An uncovering situation in ferguson, officer darren is speaking out for the first time about the shooting that killed Michael Brown. Wilson says the altercation began after he asked the teenager to move out from the middle of the street. After a verbal exchange, wilson says he reached into his police car and grabbed for his gun. The officer says brown punched him in the face. Is there anything you could have done differently that would have prevented that killing from taking place . No. Nothing . No. And you are absolutely convinced when you look through your heart and your mind that if Michael Brown were white, this would have gone down in exactly the same way . Yes. No question in. No question. Something you think will always haunt you . I dont think its the haunting. Its always going to be something that happened. You are, you have a very clean conscience. The reason i have a clean conscience. I know i did my job right. Im just curious, so we have stated and i have stated repeatedly that there are two criminal Justice Systems in america. I know. Black, young men, especially, are no longer treated worse in the streets, theyre treated worse in the court systems, all the way through, but white kids get away with, black kids dont get away w. All right, so everybody agrees with that. Okay. Everybody agrees with that. Yeah. That said. If whats in the grand jury sorority true and if i stood in the middle of the street in front of that Police Officer and then ran to his car and started punching him and grabbing for his gun, does anybody presume that i would not be treated the same way . Because i will tell you, cops areeto everybody when you dont do what cops tell you to do. If thats what happened, i think its what the grand jury says. So i just, there is an element of race, but as far as this specific event and this cop goes, im just curious, discuss anybody on this panel believe that if i confronted a cop, a new york cop, lets say, Staten Island, the cop said, get out of the street and i said no and i started swearing at him, i went up, i started punching him, i started grabbing at him like the grand jury report says, if that is, fact, true, what would that Staten Island cop do . Steve, you lived in new york a while, what would a new york city cop do to me, white guy . Well, at that point in time, probably exactly what he did do, with i is to try to recover his gun. The gun went off. I think there is two other pieces to this, one is that you are a big guy, brown was a big guy, and its a little different tan if me or catty or somebody were in a fight with a cop. I agree with that guy coming at me. Id be scared. The cop is a big guy. He is 6 4. The critical part is when brown ran away and turned back at him, thats where, of course the fatal shots were fired. Let me ask if i were running, is roland in yet . I hope you caught the first part of it. I did. We put a lot of things on the table, young black pen are treated badly, the criminal Justice System is not fair to them, et cetera, et cetera, i think we all agree with that. Im talking about as we look at this cop, and his testimony last night, George Stephanopoulis at one point said did it have to do with the color of his skin . Im 6 4, i weigh too much, im a big guy. If i come at a cop, if i go to the car, if we believe the grand jury report, do we believe the cop would act differently towards me tan Michael Brown . Ill ask you this question, how many times have we done stories on white men who have been shot and killed by cops . I mean, we have seen im sure white pen have been killed by cops, but there is not the racial component. Follow me here, heres one of the issue s the we begin to talk about just the grand jury. You understand, though, when i say, roland, like white cop kills 6 4 white guy. Thats not the story that this is. Because there is the racial component in ferguson, which, of course, thats a horrible racial provide down there. I understand. Also i take into account the fact that Darren Wilson was at a Previous Police department that was disbanded because of various problems. Heres the other issue that jumps 0u9, Darren Wilson is offering testimony it was a given or put together six weeks afterwards. He never did an Actual Police report right after the firsthand. So part of the problem here is that Darren Wilson had an opportunity to literally six weeks later say, well, this is what happened as opposed to right after. So part of the problem here is also how Ferguson Police investigated this particular case. Now, am i am alegend that he changed his story . Im not saying, what im saying is, we would have a different view if we got his view of what happened immediately afterwards. Right. We didnt get that. And ro roland, let me say to back that up, im not saying that he lied in front of the grand jury testimony. But you can be coached. You can be prepared. The one thing that did jump to my mind as i was reading this testimony was he kept talking about the hand on the waist band. Right. He kept repeating that, which, of course, is justification. I didnt know if he was going for a gun or not. There were eyewitnesses that said, including a little girl, that said he was charging at him like a football player. Heres the other issue. He had basketball shorts. Thats an elastic waist band. One of the witnesses said you cant, a gun can not just sit in those kind of shorts, if that kind of big guy is running, that gun will slide, supposedly he had a gun. If he is doing a full charge at you. Only for people at home who are saying why are they talking about the waist band . He kept talking about the waist band. He kept coming up, its kind of like when my kids Say Something way too much. You are giving yourself away. Heres the best one, he is punching me, he stops, he takes a cigar and tells his friends, hold these, you go at the punching. So, okay, if im punching a dude, im not going to stop and say, say, bro, hold my cigars for a second and let me go back to punching. Again, lisa bloom did a great job of literally going through and breaking down a lot of discrepancys and how mccullough did not push back on a lot of his testimony and took it at face value. I think those of us who sit in studios on tv are trying to read a mans heart. We dont know. What we do know is what the evidence says, we dont know if hes racist, made a decision based on race. What we can ask, though, is based on the evidence, why did officer wilson do certain things . I think its fair to ask him if he had to shoot 12 times to take this man down, did he have to kill him, with the threat so great, you had to unload 12 bullets into this guy . I guess what we know from the testimony, from everybodys testimony is that there was the altercation in the street. He charged the car. There was a fight inside the car and then he ran away and he turned back around and started chargeing at him again . Right. The question is, when he was charging at him, did he have to shoot him . Right. I guess thats what constitutes a charge, he was 100 feet away. He wasnt in his face. A couple things. The first thing is obviously there are a lot of aspects of this that are not handled well. The officer was allowed to back to his barracks, before anybody tests, takes his own gun, puts it in a pastic. They didnt have the regular prosecutor. By the way, that wouldnt happen in new york, isnt there a fatal shooting, a cop shoots somebody, everything stops, the investigators come in . Oh, yeah. The cop is not going back to the barracks . They did go to the hospital and measure his wounds. So you have real questions around how it was handled. You had cops conflicting reports. A preupon drans report in a direction of events we have been talking about. I do honestly think if what is said is true that this cop was sitting in hills car being punched and wrestled for his gun, this huge guy runs away, turns back at you, im not sure any of us would behave completely rationally, was it elastic . Was it not elastic . How many shots should i fire . Should i aim at his knees . I will say also, should a 6 4 guy leak me is running, charging at ap co, thats a little bit different than you charging at a cop. You know . So again, were trying to get, like we said, into his head. You asked the question and George Stephanopoulis asked the question would there be any difference . This to me is key. Its very hard for us sitting here to say categoryically there would have been no difference. Thats correct. Also, maybe e members of the black community are almost entirely saying they believe there would have been a difference. Thats almost as important. Its very important. You look at all the stats, blacks and whites get picked up for a traffic crime as often as each other, three times more often blacks will be cuffed and arrested in those circumstances than whites are. Right. They are coming at this with a history of mistrust and the thinking and the evidence is there to support them that they are unfairly targeted. So its hard for them to look at this report and say, and to believe officer wilson when he says, if Michael Browned a been white, i would have acted exactly the same way. Let me get one more story in here, for this block the Weekly Standard is drawing attention to the way president obama acted on immigration. The article notes, however, over the past few days, the white house says the president s action falls within the current law. Here is how the president addressed it yesterday while speaking in chicago. You are absolutely right that there have been significant numbers of deportations. Thats true. But what youre not paying attention to is the fact that i just took an action to change the law. Okay. So, we have weekly stand up. You can just put obama colon. This doesnt have to do with the Weekly Standard. This is barak obama the president of the United States, i see you smirking. What am i going to say . This is the moment, this is the moment in perry mason, you will remember this. I do. Where perry mason, well, madam. I killed him, i killed him, whatever, this is a moment in perry mason the defendant admits, i stole the jewelry, when the president says, i took action to change the law and seen unconstitutional. Its pretty jaring. I mean, we knew, i knew at least he did that. I have been saying that. This wasnt about bush and reagan doing executive order based on an 86 law that Congress Passed. This is a guy who has been saying i did this because congress wouldnt act. Now hes admitted, i created a law. He proved snl right, doing all this Fact Checking on whether or not that snl skit was right or wrong . He did the executive action. I wish i could think of a snappy witty response. I dont have it at the moment. You want me to take it from bad to worse . Thats pretty bad. I want to hear from the whole panel. If it said id changed the practice of deportation, which is what he should have said. Oh my god. Ive ended the policy to change. The same thing he is saying, he just said it differently. He didnt Say Something all of us didnt know. He just said it. Water that, roland . Is this that big of a deal . Yes, it is, constitutionally, it is. Constitutionally, he can also sign an executive order. The bottom line is congress can still act harry truman also signed an executive order to desegregate the armed forces, people upset, guess what, if you dont leak it, can you go in and change the law, im not tripping on it. Pass a law, pass a bill. The Supreme Court, i dont think tail trip on it, they may say its unconstitutional. Get over him, get over it. You dont like it, pass a bill, get over it. Just pass a bill. Pass a bill. There is so clearly about the president. Lets be clear here, this is about the constitution of the United States. This is about the separation of power. This isnt about james madison, this isnt about whats happened in the past, what will happen in the future. Yes, it is. Its about an imperial presidency, president obama said himself, if the Supreme Court takes all of what the president has said and then about it being unconstitutional and adds this on top of it. Im saying practically, maybe its a big deal, maybe its not. The Supreme Court has to act. They have to rule this unconstitutional. Oh, god. Wait, wait, what makes you tired all about the constitution . You should be tired with the president with the president that is so willfully lets go to the next story. You should be tired of president obama saying its unconstitutional, then im going to do it, tan saying, i dont need corporation i will just write my own law. Well, at this point im happy for the small section of humanity that might actually get some peace out of this, if congress doesnt act. Pass a bill. Just pass a bill. Look, joes point. I get his point. No, you dont. I get so its a big point. Well get to that in a second. Okay. Joes point, it should be litigated to the United States Supreme Court to find out whether this is legal or not. I happen to think it is legal. I dont think what he said in chicago is like admissible efdz in the courtroom. We will find out in the fullness of time whether what he did is legal or not. Then well know. Hes had a team looking at whether its legal or not the whole time through this process. Where were they in 2011, 2012, 2013, when the constitutional law professors said it was unconstitutional if he did this. We have a Supreme Court. Its sort of why theyre there. The president came too recess appointments. So he takes some action. The court ruled. They say what, constitutional. They say a former care act. Constitutional. Okay, so he took the action. Thats why theyre there, earn your paycheck. Rule on it. So what, well see what the court says, then as ike said on this show, the republicans have to pass a bill. So we can go through watching the courts do this or have the republicans pass a bill and avoid everything. If the Supreme Court is just some hobby that we picked up, a constitutional republic. The emotions of this before the Republican Party just pushing everything to try to bring everything down the president is trying to do, im not going on some sort of tear, depending on the president. They have an opportunity to get something done. They have an opportunity to get something done, to function. Thats in this coffee mug. This is legislation. Thats great, pass a bill. They have this coffee mug, this is unconstitutional. This is a Supreme Court stop, this is congress job. I get it. Can i remind you, Congress Passed the feingold, even when the Congress Passes law the Supreme Court still rules on it. Its a cause, because the Supreme Court rules on what congress does, whether its constitutional or not. No. And they rule on what the president does whether its constitutional or not. Yes. So if you take action he is acting like there is a job. We are not arguing this. You are. We go to chicago and somebody says i changed the law, necessarily means this is more than semantics, it could mean he made a mistake, he could have said, change the pennsylvania we have to leave it to lawyers as to whether he misspoke. Yesterday at the National Press club, in order to win in the future, democrats have to make themselves in the progovernment party and show people government can work. But he went a step further, suggesting democrats went on the wrong path when they began focusing so intently on health care after implementing the stimulus. Unfortunately, democrats blew the opportunity the American People gave them. We took their pan date and put all of our focus on the wrong problem. Health care reform. Now, the plight of uninsured americans and the hardships caused by unfair insurance practices certainly needed to be addressed, but it wasnt the change we were hired to make. Americans were crying out for the end to the recession, for better wages and more jobs, not changes in health care. The Affordable Care act was aimed at the 36 million americans who were not covered. Its been reported a third of the uninsured are even registered to vote. In 2010 only about 40 of those registered voted. So even if the uninsured kept with the rate, which they likely do, you would still only be talking about 5 of the electorate. Its a huge change in mandate for such a small percent annual of the electorate made no political sense. So when democrats focused on health care, the average middle class person to the, the democrats are not paying enough attention to me. Funny, he is saying what you were saying then. Yeah. And back then he was defend shopping obamacare. Im almost positive. That will be one of the great mystery, steve that, the president really did in the first term, he had an extraordinary mandate if 2008. He pretty much bet it on the health care, the 18month health care battle. Yeah, the president believed that you get the most done in the first couple years of your first term and after that, it tends to tail off. And he wanted to have, a defining signature piece of legislation, which Chuck Schumer was my friend, i was a finance chair in 1998. Theyre saying it should have been about the middle class. Remember bob for jobs . He did push that, he did support the push for Health Care Reform at the time. Yes, because chuck is a good member of his leadership and others party. He did what his president wanted him to do. Now i think in the after math of this election, you are starting to hear other views. Its quickly who joined the course, Elizabeth Warren agreed to for schierm, there was an urgent need in 2010 for middle class families struggling to get by, more should get done. She was doing a lot of that, too. A lot of second guessing by democrats who are obviously very supportive, of the president s efforts. You think its monday morning quarterback shopping or do they have a point . No, i actually i think what we are doing is we are focusing on really the wrong thing, schumer talked about, we have to make the argument moving forward in terms of how government matters. That literally is the exact same speech senator Elizabeth Warren gave to the center for american progress. I was there for it. So schumer will have his eye sit on the majority leader. Trust me. He sees a threat. Not in the center, Elizabeth Warren as an ad advisor, a consultant, whatever the harrisburg you want to call it. You can tell he is trying to sell a populous message especially when hes the center for wall street. Its real clear what he is doing right here. Its slick, but its clear. Except that two years ago, three years ago, now he wrote a book about the importance of the middle class. I dont think chuck is new to this party. He wasnt saying it. And he wasnt driving that message. He wasnt lead tack message. Again, he has a somewhat on his flank pose a threat who knows how to charge up the base as all of a sudden its, oh, lets go beyond the issue of health care. He understands that she is going to be a force over the next two years and he has to recalibrate his message, otherwise, he looks out of date. Lets check in with mike alan, the chief white house correspondent, he has to look at the morning playbook, good morning. Good morning. So Chuck Schumer is not the only democrat upset with the strategy in 2014. What else do have you here . Its getting crowded, the virginia governor, terry mcauliffe, one of the partys last swing state governors, a Democratic National Party Chairman and friend of bill and hillary, he is saying that democrats made a huge mistake in this election with no message about jobs, very similar to senator schumers criticism of the earlier failure to focus on jobs. Its interesting about what governor mcauliffe said is that it echos a point that bill clinton made at a playbook event down at his Library Anniversary that the democrats should have had a National Advertising campaign, some sort of National Message about what you get from democrats and hes been calling his fellow democratic governor 16 so far to say that democrats need a real retool and fast. Mcauliffe said what was the message of 14 im ask shopping retorically. The next stage of obamacare taking it to the shopping malls, explain. Thats right. This is a big change from the last obamacare open period when the president was on between two ferns. Joining us now from walk, nbc news justice correspondent Pete Williams. Pete, good to have you on the show this morning. Lets talk about the grand jury process. Pete, we have been hearing over the past 24 hours, this one was different than most others. And why . True or false . Well, no question about that. Normally in a grand jury, what the prosecutor does is show the evidence to the grand jury that would make a criminal case. The prosecutor says, heres what i could do. Here is the law. Here is the evidence. What do you think . Yes or no . Should we prosecute . This one was different the prosecutor by his own statement said i want to do this differently, i want the grand jury to see all the evidence thats helpful to this state. What is that, pete . What was the justification for that . Especially a case as racially sensitive as this one . What he said was because this case is different, because he wants it to be transparent, because he wants the grand jury to see everything, in other words, the importance of the case to the community justified this different approach, this unusual circumstance, knowing how much was at stake. The problem is, thats not the way most grand juries are conducted around the country. Of course, its not the way they are conducted in that county. Now, in that county, you dont have to take every case to the grand jury. They take about half of them that way. I can guarantee you they dont do this in routine cases and thats whats led to the criticism. Because they wanted there was such interest, didnt it actually do the opposite of what he was saying it intended it to do . Didnt it actually build up more curiosity, even more stress, even more, quite frankly, criticism for the system . Didnt it make people more angry . Didnt it look like they wanted to make sure they protected what they were planning on doing . Reporter well, thats certainly the point that the brown family is making here, in essence, they say the prosecutor led the grand jury to this conclusion by giving them the evidence on both sides, by letting them hear from officer wilson. Thats unusual. Targets of grand juries dont normally testify and remember, its all only just the prosecutors, the defense lawyers dont come in, but still it wasnt a real crossexamine you could say. For all those reasons, there are questions about the grand jury. The fact that all the grand jury material was released now cuts two ways. On the one hand, it could help the family, they can see all the evidence. If they decide to file a wrongful death lawsuit, which seems very possible here. On the other hand, if the Justice Department is going to pursue its own case, thats a tall order. We can talk about that. But if they do, that means that all the potential witnesses now have seen all the other potential witnesses have said. I talked to one former prosecutor who has brought these cases before. He said thats not something they would normally like to see. The protectors down in ferguson, some are saying the reason we are out on the streets and some have resorted to violence in ferguson is because they feel they no longer have recourse, they have reached the end of the official road. Are they right in thinking that . Reporter well, not, not entirely. And there are id say three reasons why. No. 1, there is still the prospect of a Justice Department civil rights prosecution against officer wilson. The Justice Department is still pursuing that. They will hear the evidence and try hard as they can to see the case. Its a tall order. Under the law, they will have to prove officer wilson acted with force, knowing it was wrong. In essence, they would have to try i to prove he was not in fear for his life. That would be a difficult thing to do. Secondly the family can file a wrongful death suit. In a criminal case, preponderance of the evidence, more likely than no. Thats what the standard would be. Thirdly, i think, institutionally, if they are concerned how the Police Department and the county conducts itself, there is the prospect of change here t. Justice department is also investigating the department, itself. And very often the government will enter into consent decrees with Police Departments saying we will sue you unless you do this. If the county says no, it goes to court the court can order it to make changes, that does seem very likely evident. Nbcs Pete Williams, thank you very much. Have a good thanksgiving. After the verbal exchange, he says he reached into the police car and grabbed for the officers gun, during the struggle, brown says the officer punched him in the face. Is there anything you could have done differently that would have prevented that kill shopping from taking place . No. Nothing . No. Are you absolutely convinced when you look through your heart and your mind that if Michael Brown were white, this would have gone down if exactly the same way . Yes. No question . No question. Is it something you think that will all the haunt you . I dont think its a haunting. Its always going to be something that happened. You are, you have a very clean conscience . The reason i have a clean conscience is i know i did my job right. The interview not a very emotional interrue, was it . Does it make anybody feel more like this is what makes sense over the last 24 hours . I think the way he walked through every step of what happened, he seemed to have pretty clear recall of the events and thats what three months ago. Yet he still seems to remember, this happened in this sequence. I thought he came across, hes been, you know, this guy has been demonized in many areas of the press and demonized by people down in ferguson, actually, i thought he came across as fairly calm and checked and not as demonic in the course of that interview. Now that doesnt negate the fact that it might not have happened the way he remembers. There are other witnesses all way he is describing, there are other witness accounts that suggest it happened. It doesnt really negate the fact that when he says it would have been exactly the same if Michael Brown were white. Im less sure about that. Im not sure i read too much into it. I would be shocked if he were not well prepared by that interview by the lawyer. Le still has that exposure him he would have been well prepared, a lot of mock questions, a lot of mock answers and he would have been he was a credible interviewee . Yes, yes, i agree with that. I think this interview, like everything in this case, depending on your point of view, you see two different things, some people who dont like officer wilson saw somebody who was cold, didnt show enough emotion or remorse for what they wanted to see. On the other side, they saw an officer who he said was doing his job. So i dont think, in this case, like everything elts in ferguson, were all going to agree on one thing. We can agree, tow that, the makeup of the Police Department and just the system, itself and even some of the officials involved, if this officer is completely clean and if he didnt do what he says he didnt do, the system was set up to fail him. Because it was so flawed that millions of people are going to have a hard time ever believing him. Joining us now from atlanta, law policy at law professor. You work where youth and urban communities, first, what do you make of the interview with officer wilson and do you feel he answered to some of the really screening questions out there in terms of race and how he treated Michael Brown right before his death . I found officer wilsons interview to be quite disturbing, to be honest. He stated that he could not have done anything differently, but if you consider you have an unarmed teen walking, jaywalking in the street with a handful of cigarellos that ends up on the floor in a pool of blood dead, clearly, he could have done something differently. I find it disturbing he seems to have little remorse. There is a lot of a child another life, he seemed almost stoic with respect to his response. What could he have done differently that day . Well, part of the problem is what the tragic death of Michael Brown represents is the practice of using adult policing practices on youth. Currently here in the united states, very few Police Departments actually include training on being a youth developmental conference, how do you deescalate a situation from jaywalk shopping to keep it from escalating to the point of murder. You say you, hes 18, 6 4 itse4 , actually if the testimony is correct, charged into the Police Officers car and started punch shopping, i had the conversation around the table here if i, a 6 4 man did that in any community in america, chances are good a Police Officer would grab his or her gun, is that not fair to say . I think thats an interest shopping point that youve made, however, yes, he was 6 4 and 18, but developmentally, his mind was that of a teenager and based on studies that have been done in research in the area, teenagers are slow tore respond to Police Commands and so there are still things that officer wilson could have done as the adult in the situation again to deescalate the situation from the jaywalking into a more peaceful outcome. He could have adjusted his behavior, luongo and timing. You say that i make an interesting point. I wonder if you think it is the case, in fact. Really . Lets say in a traffic stop, i get out of the car and charged at a cop, i think because, again, im 6 4, of course, much older, i find it hard to believe there is not a cop in america that wouldnt consider taking very aggressive actions against me to put me down. I think that a cop, a Police Officer would want to take aggressive action against you under shows circumstances, again, had officer wilson had training, it wouldnt have gotten to the level of Michael Brown charging him. Thats allegedly charging him. He would have been able again to transition from a jaywalking violation to perhaps a more peaceful arrest. I still think the lack of training amongst yoourkts i have to be quite frank with you, there is unconscious bias. He described Michael Brownsifies i face looking like a demon. Would he have described you as looking like a demon. If anybody has seen me charging at them, they would say, yes, i look like a crazy to neils point, its absolutely right, there are unconscious biases, its incredibly hard for us to get to the bottom of what officer wilson was thinking. I will say this, obviously, im suggesting that, i said it all morning, that there is, if you got a 6 4 white guy coming at a cop, you may get the same reaction. I will say the point. I would focus on her is the training and the question, how does a jaywalking incident turn into an 18yearold being shot dead and left in the streets for fourandahalf hours. What department does that . And that would nerve happen to a white child. Ever. You are talking about stay shopping in the streets before. Im sorry. As far as the shooting goes, you can understand, once it escalates. I can at least understand, once it escalated, why that happened . It would have happened to me or you, womanly, as a 6 4 guys, also to Michael Browns state of mind, why he was so angry towards the police force that is 95 white and probably has not been seen as helpful through the years. You cant put this in a vacuum. Dr. Mcneil, if we gain this out, what should have happened . Officer wilson pulls up, he sees two young men, asks them to step aside what would have been a more positive outcome in this situation . Yes, first what officer wilson should have done, Michael Brown was walking with his friends, she should have separated them, simply because teenagers tend to want to perform or behave differently when they are in front of their friends do you to peer pressure. He could have pulled him to the side and had a conversation with him. Opposed to again, i wasnt there, thats one thing she should have done differently, been careful, had he had the training, he would have understood africanamerican cultural queues, meaning understand if we are talking with our hands or a lot of passion, its not an act of aggression. Its a kuhn indication style. Again, there are several things he could have done with his language, slow shopping his language, not being confront of theational, separate shopping him from his friend. I dont think they were ready for it. I think four years later, if it happens, i think they are ready for it. I think theyre more prepared for what we went through. You look at those numbers. I see the Republican Party is desperate to have a candidate. They need to start focusing on somebody, theyre up against democrats who have a candidate. They need to want to be in a similar position. I look at those numbers and say, are we forgetting what a bad candidate mitt romney was . He was a terrible president ial candidate. It was not that his ideas were bad, its not that his policies were wrong, he came across as a bad candidate time and again. The question is. Fe has to have really improved to run a viable candidate. The question is, though, did he learn from his mistakes . And that we dont know. Can you not test that until he is back out in that High Pressure situation again, right . What does it say about the field that we are talking about mitt romney again . It says more about the field, probably, than it does about mitt romney. Well, i think, we saw a monumental blunder. I dont think that there was a great intentionality. But for sure things were done in a the way does not make sense. I mean, we had a buildup to the first night and we will release a statement at 8 00 and so forth. Look, im not an attorney, but i would imagine that the grand jury completed it work earlier in the day, or the day before, so the press conference to announce what the grand jurys decision was could have been done at 8 00 a. M. In the morning or at 10 00 a. M. Its almost like we will build this cre slen do and watch the explosion. It said if people are in the street, its simmer shopping. Its a buildup. You can tell something really bad is going to happen. Congressman, we were talking about this yesterday, it didnt make any sense to have that buildup. Another thing that doesnt make a lot of sense for black Small Business owners in ferguson and i read this in the New York Times this morning, a lot of black Small Business owners feel like they were abandoned by authorities, who have been tell shopping them for weeks now, dont worry, were going to protect you. I was in ferguson last week and you could see that while in the middle of all of this chaos, there were Business People who were there holding as tightly as possible to hope that things would not be as they were in august. And the one thing that i think, i hope you would understand and that to blow up a building to fire bomb a building, to debt fate a community, there is no intelligence required, no charisma, all he has to do is be stupid. Those are the people that did, probably 50 people out of that crowd were out doing stupid things, people were saying, lets boycott. Hook, what we ought to do is get every decent person going into ferguson to boy, that town had income revenue from traffic tickets, so we got to, you know, think this thing through. A lot of people say lets boycott, they will further damage Small Business people who are the backbone of ferguson, missouri. Congressman cleaver, its willie geist. Its good to see you this morning. In the after math of any national crisis, like this, it seems its cliche, there is a teachable moment. We should have a moment thats productive. What would you like to see come out of this . What should the country be talking about . What should we learn from this . Well, i think, if we get nothing out of it as we have done in the past with the situation with Trayvon Martin and others, i think that we ought to be nationally ashamed of our sales, to go through something as chaotic as this without getting something out of it. First of all, fortunately, congress cant offer too much in the way of help because what are we going to say to the demonstrators . Look at us, why dont you conduct yourself like members of congress when are you in a tough situation . Right. But i do think that some National Legislation otocome out of this, congressman clay and i would do something next week. I would think on this prethanksgiving day that its not a republican or a democratic issue. We otopass National Legislation that will create, i think, a positive atmosphere after this thing is over, that is, that Police Officers, Law Enforcement officers, must wear cameras and that as we did years ago with the cops program, we would make federal grants available to small communities that cant afford to have these cameras. I think it will probably prevent some hood lums from acting crazy and probably some Police Officers who might not be psychologically equipped to be Police Officers. I think its a protective for all. I cant help but think this entire episode is pardon the line more, coarseens the debate even more. You know, senator paul has been talking about scaling back on the war on drug. Its something he has been on about. Its interesting he connects it to this. It does create an entire culture, you know, both in the evener cities, but also between the police and young black males, thats not something thats sustainable. We have to attack the real problem, which is its really tough grow shopping up as a black male in the cities of this country. You are going to get killed. You will get killed by people in your own community. You dont feel the cops are there to protect you. The cops should be black, too. The cops should always feel like theyre a part of the community. They have a high rate of black men being killed by Police Officers, he says, when his kids go out, he doesnt worry about his white son. He worries about his black son. They are brothers, they live in the same neighborhood, yet his concern is for his black son. And whether or not thats totally reasonable, it is a full fledged perception across this country and its hard to tackle that. But its not impossible to tackle that. I mean, if people in, you know, various good mayors are doing it. I can see president obama going to a church somewhere in st. Louis in the next couple of weeks and giving a long talk about how we have to restore a sense that the communities are safe. Christies whole schtick is he is a great manager and leader, right, he has done great things in the state of new jersey, taking on the Teachers Unions, thats what hes always talking about. He is fantastic at retorical flourish. He attacked the credit agencies rather than govern shopping. To what extent was taking on the Teachers Union a cause of this financial problem or a solution to it . I mean, he tried to portray it as a solution. Were talking about his budget director was making incredibly unrealistic assumptions, growth rate. We will be lucky if we get 2 to 3 bucket growth reads. This is unrealistic. So there is substantial billion dollar budget gaps. Wow. Are the ratings actions being overly aggressive or is Chris Christie so bad . He is trying to make that claim. If you read the piece, i get into a more technical drive. We can talk about those. The numbers speak for themselves. So he goes and attacks those at home and which is his trademark style. If you look at how new jersey is doing relative to its peers, leaving aside the agencies themselves, relative to his peers, other states, their Fund Balances the general reserve fund balance is going down while other people are going up. So, other than the assumptions, what fiscal decisions has he made that he could be blamed for . Did he, could sam brown get hammered for cutting taxes too much and kansas creating a crisis . I havent heard like massive tax cuts there. I mean, obviously, he inherited a basket case, a fiscal situation from his predecessor, right . Its interesting, he had a down or an upgrade right when he took office for doing nothing. It was a pure method logical change. He had an upgrade. A huge issue is pensions. Westerly. I thought it was. Okay. Turning to the situation in ferguson right now where officer Darren Wilson is speaking out for the first time about the shooting that killed Michael Brown. Wilson says the altercation began after he asked the teenager to move out from the middle of the street. After a verbal exchange, wilson says brown reached into his police car and grabbed for his gun and during the struggle, the officer says brown punched him in the face. Is there anything you could have done differently than would prevented that killing from taking place . No. Nothing . No. And youre absolutely convinced when you look through your heart and your mind, that if Michael Brown were white, this would have gone down in exactly the same way . Yes. No question . No question. Something you think will always haunt you . I dont think its a haunting. Its always going to be something that happened. You are you have a very clear conscience. The reason i have a clean conscience, i know i did my job right. Im just curious. So we have stated and i have stated repeatedly that there are two criminal Justice Systems in america. Yeah. Black young men, especially, are not only treated worse on street, theyre treated worse in the court system. Theyre treated worse all the way through. White kids get away with, black kids dont get away with. All right, so everybody agrees with that . Yeah. That said, if whats in the grand jury report is true, and if i stood in the middle of the street in front of that Police Officer and then ran to his car and started punching him and grabbing for his gun, does anybody presume that i would not be treated the same way . Because i will tell you, cops are jerks to everybody when you dont do what cops tell you to do. If thats what happened, i think its what the grand jury says. So i just there is an element of race. But as far as this specific event and this cop goes, im just curious, does anybody on this panel believe that if i confronted a cop, stood in a new york cop, lets say, Staten Island, and the cop said, get out of the street, and i said no, and i started swearing at hill, went up and started punching him and started grabbing at him, like the grand jury report says, if that is, in fact, true, what would that Staten Island cop do . Steve . Youve lived in new york for a while. What would a new york city cop do to me, white guy . Well, at that point in time, probably exactly what he did do, which is try to recover his gun, the gun went off. But i think theres two other pieces to this. One is you are a big guy. Brown is a big guy it its a little different than if me or catty or somebody were in a fight with a cop. If i had a 250pound guy coming at me the cop is a big guy too, 64. Fair enough, big guy. Critical part came later when he turned, ran back at him. Thats where the fatal shots were fired. Roland, young black men in america are treated badly compare to young white men in america. The criminal Justice Systems not fair to them. Et cetera, et cetera, et cetera. I think we all agree with that. Im talking about as we look at this cop and his testimony last night, George Stephanopoulos at one point said, well, did it have to do with the color of his skin . Im 64, i weigh way too much, im a big guy. If im coming at a cop on staten island and i go into the car, if we believe the grand jury report, do we believe the cop would act differently towards me than Michael Brown . Ill ask this question, how many times have we done stories on white men who have been shot and killed by cops . I mean, we weve seen well, im sure white men have been killed by cops but theres not the racial component so but follow me here. Heres one of the issues that we begin to talk about, just the grand jury report you understand when i say roland, white cop kills 64 white guy thats not the story that this is because there is the racial component in ferguson which of course has a horrible racial divide now. I understand. Also, i take into account the fact that Darren Wilson was at a Previous Police department that was disbanded because of various problems. Heres the other issue that really jumps out. Darren wilson is offering testimony that was given or was put together six weeks afterwards. He never did an Actual Police report right after the incident. So part of the problem is Darren Wilson had an opportunity to literally, six weeks later, say, well, this is what happened. As opposed to right after. So part of the problem here is also how Ferguson Police investigated this particular case. Now, am i am i alleging that he changed his story . Im not saying what im saying is we would have a different view if we got his view of what happened immediately afterwards. We didnt get that. And this the grand jury shows that. Let me just say, roland, to back that up, and im not saying that he lied in front of the grand jury testimony, but you can be coached. You can be prepared. And the one thing that did jump to my mind, as i was reading his testimony, is he kept talking about the hand in the waistband. Right. And he kept repeating that. Which of course is justification, i didnt know if he was going for a gun or not. There were eyewitnesses who said, including a little girl, who said he was charging at him like a football player. Also, joe, heres the other issue. He had on basketball shorts. Thats an elastic waistband. One of the witnesses said you cant a gun cannot just sit in those kind of shorts. That kind of big guys running, that gun is slide supposedly a gun if hes doing a full charge at you people at home that are going to say, well, why are they talking about the waistband . He kept talking about the waistband. Its kind like when my kids when my kids Say Something way too much. Its like, okay, youre giving yourself away here. But, joe, hes the best one, hes punching me and he stop, takes the cigars and tells his friend, hold these, and goes back to punching a dude, im n going to stop and say, hold my cigar, let me go back to punching. Again, lisa bloom did a great job of literally going through and breaking down a lot of discrepancies in how mccullough did not push back on a lot of his testimony and just took it at face value. I think part of the reason this is such a tough case for a lot of people is those of us who sit in studios on tv are trying to read a mans heart and we dont know. What we do know is what the evidence said. We dont know if hes racist. We dont know if he made his decision based on race. Based on the evidence, why did officer williams be do certain things. I think its fair to ask him if he had to shoot 12 times. Did he have to kill him. Was the threat so grave that you had to unload 12 bullets into this guy . So i guess what we know from the testimony, from everybodys testimony, is that there was the altercation in the street. He charged the car. There was a fight inside the car. And then he ran away , then he turned back around, started charging at him again. I guess i would ask what constitutes a charge too. He was still more than 100 feet away. A couple things. The first thing is that obviously there are a lot of aspects of this that were not handled well. The officer was allowed to go back to his barracks, wash the blood off his hands. Take his own gun, put it in the plastic. They didnt have a special prosecutor. They used the regular prosecutor who has some history by the way, that wouldnt happen in new york, right . If theres a fatal shooting, a cop shoots somebody, everything stops. The investigators come in. Oh, yeah. A cops not going to go back to the barracks. Thats just bush league. But they did go to the hospital and measure his wounds. So you have real questions around how it was handled. You have some conflicting eyewitness reports. The prepond rens of the reports point to the events weve been talking about. If what we know if what is said is true, that this cop was sitting in his car being punched and wrestled for his gun and this huge guy turns and runs away, then runs back at you, im not sure any of us would behave rationally. And say, how many shots should i fire. Should i try to aim for his knee. I will say also, if a 64 guy like me is running, charging at a cop, thats a little bit different than you charging at a cop, you know, so again were trying to get, like we said, into his head. You asked the question, would there have been any difference if Michael Brown had been white. To me is key. I think there is. Its very hard for us sitting here to say categorically there would have been no difference. Thats correct. And also, members of the black community are almost entirely saying they believe there would have been a difference. And thats almost as important thats very important. You look at all the stats. Three times more often blacks are going to be cuffed and arrested than whites are. So they have a theyre coming at this with a history of mistrust and of thinking and believing and the evidence is there to support them that they are unfairly targeted. So its hard for them to look at this report and say and to believe officer wilson when he says if Michael Brown had been white, i would have acted in exactly the same way. How im going to get jim palmer into it. The next thing you know, all hell is breaking loose. I have lived in california so i understood the feeling of an earthquake. Theres just that one moment where youre going, wait a minute, its the world series. This cant be. Its the giants against the as. What, whats happening here . And it was it was only 15 seconds but it felt a lot longer. And there was one pretty petrifying moment when i felt as if we were going to be pitched out of the back of the booth. You know, growing up, im from the south, but i lived in upstate new york for four years. And the only posters i had on my wall were of Paul Mccartney and o. J. Simpson. Talking about how people cant remember what 1980 was like. People cant remember how o. J. Simpson was the epitome. He was the golden child at usc. He was always smiling. He was a good guy. His linemen were his friends. It was i sat in wonderment watching o. J. Simpson run in the 70s. And you were you were good friends with him. Tell us about o. J. And, my gosh, just the contrast between what we thought and what he became. Well, he was a colleague, for starters. I worked at the l. A. Olympics with him. Then we did a few other things at abc together. Help w he was a neighbor. He had a tennis court. This is before i played golf and i wanted to play tennis all the time. I was at the house probably three times a week playing with him. When his knee became south and he became a golfer, my new tennis partner became al callings. When this thing happens in 1984, i know about everybody. Obviously, i knew nicole. I met nicole when they were engaged. And this thing happened and i go wait a minute, this is like the murder of the century and its in my neighborhood. And i live about halfway between where nicole lived and o. J. And i know everybody involved in this. So it was surreal. It was, you know, i would wake up for a couple of days and go wait, this is not happening. You cant be this close to a situation and know all of these people and theyre involved in this. And of course the way it played out over the next year and a half was just crazy. You have this connective tissue to all these people. But to o. J. Directly. And he never said to you, i didnt do this . And that gave me pause too. I talked to him on the cell phone during a couple times, during that period. He was upset about the way it was being covered. One conversation i had with him a couple of days after the murders, i think he alluded to that he was working for nbc and knew everybody at nbc and he couldnt believe the way the nbc local affiliate was treating this. So i figure, all right, heres a guy whos going through all the wackiness. When i visited him in jail on three occasions, he kept saying, how can they think i did this . And not i didnt do this. If you didnt commit a murder or double murder, arent you pounding the walls . Maybe im wrong. But at the end of the day, i would think what do you mean how can anybody think i did this .
