A president who lost a popular vote by 3 million votes presiding over the ceremonial swearing in of a Supreme Court justice who most americans did not wanton bench. New polling finds just 41 of americans wanted Brett Kavanaugh confirmed while 51 said he did not belong on the Supreme Court. 52 say they believe the women accusie ining kavanaugh of sexu misconduct. 50 say he lied under oath about his drinking as a young man. If the senate actually reflected the nation, all that might have mattered, but here is how the constitutional math breaks down. The 50 senators who voted yes on kavanaugh represent states covering just 44 of the u. S. Population. And what we just witnessed in the runup to the 2018 election was the gop ruthlessly marshalling the power of minority rule to score a victory over the will of the majority and lock in a conservative Supreme Court that is largely out of step with the views of the majority of the country. The question now is whether there will be a political price to pay. The protesters who took to the streets this weekend will need more than a simple majority of americans on their side thanks in large part to gopengineered gerrymandering, analysts estimate democrats need to win by 7 Percentage Points and possibly more to retake the house. And despite Donald Trumps repeated claims the system is rigged against him, the reverse is much closer to the truth. The democrats have to overcome major disadvantages both structural and otherwise to win back power there are now 29 days until the midterms, and republicans are no longer even pretending to be polite what we all just went through. Trump today describing the wrenching testimony from Christine Blasey ford as part of a hoax perpetrated by evil people. Gop representative kevin cramer who is running for senate in north dakota lashed out at the me too movement, which he calls a Movement Towards victimization. Thats what minority rule likes in 2018, and what we find out in 29 days is whether the majority are organized enough and outraged now overcome the real obstacles they face and take power back from the Minority Coalition that now runs the country. I dont know if you got a chance to see the ceremony now which was sort of waving a red cape in front of a majority of the country that opposed this mans ascension to the Supreme Court. I mostly saw the part i saw part of it, and it was like an oscar thank you speech to all the members of the Republican Party. That was the part i saw. He was thanking every republican he could possibly think of. You know, that was the view i got. I want to play you one bit of sound from the president which i think that we have. This is the president starting his remarks with an apology to Brett Kavanaugh on behalf of the american people. Take a listen. On behalf of our nation, i want to apologize to brett and the entire kavanaugh family for the terrible pain and suffering you have been forced to endure. What do you think of that . Right. So its interesting. You cited the lawmaker earlier on the right who said that the me too movement is about a quest for victimization. And one of the fascinating dynamics that were watching happen in realtime, and it is amazing because i just wrote this book about it, and surreal le, its happening in front of us right now is you see the powerful, right, like the literally most powerful, the president of the United States, the Republican Party that has control of the senate and the house, a man who has just been appointed to a lifetime seton Supreme Court extremely powerful people casting themselves as victims and vilifying the less powerfuls anger and calling them out for, you know, victimization, calling them a mob. Donald trump over the weekend called them a mob and compared them to arsonists. Marco rubio called them a mob. The fox news host talked about the protesters as screaming animals who needed to be tasered. There is this vilification of the anger of the protesters, of the underrepresented, the majority, the subrogate esubjug minority. Meanwhile, the Republican Party is soaking in its moment of victory and moment of hour over that minority, they are portraying themselves as victims and trying to stoke an equivalent anger on the right to get them through the midterms. They clearly see the value of this anger, even as they say, even as we get all these warnings about how its going to result in backlash. Republicans want to build that anger on their side. And thats a great point. We are completely all powerful. We control all government, and we are everywhere persecuted is the message. Yes. They want they want to use you could see that from the moment of kavanaughs testimony, right . That was the whole spirit. What donald trump wanted him to do, what he did, what Lindsey Graham helped him to do and amplify, he gave voice to this anger of persecution, i have been my ascent has been impeded. I am the victim of this witchhunt, this mob. The Democratic Party conspiracy, the clintons, he named every possible factor in the world that could be coming to get him the true victim. And that of course is the message donald trump is carrying through when he talks about the mob coming to get them, the arsonists, and today talks about apologizing for the pain and the injury done to Brett Kavanaugh, a man who has just been appointed to shape our law for the next several generations. Whats interesting here to me too, they clearly feel shielded politically from the anger theyre stoking, right . They see more upside than downside in waving that red cape, in gloating, in going after those people, because theyve been surviving on 40 for so long, they think that that can carry them through. Right. Well, and the other thing, part of the point im trying to make is even as they work to denigrate the anger and say oh, look, its going to backfire on you democrats, look, they are stoking. They see the value of anger as a political motivator. Right. I think theyre terrified of the anger that they saw in those protesters, the anger that theyre seeing reflected in those polls that you read. I mean, we should remember by the way, its important to point out this difference. After Clarence Thomas was appointed to the Supreme Court, the majority of the americans believed Clarence Thomas. Right. And even given those numbers, the fury and response to how anita hill had been treated and his confirmation resulted in the year of the woman, the next year electorally, and a kind of social movement that we are still living, i would argue that anita hills testimony is still getting us to where we are today. Right. So they know the power. And the polls right now are not in their favor. More people believe dr. Christine blasey ford. They know that this has the power to stoke a social and Political Movement that could not just affect the midterms, but could affect politics for the next 20, 30 years which is about the same amount of time that were looking at Brett Kavanaugh shaping american law. That is a great, great point. Rebecca traister whose new book reads like its written somehow in between the seconds that are happening now called good and mad is out. Thanks for being with me tonight. Thanks, chris. For more on how the democrats trying to take back power, im joined by tom press, chair of the Democratic National committee. Tom, we have heard a lot. In the last week or two i felt there was a consensus formed based on data, senate races and some polling that the opposition of Brett Kavanaugh by democrats had intensified enthusiasm among republicans. How do you see it from your partys point of view at this moment what the effect of these last two weeks have been on Voter Mobilization, volunteering, donating and the like . Well, democrats continue to be very, very motivated. As i mentioned previously, 89 there has been an 89 increase in turnout in this primary season, beginning in 2018 from 2014. Weve seen the intensity everywhere. I was just in wisconsin campaigning with tony evers and mandela barnes, the next governor and Lieutenant Governor of wisconsin. I tell you, every event we went to, we were supposed to have 100 people there. We had 300 people there. Thats what i see out there. This weekend was a gut punch, there is no doubt about it. But we cant agonize. Weve got to organize. We cant mope. Weve got to vote. And thats what i see across this country. If you look, chris, at the organizing footprint in take wisconsin, because i was there recently, and you compare wit the organizing footprint that was in place in 2014, its night and day. And thats why come here with optimism. Well have a lot of work to do. We have 29 days to the weekend. But what gives me optimism throughout is weirfielding great candidates everywhere. Were organizing in every state. Weve become a 50state party again, and were leading with our values. I am very excited about the issues that were talking about. Were putting hope back on the ballot. Let me ask you this. How much does the how much is what youre seeing youre talking about longterm strub chu churl trends. How much does the new cycle matter . The things that are happening that are grabbing peoples attention, i think there is a sense that there is this kind of needle moving back and forth. But from your perspective, does it matter that much whats in the news day to day . Of course it matters. When you see the mistreatment of dr. Ford, thats a mistreatment of every woman across america. When we see kids ripped from their parents at the border, thats an affront to our values as a nation. When you see the Union Movement attacked by republicans day in and day out, when we see that there are no guardrails in washington, i mean, we know that for sure. There are no moderate democrats basically left moderate republicans left in the United States. Careful there are no moderate republicans left in the United States senate. And we need to elect more democrats in the senate, the house and the state houses. And so i see that every day, and what i see everywhere is that people understand that democracy cant be a spectator sport anymore. And i see not only women are activated, but millennials are activated. I see rural voters activated, because were organizing everywhere. People understand that preexisting conditions arent just for democrats or republicans or rural voters or urban voters. These issues touch people everywhere. Let me ask you this. You were at the department of justice. You were in the Civil Rights Division and you were in the department of labor. This is the first time youve done something specifically with this. Youre rung one of the two major parties in america right now. There are people who say the stakes are existential there are people who really believe that american rule of law and governance hinge on what happens. How do you fuel those stakes personally when you wake up every day . Every day i wake up and i see what happens at my old place at the department of justice, where i spent a dozen years. Its a personal affront. Its a gut punch. Our democracy is on the ballot in 29 days. Our democracy as we know it is on the ballot. I started at the department of justice as a career prosecutor under bush one. Im proud of the work i did there. Our independence was our currency. You see the crossing of red lines on a daily basis. The rule of law has become the rule of trump. I see the work we did at the Labor Department to make sure that people who worked overtime would be paid overtime. That people saving for retirement would get the advice that was in their best interests, not in the interests of lining the pockets of the advisers. And i see those rules go away. The assault on the middle class, the assault on the rule of law, the assault on the right to organize, the assault on women, the assault on immigration courts within the department of justice, those are an affront to our democracy. And you know what, chris, they motive me more than ever to get out there and organize. And thats why when we win elections, we can help people at scale. Thats the big question in front of everyone. Here is what is surprising about the victory lap ceremony we just saw. Can you hear me . Yeah. The victory ceremony we just saw in washington. That came against the backdrop. They view this as a political win, a substantive win. Right. Theyre happy to have a conservative sort. Sarah Huckabee Sanders tweeting a gloating tweet about it. They just confirmed someone that 51 of americans oppose. Its really remarkable. Its hard to do that with a Supreme Court nominee. They believe they can win with 40 . Government of, by and for the 40 . And that event to me was them doubling down on that theory. Yeah, chris. And heres the thing. Its worked. They can do donuts in the front yard of the white house and promote malt liquor. This is a real victory for republicans. They have demonstrated they can literally support people who are routinely accused of sexual abuse and get them into office with the support of women. Its an amazing accomplishment. Its very water into wine. Here is the issue that doesnt necessarily work down the road that may not work in michigan and pennsylvania and wisconsin and all of the other places where they have to compete. And thats where the republicans are often going to make a mistake going forward. Brett kavanaugh is not on the ballot. Okay, Brett Kavanaugh is not on the ballot in tennessee. Brett kavanaugh is not on the ballot in florida. So the longer that they spend time crowing over a victory in the Supreme Court which has longterm consequences, the less time theyre realizing you have to be on the ground knocking on doors in order to win the elections. As of yet, none of the local statewide polls in arizona or texas or anywhere else. Right. Have shown a change since the kavanaugh hearingses. There is also this remarkable structural thing happening. We have a gender gap thats bigger than its ever been in polling. Its hitting now 30 in the wake of this, and a kind of doubling down on the politics of white male grievance at a time when thats a shrinking pool of votes that they think they can maximize to keep eeking out victories. I think the key here will be what will White College educated women do. Do they take this as an affront . Yes. That is the strategy that Hillary Clinton unsuccessfully tried. She counted on those votes and she did not get enough of them. She did. But the polls that came out this morning did show that there was a huge we know that there is always this racial gap among women. Huge. That you count on women of color to vote for democrats, to believe the woman in the stories. We cant always count on white women to be part of that coalition. But what i thought was really interesting about the numbers that came out today is that College Educated white women oppose Brett Kavanaugh and believe Christine Blasey ford. And i think that that is why were hearing this stuff about the mob. Why . Because they want to erase the memory of this nice educated white middle Class College professor who overwhelmingly captivated the nation. Great point. Who even trump had to concede, even if they came up with this insane doppelganger theory, they had to concede she seemed credible. So to change the subject in this racialized mob language, this nixonian law order language that were hearing, only we alone can bring order to this chaos. Right. Stop thinking about dr. Ford. That same fear. Its a great point. And trump started his campaign arguing that mexicans were the rapists, right . The alleged rapists that weve seen were just the ones speaking in the white house, both trump and kavanaugh. They are the elite white men. Why not change the subject from that and talk about how its only other people who are bringing violence and fear to us. This observation, jason. Its a striking interview any n which the gop governs is only interested in 47 of the country in which point the structural advantages could a lou to it have supermajorities in congress, and theyre also bank thong Enthusiasm Gap they relied on midterm after midterm and the existential question for the Majority Coalition and opposition is whether that materializes on election day. Right. At this point, chris, it does not appear that thats the case. And here is where those structural things really become important. Michigan, pennsylvania, wisconsin, minnesota. If all of these states get democratic governors, and thats what it looks like right now. Right. You dont have people being purged from the voter roles like in georgia right now right before an election. Its a good point. Structurally, all the ground campaigns could end up having a big impact. This is the thing about enthusiasm. Look at the eagles. They win last year and now theyre screwing up. Victory doesnt make you more enthusiastic. It tends to make you lazy. Losing is what keeps people motivated. I think democrats are going to stay motived from this loss more than republicans are. I remember watching the tea party unfold in 09 and test 10. It was angry and loud. Righteous kind of anger. As opposed to the mob kind of anger. But that also portended something. That said something about where the electorate was. It said something that people that were reporting on this anecdotally, the democrats are headed for a bad election being around that, because that anger does transfer into something politically and meaningful. It may well. I think were look, trump said the same thing about his own rallies, and some of his people did turn out. It is possible. Nobody know whats the electorate is going to be composed of. I think its really interesting to see, for example, we skipped over it so fast that only one democrat voted for kavanaugh, including extremely vulnerable democrats. Now heidi heitkamp, for example, won narrowly in 2012, but she is now doubling down. Ever since i wrote about her, my facebook feed has been full of ads from here saying im going to lose because i stood up for Sexual Assault survivors. She is giving introduce about how her mother was a survivor. I think that the strategy for democrats here is going to be were not going to be republicans light, right . Were going to stand up for Sexual Assault survivors. Were going the stand up for the people in our coalition. And i think we heard all about how Hillary Clinton was inauthentic. This is the authentic pitch from the Democratic Party, and hopefully people will react to it. Heitkamp cutting an ad on her vote, talking very personally in an interview recently while her opponent is talking about me too and victimization. But in 29 days, the republican vote that has the greatest chance of backfiring is the one cast by senator dean heller of nevada. He is a republican facing voters in a state that Hillary Clinton carried. He is already narrowly trailing his female opponent, jacky rosen, and the ads attacking his kavanaugh vote have already begun. Senator spineless dean heller is pushing Brett Kavanaugh on to the Supreme Court without all the information and without listening to nevada. Dean heller dismissed Sexual Assault allegations as nothing more than a hiccup. Joining me now to talk what the kavanaugh vote will mean for the hotly contested senate seat in 1 2, jon ralston. So much talk about heitkamp, manchin. Very little talk about heller. How is this playing in that race in nevada . Well, its hard to tell right away, of course, chris. And of course dozens of things are going to happen between now. Yeah, great point. And the election. Although i got to tell you, early voting here starts in 12 days. Were going have a lot more information then. Its interesting, though. You frame this as the vote that could cost dean heller his senate race. He thinks its going to save him. And let me tell you what i mean by that. He has been all in for kavanaugh. He met with kavanaugh. Immediately he was on board. Even after they did they called for the fbi investigation, he put out a statement saying i hope after this is done, the other senators will come around to where i am. As kavanaugh started speaking just about an hour ago, dean heller put out a tweet that said the smears back fired. He is doing a simple political calculation here, chris in a midterm with turnout down from what it would be in a president ial election, its going to be a base election. The base loves donald trump. Right. He is all in. Now its hard to believe that he actually believes any of this based on his entire career, and based on the fact that a couple of years ago he was saying im 99 against trump. But he has decided this is his path to victory to be all in on kavanaugh, all in with trump. You know, it always fascinates me when each candidate thinks they have the better side of an argument. And rosen clearly, this is not something she is running away from either. She is leaning into the kavanaugh fight as well. She is indeed. And her polling, which is the same as dean hellers polling in every poll ive seen recently, chris, shows a huge gender gap. Its in doubledigits in that race, 12 to 14point lead rosen has among women. So the question, and you talked about this with rebecca earlier is whose going to be angrier . Is it going to be trump and others stoking the conservative base that kavanaugh was treated unfairly, or are a lot of women now who might not have voted going to be so angry with dr. Fords treatment that they are going to come out to vote . That is what rosen is counting on. And of course you know this, chris. You see all these polls. Every poll ive seen shows heller and rosen very close. Rosen has had a slight lead in most of the recent ones be. The pollster is only as good as how he has modelled what is actually going to be the makeup of the electorate. Democrats have done very poorly here in midterms. The question is that going to continue. All right, jon ralston, thank you so much. Axios reports today the white house has begun to prepare for an onslaught of investigations if democrats win back the house. Im joined by new yorker staffer Adam Davidson who has been covering the president s finances and reports the president has more to worry about than a democratic hour, including the possibility that state officials and unpaid taxes could force him to liquidate part of his fortune. Ive seen a lot of tweets this week rightly in a lot of commentary. They found massive fraud four days ago. And no one is doing anything about it. No one is talking. The story is not over. The story is not over. Its not that they found one time there was massive fraud. What they found is at the core of the Trump Organization was decades and decades of unimaginably blatant fraud, creating false companies to pretend to buy hundreds of millions and millions of dollars worth of equipment. Right. So they could simultaneously defraud the irs and and their tenants. And jack up the rates on their tenants. Its um. I think your microphone fell. Okay. It is a shocking, shocking, shocking story. This is not oh, a rich family tried to not pay as much in taxes. This is blatant. It also shows that donald trump himself added virtually no value to the company, that his wealth is very clearly he was black hole. He was a black hole. Dad kept pumping more and more money and he kept screwing it up. Yes. It was making money on middle Income Housing in brooklyn and queens, spending it irresponsibly on trump projects. And heres the thing. His businesses in new york, new jersey, florida, california, virginia, these are states that either likely will have or could well have democratic attorneys general who have every right to seek both criminal investigations for tax fraud as well as to start reclaiming money. Cranes reported that the trump family might owe as much as 400 million just in new york state tax, forget about federal taxes, virginia taxes, florida taxes. I dont see how 2019 is anything less than many multiples as crazy as 2018 because youre going have for whatever mueller does, whatever the Democratic Congress does, and then multiple state investigations trying to claw back the trump family fortune. And one of the points i think you make in the piece and others made is even though the commission of the acts is often outside the window of the statute of the limitations, the furtherance of the fraud keeps happening because theyve done a lot of bunch of stuff to cover it up. First of all, we dont know yet. Right. What the New York Times found is unbelievable documentary evidence through 2004 of ongoing schemes for decades. The exact same people continued to run the Trump Organization. We have no evidence that they change their strategy. Great point. Or stopped committing fraud. But the New York Times only got that data. They dont have subpoena power. All those other entities do. But more to the point, the courts are very clear while the statute of limitations is for criminal tax fraud is generally six years, its six years from the last effort to conceal. And since, you know, just today trump was concealing this tax fraud, i think a prosecutor would have a fairly easy time saying, no no, this is an ongoing criminal enterprise. Youre a person who i think is on the record as saying the president s finances are a ticking time bomb. Yes that. Its bound to go off. Yes. I wonder what your reaction was when you read the times story. It is a fundamental game changer in American History. It is so important, and it will take, i think, months, maybe years for us to absorb it. I dont know what it was like to read the pentagon papers the day it came out or to fully take in the smoking gun tape of nixon, but this is bigger than certainly the smoking gun tape because this is it ends discussion, ends responsible discussion of trump as a selfmade man. It ends responsible discussion of the Trump Organization as anything other than a at its core criminal enterprise that trump himself, almost certainly ivanka, don jr. , trumps sister, the former federal judge were deeply involved in. It is and i dont see how prosecutors dont spend the next many, many years looking into that. I think the trump family will be much poorer in a few years than they are today. And you also make a point. You just made it which i think is worth noting, this goes to 2004. There is a lot after that that we dont know, but there is no reason to believe that anyone like sort of got super obsessed with following the law. It is the exact same people. I have to assume he either designed these schemes or was integral in promoting these schemes. I think its clear too this blue wave is going to emerge in suburban metropolitan areas around the country, at least i think thats clear. You look at these most vulnerable republican incumbents in the house side, suburbs outside washington, d. C. , kansas city, denver, get out to california, that weve seen Consistent Energy in the democratic side. My question, though, is it going to expand much further than that . The possibilities are there, but im not yet convinced thats actually going to happen. Celinda, one of the dynamics here, and these are top ten races to give us a sense what steve talking about, one of them Barbara Comstock in number three there who is a sort of classic example of that in the d. C. Suburbs. One of the things weve seen, celinda, is things do tend to break all in one direction. Weve seen a kind of nationalization around these midterms. It really goes back to gingrich in 94 which is what a big part of your book is about, steve. These tend to be National Elections in many ways. Thats exactly right. And the turnout makes them National Elections. The issues make them National Elections. Turnout make them National Elections. And its way for people to vote for a change from what theyre seeing right now. The other thing thats nationalizing these election series the number of women candidates running and the preferences of women voters. The gender gap is on steroids right now and you have women voting 20 points democratic, men voting only 9 or 10 points republican. And youve got a lot more women candidates than basically ever before. On the democratic side in battleground districts, i think a majority of the candidates are women. Thats exactly right. And women roared out of these primaries, and voters think that women represent change. They represent being in touch with your lives. They represent candidates who wont get involved in personal scandal. They represent health care, which is still the number one issue for democrats. So whats that next tier . So weve seen this sort of like College Educated white women in suburban meth areas as this kind of key voter that we can trace having swung towards the democrats pretty strongly, both in sort of preference and intensity. What is the next tier of districts if you had to sort of group them that would represent real trouble for republicans after that . Ill give you one you can mark right now and everybody can think of this one on election night. Its one of the first districts were going get real numbers from on election night. The sixth district in kentucky. Kentucky has a very early poll closing time. The sixth district of kentucky is represented by a republican, andy barr. This were the democrats have nominated amy mcgrath. She is the former fighter pilot. She had that viral ad that raised all sorts of money, raised her profile. The interesting thing than district, this is a district donald trump won by doubledigits in 2016. Obviously its kentucky. But its a district thats got lexington, which is a college town, university of kentucky. Its got the area sort of suburban white collar professional area right outside lexington. Thats about half the district right there. And then its got sort of a classically kentucky rural exurban second half of the district. If there is a surge. And if mcgrath is overperforming like Hillary Clinton did significantly in the rural parts and that thing is a race and she is ahead there, that i think is important for the roast telephone night. Thats a great point, celinda. That was the recipe for connor lamb when he won that race. Thats right. It was rural pennsylvania but parts of the pittsburgh suburbs and exurbs that a lot stretch across different kinds of terrain with constituencies that might be differently motivated. Thats exactly right. But what you saw in conner lamb is you saw a great example. You saw him win record numbers of older women who wanted to protect their health care, want to protect their social security, wanted to have good schools in rural areas. So it is the year of the woman, the woman voter, the woman candidate, and women will determine what happens in this election. And also sometimes its going to be either or but its not. Thats exactly right. You need to mobilize voters into your base of votes but you need to cut down your margin in the rural areas. A democrat is not going to win the rural counties. But there is a big difference between being caught by 25 and losing by 12. In the columbus area in ohio. Another great example. Big, you is a two things there. Very similar to this kentucky district. Huge democratic surge in the immediate columbus suburbs. In the outlying areas, the rural texas, blue collar cities like zanesville still a big republican margin, but it was genuinely narrow than you saw. Were doing the largest youth Voter Mobilization drive ever, because thats the biggest generation in america, the 18 to 35yearold generation, and they voted half the rate of other americans. We figure if they join the democracy, we have a representational democracy again. And by the way, theyre going to get rid of all these guys. When i was listening to how we expand the electorate, this is how. The biggest generation in American History, the most diverse generation in American History shows up and tells these selfish, entitled white men your time is past. And thats a generation that also in polling cares the most about this issue, which makes a certain amount of sense, because when you read the ipcc report, it sort of scans that people that are 60 may not care as much about 2040 and 2050 as people that are 25. Well, let me just say, chris, anybody who is decent, anybody who has kids, anybody who has grandkids, anybody who cares about other human beings in the world, when they see a big threat to the world and know we can solve it, they go, they run towards the fire to solve it.
