Washington post. The cnn polls are fake. And the fox news are fake. I tell them they should get a new pollster. You look at the polls that came out this morning, people dont want anything to do with impeachment. It is a phony scam. Its a hoax. During a whip around the sunday talk shows, white house counselor Kellyanne Conway says she does not know whether or not the president held up aid to ukraine in order to investigate former Vice President joe biden. Was there a time when military aid was held up because the president wanted ukraine to look into the bidens. I dont know. But i know theyve got their aid. But it is possible. Heres what is absolutely unimpeachbly true, ukraine got aid and more from the previous administration. The ukrainian president said he had no idea it was held up. He felt no pressure. Being pressed further. Top Foreign Policy officials for this president have testified about repeated incidents where they saw that support for ukraine was dependent on ukraine investigating the bidens. Isnt that the definition of a quid pro quo . The fact is that ukraine has that aid. Theyre using that aid as we sit here. Under president obama, they got blankets, that is important. The way the aid was withheld, until the ukrainian president said he had no idea the aid was withheld. Lets just say that President Trump did condition, giving the military aid, withheld it and said it will be given out, only if you investigate joe biden. Is that an Impeachable Offense . Youre giving me, is it a high crime and misdemeanor, i wouldnt think so. But you are giving me a hypothetical. Danny, let me begin with you if i may. The impeachment inquiry ramping up against this week and you expect to see some folks from the omb dragged in front of this. They say they will defy the subpoena. And the Washington Post is saying it is kind of a little bit of favor with the president. What happens if the director, or one of the senior members of the omb actually ignores this subpoena, and does no go through. Congress has three tools, and we have heard a lot of them. Criminal contempt. Civil contempt. And inherent contempt. Wer theoretically they ask the sergeant of arms of congress to physically arrest the person and bring them before congress. It is not a realistic option with the president. It might be with individual members of the executive branch. But criminal contempt takes time. Civil contempt takes time. Criminal contempt, the crazy thing about it, the statute says that in order to enforce criminal contempt, you know who has to enforce it, the d. O. J. , part of the executive branch and the d. O. J. Takes the position if they dont feel like charging someone with criminal contempt they woe dont it. So congress may have all of this power to subpoena but really no functional enforcement mechanism. Wow. It will land on the d. O. J. s desk. It could. Lets tick through some of the pros, daniel we were laying out earlier, woulder have this nbc news the wall street journal poll, 53 of americans approving of the impeachment inquiry, the fox news poll 49 agreeing that trump should be impeached and removed from office and the Washington Post abc news poll saying 49 of americans say President Trump should be impeach and removed broken down by party, 18 of republicans and 47 of independents and 82 of democrats. What do you make of the latest polling, and especially the president is very quick to dismiss them . Well, not a huge surprise that trump is not happy with these poll numbers. But i think it just shows that the five weeks of private depositions which have leaked out, that theyve proved really damaging to trumps case here. And you have mick mulvaney, two weeks ago, saying well, there was a quid pro quo. Basically confirming this inquirys whole investigative point. So it is kind of hard for republicans to mount a serious defense of trumps behavior here. They have really been talking about the process. And now democrats are going to open up the process to public hearings soon to try to mollify some republican concerns. There is a suggestion that some republicans are saying hey, you know what, maybe it is better to say, there was a quid pro quo, big deal, there was no criminal act. There was no that is not an Impeachable Offense. Not an Impeachable Offense. What do you think of that . Even though the president himself has kind of contradicted himself in that same way in the way he treated it, saying it is an unimpeachable event. It is not a bad defense. In Foreign Policy, there are often many different quid pro quos. And in criminal law, the quid pro quo is only unlawful if it is for a corrupt purpose. And an improper purpose. So this for that. And exchange of thing happens all the time. Every day. In almost every business transaction. Where it goes wrong, at least in the criminal context, is when a Government Official or someone affiliated with government money, gives some of that official work or power or something, some kind of benefit, in exchange for something that personally benefits the official. Thats the traditional idea of and a political opponent, for example. That is exactly an example. But a good reason would be, hey, theres this corruption in ukraine thats damaging the United States, and therefore, were asking you to go after corruption generally. Or thats not what happened here. Youre laying out is what actually seems as if what happened. If for example, the bidens, hunter biden and burisma opposed some existential threat to the United States, then the quid pro quo would be lawful. And thats where i think trump ultimately loses. Because hes going to have to be able to argue that these particular people who just so happen to be his political opponents are the ones that pose the most important threat for ukraine to investigate. Thats a difficult sell. Daniel, i know you wrote about President Trumps obsession with the Media Coverage. Surrounding the impeachment inquiry. He has had a general obsession with Media Coverage throughout his entire time as president so far. But what did you learn specifically about this . Well, i learned that while he is consuming this coverage ravenously, he thinks that the House Democratic inquiry should get no Media Coverage at all. Because hes released his transcript, and also that these private depositions should not be leaking. That they should not be, you know, getting into the public square. But at the same time, hes very downcast at the, you know, his Media Coverage. He often says almost every day, were getting f ing killed, so for a guy who really values his perception in the media, he is pretty negative and down trodden when he watches television and reads the papers, and he is probably still reading the New York Times and Washington Post, even though they made a big huff and puff about canceling subscriptions. It is early to say. Im not saying it is a twoway. But i think if you see, it is coming into focus you are one. Obviously there is a lot of candidates and a lot of things going to happen, but i think as that happen, the contrast becomes clear. Look, the contrasts are real. Theres substantive respectful policy contrasts but theyre real. Buttigieg tried to clarify comments with reporters, saying he is excited about the strong competition within the democratic field. I dont remember the exact context, i think i was getting pulled into the kind of scenario but the bottom line this is a really strong Competition Among really strong campaigns, and i dont think there has ever been a primary or an Election Year that has had this much at stake in my lifetime, and were putting forward both who we are, what we care about, our different styles and differences in policies and i think the policy differences are become are more clear as we go and that is part of what is sharpening the conversation. It is a healthy thing. And beto orourke has ended his 2020 president ial campaign after announcing he does not have the finances or the man power to move forward successfully. President trump is threatening to expose information about army Lieutenant Colonel vindman that would support unfounded claims that he was a nevertrumper, labeled as such as the purple heart recipient purportedly testified last week that the white house omitted crucial language from the reconstructed transcript of his call with the president of ukraine that is at the heart of the inquiry. So an attorney for the whistleblower tweeted over the weekend, that his client has offered to answer any written questions that republican lawmakers on the Intelligence Committee may have. Attorney mark zaiz told cbs news he reached out to Ranking Member devin nunes on saturday saying his client is willing to answer questions under penalty of perjury if written questions are submitted to the whistleblowers lawyers. Zaid tells nbc news he has not received a substantive response regarding the offer but the House Minority leader Kevin Mccarthy said in an interview yesterday that written testimony would not be enough to satisfy republicans. Could that possibly and feasibly be a tactic of the president to do anything he can to slow this thing down . I think it is actually more like the case that he would introduce a shutdown or not really cooperate in terms of funding the government, to create a diversion. So there is an alternative story line that the media can cover, and then congress will have to fix eventually, and to try to draw attention away from the impeachment inquiry. And so that seems to be the logical play that trump might be thinking of in his head. But the impeachment inquiry would actually continue because maybe lawmakers and staffers would not get full pay, but as part of the constitutional responsibility that you have, you know, impeachment inquiries, whatever congress deems is necessary, and so that proceeds no matter, if the government is open or not. It is pretty bold to use the word logical about anything to do with washington and the strategy there. But we respect that. Its a big leap. We respect that. A logical play. He was elected president. So you know, he must be, he must have some intelligence there in terms of political strategy. Exactly. Talk to us about your take on the continued attacks on colonel vindman here and also the whistleblower, the urge of media to identify the whistleblower and especially when it comes to colonel vindman and many lawmakers coming out and saying we will not attack the integrity of this individual or who he is and we appreciate his service to this nation. Well, i think this is going to be a damaging play, for President Trump. Because republicans are not backing him up on this. And if you look at colonel vindman who served in iraq, and referred a purple heart, is a decorated veteran still serving in the military, that is hard to, for Many Americans to stomach, that they dont see him as a nevertrumper, i dont think trump actually has this evidence, and most people in the military are not going to be so stupid as to have signed any letters or to tweet or facebook anything about thats antitrump, and so this is kind of a desperate attempt to take down a person who still serves in his white house, but i dont think it is going to work. And would require the federal government to absorb 20. 5 trillion in new spending. Now, much of the revenue burden to pay for that would be placed on businesses and the wealthy by implementing significant new taxes on the rich, corporations, and high earning investors. This includes raising her wealth tax to 6 on fortunes over 1 billion. Treating Capital Gains for the top 1 as earned income and requiring taxes to be paid annually, imposing 2. 9 trillion in new taxes on corporations and foreign earnings, and creating a new 0. 1 tax on financial transactions. The plan also protects 2. 3 trillion in additional revenue from stricter enforcement of existing tax laws, 400 million by overhauling the immigration system, and 400 billion, excuse me, and roughly 800 billion from ending the overseas Contingency Operations fund. Warren also sets an ambitious goal of cutting Medicare Drug Prices by 70 for brand name drugs and 30 for generics, and would also cut medicare administrative overhead. While warren promises no middle class tax increases, her lan does assume a reversal of the trump tax cut, which by default would raise taxes on some middle class families. As you can imagine, several of fellow warrens Democratic Candidates responded to the medicare for all plan and the Biden Campaign says by putting forward an unleave plan, she will be left with only two choices, even further increase taxes on the middle class or break her commitment to these promised benefits of the mathematical gymnastics are geared to holding a simple truth from voters, it is impossible to pay for medicare for all without middle class tax increases. To accomplish this sleight of hand her proposal dramatically underestimates its costs and overstates the savings and inflates the revenue and pretendance employer payroll tax is increasing somewhere else.
