Some very basic questions remain, including what is it . What is in it . Who gets to see it . The only thing the guidelines say is mueller should submit a report to the attorney general. And then its the diskregsz to the picked attorney general what, if anything, he shares with congress. He did not make any commitments about what he would make public. Today the president seemed rather confident in the man he just installed in the job, the guy who auditioned with a long mem eo mem about how the president cant commit a crime if hesfer has executive power. That will be totally up to the new attorney general. Hes a tremendous man, a tremendous person who respects this country and the Justice Department. So that will be totally up to him. The new attorney general, yes. I guess from what i understand, that will be totally up to the new attorney general. Joining me as part of our team and National Security reporter, ken delaney. What does wrapping up mean and what are the detail of how this gets to the new attorney general . Although you read interesting tea leaves in the report. Offici been telling us for weeks that the Mueller Investigation is wrapping up and that they expected a report as early as midfebruary. And its a report in reaction to the independent counsel law and announced Public Solutions report. But practically broke the internet back then. This is a confidential report that will go to the attorney general. The rules call for a report from the attorney general. To congress. You and i both know theres a huge public demand to know what Robert Mueller has found. They know they have to in some form, whether its a news conference, a report, a summary, more than to explain what Robert Mueller found and particularly because the regulations really say that mueller has to explain why he decided not to prosecutor. But in the case of the president who cant be indicted under Justice Department policy, its possible mueller has found what would be crimes but he cant indhiet president so hes got to explain what they are. He could accuse him of impeachable offenses. Obstruction of justice. There are signs that it may have been the last indictment. Theyre waiting for a big conspiracy case. Jared kushner and other people around the president. Theres no signs that is imminent. It does seem to me insane from the standpoint of an open democracy and Self Governance for the document not to make its way to the public. Given the interest and what were talking about. I guess the question is does congress have it within its power to shake the document loose . I would say yes, but theres going to be a fight over it. As you know there are secrecy rules about grand jury material. And mueller has a lot of documents and testimony from the grand jury. But theres a precedent. There was a grand jury report in watergate. Leon had the investigation and the judge wrote an opinion where he said look, i know its secret but its pertinent and so im going to send it over. So i think were going to see the same arguments made by the House Democrats in particular. They will negotiate redactions if they have to but they want to see the full document. Andrew mccabe served as a senior fbi official and he over saw the formal opening of investigations into the president himself. And now his new book the threat how the fbi protects america in the age of trump. Andrew mccabe, welcome to all in. Its good to have you on. First, lets start with your reaction to the Mueller Report is wrapping up. As someone intimately involved in the beginnings, who knows the building and the fbi well, how do you conceive of or mentally model what this document is what and its function is . First i want to say make it clear i am not in the prediction business. Although i heardcons report on how solid i think the reporting is, i think we need to wait and see when that shows up. But i am conend if fdant that mueller and his team will deliver to the attorney general will be thorough, objective and will include the results of all the work that theyve done. What is it like to navigate i mean this is something you have first person experience with at a particularly chaotic moment in the bureau and Justice Departments history, but are you confident this has been done without political pressure and that the pressure we know the president has applied, because hes applied it in public has not tainted the investigation . Yeah, so has it been done without political pressure . I think the answer is clearly no. Weve seen the president and his supporters try pressure this investigation from many Different Directions over the last year and a half. However, i am absolutely confident in director mueller and the team hes put together, that they have charged forward and done their work regardless of the pressure or the interest or Media Coverage or the table about what theyre doing. And i think results they delivered today speak for themselves. Why do you have trust in mueller . Chris, i worked for director mueller for about 12 years. I learned a lot about how the fbi conducts major sensitive complex investigations from working on cases that we interacted very closely with director mueller on. Im familiar with not just his integrity and honesty and independence that he brungs but with the grannialer way that he approaches his task. Director mueller is a guy who is most happy when his hands are deeply emeshed in a complex investigation. He is a true investigator. He likes to know elethe facts. All the people. He likes to talk directly to investigators on a daily boss toorbs participate in those conversations about strategy, direction, about plans for the investigation. So from my own experiences with him, through the course of many investigations over the years, im quite confident he brought the same approach to this task. Do you think that report should be made public . I think the report should first of course be shared with congress and then i think it should be made public as broadly as can. Part of may be sensitive, theres all types of other concerns around releasing information of this kind. Particularly if theres something to not charge 1 someone. Theyre well positioned to come up with a summary for a sdauk document or a version that can be share would the public. I think back to the Intelligence Community assessment, come is a document we prepared to put together all the intelligence l the indicators, multiple agencies about russian interference in the 2016 election. That document in its original form was one of the most highly classified, compartmentalized documents ive ever seen. And we were still able, that end of the day, to take that document and destill it down into an unclassified version we were able to share with the public that care that he had sum and substance very important conclusions we had drawn. So i see no reason why folks at d ooj couldnt do the same thing like with the Mueller Report. Part of what youre eluding and others have as well, its a strange situation. Youre talking about investigations with Robert Mueller and 99. 99 of those are with citizens or noncitizens that go through the normal course of the laws treatment. This is a spells individual, constitutionally. Who says cant be indicted. How do you think about what facts and what the bar is for an individual that is the most powerful person in the world and cant be indicted so theres not the same kind of bar of beyond a reasonable doubt you would if you were bringing a criminal case. Sure. This is an incredibly complex situation. So in the fbi we vea lexicon for what we refer to as sensitive investigative matters. Theres special class of investigations that are so sensitive for any number of reasons that they provide additional oversight in the bureau and across the street at the department of justice. You can only imagine this is maybe one of the most sensitive matters thats ever been havinged simply because of the involvement in the president and the people around him in his campaign. I dont know that this will be the case, but if the results of the report indicate that charge cannot be brought, thats a very easy end to an investigation. If youve determined youre going to pursue an indictment, thats what you do and we have processes in place so the public finds out whos been charged and what theyve been charged with, that sort of thing. Its a much trickier situation as we found out when youre not bringing charges. Whether thats because of doj policy or because you dont have the evidence you feel you need to go forward a charge. Just to talk about the two branchs, not having the evidence to go forward with a charge and a strong case for the fact that in a free society that the tools of Law Enforcement dont come out and say heres nasty stuff about this person that we couldnt charge. Its that other bucket which is the person happens to be the president. Thats absolutely right. Theres a very delicate and complicated, challenging balancing, i would imagine that goes on in the department and ultimately on the attorneygenerals desk to make that determination. A compelling interest to understand what the mueller team has come across in the time they have this investigation im sure those are all things the attorney general would consider. Im asking you, a man who worked at the fbi for decades and has some mental framework for how he thinks about cause and effect. Some mental framework. I think thats probably the own ly way i can describe it at this point. We were very confident that we had facts and inform in our possession that required we open a case and that thresh hold is having a factual basis to indicate that a federal crime may have been committed. In this case obstruction of justice or that a threat to National Security existed. It was our belief that we had indicators to believe that both factors might be present. What director mueller had added to that compendium of facts that complete understanding of whats going on, we can only guess. But we can pull at the tleds youve mentioned, the things weve all observed over the past year. The president s own conduct like in the clip you showed from his really inexplicable statements in helsinki. The things weesk rr learned about the president attending meetings with Vladimir Putin and insisting that no one else be present and trying to destroy the translators notes after the fact. I mean these are very concerning and curious behaviors that cause counterintelligence investigators to step back and ask themselves bhie. Why would a president act that way . Whats the answer . I dont know the answer to that, chris. Im not investigating it now. Do you think hes compromised . Its possible. That was our concern in may of 20. I havent seen anything since may of 2017 that would warn me off of that. Its one thing to immerse onesself unhow they can be unwhiting or witting. What is if he were compromised and youre saying thats an open question but you have concerns. What does that word mean in this contects . We talk people being compromised. But the relationships individuals develop with Intelligence Services are far more nuance than that. Theres a broad spectrums of relationships they develop. Sometimes its completely unwitting. If youre someone who just you have an occupation with access to classified material and you have the unfortunate habit of drinking and talking too mch, you may find you have a friend really interesting in all those stories from work. You could be an unintentional asset to a Foreign Intelligence Service too, the other end of the spectrum where people actually offer themselves to Foreign Service for the purpose of financial renumeration. Those are all the kinds of possibilities the counterintelligence investigators need discover. Are they acting with a Foreign Intelligence Service . Are they providing detroom to the United States . And theyre striking in so far as they kind of look like how he is on twitter and public. Theres not a huge difference in how you would imagine him being. When hes going off about the North Carolina victory and going off on the unsuccessful race. What are you thinking about the individual whos the president of the United States . You know, its hard to describe and i feel like over uses the term surprise and i couldnt believe. But thats what i was thinking in those moments. I entered the oval office for the first time in my life after finding out an hour or two hours earlier that jim comey had been fired. I was summoned by the president to meet with him that night and that is an impactful moment in the life of any government professional. You are standing in the office of the presidency of the United States. The decisions that have taken place within those walls, the people that have worked there, the contributions to our society, its hard to describe. It impacted mes a i stepped in. And very quickly, the president stepped up from behind the resolute desk, stuck his handout, shook my hand vigorously and talking about a mile a minute. Ive been in situations where they are talking for a really long time and sound kind of unhinged. Everyone has been in unpleasant conversations, people have been with their bosses saying ideas that are bad ideas and trying to figure out how theyre massage out of an conversation. He immediately launched to a conversation that wasnt a conversation. It was suggestion. It was a presentation of a narrative, of a version of facts that did not exist and what i came to realize is this is a narrative that the president was pulsing me to adopt. He wanted to see if i was willing to get on board with his version of these events. Claiming the fbi static about the fact that jim comey was fired and nobody liked jim comey in the firb. These were all things i knew not to be true. So from the very beginning a perilous end and really concerning interaction. I was trying to navigate that interaction. By telling the president the truth. But trying to do so in a way that didnt provoke an allout confrontation in the oval office. One that i thought would ultimately be a distraction to my ability to lead the fbi. So youve been a critic. Youve been a target of his allies in congress and in the media on trump tv. There was conspiracy of people inside the fbi. They sthiet fact that the ig found you lacked candor and that you were fired because of that to question your version of events and integrity. What do you snie basic idea theres people inside the fbi, you among them, who just dont like the guy . Didnt like the guy from the sglump and were animated by anmists in the actions you took throughout the campaign and up to him being president . It is just absolutely and completely false. I understand how that narrative made the president and his supporters find that narrative to be helpful in their quest to defend and protect the president. But the fact is that narrative is not true. Its not true as applied to me and its not true as applied to anyone that i work with in the fbi. Fbi people go to work every day. They put their personal lives aside. They put their personal believes aside and political believes aside and dhie their jobs. If you look back over the course of the decisions we made, the steps we took, each one of those was made for the right reasons. We make mistakes like any organization. But we honestly try to live up to the responsibilitiess that we have in a fair and unpolitical way. The fbi people are very, very weary about even the perception that politics might be influencing the work they do. So this narrative of persistent deep state about the get the president to overturn the results of the election is false. I would also ato you this is an argument ive made on air, that they could have leaked details about what was going on before he was elected. That is a great point. Stayed top secret i think mitigates against the idea you were out to get him. Its absolutely right and i would say having served for 21 years, the fbi is not a place known to be ea hot bed of kind of liberal leanings and antiare republican politics. No t is not. And i think a lot of people could say and for good reason that the decisions we made in the clinton case likely had the effect of helping the candidacy of donald trump. So when you put things together, this narrative there were people in the fbi aught to get the president makes no sense. We have breaking news on a disturbing case that has been cracked and theres a charging document. Someone plotting a terrorist attack essentially. Court filing in maryland has revealed the arrest of a man being held on weapons and gun charnels. A man who intended to carry out a major attack. Does it take it seriously enough . Thats a different question. As this threat continues and develops and becomes more intense, the fbi im sure is going through a process of constantly reevaluating how their intelligence collection and investigative resources are positioned against this threat but i can tell you it is one of the most concerning and closely watched threats that we have in the Counterterrorism Division at the fbi. Youre someone its hard to separate this from the way the president talks about the press, particularly. He talked this morning about enemy of the people. And i should be clear i dont think it meant the president s okay but theres an atmosphere where constantly talking about his political enemies in these loaded terms. What doyou thing that does country and people who might have dispositions . I worry greatly that rhetoric along those lines, like weve heard from the president that talks about press is the enemy of the people, that constantly villifies and undermines the work that our free press does and cannot have a beneficial impact on extremists and people prone to violence. And we expect more from the greatest count raeon earth. These are comments that concern me much in the same way the president s constant villification of people in Law Enforcement, Justice Department, intelligence agencies constantly ntd mining the work they do, it doesnt make the hard and dangerous and stressful work they do any easier, doesnt make it any easier to protect america. Youre somebody whos anonymous essentially a year ago. Nobody knew who mccabe was outside the senior levels of department of justice. Your face was not plaster anywhere and you became famous first as an enemy of the president. Fox news focusing its fire on you. What is the firstperson experience of that been like . Well, chris, and my heart goes out to you to see to listen to your report and understand your name was included on this list. Youre unfortunately having your own experience as i have, as my family has. These are very concerning times and to find out that you are discussed unthat way or even just thought about, talked about, maybe searched on the internet by one person is incredibly you know, its scary. Nobody wants to think that they might, boy virtue of the work that you due, the service you perform for government, or in the media can become the folkess of one violent persons intentions. I mean its scary. Is that something youve had to worry about . Its something ive been concerned with. I had security arrangements while i was serving in the fbi for obvious reasons. Its something that concerns me until this day. And i cant im not going to lie to you. When yub sit and listen on the president shout out lies and slanderous comments about me and my wife to rallies of thousands of people and to hear them are chanting back, i mean its chilling. What the Trump Administration is doing to america. Pretty chilling. Just as the bomber that you referenced in florida. It was pretty chilling. And thats not to say that president causes crazy people to be crazy. Its to say that his words have impact and they have particular impact on people who are mentally unbalanced or who have an inclination to violence. There is also a problem here that trump personally has lied over and over again trying to convince us that muslims from outside the United States are the greatest threat to americans. And in fact it is domestic terrorism. He has lied about this. He has lied about it to congress and its about time. I think we had oversight hearings from nadler and others in the house to explore why we havent taken this more seriously and whether we need more resources or direction from the white house on this. You know to that end, its trike stoog me this is a case with extremely lurid details as contained in the filing that weve talked about. The kind of case that the government would often usually put a press release out about. We found out about this because of a professor who follows this and grabs the court filings. Strange to me that this is not a case that Justice Department is putting oen a press release on. Well, the Justice Department right after jeff associations became Donald Trumps attorneygeneral down graded domestic terrorism in groups like the kkk and others who promote white supremacy. Big surprise given sessions background and Donald Trumps race baiting throughout the campaign. Donald trumps been giving aid and comfort to these people. And those mentally unbalanced or towards violence are being encouraged to act on their enimpulses and not just fantasize about them. There is a general feeling and there was that awful shooting in annapolis, the newspaper related to something not having to do with the president of the United States. It was a preexisting session that this individual had. But theres a sense of someone is going to get killed eventually. That the rhetoric and the temperature and we saw that guy jump into the camera well at recent trump rally and essentially true to assault a cameraman, there there is a palpable sense when theyre talking with their friends that there is an environment unwhich something terrible is going to happen. And youre right to reference an individual at trump rally who jumped in. Unfortunately i think it didnt get enough coverage in the america media. I would like to think its because we were following some trump atrocity of the day. But when he bates his crowd, when he tells them to turn and points fingers and scream at journalists. When he isolates a journalist as he did during the campaign, a single journal points them out, he is essentially giving people all the impetus they might need commit violence too, act in ways illegal and threatening to journalists. And i think this is a concern in every news room, a concern in every network. I think the degree of security is greater than it has been in the past and its because of this president. Every politician in some way has their critiques of the press, they argue with the press, beerate the press oicationally. I grew up where mayor daly would be quite tough on reporters. What makes this different . Is it different the way this president talked about it . The language hes used . The atmosphere hes created . None of us went into this business to be liked. We understand that a lot of people dont want to hear things. When american correspondents were traveling with the secretary of state or troubled by local thugs working for whatever the dictator and power that moment was. The u. S. State Department Personnel would step unand speak about it. Previous president s have talked about how valuable having a free press is, even when they get to the residence of the white house that theyre unhappy about whats being reported. Donald trump is in a unique category by himself and whenever he is out of office under dash doesnt matter what the circumstances ar he will continue, i believe, to call for violence, to the idea that we really dont have a legitimate government, which is fundamentally what hes been doing, and particularly violence against journalist, people of color, and people whose religion he doesnt like. Carol, let me start with you. As someone who ran a u. S. Attorneys office, i want to ask a question about this breaking news and something i raised with jennifer and david. It seems there was no press release a fact pattern that is as lurid as this one is. I do find that very strange, chris, i have to say. Normally Something Like this where theyre members of the media being targeted, members of congress being targeted, i would have expected the department of justice come out with a press release. That would be fairly Standard Operating Procedure . It certainly would have been while i was u. S. Attorney, yes. Clint, i want to talk about Michael Cohen being back on back on after being off. What do you make of the fact that he was scheduled, he canceled, he talked about intimidation with the president of the United States. Elijah cummings said he will get him on, and now it appears he is going to be testifying in public under oath next week. I just dont know. It keeps me in a delay, and that makes me think its more than just surgery or recovery. I think there has been lots of negotiations going on behind the scenes. I imagine capitol hill is part of it. I wouldnt be surprised if the Mueller Investigation is part of it too, and you got a new attorney general that just taking over. Lots of things are in the mix. I just find these constant delays all too curious based on all the other circumstances we see swirling around right now. It does look like were going to finally hear the mans testimony, which is the first time, weve talked about this before, carol, that the Mueller Investigation is a black box. It doesnt leak, there is all this stuff. There is a lot that the public wants to know just as citizens that this is going to be one of the first opportunities basically since comey came before congress to have an open airing under oath. Thats absolutely right. I think what we have to prepare ourselves for is at first its going to take a little bit longer perhaps than the public is hoping and expecting. Like a house renovation, it always takes a little bit longer than we think. But, you know, mueller, unlike many of the previous special counsel, he is already indicted a lot of people. Those are already in the public domain. The part that it might be interesting that will be reserved for the special counsels report i think might be parts of his investigation where he thinks that one of two things. Either he is concerned that he cannot meet the very high bar, and i think hes probably as a good prosecutor putting extra requirements on himself, because what he doesnt want to do is bring a criminal case against very, very high levels of governmental officials and then lose the case before a jury that would be a destabilizing factor for the government. And i think somebody as god as bob mueller is probably taking that into account, or he is concerned that perhaps if things really do involve people at very high levels of government, he wants to have a discussion and a deliberation with the attorney general as to where the appropriate place is for such prosecutions to be brought. You know, clint, one of the things people have noted that is a little strange, i didnt get a chance to ask ken dilanian this, there is still open threat. There is Andrew Miller who has fought his subpoena. Muellers team has been fighting him. There is a subpoena for an unnamed corporation that is owned by an unnamed Foreign Government thats gone up to the Supreme Court and back down. They are fighting that. That is not resolved. What do you make of the fact that there appear to be loose threads just right there, and it also looks like hes headed towards some kind of conclusion . There is no there is no perfect analog for what hes supposed to do, what his work product, right, carol . Thats absolutely right there.
