publication of the Mueller Report, most recently over what is seen here asu. S. Political class tearing itself apart over mueller. And theres been a lot of reference in newspapers and so on to, for example, senator Elizabeth Warrens call for President Trump to be impeached. But dont think for a moment that russia is simply dismissing this report. It is pouring over its nearly 450 pages to find out how President Trumpoperates, how the Trump White House operates. It will be noted, for example, that when President Trump gave an order to an official, that that order was simply ignored. So for the kremlin, that is fascinating detail. So they will be really interested to hear how their efforts to interfere in 2016, they have, if you like, a report from Robert Mueller detailing that and that will be interesting for them if, for example, they do want to interfere in the 2020 president ial Election Campaign. Phillip, back to you. Bill, thank you. The president s legal team and administration stand by their no obstruction no collusion claims, but a new article in vanity fair lays out the special counsels six cases for collusion, and while mueller established the presidt not colluding with russia, the behavior detailed is described by the author as deeply corrupt. Joining me now is the author of that article, abigail tracy. Shes a staff news writer for the hive. Good morning. Good morning. The report describes the wi r damaging information on Hillary Clinton but ultimately does this fall just on there was insufficient evidence to prove that the campaign was directly involved . Yes. So i think one of the key take aways from the Mueller Report is the sentence wherein he says he was judging the actions of the president and the criminal conspiracy framework. He wasnt judging them on collusion and the concept of collusion as he says. One of the keys to think about is that he outlines all this behavior and just because it might not rise to the level of criminal conspiracy doesnt necessarily mean that this is okay behavior. And when you read through the troubling episodes andly see a interactions between Trump Campaign officials and the russians. Mueller says that several Trump Campaign individuals lied about their interactions and, quote, those lies materially impaired the investigation of Russian Election interference. That is on page 9 of the report. Is it clear that mueller would have proved conspiracy beyond a reasonable doubt if those who lied had coop perfect rated . So i dont think its necessarily clear that he would have, but i think it is very telling and important that mueller noted the fact that the cooperation he got from members of the Trump Campaign wasnt at the level that he would have wanted. And i think its really critical that he says, hey, if these individuals had maybe been a little bit more helpful, hadnt deleted correspondence, hadnt lied, there were a lot of pleas that he had got so i think thats critical to noe specially in the case of individuals especially former Trump Campaign chair men, paul manafort. Hey, mueller is saying i might have been able to prove conspiracy had people been more cooperative. Lets turn now to the 14 investigations, those are redacted referrals that mueller handed off to other article detailing how the cases could cross the president s, quote, red line that he talked about into his family and business dealings. Does it appear the president will, in fact, face legal peril when he leaves office . Yeah, i think one of the interesting things to think about is, okay, you had the mueller investigation, and what he was really investigating was this question as to whether the Trump Campaign was involved in a conspiracy to defraud the United States of america and whether the president of the United States obstructed justice. So both of those crimes are very difficult. You know, theres a high legal bar that investigators would have had to clear to prove that, but some of the investigations that are also ongoing, whether its at the Southern District of new york or the new York Attorney generals office, those are more kind of garden variety crimes that theyre investigating. It might be tax evasion, tax fraud, a lot of investigations going on into the Trump Foundation and the trump familys businesses. So i think there is a lot of legal peril out there and obviously we still have the ongoing Southern District investigation into the hush money payments to Stormy Daniels and what you saw is President Trump named as person one in the filings. There are crimes out there that the president might be more legally vulnerable on. You just laid out several right there. At this point, which investigation do you think the president should be most concerned about . Bill barr released the conclusions, the president s disapproval now stands at 56 . What does it signal to you . Well, it signals to me that its april of 2019 and he just gott a threeyear investigation into potential russian collusion. I would offer, phillip, that i think donald trump is going to be stronger ultimately from this. Again, if you strike at the king, make sure to kill him. They did not. Donald trump is going to be Even Stronger moving forward. If this was april of but i wou also remind people, too, if the polls were correct, donald trump wouldnt be in the white house. Antwon, do you agree with what he said . Surprisingly, shockingly i actually do. This might be the first time weve agreed, antwon. I know. No wonder we having such bad weather in south carolina. Theres no way to measure the effectiveness to donald trump. Because this investigation i think is going to hit a second gear in terms of democrats doing their job in the congress of flushing out what the special prosecutor put in his report, i think youre going to see these poll numbers go up and down. I think theyre going to change. I think its very early. The truth is we do not have a nominee on the democratic side to compare donald trump to. And so i think this poll, while its great and it may be a motivational factor for democrats to consolidate at some point, its also going to allow republicans to consolidate their base and donald trump voters are going to go home even more, i think, because of this poll and because of what weve seen from the report. Ned, i want to ask you about what the white house is saying about thehere is white house des secretary hogan gidley. Press secretary hogan libby. They have seen the information. They did not have anything to get him on with collusion. They did not have anything as it relates to obstruction. It is a complete and total exonerati exoneration. Here is what the Mueller Report says. Quote, the evidence we obtained about the president s actions and intent presents difficult issues that prevent us from conclusively determining no criminal conduct occurred. This does not state the president did not commit a crime, but it does not exonerate him. Ned, is there some troubling information, potentially, impeachable information, in the Mueller Report . On that front of impeachment, phillip, democrats, it is time for them to put up or shut up. The initial reaction from nancy pelosi and now steny hoyer has backed off from the comments. Looking at the democratic nomination for 2020. Nobody is talking impeachment. They understand. American people wanted answers at the macro level. Was there collusion or obstruction . The Mueller Report said there wasnt. No indictments or charges on collusion or obstruction. The American People have moved on. Democrats know that. They know that very well. Thats not true, ned. It is true. The other thing i would add, phil, i think i need to write a diagram for the democrats and far left base how impeachment works. Im not sure they would have votes in the house. They would not have 66 votes in the republican senate. If they were successful on those two fronts, phillip, they get mike pence. Nobody thought this through. I think impeach. Is untenable. I would hope in many ways from the political and Strategic Point they go for it and watch what happens. Thats why nancy pelosi has said everybody hold your horses here. We need bipartisan support if we make this happen. Ned, senator mitt romney issued a statement. He called it good news that the president wasnt charged with a crime, but he also said he is sickened and appalled by the behavior in the report. What is your reaction, ned, and should more republicans express that senator pablum is what i l senator romney. I could care less what he thinks. For him to say whatever he wants, i could literally care less what mitt romney has to say about this or any other subject moving forward. A chance to respond. You have the floor, sir. What i will remind people about the report is the most important thing and ned you should be concerned that russia penetrated and hacked our elections like they never have before and we cannot seem to get one republican to agree to that or say that and say, you know what . We democrats and republicans have to come together to prevent that from happening. I agree. The second thing is the Trump Campaign knew that russia was going to hack into the dnc emails and cause confusion among people in the country in order to help donald trump. Number three, donald trump jr. Was too dumb enough to know he was committing a crime throughout the process. Number four, this report does not exonerate the president. Mueller gave the democrats an alleyoop on the goal to call in Trump Officials and people who work closely with him to flush this out. There were 14 examples in the report that say that there is more work to be done and more investigations taking place. When Donald Trump Tweets that the game is over and republicans are taking victory laps and doing toe touches, i caution them to pull back. Ned, i saw you chuckling. Do you have a chance .
