First, on some mondays when lawmakers come back to work and get ready to answer questions from reporters like me on capitol hill, they usually have a pretty good sense of exactly what it is were going to ask when we show up with our microphones. Tomorrow however i dont think is going to be one of those mondays. The first question they get could be about the president s decision to back off his threat to impose tariffs on moeexico a the new reporting from the New York Times that the deal the president announced consistents largely of actions mexico had already promised to take months ago. Or the first question they get could be about the upcoming contempt votes on tuesday against attorney general william barr and former white House Counsel don mcghan over their refusal to cooperate with congressional subpoenas over the Mueller Report. Or we could ask about Nancy Pelosis comment this week about wanting to see the president in prison rather than impeached. The president , of course, responded to nancy pelosi while sitting in front of the graves of fallen troops in normandy. Shes a nasty, vindictive person. She made a nasty statement while you were overseas. If i made a statement about anyone, it would be why did he do that over seas. I tell you, her name is nervous nancy because shes a nervous wreck. Joining me is chris van holan of maryland. Lets start with what the president said while he was overseas speaking with fox news. Its Hallowed Ground behind him really, going after his political adversaries. Democrats have been very careful, nancy pelosi was careful, joe biden in a similar circumstance when the president was overseas also careful to try and at least pretend that theyre leaving politics at the waters edge. What do you think i mean, does anything surprise you about this president now doing that . Or how do you think nancy pelosi should respond to that . I think she responded exactly how she should. Which is essentially ignoring him and taking the higher ground. Here you have the president of the United States with a cemetery in the background after solemn dday ceremonies launching an attack on the speaker of the house, calling her names. And the hypocrisy of him saying she said something when he was overseas and him overseas making the statements. Its another example of the president s depravity when he goes over seas. He always ends up embarrassing the rest of us. He was in japan a little while earlier and at that time you had the white house ordering the removal of the uss john mccain and the day before they put the tarp over it because they didnt want the president to see the name of a war hero. This is unfortunately the president that weve got, which i hope we have a new one in 2020. I want to ask you on politics, i know we have a list of substantive issues to get to, but the democratic field, the president ial field so far is playing by the rules. There are some democrats who said the president has thrown the rules out were hamstringing ourselves if we follow the rules. Which side of the debate are you on . My view, you have to tell the truth. You dont go low just to go low like the president of the United States. But you have to call the president out when he does things like he just did. You have to call the president out when he goes after john mccain when he himself got his father to excuse himself from the war because of a bone spur. These are issues that people can talk about. They go to character. Yeah. My view is our main focus should be on the issues that the American People care about, the pocketbook issues the people are talking about around their kitchen tables tonight. You cannot let the president go unchallenged when he says an outrageous thing. On the other hand you shouldnt chase every single thing. I think you outlined the challenge of running against tru trump. Lets start with the stannive issues, and mexican tariffs. It seemed most of this was in the works before it all unfolded. Seems there is now a deal to divert tariffs with mexico. At what point does the senate have to take some action here . Again, you have sort of this president s m. O. Here where he sort of creates these big threats and then, when mexico agreed to pretty much what it already agreed to do in previous weeks he claims victory. I think the reason he decided to try this face saving measure was because i believe in the United States senate had we had a vote to overturn this veto, we would have excuse me, over turn the tariffs. We would have gotten a vetoproof majority in the United States senate. When the president s folks went down to capitol hill last week, they got an earful from Senate Republicans about the president s mexico tariffs. I can tell you, having talked to a lot of republican senators this was one thing they were willing to go to the mat on. I think the president decided to back down here and look for the space saving device. Lets move to oversight because its a big week on capitol hill. Looking at were expecting contempt votes in in the house of representatives against the attorney general. Theres also initial hearings into the Mueller Report. You worked very closely, youre in the senate now, but a house guy originally. Worked very, very closely with the current House Speaker. Do you trust her strategy on impeachment and oversight . Yes, i do. I think what she wants to do is layout the facts for the American People. Which is why the Trump Administration is resisting so much. The president look, he knows tv. He knows that most people havent had time to read the Mueller Report. He knows if you have mueller before the congress with all the lights on, that the American People will tune in. We knows if mcgahn, his lawyer, is there talking publically about how the president encouraged him and instructed him to lie, thats a very different thing than when its somewhere in a big 300 page report. So what Speaker Pelosi is doing is laying out the facts. At the same time, the house as you dont think thats getting muddled at all in the narrative . A lot of americans, theyre fighting on a lot of different fronts and its not clear theyre getting anywhere. They havent gotten anywhere because the president threw up the roadblocks, which is why theyre doing the contempt motions so they can go to court and have the strength to require the documents and witnesses be produced. At the same time theyve had Good Movement when it comes to subpoena the documents from Deutsche Bank and the trump enterprise organization. So look, they want to put together the story. Speaker pelosi, youve heard her say this before, public sentiment is very important. So i think the House Democrats have all the facts. They have the facts to bring a case. But they want to make sure the public fully understands the story. You mentioned Deutsche Bank and i know thats something you have been working on as well with your colleagues in the senate. Where are you in terms of actually being able to get Deutsche Bank to turn over records to illuminate this . The house has subpoenaed Deutsche Bank but weeks ago the New York Times did a report where they had a whistle blower from Deutsche Bank. This was someone that was a specialist for identifying Money Laundering. She flagged certain transactions from trump controlled entities and she was preparing to file suspicious activity reports and her higher ups at Deutsche Bank squashed it. They werent in the chain of command they were in the Private Banking part of Deutsche Bank. So what we asked chair brown, senator warren and others of us on the Banking Committee have said to the Federal Reserve and the Federal Reserve bank of new york that is supposed to oversee Deutsche Bank, we want you to investigate. Do your job whats it going to take to make that happen. Were going to stay after them. I wrote to them last year asking for assurances that they would remain independent and they would do their job, this is the Federal Reserve with respect to overseeing Deutsche Bank. They wrote me back saying absolutely they will investigate when theres evidence of wrong doing. Theyre an independent body. So this is their test. The test is whether now, as the regulator of Deutsche Bank they investigate these very credible claims from a whistleblower about potential Money Laundering from these trump controlled enentities. We want the Federal Reserve to investigate, we want to get the documents from Deutsche Bank. As all of these versio investigations are going on, the temperature is going up in the House Democratic caucus. The pressure is going up on nancy pelosi, she was quoted this week saying she doesnt want to see trump impeached, she wants to see him go to prison. Are you with her on that . What shes referring to i believe is the main event is 2020. I believe the main events removing President Trump from the white house is the election. And, of course, if hes removed after that, he is subject to criminal prosecution for any wrong doing hes engaged in. After all you think hes a criminal, the president . Look, that has to be determined by a jury ultimately sure. In terms of a crime beyond a reasonable doubt. Heres what i can say, his lawyer, Michael Cohen is in prison in part with respect to criminal wrong doing with respect to campaign finance, that the president was clearly engaged in. Thats up to a jury. What nancy pelosi is doing now is saying we have to put together for the public the case for impeachment. My view is look, my view is the president s conduct and misconduct clearly merits impeachment but what she believes strongly in is that you have to build a case with the American People, not just for elections. Great to have all of you on board tonight. Brendan let me start with you, pick up where we left off with the senator. It is going to be you know, democrats have had so much pressure to kind of get it together, show the public what theyre doing on the Mueller Report and were finally going to see some of that actually unfold this week. We have a hearing in the Judiciary Committee with jerry nadler and then, of course, a contempt vote for bill barr. What can democrats actually accomplish here . If you listen to Nancy Pelosis allies, they say the contempt vote sets them up to take action against the Trump Administration. I think the other thing theyre trying to do is for the first time get into the substance of the issues discussed in the Mueller Report. To this point i think theyve botched this. The Mueller Report has been out for two months now, all weve heard is democrats fighting with each other in conversations about process. They have taken no time to actually talk about whats in there. Thats one of the striking things mueller said when he did his press conference is, everything you need is here, its in the report, its in black and white. But theyre not talking about that, theyre talking about the process. I understand the fights they have, theyre not new between congress and the administration. Nancy pelosi hasnt laid out a standard by which shes ready to go towards impeachment. And at this point they need to convince people something is there, to say whats in the underlying report more than the back and forth with each other. Is it a mistake to keep waiting around for bob mueller to show up and testify . Reporter i agr. I agree with you. No matter how you spin it, the republicans are winning the messaging game. Im glad you pressed the senator on this, right now thats not the narrative. For the chatter class to sit around and spill over the minutia of it, its really about protecting america and our elections. And documents just reviewed by nbc news, there was new evidence now that russians are actively again attacking our democracy. So think there are members of congress who have not read this Mueller Report, everyone saw the sound bite that had the woman saying i didnt know the Mueller Report said anything bad about donald trump. That should let you know that no one is with you because they have not heard the story. Investigations, investigations, is the drum beat but sadly americans arent spilling over the minutia of that. So its not just congress, i would say the media has a responsibility as well to detail whats in the Mueller Report and why it impacts peoples everyday lives, which it does. Im hearing brendan and tiffany, which im not sure you ever agreed at this table before. Saying democrats are losing the war to the master of telling americans what to think about things and his base certainly believes him. Is there a successful strategy to fight back against that . This is key for Speaker Pelosi to hold off parts of her Democratic Caucus that want to hold off impeachment sooner rather than later. They have to show results from this. The problem is that republicans i think have a double incentive to slow walk this and resist it. As the senator was saying, if you get some of these investigations and these hearings rolling, thats going to reflect badly on the president. But also the more you resist this, the more frustrated the left flank gets, the harder they push for impeachment which i think republicans would probably like to see. I dont think they think thats a political loser for President Trump. What do you think the white house wants on this . Speaker pelosi said theyre trying to goad us into impeaching the president but you have to think that would be a terrible historic moment for them. Maybe. The way the country is so divided its not necessary a fate a comply that the country would look at the president as being impeached as changing their mind about anything. I think the white house looks at this as a way President Trump can say theyre playing politics, im trying to get things done. I dont think they have an allusion about this idea theyre going to widely grow their base of support. I think its possible and i think theyre hopeful and think if the democrats pursue impeachment at this point, that a lot of voters, where it matters, in battlegrounds that matter, will say i dont like the president but democrats are overreaching. They didnt like what they got out of the Mueller Reports and now theyre making it about all the things they wished mueller would have done. I dont like them either and so im done with all of you. I think thats why the president likes to have this fight. Dont forget, the president likes to have fights. He likes to have an enemy. He likes to have somebody to go after. Its where hes most comfortable. He cannot resist. Its where hes most comfortable and knows how to do. Weve seen this in the past that voters can say that a president or an elected official is a bad guy or maybe a crook but i dont like what the other team is doing about it, especially when the country is so buy fur indicated about it. I think they have to be careful and make the case if they do go into impeachment its justified. Can i say quickly briefly. That doesnt absolve members of congress from doing their job. That is their job. If the president has broken the law, democrats have to pursue it. When youre worried about those people in those battleground states, thats a scary place for our country to be. Your job is to protect democracy not necessarily appeal to a small sliver of the electoral base. Thats something the democrats have to worry about with the left. The question now, what did the president actually get out of it . The white house announced that mexico has agreed to deploy the national guard, increase actions to dismantle Human Trafficking operations, and wait some migrants wait in mexico while their asylums are processed here in the u. S. But the New York Times said the deal has actions agreed to month ago. According to the times they agreed to Deploy National Guard in march and agreed to keep Asylum Seekers in december. The two sides agreed to expand on some of the previous commitments is what was reported. Heres what Kevin Mcaleenan said about the deal in an interview this morning. All of it is new. Weve heard commitments before from mexico. The last time they deployed 4 or 500 officers. This is more tenfold. Just to be clear, it is not all new. As the New York Times and nbc news have reported. However, this has become, i think, all of us can probably agree, kind of the m. O. For this president , its become, if anything, predictable unpredictability. Lets take a look at. This is what Chuck Schumer said on tuesday. The past is pro log a, he mas the threats and then he backs off when he sees the danger. I think this just popped into his head. It was clear lots of people in the administration didnt agree. I believe he will back off when faced with the opposition among business, his own republicans and when he sees what a dumb move he has made in terms of dealing with both the border, the american economy, and with any kind of trade agreement he might try to get. Brendan, seems as though Chuck Schumer has been here, done this before. Yeah, its hard to tell whether mexico got taken for a ride, trump got taken for a ride, or we all got taken for a ride on this. Im glad theyre not there, i hate tariffs. But the issue isnt solved, hell probably come back and make the threat again. Im not certain he wasnt going to do this. Everyone seems convinced he was. On mexico he backed down before, but on tariffs he backed down. We talked about the 25 tariffs on china, everyone said no way thats going to happen and here we are. I think people convinced him, this is a selfdestructive move for you, dont do it now. I wish it was the end of the story but i think well keep talking about it for a while. He made the threat, he sort of married his two signature issues, tariffs on one hand and immigration on the other hand in a way that, you know, i think seems to have made sense to him but not to any other republican in washington. I think setting aside the question of whats new and what had been agreed to before, i think the other question here is, what are the costs to this kind of negotiating tactic over the long term. Theres reducing the strength of your word, credibility when it comes to the world stage. Youre releasing a lot of tension into a relationship we need. Its striking the mexicans talked about retaining their own dignity to their own people. Any time your relationship with an ally is introducing that element thats not the healthy way to conduct business. Now the focus is shifting back to the trade war with china. Heres what treasury secretary Steve Mnuchin had to say about that. If china wants to move forward were prepared to move forward on the terms weve done. If china doesnt want to move forward, President Trump is happy to go with tariffs to rebuild the relationship. Brendan eluded to this point. This is really the bigger tariff question here and the one that could have incredibly longstanding implications for china and consumers in the u. S. This traariffs fight with cha has had problems for the United States. The farmers have been hit thats why the government is now subsidizing them for the crops they can no longer sell to china. Theres the potential for economic and political ramifications in some of the 2020 battlegrounds but even in other states are huge. Thats why the administration is trying to be sensitive to that. I think this is different than other trade fights however that the president has picked because there is actually politically across the board a lot of support for the concept of standing up to china, both on economic and National Security grounds. Youve seen a lot of conservatives who dont like tariffs saying in this case with china im willing to do it. Youve seen Chuck Schumer saying when it comes to xi jing ping hang tough. I think the president would have put himself in a better chance to succeed with china if he had not picked trade fights with our european allies and nafta allies, and said were going to put a stop to a rising china. Its one of the reasons pulling out of the Transpacific Partnership may have been an error it was a way for the United States to cultivate influence against china, in the asia pacific where we need it the most. But if the president is remembered for anything, its going to be whether this trade war with china won. And if anything, Elizabeth Warren is trying to steal ground on trump on this issue. Hes had a rough learning curve on the global scale everything from north korea to china and mexico. There are not many people trying to defend china in this, they are a real issue. But when you look at the president , hes not been consistent on any level of foreign or Economic Policy on the foreign stage. And shifting to mexico, remember a few months ago he said he was going to close the entire border never mind 1. 7 billion worth of goods come through the border. When you get down to it, it means keeping brown babies out of the country. And the gop lens looks at that as a criminal crisis at the border and we have to shift that to that point. I understand the dangers of mixing immigration policy and tariff policy but at the end of the day i have an american president claiming victory and a mexican president claiming victory but at the end of the day we have a way to deal with what is a very serious border. I say the best place to build International Relationships is on these foreign trips because we are speaking to our partners. But theres a different tone. Bill clinton was working with a congress that was trying to impeach him. Before the day of the big negotiation you didnt have the big inflammatory words. I was watching Chuck Schumer and his clip calling the president dumb, even though this was a bipartisan disagreement on tariffs, went after in such unflattering and fairly childish terms. I recognize thats a problem both parties are facing today, but i cant find where that blame began. All i know is what we can do as bipartisan partners to stop it. You were first elected to congress in 2010, and you are departing after this year. Youve announced youre retiring. Is this the same Republican Party that you came to washington as part of . If you talk to rank and file members on capitol hill, i say the same thing about my democratic friends, there is a huge majority of hardworking men and women both sides of the ail that want to get things done. But msnbc knows its voters that have a thirst for something. That Tea Party Movement that thirst was to say no. Here today the thirst is to go after the president on so many different issues. If he hadnt taken credit for mexico, he probably would have been accused of being the architect of the master plan. We have to get out of that business of celebrating our failures more than we celebrate our successes. I would argue 90 of men and women in congress, both sides of the aisle just want to get something done. We can, but the question is will we be able to take yes for an answer. Let me ask you about the investigations. Pelosi used the word cover up. Have you read the Mueller Report in full . I have not. Why not . I said when we started this conversation, i trusted mr. Mueller, took a lot of slings and arrows but every attorney i news said he had great integrity why not read the report . I have a concern when you put the entire power of the United StatesJustice Department behind anything you can achieve an agenda. You can drive a message. All of those you think the Mueller Report was just driving an agenda, theres nothing in there thats worth figuring out . You tell me what that investigation is that mueller said i didnt get a chance to do. He had a chance to do it all im talking about the report. Fine, were not talking about going beyond the Mueller Report. Im saying why not read when theres ten things in there on obstruction, he said the president may have obstructed justice here, he seemed to say you need to figure that out. He didnt say to congress you need to figure that out. Obstruction is a criticcriminal he did. He said i cant indict a sitting president of the United States. Right congress to you if you want to start impeachment proceedings. I was a staffner 1988 when republicans went down this road. They thought it was going to be a wonderful thing to impeach a sitting president and you know republicans lost seats in that election. The consistents i represent dont want to see impeachment activity when there are important economic issues, family issues, that need to be handled. Folks wants today see that investigation take place, what they heard at the end of the investigation, theres nothing here that were going to go after the president further on. Folks are ready to turn that page. I know people are pouring through the Mueller Report looking for something to talk about again tomorrow and next week and the month after that. As a curious citizen, you werent interested to read it . I didnt read the bill clinton report, either. I didnt follow any of that news. You werent in congress at the time. I was on the board of directors, the United States of america, as a voter. The role i play in congress i promise you is not to try to bring down a sitting president. The role i play in congress is to try to work with my speaker so i can send a bill to the president s desk. I have 18 months left on the job. I didnt run to make a point, i ran to make a difference. If i cant get nancy pelosi to get a bill through the house. I cant make a difference for anybody. A week is an eternity in politics, theyre not running against donald trump right now, theyre running against each other, he gave his fellow contenders something to hit him on in the debate coming up, and mes going to have a story to tell on the evolution. Theres a disconnect between the politics of this and the reality of this, because frankly this isnt going to get reversed unless democrats have 60 votes in the senate. And its important to know jimmy carter was the last democrat to support the Hyde Amendment, thats what i read. I think its interesting to show how joe bidens politics were shaped at a time when conversation around race and the way systemic discrimination impacts race. Yes, this is an example of abortion being more polarized. But its not just people who are kind of very supportive of abortion that are going to be worried about bidens stance on this. Say youre a middle aged africanamerican woman, regular churchgoer. You have problems with abortion maybe but you see ways the problems in the Africanamerican Community have been created by policy and then you see, in addition, the Hyde Amendment sort of piling on to this issue. I think youre going to feel like oafffended by that. I think its also a reflection of the way were talking and thinking differently about systemic issues of race. This is who were talking about, who is denied access to abortion because of the Hyde Amendment, people who rely on Services Like medicaid. And who is going to impact this democratic election, predominantly black women, they are the path of the white house is going to pass through that community. So your point, this is a point its not a monolith. This is a fractured Community Like everywhere else, there are plenty of people in communities of color who dont believe they dont believe in abortion. That doesnt mean to say a woman should have access to Reproductive Health care. Those are very different things. Can we point out the irony of the Republican Party, some of the conservative right who are, you know, this prolife party, except when it comes to children crossing the border, except when it comes to kids being shot, except when it comes to unaccompanied minors trying to get in the country. So the middle is going to be looking for something in between, and i think the party that wins is going to be that that seeks the middle and that independent vote that will swing elections at the national and statewide level. Your state party, you guys have had a couple rough months in North Carolina. Your state chairman was indicted on bribery and wire fraud charges. There was an entire new special election. North carolina is a major battleground state in a president ial year. Is the party ready for that . Actually were going to find out in two elections coming up this year. We have two congressional elections, one due to the sad death of walter jones, a longtime republican congressman. Its a republican seat in ownno carolina. We have a very important race between bishop and mccready, which is a new election duty voter fraud in our rural counties. And then we also have this russia investigation of the durham voting that occurred in 2016 when i lost my reelection as governor by 10,000 votes, and at those no precints that came in late at night that changed the outcome after i had been declared the winner. Its going to interesting how the whole voting process is examined between now and the journal election in 2020. Speaking of how this may play out, because you also have a senate race coming up in North Carolina. Are you confident that the president of the United States is going to be behind tom tillis here, or do you think hes at risk of a serious primary challenge . No, absolutely. In fact, Vice President pence was in the state just in the last week and a half to two weeks campaigning for tillis, and i anticipate full support. But the primary doesnt help him. Hes getting pushback from the right in a primary which, you know, could cause him to spend money that he shouldnt have to spend in preparation for a generally election. But at the same time, the democrats are looking for a tough time finding a strong opponent for tom tillis in a senate race that should be fairly close. Governor pat mccrory, thank you very much, sir. Politico reports, quote, nadler pressed pelosi to allow his committee to launch an impeachment inquiry against trump. The second such request hes made in recent weeks, only to be rebuffed by the california democrat and other senior leaders. Pelosi stood firm, reiterating that she isnt open to the idea of impeaching trump at this time. Id like to welcome my panel. Attorney and msnbc contributor joyce vance, and at 30 rock, we have former democratic congressman joe crowley of new york. And White House Reporter for the associated press, john lemire. I want to start with you, congressman crowley, because youve been in some of these meetings, and this one was a real doozy, and this division between jerry nadler and nancy pelosi seems to me to be what is going to be driving what happens next in this drama over how democrats handle impeachment and the Mueller Report. Do you disagree . I think it was impolitic that was used. Youre for impeachment . Im for xy andz so hes trying to appeal to those who would take strong positions on impeachment in the Democratic Caucus. Do you think she expected this to leak, though . This was a very small group of people . The only thing i can tell you is im no longer leaking or being accused of doing that. But, you know, theres nothing sacred in the Democratic Caucus. It was something i had to deal with as the chairman of the caucus and reprimand my colleagues from time to time and say, you know, its really important we keep the family discussion within the family. But inevitably, kasie, if its hot enough, salacious enough, it will get out. So, again, who do you think is going to win this fight . Do you think pelosi is going to win this fight or nadler . I dont think theyre too far off the mark from each other. What nancy has been calling for is to further the investigation, jerry, do your job. Elijah, do your job, et cetera. She wants all the committees to do their job and let the truth lead where it may. Jake sherman, where is your reporting on this . Youre in the hallways every day as well. Is nancy pelosi going to come under so much pressure shes going to have to give or are we in for 18 months of this . I dont know how shes going to get through the next 18 months. Literally i have no idea how she withstands this pressure. But time is really on her side in the sense that congress is going to go out of session for august, theyre going to come back in september and have budget messes. We may have a government shut down. Need to raise the debt ceiling, all those stave off the impeachment folks. Nadler has his own internal politics. He has a Committee Full of liberals that are hot to trot on impeachment. He has to stay in line with them while also staying in line with pelosi. Those are in conflict. I really have a tough time believing shes going to be able to keep the temperature low for the next 18 months, but we have all doubted nancy pelosi many times and we have all been wrong every single time weve doubted her because she is really good at caucus management. She knows where people are. And she knows how to wrangle. I would bet with her, foid bet at all. Joyce vance, lets talk about how democrats are doing at actually getting this message through part of whats driving this frustration that exploded in this room is that they seem to have a lot of different tentacles going on and not a lot of clarity on what happens next. I think thats right. Democrats are trying to run an investigation. Theyre issuing subpoenas and nobody is showing up. From my background as prosecutor, i cant imagine what that feels like because i would send the u. S. Marshal out. But this notion that we now have folks who are just ignoring subpoenas, the attorney general of the United States ignoring a subpoena is frustrating for democrats, but they will have to find a path forward, whether thats contempt or working out through the accommodation process. Anne gearan, you were on this trip. Your pool notes were legendary. Thank you for all of us who were reading them from back here. But this really was, i mean, the president sitting on hollow ground, we showed the footage at the beginning, not just criticizing a rival, but laufrmg launching a deeply, deeply personal attack. He is worried about what pelosi is going to do next. He is. Ive been waiting for the moment when he finally gave her a real nickname, and it came there, right . Hes now going to call her nervous nancy. And that actually show s a coupe things. Its one of the things trump does extremely well. He figures out something to get at his rivals, something that gets under the skin a little bit. Right exactly. In this case he knows that she is indeed nervous keeping all the arms and legs inside the ride here for the next several months among an increasingly divided democratic house, at least three camps, those who want to go for it immediately, those who, like she, seem to see impeachment as a political loser, at least now is not the time, and those who havent made up their minds or somewhere in the middle or go back and forth. Shes got to keep everybody organized. Donald trump knows that. He knows that shes standing in between he and impeachment. Theres a part of him and a part of the house that wants to go through impeachment because it could be a political winner. Right. But hes had at her, offended by what she said. They were sort of playing on the same team in a weird way on impeachment for a while. Very strangely, yes. And now not. John lemire, i know jake has written in playbook with his colleagues that nancy pelosi isnt nervous about anything. I mean, i take anas point on the tight rope she has to walk. I wonder how much of that was to do with the video that was put out and people kind of falsely making it look as though she was stumbling. Whats your take on how concerned and stressed the president is about nancy pelosi and the evolution of this relationship . A lot of things are true at once here, kasie. Certainly to anns point, people around the president who think that impeachment is a winner, they feel like they see what happened to bill clinton in the late 90s where his Approval Rating went up when republicans went on with the impeachment proceedings. They feel like especially as we get closer and closer to the 2020 election they can sort of paint an impeachment as a purely political thing and point to, look, you should be letting the voters decide. This is an overreach here. They feel like they can sort of could you see the democrats of that and that would be a win for them. That said, in our reporting, the president himself is a little squeamish. Maybe hes a little nervous about this, he is cognizant of the idea, even if he were helper to defeat this, thats now the first line of his political obituary. The idea of impeachment, even if it helps him in 2020, thats something that makes him queasy. His relationship with pelosi, yes, there was a sense that he felt when she first regained the speakership, he was telling people he really liked her, he respected her, he thought she deserved to be speaker. These days hes not saying any of those things. He is really sort of grown angry with her. Feels like shes been unprofile, inappropriate, gone after him in really deep, personal, upsetting terms. Congressman crowley, have you ever seen pelosi be nervous . Nancy pelosi im going to quote from a movie. Nancy pelosi is as tough as a bar of iron, okay . Nervous and nancy dont go together. She has the full faith and confidence of her caucus. They believe in her. She has moral persuasion over them because she has character and integrity. I have to say, kasie, its absolutely crazy. A republican member of Congress Actually said that he did not read and will not read the Mueller Report. I mean, that is incredibly outrageous but it shows you just how nervous they are and so is the president. Hes the nervous one here. Do you know if any democrats who havent read the Mueller Report . I can tell you i have. I know my colleagues have. I talked to my colleagues from time to time about this, and just about every one of them has read it, especially volume ii. America, read volume ii. Psa from joe crowley. There are a lot of americans who have picked it up for sure. I want to talk a little bit about william barr. The congress is set to hold a contempt vote against him on tuesday, which is a big step in the mueller investigation. But also this. The attorney general joked about a rocky entrance to his tenure to the Justice Department, but he turned heads over a timely metaphor that he used. As we have been watching the coverage of june 6, 1944, dday, i had the thought that my rival this time felt a little bit, i think, like jumping into son mara glaze on the morning of june 5th, trying to figure out where you could land without getting shot. It reminded us of another recent comparison, illadvised comparison from a prominent politician. For all that ive been through, seems even strange for me to say it, but im at a certain peace because a lot of prayers for me. When i had to step down to the floor of the house of representatives and look up at those 400 and some accusers, we just passed through easter, i had a better insight for what he went through for us. Hes been here for a long time but comparing it to landing on dday is a little bit much to say the least. You know, sometimes people in public life misspeak. When they do that, they apologize. They man up and they go back out and say it was a bad choice of words. Im surprised we havent heard any sort of apology for these comments which are inappropriate for anyone, but certainly for a sitting attorney general. He doesnt feel this was an off the cuff moment. Lawmakers are voting on the house bringing Trump Administration members to court. If it passes the resolution will also declare attorney general william barr and former white House Counsel don mcgahn in contempt. All of this is slated to happen as soon as tuesday. Meanwhile, the white house has directed former Trump Administration officials hope hicks and Annie Donaldson and then theres Michael Flynn who is the focus of an Important Court deadline set for this friday. The prosecution and defense in his case will outline for the judge how flynns cooperation has been proceeding, and whether theyre finally moving ahead with his sentencing. Flynn also just fired his longtime attorneys, though its not clear why that happened. With that, lets turn to the panel which includes msnbc contributor joyce vance who will be testifying at a house judiciary hearing on obstruction tomorrow. Joyce, lets start there. Whats the plan for tomorrows hearing . I shouldnt have to ask why they would ask for your expertise, but in your mind, what is the purpose . What are you hoping to accomplish tomorrow . You know, i hope what we can do tomorrow and maybe people will be skeptical of this, but i hope we can take the politics out of it and talk about prosecution. Were at an important point in this country. A lot of people have read the Mueller Report but its 448 pages and we have to face the fact that not everyone can do that. So the question is how can we make it accessible. And former prosecutors like myself can talk about the evidence, but also talk about what you do as a prosecutor, how do you weigh the law, how do you look at the evidence, how do you decide when its appropriate to indict. These are the sort of questions that prosecutors take for granted. Its their daily workday in and day out, and now theres a hungry to understand how that works. Its our job to share our expertise. Jake, the president has been apparently tweeting about sleazebag john dean, the watergateera figure who is also going to be appearing at the hearing tomorrow. Whats the rationale behind picking dean to testify . I can tell you the stated rationale. I dont know if i agree with it. Please. They want an expert. What joyce said is right. They want to make this accessible to americans. They think people dont understand that impeachment actually means an indictment, not if the house impeaches him, hes gone from office tomorrow. I would saythy john dean has singledigital name i. D. In america. I dont think anyone knows who he is. This is not going to quench the thirst of people on capitol hill who want some sharp action taken at donald trump like impeachment. I think that its going to be an educational hearing. Theres no question that you guys have some knowledge to impart, but the people who want impeachment are not going to say, oh, we had this hearing, were on the right path. I think its a step in a direction that pelosi wants to take, but its not going to be enough for a lot of people. Jonathan lemire, jump in. First of all, i knew day would come where joyce would be hauled before congress. I dont think this is going to move the needle very much in the west wing. I mean, i anticipate it will get a couple angry tweets tomorrow from the president. Maybe about mr. Dean, perhaps joyce, but theyre going to try to paint this as a circus. Certainly theyre not going to suddenly want to comply with any of this. The tactics here are clear. Theyre going to stonewall and say no to everything. Theyre willing to run the risk of being held in contempt, of this going into court further and hoping they can tie it up for the months ahead. Their plan is to run out the clock and paint the democrats as a party of overreach. Theyre trying to deny the constitutional right congress has for oversight. Theyre trying to say they can only have that power if they can prove a legislative purpose, which is not written in the constitution. But the white house here, theyre going to steamroll over there. Theyre not going to playing ball at all. Congressman crowley, how big a test is this for the Judiciary Committee to actually, as joyce was talking about, to educate the american. Youre trying to move the needle on public opinion, is this the way to do it . The scoffing at subpoenas, joyce mentioned it earlier. That would have been enough to drive people to testify truthfully before congress. Instead theyre ignoring it. So i do think people have talked about the constitutional crisis. We may be developing, moving further towards that, telescope scoffing at theespecially the scoffing at the subpoenas that was something that was really damaging for ones life. So far they seem to be scoffing at that. Ann guerin, its a good point. How dramatic is this . We started to take it for granted that theyre not showing up for this stuff right. People throw around the term constitutional crisis, but this is the start of what that looks like, right . The constitution says that youre supposed to show up in congress when Congress Calls you to do it because congress has the independent authority to force the executive authority to show up. If they dont show up, this doesnt typically end well. We havent been here before. In modern political memory, the white house has always grumblingly, complainingly, you know, made a political show out of it complied. But republicans will point to eric holder. True but you know what a big deal that was . It was a huge deal. Months. And it was completely different, right, because doj turned over thousands of documents by the point where they exerted executive privilege. Here we have a situation where they havent been willing to turn over anything. Where an attorney general said i wont show up and talk about the Mueller Report. Politics of this, quickly, are crazy to me. I dont understand this. The white house could have pushed this off by months and just said were going to produce documents, we need some time to consider what were going to produce and withhold. That would have kicked us into next year. Instead the white house went to defcon 5 on the front end, which leads you to fold or getting dragged into court battles. I dont understand it on the politics or merits at all. Or something along those lines. This is a joke, right . Thats not applying well here. There are those in the obama camp who are asking, why isnt the former president and his staff latched onto joe biden just yet . Speaking of biden, biden is a soft frontrunner but is drawing fire from the rest of the field, including this not so veiled criticism from Bernie Sanders. Take a look. I understand that there are some well intentioned democrats and candidates who believe that the best way forward is a middle ground strategy that antagonizes no one, that stands up to nobody, and that changes nothing. In my view, that approach is not just bad public policy, but it is a failed political strategy that i fear would end up with the reelection of donald trump. Anne gearan, i feel like he was making a not so veiled comparison of joe biden to Hillary Clinton. Oh, absolutely. And it worked once, so try it again. Hickenlooper had a response to that, which was, well, whats bernie gotten done . I mean, that was sort of what Hillary Clinton responded in 2016, but she didnt feel that she could go all the way there and say in as pointed terms as many of her advisers did privately that, you know, look, hes offering you popsicles and strawberries and puppies and none of that is actually ever going to work. Free everything is not the way we do things in the United States of america because we dont have taxes that are that high and weve made a bargain as a nation were not going to do it that way. She did get there a little bit in the debates, and certainly you see the other democrats now beginning to make the same arguments that she did then. Theres a certain amount of the free stuff that will work, theres a lot of it that wont. Right. And you eventually start to get toward the middle. Hickenlooper said im not sure what hes accomplished about Bernie Sanders. The other piece we want to show you about as to what unfolded at this dinner is a new argument from Kamala Harris, trying to put a sharp point on this idea that donald trump is a fraud. Take a look. So this is a significant issue for people who work on capitol hill, and the nrcc, and we dont know if its going to happen, if the Republican Campaign committee Kevin Mccarthy and steny hoyer agreed not to politicize the issue. The Campaign Committee did it anyway for reasons that are not clear to me or to anybody. Were not sure if now members of congress are not going to get this raise. Their staff isnt going to get this raise. Its an important issue. Congressman crowley, everyones looking at the statement that the nrcc made in their press release. But congressman, you know, i realize that pay raises for members are always a controversial thing and its hard to come out in public and say you want to do that. But this affects the entire operation, and i think one thing weve seen with the stagnating pay among staffers on capitol hill as well as, you know, this unwillingness to put the money that needs to be there to have the legislative branch operate really kind of hinders our governments ability to actua y actually, you know, do the job its charged with doing. If anything, it outsources things to lobbyists on k street. Yeah, i think the first thing we hear about with pay raises, i hear that violins playing over the country right now. People dont have a tremendous amount of sympathy for members of congress. Quite frankly, its a tremendous honor to serve in the house of representatives, i think every member knows that. But jake is right. Every other employee in the house, their salary is linked to the salaries of the members of congress. I think there was more support nationally for increasing pay on a regular basis for our judges than for legislators. Once it was decoupled it created this atmosphere. Its not about a pay raise per se, except a cold increase that was put in place by congress decades ago to eliminate the need for large pay raises for congress.
