Reporter you know when you have the hot weather, the Severe Weather kicks in. In north carolina, the ef 3 tornado snapped power line, ruined homes. There were over a dozen hurt, and the pfizer plant took significant damage. And over in kentucky, that flash flooding, we know the governor of kentucky just tweeted out not long ago that there were several people who had to be rescued from the flash flooding, but so far, no one missing, no fatalities reported. The thing to remember here is the most deadly form of Severe Weather is actually extreme heat, and that is something we have seen from coast to coast across the country, particularly were not just talking about here in miami we hit the 40th day of a heat index in the triple digits. Were also talking about over in the southwest, el paso, las vegas, of course phoenix, arizona, where i just got back from, spent several days there. We have seen how this can get not just dangerous, not just uncomfortable, but deadly, people have severe burns, thirddegree burns from accidentally getting on the asphalt. It takes seconds for them to get severe burns. Some of them fell, and unfortunately, we understand one elderly woman couldnt get back up. The heat, of course, depending on who you are, depending on what population, whether you are part of the elderly population, we know that this can be deadly. It can be deadly fast if you dont have access to airconditioning. Were looking at the highs in phoenix, another record broken, consecutive Straight Days of temperatures over 110 degrees. Were not talking about a heat index. We are talking about just straight temps. We saw a high of 118 degrees. This is something that was putting a strain on hospitals and local rescuers and First Responders with, chris, no end, at least in your sight. Marissa parra, get into some airconditioning. Im told he will be testifying today. Our team at the courthouse has set their eyes on the lawyer representing him. For context, this lawyer is also walt nautas lawyer, and several trump loyalists. Will russell is somebody who served as the Trip Director inside of the white house up until Donald Trumps departure from it. You can see him in that photo with donald trump and Mark Meadows On January 6th under a tent at the ellipse. Just before donald trump took the stage and delivered his remarks. Midday then, the questions around will russell, what may he have been privy to. What conversations was he a part of . Will russell was not named in the january 6th select committees report. He was never interviewed by the house january 6th select committee, and so theres questions over whether new testimony from individuals who had not previously spoken with the congressional investigators had potentially come forward for the Special Counsel or whether there was evidence that had been acquired and obtained by the doj that led them to will russell. He has now testified multiple times. Of course the expectation is that this is nearing its conclusion of the investigation around donald trump. But will russell continues to work for the 2024 campaign. He is somebody who is still in Donald Trumps orbit. The question is to what extent is he working with the Special Counsel, and to what extent is he aware of conversations that could directly potentially implication donald trump and lead to charges . And Rudy Giuliani . And Rudy Giuliani, too. This is a web that extends across this country at this point, and we know that Rudy Giuliani now met at least two times with prosecutors from the Special Counsels office. Rudy giuliani, an aide to his has insisted he has not flipped on donald trump. Of course, Rudy Giuliani has been told that he is a target of the investigation in Fulton County by the District Attorney there. But Rudy Giuliani, to our understanding, has not received a target of Investigation Letter from the Special Counsels office, and so, again, donald trump at this time is the only one we are aware of to have received such a letter. Rudy giuliani, we should expect him to be a key player of any charges against the former president , chris. Vaughn hillyard, thank you for that. Lets go to texas where women are suing the state over its abortion ban. Nbcs Lindsey Reiser is following the case. You brought the incredibly emotional testimony of many of those women. What did we hear today . One of the women got sick on the stand, they had to have a recess. It was so traumatic, recounting what happened to they are. Today were hearing from a slew of doctors. Were going it put names on your screen. For example, dr. Aaron caughey, he testified if a womans baby has a condition like anesephly, the standard of care is abortion. And dr. Ali raja, how a doctor might consider the language of the sixweek abortion ban to be vague. Lets listen to what he said. The laws as theyre written, the medical exceptions, theyre confusing and that confusion, that lack of clarity is keeping physicians from being able to exercise their good faith clinical judgment in the treatment of patients. It also is pretty evident that the fact is that the consequences of those laws are severe. The state argued that that doctor is not in texas, has never performed an abortion, and overall, state is arguing that the lawsuit should be dismissed. They say the plaintiffs dont have standing. Theyre going to be calling a single witness today, a doctor who supports research and policies in her words that respect the dignity of every human life. The judge is expected to either grant the temporary injunction, blocking this abortion ban, chris, for women with risky pregnancy or dismiss it all together. Chris. Republicans largely want the status quo which is to let the Supreme Court supervise itself. The bottom line is this is a bill not designed to make the courts stronger, more ethical. Its a bill to destroy a conservative court. This bill, if enacted would bluntly insert politics into the Supreme Court and erode away at the checks and balances carefully crafted by our founders. This legislation is meant to the bills lead sponsor, senator Sheldon Whitehouse said this is just round one, telling politico, think of a boxing match, if you dont fight the first round, you cant win the match. I want to bring in ali vitali, msnbc legal analyst, lisa rubin, former senior adviser, alencia johnson. Senate democrats scored a win, they had a razor thin margin, 1110, voting along party lines to advance the bill. Then what chance does it have . Reporter very minimal. You dont get to round two before going through round one. This is a win notched by Senate Democrats. We expected that was going to be the margin because thats the partisan break down. When you take this to the full floor of the senate, it would need 60 votes to pass and avoid a filibuster. Thats the magic number around here, not 51. It would require a bipartisan effort, and frankly, listen to the way republicans were talking about this, its clear theres not a ton of willingness on the part of senate republicans, and House Republicans have made clear they dont want to touch this issue. Nevertheless, heres what senator whitehouse was saying about why he thinks this bill was important, especially in this current landscape. Watch. We have to allow power to check power, allowing congress the power to check abuses in the Judicial Branch is a long established and proven fact. That the Supreme Court has for decades gone along with without complaint. Even when and perhaps particularly when it involved justices themselves. And look, its important to remember the things that led up to this because this has been a push on the ethics front for months now, especially from the Judiciary Committee because of the reports we have seen about people like justice alito, Justice Clarence thomas, receiving gifts from donors or vacations or private jet travel, and then not disclosing them, and those donors having business thats relevant to them in front of the nations highest court. That has of course prompted a little bit of a crisis in confidence here in washington, but also across the country, especially as we watched the Supreme Court weigh in on increasingly important issues such as abortion, just over the course of the last year, chris. Thank you so much, ali vitali. So lisa, i guess the question is why dont the Supreme Court have a code of ethics when all other federal judges have one, right . Its a good question. There are some who believe constitutionally, that that would be an incursion on the separation of branches. We have three coequal branches. The Supreme Court should not be subject to supervision by congress. Thats unsatisfying for a number of reasons. A Senior Member of the Judiciary Committee, john cornyn said to the new york times, hypothetically, what if the Supreme Court sent over a code of ethics to the senate, how do you think that would be received to the coequal branch of government. The Supreme Court gets its budget from congress, for example, a number of interactions between the court and congress that rely on Congress Making decisions about the court. This should be no exception. Particularly where as here, the Supreme Court has shown no appetite to govern itself and the bill that the senate Judiciary Committee reported out today, it gives the court 180 days, if passed to come up with that Code Of Conduct itself. The congress or the senate Judiciary Committee is saying, our preference is still that you do this yourself, not that we should have to do it for you. So alencia, Clarence Thomas and samuel alito were in the spotlight might be the wrong word but getting a lot of attention and criticism and gifts they accepted from what they said were wealthy friends. There was a report in the associated process about an aide to Justice Sotomayor to pressure Public Institutions who hosted the justice to buy her books. Does that mep democrats argument this is a bipartisan effort. Is it an example of why this is needed or can they mine their own story. Im glad you brought that up. I think democrats are actually welcoming this code of ethics to be for everyone, whether conservative or democratic. The reality is democrats are responding to the public outcry when it comes to faith in the Supreme Court. The numbers show us that people have lost faith in the Supreme Court, and most recently, there was a yougov poll that came out this week with an organization, demand justice that focuses on Supreme Court reform, and they said that 60 of americans would not support a candidate for office who doesnt support Supreme Court ethics, right . Ive asked a lot of folks in the fbi and doj about this. I want to ask you both, thousand, how concerned are you when you see those kinds of numbers, as people who work in the business, and people whose very integrity is at stake here. When you see those that the integrity, the support for the Supreme Court is being questioned, what does that mean . You know, i see it as an opportunity, i guess im ever the campaigner, an opportunity to educate the American People on their power to say, hey, we done have faith in how these institutions have been won now. We dont have faith in the ethics, we have the opportunity at the ballot box to make our voice heard. I have been on the road with Coalition Groups talking to voters about that, and theyre realizing the power is with the people. In order for us to right the wrongs, people have to get the right folks in office. Thats where i have optimism and hope while we have this continued culture conversation dismantling the legitimacy of so many institutions. Lindsay comes at it from a political perspective. You come at it from somebody who works within the system. Whats it mean for you . Its deeply concerning for me, chris, and one of the things that concerns me about it is the lack of faith in the system is so pervasive that when we have problems that arent problems, the lack of guardrails around the court prevent the public from seeing that. There was recently reporting about a Christmas Party that Justice Thomas hosted for his clerks and venmo payments from a number of prominent lawyers in d. C. As a former federal law clerk, i can tell you, that was inknock innocuous. Theres all of this other suspicious activity and no guardrails around either disclosure, recusal or what gifts you can or cannot accept. That makes the public distrustful not only with the court but similar Polling Results with the Department Of Justice and fbi as well. We have 30 seconds left, is there a very pointed way na that democrats can campaign on this or message on this, in ways that rnlt necessarily about abortion and Student Loans and gay rights. One focus, Legacy Admissions. In an oped earlier this month, congresswoman barbara lee of california wrote, the Supreme Court did not strike down Affirmative Action for everyone. It was just taken away for everyone thats not wealthy or white. For many wealthy white students, it still exists in the form of Legacy Admissions. Wesleyan university in connecticut is the latest to formally end that practice, which its president says was a sign of unfairness to the outside world. Joining us now, Wesleyan University president , michael roth, we appreciate you being here. So why this, and why now . Well, in the wake of the Supreme Court decision, which said that we cannot use the groups with which students affiliate racially in our admissions process, it seemed egregiously wrong to help someones admissions chances because they were related to someone who went to wesleyan in the past. And so although at wesleyan, this legacy bump has been really small over the last decade or so, as ive been president , it just took the focus away from our efforts to recruit a diverse student body. We are going to continue to do that. Were afraid that many black and brown students wont apply to schools like wesleyan because of the end of Affirmative Action. We want to continue to recruit people from all parts of the country, from all socioeconomic backgrounds with various lived experiences to create a diverse student body and abide by the law. Having Legacy Admissions on the books made that effort seem hypocritical, and so we removed that hypocrisy this week by saying we would no longer privilege people who had a wesleyan parent. To what extent can doing that actually help to assure a diverse student body given the ruling by the Supreme Court . I think theres a lot we can do to recruit a diverse student body. The issue of Legacy Preferences is a small one given all the inequities in Higher Education and a k through 12 education. What we should be focused on is helping to prepare students to be as successful as possible in school, and to find the right school when theyre ready to go to a college or university. And we can recruit actively from parts of the country where there is a high concentration of black and brown students, where theres high concentrations of other ethnic groups. For us at wesleyan, whats really important is we create a diverse student body. People from all over the world, different parts of the country and different points of view. We have to recruit students of faith, conservative students, because as a highly selective new england liberal arts school, sometimes people think, we know what kind of folks you want in the student body. We want a student body thats surprising, unexpected possibilities for making connections. It sounds like you want to acknowledge there are a lot of folks out there who frankly think the system has been rigged for a long time, whether it was several years ago when we found out that folks were paying, you know, wealthy people with connections were paying to see their their kids got into school, and all the things that are in between, including Legacy Admissions. You have a high hill to climb to convince people were doing this in a fair way . Absolutely. Your Previous Story about the declining trust in the Supreme Court because of the ethics issues we have that all over the place in Higher Education. The decline in trust in colleges and universities is really strong. And i think its so important for colleges and universities to do the right thing in a very public way so as to restore some of the confidence in our institutions. Our students, when they graduate, are full of admiration and gratitude for the schools they went to. They think they have been transformed by their education. The Greater Public is very suspicious and i think what we have to do more to get the message out to the public that we have fair admissions processes, and that we can also open our gates, at least virtually so people can take advantage of the Educational Resources in online classes and hybrid classes and other programs. If you have a social Media Company you have a First Amendment right to decide whos on your platform and who isnt. You know, theres no First Amendment right to be on anybodys platform. Hes complained about the way he has been treated. He has a First Amendment right to go out and get on a soap box and say whatever he wants. He doesnt have a right to be on any social Media Private companys product. How do you explain the 14 he has with democrats . Is that just name recognition, and they dont understand what he stands for . What do you make of that . They had set it for this specific time. Stanley woodward knew he had a client expected to come in in the morning, to make sure that wouldnt interfere with everything. He ended up being a half hour late for this verdict, and the reason he said in court today while explaining why he was late for this verdict was because of the fact that his client in the grand jury case was being asked questions that specifically had to do with Executive Privilege. This was a trump aide who was with Donald Trump On January 6th. And the invocation of Executive Privilege has been something that has gone back and forth throughout this entire investigation.
