The Washington Post reports, trumps announcement of mcgahns departure came as a surprise, including to mcgahn. While it had been an open secret inside the white house, mcgahn planned to leave after kafanca n kavanaughs shortly after the inauguration, it was acting attorney general sally yates who says she warned mcgahn about National Security adviser Michael Flynn and his contacts with russia. Michael flynn, of course, eventually pleaded guilty to lying to the fbi about contacts with the russian ambassador. And in march 2017 the fbi says it gave mcgahn derogatory information about then staff secretary rob porter. Porter didnt resign until almost a year later, when the allegations became public. Just this month, mcgahn has cooperated extensively with the special counsels probe. Trumps announcement today prompted dismay including Chuck Grassley who wrote, realdonald trump. I hope its not true mcgahn is leaving white House Counsel you cant let that happen. Even as reporters peppered a stoic mcgahn with questions about the Mueller Investigation, mcgahn is not without his enemies. Pretrump tweet reported mcgahn was eyeing the exits. Any concern about what you said to the Mueller Investigation . No, not at all. Reports are already surfacing, including Trump Legal Team member emmitt flood who represented bill clinton when he was impeached. Flood is widely seen as a likely replacement. Flood has built a rapport with potus to mcgahns relief. Joining me now is robert costa of the Washington Post. Im a little unclear how this went down today and why it went down this way. Could you shed some light . The joke around the white house with my sources there is that mcgahns been spotted more on capitol hill in recent weeks than at the white house, because hes been working on the kavanaugh investigation. This was a long simmering decision, but the president based on that reporting today decided to make it public. Was it the case that from your reporting that essentially this was i mean, i guess my question is, was he fired or did he quit . He was expected to leave, this was a story everyones been writing for months, mcgahn likely to leave after the midterm elections, its been confirmed as republicans hope he is. But the the same time. You have a lot of push back on capitol hill. Hes our link to an unconventional white house. Hes the person that helps get these judges through on all levels of the federal court. Theres an inclination to have him stay. Its been something thats lingering over this white house. Emmett flood who you reported as a possible replacement. The top line of the biois that he was a lawyer during clintons impeachment. A lot of people wondering what that signals. The white house is preparing for the democrats to possibly take over the house. They hope that doesnt happen, but you have to prepare. My sources tell me that flood is a white shoe lawyer will be ready. Will be able to mount a defense of the presidency. Trying to mount a defense for the president should that scenario happen. He has built a rapport with the president. Its not clear an offer has been made yet. Mcgahn brought him in, a lot of people dont want to come into this white house as lawyers. Flood was convinced maybe he could be white House Counsel. The circumstances around the special council are complicated. What does your reporting indicate . The president s torn, talking to a few white house officials today, he knows mcgahn listened to john dowd and ty cobb who urged cooperation, he didnt want to cooperate, of course he did cooperate, sad for those 30 hours, hes someone who should have exerted executive privilege months ago. He ended up sitting with mueller, anyone connected to the mueller probe. Youre at risk of getting the president s ire. Robert costa, thanks for that report. Senator Richard Blumenthal a member of the Senate Judiciary committee. One of the most notable things about mcgahn, there was reporting he stood in the way of the president firing mueller. Trump ordered mueller fired but backed off when mcgahn threatened to quit, between that and sessions likely imminent dismissal, what do you think the white house is up to. First, mcgahn has been perceived in congress as the voice of reason and respect for the norms in a white house that has very little of either. He was a calming and moderating influence, willing to stand up to the president and say no in the white house that has very few people willing to do it. And he said no to firing mueller. He did go to Jeff Sessions. And try to persuade him to recuse himself. Which sessions refused to do, he basically had no choice. Mcgahn accepted that refusal. But the president never has. He wants a roy kohn. Someone who will have his back and serve his interests. I think mcgahns leaving will possibly embolden the president. Even though it will invoke a prior storm on capitol hill. You really think it would . Take what mcconnell said in the last 48 hours, that he thinks sessions should stay. I think Lindsey Graham was right. A year ago, when he said, it would be holy hell to pay if sessions were fired. I think the president would have a lot of difficulty trying to confirm someone to replace Jeff Sessions. After that story broke that mcgahn spent all that time with mueller. A fake piece today implying that because don mcgahn gave hours of testimony to mueller he must be a john dean rat. There is the dean precedent who was nixons White House Council. Who also did time in prison. When you think about what it is mcgahn knows. Nobody knows all of what he knows. But hes been at the president s right arm as the president has committed some acts that very plausibly amount to obstruction of justice. Theres a credible case of obstruction of justice right now against the president of the United States. Don mcgahn has been at his side through all that he knows, the motive, he knows what the president said, when he wanted to fire comey initially. He wanted to provide a pretext for firing comey. And he has been in a sense a witness to potential obstruction of justice by the president of the United States. Hes been the chief architect and strategist in remaking the federal courts. Of this republican he was spending all this time on capitol hill working with kavanaugh preparation for the hearings. Where do you stand in terms of preparation for those hearings . I am actively preparing as recently as minutes of coming to talk to you. They disclosed only about 6 of the documents relating to kavanaughs service in the white house. Only 6 , and that is as a result of screening, by the way, by a lawyer who is don mcgahns personal lawyer, bill burke. Don mcgahn am i right, hes the one deciding what all of us as americans get to sigh of the record of a man who served in Public Office in the white house . What all of us as americans get to see, and what we as senators get to see. Hes denying us access to papers in the National Archives that are the property of the American People. How does that work . How can he do that. The United States has made a rule that in effect they will delegate to him i see. That assignment, we have challenged it, we have argued against it. And frankly, when these hearings begin on tuesday, were going to renew our effort to have all those documents come to the American People as well as to us. Thanks for sharing your time. You know, you just heard the senator say, you should start standing up for norms. He also was at the center of a lot of really dodgy stuff. Lets not lionize don mcgann here, ill tell you, when i was working in the white house, we had a president who was committed to running an administration that he prove to the American People his first position was public service. I briefed every political appointee for the first three years on what it means to serve the public. That before you come to this administration to do work on health care or Climate Change or foreign policy, your first obligation is to show you serve the public and we would go from office to office, every six months, reminding people, creating a culture of compliance. What we have seen under don mcgahns leadership is the opposite. Its sad. When we have built a white house that tried to stay compliant with the rules, the mcgahn reign in the white house has shown repeated violations of the government act. More than rules limiting contact from the department of justice. Hes really been largely silent not Holding People accountable. What do you think of that assessment . Well, i mean, i i agree with it, but i think were in a situation where if the arm is cut off were not going to worry about the broken ankle. At this point one thing he has done is keep the Mueller Investigation going. If the reports are correct, hes argued with the president against firing Robert Mueller, he argued against the firing of james comey, fbi director. He didnt stand in the way successfully of sessions from recusing himself from the russia probe. And at this point thats where we are in america. Where we have russians interfering with our election, and some serious concerns about obstruction of justice as well as collusion for lack of a better word with a foreign power that is in our interests. I think he did some good things in the white house to the extent to which he served the american populous withholding the rule of law. To kims point about it looks a lot like don mcgahn whos a lifelong conservative republican, right wing lawyer, like foot soldier, and Jeff Sessions, who is probably one of the senators and figures in least of all of washington. Those are the two individuals who provided guardrails and are now going to be gone. Heres the danger. What we are watching is a slow motion purge of everybody whos in a position to potentially hold the president accountable to the rule of law. Think about all the people who are involved in this country in essentially ensuring theyre held accountable to law. First investigators, second prosecutors, third, witnesses, fourth courts. Who has the president gone after . Investigators . Hes moved all the investigators working on russia. Prosecutors . Hes targeting mueller, rosenstein, now hes going to fire sessions. He appeared to fire don mcgann today. Hes going after the other witnesses to intimidate them as being rats, and heres the last one, courts. Whats going on right now, Anthony Kennedy was reportedly coaxed out of retirement by donald trump, so trump can put someone on the court who at least according to everything we know about him, shares an extreme view of executive power with donald trump that could potentially, if some things go to the court, put trump in a position where he could go to Great Lengths to subvert the rule of law. Theres a question, what you see now, what are the guardrails on this president right now. I think congress is not the guardrail and its not functioning. Theres a lot of discussion as to whether a sitting president can be indicted. The constitution has to be construed that there is accountability. Congress isnt going to do something that it would have to be in my mind indictment. We can be in a free fall to the point where, where is there a Tipping Point where republicans are going to start stepping up and doing investigations. There have been literally nothing done into the widespread abuses of this white house, and the various agencies that answer to this president. As compared to the obama white house, those are all sort of, as i mentioned before, small potatoes in this situation, where the rule of law is really at stake here. One last thing i want to talk about is the ron porter situation. I dont want to let it go, you worked in that White House Councils office and the security clearances. The fbi came to don mcgahn and said, this guy is accused of being violent of abusing two exwives, ultimately, restraining orders, theres documentation a picture and mcgahn let him have one of the most sensitive jobs in the white house. Ive done vetting for two different administrations, there were two things you looked for. Things that could be politically embarrassing. And two, things that suggested that someone didnt have the character to hold the public trust. And the latter was always fatal. Ill disagree with your characterization of my bipartisan bill to protect the special council. You said it hasnt gone anywhere, when we first introduced it a year ago, thats exactly what we were told. This will never got a hearing, then it got a hearing last fall. Then i was told we would never get a markup. Several months later we got a markup. It came out of the Judiciary Committee by a strong bipartisan vote of 147. Chairman grassley voted for it, as well as a number of other republicans, and its now ready for floor action, youre absolutely right, that Mitch Mcconnell, the republican majority leader has said theres no need for us to take this up on the floor. Im convinced if we got to the floor, it would get a veto proof majority of the senate, both democrats and republicans supporting it, it is a needed protection for the special council. Is there anything you can do to change mcconnells mind . Hes running herd over the senate. Hes very practiced and good at what he does. Using his ability to prioritize. Can you do anything . The thing that has to happen in a Republican Majority Senate is for republican senators to go to mcconnell and say, we have to vote on this now, its the only way to prevent the president from doing lasting harm to the rule of law, and to himself. Of course, ive had that conversation with a number of colleagues. For reasons i have difficulty understanding, many of my republican colleagues are convinced that the president wont do anything sudden or irresponsible. As your lead in to this segment suggested, im concerned that some of the reassurance theyve gotten might have been either from the White House Council don mcgann who we hear may be departing or from Jeff Sessions. While i have profound policy differences with the attorney general and White House Council, i think that they have been pushing the president not to take an abrupt or irresponsible action to interfere with the special council. If both of them are gone, i think we lose key guardrails that have prevented the president from acting on his impulses. You are on a brief recess in the United States senate. Pursuant to a deal for confirming a bunch of trump nominees, the president is on the federal judiciary, there are Many Democrats who are very angry about this deal, who feel theyve been steam rolled by Mitch Mcconnell, Chuck Schumer and the democrats have not fought hard enough on this, what do you say to them. Were in session in august, exactly because we have been standing up and fighting. President trump has nominated a Record Number of Circuit Court nominees, and we have forced an inch by inch fight on every one of them. Majority leader mcconnell has stated how upset he is, with how hard we have fought against the Circuit Court nominees by this administration, and as a result, for the first time in decades, were here in washington working in august. Im just finishing now a 12 hour day in my office here in washington, preparing for next weeks kavanaugh hearing. It was possible for Mitch Mcconnell to get the same result and ill remind you, half of these judges are noncontroversial judges that democrats move forward, it does allow him to Fillmore District Court seats, thats correct. The end result is the same, we would have been here wednesday, thursday, friday, saturday, sunday, monday, tuesday, and instead we have the choice, whether to stay hear and prepare for the hearings next tuesday or be back in state and campaigning. For many of my colleagues, thats an important priority. You talk about the kavanaugh hearings coming up next week. Day after labor day, everyones back in session on the hill. I wanted to ask about an item that i dont think is getting priority. We have just learned from the governor of puerto ricos own commission study. 3,000 americans died in puerto rico after hurricane maria. Thats 3,000 americans that died on your watch, on the president s watch, and it seems astounding to me that that would not be one of the first items on the docket for everyone in the United States government come tuesday. Well, chris, youre right, and im grateful for the ways in which you continued to press and keep attention on this, its shocking that thousands of american citizens died in no small part due to the failed response by the trump administration, and by their Emergency Response agencies. Back when Hurricane Katrina happened on president bushs watch, the number of americans who died, the slow response was a nationwide scandal, and something that was paid great attention to. Im concerned theres two reasons for this, you know, first a negative one, there are so many other things going on. Whether it was the separation of families at the border or its the threat to rule of law, posed by the possible interference with the Mueller Investigation. Theres so many other things this administration is doing that deserve con tem nation that its hard to make a list of them. But second, this does fall to the republican majority, thats who sets the agenda for the hearings, for the hearings on the floor, and they have largely been silent. We did ultimately send billions of dollars in assistance, but it wasnt delivered in a timely and effective way, for a Majority Party that claims to be concerned about american citizens, and about spending federal dollars wisely, there should be investigations and hearings to get into the details of, why was this response so flawed and so failed and in such a deadly way. Donald trump, the president who endorsed him and fox news, according to politico, since trump endorsed the florida congressman, hes been on fox news and fox business channel, 121 times. His own campaign estimates it would have cost his campaign 9. 3 million to purchase all that air time. While his opponent focused on local issues, desantis has boycotted reporters who may ask him about florida issues. He focused on his support from donald trump and knox and his campaign had data backup in that strategy, it was intentional. They found this, 52 of gop primary voters saw themselves as supporters of the president first. Also, get this, 37 of the partys voters in this primary watched fox daily. And of those who call themselves trump republicans, the daily viewership was higher still. With information like that, it is no surprise that after desantis won his primary, he went straight on fox news to talk about his new opponent democrat Andrew Gillum. Lets build on the success of governor scott. The last thing we need to do is monkey this up with a socialist agenda and bankrupting the state. That is not going to work, thats not going to be good for florida. I personally had never heard that phrase before. After that statement was criticized as racist, the Desantis Campaign said he was talking about florida not making the wrong decision to embrace the socialist policies of Andrew Gillum. To characterize it as anything else was absurd. Its not obvious desantis was talking about gillums policies. Joining me now, author of the loneliness of the black republican, which is a title i love. And the editor at Tampa Bay Times who has been covering this race since the beginning. I am fascinated by this dynamic. All politics is national, the inverse of the tip oneill thing. This race was run successfully by desantis on essentially national terrain. Does that square where what you saw . Well, you know, i think when youre in a time when every hour is dominated by something the president is doing, thats whats on everybodys mind, everybodys focused on the president and on whats happening in washington. So that ron desantis was responding to that. How intentional was his strategy, his campaign seems to make it appear that their focus was on fox and trump. Thats where they understood primary voters are. Did it look intentional to you covering the race. It didnt matter whether it looked intentional, because it was intentional. They basically acknowledged that, they kind of scoffed a little disdainfully at the suggestion that one could win an election in florida by doing a lot of rotary meetings and meet and greets. And bbqs, this was very much about reaching that fox audience. Putnam was out there doing that. Theres nothing like the sort of hold that both fox and the president now as a kind of symbiotic entity have on a voting base in the Republican Party. Theres nothing like it anywhere else. I mean, its almost a kind of monopoly, and it its almost definitional i would say, for the party at this point. Right. I mean, you know, i think desantis said it best, when he said, i am basically trump, i am running a campaign that says, i am trump. Even if he did it in geft, he was serious, we saw how well it worked for donald interrupt, and now were seeing how well it works for the republican primary in florida. The problem with that, is that again its the primary. And that at the end of the day, you know, you still have to believe to some extent that all politics is local politics, and that the general is very different from the primary race. Were just seeing the tip of you know, the tip of the iceberg, the beginning of the narrative, and actually what weve seen, the things that rile up the base, get the base to come out, at least on the republican side, may not in fact work for a general election, that may actually turn off voters, including independent voters who may make the difference in this general contest. Thats a great point, we saw Something Like this in virginia, ed gillespie had a challenge from his right, he started veering toward these trumpian issues, ms13, immigration, things like that, there are a lot of folks who think desantis has a lot of electoral liabilities. They were concerned about precisely that, right . Yeah, they were. But its telling that our governor has very much distanced himself from trump. I think its absolutely impossible for desantis to do that even if he wanted to. This is the guy that had that ad with him teaching his toddler daughter how to build a wall and reading the art of the deal, he is super glued to trump. I think he feels fine about that. That is in some ways, that is where the party is right now. And theres different ways to deal with it as an electoral reality. Adam makes a point that scott has distanced himself a bit, scott doesnt have a primary challenge. Anyone who comes through that funnel, right . Is going to have to is basically stuck to him whether they like it or not. Donald trump has also stuck himself to these candidates, whether they like it or not. So, you know, again, this may play out really well in the prima primary, in terms of the Gubernatorial Race on the republican side, in the general, we really dont know that this will work to the advantage, so far weve seen that it hasnt. We also know that Andrew Gillum is doing something interesting, hes bringing these democratic coalitions together, progressive, black, latino voters, women voters, voters who have been ignored, and hes doing it on a shoestring budget. Doing it in a way thats stw traditional campaigning. It looks very different in the long run. Its going to be so curious, you have these two races in florida. And then you have the Rick Scott Nelson race which are going to be run differently, and its going to be interesting to see how much they converge toward each other as the kind of national dynamics.
