Why has he not punched back on this one . Look, i didnt say he punches back on every single topic. If he did, he would probably be addressing a lot of stories most of you write every single minute of every day. He has a country to run and doing a great job with that. Despite his public silence, the president is reportedly seething behind closed doors. West reported privately, the president has lobbed sharp attacks at daniels and her tour calling her allegations a hoax and asking con if i das if the episode is hurting his poll numbers. He even has griped to several people daniels is not the type of woman he finds attractive which to his credit is a very funny line. Trump left it to surrogates to deb the encounter took place and to lob attacks at daniels credibility. This woman said she signed false statements, she said she told a mistruth to the public. She said she didnt want her kids to find out and yet shes out doing a huge 60 minutes interview. She has no credibility. Do you think the president slept with Stormy Daniels in 2006. No, he denied the allegations. The white house has but the president has not. He has not addressed Stormy Daniels claims in public, not once, not one time. Late last night, a Senior Administration official told nbc news that trump has discussed daniels claims with aides and several counseled him. It doesnt rise to the level of a president ial response also a funny line, unlike i suppose for instance, alec baldwins supposedly dying mediocre career and allegedly terrible impersonation of trump on snl and how they should bring back darrell hammond, nonyer and a greater talent because snl does rise to the level of a president ial response. So the big question in all seriousness, why is the president who doesnt have a reputation for selfrestraint or discipline, why is he being oh so careful, so canny, so retrained so as not to utter a single word about Stormy Daniels . My next guest might provide some insights on that. With me now Stormy Daniels lawyer michael avenatti. Do you have a theory on this. Well, i guess theres twos theories. Theories. One maybe were not punching hard enough. Maybe were not being aggressive enough. Thats why hes not counterpunching. Were going to examine that tonight. Do you judge yourself harshly for that if thats true . Yeah, i guess weve been pretty weak in our approach and well have to reexamine how to approach this thing. Thats one theory. Well go to work on that tonight. The second theory and i think this is the theory that holds, he knows its true, chris. And you know, he wants deniability. The same reason why he didnt sign the agreement so the he could later claim he didnt know anything about it and now he sends sarah and others out to talk to the press so that he can later claim, well, they didnt understand what i told them. Thats exactly not what i told them. I didnt say this. Ya da yada yada. He wants deniability. Thats why we havent heard from him. I dont understand what the exposure is. I have covered this president for several years pop hes happy say things that are untrue that everyone knows is untrue. Why is this something . It almost looks like the white house is crafting his public schedule to shield him from questions. Thats how careful theyre being. And yet what happens if he gets caught in a lie here . I dont understand what the exposure is, do you . There could could be considerable exposure. If hes found to be lying about his knowledge about this agreement and the 130,000 payment, that can have significant consequences from a Campaign Finance violation perspective and other things. That could really put him and mr. Cohen in the crosshairs. I believe theyre operating under a fallacy which is if he never comes forward and denies it, hes in safe waters. I dont believe thats the case at all. Well get to the bottom of this one way or the other whether he makes a statement publicly or not. But heres the thing about this, right . So the complaints you filed, youre basically saying we want out of this nda. Its an illegitimate contract for a variety of reasons. It was a party to attempt to evade Campaign Finance. That argument was well laid out. All that can happen is she speaks. The point of the hush money was for her not to talk. Why not walk it away and goodbye to your 130,000 if all youre saying is let us out of this agreement . Its an interesting question. The approach has been just the opposite. The president and mr. Cohen and mr. Cohens personal lawyer although hes on the sidelines in this case, i dont understand what his involvement is, mr. Swartz, weve doubled and tripled down on this. Now theyre saying theyre going to sue my client for 20 million and trying to threaten intimidate me. Theyre not paying attention. Were not going away. Heres my question, right . Stormy daniels told her story once to untouch in 2011 and once on 60 minutes. Has she said everything she has to say . That is one reason if you were the president or the president s attorney or people around him that you would want to keep pursuing this because you are worried there is more she has to say she might have to say and is that the case . Theres no question. The initial interview was about two hours. I think the total time for her on the 60 minutes piece was probably 16, 17, 18 minutes. Theres a lot of information left on the cutting room floor, a lot of details, a lot of embarrassing information that has yet to come out. Theres a mountain load of evidence. So perhaps thats why hes continuing to deny it. But its shocking. I agree with you. We didnt think that he would stay silent this long. And i think its pretty clear. He is scared of my client and perhaps of me. He should be. You tell me a bit more about the other women that have talked to you. Obviously anyone can call you and say this happened to me. Thats something you would have to run to ground. What are the implications if there are women out there who also have ndas . I think a lot of the implication or the implication would rise and fall on the timing of those, whether they would have coincided with the election, you know, in the case of my client were talking about within two weeks of the election. Its a critical type period as it relates to Campaign Finance law. But i think the timing of those payments would you have a lot to do with it. I want to be clear about something. Ill tell you this, look, when it comes to the Mainstream Media, the evangelicals do believe in what donald trump calls fake news. I know that term is toxic. I know donald trump kind of came up with it in the last few years. Look, evangelicals believed that for a very long time. The more the Mainstream Media piles on donald trump and they consider Stormy Daniels part of the pilon, its not going anywhere. The needle is not moving at all. You can say these are a group of people who do not trust what they hear. This is white evangelicals being polled on this. Do you believe trump or the women. 40 say the women, 36 say trump, 24 arent sure. A plurality believe the women. Theyre saying yeah, i believe this happened. I do not care. Yeah, but chris, heres the thing. They believed all those other stories too from the 80s and 90s. Donald trump got into this race and everybody knew, this just in, hes not a boy scout. They voted for him anyhow. They see this culture and say enough. They feel theyre being played by the Republican Party and say were going to give this guy a shot. So from a purely pragmatic perspective, i get that. There are two political coalitions. Hes on my team and represents my coalition. He dont care what he does in his personal life. Im going with him. If thats true, does that at least sort of retroactively apply where were not going to see evangelicals make a big deal out of the private behavior of politicians . Do they regret everything they said but clinton when they were basically marching to washington to get him run out of time because of his dastardly private deeds. Legitimate question. They believe in the grace principle. And they understand were all in need of gods forgiveness. Were all sinners. Where does grace run out . Grace doesnt run out with jesus christ at all. It might run out with liberals or conservatives or you or me but not god. David, ive read my bible and i grew up in the church. Grace doesnt come cheap and you got to the ask for forgiveness and you have to be pious and pray to your god and saviour and you have to have a change of heart. You have to reach out spiritually. Is there a Single Person on gods great earth who believes that donald trump is doing that . He can tell you this. I interviewed him. You can google him in 2015 in august excuse me, september of 2015. He said he does ask god for forgiveness. Thats his word. Im not god. He also talked about he also talked about when you asked him what god means to him, he talked about how great his golf course is, that he didnt have a mortgage on it. The bottom line is this, chris. Evangelicals and donald trump see the world very much. Absolutes. Good versus evil, right and wrong, all of that. Im telling you, maybe its a dr. Phil experiment at some point. Im telling you whats going on. Theyre both bold in their views and theyve also been, chris, theyve been criticized for those views. You put it all together and they feel a kin ship between themselves. That i get. A set of absolute beliefs and being in the bunker with him. That is quite descriptive. Heres the question. Is there a revelation that could come out about donald trump about his private behavior, about his public behavior, anything he did . Roy moore we saw this put to the test. This is a person credibly accuses of molesting children who still won 80 of white evangelicals in alabama. Is there something donald trump could do to lose the support or is it the case he could do anything . Bill clinton had a mon cap lewinsky. Right now we dont see a Monica Lewinsky in the donald trump white house. If that happened, chris, game, set, match. Its over for donald trump with evangelicals. Wait a second. You think that . Okay. Let me explain. When i say game, set, match, he won 81 of the evangelical vote. He will not get 81 . If he doesnt get 81 , its game, set match for him. Why in the world does that matter compared to 12 years ago . Evangelicals would feel played at that point. Hes promoting. You dayiol christian values but doing something against that. That would be an issue for them. We dont see that. In the book, i can tell you he has so many evangelicals around him right now, the sense is from our reporting over 100 interviews hes on a spiritual journey that evolved. Youre talking about 10, 12 years ago. We havent seen anything in the last few years. Thats what the book shows. I guess the lord works in Mysterious Ways if he have on a spiritual journey. It may not seem like much at first but the decision by the Trump Administration to add a single question to the upcoming u. S. Census is tonight being called an attack on our democracy which could upend the balance of power between democrats and republicans urban and rural americans, white people and people of color. You see, since 1950, the questionnaire which every single household has to fill out every ten years has not asked people about their citizenship status. Immigrants are understandably cautious about handing over data to the government if they fear it will be used to round them up. And given what theyve been seeing online and on the news lately and coming from the white house, people picked up on the street hauled away from their families who could blame them for fearing that. The Trump Administration decided for the first time in decades, the next census will ask about citizenship, raising concerns that immigrant communities wont be counted accurately. That could, of course, stack the deck for the gop when that data is used to redistribute political power. Xavier becerra is now suing the Trump Administration over this Citizenship Question. Ill start on a policy question and then well move to the legal question. Policy question, ted cruz today said this is great. We should know this information. Whats wrong with asking the question . Well, if ted cruz is one saying that, that should make you have real concern. But to give you a more substantive response, it should concern you because a lot of policy will be made based on what the census shows us. If the census has a severe undercount of the people in this country, there will be many portions of the country many regions that will be left without the resources they should have and perhaps even the representatives in the house of representatives that they should have. So chris, its crucial and the reason we havent seen this census question in four or five decades is because we know that it could undermine the ability to the actually get everyone top participate. So thats the policy rationale. If you ask this question, youll get a less accurate count. The whole point is to the accurately count how many people there are. The legal issue is separate from saying its illegal. In a tweet immediately after this came out, you said its illegal. Whats your case on that . Because the constitution requires the federal government to get an actually count of all the people in this country, citizen and noncitizen. Weve been doing that since 1790. It doesnt say get a count of the citizens of the country. So to violate the constitution would be to go straight to the heart of what were supposed to do and trying to get an accurate count. You actually think youre making a constitutional claim that this is a violation because they know it will result in a less accurate count and that the constitution mandates as accurate a count as possible . Simple as that. Youve got a lot of other states supporting you. What do you say to those people who say this is the states that fear theyll have power taken away from them . At the end of the day, it hurts everyone. When it comes time to deciding what school your child will go to and if youre concerned about class size but if a particular child has not been counted in the census because the parents were afraid to actually submit the questionnaire because they were immigrants, then all of a sudden, the monies that would help avoid having large class sizes in our schools those problems start to surface. Whether youre a parent with kids in school, whether youre driving on a highway abyoure stuck in traffic, congested traffic or because there are too. Potholes and they have to wall off a particular lane on the highway, all those things could be determined because theyre not getting enough resources to build a highway, build enough schools because the census doesnt drives the dollars where they need to go. Yeah. Just to be clear, what youre saying is that that count is the underlying number for a bunch of different calculations from federal monies for highways to schools to all kinds of things aside from political reapportionenment all of which could be skewed if the counts not accurate . Not only may be skewed, will be skewed. How sure are you of that . How can you know thats the case . The majority of monies that we send to the federal treasury through our taxpayer dollars are redistributed to the states through formulas that are derived from the census numbers. So we can make sure that were distributing tax dollars fairly. If a region is undercounted because its people did not fill out the Census Bureau questionnaire, then you will not get those monies september back to you even though youre paying those taxes. And so its not a question. Its a certainty that regions of the country will lose. But if regions of the country lose, if california loses and were the economic engine for the country, if we start to have problems, guess what, pretty soon the rest of the country will feel those problems, as well. Commerce secretary wilbur ross who is oversees the department in the Commerce Department that runs the census is making the argument this is necessary to include this question to enforce the 1965 Voting Rights acts to protect what he says are minority voters. Is eliing . Chris, you know, that one is hard to swallow that all of a sudden, the reason in the dead of night last night right before the department of commerce has to make a decision about what questions to include theyre now including this because any want to protect the Voting Rights of people . I got to tell you, that one is as far away as my wanting to buy or sell you some real estate in the desert. It doesnt fly. I know thats their argument. But thats why we feel very confident when we go to court we can prevail. Final question on another topic. Your office has announced an investigation of the shooting of an unarmed black man in sacramento. And taking that over i guess from local police. Having just watched attorney general investigation in louisiana clear the police who shot alton sterling, why should people in california have confidence the result here is going to be any different . Let me shake sure the records straight. We are going to do an independent oversight of the investigation thats under way in sacramento. Were not taking it over. Were going to be providing independent oversight. That means that we dont lose our ability to take whatever action we as the department of justice in california think is necessary whether its through investigation or eventual prosecution. But we are working with the investigation that is being done by the Sacramento Police department. What is important to understand is that this should give us a better sense and hopefully a greater degree of confidence that at the end, what comes out from this investigation is something that people can have some faith in. And heres where i think its important and i believe california is going to try to move the ball further so the that people can have that trust between communities and the men and women in uniform who serve them. Republicans at all levels of government increasingly seem to be using extreme tactics to maintain control of the government even as a demographic change shrinks their base. Ari berman author of give us the ballot, the modern struggle for Voting Rights in america, Christina Greer and Michelle Goldberg is an oped columnist for the new york times. Ari, you tweeted about the census question as a threat to american democracy and connected it to a lot of reporting youve done on Voting Rights. Whats the connection . The connection is that the census really forms the basis for voting and the Core Infrastructure of our democracy. It forms the basis for how many congressional seats and electoral votes states receive. It forms the basis for how congressional districts and state districts are drawn. So if the census is corrupted, if the census is rigged our entire democracy is corrupted and rigged as a result. Thats why the Citizenship Question on the census and the larger threat to the census more broadly are such a threat to democracy because they impact every single facet of our democracy. Its zero sum. There will be 435 members of the house and 538 electoral votes. If illinois new york and california lose population because you dont count the folks that are undocumented, theyre going to go to other places. Its right, michelle . This has to do with something youve written. In your columns about the sort of desire to kind of use changes to the rules of the game to maintain a hold on power even as their coalition experiences demographic decline. Its not just a desire. Its a reality. They have done it. Its not just the fact that we have a minority president and its not a coincidence its the second minority president out of the last how many, three, four . And that theyve both been republicans. So you see this kind of structural advantage for republicans at all levels of government. Some of it is inherent to the way the population is distributed, liberals tend to be clustered in big cities. Some of it has been this deliberate attempt to pack liberals into certain districts and spread out conservative advantages in other districts. Theres a report from the Brannan Center that says that in the midterms, democrats will need to get 11 more of the popular vote in order to take back the house. And other people have disputeded that number. Some people have said its more like 7 . Theres no question they need to vastly overperform just to be just to have any power in the federal government. That the majority of the people have no say in the federal government and its entirely possible that even if they mobilize and go out and try to make their voices heard, it wont be enough to overcome these structural impediments. Its funny to watch people going back and forth, its 11 points, six points, its a national election. Thats not the system we have. In a broad sense of democratic legitimacy like that should matter. Christina, its not an accident of which way the demographic and racial divides break in this question. Not at all. As michelle said, when youre gerrymandering particular districts can you either pack or crack for the most part. What we see with largely africanamerican and latino communities is they are packed into hyper democratic districts or you know, so theres racial gerrymandering and partisan gerrymandering. When it comes to voters of color, theres overlap considering the vast majority of americans are democratic voters. Theyre packed in these particular districts which leaves all these other districts spread out where republicans have a distinct advantage. And whats so important about this question about citizenship is we already know that communities of color do not like interacting with the state on a particular level in these institutional mechanisms. Immigrant communities also dont like interacting with the state and these questions coming into your home. There are so many families that are mixed status households where you may be documented but your sister or your spouse may not be. Those people are less likely to fill out the census. What we saw the last time we took the census, was queens reported they lost you know, members of the borough which we know for a fact is not true. We also know queens is one of the most diverse and ethnically immigrant diverse boroughs in the country. Now youve got the question, right . Theres use of these different ways the rules actually work like the census map, the gerry mander. Theres a development that is worrisome which is even when those are challenged, this sort of desire to nullify by republican legislators. In pennsylvania, the highest court says this is unconstitutionally gerrymandered district. Youve got to refile new districts and the republicans Start Talking about impeaching the members of the state Supreme Court. I mean, the fight for democracy is never over it seems. You have pennsylvania where theyre trying to impeach the Supreme Court justices that struck down republican jerry mandering. The most extreme example is in wisconsin where scott walker just flat is refusing to hold special elections for vacant legislative seats since december, a federal court said you have to hold these elections and the wisconsin constitution is clear on this. Immediately after the court orders him to hold special elections, scott walker and the Legislature Say were going to hold a special session to change the law on special elections so we dont have to hold elections. And this is such a disturbing trend where basically if republicans think theyll lose an election, they cancel the election. If they lose a court order, they decide theyll nullify that order. This gets to shattering core basic norms of democracy. Christina, when you use the words nullify or think about massive resistance, there are Historical Echoes of no, were not going to bow down to what the courts tell us. Weve talked about this for well over a year where we talk about the separation of powers. We have courts in place to make sure that no branch overreaches. That even operates on the state level. We cannot have governors as the executive of their state working with the state legislature to overturn the rule of law. We see this time and time again especially as the Civil Rights Movement where each time we make surprised, there are different ways the institutional mechanisms of this country work hard to make sure there are particular communities that stay marginalized. With this particular political movement, the Republican Party is feeling like its losing numbers and theyre a party that is largely homogenous. They fear as other marginalized groups form coalitions together, theyre going to lose ground. Their Winning Strategy is to essentially change the rules in the middle of the game and consistently move the goal posts. I think michelle, they have come to view anything that stands in the way of that as illegitimate. Theres a genuine view that the institutions that would constrain that many arent legitimate. Right. I always go back to this one comment that trump made at the very beginning of his administration where he said the only thing that matters is the uniting of the people because those other people dont matter. So when they talk about the people, they mean a very specific slice of the american population. At some point its going to be a minority slice. But they really believe that they have a right to rule. So in as up as theyre able to substantive minority rule, i think were aheading it towards a real crisis of democracy. Were already starting it. Thank you all for being here. The same place reagan took the money to invade grenada. The same place he took the money to bomb syria. He has money to spend on National Defense and this is a much bigger problem of National Defense. All of this can be done under his powers as commander in chief if he cared.
