The heels of a whirlwind day in court yesterday that delivered the president and his long time fixer Michael Cohen a serious legal setback. The judge refusing to allow Michael Cohen to review the documents seized in that raid last week before investigators do. The revelation that fox news personality sean hannity is one of the clients mr. Cohen sought to shield from becoming public prior to yesterday. What cohen did for hannity is, at this hour, still unclear. Joining us now to discuss the developments in the case Stormy Daniels attorney michael avanatti. What do you feel the importance is to stormy getting her story about . Is it about shoring up her credibility, or is it for her very personal . I think its both, quite frankly. I think todays appearance on the view was something she wanted to do. She had cancelled an appearance back in february or january due to an issue. She felt like she needed to make good on that promise to go back on the show. She also wanted to clear some things up relating to why she didnt report the threat around the time that she did. She wanted to address this nonsense about her looking high during the 60 minutes interview, which is one of the most absurd things ive heard in a long time. She wanted to set the record straight as to some issues. I thought she did a remarkable job. I think more and more that america sees her, they are able to gauge her credibility and see the whatay she conducts herself. I tweeted out this morning, ive never been more proud to be an attorney for a client than i was yesterday when i watched her approach the microphones outside that federal courthouse in a very intense moment and give the statement that she did. I thought it was remarkable. I was so proud to be an attorney at that point. What do you hope to accomplish . You release the sketch, but it sounded like well put that up. And a hotline for any tips. This is a sketch of a potential suspect who intimidated your client in a parking lot when she was with her infant. If youve already shared it with law enforcement, are there no leads . Where does the investigation stand in finding this man . We have a number of leads. Weve received a lot of leads. We have narrowed the field to some names that we think of people that it may very well be. Were not quite there yet. We decided to release the sketch now with the hope that a member of the public saw something or heard something that would get us effectively over the goal line. If someone refers us to a name that is already on our list, were certainly going to use that lead to potentially identify the person. I think were going to get this done in short order. I hope we are. Weve offered 100,000 for people who email information that leads to the identity. The email is idthethu idthethug gmail. Com. Tie this crime to whats going on in court in the Southern District of new york with mr. Cohen. Weve got a federal investigation now into alleged criminal conduct by Michael Cohen. I think thats multifaceted. It looks at a number of different issues. I think theres little to no doubt that hes going to be indicted in short order, likely within the next 90 days if not sooner. What do you think hes going to be charged with . I think theres a number of things he could be charged with, money laundering, potentially Campaign Finance violations, bank fraud in connection with some of the accounts at his bank at first republic. I think prosecutors are going to have a whole host of charges they could potentially bring against Michael Cohen. I think its going to be a significant domino to fall as it relates the president and theres going to be serious consequences that result from that. Ive been saying that for a while. I was saying that before the fbi raided his home and office. A source told me yesterday that the angst that the president of the United States feels around the cohen raid falls into three buckets. One, things that he knows cohen did for him that he doesnt want the public or Melania Trump to find out about. Two, things he cant really remember whether cohen did for him or not. Three, things he may have never known cohen did for him. Where do you think the payment to your client Stormy Daniels falls if that source is correct about the three buckets . In the first bucket, meaning something that he knew that he did and melania didnt know about and the American People have been lied to about it. It doesnt make any sense that the president would not know about this payment or would not have been informed about it, either contemporaneous with the payment or shortly thereafter because of the following reason. Lets assume that Michael Cohen is telling the truth. Thats a huge assumption. He would have, at a minimum, told the president , mr. Trump, just so you know, i did you a solid, i paid this 130,000. Dont worry about it, i took care of you. But i just want you to know i covered it for you. He would have done that to curry favor with mr. Trump. Nobody pays 130,000 of their own money, number one. If they do, they most absolutely inform the person they did the favor for so they get potentially a favor in return down the road. You said on morning joe and the view that you have a strong belief that mr. Cohen will be indicted. You also have a theory about what hell do. Its your belief hell what . I think hes going to roll on the president. Why do you think that . He said hed take a bullet for him . Its another thing to say youll take a bullet when the gun is locked and loaded and the safety is off. Were about to get to that point. A lot of people can talk tough about what theyre going to do in certain circumstances right up until the time youre arraigned in federal court, right up until the time you post bail. You have to pledge assets. They put potentially an ankle monitor around your ankle if youre bailed out. Right up until the time that reality sets in and your attorney has a come toe gkocome meeting with you. If youre convicted, youre going to potentially face 15 or 20 years in the federal system and youre going to serve a lot of time unless you roll over and provide information on somebody higher up the food chain. That discussion has a tendency to bring a lot of clarity to the choice. Hes got daughters. Thats obviously a discussion. I understand hes a wonderful father and he loves his kid. I respect that, but thats going to have a lot to do with the decision. Thats a conversation that other men in the president s orbit have had to have with their loved ones, his Deputy Campaign chairman. Would you look at the people in the president s orbit who have been charged with crimes or who have pleaded guilty. Where does cohen fit in, better, worse, similar . Were they all in the same line of work . You have this case that is separate but not completely different. Now youve got some of the same federal investigators who referred this case by the Mueller Probe. Whats your sense of the comey book is in the news. Hes described the president s team as a mob family. Whats your sense from being almost on a parallel track, but now very much involved in litigation with someone deep inside Donald Trumps orbit . Heres what ill say. I think cohen is similar to sam my the busa sammy the bull who rolled on gotti. Sammy the bull to gotti is what cohen is to trump. From a liability standpoint to the president , i dont think it gets any worse than Michael Cohen with the exception of perhaps mr. Shiler who i think also knows where a lot of the pods a bodies are buried. The worst person the president could have in the cross hairs is Michael Cohen. I dont think the guys that smart. I dont think he did a good job of covering his tracks. We now find out he may have actually made audio recordings of some of his conduct which have now been seized, if the reports are true, by law enforcement. Thats a disaster. There was a report in the New York Times that donald trump called Michael Cohen on friday. What do you think that conversation was about . I dont know what it was about, but it wasnt smart. Did he offer to pardon him of anything . He probably called him with an atta boy and told him he had his back. We all know how loyal the president can be, which isnt very. I dont know whats going on on the other side. These guys are making it up as they go along. Theyre not being smart. I dont get it. The second name you raised was keith shiler. He went into the white house as his body man when john kelly came in as the new chief of staff, he was pushed out. Who was he to Stormy Daniels . What was her interaction . She routinely interacted with him on more than one occasion as it related to meetings with the president and rendezvous with the president. She had a lot of contact with him. A lot of women had a lot of contact with him. He absolutely knows a lot of details about the president and his life. Im not aware of any crimes he may have committed. Just as a possible witness to everything . Correct. Im talking about him as a possible witness. This Michael Cohen development is significant and it is a potential big bombshell. For the president . 100 , no question. Let me ask you about the other bombshell yesterday. Were you in the courtroom when attorneys had to reveal that one of mr. Cohens other clients was none other than sean hannity . I absolutely was. Take us inside that. There was about 20 minutes of foreplay or leadup to this. If you will. To this moment. Im sorry, but there was. There was a lot of back and forth. Michael cohens attorney was arguing vehemently with the judge he should not have to disclose his name. He then offered to disclose it just to the judge. This went on and on and on. It was a long argument. A lot of people weighed in on it. Ultimately the judge ordered him to disclose the name. Instead of writing it down, which i thought most certainly he would do, because what you open is the judge would get the note and open it and take a pause and think about it. He said, well, ill just announce it orally. The clients name is sean hannity. No one could breathe because all the air was sucked out of the courtroom. There was an automobile gasp. All of a sudden about eight or ten journalists stood up and rushed out of the courtroom. You dont have your cell phones in federal court. Let me ask you what you think Sean Hannitys just sort of the range of potential involvement is between mr. Cohen and sean hannity . Interesting new development in that theres no more fierce defender of donald trump and mr. Cohen. Mr. Cohens been on Sean Hannitys program more than a dozen times. Certainly an interesting development. Theres no evidence, to be clear, that sean hannity did anything wrong or that Michael Cohen represented sean hannity in anything untoward or anything that people would be outraged by. I want to be really clear. Sean is saying its raeeal estate. That may be true. We dont know. I know theres documents that were seized in connection with the raids with Sean Hannitys name or involvement on the documents. How do i know that . Because the context in which this was raised was the names of clients whose documents would be protected in the event of a review in connection with the case. So if there were no documents, Sean Hannitys name doesnt come up. It doesnt make any sense. Take me to law school for a second. So they keep losing all of these arguments theyre trying to make to protect Attorney Client privilege. The president is so mad about that that hes been tweeting since the raid Attorney Client privilege is dead. What sorts of things are big enough to make a judge constantly rule on the side against protecting Attorney Client privilege . I think theyre seeking an overexpansive view of the Attorney Client privilege by way of their arguments. I think thats a significant problem for them. Make the no mistake. The Attorney Client privilege is alive and well in the United States. I know the Attorney Client privilege. I like the Attorney Client privilege. The Attorney Client privilege is a friend of mine. Its alive and well. What you cant do is you cant use the Attorney Client privilege to go out and commit a crime or engage in conspiracies and then rely on it in order to hide information. That does not work and its not going to work in connection with this case. For a federal judge to have decided to dgo ahead with this raid, what must they have determined was at risk to violate Attorney Client privilege . The bar that the prosecutors had to pass in order to go out and get these warrants of Michael Cohen, because of how high profile he is and because hes at the right hand of the president , was significantly greater than if they wanted to execute a warrant on my office or your office. I can assure you that. This had to go through a number of layers of review. A magistrate judge had to find there was probable cause of a crime from the documents that were released, it appears that they provided evidence that perhaps Michael Cohen was on the verge of destroying documents or was taking steps to destroy documents, which gave rise to an urgency. I dont think a lot of people have talked about this. I want to raise this. This is rather remarkable if you think about it, because you have the president of the United States going to a federal judge and basically saying i dont trust my own Justice Department to do me right. He says that every day. I dont trust the Justice Department. Remember, the Justice Department is part of the executive branch. I dont trust my own Justice Department to do right by me and do the up standing thing and engage in an ethical manner. Thats remarkable. Last question. What about your case do you think intersects with whatever case they made to that federal judge, who made this extraordinary ruling to let them go in and seize everything in boxes and to take images on the spot of all of mr. Cohens records. Do you think there was an ent intersection we know the fbi seized documents related to the client to your client and ms. Mcdougal and the access hollywood tape. Theyre obviously looking for other instances where mr. Cohen paid women to shut up. Where is the intersection between your case specifically, which is about invalue daidatin nda. I could be bank fraud, Campaign Finance violations as it relates this 130,000 payment. We can very easily see charges in either of those three spheres in connection with this 130,000 payment. Remember, al capone was not convicted of murder. He was convicted of tax evasion. I know. Its so much less sexy, though. Thank you so much. Cohen, unlike ivanka or the other kids, is the only person on earth intertwined in trumps professional legal political and family life. Said one former campaign official, quote, the guys that know trump best are most worr d worried. People are very worried because its Michael Cohen. Who knows what hes done . Joining us now ashley parker, the now Pulitzer Prize winning journalist. Former Clinton Campaign advisor, now director of progressive programming for sirius xm. Basically the president is very rattled and correctly so by the raid on Michael Cohen. He was the make it go away guy. So we understand that hes basically infuriated at the idea not just that he believes Attorney Client privilege could have been violated, but in the documents and the electronic records they seized from Michael Cohen could contain and we dont know that it does but the fear from the white house and the president is that it could contain some of the very sensitive work cohen was doing on behalf of trump, his family, his businesses. The president was the one sort of most willing to sit down with muellers legal team for an interview. This has now soured him on that idea. The final point is that within the white house and within the west wing, the concern is basically about what they dont know. They dont know what they dont know. As one outside advisor put it to me this morning, this is definitely bad for Michael Cohen. We dont know how bad it is for the president. The key thing we dont understand is, if Michael Cohen was doing stupid stuff, although the advisor put it a bit more colorfully. What i heard that i thought was interesting is that the way the president is seething about the cohen raid is different from the way he lashes out against sessions and rosenstein over the Mueller Probe. To him, the Mueller Probe is about something he is sure he didnt do, collude with russia. To him, the raid of cohens offices is his own personal, political, legal skeevey third rail of what have hes done. The cohen stuff crosses in a lot of ways the red line that the president sort of drew early on last year in an interview with the New York Times, which is anything that has to do with his family or his business or his life personally is off limits. Again, theres also the concern that the president has repeatedly denied any knowledge with russia collusion. We dont know what the truth is, but he seems to deeply believe that he personally has nothing to hide. Even though he might not know everything that Michael Cohen had his hand in and that was one of the concerns that this aide was articulating to me earlier. The president does know that Michael Cohen does know where the bodies are buried. The final point is even with the Mueller Probe, the president has sort of always mained at lea ma least the illusion of control. The idea that if things got bad enough, he could shake up his Justice Department. Now that the cohen raid is coming out and was referred to the Southern District of new york, its a totally separate thing and the president has a lot less control over that. Even if he makes changes or tries to squash the Mueller Probe, my understanding is that is sort of already going down a totally different track. One of the things that cohen does as a practice for his clients is kill stories in the media. These were four protrump heed lines in the national enkwiquir. Youve written about the sort of catch and kill practice. Now, if he had fixed we call him a fixer, but if he had fixed, for instance, the Stormy Daniels matter, Michael Avenatti would not have been sitting at this table talking to you. Bad fixer. Its more rent and kill. Or catch and rent. Very good. He would intervene in these stories. He was the cleanup guy. Again, it all got out of control. It spun out of control. The interesting thing and weve been saying it on this show is that this seemingly crazy t tabloidy story about a porn star and a playboy model are what have opened the door to a much more serious investigative situation for mr. Trump. Thats exactly the point that people keep making. Weve got this esteemed 73yearold former fbi agent, the only man for whom the laws were changed so he could serve as fbi director longer. The president is surrounded by terrible lawyers. Michael cohen only has three clients. We for two of them what he was doing was arranging poorly executed hush money agreements. If you look at some of his other lawyers, hes not a real criminal lawyer in any sense of the word. He mainly runs an organization that allows him to raise money from republicans all over the country and hire his brother, his wife and other extended members of his family. The president is now completely overmatched. Hes squaring off not just against bob mueller and one of the best all star teams of prosecutors in america, but also the Southern District of new york, maybe the best Us Attorneys Office in this country. Bob mueller came out of that office. Everyone that sort of goes on to run the Justice Department for democratic and republican president s, many of them come through that office. Thats right. Its a very hard office to get hired into. They take the best of the best. They are some of the best prosecutors in the Justice Department. You now have the president intervening in this case. One of the things that Michael Avenatti mentioned in his interview that was so strange, it was odd for the president to intervene in this case and try to get these record back from the Justice Department. He didnt need to do that. Michael cohens attorney was already arguing that position. You had the unusual case of the president himself coming in and arguing against his own Justice Department. The Justice Department calling the position the president took dangerous in one of its filings. Very very unusual. It really is unusual. I will tell you to matts point about poor lawyering, the entire lawyering around this situation, simply the Attorney Client privilege and the taking of documents during the raid shows you what poor lawyering donald trump has. If you read the filings back and forth, he makes such ridiculous arguments, the cohen team. And trump was asked or asked to be allowed to intervene and couldnt come up with his own independent arguments. So both the judge and the prosecutors of the Southern District did their best not to show contempt. But i think there was some internal eye rolling. Theyre taking positions that have no basis in fact. They have no idea how things work, like the taint group or the work that works for Attorney Client privilege. Its kind of an embarrassment. Youd think that somebody out there would want to represent the president of the United States. Hes gone through a dozen. Hes moving onto legal zoom. I want to ask you about sean hannity. We dont know yet. You listened to what he had to say. He was just on the radio. Lets listen. Yeah, i did have Attorney Client conversations, mostly over reality. You know, its just so corrupt, it is such a double standard. And it is so obnoxious on so many different levels, but its never going to go away, because the mission when you really look at it, is been and has been to never let trump get elected. And then from the day he was elected, to undermine donald trump. Im a little struck by the word mostly in that. What i would say, though, is as we have been talking about the feds have communications of Michael Cohens. So one would presume that mr. Hannity will be careful in what he says lest that something comes out that contradicts it. Whats funny to me is whos corrupt now. This is the chris wray run fbi. The trump appointee runs the Southern District office. The conspiracy falls apart when you have to answer whos conspireing . You picked all these men. Generally the conspiracies on the right fall apart. I do a segment on my show called oliver explains the right. He was a long time media matters reporter. Essentially the underlying trend in the coverage in the right wing media is, it doesnt matter if more facts debunk your conspiracy theory. Thats just evidence that your theory is actually correct. That sounds counter into uitive but thats literally what they do every day. Let me give you a quick last word, ashley. Are you if i cpicking up anythim the white house or any senior advisors about sean hannity, the defender with the biggest audience on that fox network that they love so much now being ensnared in all of this . Thats a great question. What im hearing from the white house is sort of what jim just said, which is they dont know. As of now, they sort of think its a weird quirk, that you know, of course his name was mentioned as Michael Cohens third client, but its not more than that. Someone i talked to made this point. If more news emerges or another shoe drops or Something Else happens, they absolutely would not be surprised, because theyve learned that in president trumps world, the outlandish and the zany and the scandalous often turns out being true. Your impression of watching comey try to take what is, i think in his view, a factual telling of his encounters with difficult decisions at the Justice Department that have come under fire from the right and the left, and having to wage this asymmetrical post fact, in the gutter war with a president who managed to defeat 16 republicans that way and the hillary Clinton Campaign that way. What do you make of someone from your line of work, the Justice Department, going to toe to toe with a president who fights dirty . I mean, its sort of surreal. Toe to toe is the word. Thiss a lot of coverage of it as if its acaged wrestling match, comey versus trump. Comey did some things that im on record as saying were mistakes, but hes 100 right here. This is not normal. This is not okay. It is not the job of the president of the United States to say who should be in jail and who shouldnt be in jail. And thats even if what we were saying had any basis in fact, which it doesnt. It really is an attack on the norms. And a little postscript, having listened to the last panel, because the thing about stormy that in some ways is heartening yes its anomalous and sensational, but it really is a kind of triumph of the rule of law there. Its kind of good news. We have the president against the porn star. The porn star is going to win and shes going to win because the law is going to be applied faithfully by a single judge. Thats the way its supposed to work one way or another, even against the president. Whats happening with comey, just whatever he did or didnt do is completely unpresident ial, to say the least. Just inappropriate for a president of the United States. Jennifer rubin, i feel like youve written enough columns about the obliteration of norms for me to wallpaper my room. If i didnt have a show, id just read them out loud at the dog park, because they are the thing that guts me about this trump policy. Its not policy disagreements. Its sort of decimating all that was dignified about the american presidency. One of the central pillars of system democracy is the rule of law, the notion that we operate with rules, doesnt matter if youre the president or the porn star, theres certain ways we go about enforcing our laws. Everyone has the same constitutional protections. What donald trump on a regular basis does is he inserts himself into the legal process, which in our system is not politicized. We dont run show trials here. We dont allow the president of the United States to use the Justice Department as his personal goon squad. Thats what donald trump tries to do. He inserts himself because he wants to change the players so he gets the right outcome. He wants to tell the Justice Department they should go and investigate Hillary Clinton. He wants to tell the Justice Department that james comey should be locked up. It is totally and absolutely inappropria inappropriate. Theres a lot of talk on the right that oh trump hasnt done anything, its just talk. What the president does is he takes an oath to enforce to the best of his ability the laws and the constitution. When he is doing this, he is violating his oath. His job is to enforce the law. His job is to make sure that the executive branch takes the laws that are on the book and enforces them evenly and fairly. When he does the exact opposite, when he personally is involved, thats not just corruption. Its unconstitutional and it is the sort of behavior frankly that if i were a member of congress i would look at in the totality of all the other things hes done and said, this person really should not be in the white house. Its not only this. Its the pardon of sheriff joe. Its the nonsense lies about having tapes in the white house. Its threats against comey. Its firing comey. Its telling comey to lay off of michael flynn. No other president in our history, republican, democrat, has ever done this, because theyve all had an appreciation that the rule of law does not allow the president of the United States to do whatever the heck he likes. Its there to protect citizens and its there to treat all citizens equally. So it is gobsmacking. I know we keep saying this. Theres no other way to describe it. I want to ask you to pick up on this thread. There is a pr war going on. I think jennifer and harry are speaking to the legal implications of talking about jailing your political opponents. But there is a pr war underway between james comey and the president. Who do you think is winning . Im not sure, because i have to say i do think this creates a lot of noise around central questions. If i could wear my media colu columnist hat, for us the reporting just has to stay on the nittygritty, really following the money, following the legal trail. Investigating trump. Investigating the story, getting to the bottom of it and letting the war of words you know, keep score in terms of the truth and dont let it distract us all from figuring out what happened here. Thats everybodys responsibility. No matter which side youre on, we just ant answers. What do you think about the speck tack spectacle of seeing the former fbi drek tirector talking about size of the president s hand. I found that just as a viewer, i didnt have to hear that. I would rather hear the facts as he saw them at the time without getting into this like physical the insults. This has been going on since the campaign, we saw some of that. I dont know what it gets us. That is the prevailing opinion among most people ive talked to. The other side of that, though, is thats not how you win a war with donald trump.
