Even though theres a privilege tha that exists between an attorney and client that could protect communications, correspondents, at this point in time, a crime fraud exception aplies. Basically, so you have this privilege, Attorney Client privilege, but if theres the assistance of a crime, you cant hide behind the privilege as the lawyer or client. So as a result of that, theres going to be a serious problem for cohen, so thats why trump is denying everything. Let me ask the other question. The intermediate question, which is what michael said there on tape. If there was a nondisclosure agreement, the obvious purpose is that she will not talk about what she and she did together. Now, according to the argument michael made, however, its two ways. A nondisclosure agreement binds both parties to silence. So therefore, it could not have been made without telling one of the parties the president in this case, that he was supposed to keep quiet about it. Yes. So if trump himself is not a party to the contract and if trump himself had no knowledge about the payment, which was the consideration given to Stormy Daniels to buy her silence, then why in the world is trump joining in a motion to compel arbitration, why is trump joining in a federal lawsuit if trump had nothing underlying contract. We understand theres a three alarm fire at trump tower. One seriously injured. That is reported at the moment. We do understand that the president is aware of it. In fact, he did tweet this in reaction to this fire. Fire at trump tower is out. Very confined. Well built building. Firemen and women did a great job. Thank you. And again, a three alarm fire. Just getting this information. At a 6 46 evening hour on a saturday. Its a cool evening, but as you can tell, at the moment, on the right hand side of your screen, you can see some of the units that have been deployed of this three alarm fire then at the lower end, right below what is the wording, you can see more of the trucks thask t have been deployed here. A couple of hooks and ladders that have now arrived. We were getting some information related to this three alarm fire that there were flames on the upper floors, were not sure which floor exactly. At this moment because the information is just coming in to us here at msnbc. But again, were breaking into regular programming the 6 47 local time here in new york city. The three alarm fire at trump tower. This is where President Trump lived before he became president and moved to the white house. We are unaware and so what we understand right now is that both the first lady, melania trump, as well as son, barren, n not here at the time. At this moment. Theyre in washington, d. C. That would be another question many would be concerned about. That the first lady as well as the first son might be back in d. C. But, excuse me, in new york, but they are in d. C. At the moment. We are hearing that the flames on this upper floor was a residential unit. We do not know which floor of this particular fire, but we know that the again, the president is aware of what happened as you saw on that tweet that i shared with you. Its a three alarm fire with one person seriously injured. And this is what the president said earlier. Fire at trump tower is out. Very confined. Well built building. We have tom winter from nbc news Investigative Unit with more on that. Tom, what are you hearing . So, at this point, the fire has been knocked down. Just talked to a Senior Fire Department official. Right now, they have 140 firefighters on scene. Its a three alarm fire response and at this point, there is one serious injury. That injury was not to a firefighter, so theres somebody who was at the building. Not sure if its somebody b who lives at trump tower, works there or is part of the building you know, is a building employee, so the details on who that person is at this point is unclear. The information that somebody was injured just came in. So thats kind of preliminary at this point. The fire has been officially deemed knocked down, so what does that mean . It means that the visible flame and the bulk of the fire is out. At this point. Make sure theres nothing that was overlooked in response, in responding to the fire. Then in addition to that, theyre going to start the ventilating process. And thats as far as getting smoke out of the building. So at this point, thats where things stand. No longer any Additional Units being added to the fire. And at this point just to recap, one person has been seriously injured, and at this point theres been no injuries to firefighters, 140 of them on scene. Yeah, tom, you were reporting earlier 140 firefighters and i was watching some of live video, as we saw some of the firefighting personnel now leaving it, appears, or walking away from the entrances to the trump tower, and you are also reporting that the 50th floor and other floors is where there was smoke. Is that correct . Reporter right. So basically the fire occurred in multiple units on the 50th floor, im told. Im not sure on that floor if its all residential or residential and offices. Its just not clear, but at this point there were multiple units. Obviously in a fire, and i believe theres some video of this, a fire that was briefly intense, youre going to have smoke not only on the 50th flier, but the floors above and possible the floors below, but typically the floors above. One of the things i was hearing the firefighter, theres an incident commander, one of the battalion chiefs thats on scene, and he was asking for some of the units to bring in some of their fans, and how that works is its just a way for them to create some positive pressure and push the smoke out of the on parts of the building where it still was in there. And the ventilation system may have even shut down to stop the spread of fire, so they want to move the smoke out there, allow help with searches, make sure nobody else is injured from inhaling smoke. Thats a normal part of the firefighters watching this. Thats a normal part of a postfire, one of the things you want to do is get that smoke out of there, and allow you to search and see if theres any fire hiding in the walls. In a large building like this where you have a lot of steel concrete construction and firepro fireproofing, that may be less of a concern, but thats something theyre working on. We have seen this, you and i both being in this part of manhattan, where they will occasional close down certain streets, of course, for security reasons. Did they increase that cordon . Though its a common practice for Law Enforcement to do that around trump tower. Reporter well, great question. I havent had an opportunity to speak to the nypd, but anytime you have a third alarm response of this size, its called a 1077, working fire in a highrise, youll have Police Involved both for crowd control, i mean any time a fires on fifth avenue on a saturday night, youll need crowd control. Youd need the ability to divert traffic, and the nypd there just to help with manpower. I would presume they would be going there, but at this point theres no indication that theres a criminal need for them to be there. Right. Reporter but yeah, i would imagine that fifth avenue right now would be pretty miserable to try to travel down in new york city, but one could say that on any night at this time. So traffic will be bad, and theres a lot of ladder units that are there, so those Fire Fighting units take up a lot of space. I would not by spreed if nypd was there for that, but i havent had a chance to talk about that. Youre the man with all resources, tom winter. Were getting more information, and we believe the fire has been extinguished, thats what we are hearing. We also have a picture thats been put out by the fdny, which we can show of the fire when it was happening, that head put out. This tweet reads of a threealarm fire at 721 fifth avenue, there are currently no injuries reported. You get a sense of where that fire is. Not at the top of the building itself of trump tower. Somewhere it looks like to be maybe ten or 15 stories below. The building itself is a 68story building, mixed use, as many know. On the lower floors you have retail. Its also home to the corporate offices of the Trump Organization, and it also has new Yorks Tiffany location right next door to the world famous tiffanys as im pulling facts from the trump tower site. Right there on 5th avenue there in midtown as tom was telling us, and it, again is a 68story building. It was built in 1984. We have these pictures, on the live on the lefthand side, and also the white house producers monica alba joining us along with tom winter. Monica, we did get some commentary from the president. He was, of course, very appreciative of the fdny and what they were able to do. Were showing on the righthand side a picture from early when flames were actually coming out of the building windows, and they see are glass windows that are after that floor. What do you know . Thats right. As we so often do, the First Response from the president sometimes comes on twitter. Thats where we have heard from him directly, as you mentioned, that the fire is now out and he wanted to thank the firemen and women for the job they had done. Now, we know that in addition to the president being at the white house tonight, the first lady and their son barron are both in washington tonight. Its an interesting night here, because the pool who covers the president has been called to a later than normal call time this evening, which suggests the president could possibly be heading out to dinner or there could be an evening activity for the day. As you know, the president did not golf today, did not have any Public Events on his schedule, so were still waiting to find out what else he might be doing. As is typical, he may be heading to dinner at his hotel nearby with his family. We may know about that later, but as you saw, hes grateful to the firemen and women who have put out this fire and also mentioned he felt the fire was very confined due to the wellbuilt building. Just within this very corner, youve got location like burberry, lieuies vuitton, chanel, tiffany, and its got its own collection of highend retail locations. It is a 68story building, but on the lower floors there are five levels of retail restaurants, some galleries down in that space. But during a normal day like saturday, it tends to be a busy day. You will always see the new York Police Department in front there with the metal cordons on the street, on certain days, always being monitored by the new York Police Department, as was said earlier, this is the home to the corporate offices of the Trump Organization here at trump tower. One of the key buildings in the trump empire and its real estate holdings, and of course the residence before he became president for donald trump. Monica did underline that both barron as well as melania, the first lady and first son, not here today. Theyre in d. C. We understand theres one seriously injured in this incident. The picture on the right is where the fdny put out the visual of what was earlier. That fire is now out, but again if youre just joining us, a four alarm fire at trump tower in new york city throat on the corner of fifth avenue and 57th street at the moment, you can see in the live pictures theres still hookandladders and then on the righthand side, there were also some fdny vehicles. You can see in the reflection in the windows some of the other units that are on location. There are several sbraxs to this. Were looking at 57th on one side and fifth on the other. Theres also an entrance on 56th. Theres many ways to get in and out of the building. You can see some of the personnel coming and going. It appears from what were seeing at this 7 00 hour here in new york city in manhattan, in midtown, at trump tower, a fouralarm fire that is now out. One seriously injured. It was a threealarm before. Flames on the upper floors as you see here, and it looks like if we had to count down, unright there in the 50s in terms of what we are seeing where the fire was before it was put out.
