We are learning much more about exactly how that dramati moment will take place the former president wil arrive in new york city monday evening, and on tuesday, the will be driven from trump towe to the courthouse around 1 p eastern time as of now, there are no plans to handcuff him, and n plans to place him in a holdin cell but there will b fingerprinted. Trump will then leave new york that same night, and head back to florida. So, katie, this i incredible what we are about to see and we have never seen anythin like this in all of ou history. A former president of Th United States indicted by an manhattan grand jury and we use the adag unprecedented a lot, there has been a lot that has happened i the last few years for covid. But as you know, the chances o us sitting here having thi conversation, having to do thi coverage because in the history of Th United States, no current or former president of the United States has ever been criminall indicted i know weve flirted with it before, with Richard Nixon but the fact that we are actually doing this is actuall profound and its the reason that w have to emphasize Th Historical Implications of wha were doing right now. Starting on monday donald trump is supposed to be coming from florida up to ne york, before he goes down to Lower Manhattan on tuesday yes, of course, the sourc of this information is his counsel. So we know a few weeks ago h put on truth social that he wa going to be arrested tha tuesday, and a few days late that came and went but from all reports, we wer expected to have this sooner we, meaning the arraignment wa supposed to happen sooner. And trump said he was not read to do it so he is turning himself in on tuesday, what is that gonn look like . We are going to get into tha throughout the course of the next few hours this morning. It happens every day but transporting an indicted former president under Secre Service is absolutely differen nose lets go stepbystep to exactly what we are going to see over the next 72 hours this weekend, president trum is at maralago, perhaps he will go out golfing, well see if that happens then monday morning, or monda evening, we expect him to go from maralago, to upon Beach International airport, where hes gonna get on his trum landed plane and fly up to the airport. And from there we expect Him T Chopper over to manhattan. Hes gonna spend monday nigh at trump tower, his former residents. And tuesday when he wakes up hes going to head down to Lower Manhattan, to th courthouse, for processing hes not gonna be handcuffed not place in a holding cell. But hes gonna get processed a any other indicted person woul be at 2 15, as we expect, o tuesday. That is when the arraignment himself happens. He will sit in front of th judge, the judge will read him the charges against him, and they will go from there. He is then expected to leave the courthouse perhaps he will make a statement, perhaps he will not for a guy who loves the show and a reality show, it would not be as surprised to see him try to seek out some cameras a that point then hes gonna head back to laguardia, and back down her to maralago. Walk us through, because a lot of viewers need to know th actual nuts and bolts. Lets start with that. Walk us through what we should expect to occur during trumps arraignment on tuesday and what would most likely happen immediately thereafter . Good morning katie an jonathan what a dynamic duo good to be with you both i teach Criminal Justice a George Washington university and every semester we dedicate an entire class to the Arraignment Hearing. And mice students have heard m say 1000 dies. The Arraignment Hearing is eyeball to eyeball between the defendant and the judge. That is the moment where i becomes very real for most defendants a few things will happen, firs of all, donald trump will be arraigned on the charge. What will that mean . It means the indictment will formally be read to th defendant. So he is on notice of th charges that he has to defen against. Unless his Attorney Rule waves reading of the charges which ordinarily they do because nobody wants to si there for 20 minutes and hea the clerk of the court Read Th Entire indictment. Donald trumps attorney will then enter a plea of not guilt on his behalf. The next court date, The Statu Hearing will be set. And the topic will turn to wha to do with defendant trump because now the former president has earned tha title. What to do with defended trump pending trial. Extraordinarily unlikely tha they will discuss Th Possibility of pretria detention. That is jailing defending trum pending trial. But i do think that they wil have a robust discussion o what conditions of release the judge should set for donal trump, to assure that he wil reappear, and to assure th state the of the community and i think that we might hear about something called a gag order. Those judges are often loath to engage in what we call, prior restraint on speech by telling a defendant what he ca and cannot say what he can and cannot post. Only if the jurisdictio allows cameras in th courtroom. And i dont believe new york does i would actually hope that given the unbelievable publi interest and the worldwide interest, maybe they would consider revisiting the rules. And allowing these Court Proceedings to be broadcast. But, usually the courts will stick with whatever rules ar in place regardless of the Public Interest in a particula trial. So i have a feeling that there will be a lot of great reporters in the courtroom as people may know, they hav overflow of courtrooms where they will use Course Circuit Cameras to broadcast whats going on in the roo proper, to other, rooms to the media room so as many people as possibl can watch it but i dont suspect we are going to see it on tv. Talk to us about the Delegat Balancing Act that President Biden is attempting here he obviously doesnt want to comment, as you just heard but he has been vocal in the past about the dangers o donald trump, and maga extremists and the reporting i have is that he is very opinionate about this very topic. When he is speaking privately, but publicly its a differen matter because remember his ow Justice Department, the Bide Administration Justice Department still has two activ investigations that ar arguably even more serious and the one that trumps bee indicted for that are still opening they are under the handling of the Special Counsel, jac smith. So any idea that there would b any interference, or politically motivated, i extremely toxic for biden. And as you saw that clip there three times he was pressed the answer was no. And its gonna continue to b no in the coming days. And i think that the questio is, when does the true biden feeling pop through, and whe does he have to address it because he becomes a candidate for president . Right, and actually, i gonna ask you whats happening trump has been calling for his supporters to protest. How concerned is the white house about this in general, and about a reprise of january 6th in particular . They are very concerned about it again, this is not something that they have talked abou publicly but the National Security team is absolutely focused on this. And they are monitoring, for instance, there are alread planned demonstrations and protests in new york that Marjorie Taylor greene an other trump allies are attending. They are watching that closely the National Security counci has the entire team. Focus on domestic extremism, and domestic issues like that. And so they are watching him very closely and speaking of the campaign, as you mentioned, there is going to be a 2024 campaign. What President Biden makes his expected reelection into campaign mode. Yes, i think that is th question that he and his tea is going to have to answer how do they even talk abou this because this is not the messag that they want to send t voters the message that they want t spend is about the things that they are doing affirmatively and positively and broadcasting competence. Brendan, let me start with you the silence is deafening what you make of who we haven havent heard of yet well, Mitch Mcconnell despises donald trump. So i think we have to remember that but Mitch Mcconnell also understands politics as well a anybody. So he is not going to sway poison here. And almost every republica that you have heard has made these same argument, that this is a trumpedup scam its Election Interference there are various degrees of love and hatred for donald trump. But every one of them know that in todays Republican Party, you cant give pain and comfort to the other side. And that is more important tha anything so anything that isnt a criticism of this process will be seen as something of treaso and the party. So its very easy for them t do its also pretty good politics to go after this case, mor than some of the others that have been discussed a lot. This is probably the least strong case of all the thing that hes potentially going to be indicted on so it actually helps republicans to jump on thi when and set the narrative tha this is the one where they are just coming after him and its a little bit more political. But to brandons point, six months from now if there are more indictments which i think were gonna see from Fulto County Fani Willis and Special Counsel jack smith do you think that donald wil still be enjoying this type of support from his party well it does seem to me tha he has been able to very successfully play the victim and that will likely continue. Its hard to see republicans moving away from donald trump, i think the ones who are running for the nomination are hesitant to do that. Because they do not want t alienate Donald Trumps base Donald Trump Space is actually growing. And solidifying and so i think that holds them off. They only real, dissenting voice that i have heard came from arkansas governor asia hutchinson, who reall clearly stood on the face of rule of law. And the process, and not attacking the prosecutor but other than that, it is not just the silence is deafening. Its that it is full show of support for donald trump and i really dont see tha changing he has been very successful at being the victim, and playin the victim, and i see that playing out over the course of the next several months. So donna, let me stick with you here and talk about all of this fro the perspective of the democrats. And there are plenty o democrats who have praised the indictment do you think that that is wise move from them . I think for elected democrats, the smart move is t say nothing. And not to appear to b interfering in the, in the judicial and prosecutorial process. And to allow the case to speak for itself and i mean, you saw that fro President Biden. I think that he is demonstrating the Kind O Leadership that all electe democrats should demonstrate which is two just stay out o the way. And let the process play out we believe in the rule of law, and so let us allow the rule o law to proceed you know, i get the idea of there being some fatigue whe it comes to the idea that trum is a teflon don. Maybe it is a former prosecuto in may that bristles at that idea, because the gop is supposed to be the party of la and order. What does it say to you that the state of the maga world . And establishment of the gop that were not hearing mor outrage about the firs president of the United States being indicted i think you have to understand about the republica party, that we are very much beyond policy, principles, w are about fighting and that simple act of fightin is so much more important to most Republican Voters these days than anything else. Its almost no matter what you are fighting for and they love that donald trum is being a fighter right now i think that is a big point an why he is rising in the polls. Fighting culture wars, i doesnt matter what the figh is it also matters who our enemie are, and donald trump has lots of enemies floridas ron desantis has bee able to having the presumption that people dont like him so look, the liberal left is coming after me. Im fighting, and im fighting for you. Thats more important than everything so theyre gonna overlook fo staff, when they say that yo stand, up not back down. Its a pretty good stretch, at least politically for him. But he finds himself in seriou legal trouble that becomes s apparent that he becomes elected. I mean, im very worried for alvin bragg, for the judges wh are going to preside for the jurors in the courtroom. Because Marjorie Taylor greene among others, including donald trump are really, i mean you see this run up to january 6th very similar to the kind o language that we are hearing now, coming out of these, ou of these maga folks. And so, i am very worried, and it stirs people up and you never know who is on the Receiving End of the languag that you are using and the lac of care that these elected people have paid to that i really disturbing, and im gla its in new york, there will b lots of security, but it shoul be worrisome for all of us tha across the cuter, doing his jo is persecuted in this kind o way. To a degree look, i think that we have learned from january 6th we shouldve learn long before because people are out there listening. And not everybody understand that it may be something tha is just rhetorical and all this takes is a fe people doing something bad t lead to very bad outcomes. We have to understand that words matter, people hear them differently. We used to say, Take Donal Trump seriously. But literally, there are peopl who take him literally and when he says things like death and destruction. Bad things can happen. Charles, i have to ask you this is a sealed indictment, arraignment is on tuesday. What are the chances that an of us public including donald trump, woul be able to see what the privat charges are to tuesday i dont think the publi will have much access to this. Alvin bragg is going to procee with this case with every dotted, and every t crossed. And so any leads that we can expect to come from his office probably are not going to tell us much of anything. It is very possible that his attorneys may have heard a little bit about the indictment, before its unsealed but in terms of the public i the media i expect that we wil find out with everyone else. Once the indictment comes down and donald trump is arraigned. Charles, lets talk about fairness because i know some people o the other side that maybe are supportin donald trump are gonna be comparing about a lack of fairness this is by allowing him to see what in the indictment on tuesday that is correct, katie it important that viewers understand that right now we are talking about citize trump. We are not talking about the former president we are not talking about someone who held office as the 45th president of the United States of america. Donald trump is being treate like a normal citizen in the state of new york, and the county of manhattan. Where alvin bragg is the District Attorney and chief la enforcement officer. Because of, that he is not receiving any sort of specia provisions an Extra Specia Treatment given his previous status as president. This is what would normall happen, the indictment wouldv been sealed and filed by the da, and they ultimately unsealed a the point of arraignment where he will have a opportunity, along with th rest of the world. To learn what these charge actually are so trump is claiming that the Justice Department has Bee Weaponized and is politicall motivated. Putting aside the hypocrisy, because we all saw what the do was like under attorney genera barr we already said that are not recognized Legal Defenses but could Selective Prosecutio be an argument for donald trum as grounds to dismiss an indictment in the state of new york actually, they cant hear because alvin Braggs Office has a history of prosecuting people far falsified but keeping. They have 100 cases on record, where they have tried people for the same very thing that h is expected to be tried on or expected to be prosecuted o in this case so alvin bragg is sticking t the rulebook, in terms of ho he is going on prosecuting cases of this nature in the past, this is not a new charge this is not a first for this office this is something that i standard, and routine for them to go after. So in terms of Selective Prosecution. Its simply just is not here so i understand that the arguments from the other sid may be that this is somethin that alvin bragg is doing as a personal vendetta. But that could not be furthe from the truth and the proof is in the record because there are so man Different Cases that this da office has already prosecute in the same vein charles, trumps attorney joe tech pinot, says that he doesnt know the nature of the charges, none of us do at this point. Against donald trump, he doesnt know how many counts there are. But he says, if the number o counts are 34, it means theyv taken each transaction, each payment, each entry. And made a separate charge as a former prosecutor, we use to do that down in florida do you think that that is what we are going to see from Thi Unsealed Indictment come tuesday . Katie, i do think that gonna be part of the indictment and i do suspect that thats why the number of counts on Th Indictment is so high. However, i do expect that ther will be some Additiona Information given from the indictment thats Gonna Take Th misdemeanor to the felony. And thats where the meat of this indictment has. Its gonna actually come int play i absolutely do believe that each and every one of Thos Transactions to michael cohe is one of the counts of Th Indictment but theres gonna be more, onc i suspect this statement i revealed and thats gonna be the focu as everything comes out. As we know, earlier in this month of march now we are in april. Earlier in, Munch Trump Wa invited to testify before th ground jury. We know that he was invited, instead, he sent Rober Costello for the defense get the fact that donald trump failed to take up that offer t testify. Ever be used against them in the prosecution . No katie, as you and i both know, the defendant has a righ to silence and the fifth amendment righ to basically not sel incriminate. And i think its important t understand, for all the viewer out there. Donald trump has said this i trump is entitled to a fai trial. In front of a jury of hi peers. And he has every constitutiona rights and protection that any of us would have if we were in the same situation accordingly das would not b able to use the fact that he did not choose to testif against them that would absolutely be grounds for a mistrial or grounds for an appeal so i expect that alvin bragg and his assistance would say very far away from that. In fact its very wellknown from the public that they will draw whatever inferences despite whatever instruction they are given from the judge. But its not something that we would see prosecutors judge. Because we know that he has th right to protect himself against Self Incrimination you know charles. Donald trump, one of his strategies, is to launch the a hominem attacks against whoeve he wants to put in the cross hairs. We already know that he is going after the judge in thi case who has been assigned to his case this is judge marchand who was ruling and presiding over th trump organizations crimina trial last year. What kind of impact to those a ad hominem attacks against someone like the church, in hi own, case have on trump political prosecution . So in your opinion, does tha kind of, i guess, Background O Lead up to this particular indictment lent some credibility to what the alvi bragg is doing with donald trump . The Manhattan Distric attorney is treating donal trump the same way that he would treat any other similarl situated if and then, which is to say that in white colla cases, cases that do not involve cases of violence. Defendants are often permitted to do what prosecutors do to turn in. To surrender in order to b booked, and to be a range. Donald trump will enter a plat of guilty in court presumably a plea of not guilty like anyone else who is nearly indicted and he will be treated by th office and courts islam like any other defended without corsi exception of any other defendant. But we could see thi indictment along with severa others in the state and federa level, so the fact that what appears to be the leas important of the many case under investigation. It just is a footnote that thi one happened to go first joyce, let me ask you something that has occurred to me, because we are also focuse on this grand jury indictment. But is there a chance that a judge my dismiss this before i even gets to trial its tough to talk about Th Indictment before we have seen it its still under seal, we thin that we have some sense of wha is going on here but we will have to wait until the indictment itself is unsealed on tuesday. Take a look at the charges andrew talks a lot in case like this about whether ther is about whether the charges Ar Questionable in any sense. Are there possible, factua insufficiencys. Are there wide open lega questions that might make thes charges difficult to prove at the point where we ca actually take a look at them, think we will be in a position to assess. But i would point out, what think jonathan, it is importan to note that alvin bragg, this is not his first rodeo he is an experienced prosecutor with both the state and federa expertise. Yeah, its not clear ho much is going to impact trump focus, or at least his legal teams focus their principal priority actually is still dealing with the federal investigations concerning january six and the documents investigation. Most on the criminal Defense Attorneys are representing trump on the documents case an the january 6th case you know, all the manhattan da stuff is going on, they ar still, for the chief judge i d. C. And proceedings, trying t head off, potentially more dangerous and perilous legal action there i dont think we should se these as mutually exclusive. When you are fighting lega battles on multiple fronts, th only thing that changes th amount of time and energy an focus you are going to devot to each case i think his lawyers, hugo also change, depending on whic cases and investigations are coming on. Tea, when you and i last spoke we were talking about the word imminent and how imminent thos indictments were from Fulton County da, fani willis do we have any updates, to, ye in terms of what we might se in terms of those indictments . The honest answer is no, we dont have many updates. Fani willis has made it clea that she is taking her time an she does have the report fro the special grand jury she is now determining which charges to bring to the regula grand jury she said a minute, but she later clarified, that is attorney imminent, not reporte imminent were thinking sometimes, this but she has really kept a lo profile recently, and basicall said when im ready to discuss what charges, if any, im goin to bring against the forme president or any of his allies all let you know then. You know, hugo, theres bee a lot of major developments on the maralago documents case, including recent decisions and rulings by federal judges that would force somebody like evan corcoran, one of trumps councils, to have to appear in front of Special Counsel jacksons grand jury, to tal about, usually, Privileged Communications that he had wit donald trump, includin documents and transcriptions o conversations. Do you think what just happene right now, with the alvin brag indictment, is actually goin to speed up jack smith its own timeline its not clear, right we dont know if jack smit its conducting hi investigation, especially with a document case, with an eye o that das case you know, you would assume tha the Justice Department is doin its own investigation at its own pace that being said, constitutio are not robots they are humans. When you get momentum in one jurisdiction, on one cas against the same defended, i think you have to assume tha prosecutors in a different jurisdiction are keeping an ey on that. They may think, you know, if w have to move forward with an indictment, then it will be conducive time to be doing so. Are already under a lot of heat, at least in this case, in ne york to your, also in terms of that in Fulton County and the special grand jury repor that was issued. You just mentioned a minute ag that fani willis has tha special grand jury report. The reality is, its a difference grand jury that i going to reconvene, if not already, to listen to th presentation by fani willis in terms of the pursuit of an type of indictments. What is the kind of energy i atlanta and in georgia right now, in terms of this Da Alvin Bragg indictment coming out, and do you feel like theres been an uptick in the energy towards pushing towards an indictment in georgia . Well, i think the news ou of new york definitely brought just a renewed wave of energ on the Fulton County case. And as you can predict, th reaction in atlanta kind o broke down, depending on wha you think about Presiden Trump. So, you didnt have a lot of republicans and trum supporters, and im talkin about voters, who, you know, said they were disappointed an wanted to defend forme President Trump, but we also know Metro Atlantas pretty, its a pretty progressive, democratic leaning area. So, a lot of people are saying you know, bring it on. There is a lot of anticipation on either side regarding wha the Fulton County District Attorney is going to do. A lot of people do expec charges, but the questio really is, do we expect thos charges to go all the way to the former president and we just dont know until she is ready to make tha decision hugo, very quickly, i hav less than a minute left. I do want to ask, i kind o said glibly, and i laughed, bu the reality is, donald trump does have several lawyers. Do you think there is liability that created with th fact that there isnt on centralized kind of spear in terms of a Legal Defense tha are being coordinated fo donald trump no matter how much he thinks h is teflon john, theres myriad of investigations tha he is being confronted wit right now. I think thats absolutely right. Look, theres multiple lawyers looking at multiple cases, wit all competing interests. Some of them have differen agendas. Some of them want differen outcomes its not always clear that all that lawyers are going towards the same goal. Take the documents case, for instance evan corcoran, the trump lawye who was forced to give additional testimony to th grand jury in washington, an turn over his notes, i mean, h is now a fact witness in tha investigation. To think that his interests ar steadfastly aligned with those of trump that just doesnt compute. You have a lawyer who is a against his potential client down the line.
