The federal judge ruled late yesterday that trumps former Chief Of Staff Mark Meadows Cannot move his Georgia Election interference case to Federal Court. Meadows argued the charges against him were but u. S. District judge steve jones didnt buy it. Writing in the ruling, his efforts fall short. Lets bring us in on capitol hill. And katie feng, msnbc legal contributor and host of the katie phang show. She was a former Florida State prosecutor into counties with an extensive felony trial experience. That makes her a good one to ask these questions to. I will go fast meadows has already appealed, and help us break down the judges decision. Look, just or judge steve jones did exactly that. In hours of testimony, meadows trying to plead his case to have him move out of Fulton County, where he likely thinks a more friendly jury pulled that of the mostly democratic jurors in Fulton County. He failed to prove that the work that he was allegedly doing, that words that he was indicted, im trying to pressure State Officials to overturn the Election Results in favor of the former president , including a call that he was on with Brad Raffensperger, the top election official in that state with his former boss. And he failed to prove that he did that, and according to his Job Description as a white house Chief Of Staff. He did admit, according to the judge, plenty of times that he did this work as a Campaign Official instead for the former President Trumps 2020 campaign. Of course, that is subject to some violations. Its some of the things that the state prosecutors had pointed out. This is not boding well for meadows, and of course noted that he we did expect him to do so. He had also asked that he hauled all proceedings while this plays out. Remember, there are others that are also considering to make this move, at least five of the mitt of so far asked to move to Federal Court, including the former president that was weighing that option. He will make that decision at the end of the month. Overall, its a setback for those seeking to do that. Based on what julie just reported, was meadows attempt to even try to move to Federal Court wise . Could it change the calculus of the others, including donald trump that could do the same thing . Alex, your last question first. It should serve as a deterrent for people like donald trump that have not attempted to remove yet, even though that federal official has to find out under the law. The ruling of judge jones, releasing a 49page opinion, its very explicitly noting that any of the comments of mark meadows, has a really good for the defense, all of those defendants. Judge jones, making it clear that any action picking up outside of the realm of your capacity is a federal official, if it veers too far outside of the that in itself will probe prohibit you from getting into Federal Court. Donald trump i know has acknowledged, as julie has said, that he was contemplating maybe removing the Federal Court. If i am Donald Trumps attorneys, you have to think about the time. Any deviation should he be crazy enough during his criminal case, just a criminal trial, would be nuts. Fani willis would have a lot of that material to work with and impeach mark meadows. I tweeted last night about this trump issue, alex, if you were to be tried to remove, he himself would have to go through an evidentiary hearing process. He would have to testify. I think its just too wild. Its just too unpredictable to put donald trump on the stand. I dont think you would be wise for him to do . It is a bombshell when Fulton Countys Grand Jury Court was unsealed yesterday. It revealed that the jury recommended an additional 21 people we charge in this Georgia Election interference case. They didnt make this cut. Senator lindsey graham, former republican senator kelly roffler, david perdue, they were on the list. They were not indicted by disputed tierney fani willis, nor was mike flynn. The top and boris epshteyn. Many familiar names there. Why were they not indict it . What separates them from the ones that they were . Why they were not indictment, will probably never get an answer at this point. Now is that Second Grand Jury at Fulton County that was seated to make a determination on whether a true bill would be tanya, it does not necessarily mean that fani willis will pursue charges. Remember, that Special Grand Jury, the one in the report released yesterday, isnt entirely different body doing an investigative effort. Taking in evidence, listening to witnesses, making recommendations only. The special grand jurors, not lawyers, no legal training, no legal background, just considering the evidence that is putting put in front of them. Making that recommendation to have this georgia statutes that apply. I would, you know, tell people, look out. Your record looking right now at your screen, at these recommended for indictment but did not get charged folks. Youll probably see them as witnesses called by d a fani willis, charging them early as they kind of chesbrough in sydney powell trial, which is due to set off in october 23rd. Up to get through that hurdle, jury selections, the state approving the element of exclusion, and without reasonable doubt, guilt 150 witnesses in this case, and you will see people like lindsey graham, et cetera, probably calling to testify [inaudible] yeah. But clearly they are thinking something is rotten ended, mark something is wrong with what these people were doing. But you mentioned lindsey graham, usually, how is the senator responding to this news that the grand jury recommended charging him . We follow that, katie, when you talk about the Political Landscape of this, senator graham is saying now what he said back in November Of 2020 when we asked him about these calls that he made two State Officials including Brad Raffensperger who is on the record saying that the senator told him to essentially find different votes, he denies ever doing that. Yesterday he talked to reporters, after this report came public that he was one of those 39th of the Special Grand Jury wanted d. A. Fani willingness to charge. Obviously he wasnt. Heres what he said. Watch. I called around different states including georgia. As a sitting United States senator, chairman judiciary committee. I eventually certified the election and all states, including georgia. I did not find any evidence of mass voter fraud, but i did have concerns about the mailin ballots. We cannot criminalize senators doing their job when they have a constitutional requirement to fulfill. We are opening up pandoras box here. I should, note while the other two senators, the georgia senators, kelly and david perdue, they are no longer in congress. Here is the thing, graham back when he made those phone calls, those conversations, he was the chairman of the Senate Judiciary committee. Certainly serving in a top role, top capacity, a really Important Committee here in the senate. Certainly he is defending his actions. Hes defended trump, hes one of his biggest allies here on capitol hill. I dont know if hes going to get called to testify, as katie said, if he, does will he actually show up . Theres been some back and forth discussions already in the last couple of years with the georgia District Attorney trying to get him to show up and testify and say what he knows. A group of voters in colorado sue to keep the former president off that states ballot under Section Three of the 14th Amendment. Which states, no person shall hold elected office who engaged in insurrection or rebellion. Now, while colorado may be the first day to actually challenge trumps eligibility, it is not expected to be the last. Trump responded to those efforts. What they are doing it its called election interference. And all these lawsuits get in the way. Now, the 14th Amendment is just a continuation of that. Its nonsense. Nobodys even said its insurrection, and by the, way there was no guns in the capital. You know, the insurrection is frankly the people that interacted on the election and rigged the election. I will start with. You what do you make of Donald Trumps definition of insurrection . Can you play the part about the no guns in the capitol . How big a threat are these efforts against him . I think first of all, hes, wrong the facts, we know from the january six committees investigation that there are lots of people in the capitol who were armed that day. Not only with bats and pipes, but with guns, as the Secret Service said on its radio transmission. That is actually incorrect. But the 14th Amendment is interesting because it is separate and apart from criminal cases that he has mixed up in. Which is notable because he has not been charged with inciting insurrection. But there is this provision in the 14th Amendment that says that if you give aid or comfort to insurrectionists, that can be disinhibition to disqualify you from the ballot. It will be interesting to see whether or not that will be upheld if he has not been criminally charged. I wonder if the word reptilian as well is something that would have a bit of a lower bar to prove and insurrection, but i know, katie, earlier today you spoke with the chief counsel of the group that filed the lawsuit in colorado. How confident are they in their case . Yeah, so that organization, crew, actually has won in court in the state of new mexico. It was a commissioner who was involved in promoting and assisting the january 6th insurrection, that commissioner off the ballot, not being able to serve, not being able to hold office, anymore and the crew has kept this in a court of law and has been unsuccessful. Check new mexico off. We know that jim griswold, the secretary of state in colorado, has already been in touch with other secretaries of state in other locations in the United States and she reasonably anticipates, as to other secretaries of state, these types of cases can be brought not only by crew but other plaintiffs. I want to note, in colorado, these six plaintiffs, four of them are republican. Two of them are unaffiliated voters. So this challenge that is being brought to trump candidacy and his ability to even appear on the ballot in 2024 is a bar partisan one. It is one that has no party affiliation. It is the idea that if you consider the language of Section Three of the 14th Amendment, if for the opportunity to the plaintiffs to sue the secretaries of state, to present donald trump from actually making it to the ballot. So to hugos point, there is power in a case thats not criminal. Dont sleep on the civil cases. Those are the cases that actually can create serious obstacles to someone like donald trump. Another critical example, eugene carroll, shes had her civil litigation she brought against donald trump, so sometimes they can actually have a profound impact on somebody like donald trump. Is there a sense, hugo, that there is a point where all of these indictments pile up to where donald trump does consider Cutting Deals. Even ones that are based on him not running for office . We will make a deal with you if you say you are not going to run for office again . Yeah, i dont see either of those scenarios, at least for the moment. Trump is running on this idea that hes innocent and he needs to appear at defiant to his supporters. The moment you deal with prosecutors, you have to plead guilty. I think the optics of that is going to be insurmountable for him running into the election. So i dont see that happening. As for this discussion about if he agrees not to run for president , when will they drop charges, i dont see any way in which the Department Of Justice on Merrick Garland takes that approach. The whole point of these cases, as youre following the facts in the law, and according to that, trump violated three federal statutes with the federal january 6th case, for instance, and the maralago classified documents case, he clearly violated National Security statues by retaining National Defense information. The moment you start inserting politics into it it becomes political, and that is one thing that this Department Of Justice has tried to avoid from the very start. Point well taken there, katie, you touched on this an alaskan first nations, lets take a listen to what donald trump said about taking the stand if his cases go to trial. Here it is. So, if you have to go to trial, will you testify in your own defense . Oh yes, absolutely. Absolutely. You will take the stand . That i look forward to. Do you believe he would do that . And, for the Defense Attorney for donald trump, how terrifying is that prospect . We yeah, there is no way hes going to take the stand in his own defense. With the potential exposure that he would have, it would just be too profound. Not only is there an overlap, alex, in terms of the types of cases being prosecuted, consider, this fani willis and Fulton County case is pursuing his efforts to overturn the Election Results in the state of georgia, but that does not necessarily mean that it precludes special counsel, jack, Smith Trumping able to utilize evidence from that case in his own prosecution. So i think there is no way that any criminal Defense Attorney would never let somebody like donald trump take the stand, and any criminal setting, which speaks to the idea of trumps attempt to remove move to Federal Court to an evidentiary hearing and how that would be a harm in terms of him testifying, have him try to remove the Federal Court. Hugo, as we take a look at the federal documents case, there is a new court filing which shows that the i. T. Manager at maralago is now a government witness, after being offered immunity from the special counsel. Here is how Chris Christie thinks trump might be reacting to that news. Here is that. That news this man will be vilified, attacked, savaged by donald trump publicly. He likes to be one away from the people hes trying to, get in this, case objects justice. I dont think that part hold. But i think it is true that as the case progresses, trumps i will be focused on people who testify against him at trial. His lawyers right now, theyre looking through with the classified and non classified discoveries that the prosecutors have turned over to. Them at this, point they should know who in trumps orbit, inner circle or otherwise, have provided incriminating testimony against him. It is a string of Wrecking Ball sized buoys. It separates by serrated saw plates with an underwater mesh. Its all in an effort to try to stop migrants from mexico. The rio grande, as you, know is already extremely dangerous. Hundreds die trying to cross that river. Who is going to prevail in this battle over them . Is it texas over the Biden Administration . How do you pick . This and by the way . Is this barrier merely a visual symbol where do you think it is designed to not only prevent crossings but to cause physical harm . Like look how we describe it . Yeah, alex, look, this is a contraption that i think accurately has been called a death trap. There are people who have died because of. It people have been maimed because of. It Governor Abbott and his administration are aware of these, injuries these deaths, they refused to move it out of the middle of the river. And so this case is an important one because it is actually harming people. The Abbott Administration says look, it is about deterring people crossing, people are still crying to across the border. Still trying to cross the river. Theyve been harmed, theyve been hurt because of this barrier. It is barbaric. A lot of people have called it out because of that. Traditionally, courts have given a lot of deference to the federal government when it comes to Border Security and enforcement. That is an american legal jurisprudence. The usual course of affairs. It was not a surprise when the Federal District court in texas said to abbott, you have to remove these buoys and the most you can do is put them on the texas side of the land. Texas side of the border. The defense circuit, which is one of the most extremely conservative appeals to circuits in Federal Courts said, hold on, you dont need to do that until we hear the merits of this case. So it is unclear what is going to happen here, if this circuit is conservative, like, i said however, traditionally, a lot of the deference has been given to the federal government when it comes to the waterway this along the border and Border Security. Here is a question. The rio grande, correct me if im wrong, but is that International Waters . Is it belonging to both mexico and the United States . Does that somehow play into all of this . Might this rise to the level of a case that goes to the Supreme Court . With the Supreme Court pay that same level of conservative deference . It absolutely, is this is an international waterway. There are treaties that make this this is the subject. Of the waterway is a subject of. In fact, it is very telling that abbotts administration actually did move the buoys slightly from where they originally put, it because they were afraid that it actually was encroaching on the mexican side of the waterway. They have shown already but they understand that this is not fully a texas or even United States issue. It involves mexico. The courts have acknowledged that as well. The federal government, the u. S. Federal, government is claiming that yes, this is the international waterway. In addition to being important for the work of u. S. Border patrol, so there is a lot more play here than just a fight between texas and the United States. This also involves mexico. Mexico has indicated their displeasure with Governor Abbott. And has lauded the federal government, the Biden Administration, for going to court on this. Overall, though, this says something about who we are as a country. To be what the symbol of our border to be this barbaric Razor Wire Buoy System . It has killed people and maimed people. I dont think that we do. In fact, time after time, even watchdogs within the federal government have said that these types of mechanisms are outdated, they are not the best way to keep people out, if that is what youre trying to do. There are better ways to achieve Border Security that involve cameras and other types of sensors and technology. I think that our time and effort would be better spent on that and on personnel, down on the, border than on this kind of thing. Except those of us who are political junkies. It is very early. This is 12 point 3 million. This was more than what was spent in the last two cycles as super pacs have gotten their legs under them. This is also different because its not negative. A lot of the super pacs do negative ads. They try to take down the opponent. This is about boosting biden, trying to bring up his positives, specifically on the economy. It is amazing, for, instance in the Wall Street Journal Poll that came out a week ago, when people were asked, okay, who has more accomplishments . 51 to 40 , people said donald trump. Now, think about that, think about how many accomplishments the Biden Administration can be rightfully proud of and have helped folks in this country and boost of the economy.
