We begin with new developments in the fight over who should get to see the documents seized during last weeks raid of President Trumps personal attorney Michael Cohen. A judge has rejencted a request to allow investigation of the materials seized in that raid. A new turn in the legal fight over what should happen to the records the fbi seized from President Trumps embattled personal attorney Michael Cohen which include some materials related to porn star Stormy Daniels who was swarmed by photographers, cohen and the president dont want the government to decide what documents get turned over. Instead, they want an independent lawyer to be the filter. A judge said all the lawyers involved get to look at the documents first and then shell decide next steps. No comment from coenh, but Stormy Daniels had plenty to say. He has never thought that the little man or especially women and even more women like me mattered. That ends now. Reporter the documents seized from cohen included some related to that 130,000 cohen paid daniels in the days before the campaign to stay silent about her alleged affair with mr. Trump which the white house denies. In an unexpected twist the judge forced cohen to reveal that in addition to the president he has also represented hannity. I never paid legal fees to michael. But i have occasionally had brief discussions with him about legal questions about which i wanted his input and perspective. He has been a fierce defender of the president and harsh critic of the special counsel, especially after last weeks raid on cohen. Secretary mnuchin will be announcing those on monday if he hasnt already and they will go to any sort of companies dealing with equipment related to assad and chemical weapons use. But yesterday the president put the ka bosh on that plan. Trump told his National Security team he was uncomfortable executing new sanctions and an official said he was annoyed Ambassador Haley announced it first. No new sanctions are innocent. A decision will be made in the near future. She also said yesterday that trump still wants to sit down for a meeting with vladimir putin. Chemical arms inspectors have blocked by the Syrian Government and russian authorities from inspecting the site of the recent attack in douma. They arrived on saturday. Russia which continues to deny there was any evidence of a chemical attack now says the inspectors will be allowed into douma on wednesday. Russian military police began patrolling the area leading experts and officials to believe that the site will be tampered with before inspectors arrive. Jim mattis and chairman of the jount chief of staffs will hold a briefing this afternoon with the entire house of representatives regarding the recent air strikes in syria following by similar briefing in the senate. Meanwhile there are reports of a new strike overnight hitting bases near the syrian city of homs. They were not conducted by the united states. Bob corker and tim kaine have unveiled legislation that would update and replace the authorization of military force. The last Time Congress passed Something Like this was back in 2002 and that has been used ever since as a legal justification for nearly all military force by the united states. The new authorization would allow the president to continue the ongoing war on terrorism but would place new checks on the president s ability to launch new offenses. A con gression fall review would also be imposed every four years that could amend, expand or repeal the president s authority. Last week syria strikes would not have been impacted by this new legislation. A republican senator is speaking out against republican criticism of his bill to safeguard the office of special counsel robert mueller. Spare me is the message from tim tillis. Now we also learn that he defended sean hannity. Were told he used cohens Services Last year and or this year though he never disclosed that to his audience while defending cohen on the air. Heres the fox news host playing down his relationship with his lawyer. Michael cohen never represented me in any legal matter. I never retained his services. I never received an invoice, i never paid Michael Cohen for legal fees. I did have occasional brief conversations with Michael Cohen. Hes a great attorney. About legal questions i had or i was looking for input and perspective. My discussions with Michael Cohen never rose to any level that i needed to tell anyone that i was asking him questions. And to be absolutely clear, they never involved any matter, any sorry to disappoint so many, matter between me or third party, a third group at all. So cohens attorney said his third client whos now been revealed as hannity asked him over the weekend to keep his identity a secret. Cohens lawyer tried several times to keep are if saying hannitys name in open court including an offer to hand the judge an envelope containing the mystery clients name but in the end the judge ordered the disclosure and hannity was identified. The only reason why hannitys identify was revealed is because of trump and cohens request to review the materials seized in last weeks raid. Now to the president s request to allow him to unilaterally decide what evidence from that cohen raid investigators get to see. Yesterday, the judge denied the president s request to temporarily block prosecutors from reviewing the material. However, she did not rule out the possibility of using a socalled tank team or special master to determine which of the seized evidence is actually protected by Attorney Client privilege. The judge said quote, i have faith in the Southern District attorneys office, their integrity is unimpeachment. I think a tank team is a viable option. She asked all the lawyers to reconvene to determine the best course of action after the government has finished producing materials seized from cohen. Sitting right behind Michael Cohen in court was porn star Stormy Daniels. She walked into court and made a media circus as you can imagine surrounded by photographers literally tripping over each other to get pictures of her. Depending on what is contained within those documents i think there is significant danger to the president , the president trusted mr. Cohen as his fixer for years. He trusted him with his innermost secrets and i think that the chickens are about to come home to roost. All right. Now, the normal procedure for the government, for u. S. Attorneys is to have whats called a filter team. These are u. S. Attorneys and agents that are separate from the underlying investigation. They eyeball the document, they say is this privileged . Yeah, maybe, im pretty sure this is privilege and ideally they return those privileged documents to the attorney. Now, what we were doing in court yesterday is that Michael Cohen was saying hey, those are some of my clients and that raised the question on friday, who exactly are your clients, Michael Cohen . His answer, donald trump, the former rnc chair and mr. X and i dont want to reveal who mr. X is and the judge said on monday, you have to tell me who that third client is. Kind of pert nernt. And that is a short client list for any practicing attorney. Its interesting that hes trying to build it up that hes full of clients and hes come up by three clients. Just by the quantity of the clunts. Let me ask you quickly, one of the arguments hannity has said he didnt feel the need to disclose that on tv was because he had never paid any legal fees. He said our conversations were focused on real estate. Is that a valid argument that if you are not paying an attorney that you dont have a client attorney privilege . The rules of ethics and the ethics opinions in the ethics exams are full of hypotheticals like this one. Youre at a cocktail party, you have a discussion about legal advice or services with somebody casually, does an Attorney Client relationship arise . The answer is its definitely possible. You dont need a written Fee Agreement for an Attorney Client relationship to arise. You dont need an invoice. The Attorney Client relationship and the privilege that can attach can arise from a conversation in which youre seeking legal advice. Pro bono work also doesnt involve no fees. If you look at the waves of expulsions and sanctions and diplomatic facilities close that maybe thats true, but President Trump sometimes doesnt personally comment on these big waves. He apparently was upset at the number of alleged russian Intelligence Officers expelled recently and now theres this recent shutting down of nikki haleys claim that there would be more sanctions. Ed its one big thing is President Trump and his relation with Michael Cohen. He has been trumps fixer, but now were seeing how Michael Cohen has become this controversial problem that trump just cant make vanish or go away in the way that he wants. So we know that axios did speak with people inside the Trump Campaign and the organization about Michael Cohen. What did they say in terms of why cohen matters sort of in the grand scheme of things . Michael cohen, theres no one else like him whos so int intertwined in the president s personal life because he just knows so many secrets that people that are close to the president just dont know if the way that he does. And my sources told mike allen that there are ways in which Michael Cohen deals on the sidelines and sort of off the books that even President Trump doesnt know. And, you know, people say ignorance is bliss, but in this case its not the situation when the president is becoming more entwined with Michael Komen and he doesnt even know the sort of deals hes making. Lets talk about what all this means for the mood inside the white house, because i know its sources and frequent contact with the west wing told your colleague, mike allen, that the president s worries about cohen are actually reflected in his dark moods and amid all these troubles were hearing about Michael Cohen, what has the mood been like at the white house amazingly . I think the last time i saw you guys we were talking about the dangerous phase that sources close to the president are saying theyre seeing his fres presidency and the mood reflected in the white house. This is consistent, this pattern of be behavior from trump where his mood is worsening as he feels hes being treated unfairly or people close to him are being treated unfairly. We see that in his tweets. And whats happening with Michael Cohen is contributing to that. Ill point to one tweet he had from the other day where he was sort of saying i have many lawyers and lawyers across the country including my lawyers feel worried that they will be the target of what he considers to be an unfair raid from the fbi similar to Michael Cohen. Hes feeling target and knowing that those around him are feeling the same way and hes getting worried. Before we let i go we have to have you talk about sean hannity. Talk about the significance of this. Sean hannity say fox news star. We all know that the president loves fox news, thats his preferred way of getting the news. And sean hannity has been a cheerleader for trump naufl these developments about the russia probe and Michael Cohen and the russia investigation in a way that just seems unethical considering he was one of Michael Cohens clients and he never mentioned that. Sure, he will say that he never paid Michael Cohen, but that remains to be seen. But what is fact is that he was working with Michael Colen in a way that presumably altered his coverage and is speaking directly to the president that is just unethical. This urge entwines trump and fox news and represents a collision of media and politics and business and the law in a way thats just not good for anyone involved. I know that weve talked about midterm concerns for republicans, but this is a question for you guys about the democrats. There are some concerns for the democrats. Why should they be concerned ahead of the midterms . So a new poll shows that since january, the democrats midterm advantage over republicans has gone from plus 12 to now just plus four, and they should be worried because this poll showed that there are a number of sort of wildcard factors influencing this. President trumps Approval Rating ticked up slightly which doesnt hurt republicans and the gun control debate is one particularly interesting wildcard because equal numbers of republicans and democrats want their represent toifs reflect their views on gun control. Thats not necessarily helping democrats in the way that maybe we all thought after the parkland protest and things like that.
