Lindsey, the only girl, was the eldest of the lovelace kids. I remember being at school and getting a call at the office that i was getting pucked up and i thought maybe my mom is in the hospital. She didnt feel good the day priorer. Its fine. But once inside the prunsples office, her father broke the news. And told me my mom died and i remember then on my world crashing down. Everyone was just in shock because she was very young 38yearold and she seemed healthy from what everybody understood. So it was a huge shock. That very sad your professors wife had died. You didnt know her . And i really didnt know him at that time either. Soon everyone in town was wondering what had caused coreas death. The pathologist that performed an autopsy noticed a small abrasion on the upper lip and something inside that looked to be a can ut. He said she had fallen. The fallsed could have caused the injury to the lip presumably . I wish i knew but yes, a fall could account for a injury. And she had fatty liverauen caused by heavy drinking. Still labelled the cause as undetermined. She doesnt know what killed this woman . That was frustrating. She did find disease of the liver that can be associated with sudden death. Unusual for a young woman to die of uncan known causes. But not heard of. Without morer to go on, the detective closed the case. Her mother could barely bring herself to read the autopsy report. Cory was drinking we dont deny that. She was beleemic and i did try to talk to curtis about that at one point in time. Now marty knew her suffering would only deepen. Her husband was dying. Tawas like he was saying goodbye to friends too. He didnt come home from the hospital after that. So both those losses one right on top of the other . Yes. Within the span of a month she lost a daughter and a husband. She purchased two burial plots even though corys remains were cremated. You can see her hands frozen abb her body. That had caught detectives attention years before but he didnt assign it any real significance. Rig mortise . Yes. In my opinion. The mechanics of rigger mortise go like this. Upon death they stiffen but it looked like they were in an advanced state of rigger meaning she likely died many hours before this photo was taken. Remember he said he tucked her into bed only an hour before finding her dead. He went straight to his bosses with the old file. My first thought was we missed something here. Chief coakley had been in charge in 2006 when everybody assumed she died a natural death but said he never saw the photos. What did you think . I thought this is odd. This is not natural. The poscanture of the arms definitely appeared to be that inrig ormortise stepped in. I cant believe we accepted an undetermined cause of death and a natural death. Detective gibson agreed. But they had a problem. Very thin. Some notes from eight years before and a few photos, very few. And only two slides were taken by the pathologist and passed on in evidence. Very thin file. Basically a review of the original autopsy done. Couldnt do a new autopsy because the body had been create mated. The chief okayed the request to have a pathologist review old autopsy notes. And talk to everyone and anyone who had known cory. His first call was to cory and said he wanted to meet but not about why. He said can you tell me a time and i was said scratch everything. Come now because i was so nervous about what it was. Everything was about to be new and unsettling. The thing that struck me first was the position of mrs. Lovelesss arms. And that surface, whatever the object was, why wasnt it there anymore . She noticed the abrasion and cut. To her that suggested something had been pressed against the womans mouth and then seeing the marks around the mouth and inside the mouth all suggest that suffocation occurred. Suffocation. An abrasion, an accepted timeline that no longer fit. She concluded someone had used an object, lakely a pillow to suffdhat woman left it under her arms and removed it many hours later. For the detective, corys death came down to two competing narratives from two competting women. One relied on science, the other relied on memory to describe an ailing mother just before she passed away. In the end the detective believed the science, that a crime had been committed. But now he had a problem. There were two officers that conducted very different investigations othe very same case. Detective gibson, you bleeb this is a homicide . I do. Some of his own actions were at the very least unusual, including never calling 911. He called who . His boss. His wife is dead in the bed and he calls hiss boss . Corys mom testified curtis broke the news of her daughters death in what she thought was the most callous way. There was a knock at her door and he was standing there with 4yearold larsson. I open the door and he hands me larson. And says. And by the way orcorys dead. Take your grandson and by the way your daughters dead. He was emotionless. Lets put it that way. People who saw him that day claimed he was without emotion. Curtis also knew cpr and yet he never tried to revive his wife. On the day, why didnt you do cpr . I dont know. I dont know why i didnt do cpr or call 911. Looking back i saw my wife, corer canny, dead and i didnt know how to react. Prosecutor parkenson, the next pushing hard against detective bard who handled the case. He questioned if baird gave curtis preferential treatment. He gave them a story how it happened. They bought into it. Afterall hes one of us. So maybe tougher questions didnt get asked . I think so. They testified the household was sometime as stormy one and he says thats the back drop of her death. They fought all the time. A rocky marriage with lots of arguments going both ways and it got out of can control. Again i didnt know why why he was asking and i just ghav story i gave that day. I wish i could say i really do wish i could say i remember her or no, i dont remember. But i cant say that. Since he couldnt make bail, hed remain in jail unless a deal . They had offered a Second Degree murder plea but i knew it was a decision not only that i had to make but we had to make as a family and i didnt know whether i could put them through another year of what we had already gone through. Thats when one of curtiss lawyers turned to christine. And he said that this can end right now if curt agrees to take this deal. It would keep him from dying in prison. But hed have to admit his culpability responsibility in her death. And he wouldnt have to spend anymore than 13 years in prison. Dprrs the two said no thanks and geared up for a second trial but that forced them to face another dire reality. They were broke unable to afford another lawyer. What are we go doing . At that point there didnt appear any option. This could be a moment for christine to say i didnt sign up to be a tammy winet standing by her man. And who could blame her if she would have done that. But thats not who she is. It looked as though curt cans would have to use a public defender. But christine wouldnt accept that option. She worked her connections and eventually ended up here in chicago. She came to our office and told us her story. I remember finding it compelling and certainly worth exploring furtherer. Hes a civil rights attorney who also does pro bono work with the exoneration project. Its aim was to overturn wrongful convictions. But he hadnt been convicted, at least not yet. Still they decided to take the case. Their services would be free. Gr the main concern i had was the lack of evidence. This didnt feel like a murder case from the beginning. Another neighbor testified she heard cory and curtis really going that the night before v. Valentines day 2006. It can did cause me to pause. I guess i was listening to see if somebody was in distress. The prosecutions theory this go around remained the same. After a heated argument the night before valentines day, curtis suffocated his wife with a pillow in a fit of rage. He then waited up to 12 hours before the police were called. And once again science would play a leading role but they had a new witness, a star forensic expert. I have also testified before the house of representatives. In a 64year career he has consulted on jfk and Martin Luther king assassinations including phil specter and casey anthony. The appearance of of the injury leave no doubt this is not a healing wound. In a darkened court room he talked about the cut inside corys mouth. He said the wife had fallen in the days before she died. But this expert said he saw no sips the cut was an old one. There is no evidence of healing. So this looked like at the time that it was a cut. It indicated to spitz that an object, like a pillow, had been placed on her face shortly before she died. This is not an accident, not an actual death. This is not a suicide. This is a homicide. Then came testimony the first jury never got to hear and it was explosive. And we had an argument about kids and he came rushing at me and tried to grab me. Tried to hurt me and grabbed my shirt and he yanked it up really hard, hard eintoof injure my knee. He ripped my shirt and then he let me go and he tried to grab me again and i kept on trying to fight him off. Then erica told the jury curtis had been drinking at party and later that night he blurted out something she found disturbing. Hes rarely honest except for when hes been drinking and it was tough. He was upset about something. I asked him what he was upset about and he stated something about she was righting underneath me and then he said the black cat. He wasnt talking about a cat but of corys last minutes of life as she struggled. He says i could hear her writhing beneath me and sounds like hes talking about killing the wife. Thats what we thought it sounded like. I could feel her writhing beneath me and thats pretty much what would have happened if suffocation was occurring. Not so fast said the defense. Thats because it had some things up its sleeve. A new piece of lastminute evidence and what an interesting nugg nugget they had found. Coming up tough questions for erica. Someone made that up. E the investigatio that i did not we told the judge we werent going to talk. Curtis lovelace was putting his life in the hands of the new attorney. He had more than 20 years of experience, just not in criminal law. Was this your first murder trial . It was. I did a battery case out of law school. Curtis was taking a huge gamble. On the other hand, since he was broke, he didnt have lot of a options. In his opening remarks he said the state hadnt presented any evidence of murderer for a reason. There was no murder. All the evidence is going to prove that she died as a result of acute problem brought on by her alcoholm. One of the things was to delunk the testimony of his ex. And one of the First Defense witnesses was larry fuller of the l. A. National guard. I asked if she wanted to make a sworn statement and she said she would.
