T the Judiciary Committee voted for a contempt. The attorney general could not comply with the house Judiciary Committees subpoena without violating the law. Its deeply disappointing that elected representatives of the American People have chosen to enthe agency in such inappropriate political theatrics. There could be a lengthy legal fight which Jerrold Nadler put in dire terms. We talked for a long time about approaching a constitutional crisis. We are now in it. Were now in a constitutional crisis. Now is the time of testing whether we can keep a republic or whether this republic is destined to change into a different more tyrannical form of government as other republics have. The House Intelligence Committee issued its own subpoena to attorney general bill barr for documents and materials related to Robert Muellers ruin investigation. It accused the Justice Department for failing to negotiate with the panel or comply with its bipartisan request for muellers files, his unredacted russian report and underlying evidence. In a tweet the committees chairman adam schiff wrote the doj has responded to our request with silence and defiance. Congress needs the material. We wont be obstructed. The move comes after schiff and devon nunez sent a letter to the doj reiterating their month for mueller to brief the committee over its findings. Jerrold nadler says his committee is still working to have mueller appear. You said that the president thats ordered mueller not to testify. Yes. Has mueller specifically told you that . It puts a lot of pressure on mueller and the discussions are ongoing. So in an interview with politico chairman nadler said trumps claim in executive privilege could succeed. Nadler told politico he has not received a definitive assurance about when mueller intends to leave the Justice Department but that by all accounts its very short. Nadler indicated hes banking muellers departure to ease his path to testify to the Judiciary Committee. President trump did not mention the subpoenas or contempt vote at his Campaign Rally in florida last night. However, the president did praise attorney general barr and i complained about the russia investigation while also suggesting that he only talks about extending his term of office past the eight year constitutional limit as a way to provoke criticism. Now the democrats, we have a great attorney general, now the democrats are saying we want more it was going to be we want the Mueller Report. What do you make of it . I think you hit the nail on the head in that the ramifications here are political because the legal ramifications dont really change based on whats happened here. Whats going to happen is that congress is going to go to a court in washington, d. C. , and move to get the entire Mueller Report released. First thing the judge will say why didnt you take the dojs offer to read less redaction versions of the court. They invited certain members of congress to look at a very, very lightly redacted version of the report. The why said they made this offer, you didnt accept it. I want to you look at what they offered you and then come back to me and tell me why you need to see the entire report. What about this testimony from Robert Mueller himself. They missed that may 15th date some on the Judiciary Committee. How does that complicate potential for mueller to testify on the hill . Right. So that i think is a bigger question here because chairman nadler did say yesterday mueller leaving the doj would ease his path to testifying but it doesnt change anything as far as what mueller can testify about. So whether or not hes at the Justice Department doesnt affect the topics that he can talk about. The work he did as special counsel while working under the Justice Department. I want to go back to the contempt proceedings because when we heard from Jerrold Nadler yesterday he seemed very confident they would farewell in the court system with regard to these contempting allegations. The way you frame it, it seem they wouldnt necessarily farewell. It could go in their favor but the main issue working against them is the fact that the court system is very slow, and so whether or not, you know, they get a ruling thats favorable to their view, that could be months and months down the road and i think thats the primary reason why President Trump invoked executive privilege. He borrowed heavily. When you borrow money thats not taxable, youll pay it back. If that debt gets forgiven. The for example if you fail to payback me money that money i gave you for launch its income. Thats the argument here. What trump did was more interesting. He borrowed other peoples money and then took the deduction when he didnt payback the loan on the other peoples money. So its a really interesting piece of use of the tax code, but ultimately one that stretches limits and may not be illegal but its a questionable practice. Its an aggressive, what they would call in tax law an aggressive move. So weve seen how the president has leaned on the treasury secretary to slow walk the demands. How can he do that with this new state request the new York State Legislature . Its going to be a lot more difficult because President Trump only has his article ii power in the federal system. In new york its limited only by new yorks individual state tax laws. As the president believe it or not he has zero power over state laws or state government. So its a totally different sovereign as we call it, a different kingdom literally between the states and the federal government. So that is something that wont be as easily slow walked because trump doesnt have the same power over the state government. So for the New York Legislature its a way around for them. It is. There may be other laws protecting the privacy of individual taxpayers but trump doesnt have that article 2 power that president ial power to order the executive branch including the department of the treasury to do whatever he wants hem them to do. When we get those thunderstorms nowhere for water to glow. Flash flooding is the concern. Overnight torrential rain around shreveport, louisiana all through southern arkansas and now heading to greenville, mississippi. These storms have produced up to two to three inches of rain. Still flash flood warnings for shreveport and pine bluff and new flash flood watches being issued for southern louisiana and eenl well head houston to this mess because youll get soaked. Heres the rainfall forecast. This is through saturday. So areas of pink, thats four plus inches of rain. Thats a huge area here from southern mississippi, southern louisiana right into the houston area. Houston is very susceptible to flooding. Totals could get up to eight inches of rain. Almost like a tropical system over the top of you. A lot of flooding problems. As far as Severe Weather, tornado threats are a lot lower. Maybe an isolated one or two. More concerned with large hail and within damage from louisville to cincinnati, all of mississippi, louisiana and portions of southeast texas. House Speaker Nancy Pelosi and other Top Democrats are arguing President Trump is building his own case for impeachment because of his administrations noncompliance with congressional subpoenas and stonewalling democrats efforts to push forward with investigations. But i think this is by far the most significant move to come out of this panel because we already know donald trump jr. Was under scrutiny for his congressional testimony before but mueller decided not to charge him with any kind of criminal, you know, criminal charges related to perjury or Campaign Finance violations but this is another reminder because the Mueller Report is out doesnt mean these people are out of the woods. A reminder how dangerous Michael Cohen is to the trump family in particular because a lot of these revelations are based on his conversations with fbi prosecutors and also his testimony to the House Oversight Committee Earlier this year. One of the reasons why they may know about the fact that donald trump jr. Knew about trump tower moscow project he knew more. Michael cohen went into great detail about just how much members of the trump family, top executives of the Trump Organization were aware of the trump tower moscow negotiations. Will he ignore the subpoena . Based on what weve seen so far, it seems hes very likely to ignore it. The white house, the president and perhaps even the Justice Department may now start telling a lot of these people to, you know, comply more with the white houses direction. Since we reported yesterday the Republicanled Senate Intelligence Committee had subpoenaed donald trump jr. , the backlash has been extraordinary. I havent seen this kind of or received this sort of republicanonrepublican violence since the days of bob corker and jeff flake in the final months of their senate careers. You pointed this out, i think its 100 right, that richard burr is perhaps unusually resilient in the sense that hes not running for reelection, he does have this sort of independent way of running the committee. But nonetheless, its not just Kevin Mccarthy and rand paul, lee zeldin, congressman, theres a ton of pressure being applied to a whole lot of other members who havent come out yet from allies of don jr. Thats going to continue today. Theyre basically just going after richard burr now in a very concerted way. Republicans obviously going after richard burr. What about don jr. . What about the president . Are they basically going to fight this thing or straight ignore it . I dont want to speak for and i cant speak for either of them but i believe that don jr. Is going to continue fighting this and that his i know his allies are already out there on his behalf going after richard burr. So its pretty clear theyre not going to back down. Lets talk about these trade talks. Negotiators from the u. S. And china are set to meet today to talk about trade. Jonathan, what are you going to be looking for . So myself and some other reporters were with the top two negotiators on the u. S. Side, Bob Lighthizer and steven mnuchin. They made clear these are massive, substantive retreats from the chinese on the negotiations. Unless theres some sort of hail mary from the chinese, were going to see tariffs kick in at 12 01 a. M. Friday morning, and i dont think we are going to see any deal because i just heard from somebody who is there in beijing who is very close to the china leadership and they said the mood here is very defiant. And lou hurr i dont believe has been sent with the authority to flip back. I think there was an opening for that to happen because donald trump loves nothing more than they came begging and i triumphantly solved this deal but i dont think the dynamics are there to achieve that. What are you hearing from the administration on their strategy with regards to china and what kind of support is the president getting with his china strategy with regards to capitol hill . This is the interesting dynamic. Capitol hill hates Donald Trumps tariffs on steel and aluminum and they will go completely berserk if he applies tariffs to autos, to cars. On china he has an incredible amount of support from democrat and republicans, everyone from Chuck Schumer to marco rubio on the right saying hold strong, hold the line. Theres a piept consensus that chan has been abusing america for too long in terms of trade, i. P. Theft and he has a lot of running room to be tough on china. What are you guys watching today .
