This morning they voted 5159 on a key procedural vote setting the states on a final vote to confirm kavanaugh tomorrow evening. In true profile and courage, senator Lisa Murkowski of alaska voted against kavanaughs nomination to the floor. The lone republican to do so. Murkowski told reporters she had been wrestling with the decision. I did not come to a decision on this until walking into the floor this morning. I believe we are dealing with issues right now that are bigger than a nominee. I believe that Brett Kavanaugh is a good man. I believe he is a good man, it just may be that in my view hes not the right man for the court at this time. In a very different decision, jeff flake who had forced the oneweek delay to allow an fbi investigation into allegations of Sexual Misconduct by judge kavanaugh, voted to advance kavanaughs nomination. And you plan to vote yes tomorrow in. Unless Something Big changes, i dont see what would be in the process. Inaudible question ] no, i admire her a lot. A lot. And everybody had to make their own decision and i think the world of her. Well, shortly after 3 00 today, maine senator Susan Collins ended the suspense over the nomination battle when she announced her decision to back kavanaugh, giving him enough votes to make it onto the court in tomorrows final vote. In evaluating any given claim of misconduct, we will be ill served in the long run if we abandon the presumption of innocence and fairness tempting, though it may be. I do not believe that these charges can fairly prevent judge kavanaugh from serving on the court. I will vote to confirm judge kavanaugh. Moments after collins spoke the lone remaining undeclared law maker, democrat joe manchin of West Virginia announced he, too, would vote yes even as protesters swarmed him outside his office. Sure, i know, im very much concerned with the sexual abuse that people have had to endure. I am very much concerned we have to do something as a country. I had to deal with the facts i had in front of me. Yelling shame. Manchin was the odd senator out. They railed against the message kavanaughs message would send. To confirm judge kavanaugh under these circumstances would send a powerful message the senate and possibly the Supreme Court is a hostile environment for survives of Sexual Assault. Ours was an investigation to figure out enough about what happened to determine if Brett Kavanaugh is fit to serve on the highest court in our land. Is he fit to be a jurist . That is our role. When it comes to dr. Fords allegation, and we fell short. We fell short. We did not do her justice. We did not do the American People justice. Im am joined by connecticut democratic senator chris murphy, nbc news capitol hill correspondent casey hunt and anne galan, executive director of moveon. Org. Let me go to casey. You have been doing a great job covering this. Was this in doubt as we got the last couple days or was this foredoomed . Reporter no, it was definitely in doubt, there was no question. I think senator collins said that she had decided this last night, which i guess means officially that it probably wasnt in duty you know overnight. But we also didnt know how Lisa Murkowski was going to vote. She said she didnt decide until she walked on the floor. Senator manchin doesnt want to be the deciding vote. Jeff flake clearly has been all over the place. No, i dont think this was preordained. I think it was clear senator collins spent a long time thinking why she was for judge kavanaugh. She laid out that case. She didnt just say im going to be the deciding vote to back him up. She provided you know kind of a redrock of defense i think if judge kavanaugh faces challenges around this while hes on the bench, he will be able to point to what she said and say Susan Collins said all of these things about me and its going to be i think really potentially a Central Point going forward. I dont think her speech will only live in this moment. I think it will live on. I think a lot of the people who think she is betraying the Metoo Movement will really focus on that over the long term. There are people that say they want to work against her, work on the campaign to run against her. You know, im interested to see if she underestimated the people. I do think a lot of what happened before dr. Fords allegations influenced senator collins tonight. She got a lot of really nasty po tests and things that came before dr. Ford ever surfaced. You can hear in her speech that that was so important to the her tonight. Casey hunt, thank you so much from capitol hill. Let me go to senator murphy. What do you think, chris murphy, what do you make of these lastminute travails . Do you think, i want to ask you the same things i asked casey, first, joe manchin decide he wasnt going to be the deciding vote the ohim guy that got kavanaugh over the top. Flake looked like he locked himself in last week with Mitch Mcconnell. The two women, i think murkowskis got a lot of guts. I think she showed it. Thats my view. Your thoughts. Listen, lisa has always been an independent. Remember, ve got elected after losing a primary. She was a writein candidate. She will always be someone that speaks her mind, votes her mind. Listen, i saw susans speech. I have a great amount of respect for senator collins. But i just think she is going to be sorely disappointed when a year from now Brett Kavanaugh writes the decision overturning roe v. Wade. She has this opinion of him as a great moderating bridgebuilding voice on the court that belies his body of jurisprudence. Ultimately i think that speech will live on, but its going to be pretty embarrassing when Brett Kavanaugh is the deciding vote to criminalize abortion in this country. Lets talk about that, criminalize means you put women in jail for having an abortion . Thats what he said . Listen, this idea that he is going to respect stare decisis, is ridiculous, he was vetted by the Heritage Foundation and others to make sure that ultimately he would be the deciding vote to overturn roe v. Wade. Thats just whats going to happen. How many republicans, 51 out of 100, how many do you think really, really, when you get down to it under sodium pentathol want to outlaw abortion, much less criminalize it . I obviously take them at their word. I cant get into their heads. I think almost to a person they have conducted themselves no a way to make sure that ultimately the majority of states will do it. They come from trigger laws the minute that roe versus wade is overturned by the Supreme Court, abortion is illegal in their state. So, you know, theyre walking the walk every single day to try to criminalize abortion. They knew what this vote is about. Her speech today, senator Susan Collins of maine argued her vote should not be taken as an affront to survivors of Sexual Assault. Every person, man or woman, who makes a charge of Sexual Assault deserves to be heard and treated with respect. The Metoo Movement is real. It matters. It is needed. And it is long i dont haoverdu. Tell me what you think of that setting today. We saw three republican senators, all three together as a political bhalanx phalanx . What did you think when they put them in those seats today . I think the thing that this was a group of the women that had the power in the world, not to determine who will sit on our highestco urt to evaluate the Job Interview of a person who is being optionally nominated for the highest court in the land for a appointment who had a character reference from dr. Ford which was in deeply troubling. They took in all the that information. They had the power to determine the outcome. More than that, they had all the power in the world today to send a is thatle to a movement. This was a sort of a twopart thing going on what is going to happen to the Supreme Court, a generation of jurisprudence what message will be sent about what happens when survives of Sexual Assault comes forward . Whats the future of Metoo Movement in america . Susan collins to her great and lasting shame turned her back on both fronts on what was right and just and good and senator murkowski to her great credit i think looked herself in the eye and said i have to do what is right, not what i think is politically expedient or make Mitch Mcconnell happy. It was a day we will remember for the rest of our lives. I think the senators and even else in the republican parity is going to be in for a real awakening in november. The outrage, the levels of outrage and heart break and passion that we are seeing around this fight are unprecedented. You are seeing the senator Murkowski Office noted call volume has higher than it had been on health care. If you sa you the thousands of women occupying the Senate Office building. The thousands that marched and rallied the last few weeks, few months, you would have a sense, this movement is not on fire, its not going anywhere. It will be marching straight to the polls in november. Im a political guy. How are you going to get murkowski in office . Heidi heitcamp reelected . These are challenges. Its not all blue wave. Yeah. I this city important thing is people who stand up to people like Mitch Mcconnell and stand up for their constituents and the women who have been pouring their hearts out in public at great personal costs. People who stand with those women will be reeleblged. You get reelected by volunteers knocking on doors, people donating. How do you get she is 11 points down, double digits down. I think she is great. I have been praising her. How do groups leak yours get her reelected . How are you going to do it . You knock on doors, you pass the finish line. Its a good question. This was a moment that was ethical around moral and human moment. Being ethic am, moral and taking a courageous stand has political benefits. Someone like heidi hate camp can only be shown that she is an independent politician who will stand i know you well. Im rooting for you. Go out there for people with courage get elected. I mean this. Were on it. Were on the case. Thank you, senator. Profiles and courage is written about people in the senate over the years, jack kennedy wrote it about people who did have guts. A lot of them paid the price. You know, i think two things about it. One, you do have to get practical help to those democrats who showed the courage. I have a Million People on my email list. About an hour ago, i send out a fundraising email to Heidi Heitcamp, this year, too. Good for you. I think what we have learned in the age of trump is authenticity wins votes and what heidi did was authentic. It may not line one some of the swing voters in north dakota. But they know that she legislates from her heart and i think what weve come to understand with lots of americans who voted for donald trump, despite the fact that he wasnt for their economic interest is that folks want to hear you. They want to see you. And thats who heidi is. Thats why i think ultimately sheem do well if she also get some help from her friends. Chris can i ask, its not just heidi height damp. Its joe donelly. Moveon members donated to over 100,000 that he would vote no these stands have hard intents for the candidates willing to stand up for whats right the people will stand with them. Im a big fan of joe donelly. I do want to hear your voice on this talk about dr. Ford, i dont think there is anybody with a soul that didnt root for her. She didnt sound like a politician. Her voice, her courage, and the fact that her cause lost. Look, she was the epitome of dignity, of courage, of civic contribution. She said she knew she would be torn apart. Her familys life would be upended. She came forward as a civic act. Because we ned to know the full truth about this person who was being considered to the Supreme Court. She put herself out there. I honestly think, number one, this fight isnt all the way over yet. The final vote has not happened. Its not all the way over. When it is over, she has inspired a generation of women to know what is possible. They can come forward and be that courageous and that brave and a movement of millions of americans, women, men, everyone will stand with them. So i do think she will have a Lasting Imprint on our culture. Not just our politics but our culture, showing and modeling that grace, that courage that, dignity in the biggest possible stage can you imagine. Its great to have you on today, i mean that, for chris murphy from connect connecticut. Thank you very much. I will be hosting Brett Kavanaughs final confirmation vote at 5 00 p. M. Eastern, you have to turn it on to see if it happens, maybe it wont. Coming up, President Trump railed against the ragefueled resistance. Now that kavanaugh will likely be confirmed. What does this mean for the midterm elections in kavanaugh pleaded his pages in the wall street journal that his words move any of the senators previously on the fence . I dont know. This is requested hardbalhardb action is. Hardball where the action is. We make sure youre in the loop at every step from the moment you decide to move your money to the instant your new retirement account is funded. Oh and at fidelity, youll see how all your investments are working together. Because when you know where you stand, things are just clearer. Is the world ready for me . Through internet essentials, comcast has connected more than sixmillion lowincome people to lowcost, highspeed internet at home. Im trying to do some homework here. So theyre ready for anything. Democrats have been trying to destroy judge Brett Kavanaugh sings the very first second he was announced, but all you have to do is look at the polls over the last three or four days and it shows that their ragefuelled resistance is starting to backfire at a level that nobody has ever seen before. Welcome back to hardball that was President Trump loving this, talking to his voters about the ragefilled resistance he calls against Brett Kavanaugh. Today cheers broke out in the white house in the press shop, that his nomination crumbled. Nbc news reported white house staffers feel euphoria and relief and today Susan Collins voted her intent yes or yay. Source says the White House Counsels Office was convinced they did enough to provide waivering senators to political cover needed to vote yes, by allowing the fbi to reopen the background check and by instructing them obviously i am joined by a National Political reporter for axios. Some of this stuff the end is sort of a Plastic Surgery on this guy, where he has to write a letter, on oped piece to recast his image. It looked leak a bill schein showing up on fox. All this fox wall street journal kind of stuff. Pr. They needed to fix his image because he did not look good last week. The white house was coaching Brett Kavanaugh on what to do to make sure this went through. Part of that sui need to figure out your testament and why people might feel as though you are unfit for the court. Why did they stop him from being a whacko bird last week when he testified . I this i the president liked the fact that he was talking about he was cry something. I dont think they liked the crying. They liked the 2016 election the conversation, that this might be the revenge of the clintons. All that talk they definitely liked. John, where do they get this from, revenge of the clintons . Evidence . This is the one the bit of his testimony. Protesters, evidence . You know what trump, this is the same of the same piece barack obama was born in kenya, et cetera. But that line could have suchg his nomination the clinton line was the pun that worried them internally. Jeff flake said the most concerning line they heard this week was jeff flake saying you no ehe did come across very partisan. Thats a big concern. Ultimately, flake voted yes. He voted yes with his head down. He was at the car the reporters grabbed him in front of his car at the senate capitol. He was not too proud of his vote. You have to think that senator flake was the one cowering in an elevator and had to look a Sexual Assault survivor in the eye. Jeff flake had real issues within it came to the yes vote and he had to worry about his own history. In arizona in. We dont know where he will go after the senate seat. He felt strong enough. A lot of senators fells personally bad for dr. Ford. We heard from people, including for Susan Collins who said i definitely think this woman survived a Sexual Assault. Maybe shes mistaken, but we definitely feel bad for this woman. Lets go to the latest hypocrisy of the president. He talked about paid protesters. Didnt he begin his campaign, these 50 an hour people waving signs for him as he came down the elevator . Isnt that a part of history in. You have a good memory. He filled that room, people who were paid actors to be there. Here he is trashing the left for, the left does have passion . You wont admit that, they dont admit they care. They had to be bought. Trump knows they had passion. To be fair to him. He didnt have to pay them for that long. As usual, we know he built a Mass Movement quickly. He has begrudgeing respect for Bernie Sanders. He would never say this publicly. But i have been told privately. He does see whats going on and he, you know, has some begrudgeinged a miration for it. Because . Hes built a Mass Movement. An enterprise . Trump sees himself as a mass politician. Its almost like a hughey long. He loves that mass crowd, et cetera. The only person he thought replicateed that to some extent on the left is Bernie Sanders. He has a lot in common. I talked to some of them. If you talk to their supporters. They thought the system was rigged. Nafta was a problem. There is a lot of overlap, even though Bernie Sanders reporters and Trump Supporters hate to think about that. The totality of the die. Bernie goes after the middle, the center right a total challenge. Im a socialist. Im against this. Im leading a revolution. He says this. Trump, everybody is corrupt and awful but him. The totality of argument. Appeals to the most voters. Are you completely with this guy against hills enemies. This afternoon, Sarah Huckaby sanders tweeted. Thank you, senator collins, for standing by your convictions and doing the right thing to confirm judge kavanaugh. Earlier in the day confirming judge kavanaugh would be one of the most impactful things the president has ever done. Lets watch. This is such an important moment in our countrys history, we want to make sure we are doing every single thing we can to get the final vote done. I want to give you the last word in terms of this president s building a legacy in. I think this will be one of the most impactful things he does. I think shes right. It will be one of the most impactful things. Two out of nine of his. I think two out of nine are his. You think even if he loses in 2020, 50 years from now, we will look at Brett Kavanaugh and say this was the legacy of President Trump. He ut this person here. He tilted the court in the conservative districts. Gunning for three. He holds the senate. With 50 votes after november. Which he could do. If he holds the senate for two more years, he is looking at ruth wideer ginsberg. I was looking trump was telling people he thought he could confirm five. In eight years or in four in. No four. Going through the list, what does she weigh, 80 pounds . Sotomayor, the health is really bad. It got really sort of edgy. Kind of ma caulkesque . Something like macabreesque. Are you smart. You are the smart ones. Up next, the kavanaugh vote could have serious repercussions dont you think . I think a couple of these people are worried about the next election, some of the good people are worried about the next election like Heidi Heitcamp. Thats coming up next month. This is hardball where the action is. This is hardball where the action is. Better world. Heres to the people who do what it takes to build it. To keep it running. Senate to elevate judge Brett Kavanaugh to the Supreme Court tomorrow night. As of today all the last remaining five holdouts in the senate have announced how they intend to vote this weekend. In fact, two of them face serious reelections this year. A month from now. Democrat Heidi Heitcamp says shell vote no she is trailing her latest opponent in a fox news poll. Opponent in a fox news poll. Democrat senator joe manchin said he will vote with the Republican Party. E with the Republican Party i am joined now by a democratic strategyist and michael steel, the former republican chair of the national committee. Ayesha, where do you see guts on the side you like in. Ha, where do i see guts . Look the democrats have done the best they can, especially the Judiciary Committee have done the best to hold this nominee back. The truth is they not hard. I think it was very gutsy the way that Pamela Harris and corey booker and all the democrats frankly went after the truth and tried to reveal the truth. But, clearly, the republicans dont care about the truth. They didnt want an investigation into who Brett Kavanaugh really was. That was gutless, unfortunately this is a travesty for america right now. What about heitcamp . I think look at her polk numbers, it was gutsy of her. I hate to credit people with being gutsy when theyre doing the right thing. The problem with america right now is weve lost a moral compass. I am thankful no senator heitcamp listened to her inner voice the right thing to do is to make sure we dont put someone on the court who is questionable. I guess we can praise her. You seem to be hesitant to praise her, why is that . Why . I think its great she did the right thing. Were in a position right now where people need cover to do the right thing. We are playing so many politics with our lives. Corey is in new jersey. It doesnt take a lot of guts to vote the way they did. Whereas somebody in north dakota who votes for the people in jersey and california, you got to give them something here. You it takes guts to be a leader that leads, that actually leads. Keep going. Without regards to whether you are going to be able to you know slap the right hands and get the right next job. This is the democrats problem right here. You have a strong point of view. I think the problem doesnt give any credit to the people who are a bit more moderate than they are. Your thoughts. Unite the party before you unite the country. Just thinking here. But i think it will look for Heidi Heitcamp, she is looking at the numbers. She is 12 points down, tant play the game, play the odds. You are already in a hole. This was in one sense a no brainer for her to say no i bet you if her poll numbers, she was 3 points down or four points ahead, her vote would have been very different. The politics would have been very different. The politics now in her state dictate that its over. So now she can act on conviction, without the political overcast. I am surrounded by cynics. I wish everyone acted on conviction. Her vote for judge kavanaugh after that, senator collins condemned the extreme partisanship that characterized her confirmation process. Here is Susan Collins. It is particular worrisome that the Supreme Court the institution that most americans see as the principal guardian of our shared constitutional heritage is viewed as part of the problem through a political lens. Well, however, collins vote today is already fueling democratic speculation about 2020 up in maine. Susan rice, you know her. President obamas former National Security advisers tonight, indicating that shed like to challenge Susan Collins come 2020. Responding on twitter to the question, who wants to run for senator of maine . She said, me. Thats dramatic. What do you think . Susan rice as you might say going out there running for office . Hey, im all for it. Im all for awesome people running for office. So she wants to challenge her, raises her hand. By all means, i think challenge is good. Its time. Its absolutely time that we have someone challenge the senator. Let me ask you about manchin the problem with man chichin, a you all tough politicians. I will be tough too, manchin made his a beat after collins . Why . Scripted. All pre planned conversation. Look, Susan Collins indicated where she was going when she came out of that, skip, said oh, yeah, everything seems to be in order here. Why do you have her make it official in. Today she has lunch with Mitch Mcconnell, step two. Step three the conversation the last three of them together coming together around this nomination would go out the door the same way. So the only one who is given the path to vote no is murkowski. Everybody else how did she get the pass . Because of the politics on the ground and her election is the furthest out. By 2022 its a memory. I like murkowski, which one do you like the most . Of all the most that held out, i thought murkowski had a lot of gutsheitcamp. I thought it was great she said im going to vote my conscience or gave it to the American Public that way so i appreciate her for doing that. At the end of the day with are in a moment in time when americans are looking at our senators to lead and do less of the politicking. So my frustration, frankly, as a political strategist is that we are losing. We are completely losing sight of what the people want. You had hundreds, hundreds of protesters at the senate all week long, for weeks now in fact, having rallies, trying to talk to senators and say, these are what our values are, this is what we believe. These are our concerns. Literally, they wouldnt hear from the people. To have the senator say, look, i have to check my gut, something, he doesnt feel right. I present him for that. Nine out of ten republicans will support donald trump, as he announces the moon is made of blue cheese. Theyll support your party, they will do anything this guy says, simon says, trump says, they do it. Great to have you on, michael steel, what a charmer. Up next, both parties hope the contested and drawn out process which ends tomorrow for Brett Kavanaugh ends tomorrow. It looks like hes going to get confirmed tomorrow. So which side will get the biggest bounce . That is great. I still think going into this fight, the democrats have the biggest bouts coming. I still do. But there may be a little red what ev to try to catch up to the blue wave. Well see. You are watching hardball. See. You are watching hardball. Come to my window. Ohhh. Crawl inside, wait by the light of the moon. Applebees to go. Add a fountain drink to your next order for just 99 cents. Now thats eatin good in the neighborhood. They do lead me to conclude that the allegations failed to meet the more likely than not standard. Therefore, i do not believe that these charges can fairly prevent judge kavanaugh from serving on the court. Well, those are the three senators, all republican women, all supporting this nomination sitting together there. And that was, of course, senator collins, herself, announcing she is voting yay on Brett Kavanaugh. She was joined by democrat joe manchin quickly thereafter confronted by protesters in the halls of congress. Eugene robinson has a simple message for democrats. Get mad about kavanaugh and then get even the problem for democrats is they are powerless. He writes, democrats cannot by afford to be couraged. They talk about the residents among vote, health care, stagnant middle class incomes, corruption, tax cuts for corporation and millionaires as the kavanaugh issue inevitably fades, democrats and republicans need to keep their eyes on the prize. Lets bring in Shannon Pettypiece a National Political reporter for nbc digital, for the daily beast. You take it first. Democrats know, i hear this from people i know, like my wife the democrats think health care is a biggy. Can they go back to the real bread and butter Kitchen Table issues and get away from the glamorous spotlight of a Court Nomination in. Yes, they k. On the other hand, why do they want to get away from this Court Nomination . This battle will fire up their bails the side that lost the confirmation battle will be the side angrier the next few weeks and will be the side that wants to come out to vote. Republicans got their conservative vote. They will relax a little bit. Democrats are wired about this i agree with what anna galen from move on said, i think turnout among women in particular, on the democratic side i think it will be through the roof. Is it better . As awful as it is to say, when you lose one of these, it riles you up. I think the anger will last longer on the democratic side. This was the jolt the republicans needed in the days before the kavanaugh accusation, before his testimony, i was hearing a lot of republicans saying there was apathy, they were searching for an issue to get people engaged. It started with. A single white man . The land say graham argument . We were thinking impeachment. There is this cultural undertone that fits with this forgotten man narrative of the white male under attack. This idea that society is moving in the direction that people arent comfortable with and some people i women feel this to. Trump went on, my son he was accused at work, he lost his job, trying to appeal to women. I think that is an undercountry, that under served disadvantaged white miami. Isnt it interesting the two guys that come off as week, judge kavanaugh and a little frenzied lindsey graham. They didnt come off as john wayne characters. Ill be honest about it. They just didnt. Or harrison ford, they come on as guys scared, guys in trouble looking for help, victims. They both played the victim card. What interesting is donald trump is so good at playing the victim card and the winner at the same time. Brett kavanaugh couldnt pull it off. I think the most interesting thing, its fascinating to watch how this plays out. What Susan Collins said today is further than donald trump said. She basically said she didnt believe Christine Blasey ford, it failed the more likely than not test. That was a huge thing that basically republicans were saying without saying. They wanted to confirm. Are they saying she is not telling the truth she knows or the truth she knows isnt true . Theyre saying the truth she knows isnt true. Donald trump ridiculed Christine Blasey ford. People told him you have to pull back from that. That will upset people. Sui soon collins today went a stride further than that and did it into moderated tones. I think it was going to be a backlash against that. Why do you think i watch these trump rallies . Certainly i dont listen to them, i watch them. I watch the people in the back of them. Why are they all yucking it up about making fun . Everybody i thought liked bureaucracy blasey . Those rallies are the uncontrolled of the republican parties. There are Trump Supporters that dont go to those rallies. I have some friends that voted for trump and said i would never go to these rallies the people are tonal rah. Arh. Rah. Theyre there waiting for to him say these things. Thats why they go. I think it brings out when there is that crowd mob mentality. I think it brings out things people feel outside and will be afraid to say outside. Thats trump right there. Thats true. They will be afraid to say that lady seems a little cookie. When i talked to them at the rally i did on tuesday night. One man said, something doesnt seem right in her head. Its the more comfortable to say these things outside. Supporters are doing much more than he is. He is saying things. That was true in the old days. When you covered Pat Buchanans people, way beyond the right. Anyway, chairman Chuck Grassley was asked if there should be republican women on the Judiciary Committee. He said it was ultimately up to voters, but added this. My chief of staff of 33 years tells me that weve tried to recoup women. We couldnt get the job done. You think they just dont want to be on the committee . Its a lot of work. I mean, dont forget, compared to a lot of committee meetings, we have an executive every thursday. So its a lot of work. Maybe they dont want to do it. Shannon, i got to go to you on this they dont like the work . They tried to rekrooucruit w . I have binders of women we can try, there are democratic will on the committee. Hes rather aggressive, Pamela Harris and diane feinstein, theyre not holding back. And senators on the republican side can as well. The Judiciary Committee is a terrible assignment.
