The federal government under President Trump is now tasked with putting families back together after they were forcibly separated at the southern border. Children from those families have been spread from maryland to michigan to california as well as shelters in virginia and what the Washington Post describes as cold institutional settings with adult who is are not permitted to touch them or with foster parents who do not speak spanish but who hug them when they cry. Department of Homeland Security told nbc that as of june 20th, 2,053 Migrant Children were separated from their parents. A migrant lawyer says that people separated from their children are being told they can reunite with their kids at the airport if they agree to sign a voluntary deportation order now. In el paso a charity tells its housing 32 immigrant mothers and fathers who dont know where their children are. The parents were released. On friday the department of health and Human Services created an unaccompanied Reunification Task force and on saturday, asserted the United States government knows the location of all children in its custody and is working to reunite them with their families. And dhs says that 522 have already been reunited though yesterday the republican chairman of the senate Homeland Security committee sounded less than certain about how successful they will actually be. Can you tell our viewers this morning that the Trump Administration knows right now which kids belong with which parents . That is what theyre claiming. Does the u. S. Government have the skills, do they have the information to reunite these kids as First Lady Melania Trump says she wants to have happen . So they are saying they do. Well continue our oversight on that, but the track record in the Prior Administration wasnt particularly good either. Deflection. All right. So twitter was pretty ablaze this weekend during a drive to virginias golf course sunday morning President Trump calling for suspending Due Process Rights for migrants detained for illegal border crossings, quote, we cannot allow all these people to invade our country. When somebody comes in we Must Immediately with no judges or court cases bring them back from where they came. Our system is a mockery to good immigration policy and law order. Republicans have recently proposed increasing the number of judges to expedite the detention process for families including senator ted cruz call for 375 more judges. President trump roundly le jacket rejected those calls on saturday. They want to hire now 5,000 more judges. So that a person puts the toe in the land that we have to go to trial. This is crazy what were doing. I dont want judges. I want Border Patrol, i want ice. We dont want judges. Again, just to be clear here, cruz requested only 375 judges, not 5,000 to add to the 375 currently working these cases. And amid the fallout from the Trump Administrations family separation policy, there has been confusion within the federal government and second guessing from President Trump who signed the executive order to end the policy last week. According to the Washington Post in private conversations with aides, trump said he wanted to sign a full immigration bill as part of an executive order which one Administration Official described as quote, a pretty insane idea. The president was told by government lawyers that he could not change Immigration Law by fiat and said a person familiar with the discussions. Trump then demanded that an executive order be written that would end child detentions and cages and said he wanted it on his desk for signing by that afternoon according to people involved in the discussions. Given hours to produce a complex legal document, government lawyers crafted one that met the moments political demands but only added to the confusion within the agencys task to implement it. Despite the data that shows that undocumented immigrants commit less crime, President Trump depicting the people coming here as violent threats to americans. Watch. These are the american citizens permanently separated from their loved ones, the word permanently being the word you have to think about. Permanently. Theyre not separated for a day or two days. Joining us now from mcallen texas, our legal analyst, danny, great to have you with us on this morning. I know that you spent some time yesterday in Federal District court. I should say friday, not yesterday being sunday. These legal entry cases were being adjudicated. What stood out for you . What did you observe unfold over the course of those hearings on friday . Reporter what stood out to me was the Conveyor Belt style in which these cases are adjudicated. For the most part in federal court theres maybe one or two or three defendants waiting for their case. When you have a mass of 60 to 70 defendants being entering guilty pleas, being sentenced right there with the judge maybe spending a minute or two on each of their cases, thats the stuff you normally see in state court with lower level crimes. Granted, this is a federal misdemeanor and misdemeanors are relatively rare in the federal system but the mere fact they are adjudicating so quickly and what jump out to me, to a person, every defendant took the guilty plea and when given the chance to speak in open court, those that did speak expressed an interest in just getting the least amount of jail time possible so that they could return to their home country to their family back there. Thats interesting stuff there. Talk to me about the tweet from yesterday from the president in wanting to abolish due process in many of these cases that you witnessed on friday. Whats your take on this . Reporter removal proceedings are not subject to the full spectrum of constitutional protections. But immigrants do have a 5th amendment right to due process. That due process means they must be able to at least state their case in an immigration proceeding. When it comes to children, they have a 14th amendment Even Stronger constitutional protection. In fact, the right the liberty interests in raising ones children is considered one of the most important Constitutional Rights in our country. And it applies to citizens as well as aliens who come to this country with their children. So they are entitled to a hearing, they should not be separated or removed from their children unless they are what are unfit parents. Thats according to state law with the idea that the state must show clear and convincing evidence that thearent has abandoned their child. The practical reality is that the law makes little distinction between being removed from the country unwillingly and legally abandoning your child. So from what im hearing its not happening and it was completely out of line for the president to ask to go outside of due process for these immigrants that are entering into this country. All right. Were going to check back with you at the bottom of the hour. I want to go to an update on items seized from michael cohen. Reuters citing a written order from the judge in the case reports that few of the items so far are from protected by Attorney Client privilege. Of the nearly 300,000 items reviewed, only 161 are actually privileged. Most of the roughly 3. 7 million items seized from cohen are still under review. Cohens lawyers have until wednesday to identify which of those they believe are privileged. Cohen is reportedly under investigation for Campaign Finance violations, bank and require fraud. Exactly. Certainly not on social media at least. And Rudy Giuliani didnt help when he said he didnt have a significant relationship with michael cohen. And trump was initially defending cohen. He was saying they shouldnt have raided my Lawyers Office and so on and so forth but its been radio silence so far. Lets ask about another onetime close president ial confidante. Pall manafort, could he be in danger of flipping . Hes had a tough month to say the least. He has lost a whole slew of motions in washington, d. C. This is only one of two cases that mueller has brought against him but as far as the washington case its not looking good for manafort. Lets start with the mornings top stories, President Trump continuing to ramp up his rhetoric over the weekend. He made this argument for a merritt based system. We need merit based immigration. Were taking in people that will never help us as a country. We need people that can help us. We want a merit based immigration system. We need safety at the border. We need the wall. The wall is going to happen. But a Study Released last year by the department of health and Human Services found that refugees brought in billions of dollars in government revenue over the past decade. The study found that refugees quote, contributed an estimated 269 billion in revenues to all levels of government between 2005 and 2014 through the payment of federal state and local taxes. Overall, the report estimated that the net fiscal impact of refugees was positive over the 10year period at 63 billion. The times notes that the study was completed last july but never publicly released. President trump is also suggesting that the u. S. Cut off aide to honduras and other countries. One other thing i want to do is you know, you take a country like honduras and so many others theyre sending people into our country by the thousands, i think we should stop giving them money. I think we you know, we give them tremendous aide. Why are we giving them aide when th theyre letting people into our country. The United States has a trade surplus to honduras. U. S. Goods exported was 5 opinion 2 billion in 2015 with honduras exports 4. 8 billion in goods to the United States. Last year the u. S. Department of commerce dedicated 1. 5 million for a customs and Border Management program focused on improving trade into honduras and other parts of central america. The department of agriculture provided 47 million between 2015 and 2016 for two programs that deliver school meals to 53,000 students and increases agricultural productivity and trade. And the United States armed forces maintain a small presence at a honduran military base there. And resources taken away from drug smuggles cases in california. The assistant u. S. Attorney who runs the Major Crimes Unit in california reportedly emailed border officials warning that the um grags cases will occupy substantially more of our resources and added the office was quote, diverting staff both support and attorneys accordingly. Now, a Spokes Person for the u. S. Attorneys office says the district had been given the necessary resources and that number of drug smuggling cases is on track to increase this year. However, the chief federal public defender in san diego says a number of the people charged with drug smuggling cases in federal court has actually dropped since the administrations zero tolerance immigration push. Joining us now from mcallen texas, our legal analyst, good to see you once again. What goes through your mind, danny, when you hear that resources are being diverted from major drug smuggling cases to misdemeanor illegal entry cases . Two things. Based on my personal observations in court im not entirely sure what how many more resources are needed to prosecute at least the misdemeanor entry cases. Those are conducted en masse, very quickly and in fact, u. S. Attorneys are not even in the room. Theyre actually customs and Border Patrol attorneys who are cross designated as u. S. Attorneys. Its interesting to me that theres this notion that will are not enough resources. Its the federal Defenders Office that could use more resources to interview these defendants and provide them effective representation or better provide them representation. The Second Thought is this. The last administration, their initiative resulted in a decrease prosecution of lower level drug crimes, but an increase in the higher level drug crimes. In other words, they focused more on kilograms than ounces. So the real data point ill be interested ultimately when the dust settles is what was the what has been the lessening of prosecution based on weight, based on amount of drugs being ferreted across the border. Is it kilograms or is it the low level drug crimes . Is it the mandatory minimums . What exactly is the data on the crimes being prosecuted now at the border by the doj and what resources have truly been diverted . So let me ask you from the time that youve been down there and i know you went to court on friday. What have you learned about the reuniany occasion process that is playing out . Reporter in court we were in federal criminal court, which the judge explicitly said is a completely separate process from any reunification with your children. Its a question that didnt even come up in criminal court, but what were hearing is that because these parents are released immediately to cbp and i should be clear, there was not one person who stood up in court and said ive been separated from my children. They did say they had children back in their home countries that they wanted to get back to as soon as possible and the general feeling was that they were entering into pleas and asking the judge to give me the least amount of jail time so i can get back home to my home country to my family who i provide for so we didnt get a lot of information from criminal court. What the real question will be today is how the new policy affects or achieves reunification, where its done, the logistics and whether orbit it ultimately happens. And how long it actually takes. I spoke to a couple that was fostering a child about six months or so ago. That child was in their custody or they were fostering that child for six months. The father was sent home after three and a half weeks, was deported after three and a half weeks. The daughter, six months later was sent home. So the reunification process even in instants like that took a very long time and considering the fact that she had a lawyer and she had an organization on her side that was advocating for her. A lot of these kids dont even have that. All right. Thank you. All right. Jared kushner is trying to make a unique strategy for procuring a peace deal in the middle east insulting one side in an interview consulting one side. In an interview kushner heavily criticized the palestinian president and questioned his ability. Kushner who has no known background in the middle east politics or diplomacy has been tasked by his fatherinlaw with securing a peace deal. Kushner also took a page out of his fatherinlaws play book saying that the administration will soon unveil its peace plan with or without palestinian input while offering no Additional Details or time line. Palestinian leadership has refused to meet with u. S. Officials since the Trump Administration ignited deadly new unrest in the region by recognizing jerusalem and israels capital and moving the u. S. Embassy with the palestinian side saying the u. S. Is no longer able to broker a peace deal. Now to the latest regarding President Trumps possible upcoming july summit with Vladimir Putin. Per russian state television, politicians and experts believe trump and putin will enter a secret verbal agreement where trump will agree to look the other way regarding russias actions in the ukraine. There is a lot to suggest it may be true without elablating and in addition there are growing concerns that trump who is known to dislike preparation and also agree to things on the fly despite what his advisors give him direction on will be played by putin who is known to have well rehearsed plans in addition to being a master negotiator. Meanwhile during a dinner at the Democratic Campaign retreat, Vice President of the Senate Intelligence committee reportedly was over here joking to the crowd quote, if you get me one more glass of wine ill tell you stuff only bob mueller and i know. If you think youve seen wild stuff so far, buckle up. Its going to be a wild couple of months. Great to have you back with us. Lets talk a little bit about this likely summit between President Trump and Vladimir Putin. Are we likely to see something tangible come out of this liken a agreement on any host of issues that these two countries are facing whether its syria, election hacking, north korea, what are we likely to see if in fact this goes through and is the president likely to confront him about election meddling . We may very well see something tangible come out of this summit. The downside is that it will likely be to russias benefit. That doesnt sound very because that would be i mean, that would be a significant development, of course. Like north korea . Exactly. The basic pattern weve seen with trump is that he favors one on one diplomacy because he feels like hes the ultimate deal maker but what have we seen for the u. S. Out of his deals and conversations with foreign leaders . Obviously we know that when it comes to putin he has a particular affinity for this soft spot. Exactly. And so he may very well agree to certain things like lowering the u. S. Troop presence in ukraine or coordinating with putin when it comes to syria. Yeah. Of course those things are not beneficial to the u. S. So its really important here that he sticks to his notes. So do you think that this summit with putin is more about the optics of it for the present versus actually getting anything tangible done or getting Vladimir Putin to admit to election meddling or anything like that . Is it more like i sat down, we talked about this and that and we got some things done and look at where we are now. Absolutely. And a lot of it comes down to the optics. Its about how will the media receive this . How is this portrayed to the public. And he knows everybody is going to be talking about it. Absolutely and its very, very unlikely he will get putin toe admit anything when it comes to Russian Election meddling. It will be interesting to see if he tweets anything out about how tough he has on russia saying hes been the toughest president against russia. And it will be surprising to see if it will be documented. We have no idea what was said between him and kim jong un and well have to see if the same thing happens here with Vladimir Putin. Almost like two parallel universes spinning further and further away. On one hand, you have the president saying outrageous things, dialing up the rhetoric on immigration and his critics and democrats in the media. More hyperventilation in response to it, yet on the other side, and you look at his poll numbers, he is doing better than ever. According to gallop, he is at an alltime high at 45 which is comparable to where bill clinton or jimmy carter was at this point in their presidency. You also look at the generic republican versus democrat. Its narrowing, and there used to be a democratic advantage. Why . Because republicans like trump even more today than they did a year ago. 90 favorable rating among republicans. His attacks on mueller also seem to be working. There was a poll last week. So when you get into these issues like immigration, like the muslim ban, where there is an undertone and often an overtone of racism and race to it, you really do end up with these with this potential where there will be more and more vitriol, and passion on both sides.
