The president of the United States has unleashed his trusted attorney general against career Law Enforcement and intelligence trump sees as his enemies. Last night attorney general william barr has been given free reign to investigate the Law Enforcement officials and intelligence officials who began the russia investigation and to unilaterally declassify intelligence helpful to trump that he might find. We know the president championed the narrative that the investigation into his campaigns intersections with russia was illegitimate from the jump. I hope they look at the oranges, the oranges of the investigation. The beginnings of that investigation. You look at the origin of the investigation, where it started, how it started, who started it, whether itmccabe or comey or a lot of them. The Mueller Report i wish covered the oranges, how it started. The beginnings of the investigation. How it started. Barr can squeeze that orange. Trump has every reason to believe barr will use his powers to aid the president s antideep sta propaganda efforts. He told confidants he had my attorney general. Barr has been criticized from across the spectrum as a lackey in a position of independent powers and trump giving barr unilateral authority over classification is just a huge deal in the world of intelligence agencies. Barr will be able to override other agencies independent classifications or determinations and the goal seems clear. Its basically to give sean hannity material for his television show. Selective declassification has already been used here by congressman devin nunes when he was chairman of the house intelligence committee. You may remember the antitrump bias and the russia investigation, or maybe you dont. There wasnt much to it in the end. How the selective release of information can work is none other than bill barrs piece meal. He quoted part one of a sentence making it seem Trumps Campaign had nothing to do with russia. Weeks later we saw the complete sentence. It became clear this couldnt have been further from the truth. All of this comes in the context of the president claiming that the guy who used to run the fbi is guilty of treason, a crime punishable by death. The constitution said treason is punishable by death. You accused your adversaries of treason. Who specifically are you accusing . A number of people. If you look, they have unsuccessfully tried to take down the wrong person. If you look at comey, if you look at mccabe and probably people higher than that. If you look at strzok. They wanted an insurance policy that should she lose, 100 million to 1. Maybe he said 100 million to nothing. But should she lose, well have an insurance policy and get this guy out of office. Thats what they said and thats what they meant. Thats treason. Just to be clear, one of our own reporters raised that treason carries the Death Penalty and someone can be computed and killed for that crime. When asked specifically who hes talking about, he just names a bunch of people, including the former fbi director. The plan is essentially a kind of purge of the ideologically suspect members of the intelligence apparatus. Thats a sentence uttered in any other context would be deeply terrifying and raise concerns about the rule of law. Joining me now, a man with a deep understanding about the importance of classification, john brennan who served under president obama. How big of a deal do you read the portion of the executive order last night that appears to give barr the unilateral authority to declassify . I see it as a very, very serious and outrageous move on the part of mr. Trump, trampling upon the statutory authorities of the director of National Intelligence and heads of the independent intelligence agencies. Its unclear to me what mr. Barr actually is going to do. Is he investigating a crime . Well, whats the predication of that crime . Or is he just looking for information . As you rightly pointed out at the top, mr. Trump can just give to some of his defenders on the right and cherry pick information that could be taken out of context. More fundamentally, the concern is that very, very precious and sensitive sources and methods of the United StatesIntelligence Community as well as our partners and allies abroad. Those who share this Sensitive Information with us is mr. Barr who doesnt have the understanding of the equities involved. Is he going to release information that he deems appropriate for mr. Trumps defense . This is very serious and know that my former colleagues in the intelligence agencies are looking upon this with great concern and worry. Its interesting you said that. Sometimes the president will issue an executive order that ends up being more of a messaging document than actually conferring power. You appear to see it the same way. I want to read the believe r director of National Dan Coats statement to get your reaction to it. Much like we have with other investigations and reviews, the Intelligence Community will provide all the appropriate information for review of activities related to russian interference in the president ial election. As part of that process, i am confident the attorney general will work with the Intelligence Community in accordance with long established standards to protect information publicly released would put our National Security at risk. What do you think of that statement . I have a lot of respect for dan coates. He is trying to protect the men and women of the Intelligence Community. He said they will provide the appropriate information. I think thats critically important. What is that appropriate information . What is the basis for those requests . I hope they stand up to this effort by mr. Trump that does seem to go into the sensitive files, the very sensitive technical or human source files and to pull out of that information that they may see fit as to defend mr. Trump. I implore dan coats and gina haspel to stand up to this unprecedented act on the part of mr. Trump who doesnt understand nor care about the National Security concerns of the Intelligence Community. I want to read you a section from the column in the New York Times about you and your russian intelligence and ask if this is an area of concern for you. This is about john brennan, yourselves, who would bring reports about a source in the russian government to the white house, keeping that on the president s Daily Briefing for fear the document was too widely disseminated. Instead he would place them in an envelope for mr. Obama a tiny circle to read that provided intelligence before leaving office and mr. Putin himself was behind the russian hack. Are you worried about the exposure of sources that are giving us intel on russia . Im not going to get into the specifics as you can imagine, but i am deeply, deeply concerned about what is going on right now and how mr. Trump is authorizing what appears to be his personal attorney to pursue these efforts in the intelligence agencies and to uncover and potentially release this information that could, in fact, put peoples lives in great jeopardy as well as put very sensitive and very exquisite u. S. Intelligence capabilities at risk. This is something i think the committees and the Senate Intelligence and house intelligence committees really need to exert their appropriate authorities and to stop any reckless and irresponsible release of information that could harm this country for years to come. What do you say to folks that say the Intelligence Community is capable of wielding classification and secrecy like a sword to protect its turf and keep committees of oversight away from them, to fight intramural battles for supremacy within the government and maybe its good to give someone the power to get in there and override that. Well, the women and men of the intelligence communities do their utmost to keep their fellow citizens safe and secure, and they do their utmost to keep the capabilities whether they be technical or whether they be human sources safe from harm. So to say that someone else should come in and just release things almost willynilly, i think, is a reckless, reckless initiative. I do believe the intelligence committees in the congress are the appropriate ones to make sure the Intelligence Community is carrying out its responsibilities in accordance with the law as opposed to someone with a political agenda. Final question for you about the effect of all of this. Here youve got folks who started a very secret counterintelligence investigation that had it leaked would have been explosive politically and did not leak. They get it completely secret during that period of time. What will it do to folks who work in counterintelligence in the back of their head that if they pursue them, they may find themselves on the wrong end of an internal investigation . I hope they stay strong. The attempt here is to try to intimidate those who might go against mr. Trump and the members of his administration. Its critically important that the counterintelligence professionals continue o carry out their responsibilities and resist these unwarranted and very, very irresponsible efforts to undermine what they are doing. Also i am concerned about those human sources around the globe who put their lives at risk for this country. They are watching the spectacle in washington right now and watching mr. Trump expose all of this information to try to keep him safe from the appropriate investigations that are under way. I really am concerned that this is going to harm our National Security in a manner that we have not seen before. John brennan, thank you very much for sharing your time and expertise. Brennan is a cool tempered individual, generally. He seems not to be faking his concern here. Right. Look, part of the problem is that william barr, who until he was appointed as attorney general under this president had a sterling reputation and people believed he was acting in good faith. Hes now really called that into question. He seems much more willing to do the bidding of trump and to serve trumps political interests rather than sort of the detached position of upholding the rule of law. And so its reasonable to doubt that he will perform a fair evaluation of whatever evidence hes looking at, that he might cherry pick and release things that will be helpful to the president s case. Michael, youve been around washington and classification battles happen all the time between government. But giving someone i mean, this is the sort of thing, a slug fest between agencies about what can be classified and what cant. Giving someone the authority is an enormous deal, right . It is a huge deal. This is sack sanctity to the executive. He doesnt dish it out to other members of the administration to go off into the Wild Blue Yonder and decide we will now declassify. There is a concern and quiet rumblings on the hill about what this potentially means going into the rest of the year and the fullthroated aspects of the president ial campaign where youve got the attorney general now surreptitiously and sometimes not so surreptitiously putting information out on the street that may be beneficial to the president s overall narrative about no collusion, et cetera, etc. When you stop and think about it, chris, this could be worse than hacking our government by the russians. The president through his operatives are willynilly putting it out on the street. Thats a big concern right now. I just dont see any incentive for the people that participated in this in 2016. Either the Trump Administration and the Campaign Going like this to the russians and the russians mucking around, it doesnt seem a lot of distance for either party at this point. Disincentive to do what . To do it again. You know what i mean . It doesnt seem to have dawned on many republicans who now suddenly having been strong opponents of the russian state and before that the soviet state, they have thrown all that aside to dismiss any concerns of meddling for trumps sake. The next time the russians interfere, it could be for the democrats. You can imagine a world where putin gets mad at trump and leaks some new email that hasnt come out before. Exactly. What will the republicans say then . Will they say no collusion . Right. Michael . I was going to say, the narrative that is beginning to develop here in washington is the position that china potentially could be taking in this election. Visavis the democrats because they do not like the president s tariff policy. The democrats tend to be more user friendly with their perspective on that front. We are opening ourselves up to have our government and our elections managed by these foreign enemies. Chris, do you know whats staggering is that this is the response of the Trump Administration to the release of a report they claim is a total vindication and exoneration. Right . So theyre going around shooting the survivors. Thats exactly right. Doesnt look like they mean it. Right. When he says its personal, they went for the wrong person. They came for the wrong person. Its about extracting revenge and giving sean hannity programming. Its actually very serious. Donald trump, three of his children, and the Trump Organization are now appealing that wednesday decision. But since the judge already said in the decision that trumps claims, quote, are not sufficiently serious as it relates to Supreme Court precedent, the president s odds may not be great. We also know that at least two banks, wells fargo and td bank have already handed over trumprelated financial documents to congress. Here with me now, democratic congresswoman Maxine Waters of california, chair of the Financial Service committee which subpoenaed those financial documents. As the chair, i have not had an opportunity to talk to you about your reaction to federal courts ruling in favor of the subpoena Going Forward on wednesday. Well, i am very pleased that judge ramos ruled against the preliminary that trump was trying to keep the from hearing Deutsche Bank. They did not want Deutsche Bank to release the documents, im sorry. Im so pleased about all of this. Im really in a state of shock about it. But they tried to keep Deutsche Bank from giving up the documents that we subpoenaed. And so the judge said, no, he did not agree with them. Now, the judge didnt rule on the merits of the case. And so now that trump has appealed, and i understand he filed an appeal as of today, then were going to have to deal with that appeal. And so the judge will rule on the merits of the case later on after the briefs have been done. Were hoping in july there will be oral arrangements we were we will win on that. Do you view this as an attempt to run out the clock . There is a concern that the process has been slowed in the courts and even if you are winning in the courts, the administration is able to hold things out and run out the clock for a long period of time. Yes. As a matter of fact he has a reputation for running out the court. It is sad that during the time he has been involved with all of these cases that have been filed against him over the years by contractors and others he cheated that he did not want to pay, he would outlast them in court. I think he is trying to use the same tactics and trying to get up to the Supreme Court. The documents that have been subpoenaed, can you describe them . They have to do with the businesses. What is the project that you are looking for . What is the goal here and what are the categories of documents youre seeking . Were absolutely concerned about Money Laundering and concerned about illicit funds and the loans that hes gotten from Deutsche Bank. No other bank would lend him money and he sued deutsch bank at one point. But somehow Deutsche Bank has been lending him and his family huge sums of money, and at the time of his election he owed them about 300 million. So we want to understand that relationship, we want to understand his relationship to russia. We want to understand his finance and financing. You have been very early in your call for impeachment. Its been a question that has hung over the caucus. Nancy pelosi oppose it at the moment. I want to ask you about an argument that they made. Since your committees are winning in the courts, theres no reason to move forward on an impeachment inquiry and you should let the Court Process play out. No, i think we can do both. Ive been for impeachment for a long time, and a growing number of members of congress are thinking we should have impeachment inquiry at least. But i think that we have a responsibility in our committee, its a constitutional responsibility for oversight and investigation. We should proceed with the courts and let information unfold. If wedge to a decision, that somehow we know enough, theres new information that the dots have been connected in ways we did not think they would be connected, then we can move with impeachment if wed like. So we have options here and i think we should move down both paths. Final question about the banks that have complied with your subpoenas. Were they just not targets of lawsuits . Have they been useful to you . Has your staff had time to review it . No, we have not reviewed all of the information, but we have reason to believe that there is information of interest to us. I wonder if you agree with michelle that he has created a situation in which if you go and testify, you will become enemy number one for the president and propaganda apparatus. District court said congress not only has the power to investigate the president s conduct while in office, but before office. And this is exactly whats supposed to happen. Article one and article two have a fight and article three is the referee. Right now theyre siding with article one. My response to that and thats true, article one needs to assert its powers. They have the power of the purse. You can initiative showdowns and an impeachment inquiry. I dont know if that matters. But theres the brute playground politics of force against force. The white house today notified congress it would be invoking a rarely used emergency power provided under arms control laws in order to sell weapons to saudi arabia, United Arab Emirates and jordan without congressional approval. An emergency power to sell 8 billion worth of weapons in the case of the saudis so the saudis can ostensibly use those arms to bomb yemen in a war that so far has cost tens of thousands of lives and resulted in the worst cholera outbreak in modern times. To be clear, the humanitarian crisis in yemen is so ghastly and shocking to the conscience that both houses of congress with huge bipartisan majorities voted for the first ever invocation of the war powers resolution to stop the saudiled war in yemen. The president vetoed that. Congress would never have approved this arms sale to Mohammed Bin Salman whose men hacked a u. S. Columnist to death last october. So the administration took the extraordinary step of draeclari an emergency with the intent to evade the law. Why is it an emergency that we need to sell arms to saudis . Its not. Its just like the fake border emergency, a transparently cynical attempt to evade the constitutions checks and balances. I am, when you have a hawk like Lindsey Graham saying this is a morally bankrupt policy and has no constitutional basis, you can see how inept the policy is. I mean, basically they are defying the senate and the house, which voted against any aid to the saudis for bombing yemenese civilians and theyll be providing the saudis with bombs to kill women and civilians in yemen and frankly for use by al qaeda again our own troops in yemen. Its clearly unconstitutional and hopefully even republicans will oppose it. Whats remarkable is the bipartisan opposition in congress to the yemen war and increasingly the saudis, marco rubio, Lindsey Graham, and others, to think that Mohammed Bin Salman sent his goons to murder a Washington Post journalist, did change the representation government gets on capitol hill. And this white house is beholden to the saudis, theyre willing to take this step to sell some weapons. Chris, youre absolutely right. So the administrations total alliance with the saudis, where theyve been willing to sell nuclear energy, theyre basically goading the saudis into a war with iran and think that theyre an ally of ours, is a policy that is opposed by bipartisan majorities on capitol hill. And one has to ask what is the link, why is the president and the administration so embedded with the saudis . The congress, michael mccaul, who is the lead republican on the House Foreign Affairs committee, says, i would have strongly preferred for the administration to utilize the long established and codified arms sale review process that requires the president to submit a formal notification to congress. Mike pompeo saying hes determined that an emergency exists which requires the proposed sale. In the National Security interests of the United States and thus waives security requirements. Is there an emergency . Is this entirely a fiction . It is a total fiction. Look, chris, you know, because youre one of the few journalists who has been covering yemen, the saudis have been involved in a proxy war in yemen for the past three or four years, and nothing has changed on the ground. There is no greater threat to anyone in yemen, to anyone in saudi arabia. So it is total fiction. Its totally made up for the president to invoke this. It has no basis. Congress needs to do two things. We need to make it clear that we wont fund it, we wont fund any of these arms going to the saudis, and we can cut off the funding. And second, we need to pass in our committees that this is unauthorized, and then it would go to the courts. Even this court, as conservative as it is, has to recognize that you cant have an executive branch totally defying the will of congress in matters of war and peace. It does seem to me the power of the purse becomes more urgent by the day, if this president is going to be checked. Speaking of which, an announcement that 1,500 new u. S. Service members will be deployed to the middle east. Your thoughts on that . Its scary, the administrations argument is that our troops in the middle east are under threat. So you would think that the last thing we would want to do is send more troops to put them in harms way. The president s own National Security strategy says our big competitor is china, hes fighting a trade war with china. China is 15 of global gdp. Were 24 . Iran is 0. 55 of gdp. The idea that we want to get into a war with iran is ludicrous. Thats why you see china and other powers having nothing to do with getting entangled in the middle east. I have a broader question for you here. This announcement today is part of a longer chain, the president declared an emergency to try to build his war at the border. Hes now declared an emergency to avoid in both case bipartisan congressional rebukes, trying to get around them. Hes defying subpoenas, defying statutory requests for tax returns. How do you rein this president in . I think we have to go to the hope. My hope is Justice Roberts, Justice Roberts clerked for judge friendly, one of the great jurists of the 20th century. I think he understands that the courts credibility is at stake, and the case law is so overwhelming, the president doesnt have the ability to use the military to enforce domestic law in the case of the border. The president doesnt have an ability on matters of war and peace. And i hope the Supreme Court will vindicate us.
