Trump has tested negative for covid19. Welcome. Good sunday morning to you. Since chairman steele is here at the table im going to start with chairman steele. Lets go. I want to go round robin im sure thats tea. So lets talk about this poll from the Washington Post abc news poll, we will put it up here. I want to start with the number one thing you see there and that is the economy. Chairman steele, explain to me how an incumbent president who is losing in the National Poll by 12 points is a point ahead of his challenger on the economy. Actually, its not that strange, i mean, remember, that number was 10 points about three weeks ago, so the president has lost a lot of steam when it comes to this particular issue, but its not its not that hard to understand because that was the bread and butter of his administration was the economy and the way hes talked about the economy and the way, quite frankly, people have perceived the economy. Hes gotten the benefit up until covid19 of a Strong Economy and so that still you know, theres still a little aspirational thinking here about, you know, he got us a Strong Economy, he can get it back, but i think now that you see that number drop to 1 the impact, the full Economic Impact of covid19, eight months in, has now settled with a lot of americans and between the president s hot rhetoric about the virus to begin with and his really lack of a plan besides just open up the economy is starting to resonate with people in a way thats hurting them. You know, evan, the chairman raises a good point. The fact that the president keeps talking about this National Plan that has not materialized, do you think that that is something that will no pun intended trump peoples view of his handling of the economy . The idea that theres no National Plan to deal with the coronavirus pandemic . Good to see you, jonathan. I agree with chairman steeles comments. Look, i think the American People understand now that the economy isnt going to get back up and running until we defeat this or at least control this coronavirus pandemic. And the American People understand that the president not only doesnt have a plan, but what he does with regard to the pandemic is reckless and making it worse and he just continues to do that, even after his own hospitalization. I think the American People are saying, my goodness, if this guy cant even conduct his own operations at the white house in a way thats going to protect himself and his staff and his supporters for whom he apparently has obviously no regard, then how is he going to come up with a plan even if he wants to to defeat or control the pandemic and get our economy up and running . I think people are just wise to it now and thats why youre seeing americans confidence on his ability to help the economy recover wane. Congresswoman edwards, we were just showing the video there from the south lawn yesterday and all those people there, i guess a few hundred people, estimates were 400 people, 2,000 invitations sent out it should be noted, but the one thing that i found very interesting was a president who loves to talk and who is known for hour plus, maybe even 90 minute plus rallies spoke for only 18 minutes. Are we supposed to make something of that . Well, i think its why it begs the question of when or whether the president had a negative coronavirus test and, i mean, it seems like a really simple question to both ask and answer, but we havent really gotten that answer from the white house and i think, you know, we have to question whether the president is suffering from fatigue and has an issue with stamina that he wouldnt go on for the, you know, sort of hours long type rallies that he used to. I was actually struck by just the shear number of people on the lawn without masks, not social distancing, it actually gave it made me like scratch my skin it was so disturbing, but i think that we really have to wonder about the president s health and the statements that were getting out of the white house and from his personal physician simply do not cut it for the American People. Congresswoman edwards, i want to ask you a question that i actually happened to look over at my twitter machine here and there is a question here from pauladecember 142 which is a good question, shes wondering what folks thoughts are on blexit. As i mentioned in the intro, it is this organization trying to woo africanamericans from the Democratic Party. How successful are republicans going to be in trying to woo africanamericans away from the Democratic Party with this president . Well, not very, and i think the indication of that is that if you have to pay people to show up at a rally and pay people to come in to the south lawn to jeopardize their own health, it doesnt mean that youre going to be able to get them because they are rallying toward you. I just dont think its going to be very effective. It may have looked good from the standpoint of a photo on that has a lot of brown faces in there, but, i mean, in this economy if you are unemployed or whatever, i mean, maybe you take somebodys money to go and stand on a mall, maybe put on a mask and cheer for the president. Not very successful. The shade is real. Dean, let me come to you. In terms of the polling, you know, for biden supporters its great that he is leading nationally by 12 points, but when you look at the state numbers, the state polling numbers, particularly in swing states, joe biden is leading, but its not by 12 points, its within single digits. From your perspective is that something that should worry democrats . I think they have to be aware of it, but, jonathan, youre overlooking the big endorsement donald trump got yesterday, the taliban enforced him. Im not even kidding. No, were going to be talking about that later in the show. I think they like the way that he emboldened our militias to threaten elected officials, thats right from the taliban playbook. Look, the reality is this is going to be a close election in key states. Anyone who wants to defeat donald trump cannot take this for granted. Polls show Hillary Clinton not leading by this much, lets put some perspective at this time four years ago, but with about a 6. 5 point need, right now joe biden has a 9. 5 point lead in the average of polls. Yes, in the spring state every vote matters. If you want to see donald trump defeated, if you want to see someone who has spewed everything like this week from, again, his white supremacist garbage about the suburbs undermining our election to lying about covid you have to come out and vote. I will disagree with chairman steele on one thing, trump has a plan on covid and the economy, its lie, deny and hope for a miracle. Its the same plan over and over and its not working. People have theres over 100,000 Small Businesses gone. Joe biden has a plan to create new jobs. Donald trumps plan is tweet about it. Thats not working. People see that. So the economic number to me a devastating to donald trump that hes not leading anymore on the economy. Alexei, the president clearly itching to get out back out on the campaign trail, his 18minute speech from the truman balcony yesterday and then starting tomorrow hes going to sanford, florida, then on tuesday hes going to johnstown, pennsylvania, and then on wednesday hes going to des moines, iowa. Is this all part of an effort by the white house to keep a caged up president entertained . Well, we know that President Trump feels in his best form when he is in these rally settings. We saw the way his poll numbers tanked when he began giving those daily coronavirus briefings, clearly not a natural setting for him and something that the American People didnt respond well to in the way that his supporters respond very well to him in these rally settings. The other thing is that when he contracted the coronavirus it was very much looking like he was going to be off the campaign trail while joe biden and senator Kamala Harris and now their surrogates, bernie sanders, were storming the country taking on different battleground states not really limited in what they were doing because they were following the safety guidelines and working with state officials to make sure the travel that they were doing was safe. President trump loves being out there and were seeing how hes ready to get back out there at any cost. This rally was just a preview of how eager the president is to get back out there on the campaign trail. Jonathan, i think about the midterm elections, i was doing some reporting then about how President Trump and vp pence were doing this insane blitz, seven days before the midterm elections, they were going to one, two, sometimes three states in a day because they were worried about republicans chances in those. I think were going to see similar efforts from President Trump now and were going to see the way that he talks about the coronavirus continue in the same kind of flippant way and acting like its not something thats really consuming his life or that hes afraid of. What i found really interesting was that when he was sounding out those proof of life videos from walter reed, he called the virus what it is, the coronavirus, but there on the truman balcony yesterday i noticed the reemergence of his racist pejorative name for it. So, america, i have said it now for the last two months, yall got one charge right now and, baby, you need to do it because if you dont thats what youre sending back to the white house, a guy who wants to pretend about coronavirus while you mourn your loved ones and you care for those who are ill, and your businesses havent returned or you have not gotten your job back. Congresswoman, i am not going to play any of the sound from President Trumps rally in duluth late last month, we know what he said, we know what he says about you, the pejorative horrible things that he says about you, but what im wondering is what do your constituents think about the what the president of the United States says about you . My constituents are appalled and have continued to be appalled. I mean, they know that donald trump has a woman problem and i dont just mean that women are not wanting to vote for him as you just expressed in that latest poll, but he really does have fear of capable, smart and competent women. It is really sad to see, you know, someone who is supposed to set the pace as a leader on how we are supposed to Work Together as americans caring for one another, lead with compassion, with unity, divulge into someone who has really done everything that he can, not only to steer up hate and fear, but to also denigrate and save, you know, his most caustic attacks for women, whether it is calling hillary nasty or calling, you know, senator harris monster or saying all of the other things he has said about me. But what i do know is that we do have an opportunity for women in this country to stand up and send a clear message that this is not the kind of leader that we want for our country and to send a message to our daughters about what they deserve in a leadership. You know, he also has a problem not just with women, but particularly women of color, but i want to move on to Something Else because as a result of that rally in late september, september 30th, we now know that 19 people have come down with the coronavirus since that rally. Are you satisfied with the information thats coming out of the white house, particularly from the president s doctor, about the president s health . No. We still dont have a clear answer to, you know, when he actually tested positive for the coronavirus, we dont know if there was indications of him being possibly positive when he went to minnesota and other states in his as he held his cult rallies. We at the moment dont know if there has been a negative test for this president as he prepares to reassume his cult rallies that have now become super spreaders. I mean, you know, that saturday at the rose garden that event wasnt just outside, it was also indoors. It speaks to the level of incompetency, negligence and, you know, just the danger that he has created as hes damaged what it means to trust, you know, the information that is supposed to come from the white house. Congresswoman, we have seen the president visit minnesota many times as president and also as a candidate running for reelection. He and the Republican Party believe that while the president lost the state by the narrow west of margins in 2016 that he can actually put it into his column in 2020. You are a member of congress from minnesota. How likely do you think he could move minnesota into the republican column . Does he have a chance . I say tough luck. It is not going to happen in 2016 he came two days before the election and spoke of his hate for, you know, everything minnesota stands for, and we send a message by rejecting him and this time around we are going to send another clear message that donald trump isnt welcome in minnesota and minnesotans are greater than fear. The amount of enthusiasm that we are seeing in our state in regards to voter turnout is just amazing. Just in my district, which is why, you know, trump has chosen to attack me in our state is that the Democratic Power runs through minnesotas fifth Congressional District and in the last couple of weeks we have seen the number of ballots request be higher than 130,000. This time around in 2016 that number was not the same and we are seeing 1,000 increase in the amount of ballots that are being requested. So we know that he doesnt have a chance in minnesota and his campaign actually knows that hes pulled out of the ad market and he is no longer televising his hate on our tv. And we should also point out that no republican has won the state the great state of minnesota, i went to college there, Carlton College in north field hasnt won minnesota since 1972. That was home to the great walt stone. Yes, he was my professor. Yes. And, you know, minnesota is known for sending people who put prioritize people over profit and we know we do not vote for people like trump. Congresswoman, we have less than a minute left, but, you know, there are a lot of democrats and americans quite frankly who are worried about Election Night and what and what may happen in terms of election interference and chicanery on the part of the Republican Party. Are you as worried as Many Americans are, say, like the Mandy Patinkin and his wife kathryn grody, are you as concerned about Election Night as they are . We all are concerned. I share some of these concerns, but i also, you know, trust the institutions and i trust that we have enough people worried about Election Night security that we are going to put proper measures in place to make sure people are protected, people have the tools that they need and the resources that they need to safely cast their ballot and that our country does transition peacefully regardless of what trump and republicans have to say. I mean, its astonishing just how much disregard they have for the democracy we all cherish, how much disregard they have for the institutions we all love and want to improve upon and how much disregard they have for the will of the American People. I have never imagined in my entire life in the United States that we would be having a conversation about elections being unsafe, our democracy being threatened this way and have a president in the white house talk not accepting or stating that he will peacefully transition power. These are scary times, they are dangerous times, but we are not to lose hope and we are not to allow ourselves to despair. We are going to march on, cast our ballot and trust that there will be a morning after on election day without trump. And that is a great way to end this segment. Let me show this South Carolina senate poll where it has you up by one point, 48 to 47 against Lindsey Graham. And then lets show what the Cook Political Report did on wednesday which is seismic. South Carolina Senate moves to toss up. Jaime harrison, i wrote a column last month, i believe, that said that you were like a cheetah bearing down on an impala on the serengeti and that the impala was Lindsey Graham. No democrat should be anywhere close to an incumbent republican in the state of South Carolina. Why do you think you are not only within a point or a point ahead of Lindsey Graham and outraising him by multiples of millions of dollars . Well, jonathan, i think its because were talking to the hopes, the aspirations and the fears of the folks here in South Carolina. You know, Lindsey Graham was someone who i used to respect, who i thought when john mccain was alive could rise above the political fray and really represent the state of South Carolina, but what we have seen is that this guy is a political opportunist who only cares about his own political power in d. C. And doesnt care that 38 of Rural Communities in South Carolina dont have broadband. He doesnt care that four of our rural hospitals have closed here in the state. He doesnt care that just two years ago 14 of our 46 counties had no obgnys. What you are seeing with our fundraising, with the polls is that folks are waking up and saying we need a senator who is going to fight for us, not fight against us. Lindsey is learning a lesson. You never tell jimmy lou harrison and willie harrisons grandson that he cant do something. We are going to show Lindsey Graham on november 3rd that the seem of South Carolina are going to take their seat back. Jaime, youve i will give senator graham some credit in that hes not shying away from debates with you, but in the first debate you showed up with a plexiglas divider to keep to separate you two and then in the latest debate there was a kerfuffle that went down because senator graham would not take a covid test. Yeah, you know, jonathan, listen, lindsey took a covid test for the first debate because he said he was in a room with senator mike lee. Well, he was still within the 14day window. Every person this that studio took a test, i took a test as well. Its not you know, it doesnt hurt, jonathan, its less than two minutes sticking a cotton swab up your nose and getting the test results in 30 minutes. And i dont understand why mike pence can get a covid test before his debate with Kamala Harris, why senator cornyn can get one before his debate with m jhay gar but Lindsey Graham thinks hes too special to get a covid test. Every time he golfed with the president , guess what he got, a covid test. So why couldnt he do a covid test for this time around . Either there was something going on and he didnt want the results or he was just scared to get on the debate stage with me. You know, i was going to play some sound of you getting into it with senator graham, but i want to move on to Something Else that he said in your Candidates Forum because it became a forum because he wouldnt take the test. What he had to say about africanamericans in the state of South Carolina. Take a listen and i will ask you about it on the other side. You could be an africanamerican and go to the senate, i just have to share the values of our state. Its not about the color of your skin or where you came from, its about your ideas. I care about everybody, if you are a young africanamerican, an immigrant, you can go anywhere in this state, you just need to be conservative not liberal. Jaime, what . Well, jonathan, that just goes to show you how out of touch Lindsey Graham s this is a guy who said when you have a state where 750,000 people are unemployed that over our dead body will we allow an extension of the unemployment benefit. This is the same guy who in a debate with a younger guy who has Student Loans like most young people this this country will say, well, why dont you pay your Student Loans . He is out of touch. He is a relic of what i call the old south and im talking about closing the book on that and writing a brandnew book called a new south. One that is bold and inclusive and diverse. Where your senator represents all of the hurt people and not just a select group. I mean, senator graham is just out of touch and, you know, we need to send him back home so he can rest, he can retire, he can golf all that he wants, but he does not deserve to represent the great state of South Carolina in washington, d. C. So, jaime, i mean, you running in South Carolina and South Carolina is a red state, but youre not going to win this race unless you pull more than a few republicans over to your side. Youre campaigning in places in the state where probably democrats have not gone giving up on them. What are you hearing from republicans when you are out there campaigning . Well, we are winning over some of those republicans. Thats why we are neck and neck with Lindsey Graham in the polls right now. Thats why hes sweating, because he understands that there are some people right now who just dont like the direction that the state is going in, they dont like the direction the country is going in and they dont like Lindsey Graham who he has become. I always say there was a Lindsey Graham 1. 0 and now we see this Lindsey Graham 2. 0 and hes feckless, he doesnt stand up for the state, he is only concerned about his own political power. This is a man, jonathan, that hasnt done a town hall in person in this state in three years and that old adage that all politics are local is true and hes going to see on november 3rd that when you forget the people that you represent they wont forget you and theyre going to vote him out on november 3rd. Jaime, before i let you go, i wanted to get your reaction to something that senator graham said earlier this morning on fox news. Have a listen, i will ask you about it on the other side. We must win this election, keep the senate, because if they win theyre not going its not going to be about a health care debate, theyre going to structurally change the country, the parade of who are i believe so that come if we lose the house, senate and white house is unbelievable. This week five years after many of us presumed Marriage Equality to be settled law, justic justices thomas and alito saying that it left those with religious pins in the lurch. The victim of what many say was a hate crime in wyoming this morning has died. 21yearold Matthew Shepard was found beaten and uncon shechkoc last week, he was gay and while police say robbery was the primary motive, gay Rights Groups call it a hate crime. At the time of shep arrestar brutal murder, laws did not expect based on sexual orientation. After years, congress eventually sent the act to president obama who designed it into law in 2009. And joining me now are dennis and judy shepard parents of matthew and founders of Matthew Shepard foundation and alphonso david, president of the human rights campaign. And dennis and juddy, given the tenor and tone of the conversation that the country is engaged in particularly in this election campaign, how how concerned are you that the Supreme Court will take a hammer to the hardfought rights that lgbtq rights that americans have fought so hard to obtain . Well, certainly a fear and i think it is justified based on the senates hypocrisy. We should let the people decide i think on the replacement seat. But if we have a court that is so set on not helping marginalized communities achieve equality, i think were all in trouble. Dennis, let me pull you into this. Again, tomorrow is the 22nd anniversary, the country has changed a lot when it comes to its views of lgbtq americans. The laws and the rights that have been won by the community. But how concerned are you that all the hard work that the Matthew Shepard foundation has been working on is potentially on the cusp of being eroded . Well, one thing you have to remember is number one we have the law. We also have precedence set. These people the Lgbtq Community has been living out in the public eye for years now. And people are starting to realize that they are just ordinary boring people too, just like the straight community. And that is the important thing. They are hardworking citizens, they have families, they just want to have a career and they love their country. There is no difference. That is why i cant understand what the problem is. This country is a democracy, it is not a theocracy. And trying to bring Something Like that on other aspects of the country just confuses me. And there are polls that the country largely is in equality for the gay community, so listen to the voters. Do what they want to do, not what your previous thoughts were. It is a new world. So get with the program. So jude decidjudy, if you ha opportunity to talk to judge Amy Coney Barrett, what would you it he will her . Well, parent to parent, mom to mom,it he will her . Well, parent to parent, mom to mom, if your child comes out as gay, i hope you understand that that is who they are, it is not their choice, nothing you did, it is just who they are. People are people. And i would hate to think that you would reject one of your children because they happen to be gay. Were all humans trying to fight for the same things which is acceptance and a good life and safety in our workplace and in our homes and i hope that she would recognize that as a human being. Alphonso david, president of the human rights campaign, you penned an oped for the Washington Post talking about the danger posed to the Lgbtq Community by the Supreme Court. Talk more about it. More specifically, about what is at stake with the Supreme Court. Well, thank you, jonathan. The Lgbtq Community is in a state of crisis. And this election could be the turning point. We have hit the highest numbering of antitransgender deaths from violence in any other year since we tracked it. Justice thomas and alito as you mentioned have declared an open war on major equality. And we have lgbtq people are dying and suffering significantly Economic Impacts. One out of five lgbtq people live in poverty. So what does a Amy Coney Barrett confirmation mean . Our relationships are threatened kt , our access to Government Services are threatened, access to Services Provided to any other member of the public are threatened. In short, appointment of Amy Coney Barrett simply means that we become second class citizens. Marriages become skim milk marriages. Were denied the ability to be foster and adoptive parents, were denied services that anyone else can get in the public square. This is a significant concern for members of the Lgbtq Community. We know there are 57 million voters in this country. The majority of people, equally vo equality voters i should say. Majority are saying the next justice should be selected by the next president instead of heeding those words, the Senate Majority and President Trump are trying to jam through this nomination. And it will have significant collateral consequences on the lives of lgbtq people and marginalized communities. And one of those collateral problems is something that was pointed out in another Washington Post story here where it says the court is set to hear oral arguments in a case that could significantly scale back lgbtq rights on november 4th, the day after the election. In bolten v philadelphia, private agencies that receive funding such as foster care agencies and homeless shelters could be given a constitutional right to deny services not just to people who are lgbtq but even to religious groups such as jews, muslims or mormons. So this gets to what you were just talking about, doesnt it, alphonso. Absolutely. And for context, more than 40 of children who are homeless are lgbtq. And those children go through in many cases through the foster care system. Now, if you are Foster Care Agency or Adoption Agency and you do business with the government, you are receiving monies from the government in order to provide these services, what these is agencies are attempting do is effectively say were going to deny same sex couples the right to be foster parents, deny religious minorities the ability to be foster parents, deny single women because they believe that it is inconsistent with the tenants of their faith. We have religious liberties in this country, but what they are try to do is create exemptions to supersede individual rights. We should all have the rights to exercise our fundamental rights and they should not be subjected to additional religious exemptions. The First Amendment has existed for deaidnd i had dec decade, b amendment and this is important. Dennis and judy, given what is happening in the country right now and the work of the foundation, im wondering what you are hearing from the Lgbtq Community about what is going on. How concerned or afraid are the people you work with and talk to . I think everybody is afraid. The rise in hate crimes ansd s lack of interest by the doj scares us all. We are in a very different time now and things are working against us rather than for us as they did in the obama biden administration. So just regular lgbtq folks and folks working as advocates, were all nervous about what will happen. Which is why everybody is saying that yall got to get out and vote. And dennis, ill give you and i emphasize all the time, we have two, one straight and one gay. One has all the rights 6 ghts o american, but the gay side wouldnt have the same rights. Why . They both the pay taxes ansd want to serve their mother country. So tell me what the difference is between the two. And that is an excellent question to leave this part of the conversation. Same here, thanks for having me on. So this whole segment is talking about what is happening with the Supreme Court and the nomination of judge Amy Coney Barrett. Since ive got you, tell me your screws abo views this nomination and this particular nominee. Of course like most americans, i believe that the winner of this president ial election ought to make the decision about who fills the seat. And were not talking about an election day coming up. Were talking about an election underway. Millions of americans have already voted. And those votes ought to be part of the Decision Making process here. So there is a process question, but more importantly, there is a substance question. There is a question about our rights. You know, the bottom line is my family, my marriage, this household that i live in legally exists by the grace of a single vote on the u. S. Supreme court. And i think about what it would have been like if that single vote had been a Justice Barrett instead of a justice ginsburg. I literally might not be a married man right now. So this is not some about academic concern or some arcane question. This is about our lives in a very immediate sense. And this is nothing personal about the appointee. This is about the philosophy, the ideology that is driving these appointments driven by a far right that is out of step with the American People on issue after issue, whether it is lgbtq rights and Marriage Equality or whether it is health care, which is also very much on the line right now as this decision, this aca case approaches the Supreme Court. Perhaps Voting Rights and other questions. The decisions that they make in that building, they come down into our most intimate dimensions of life. And that is what is at stake for me right now. It is not about her, it is about the decisions that will be made. As you say, it is about our lives. I was reminded of the tweet that your husband sent out where the tweet says staring at this wedding ring thinking of what company tuesday means to our lives, our families, our marriages, our rights. I need you to vote. We all need you to vote. Mayor pete i still call you mayor pete even though you are no longer mayor of south bend, indiana. As i noted at the start in the introduction of this segment, today is National Coming out day. As an openly gay man, ownly gay married man, for those folks who are lgbt and especially q who might be watching, what would you tell them if they are struggling with coming out and how to do it . Most poornimportant thing i them to hear is im rooting for you. I know that this can be incredibly challenging. And for different people in different ways. Some people have the sense of who they are and the readiness and the willingness to come out when they are teenagers. I was a grown man, mayor of a city, in a position of responsibility. I owned a house and i found it extremely challenging to come out in my 30s. Some people are seniors and know that they are at a moment in their lives when it is just time. You are ready when youre ready. And i cant promise that it will always be easy, but i can promise that there is an Extraordinary Community of people who care about you and who support you as you are making going through this process. And when you are ready, you know, i will be one who will be there to welcome you and to urge you to stand up and be proud. And the other thing that i think is important for people to think about, because you are often understandably wrapped up in your own fears and concerns, remember that when you make a decision to come out, to be who you are, to let others know who you are, someone you might not even realize might be looking to you, might be looking up to you, and might know that they have a better chance of acceptance from seeing you live into who you really are. Mayor pete, so moving what you have to say to people who might be struggling with whether and how to come out. As you were speaking, i was handed this, just in, Amy Coney Barretts Opening Statement tomorrow has been released. And i want to read to you one part of that statement where she writes, when i write an opinion resolving a case, i read every word from the perspective of the losing party. I ask myself how would i view the decision if one of my children was the party i was ruling against. Even though i would not like the result, would i understand that the decision was fairly reasoned and grounded in the law . Mayor pete, what do you make of that . Fairly reasoned and grounded in the law. Well, you know, two of her wouldbe colleagues Justice Alito and Justice Thomas wrote a memo last week essentially putting Marriage Equality back on the table in their minds. So she really wants to understand the party she might rule against, i guess i would invite her to follow that process and put herself in the shoes of somebody who was married and then was effectively forcibly divorced by judicial fiat, told that they were no longer married to their spouse, told that their family was no longer a family because of the ideological commitments of people wearing black robes on that bench. Would we think of that as fairly reasoned . Maybe she would. I dont think that i would. And i guess i would just hold her to that if she is going to be a part of the majority stripping away a right to choose, a right to vote, a right to get health care, and maybe even a right to be mayrried fro people whose wellbeing and whose lives depend on her interpretation of judicial philosophy. And i want to read one more section from her Opening Statement. And in this she says courts have a vital responsibility to enforce the rule of law, which is critical to a free society. But courts not designed to solve every problem or right every wrong in our public life. The policy decisions and value judgments of government must be made by the elected by and accountable to the people. The public should not expect courts to do so and courts should not try. Just reading that, mayor pete, that troubles me beyond words. Your reaction. Yeah, i mean, look, this is what nominees do. They write the most seemingly unobjectionable dry stuff. But what i see in there is a pathway to judicial activism cloaked in judicial humility. At the end of the day, rights in this country have been expanded because courts have understood what the true meaning of the letter of the law and spirit of the constitution is. And that is not about time traveling yourself back to the 18th century. And subjecting yourself to the same prejudices and limitations as the people who write these words. The constitution is a living document because the english language is a living language. And you need to have some readiness to understand that in order to serve on the court in a way that is actually going to make life better. It was actually Thomas Jefferson himself who said that we might as well ask a man to still wear the coat which fitted him when he was a boy as expect future generations to live under what he called the regime of their barberist ancestors. So even the founders that they claim fidelity to understood id descendants the importance of keeping with the times and we deserve judges and justices who understand that. And i cant let you go without talking about your book, trust. Why did you feel that it was important to get this out now . I thought it was important for this book to start some conversations before election day because we really are in a trust emergency in the United States. We have a threefold crisis of trust. Trust among the people in our institutions and our government, trust among American People in one another, and trust around the world in america itself. All of these can be measured and all of these have plummeted. And the problem is that the crises and challenges that will d decide how the rest of the century goes for us cant be solved without a high gldegree cooperation. We dont live through this pandemic without cooperation. Sigh tecience can develop a vac but we have to have enough trust in the process to get it. And by the way id be the first in line to get a safe and effective vaccine for covid19. And what is true for the pandemic is also true for things like Climate Change and even just coming together to invest in better infrastructure and education and health and the things that well need as a country. The challenges require cooperation. Cooperation requires trust. And so we have for billed uild sour sources of trust so people dont wonder whether their voice will even be heard. This white house is for sale and donald trump, if you want a deal from him, he will give you the benefit of things the federal government can do for you many times. Not every time, not everybody will get what they want, but you will first pay him tribute, jonathan, and donald trump signaled that to the influence peddlers on the day of his inauguration when he stopped his motorcade going from the capitol where he was sworn into the white house and where did he stop . David, let me read Something Else from the New York Times about President Trump and the wind falls. It is par for the course, and it is a little bold that there may be a tax crime here, but this appears to be a very clear violation of the federal election laws. That would, a felony criminal violation of that law to slip money into the campaign. And it further reinforces in my mind that we need significant strengthening not only of the Auditing Authority of the irs which has been defunded, weve defunded the tax police, but we also need to strengthen our federal election laws and we need to have serious investigations of action. Right now of course nothing can be done because we dont have a majority because trump hasnt appointed people to the federal Election Commission to create a quorum. David, there is something you said in your first answer to me that is sticking in my head. And that is in reading the New York Times latest bombshell, that you correct me if im wrong, you can see that they actually do have the president s tax returns given the details that they are reporting. Given what you know about the president and his tax returns, is there a shoe to drop that you are waiting to drop that only you can see and are hoping for that you can tell the rest of us to look out for . A little fine detail. What they have is tax informati information. They have the data on his tax returns, not the actual forms themselves. Immaterial, but a distinction. And clearly they have a number of supporting documents schedules and records and they have been linking them up to other public records. The most important thing which would require an audit and two things, i guess, how much money he was getting from russians. And he did get 2. 5 million in round numbers from the moscow beau beauty pageant suggesting that it was really a payoff to donald trump. And the second is what is behind the loans with ditdeutsche bank. With they backed up with russian criminals making deposits. You wouldnt find that in a tax return, but you would find it in the Accounting Records trump has been fighting so hard to keep from the prosecutors and the grachbd jury grand jury in manhattan. People want to know how is it that the president could get coronavirus covid19 and if the president , one of the most protected people in the world, the person with access to the best doctors who is being tested or so they have said frequently and people who come in close contact with him are tested frequently, if he could get coronavirus, how can he protect us from getting coronavirus. The question is merited because we have people who are high level members of this who have contracted coronavirus from the white house. This president is a strong man. He is as much of an autocrat as weve ever seen in the world and in the history of the world. And i think that he is dangerous and we should all be very careful about thinking that he is not going to call out Law Enforcement, that he isnt going to declare victory on november 3rd instead of letting all of the ballots be counted. And i would urge americans to be patient to engage in peace and to ensure that every single vote is counted as it has been cast under state law. This president is a danger and we should know that. Congresswoman edwards, earlier in the show congresswoman ilhan omar said that she believed she trusts that our institutions will hold. Youre a former member of congress. From your vantage point, come you share the same trust . I do share that. I believe in our institutions and i think that the American People do as well. And they are not going to be frightened out of an election by the president of the United States.
